"Illegale und schädigende Internetinhalte": Pornografie und Grundrechte im Policy Framing der Europäischen Union

Der Beitrag beschäftigt sich mit einem der gewinnbringendsten Zweige der Internetbranche, der Mainstream- Internetpornografie und ihren Rahmenbedingungen im Kontext der Politik der Europäischen Union zu illegalen und schädigenden Internetinhalten. Basierend auf dem Framing-Ansatz wird der Politikprozess zum "Mehrjährigen Aktionsplan zur sichereren Nutzung des Internets" aus grundrechtlicher und feministischer Perspektive untersucht. Dabei wird das Policy Framing der beteiligten EU-AkteurInnen insbesondere hinsichtlich geschlechtersensibler Herangehensweisen und den ihnen zugrunde liegenden theoretischen Zugängen analysiert. Die dominanten Policy Frames der AkteurInnen werden aus unterschiedlichen Schwerpunkten in der Zielsetzung und Definition illegaler und schädigender Internetinhalte und deren grundrechtlichen Implikationen sowie der strategischen Positionierung der AkteurInnen zwischen "möglichen Grundrechtseingriffen" oder der "Betonung liberaler Abwehrrechte" abgeleitet.

Subjetividade e pornô online: uma análise institucional do discurso / Subjectivity and internet porn: an institutional analysis of discourse

O presente trabalho tem como objeto/corpus analisado a pornografia online, e tem como objetivo responder às questões: \"como é o gênero discursivo do pornô online?\" e \"onde se pode reconhecer a produção de subjetividade no dispositivo pornô online?\". As perguntas foram formuladas a partir do repertório conceitual minimalista da Análise Institucional do Discurso (AID), criada por Marlene Guirado; a AID é o método, a estratégia de pensamento que orienta o trabalho e o instrui acerca dos conceitos de discurso, gênero discursivo, instituição e subjetividade. Para realizar a pesquisa, procedemos em três etapas: (1) análise de sites; (2) análise de vídeos; e (3) análise de comentários de usuários. Cada etapa corresponde a um tipo de recorte para o material. No primeiro caso, decidimos seguir a estrutura de XVideos.com, cotejando-a pontualmente com as de oito outros sítios; no segundo, escolhemos um vídeo heterossexual \"profissional\" chamado Sex Instruction, podendo confrontá-lo com materiais de categorias diferentes (gay, amador etc.); na terceira etapa, observamos os comentários escritos anonimamente para os vídeos antes analisados, e para alguns outros. Como resultados, quanto ao gênero discursivo, vimos que o site define seu usuário como alguém que sabe aquilo por que se interessa, e procura ativa e responsavelmente o \"sexo explícito\"; essa posição de autonomia não se sustenta no interior do vídeo, onde prevalece o interesse da câmera e a imagem de um corpo muito peculiar, ali composto. Já quanto à questão do sujeito, pudemos ver que o site desenha um usuário que é assediado pelas imagens pornográficas, interpelado até mesmo como corpo sexual que pode ser comparado com aqueles do pornô; o sujeito é produzido como alguém que pode participar do pornô e de um apagamento que ele opera nas \"pessoas\", que acabam dissolvendo-se na atmosfera de êxtase incessante, na figura corporal pornográfica e até na linguagem utilizada no site. Conclui-se daí que o pornô online, embora prometa uma subserviência eficiente aos desejos de seu usuário, é uma instituição que absorve os consumidores em seu funcionamento, estabelecendo lugares discursivos, moldando subjetividades e instituindo concepções propriamente pornôs de corpo, de sexo e de comunidade / The present work has as analyzed subject/corpus the internet pornography, and aims to answer the following questions: \"how is the discursive genre of internet porn?\" And \"where can we recognize the production of subjectivity in the internet porn apparatus (dispositif)?\". The questions were formulated from the minimalist conceptual repertoire of the Institutional Analysis of Discourse (AID in Portuguese), created by Marlene Guirado. AID is the method, the strategy of thought that guides our work and instructs it in the concepts of discourse, discursive genre, institution and subjectivity. To carry out the research, we proceeded in three steps: (1) website analysis; (2) video analysis; and (3) users comments analysis. Each step corresponds to a type of cut for the material. In the first case, we decided to follow the structure of XVideos.com, and opportunely confronted it with that of eight other websites; in the second, we chose a \"professional\" heterosexual video called Sex Instruction, which could be compared to materials of different categories (gay, amateur, etc); and in the third step, we observed the comments written anonymously for the videos previously analyzed, as well as for some others. As a result, regarding the discursive genre, we perceived that the website defines its user as someone who knows what he is interested in, and actively and in a responsible way searches for \"explicit sex\"; this position of autonomy is not sustained within the video, for it is privileged the interest of the camera and the image of a very peculiar body which is composed there. As for the issue of the subjectivity, we could see that the website delineates a user who is constantly harassed by pornographic images, even called as a sexual body that can be compared to those of the porn. The subject is produced as someone who can take part in the porn and in a type of effacement that it operates on the \"individuals\", who end up being dissolved in the atmosphere of ceaseless ecstasy, in the pornographic body figure and even in the language used on the website. It follows that the internet porn, while promising efficient subservience to the desires of its users, is an institution that engages consumers in its functioning, by establishing discursive places, shaping subjectivities, and setting up properly pornographic conceptions of body, sex, and community

Conselho Nacional de Desenvolvimento Científico e Tecnológico / Este trabalho investiga o que chamamos crimes da literatura, no livro de Carlos Heitor Cony, Pilatos (1974), em perspectiva comparada com o livro de contos Secreções, excreções e desatinos (2001), de Rubem Fonseca. Cony, famoso autor e jornalista, com histórico de prisões políticas na época da ditadura, publicou Pilatos obra de linguagem considerada pornográfica ainda na vigência da censura. Rubem Fonseca, perseguido pelos censores desde Feliz ano novo (1975), devido às suas narrativas também consideradas contrárias à moral e aos bons costumes, publicou Secreções, excreções e desatinos livre de censura. Este estudo, a partir das análises dos textos referidos, questiona o que é o crime da literatura? E, se não há mais a conjunção de censura política e repressão moral, se está esgotado o embate entre argumentos moralistas e liberais, como podem ser lidos os novos códigos de controle desse imaginário? O objetivo desta tese é, sobretudo, discutir a possibilidade da permanência ou não destes livros como transgressores em relação ao tratamento dado ao corpo no panorama contemporâneo. Para tanto, serão analisadas as diferentes formas de representação do corpo nesses livros, a partir de conceitos, como castração, pornografia e obscenidade, investigados em campos de estudo sobre as representações do corpo nas áreas de psicologia, sociologia e da crítica literária / This paper investigates what we call of crimes of Literature in Carlos Heitor Conys book, Pilatos (1974) in a comparative perspective with the story telling book Secreções, excreções e desatinos (2001), written by Rubem Fonseca. Cony, the famous author and journalist, with a history of political prisons during the Brazilian dictatorial period, has published Pilatos a work of language that was considered pornographic even in the presence of censorship. Rubem Fonseca was perused by the censors since the release of Feliz Ano Novo (1975), narrative also considered contradictory to the moral and good manners, he published Secreções, excreções e desatinos, free from the censorship. From these analyses, this paper questions what is the crime of literature? And, if there are no more links between political censorship and moral repressions, if the arguments between the moralistic and the liberals are vanishing, how the new codes of the imaginary control can be read?The objective of this thesis is to mainly discuss the possibility of the permanence or not, of these books like transgressors, related to the treatment given of the body in a contemporary perspective. Therefore this paper will analyze the different forms of body representations on these books, considering concepts like castration, 'pornography', 'obscenity', investigated in study fields about body representations in the psychology, sociology and literary criticism area

A rede pornô rompe com a lógica heteronormativa ao oferecer prazeres que precisam ser vigiados socialmente, mas, ainda assim não rompe com algumas continuidades estabelecidas pela matriz sexual. Assim, busca-se evidenciar as formas de representação que os frequentadores dos locais para sexo da cidade estabelecem a partir das experiências que mantêm dentro da rede pornográfica. Trata-se, portanto, de perceber os meandros da construção de corpos e sexualidades possibilitados a partir das práticas sexuais e do consumo encontrados na rede pornô da cidade.

Il s'agit d'une étude transhistorique des phénomènes de fanatisme selon une perspective psychanalytique. A partir de l'étude d'un corpus littéraire, politique, artistique, cinématographique et de faits historiques ou d'actualité, nous montrons comment le fanatisme s'articule à la manière dont le dispositif symbolique et culturel d'une société contrôle l'évacuation de l'abject sous la forme de l'obscène, dont la pornographie est l'avatar moderne. En dernière instance, cette thèse jette une lumière nouvelle sur l'islamisme radical contemporain. / This research addresses the issue of fanaticism throughout history, from a psychoanalytic standpoint which analyses various speech data: litterature, politics, arts, cinema, historical facts and news items. We intend to demonstrate that fanaticism is linked to the containment of obscenity and abjectness by the symbolic and cultural strutures of society, and that pornography reveals the modern crisis of the abjection containment process. Ultimately, the thesis sheds a new light on contemporary radical jihadism.

Självupplevd effekt av pornografi : Pornografikonsumtion relaterat till realism, effekt och sexuell självkänsla

Pornografi har med internets framväxt blivit mer lättillgängligt och fått mer extrem karaktär. Forskning visar att pornografikonsumtion positivt korrelerar med riskbeteenden som sexuell aggression, men även genererar positiva självupplevda effekter hos individer genom exempelvis ökad sexuell självkänsla med bl.a. upplevd realism som bidragande faktor. Aktuell studie undersökte pornografikonsumtion relaterat till upplevd realism av pornografi, upplevda effekter av pornografikonsumtion samt sexuell självkänsla hos fem grupper, dels en sexnegativ grupp samt en grupp med anknytning till BDSM-kulturen. Antal deltagare var 423, varav 334 kvinnor. Resultat från internetbaserad enkätundersökning visade bl.a. högre positiva effekter hos män, högre negativa effekter hos kvinnor, samt positivt samband mellan mängd pornografikonsumtion och positiva effekter. Negativt samband uppmättes mellan sexuell självkänsla och upplevda negativa effekter av pornografikonsumtion. Resultaten överensstämmer mycket med tidigare forskning men kan även bidra till ökad kunskap om vad som kan påverka bl.a. sexuell självkänsla hos individer baserat dels på kön och inställning till pornografi.

The Relationship Between Male Partner's Pornography Use and Couples' Attachment

Adult attachment theory continues to play an important role in explaining pathology within couples. Pornography is becoming more and more pervasive since the inception of the internet. This study looked at the relationship between insecure attachment, accessibility, responsiveness, and engagement with frequency of male pornography use. Little is known about pornography use and its impact on couple dynamics. This study specifically looked at pornography use predicting insecure attachment within couples. The sample was taken from the RELATionship Evaluation (RELATE) and consisted of 189 couples. Male pornography use was found to be a predictor of insecure attachment and low levels of responsiveness in him. The female partner's assessment of her male partner's low engagement, responsiveness, and accessibility in their relationship was predicted by his pornography use. These findings may inform therapists of the possibilities for direction in therapy when a couple is struggling with insecure attachment development.

Au travers des correspondances esthétiques entre littérature et photographie, françaises et américaines, ce travail de recherche se propose d'analyser le discours sur la pornographie (que nous qualifierons de « métapornographie ») mis en scène par l'art postmoderne et ses répercussions sur le corps pornographique. Ce travail prend appui sur trois séries photographiques A History of Sex d’Andrés Serrano (1995), Sex Pictures de Cindy Sherman (1992) et Pornographie d’Édouard Levé (2002), ainsi que sur trois romans Souvenirs du triangle d’or d’Alain Robbe-Grillet (1978), Blood and Guts in High School de Kathy Acker (1978) et Les particules élémentaires de Michel Houellebecq (1998). Un corpus secondaire emprunté aussi bien à la littérature et à la photographie qu’au cinéma ou à la performance étayera également l’analyse. L’hétérogénéité du corpus d’étude a permis la recherche de critères homogénéisants et susceptibles de guider toute l’analyse à savoir : la crise du sujet, la déhierarchisation, l’importance de la metatextualité avec le rejet du culte de l’unique et la permanence des discours sur la fin. La démonstration tient donc compte de ces invariants en les rattachant systématiquement à l’expression d’une temporalité particulière et à ses effets sur le corps pornographique : on assiste à une déformation successive du corps pornographique qui, à force d’hybridité, de franchissement de limites et de fragmentation n’a plus qu’une solution, celle de se reconstruire. Mais cette reconstruction, intimement liée à un processus de détournements, est marquée par une esthétique du trop et du kitsch. Ne reste plus qu’un corps froid, usé, aux limites de la mort et qui appelle son propre dénouement. / Through the aesthetic similarities between French and American literature and photography, this research work intends to analyse the discourse on pornography (which we will call "metapornography") staged by postmodern art and its repercussions on the pornographic body. This work is based on three photographic series, A History of Sex by Andrés Serrano (1995), Sex Pictures by Cindy Sherman (1992) and Pornography by Édouard Levé (2002), as well as three novels, Souvenirs du triangle d'or by Alain Robbe-Grillet (1978), Blood and Guts in High School by Kathy Acker (1978) and Les particules élémentaires by Michel Houellebecq (1998). A secondary corpus borrowed from literature and photography as well as from films or performance will also support the analysis. The heterogeneity of the corpus of study allowed the search for homogenizing criteria that could guide the whole analysis, namely: the crisis of the subject, the de-hierarchization, the importance of metatextuality with the rejection of the cult of the unique and the permanence of discourses on the end. The demonstration therefore takes these invariants into account by systematically linking them to the expression of a particular temporality and its effects on the pornographic body: we are witnessing a successive deformation of the pornographic body which, by way of hybridity, crossing boundaries and fragmentation, has only one solution left: to rebuild itself. But this reconstruction, intimately linked to a process of diversion, is marked by an aesthetic of the too much and the kitsch. All that remains is a cold, worn-out body, on the edge of death, calling for its own outcome.

The Relationship Between Adolescents' Use of Internet-enabled Mobile Devices and Engaging in Problematic Digital Behaviors

The purpose of this study was to examine the relationship between teenagers’ use of mobile Internet devices and their involvement in risky digital behaviors, including problematic Internet use, exposure to pornography, and participation in sexting. A crosssectional correlational design using a sample (N = 97) of teens aged 13-18 was used. Linear regression analyses revealed that teens using smartphones as their primary source of Internet access were most likely to receive sexting requests, while teens using computers to access the Internet were most likely to intentionally view pornography. Additionally, teens who used multiple mobile devices to connect to the Internet and teens who had owned at least one mobile Internet device for longer periods of time were most likely to have higher levels of problematic Internet use. Contextual factors such as age, gender, family structure, religious commitment, attachment to parents, and parental monitoring of online activities were also examined to determine their relationship to the aforementioned outcomes. Consistent with adolescent developmental trajectories, older teens reported higher rates of pornography exposure and sexting requests, and indicated a greater willingness to participate in sexting. However, younger teens who used smartphones as their primary source of Internet access were just as likely as older teens to have received requests to sext. Males had higher rates of pornography exposure and were more willing than females to send sexual messages to their significant other. Females, on other hand, were asked to sext more frequently. Teens with high levels of religious commitment had the lowest levels of pornography exposure and participation in sexting. Among the parental variables examined, teens’ attachment to their parents was most significantly related to the studies’ outcomes. Strongly attached teens had lower levels of problematic Internet use, pornography exposure, and participation in sexting than their peers who were not as strongly attached to their parents.

Partant du postulat selon lequel la principale justification de la répression de formes d’expressions réside dans leur nocivité supposée, nous tentons de répondre à la question suivante : comment définir des limites claires et cohérentes à la liberté d’expression ? L’analyse des controverses relatives à la pornographie, et en particulier de la manière dont les notions de liberté d’expression et de nuisance ont été articulées, contribue à répondre à cette question générale. À travers l’analyse des débats portant sur la restriction des représentations sexuelles, nous tentons de montrer que les parties en présence ne sont pas parvenues à définir la notion de « nuisance » de manière claire et satisfaisante, et ne permettent pas, dès lors, de définir avec précision les limites légitimes de la liberté d’expression. Les deux voies théoriques alternatives que nous avons identifiées, les conceptions instrumentales et déontologiques de la liberté d’expression, ne se révèlent pas plus convaincantes. Nous montrons néanmoins qu’il est possible de préciser le principe de non-nuisance en y intégrant deux éléments auparavant négligés : la subjectivité du récepteur, et les rapports d’autorité qui existent entre le locuteur et le récepteur. Nous défendons ainsi l’idée que le principe de non-nuisance reste l’instrument le plus clair et le plus cohérent pour fonder les limites de la liberté d’expression, à condition de l’amender et de le compléter. / Acknowledging the fact that the main justification to restrict some forms of expression lies in the harm they may cause to others, this thesis aims at answering the following question: how do we define clear and coherent limits of the freedom of expression? The study of the controversies regarding pornography, and particularly the way in which the concepts of freedom of expression and harm are closely linked together, is an important contribution in order to answer this vast subject. Through the analysis of debates with regard to sexual representations, this thesis aims at gaining a deeper understanding on how the authors were unsuccessful in defining the notion of « harm » in a clear and convincing way, and fail at allowing to set precisely the legitimate limits of freedom of expression. The two alternative theoretical approaches that were identified and established - the instrumental and deontological conceptions of freedom of expression – were not proven to be more satisfactory either. However, this research confirms that the harm principle can be clarified if two previously neglected aspects are included in the analysis: the receiver’s subjectivity, and the authority relationship established between the speaker and the viewer. Thus, it is argued that the harm principle, given that it is modified and completed, remains the most effective and adequate tool in order to ground the limits of freedom of expression.
