L’Afrique n’échappe pas aux débats sur les industries culturelles, déjà en vogue, au niveau mondial. Bien développées dans les pays du Nord, les industries culturelles connaissent cependant un développement très faible en Afrique. Dans le continent, si quelques pays ont des modèles réussis de développement de ce secteur, à l’instar du Nigéria ou de l’Afrique du Sud, les industries culturelles des pays francophones d’Afrique subsahrienne demeurent encore dans un état précaire. Cela semble probablement dû à une prise de conscience tardive de leurs enjeux, à des considérations socio-politiques, ou encore à une mauvaise compréhension des rôles des acteurs. D’où notre intérêt à étudier le rôle des pouvoirs publics dans le processus de développement des industries culturelles au Burkina Faso, à travers le sujet suivant : Les industries culturelles dans les pays francophones d’Afrique subsaharienne : cas du Burkina Faso. Pour mener à bien notre réflexion sur le sujet, la méthodologie a consisté aussi bien à un débroussaillage théorique et à des enquêtes de terrain, permettant de confirmer les hypothèses émises. Au Burkina Faso, les industries culturelles connaissent, par leur organisation, une certaine dynamique, malgré quelques insuffisances dans le développement des filières culturelles. Cette dynamique, favorable à la mise en place d’initiatives et d’évènements culturels d’envergure, fait sans doute considérer le pays comme un « carrefour culturel » en Afrique. Les industries culturelles génèrent des enjeux sociaux, politiques et économiques considérables pour le pays. Cependant, ces enjeux sont l’objet de conflits entre surtout les industriels de la culture et l’Etat. Aussi, est-il indispensable que les pouvoirs publics et les industriels de la culture travaillent en synergie, avec des rôles bien définis, pour prendre au sérieux les défis, pour un secteur plus viable, dynamique et durable. / THESIS SUMMARYAfrica is no exception to the debates on the cultural industries, already in vogue, at the global level. Although well developed in the North, cultural industries are less developed in Africa. In the continent, while some countries have successful models of development in this sector, like Nigeria or South Africa, the cultural industries in francophone countries of sub-Saharan Africa are still in a precarious level. This seems likely due to a late awareness of their issues, socio-political considerations, or a misunderstanding of the roles of the actors. Hence our interest in studying the role of public authorities in the process of cultural industries development in Burkina Faso, through the following subject: Cultural industries in francophone countries of sub-Saharan Africa: case of Burkina Faso. To carry out our reflection on the subject, the methodology consisted as well of a theoretical brusaillage and field investigations, allowing to confirm the hypotheses emitted.In Burkina Faso, the cultural industries are dynamic, by their organization, despite some shortcomings in the development of cultural sectors. This dynamic, favorable to the implementation of major initiatives and cultural events, makes the country as a "cultural crossroads" in Africa. Cultural industries generate considerable social, political and economic impacts for the country. However, these profits are the subject of conflicts between mainly industrial culture sector and the public sector. It is therefore essential that public authorities and cultural private sector work in synergy, with well-defined roles, to take the challenges seriously, for a more viable, dynamic and sustainable sector.

Para tanto, foi analisado todo o processo administrativo para o desenvolvimento e concretização do projeto, incluindo a fase de Manifestação de Interesse Privada - MIP; as providências adotadas pelo Governo do Estado de São Paulo para a estruturação da PPP; o procedimento licitatório; e a assinatura do contrato, que representa o modelo final da PPP. Da análise deste processo administrativo, foi possível perceber certas particularidades atinentes a cada fase do processo de contratação pública, especialmente sobre alguns riscos apresentados pelos particulares, tal como o risco da governança entre os serviços ‘bata-branca’, de responsabilidade da equipe médica, e os serviços ‘bata-cinza’, de responsabilidade da concessionária. Assim, a presença do mencionado risco no modelo pesquisado é prova que fatores políticos e sociais estão presentes na modelagem de projetos, cabendo aos seus responsáveis compatibilizar os interesses por meio de estrutura contratual adequada. Pretende-se, portanto, analisar quais os mecanismos utilizados para superar o referido risco, de modo que o estudo sistematizado possa servir de dado para projetos com semelhante característica. Por fim, serão apresentadas informações e análise crítica sobre aspectos destacados ao longo do processo administrado objeto da pesquisa. / This work aims the case study about private-public partnership, ruled by Lei nº 11.079/2004, about public concession for construction, ‘gray coat’ and São Paulo hospital complex maintenance. Therefore all public procedure was analyzed for the development and execution, including the Private Expression of Interest, the São Paulo Government providences for the private-public partnership conclusion, the bidding procedure and final agreement for the contract. From the analysis it was possible to detect particularities for each stage of the public contract, especially about risks pointed by the private partner, like managing risks among ‘white coat’ services, medical team responsibilities, and ‘gray coat’ services, private partner responsibilities. This mentioned risk presence proves that political and social factors are elements of the project model, being up to the developers to make compatible the interests through the right contractual structure. At last, info and critical analysis about the highlights during the public procedure will be presented.

Los mecanismos contractuales de cobertura jurídica ante los riesgos en los Project Finance / The contractual legal coverage mechanisms against risks in Finance Projects

El presente trabajo de investigación tiene como objetivo principal establecer mecanismos contractuales de cobertura jurídica ante los riesgos en los Project Finance. Es importante indicar, que en todo negocio sin importar su magnitud y objeto social existen distintos tipos de riesgos, los mismos que se deben identificar, aislar y mitigar su impacto dentro de la organización empresarial. En concordancia con lo anterior, el presente trabajo académico se divide en tres capítulos. En el primer capítulo, se desarrolla el marco teórico sobre los riesgos empresariales, tales como, tipos de riesgos empresariales y la administración de los mismos. Asimismo, nos centramos en analizar el Project Finance y sus características. En el segundo capítulo, se desarrolla y analiza la problemática en torno a los riesgos en los Project Finance, es decir, los problemas que comúnmente se presentan desde el estudio del proyecto, en la construcción y operación del mismo. En el tercer capítulo, desarrollamos las propuestas como mecanismos contractuales de cobertura jurídica intra y extra-empresa ante los riesgos en los Project Finance, en consecuencia, buscando identificar, aislar y mitigar los riesgos correspondientes. En virtud de los tres capítulos indicados líneas arriba, la presente tesis establece una estructura de referencia ordenada y coherente; aportando mayores luces de los temas a considerar en el desarrollo de un Project Finance. / The main objective of this research assignment is establishing contractual mechanisms for legal coverage against Finance Projects Risks. It is important to specify that in every business, regardless of its magnitude and corporate purpose, there are different types of risks, which must be identified, isolated, and their impact mitigated within the business organization. In keeping with the foregoing, this academic paper is divided into three chapters. In the first chapter, the theoretical framework on business risks is developed, such as the classification of business hazards and their proper management. Likewise, we focus on analyzing Finance Projects and its characteristics. In the second chapter, the problem around risks in Finance Projects is developed and analyzed, that is, the difficulties that commonly arise from the study of the project, in its construction and operation. In the third chapter, Approaches as contractual legal coverage mechanisms intra and extra-business are developed against risks in Finance Projects, consequently, seeking to identify, isolate and mitigate the corresponding risks. In accordance with the three chapters mentioned above, this thesis establishes an organized and coherent structure for further reference; by providing greater insight into the topics to be considered in the development of a Finance Project. / Tesis

Rethinking human security : taking into consideration gender based violence

Includes bibliography / ENGLISH ABSTRACT: The human security concept challenges the traditional view of state security. The very essence of human security means to respect human rights. The Commission on Human Security did not focus on women as a special area of concern in the 1994 Human Development Report. The report does not recognise that being subject to gender hierarchies increases women’s insecurity and that women experience human security differently from men and shows that the human security concept does not include gender based violence (GBV) because there is no specific attention paid to issues that predominantly pertain to women. This study is conducted from a feminist perspective. It is reflexive research and based on standpoint theory. The data is gathered through analysis of secondary data and primary data, collected through interviews. GBV in South Africa tends to be continuous and the perpetrator is most likely to be a spouse or partner. Studies show that women are seen as being dependent on and weaker than men. Many men view women’s rights legislation as a challenge to the legitimacy of men’s authority over women. Women who try to be more independent in their relationships are regarded as threats and violence against them becomes a way for men to show control. The criminal justice system in South Africa has made progress in protecting women from GBV but myths, stereotypes and social conventions still prevent women from receiving justice. Traditionally, the state regards what happens in the private sphere as outside its responsibility. The public/private dichotomy challenges state regulations and norms which is evident in the case of domestic violence. It is often argued that GBV has remained imperceptible because it takes place in the private sphere. However, this research indicates that due to the socio-economic situation in South Africa, the abuse is often publicly known by those in the immediate environment as people live in informal housing. This research shows that a human security framework that targets GBV has to be developed for those who bear its consequences. When women are not viewed as subjects, issues that mainly affect them remain invisible. It is necessary that analysis of human insecurity starts from the conditions of women’s lives. Many women in South Africa live highly traumatic lives. Fighting GBV requires that we know the victims of GBV and let them decide what they need to feel secure. Creating human security requires that other threats which contribute to GBV, such as poverty, gender stereotypes and prejudice are also addressed. GBV has become an epidemic in South Africa and is a permanent constraint in women’s lives and impacts society as a whole. The security of the state rest on the security of women and as long as the state fails to treat GBV as a serious crime and protect women the state is more likely to use violence on a larger scale against its citizens. / AFRIKAANSE OPSOMMING: Die Menslike Veiligheidskonsept daag die tradisionele siening van staatsveiligheid uit: die kerbetekenis van Menslike Veiligheid is om menseregte te respekteer. Die Kommissie op Menslike Veiligheid het nie op vroue as ‘n spesiale area van kommer gefokus in die Menslike Ontwikkelingsverslag van 1994 nie. Die verslag het daarin gefaal om te erken dat die realiteit van geslags-hiërargieë vroue se insekuriteit verhoog, en dat die ervaring van menslike sekuriteit van mans en vroue verskil. Hierdie navorsing sal toon dat die menslike veiligheidsbegrip nie in staat is om geslags-gebaseerde geweld (GGG) in ag te neem nie, aangesien daar geen spesifieke aandag verleen is aan vraagstukke wat hoofsaaklik op vroue betrekking het nie. Hierdie studie is vanuit 'n feministiese perspektief gedoen. Die navorsing is reflektief en op standpunt-teorie gebaseer. Die data is deur die analise van sekondêre data, asook die gebruik van primêre data i deur middel van onderhoude ingesamel . GGG in Suid-Afrika is geneig om oor ‘n uitgerekte tydperk plaas te vind en die mees waarskynlike oortreders is ‘n eggenoot of lewensmaat. Navorsing toon dat gemeenskappe geneig is om vroue as swakker en afhanlik van mans te sien. Wetgewing op die regte van vroue word deur vele mans as ‘n uidaging van hul legitieme superioriteit, ten op sigte van vroue, gesien. Vroue wat dus onafhanklikheid in hul verhoudings probeer uitoefen, word as bedreigings gesien en geweld word gebruik om hulle “in hul plek te hou”. Die Suid-Afrikaanse kriminele regstelsel het al vordering gemaak in terme van die beskerming van vroue teen GGG, maar mites, stereotipes en sosiale konvensies belemmer steeds die volle gang van die gereg. Die staat het in die verlede die private sfeer as buite sy jurisdiksie gesien. Die openbare/private sfeer digotomie bied uitdagings vir staatsregulering en vir die implementering van regulasies , en dit word veral duidelik in die geval van huishoudelike geweld. Daar word aangevoer dat aangesien GGG in die private sfeer plaasvind, dit onsigbaar bly. Hierdie navorsing het egter bevind dat GGG in die Suid-Afrikaanse konteks dikwels in die openbare gemeenskapsfeer (deur diegene in die onmiddelike omgewing) opgemerk word, omdat baie mense in Suid-Afrika informele nedersettings woon.Hierdie navorsing het verder bevind dat ‘n GGG raamwerk vir menslike veiligheid ontwikkel moet word wat diegene wat die gevolge van GGG dra insluit. Indien vroue nie spesifiek as navorsingssubjekte geag word nie, bly faktore wat hulle spesifiek beïnvloed onsigbaar. Dit is belangrik dat analise van menslike insekuriteit begin om die omstandighede van vrouens se lewens in ag te neem. Vroue in Suid-Afrika leef in hoogs traumatiese omstandighede. In die bestryding van GGG is dit belangrik dat die slagoffers van GGG in ag geneem word en dat dit hulle toelaat om dit duidelik te maak wat hulle onveilig laat voel. Die skep van menslike veiligheid vereis dat bedreigings wat bydra tot GGG, naamlik armoede, geslagstereotipes en vooroordeel , ook aangespreek word. GGG in Suid-Afrika het ‘n epidemie geword, en plaas ‘n permanente beperking op vroue se lewens. Dit het ook ‘n blywende impak op die samelewing as ‘n geheel. Die veiligheid van die staat rus op die veiligheid van vroue. Solank as wat die staat versuim om GGG te bekamp en as ‘n ernstigge misdaad te erken, en vroue nie die beskerming van die staat geniet nie, is daar ‘n hoër moontlikheid vir die gebruik van geweld deur die staat teen sy eie burgers op ‘n groter skaal.

從協力治理觀點探討地方文化館委外經營現況— 以芝山文化生態綠園為例 / A collaborative governance perspective of contracting out in local culture pavilion -case of Zhishan Cultural and Ecological Garden

隨著時代的演進,政府與民間的合作形式以從傳統契約關係轉變為公私關係(Public- Private-Partnerships,PPPs),強調參與者或利害關係人間創造共贏賽局的ㄧ種組織性關係。時至今日,公私協力關係的實踐仍有賴更多個案研究去發掘各種參與者與利害關係人的互動關係與合作模式。   以地方文化館-芝山文化生態綠園公辦民營為例,跨及政府部門、企業、非營利組織與社區,透過彼此互動、解決歧見與尋求合作,達成共識與協調,形成跨部門治理的模式。因此本研究透過三個構面去分析:(1)公辦民營的管理機制;(2)委託人與受託人雙方以及其他利害關係人之間的互動關係;(3)這些互動關係如何影響營運組織的目標發展與運作,從中釐清跨部門協力治理的問題。   為探究芝山文化生態綠園的個案探討,本研究透過文本分析法與質性訪談法進行資料的統整與分析。經由分析公辦民營實施的利弊,以及公私協力的互動模式,以探析芝山文化生態綠園在經營目標執行與各方看法,並重新思考芝山文化生態綠園未來的發展與再定位,以作為發展地方文化館委外營運相關計畫的參考。 本研究結果發現:(1)委外管理與評鑑機制完備,惟政策目標寬鬆,造成代理人的自主發展;(2)委託人、代理人雙方偏向以維持契約的互動關係;(3)本研究對象與利害關係人關係互動情形為若即若離。而本研究針對芝山文化生態綠園的協力治理的建議為:(1)評選機制宜整合在地團體與有力人士的聲音;(2)進行跨部門溝通,增加多方合作渠道;(3) 建立社區為主的溝通平台,整合利害關係人間管理的歧見,可提供環境教育推廣或地方文化發展管理者的思考。 / With the changing of the times, cooperation between government and the people have shifted from traditional contractual relationships into public-private-partnerships (PPPs) to create a win-win situation and form organizational relationships between the participants or stakeholders. Yet, the PPPs in operation today are still highly dependent on the analysis of individual case studies to ensure the greatest collaborative efforts among the various participants and stakeholders. The Zhishan Cultural and Ecological Garden ia an example of a cross-sector partnership among government, enterprise, NPOs and community. To resolve the differences and seek cooperation among the different sectors, a case study was made on three levels: firstly, the private management of public management and evaluation; secondly, the interaction between both the client and the trustee and other interested parties; and thirdly, how those interactions affect the operation of the organization's goal development and operation. The Zhishan Cultural and Ecological Garden's local cultural pavilion was contracted out by the Taipei Department of Cultural Affairs. Through text analyses and detailed interviews, data was collected, integrated and analyzed. Analysis of the pros and cons of the PPP operation's interactions revealed the multiple perspectives and executing objectives among those involved with the project to provide reference to better the future management of the local cultural pavilion. This study discovered that: (1) the outsourcing management and evaluation mechanisms were good, but the loose policy goals caused the agent of independent development; (2) bilateral relations tended to maintain contract-oriented-interactions in PPPs; and (3) the NPOs, various parties of interest and the community worked side-by-side instead of together. Thus, the following PPPs recommendations for the Zhishan Cultural and Ecological Garden were suggested: (1) listen to the voice of a strong leader; (2) build cross-sector communication;(3)establish community-oriented communication platform, alongside promotions of environmental education and help local cultural development managers develop new philosophies.

This dissertation investigates the advantages of procuring capital-intensive infrastructure services via Public-Private Partnerships (P3s or PPPs) – cost and time savings and; innovation and high levels of efficiency – accounting for these advantages by reference to the underlying legal provisions and principles that facilitate them; and in this process highlights two significant directions in which Canadian P3 law, policy and practice has evolved – the enactment of P3 legislation and/or the formulation of non-statutory P3-related policy; as well as the establishment of legal institutions that promote and/or facilitate P3 procurements. The dissertation also addresses key arguments raised against P3s, by reference to aspects of Canadian law, policy and P3 practice. The research methodology comprises a detailed review of legal and non-legal sources. The implication of the research findings is that, given the foregoing developments in Canadian P3 law, policy and practice, the key arguments canvassed against P3s are overstated and lacking in merit.

[pt] A área de química do estado sólido ocupa uma posição cada vez mais importante nas atividades de pesquisa e desenvolvimento farmacêuticas. A compreensão das propriedades do estado sólido de um insumo farmacêutico ativo (IFA) mostra-se crítica no desenvolvimento de formulações em função de seus impactos na biodisponibilidade e solubilidade dos fármacos, sendo essencial para garantir o benefício terapêutico, otimizar o desenvolvimento e garantir a proteção da propriedade intelectual. Esta tese investiga indicadores científicos e tecnológicos na área de química do estado sólido utilizando ferramentas de ciência dos dados a partir de publicações científicas e depósitos de patentes, visando contribuir para o aumento da competitividade da indústria farmoquímica e farmacêutica brasileira e de outros mercados emergentes. A partir da utilização de ferramentas de ciência dos dados é proposta uma metodologia baseada em técnicas de text mining associadas a relações fuzzy. Essa metodologia de identificação de competências específicas aplicada na área de química do estado sólido tem como estudo de caso a descoberta de uma nova forma polimórfica para o IFA acetato de dexametasona. Os resultados revelam que existem competências científicas em química do estado sólido no Brasil. Contudo, quando comparada com a interação universidade-empresa mundial, a indústria farmoquimica e farmacêutica local perde em estágio de competitividade e desenvolvimento. Por outro lado, os resultados demonstram a robustez da metodologia e sua capacidade de identificar pesquisadores em área específicas, oferecendo soluções para apoio a tomada de decisão e identificação de pesquisadores relevantes para o desenvolvimento do setor farmoquímico e farmacêutico. / [en] The solid-state chemistry area has received increased attention in the pharmaceutical research and development activities. The comprehension of the solid-state properties of an active pharmaceutical ingredient (API) is critical in the development of formulations due to their impact on the bioavailability and solubility of the final drug, being essential to ensure therapeutic benefit, optimize development and allow a proper intellectual property protection. This research investigates science and technology indicators in the solid-state chemistry area using data science tools applied to scientific publications and patent documents, aiming to contribute to the increase of the competitiveness of the pharmaceutical industry in Brazil and in other emerging markets. Through data science tools, a methodology based on text mining techniques associated to fuzzy relations is proposed. This methodology for identifying specific competencies is applied in the solid-state chemistry area exploring a case study of the discovery of a new polymorphic form of the API dexamethasone acetate. The results reveal the existence of scientific competencies in solid-state chemistry in Brazil. However, when compared to the global university-company interaction, the local pharmaceutical industry shows a lower stage of competitiveness and development. On the other hand, the results indicates the robustness of the methodology and its ability to identify researchers in specific areas, offering solutions to support the decision making and identification of researchers relevant to the development of the pharmaceutical sector.

Politics, subjectivity and the public/private distinction : the problematisation of the public/private relationship in political thought after World War II

A critical investigation of the public/private distinction as it has been conceived in Anglo-American political thinking in the second half of the 20th century. A broadly held consensus has developed amongst many theorists that public/private does not refer to any single determinate distinction or relationship but rather to an often ambiguous range of related but analytically distinct conceptual oppositions. The argument of this thesis is that if we approach public/private in the search for analytic or conceptual clarity then this consensus is correct. Against this I propose that a number of the most dominant invocations of the distinction can be understood to express public/private as an irreducibly political dialectic that mediates the relationship between the subjective and objective side of social and political life. By locating these conceptually diverse invocations within a broader and more determinate framework of the historical development and contestation of the boundaries which establish the conditions for subjectivity, as the assertion of political agency, on the one hand, and which demarcate, police and defend these particular boundaries, as part of the objectively given character of social life and institutional organisation, on the other hand, then a more determinate character to public/private can be recognized. I then seek to explore the capacity of this model to capture and explain the peculiar post-war problematisation of public/private amongst a number of new left thinkers in Britain and America.
