Native Americans och First Nations : En jämförande studie gällande lagar i USA och Kanada / Native Americans and First Nations. : A comparative study regarding laws in the United States and Canada

Denna undersökning kommer undersöka ursprungsbefolkningen i Kanada och i USA, First Nations (Kanada) respektive Native Americans (USA). Fokuset ligger på olika lagar i respektive land som behandlat och behandlar dessa ursprungsbefolkningar. Ursprungsbefolkningar har diskriminerats genom historien och diskrimineras även idag vilketvi anser är värt att undersöka, då båda länderna idag är ledande inom arbetet kring mänskliga rättigheter. När lagar trätt i kraft har motiveringen varit att det ska gynna och skyddaursprungsbefolkningar, frågan är om det historisk verkligen varit så? Teorierna som valts är andrafiering, samt assimilation i jämförelse med kulturell pluralism och metoden är en innehållsanalys samt en komparativ metod. I denna undersökningen kommer en jämförelse aven lag från Kanada; the indian act, och lagar från USA; the general allotment act, the indian reorganization act och the indian civil rights act. Syftet är att jämföra hur ursprungsbefolkningarnas rättigheter har behandlats genom de nämnda lagarna ovan. Materialet är insamlat från regeringens egna webbsidor i både Kanada och USA och består av de juridiska dokument där lagarna beskrivs. I undersökningens analys framkommer det att det finns både skillnader och likheter i ländernas hantering, att lagarna har bidragit till andrafiering, samt att målet med lagarna har utvecklats från enbart assimilation som mål till mer kulturell pluralism. / This research will look into the indigenous peoples in Canada and The United States of America, First Nations (Canada) and Native Americans (United States). The focus is on different acts in both countries that deal with indigenous peoples rights. Indigenous people have been and still are being discriminated, which is something we believe is worthy of investigation, since both of these nations today are among the leading countries on the actions for human rights. When acts are ratified the motivation behind them is to benefit and protect those indiginous people, the question is, is it historically true? The theories chosen for this research are othering and assimilation in comparison with cultural pluralism and the methods are a content analysis and a comparative method. There will be a comparison between an act in Canada; the indian act, and acts from The United States; the general allotment act, the indian reorganization act and the indian civil rights act. The purpose is to compare the rights of indigenous peoples through the acts mentioned above. The material is collected from the states´ websites and are legal documents where the acts are described. The analysis shows that there are both similarities and differences in both nations policies towards the indigenous peoples, the acts have contributed to a rise in othering towards the natives, and how the main goal with the acts have shifted from assimilation towards cultural pluralism.

The submitted dissertation's main object is an in-depth study of the portals created by the lodge of Benedikt Ried at Prague Castle and a group of portals that reflected the lodge's stimuli in Bohemian towns in the first half of the 16th century. The first all'antica portals in Moravia and Italianate works in Prague towns were also researched with the aim to analyse and better understand the contact of local "Gothic" tradition and incoming Italianate forms ca. 1500 in the area of interest on a wider theoretical background. The thesis consists of two parts. First, the key theoretical concepts of how to interpret the contact of the "Gothic" with the "Renaissance" relevant to the object of empirical study are introduced. As recent theoretical thought showed, the tendency to revise the interpretation of formal syncretism and pluralism in European architecture ca. 1500 stemmed, among others, from the need to correct several patterns common in former research methods, i.e. the presumption of stylistic unity, the effort to identify one principle through the "classical stylistic phase" supposed to be common to all artworks of a given time period, and the simultaneous use of the term "Renaissance" for both a set of stylistic features and a historical era connected with the idea of progress. White Novice Teachers' Perceptions Regarding Their Preparation for Teaching Culturally Diverse Students

At a Midwestern university, White novice teachers struggled to be prepared to implement culturally responsive pedagogy. The purpose of this qualitative study was to explore White novice teachers' perceptions about how their higher education classroom experiences had equipped them for teaching a culturally diverse population of students. The theoretical/conceptual frameworks of this study were White identity development theory, a multicultural education framework, culturally relevant pedagogy, and the motivational framework for culturally responsive teaching. Data were collected by interviewing 8 White novice teachers to convey their perceptions of teaching culturally diverse classrooms and how these perceptions influenced their behaviors. Data were organized by organizational, substantive, and theoretical categories. The themes that emerged from the data were the need for additional cultural knowledge, the implementation of supportive measures, barriers to supporting cultural diversity in classrooms, and the importance of cultural interpersonal skills. This study may lead to positive social change for teacher educators, novice teachers, as well as school districts by developing their understanding of how to support White novice teachers with strategies for teaching culturally diverse students.

A comparative case study of newspaper coverage of the Umatilla Chemical Weapons Depot/Incinerator from 1994 to 1998.

The purpose of this case study was to compare the news coverage of The Umatilla chemical weapons by examining newspapers from different communities: The Oregonian and The Hermiston Herald. The author examines solution frames, pluralistic frames, episodic frames, and thematic frames and compares them across two newspapers. The study found the difference was not significant when comparing the use of solution frames between The Hermiston Herald and The Oregonian. In addition, there was not a significant difference in use of pluralistic framing by The Hermiston Herald and The Oregonian. However, there was a significant difference in the sources presented in the newspaper articles. There was also a significant presence of episodic frames compared to thematic frames in both the newspapers under examination.

The Cultural Barriers to Integration of Second Generation Muslims in Northern Italy

In this study, I examine the existing literature and carry out a qualitative exploration in order to formulate a better understanding of the dynamics that influence the lives of 2nd generation Italian Muslims. Although monumental social and political challenges remain in confronting integration of the Muslim population and for achieving greater acceptance of Islam within the Italian public sphere, the evidence suggests that the process for integration has slowly begun. Additionally, this study examines the intellectual framework of the existing literature which addresses the issues impacting Muslim integration in Northern Italy. This issue has induced new debates within Italy on multiculturalism, national identity, human rights, while more importantly raising the question--"to what extent do we allow Muslim integration into Italian society and the further insertion of Islam into Italy's spiritual geography?" This study argues that the convergence of contemporary international affairs with religion calls for a new lens for interaction. In Italy the events following 9/11, combined with a resurgence of Islamophobia and the impact of the Global War on Terror, have drawn the issue of Muslim immigrants into a negative spotlight. Mainstream attitudes in Europe, following 9/11, have generated a rift in Muslim-West relations and have caused confusion and anxiety among Muslims and non-Muslims alike. The research hypothesis for this thesis suggests that there are multiple factors impeding the efforts for Muslims to achieve equal footing within the Italian religious landscape and inclusion within Italian society. Among these are divisions found within the Muslim community itself, a growing mistrust of Islam in mainstream Italian society, sponsored by negative media stereotyping and xenophobic political movements, and underlying everything else, the privileged position of the Catholic Church and its unwillingness to accommodate Islamic identity within the social framework. The chosen methodology employed in this study is qualitative, theoretical contextual analysis combined with interviews plus questionnaires used to construct a case study were applied. Beyond engaging in seven interviews with the 2nd generation Italian Muslims, this study was informed by the relevant academic literature from the fields of conflict resolution, history, sociology, cultural studies, Islamic studies and political science. Finally this study contextualized the dynamics generating this conflict and examined the discontinuities this situation has created in the lives of Muslims in Italy. The exclusion of the Muslim population, coupled with the complex relationship between this cultural group and state, has led to the exploration within Italy of different models for integration. The findings of this study indicate that inequalities exist for the Muslim population of Northern Italy in their relation with the host nation and society. This further hampers the process of integration and generates further exclusion. Only profound rethinking of the Italian approach to integration will serve to adequately meet the needs of this marginalized population and fully incorporate them within Italian society.

Entre locals et incomers : « Where is the community? » : appropriation collective d’une île écossaise et conflit social

En Écosse (Royaume-Uni), la majeure partie du territoire est détenue par une minorité de grands propriétaires terriens. Au début des années 1990, certaines communautés rurales des Highlands et des îles de l’Ouest créèrent les Community Land Trust (CLT) et développèrent ainsi de nouvelles formes de gouvernance locale, fondées sur une démocratie directe. Ces petites révolutions régionales aboutirent à la consolidation d’une réforme territoriale nationale, au début des années 2000. À première vue, ce bouleversement juridique contemporain semble favoriser une compétition entre deux groupes aux intérêts divergents : les propriétaires terriens et les crofters (paysans locataires de leur parcelle). L’objectif de ce mémoire consiste à relativiser cette perspective binaire du conflit social. La recherche ethnographique que j’ai menée sur l’île de Great Bernera s’intéressait aux querelles intracommunautaires dans ce nouveau contexte politico-juridique. Mon analyse se concentre sur les divergences entre ce modèle de gouvernance démocratique fondé sur les principes de l’État de droit et l’ancien système normatif local fondé sur des critères identitaires et culturels. Pour illustrer cette problématique, des témoignages sont retranscrits, notamment ceux d’un groupe de résidents qui se considèrent comme des locaux (locals), et pour qui les critères culturels et généalogiques agissent comme principes fondateurs d’une communauté. Cette vision entre en contradiction avec le point de vue des nouveaux arrivants (incomers) qui, par l’aboutissement du projet d’appropriation collective de l’île, espèrent la concrétisation d’une communauté politique. / The Scottish land tenure system is one of the most unequal in Europe. Most of the territory is owned by a minority of landowners. In the early 1990s, some rural communities in the Highlands and Islands created the first Community Land Trusts (CLT) and thus developed new forms of local governance based on direct democracy. These small local revolutions culminated in the consolidation of a national land reform in the early 2000s. At first glance, this contemporary legal upheaval fosters competition between two interest groups : landowners and crofters (Scottish peasants). The objective of this dissertation is to put this binary vision of social conflict into perspective. My ethnographic research carried out on the island of Great Bernera in the Outer Hebrides was focused on intra-community conflict in this new political and legal context. My analysis concentrate on the contradictions of a model of democratic governance based on the principle of the Rule of Law with the constraints of the old local normative system characterized by relational, identity and cultural logics. I present the testimonies of a group of residents who consider themselves “locals” and who value cultural and genealogical criteria as founding principles of a community. This vision contradicts the point of view of foreigners (“incomers”) who, by the culmination of the project of collective appropriation of the island, hope for the realization of a political social community.

Le notariat existe depuis le tout début de la création de la province et il a traversé les différentes époques sociétales et sociales. Le notaire québécois contemporain possède des prérogatives professionnelles et une manière de pratiquer dont les caractéristiques semblent encore relever des origines de sa genèse, ce qui paraît peu adapté aux réalités de la société d’aujourd’hui. Cette étude nous amènera, dans un premier temps, à nous intéresser aux différentes dimensions du passé du notaire pour déterminer leurs liens avec le rôle qui est actuellement le sien. Par la suite, nous tenterons de préciser le concept de notaire « architecte de l’ordre social privé » développé par Roderick A. Macdonald et de définir le concept de « notaire clérical ». Ces deux concepts seront à la base de notre analyse du notaire québécois contemporain. / The notarial profession has existed since the beginning of the creation of the province of Québec and has survived different social eras. The modern notary in Quebec has professional prerogatives and a way of practising that still seem to have little in common with their origins in the foundations of the notary's profession. The latter seems to not be well adapted to the realities of modern society. This study will lead us, in the first instance, to examine the different dimensions of the past of the notarial profession to determine its links with its current role. We will then try to clarify the concept of the notary as "architect of the private social order" developed by Roderick A. Macdonald and to define the concept of "clerical notary". These two concepts will form the basis of our analysis of the contemporary Quebec notary.

Grönområden i urbana miljöer bidrar med många centrala funktioner vilka är livsviktiga för både djur och människor, exempelvis biologisk mångfald, ekosystemtjänster och positiva hälsoeffekter. Förekomsten av grönområden och dess funktioner hotas däremot av den snabba globala urbaniseringen som ger upphov till förändrad markanvändning. Enligt Göteborgs Stads lokala miljömål ämnar staden att bli ekologiskt hållbar till år 2030 och detta ska uppnås genom en ökad biologisk mångfald och bevarande av grönområden. Göteborg har blivit utnämnd till Sveriges grönaste stad, men samtidigt har grönområdena minskat mellan åren 1986-2019 och fortsätter att minska på grund av exploatering. Syftet med examensarbetet var därmed att öka kunskapen om vad som ger upphov till att det tas beslut som orsakar reducering av urbana grönområden trots uppsatta mål för bevarande av dessa, vilket var ett eftersatt forskningsområde. För att uppnå syftet användes en induktiv kvalitativ metod med semistrukturerade intervjuer. Resultatet analyserades genom miljöpsykologiska, miljöetiska och policyteorier, nämligen värden, goal-framing theory, värdepluralism och lömska problem. Studien kom fram till att Göteborgs stadsplanering innefattade flera lömska problem och värdekonflikter vilka uttrycktes genom målkonflikter, som tillsammans med starka hedonistiska och egoistiska värden samt vinstdrivande mål hade en negativ inverkan på förekomsten av Göteborgs grönområden. / Green spaces in urban areas contribute with many key functions that are vital for both animals and humans, such as biodiversity, ecosystem services and positive health effects. However, the existence of green spaces and their functions are threatened by the rapid global urbanization that is causing land use changes. According to the City of Gothenburg’s local environmental goals, the city aims to become ecologically sustainable by the year of 2030 through increased biodiversity and nature conservation. Gothenburg has been named as Sweden's greenest city, although the green spaces in Gothenburg have decreased between the years 1986–2019 and will continue to decline due to exploitation. The purpose of this bachelor’s thesis was thus to increase knowledge about what stimulates decisions that cause a reduction of green spaces in Gothenburg despite set conservation goals, which was a neglected research area. To achieve the purpose, an inductive qualitative method was used with semi-structured interviews. The results were analyzed through theories of environmental psychology, environmental ethics and policy, namely values, goal-framing theory, value pluralism and wicked problems. The study concluded that Gothenburg's urban planning included several wicked problems and value conflicts that were expressed through goal conflicts, which negatively affected Gothenburg’s green spaces. Furthermore, strong hedonistic and egoistic values as well as gain goals, also had a negative impact on the existence of Gothenburg's green spaces.
