The role of the investigator in the prosecution process

The process of investigation, which begins when a crime is reported and ends after a suspect has been convicted or discharged by a court of law, is a mammoth task which requires cooperation between various stakeholders, such as investigators and prosecutors. The purpose of this study was to determine the role of the specialized commercial crime investigators in the prosecution process. The study evaluated and explored the status of the current roles played by these investigators with the intention of recommending changes that could improve investigator practice. Two research questions were posed. First, the researcher endeavoured to find answers to a question regarding what the prosecution process entails. Secondly, the researcher sought to establish the roles of the specialised commercial crime investigator in the prosecution process. It was envisaged that the answers to these questions could be obtained from specialised commercial crime investigators and prosecutors deployed in the commercial crimes courts. On this basis two samples were chosen, with nine investigators from the Gauteng North office of the Specialised Commercial Crimes Unit and four prosecutors from the Specialised Commercial Crimes Court in Gauteng North. Some of the findings were that the investigators in trying to fulfil their roles of investigations have an adverse impact on the investigation and successful prosecution of offenders, which in turn lead to recidivism and apathy among the communities being served by the police and the justice system in general. The image of the police, particularly that of the commercial crime investigators, is often negated and the justice system is portrayed as a failure in addressing the problem of crime. The conclusions drawn from the data were that the roles of investigators in the prosecution process are mandatory as they are legislated rather that persuasive and that investigators cannot rely on prosecutors to handle all aspects of investigation once a case has been handed over to the prosecution. Apart from a lack of knowledge about these roles, it was established that some investigators deliberately ignore their roles in this relationship. It is proposed that dedicated training should be afforded to investigators and prosecutors above their existing training, with a focus on how to take part in the prosecution process. Investigators should be informed that their responsibilities in the prosecution process are a result of legislation and that failure to satisfy the legislation will carry adverse consequences for the investigation itself, the prosecution and the other stakeholders. / Criminal and Procedural Law / M.Tech. The value of first report statements in the investigation of rape

In this research, the first report statement is evaluated, in order to establish whether the information contained in the first report statement is considered during rape investigations. The researcher explored how investigators and public prosecutors utilise the first report statements in order to ensure an effective criminal justice system. The researcher made use of (a) an empirical design, because of the limited information available on the research topic, and (b) a qualitative research approach – which enabled real-life observations. Simple random sampling was used to select 28 investigators of rape and sexual offence related cases, four (4) prosecutors attached to sexual offences courts, and one (1) advocate from Gauteng North High Court. The search is assumed that after the process of democratization, the Brazilian state has experienced a new constitutionalism, encouraging new time to seek effective constitutional guarantees, setting up what will be called judicialization of politics in this inset the participation of the Judiciary, the Ministry public and civil society by the action of social movements, lead to a relentless pursuit of recognition and therefore construction of social identities. Understanding the relationship between law and politics, theoretical part of this arrangement, being guided by the phenomena of the contemporary debate legalization and judicial activism. The logic of any research that set the conceptual and empirical analysis of social transformations, guided by the action of those that structure the State, is the understanding that everything will be built will be based on a true democratic state of law, directing roughly the effective organization that society we want to search. / Este presente trabalho tem por intuito analisar o Poder Judiciário e o processo de construção das identidades sociais no Brasil após a Constituição de 1988. A pesquisa tem como pressuposto que após o processo de redemocratização, o Estado brasileiro vivenciou um novo constitucionalismo, fomentando novo momento para busca efetiva das garantias constitucionais, configurando o que será denominado de judicialização da política, nesse entremeio a participação do Poder Judiciário, do Ministério Público e da sociedade civil pela ação dos Movimentos Sociais, conduzirá para uma busca incessante do reconhecimento e conseqüentemente para construção das identidades sociais. Entender a relação direito e política, faz parte desse arranjo teórico, sendo orientada pelo debate contemporâneo dos fenômenos da judicialização e ativismo judicial. A lógica de qualquer pesquisa que configure a análise conceitual e empírica das transformações sociais, orientadas pela ação daqueles que estruturam o Estado, está no entendimento que tudo que será construído terá como base um verdadeiro estado democrático de direito, orientando grosso modo a efetiva organização daquela sociedade que se quer pesquisar.

Approche critique de la lutte contre l'impunité menée au sein des juridictions pénales internationales : réflexions sur l'opportunité des poursuites du Procureur international / Critical approach to the fight waged against impunity in the international criminal courts : reflexions on the prosecutorial discretion of the International Prosecutor

Après avoir procédé à un état des lieux de la poursuite des crimes internationaux et de l'exercice de l'opportunité des poursuites du procureur tant au niveau national qu'international, il s'agira de mettre en exergue les faiblesses procédurales encadrant l'action du Procureur lors de la phase préliminaire du procès pénal et les inconvénients générés par sa politique pénale de poursuite au sein des TPI ad hoc. En effet, ces défectuosités participent à l'apparence de partialité du Procureur international et de la crise de légitimité dont souffrent les TPI ad hoc accusés d'être à l'origine d'une justice des vainqueurs. La faible place accordée aux victimes, sans doute favorisée par un système de common law réfractaire à toute implication de la victime dans le processus pénal, participe à cette perception de partialité générée par une politique de poursuite peu représentative des conflits en cours. Néanmoins, l'influence progressive du droit romano-germanique dans la procédure pénale de la CPI a introduit quelques améliorations toutefois insuffisantes pour pallier à la crise de confiance héritée des TPI. La décision du Procureur international de ne pas poursuivre (ou inaction) n'étant soumise à aucun contrôle ou à un contrôle balbutiant et face aux dérives constatées, la mise en place d'outils de contrôle et / ou contrepoids pourrait-elle permettre aux juridictions pénales internationales de lutter avec efficacité contre l'impunité et s'affranchir d'une emprise politique évidente: Des éléments de réponse pourront être soutenus dans une analyse actuelle et prospective de la Cour pénale internationale, et dans la nécessité d'une présence toujours plus assumée au sein des juridictions pénales internationales d'un droit romano-germanique dont le rôle processuel des victimes et ses représentants dans le déclenchement des poursuites contribuera à éclairer la conception de la stratégie de poursuite du Procureur international. / We will first assess the present state of the prosecution of international crimes, as well as that of the use made by prosecutors of the principle of opportunity, both on the international levels. This will allow us to underline the procedural weaknesses constraining the action of the Prosecutor, during the preliminary phase of the trial, as well as the drawbacks created in the work of ICC by the prosecution policy of the International Prosecutor. True enough, these imperfections play a major part in giving him the appearance of partiality, and contribute to the legitimacy crisis plaguing the ad hoc ICTs, which are often accused of bringing about a victor's justice. This appearance of partiality, also often created by the fact that the present prosecution policy ill-represents the on-going conflicts, is further strengthened by the small place which is given to the victims in front of the International Courts. This is because the international court system is first and foremost based on common law, which does not favour the intervention of the victims in the legal proceedings.Nevertheless it is possible to note that the growing influence of continental law on the criminal proceedings at the ICC has permitted the introduction of improvements, however insufficient they may be to end the crisis of confidence inherited from the ICTs. Thus, we can ask ourselves whether the lack or stammering of controls, set upon the positive or negative prosecution decision of the International Prosecutor, should not be remedied with a greater degree of checks and balances, therefore allowing the international criminal courts to work with greater efficency against impunity whilst, at the same time, setting themselves free from an obvious political hold. Answers can be found in a prospective analysis of the present workings of the ICC. This analysis will demonstrate the need for the ICC to draw a greater inspiration from continental law, in particular with regards to the role played by the victims and contribute to throw light on how the International Prosecutor builds his strategy.

O presente estudo enfoca o termo de compromisso de ajustamento de conduta celebrado perante o Ministério Público do Trabalho. Importante salientar que os conflitos de massa trouxeram nova roupagem ao sistema jurídico brasileiro de forma a consagrar e a insculpir o preceito da tutela coletiva. Neste sentido, a efetividade dos direitos metaindividuais ganhou corpo por intermédio das formas extrajudiciais e judiciais de solução de conflitos coletivos, tudo em prol da garantia dos direitos sociais, da paz social e do pleno emprego. A coletivização dos interesses implicou redução dos conflitos trabalhistas individuais, abrangência de interesses de grupo, categoria ou classe, maior observância dos valores sociais do trabalho, conciliando, portanto, os princípios fundamentais e basilares da República Federativa do Brasil. O alicerce dos direitos metaindividuais trabalhistas estrutura-se nos direitos humanos fundamentais e, neste contexto, devem pautar-se as cláusulas mínimas a serem estipuladas no ajuste de conduta como forma de tutela contra as lesões a interesses difusos e coletivos na esfera da relação de trabalho. A defesa da ordem jurídica, do regime democrático e dos interesses sociais e individuais indisponíveis foi conferida ao Parquet Trabalhista na qualidade de órgão agente e consagrada pela Constituição de 1988, dissociando-se, efetivamente, da função eminentemente parecerista (órgão interveniente) até então prevalecente. A estrutura do termo de compromisso de ajustamento de conduta, bem como sua forma de celebração, natureza jurídica, objeto, limite das cláusulas, dano moral coletivo, hipóteses de flexibilização da multa estipulada, competência territorial para assinatura, descumprimento do ajuste, além de outros aspectos polêmicos alusivos ao tema constituem objeto da presente dissertação. Não menos importante é a abordagem do procedimento investigatório e do inquérito civil, instrumentos comumente utilizados no exercício do poder de investigação consagrado pelo artigo 127 da Constituição Federal brasileira à Instituição do Parquet em defesa da ordem jurídica, do regime democrático e dos interesses sociais e individuais indisponíveis. / The present study focuses on the commitment/agreement term of conduct settlement signed before the Labor Public Prosecution Office (Prosecuting Counsel). It is important to stress that the mass conflicts brought new drapery to the Brazilian legal system in order to establish and inscribe the precept of the collective protection/injunction. So, the effectiveness of the metaindividual rights got stronger through the mediation of the extrajudicial and judicial forms of solution of the collective conflicts, everything in favor of the social rights guaranty, social peace and full employment. The collectivization of the interests implied reduction of the individual labor conflicts, coverage of the interests of group, category or class, better compliance of the social values of work, reconciling, therefore, the fundamental and basic principles of the Federative Republic of Brazil. The basis of the labor metaindividual rights structures itself in the fundamental human rights and, in this context, there should be the minimum clauses to be stipulated in the conduct settlement as a form of tutelage against the damages to diffuse and collective interests in the sphere of the working relationship. The defense of the legal system/order, the democratic regime and of the unavailable social and individual rights was given to the Labor Parquet as an agent organ and consecrated by the 1988 Constitution, dissociating, effectively, from the eminently function of giving an option (intervening Organ) prevailing until then. The structure of the commitment/agreement term of conduct settlement, as well as its form of celebration, legal nature, object, limit of the clauses, collective wounded feelings, hypotheses of relaxation of the stipulated fine, territorial jurisdiction for signature, noncompliance of the settlement/adjustment, besides other polemic aspects allusive to the theme are object of the present essay. Not less important is the approach of the investigative proceeding and of the civil investigation, instruments commonly used in the performance of the investigation Power consecrated by the section 127 of the Federal Brazilian Constitution to the Institution of the Parquet in defense of the legal system/order, of the democratic regime and of the unavailable social and individual rights.

Legislação urbanística: a norma e o fato nas áreas de proteção aos mananciais da região metropolitana de São Paulo / Urban law: ruling and reality in the areas of waterspring protection in the Metropolitan Area of São Paulo

O intenso processo de urbanização da Região Metropolitana de São Paulo na segunda metade do século XX foi diretamente influenciado pela propriedade privada e pela legislação urbanística. Enquanto as classes dominantes logravam influir sobre a legislação e sobre o direcionamento dos investimentos estatais em infra-estrutura em seu favor, restou às classes dominadas ocupar áreas invadidas ou se instalar em loteamentos de periferia, muitos em áreas de proteção ambiental. A legislação de proteção aos mananciais, editada nos anos setenta, procurou ordenar a ocupação destas áreas, porém é justamente lá que tem ocorrido o maior crescimento da região. A falta de eficácia da norma e a necessidade de garantir o abastecimento de água tornaram necessária a revisão da legislação, objetivando a composição do conflito entre direito à moradia e direito ao meio ambiente, que não devem ser vistos como antagônicos, e sim como conciliáveis. É necessária a implantação de políticas públicas de regularização fundiária sustentável, capazes de garantir a segurança da posse sem provocar danos ambientais. Incumbe à União, Estados e Municípios adotar medidas para possibilitar a regularização fundiária. A regularização administrativa de loteamentos pode ser promovida pelo Município, ainda que com prejuízo a seus padrões urbanísticos. O usucapião especial urbano, individual ou coletivo, permite a regularização fundiária de ocupações em áreas particulares. Nas áreas públicas, a regularização poderá se dar através da concessão especial de uso para fins de moradia, que também poderá ser individual ou coletiva. Caso seja necessária a remoção da população, deverá ser assegurado o exercício do direito à moradia em outro local. Poderá, ainda, ser celebrado termo de ajustamento de conduta perante o Ministério Público, atribuindo-se obrigações a todos os envolvidos na implantação do loteamento, com previsão de penalidade para o caso de descumprimento. A presente dissertação analisa essas questões por meio do estudo de casos inquéritos civis, ações civis públicas e julgados de quatro municípios da Região Metropolitana de São Paulo. O estudo de casos demonstra que houve muitas falhas do poder público no processo pelo qual a implantação das ocupações nas áreas de proteção aos mananciais ocorreu, contudo, mostra também que, quando todos os responsáveis se interessam, é possível encontrar soluções criativas e viáveis para os problemas. / The intense process of urban development in the Metropolitan Area of São Paulo on the second half of the XX Century was directly influenced by private property and urban law. While the upper classes succeeded in influencing urban law and the direction of state investments in infra-structure in their favour, the lower classes had to occupy public and private land or suburban subdivisions, most of which in areas of environmental protection. Watersprings protection laws, issued in the seventies, aimed at organizing the occupation of these areas, however it is exactly there that the area has grown most. The lack of efficacy of the law and the need to ensure the water supply created the need to review the laws, targeting conflict resolution between housing rights and the right to environment, which should not be seen as antagonistic, since they can be conciliated. It is necessary to promote sustainable land tenure regularization programmes, able to ensure the security of land tenure without environmental damages. The Union, the States and the Municipalities must adopt measures to attain this goal. The administrative regularization of subdivisions may be promoted by Municipalities, though with losses to its urban patterns. The special urban usucapiao (adverse possession), individual or collective allows the regularization of private areas. In public areas, regularization may occur through the concession of the real right of use, which can also be individual or collective. If the removal of the occupiers is necessary, housing rights should be ensured somewhere else. It is also possible to celebrate a conduct adjustment agreement with the Prosecution, in which obligations will be granted to all parties related to the subdivision, including sanctions fines in the case of noncompliance. The current dissertation analyses these matters through the case study of investigations, law suit and judicial decisions from four cities in the Metropolitan Area of Sao Paulo. The case study shows that authorities made many mistakes during the process of occupation of the watersprings protection areas, however it also shows that, when all parties are involved, creative and viable solutions for the problems can be found.

[pt] O aumento do crime organizado transnacional nas últimas três décadas fez com que as autoridades mundiais procurassem novos meios de enfrentar, reprimir e punir organizações cada vez mais poderosas. A soberania estatal impede a intervenção de terceiros nos assuntos internos dos Estados, mesmo quando se trata de delitos de repercussão internacional, impossibilitando a criação um órgão supranacional dotados de poderes para investigar e punir esses delitos. A única resposta encontrada pelos Estados foi o incremento dos tipos e da quantidade de medidas de cooperação internacional em matéria penal. Para isso, fez-se necessário rever os métodos tradicionais de cooperação judicial, outorgando às autoridades encarregadas da persecução penal maior autonomia para cooperar diretamente, sem intervenção judicial. No Brasil, mesmo que de forma mais vagarosa que no resto do mundo, o mesmo vai acontecendo. A tese propõe que a Constituição da República, da legislação infraconstitucional e dos tratados internacionais, que regulam a cooperação em matéria criminal celebrados pelo Brasil, revelam que o Ministério Público Brasileiro, em especial o Ministério Público Federal, tem o dever de cooperar com as autoridades estrangeiras no combate à criminalidade transnacional. É o Ministério Público o principal ator da persecução penal, sendo-lhe inerente papel a atribuição de realizar atos de cooperação internacional. Decisões recentes do Supremo Tribunal Federal e do Superior Tribunal de Justiça negaram a validade de atos de cooperação direta. Apesar disso, persistem fortes argumentos a favor da cooperação pelo MP, mesmo quando a medida solicitada pelo Estado estrangeiro depender da autorização dos órgãos da base do Poder Judiciário. / [en] In the last three decades the world has seen an astonishing rise in transnational organized crime, a challenge that made the International Society search for new ways to prosecute organizations that seem to grow more powerful every day. In International Society, each and every State is an independent and sovereign entity, which means that no other State or international entity may meddle in another Stat s internal affairs. This means that the prosecution of transnational crime cannot be entrusted to an international organ, nor can a State pretend to pursue an offender into another s territory. To overcome this barrier, new and faster methods of international cooperation have been adopted with authorities being granted a greater degree of autonomy to perform acts of mutual legal assistance. The same phenomenon is occurring in Brazil, although in a much slower pace. This doctoral dissertation seeks to establish that the Constitution, Brazilian procedural and criminal laws, and the international treaties to which Brazil is party assign to the Ministério Público - MP, as the autonomous government office in charge of criminal prosecution, the task to assist international authorities in prosecuting transnational crime. Specially at the Federal level, the Ministério Público is the main actor in the investigation and judicial prosecution of criminals, however recent decisions reached by the Supremo Tribunal Federal and the Superior Tribunal de Justiça, Brazil s highest courts, have voided acts of direct cooperation by judicial authorities, raising a lot of questions about the possibility of mutual legal assistance acts by Brazilian authorities. That notwithstanding, there are several arguments which were not presented to those courts that clearly show that the MP has a crucial role to play in international cooperation in criminal matters.

Si l’on s’accorde à dire que les droits de la défense sont un principe fondamental du droit processuel sans lequelune procédure ne saurait être dite équitable, le sens technique de cette notion demeure aujourd’hui toujoursobscur. En effet, l’approche traditionnelle consistant à définir les droits de la défense comme un ensemble degaranties dont dispose toute partie à une procédure afin d’y défendre ses intérêts ne parvient pas à lever toutesles incertitudes et, surtout, ne permet pas de comprendre rationnellement l’ensemble des hypothèses danslesquelles on peut constater leur utilisation technique et concrète.En arrière-plan des différentes garanties, les droits de la défense semblent se présenter comme un conceptdistinct de celles-ci. Ils sont en eux-mêmes une véritable norme introduite en droit positif sous la forme d’unprincipe fondamental dont les différentes garanties assurent l’effectivité. Imposant que toute personne soumise àun pouvoir décisionnel soit mise en mesure de se défendre, c’est-à-dire de soutenir ou de contester uneprétention, cette norme irrigue concrètement le droit positif en fondant aussi bien la nullité d’une procédure quel’irresponsabilité pénale de l’auteur d’une infraction. / If it is agreed that defense rights are a fundamental principle of procedural law, without which, no trial could besaid to be fair, the technical sense of this concept still remains obscure today. Traditionally defined as anensemble of guarantees, which each party to the proceedings is entitled to in order to defend its interests, thisplural approach to the concept does not however remove all uncertainties. It especially does not allow us torationally understand all the situations in which we can see its concrete and technical application.Among the different guarantees, defense rights seem to present themselves as a distinct, separate concept. Theyare in themselves a true standard introduced into the substasntive law in the form of a fundamental principlewhere the different guarantees ensure its effectiveness. Stating that any person subject to a decision-makingauthority should be able to defend her or himself, that is to say to support or to deny a claim, this legal standardencompasses, concretely, positive law by basing both the nullity of a procedure and the irresponsibility of anoffender.

La justice restaurative : étude comparée du droit thaïlandais et du droit français

L’émergence de la justice restaurative est le résultat d’une certaine inefficacité de la justice pénale classique. Le concept de la justice restaurative propose de répondre d’une façon novatrice à la criminalité et aux conflits. La justice restaurative se révèle être aujourd’hui une voie prometteuse de consolidation de l’harmonie sociale. Elle cherche à soutenir toutes les personnes impliquées (les victimes, les délinquants et les membres de la communauté), à leur donner des possibilités de participer et de communiquer et ainsi à favoriser une démarche de réparation afin de rétablir les liens sociaux brisés suite à l’infraction. Ces travaux de thèse ont pour objectif de connaître et comprendre la justice restaurative, les modalités et les mesures rencontrées notamment en France et en Thaïlande. À cet effet, nous avons posé deux questions centrales, à savoir : Quel est le cadre général et juridique de la justice restaurative ? ainsi que : Quelles sont les mesures existantes déclinées pour la mise en œuvre de la justice restaurative ? Grâce aux réponses apportées à ces questions, nous pourrons mieux connaître et comprendre la justice restaurative en France et en Thaïlande. / The emergence of restorative justice is the result of inefficiency of the classic criminal justice process. The concept of restorative justice offers innovative approach to crime and conflict. It appears to be a promising way to consolidate social harmony by supporting all the people involved (victims, offenders and community members). Restorative justice gives them opportunities to participate and communicate; and encourages a process of repair in order to mend the broken society bonds caused by offense. The aim of this thesis is to know about and understand terms and measures encountered during restorative justice programme in Thailand and in France. To do this, we need to answer two questions: what are the general and legal frameworks of restorative justice? and what are the existing measures implemented on the restorative justice? The answers of these questions should give us a better understanding of the restorative justice of both countries.
