Dept. of Public Law. / ENGLISH ABSTRACT: When evaluating a bail application, the court must take into consideration the interests of the accused against those of the community. The main goal of this assessment is to find a balance between said interests. While an application for bail is made at a stage where guilt has not been proven, it is of extreme importance that the court must not infringe on the fundamental rights of the accused which include the right to personal freedom and the presumption of innocence. In order to protect the rights of the bail applicant within the proper functioning of the legal system, it is important to determine the nature of bail proceedings. As shown in this thesis, bail proceedings are sui gelleris in nature, which means that a separate set of rules of the law of evidence is applicable to these proceedings. The object of this thesis is to identify the rules of law of evidence applicable to bail proceedings as well as to clarify the deviation from the normal rules of evidence which apply to the trial of the accused. In chapter one the purpose and nature of bail proceedings as well as the characteristics of accusatorial and inquisitorial systems, are discussed. Problem areas within the South African legal system with regards to bail applications are also highlighted in this chapter. In chapter two the application of the primary rules of the law of evidence with regards to bail proceedings are investigated as well as the admissibility of evidence pertaining to prior convictions of the applicant, opinion evidence and character evidence. In chapter three the admissibility of hearsay evidence at bail proceedings is discussed. The constitutionality of the privilege pertaining to the police docket is dealt with in chapter four. Chapter five deals with the infom1er's privilege. The requirements that have to be met in order to qualify for protection under the said privilege, are examined. Chapter six focuses on the privilege against self-incrimination and the manner In which it is applied in bail proceedings. The provisions of s 60(11B)(c) of the Criminal Procedure Act and the role of the presiding officer are also discussed in this chapter. Chapter seven focuses on the burden of proof in bail applications. Chapter eight contains a summary and recommendations. / AFRIKAANSE OPSOMMING: By die beoordeling van 'n borgaansoek moet die hof die be lange van die beskuldigde en die belange van die samelewing teen mekaar opweeg. Die doel van die betrokke verrigtinge is om 'n balans tussen hierdie belange te vind. Omdat borgtog ter sprake kom op 'n tydstip waar daar nog geen skuldigbevinding is nie, is dit van kardinale belang dat die hof ten aile tye moet waak teen die onregverdige inbreukmaking op die beskuldigde se fundamentele regte wat onder andere die reg op individuele vryheid en die vem10ede van onskuld insluit. Ten einde die regte van die borgaansoeker na behore te beskem1 sonder om die behoorlike funksionering van die regstelsel te belemmer, is dit belangrik om vas te stel wat die aard van borgverrigtinge is. Soos in hierdie tesis aangetoon word, is borgverrigtinge sui generis van aard. Dit het tot gevolg dat daar 'n aparte stel reels van die bewysreg bestaan wat op hierdie verrigtinge van toepassing is. In hierdie tesis word daar gepoog om die reels van die bewysreg wat op borgverrigtinge van toepassing is, te identifiseer en om die afwykings van die gewone bewysregreels wat op die verhoor van toepassing is, te verklaar. In hoofstuk een word die doel en aard van borgverrigtinge bespreek en word die kenmerke van die akkusatoriale en inkwisitoriale stelsels teen mekaar gestel. Die onduidelikhede oor die aard van borgverrigtinge in die Suid-Afrikaanse reg word ook aangeraak. In hoofstuk twee word die toepassing van die relevantheidsgrondreel by borgverrigtinge ondersoek, asook die toelaatbaarheid van getuienis oor die vorige veroordelings van die beskuldigde, opiniegetuienis en karaktergetuienis. Hoofstuk drie het betrekking op die toelaatbaarheid van hoorsegetuienis by borgverrigtinge. In hoofstuk vier word kwessies rakende dossierprivilegie behandel en die grondwetlikheid van sodanige privilegie, asook die toepassing daarvan, word van naderby beskou. In hoofstuk vyf word daar gefokus op die aanbrengersprivilegie. Die aard en toepassing van die privilegie asook die vereistes waaraan voldoen moet word alvorens daar op die betrokke privilegie gesteun kan word, word aangeraak. Hoofstuk ses fokus op die borgapplikant se privilegie teen selfinkriminasie. Die bepalings van a 60(11 B)(c) asook die rol van die voorsittende beampte word ook in hierdie hoofstuk aangespreek. Moterims, patyrusioms seksualinį smurtą, kreipiantis į policiją tenka susidurti su sistema, neatitinkančia jų lūkesčių. Vienas pagrindinių to atspindžių yra jų apklausos, atliekamos pareigūnų neturinčių specialaus psichologinio pasirengimo. Kriminalistikos literatūroje nurodoma, kad nors įvairių proceso dalyvių apklausa skiriasi procesiniu reglamentavimu ir taktiniais būdais, tačiau pasiruošimas jai turi bendrų bruožų. Nagrinėjama tik įprastinės apklausos taktika, kurioje nėra akcentuojami tokių subtilių bylų, kaip seksualinio prievartavimo, apklausos ypatumai. Pagrindinis šio tyrimo objektas yra baudžiamosios bylos, nagrinėtos pagal LR BK149 išžaginimo ir 150 seksualinio prievartavimo straipsnius. Tyrimo tikslas išanalizuoti baudžiamųjų bylų praktiką Lietuvoje ir pagrindines problemas susijusias su ikiteisminio tyrimo organizavimu. Tyrimas atliktas naudojantis matematinės statistikos, lyginamosios analizės, tiesioginės apklausos, empiriniu, internetinės apklausos ir teisiniu lyginamuoju metodais. Matematinės statistikos metodu analizuojami išstudijuotų bylų tam tikri parametrai. Usually first desperation is an interviewing with police officer, who rarely is qualified to communicate with a delicate victim. Tutorial tells common interviewing concepts, but delicate, such as sexual violence victims. The main object of this research is criminal cases of rape and sexual abuse articles. The aim of this study is analyzing the practice of criminal cases deal with female sexual violence in Lithuania the main problems associated with organizing of investigation. The study was carried out using various methods: method of mathematical statistics, comparative analysis, the direct questioning method, empirical method, online questioning method, the comparative legal method. Mathematical statistical method is used to analyze the main parameters of cases. Chargés de mettre en œuvre la loi pénale contre les personnes soupçonnées d’infractions, les procureurs bénéficient traditionnellement d’un large pouvoir d’appréciation qui est en général encadré par la loi et par des instructions hiérarchiques que les procureurs doivent suivre lorsqu’ils prennent leurs décisions. Avec une analyse fondée sur des observations et des entretiens dans les systèmes français et anglo-gallois, cette étude comparative vise à comprendre comment les systèmes de justice pénale étudiés s’efforcent de combiner les nécessités du contrôle des autorités de poursuites dans des sociétés démocratiques modernes avec la souplesse et la réactivité nécessaires à l’application de la loi résultant de la marge d’appréciation laissée aux procureurs. Il existe actuellement peu d’études empiriques et systématiques du processus de décision des autorités de poursuites. Cette thèse montre qu’aucun des systèmes observés ne parvient à un équilibre satisfaisant entre le degré de responsabilité et le pouvoir de décision des procureurs. En France, bien que le contrôle démocratique et hiérarchique des procureurs soit bien développé en théorie, il reste limité en pratique, en raison en raison de la primauté du principe d’individualisation dans la culture juridique et du statut professionnel des procureurs comme magistrats indépendants. En Angleterre et au Pays de Galles, les procureurs font partie d’une structure particulièrement bureaucratique et centralisée qui impose une stricte uniformité des décisions de poursuites aux dépens du pouvoir de décision et de l’autonomie des procureurs dont le rôle se limite à des tâches simples et répétitives en raison de la segmentation de la procédure de poursuites. Cette structure autoritaire de contrôle, conjuguée à un équilibre historique des pouvoirs en faveur de la police, semble empêcher les procureurs de prendre des décisions qui pourraient être mal vues par leur hiérarchie ou la police. Enfin, le manque de ressources et une recherche constante d’efficacité dans chacun des systèmes juridiques étudiés ont produit une bureaucratisation de la procédure pénale, certaines tâches étant déléguées à du personnel peu qualifié et les affaires mineures étant expédiées le plus rapidement possible selon un traitement standardisé. / Tasked with enforcing the criminal law against suspected offenders, public prosecutors have traditionally enjoyed broad discretion, which is usually structured by legal and policy guidelines defining rules prosecutors should follow when making their decisions. Basing its analysis upon direct observations and interviews in the two jurisdictions under study, this comparative thesis endeavours to understand how the French and Anglo-Welsh criminal justice systems attempt to combine the necessities of accountability for public prosecution services in modern democratic societies with the flexibility and reactivity needed in the application of the law provided by prosecutorial discretion. There have been few systematic, empirical accounts of the decision-making process of these national prosecution services.This thesis argues that neither system observed achieves a satisfactory balance between accountability and discretion for public prosecutors. In France, although democratic and hierarchical accountability channels are well developed in theory, oversight is weak due to the primacy of the concept of ‘adaptation’ in the legal culture and the strong professional ethos of procureurs as independent judicial officers. In England and Wales, public prosecutors are part of a highly bureaucratic and centralised structure which strictly enforces consistency in prosecutorial decisions at the expense of much discretion and autonomy for individual prosecutors whose responsibility is limited to narrow and repetitive tasks due to the segmentation of the prosecution process. This overbearing accountability structure, coupled with a historical balance of power in favour of the police, appears to prevent prosecutors from making decisions perceived as unpopular with their hierarchy or the police. Finally, pressure on resources and a drive for efficiency in both jurisdictions have resulted in the bureaucratisation of the criminal justice process with part of the prosecution workload being delegated to unqualified staff and minor cases being processed as quickly as possible into a one-size-fits-all system.

Gendered Bail?: Analyzing Bail Outcomes from an Ontario Courthouse

The relationship between gender and bail is an important yet understudied area of research. Studies that have found a relationship between gender and bail generally overlook important differences that shape how men and women enter into crime and the types of conditions imposed on their recognisances. This study utilizes 115 bail cases from the Provincial Courthouse in Kitchener, ON to examine the effect of accused gender on bail outcome. Results show that accused gender did influence decisions to grant or deny bail. While almost all accused persons required a surety and/or bail conditions to be released, the regression analysis suggests that women were more likely to be released compared to men. Based on the deep sample exploratory analysis, gender differences emerged around issues of mental health and drug use. Theoretical and policy implications from this study are discussed as are avenues for future research.

Instituídas em fevereiro 2015 em São Paulo, foram apresentadas como importante mecanismo para a redução do número de prisões provisórias e mais atenta observação dos direitos e garantias das pessoas presas. Entretanto, o Sistema de Justiça Criminal funciona segundo lógicas que historicamente têm se mostrado pouco permeáveis aos princípios democráticos previstos Constitucionalmente. Assim, com a pesquisa, cuja técnica privilegiada foi a observação direta da cena das audiências, buscou-se compreender, a partir da interação entre os atores, como as velhas práticas relacionadas ao funcionamento do SJC são excluídas ou incorporadas ao novo instituto, e ainda, os limites que se impõem à potência inovadora das audiências de custódia, partindo do pressuposto que compõem um arranjo institucional muito mais amplo, que engloba desde as agências policiais até o sistema prisional. Apesar de ser possível identificar pontos de inflexão tendo como foco de análise apenas a cena das audiências de custódia, observa-se também permanências sobretudo no que diz respeito ao descrédito atribuído às narrativas dos indivíduos presos, e questões relacionadas à violência institucional. / This research started from a question: do custody hearings represent a turning point for the Brazilian criminal justice system? Implemented in February 2015 in São Paulo, they were presented as an important mechanism to reduce the number of pre-trial custody and assure a more attentive observation of prisoners¿ rights and guarantees. However, sense, the research - whose privileged technique was the direct observation of the hearings¿ scene, with specific attention to the interactions among the actors involved ¿ was aimed at understanding how old practices related to the functioning of the system are excluded or incorporated into this new institute, as well as the limits imposed to its innovative power. These research questions were based on the assumption that custody hearings are part of a broader institutional arrangement, which encompasses a wide range of actors, from police agencies to prison authorities. Although it is possible to identify inflection points when focusing the analysis on the hearing scene itself, it is also possible to notice aspects that remain unchanged, especially regarding the discredit towards prisoners¿ narratives and issues related to institutional violence.

Häktning är ett av de mest ingripande tvångsmedel som staten kan vidta gentemot enenskild person. I kombination med restriktionsanvändning riskerar det att kränka ett flertalav den enskildes grundlagsskyddade rättigheter. Att reglera en häktningslagstiftninginnebär att göra en noggrann avvägning mellan de brottsutredande myndigheternas möjlighetertill en effektiv utredning samt lagföring och den enskildes skydd för grundläggande fri- och rättigheter. Med en så ingripande åtgärd mot en ännu ej dömd person är det av största vikt att ställa höga krav på reglering och tillämpning av tvångsmedlet och dess överensstämmande med grundläggande principer och rättigheter. Senaste årens ökningav häktningstider är således oroande och kräver förändring. Sverige har under flera decennier fått återkommande och omfattande kritik för sin regleringkring häktning. Kritiken har riktat sig mot att det inte finns någon övre tidsgränsför hur länge en person kan sitta häktad, en omfattande restriktionsanvändning samt avsaknaden av effektiva alternativa tvångsmedel till häktning. Till följd av kritiken presenterade regeringen år 2020 ett flertal förslag som syftade till en effektivare häktningsreglering. I min framställning kommer jag ta sikte på möjligheterna att minska de långa häktningstiderna.Flertalet av förslagen har indirekt betydelse för möjligheterna att minska delånga häktningstiderna och det mest omdebatterade förslaget är det om införandet av enövre tidsgräns för hur länge man får sitta häktad.I min slutsats argumenterar jag för att nuvarande utformning och tillämpning av häktningsregleringenkan antas strida mot överordnad rätt och i viss mån vara anledningen tillde långa häktningstiderna. Jag ställer mig positiv till de förslag regeringen presenterar isyfte att förändra nuvarande häktningslagstiftning. Jag tror det finns en stor sannolikhet för att förslagen kommer kunna leda till minskade häktningstider. Samtidigt ställer jag mig tveksam till i vilken utsträckning den maxtidsgräns som presenteras kommer lösasamma problem. Visserligen anser jag att den gräns som presenteras är viktig ur legalitetssynpunkt, men att den inte i tillräcklig utsträckning avhjälper den proportionalitetsproblematik som förekommer. Jag är inte heller övertygad om att häktningstiderna faktiskt kommer minska till följd av införandet av denna gräns. Konsekvenserna av förslagen innebär på det stora hela en minskad användning av häktning, en mindre godtycklig häktningsprocess och minskade häktningstider. Förhoppningen är att förslagen i viss mån kommer underlätta för åklagare och domstol vid beslut om häktning och särskilt bedömningen av huruvida häktningen är proportionerlig eller ej. Jag menar emellertid att mer kan göras för att komma tillrätta med nuvarande häktningsregleringoch långa häktningstider varför ytterligare förslag på förändring kommer presenterasi denna framställning. / Pre-trial detention is one of the most intervening means of coercion that the state authorities can use against an individual. In combination with the use of restrictions there is risk that it will infringe a numerous of the constitutional rights of the individual. To regulatet he law of detention means to balance the interests of the possibilities of the stateauthorities to an efficient investigation and prosecution and the individuals protection oftheir constitutional rights. With such an intervening action against a not yet condemnedperson it is of paramount importance to ensure high demands on the regulation and applicationof the means of coercion and its compatibility with constitutional principles andrights. The increasing times of pre trial detention the last couple of years are therefore agitating and requires a change. Sweden has during several decades received recurrent and extensive criticism regardingits regultation on detention. The critic has been adressed against that there is no upperlimit for how long a person can undergo pre-trial detention, a comprehensive use of restrictions and the lack of efficient alternative means of coercion to pre trial detention.Following the criticism the government 2020 presented a numerous proposals on how to change the legislation in purpose of a more efficient regulation of detention. In my thesis I focus on the possibilities to decrease the long times of detention. Most of the proposalsare of relevance for the possibilities to decrease the long times of detention and the most debated proposal is the one regarding the imposition of an upper limit of how long aperson can remain in continual detention.In my conclusion I argue for that the present regulation and application of detention canbe assumed to infringe superior constitutional law and to a certain extent be the cause of the long times of detention. I remain positive towards the proposals the government present in order to change the current regulation of detention. I think it´s highly likely thatthe proposals can lead to shorter times of detention. At the same time I remain doubtfultowards in what extent the upper time limit that is presented can solve the same problem. Indeed I believe that the presented limit is important in an aspect of legality, but that it´s not enough to remedy the complex problem of proportionality that exists. I´m neitherconvinced that the long times of detention actually are going to decrease as a consequence of the imposition of this limit.The consequences of the proposals can overall lead to reduced use of detention, a less arbitrary detention process and shorter times of detention. Hopefully the proposals canfacilitate for public prosecutors and courts regarding decisions of detention and especiallythe assessment of whether the detention is proportional or not. However, I mean that morecan be done to settle current regulation and long times of detention why further proposals will be presented in this paper.

Evaluating the role of investigators during bail application

Text in English / Every victim wants to see the perpetrator or offender of serious crimes convicted for their criminal actions. Each victim in a case is supported by witnesses and the community in wanting accused persons to be locked away behind bars. Having the accused persons locked away in prison is an achievement of every role player involved in the process of putting that accused where he/she belongs. The ultimate goal of investigation is to see successful bail opposing to ensure the safety of witnesses. There are accused who are released from custody by the court despite many attempts made by an investigator to keep that criminal in custody until trial. Victims and witnesses are struggling to get their offenders punished for the crimes they committed. It is the wish of every investigator of crime to satisfy every complainant in cases but it does not always happen, not because of any lack of skills, but because of many factors which come along with the successful prosecution in a case. Once the accused is released on bail, the chances and hopes of putting him/her back in prison are equal to the chances of getting him/her back in the community for good. This difficulty is caused by the fact that, once the accused is out on bail he/she might evade trial or the docket will be in and out of court for further evidence until the court declines to prosecute. / Criminal and Procedural Law / M.A. (Criminal Justice)
