Management efektivního jištění stavebních zakázek z pohledu veřejného investora / Management of effective protection of construction contracts from the perspective of the public investor

The doctoral thesis deals with an analysis and comparison of the effective protective forms for construction contracts from the perspective of the investor/contracting authority in public construction work orders according to Act No. 134/2016 Coll., on Public Procurement. The theoretical part includes the risk management of construction projects with regard to the management of the business risk. The functions of protective forms within the project life cycle are described. The legal standards and regulations related to the procurement process and the contract management between the client and the main contractor are presented. International legal standards used for construction projects in the Czech Republic and abroad are mentioned. The aim of the thesis is to investigate the current situation and to create a model of management of business risk as a methodical practical approach for the public investor. Quantitative research of the protective forms in the contracts for works was conducted. The research data consisted of a database of selected public works contracts published on the public profiles of the contracting authorities during the performance phase of contracts during the years 2011–2018. Within the data analysis, a structured database of inputs and the used protective forms was created according to the documentation of the construction work orders. Furthermore, the relationship between the estimated value of the contract and the contract price was examined. Based on the data analysis and the benchmark study the model of management of business risk was created. To optimize the selection of protective instruments in works contracts, a portfolio of effective protective forms and their recommended parameters was proposed. The quantitative analysis was complemented by the questionnaire survey method and the structured interviews with the public sector representatives. The results of the research were compared with current international practice.

This work deals with the bid price for a development project base on the construction of houses funded by a private German investor. The bid price create with help of budget in a various structures. The various structures of the budget, which use in German environment usually. Specifically, it uses the norm DIN 276 and classification StLB includes software. The main target of my diploma thesis is suggestion for create the bid price. The suggestion with choose form and manner of valuation build works, which respect all legislation for realization construction in Germany.

Making the Desert Blossom: Public Works in Washington County, Utah

The following thesis is a study of how communities of Washington County, Utah developed within one of the most inhospitable deserts of the American West. A trend of reliance on public works programs during economic depressions, not only put people to work, but also provided an influx of outside aid to develop an infrastructure for future economic stability and growth. Each of these public works was carefully planned by leaders who not only saw the immediate impact these projects would have, but also future benefits they would confer. These communities also became dependent on acquiring outside investment capital from the Mormon Church, private companies and government agencies. This dependency required residents to cooperate not only with each other, but with these outside interests who now had a stake in the county's development. The construction of the Mormon Tabernacle and Temple in St. George during the 1870s made that community an important religious and cultural hub for the entire region. Large-scale irrigation and reclamation projects in the 1890s opened up new areas for agriculture and settlement. And in the 1920s and 1930s the development of Zion National Park and the construction of roads provided the infrastructure for one of the county's most important industries, tourism. Long after these projects' completion they still provided economic and cultural value to the communities they served. Some of these projects provided the infrastructural foundation that allowed Washington County communities to have greater security and control over their economic future. Over time the communities of southern Utah created dramatic reenactments and erected monuments of these very projects to celebrate and preserve the story of their construction. During the first decade of the twenty-first century Washington County has become one of the fastest growing areas in the country, and as a result public works programs continue to be important to support this growth.

Le contrat de société en participation / The contract of joint-venture

La société en participation ne s’analyse pas comme une société classique. Elle ne se dissout pas, elle est résolue ou résiliée, comme tout contrat de partenariat. Sa force, sa réalité, demeure dans le contrat librement choisi par les participants, tant dans son élaboration que dans l’organisation même de la société, situation intermédiaire entre un contrat classique et les sociétés institution. C’est l’application du principe d’autonomie de la volonté. Dans ce cas de figure, l’affectio societatis se rapproche le plus de la notion de jus fraternitatis, du moins lors de l’élaboration des statuts, ce que certains auteurs nomment l’affectio contractus. Finalement, en raison de son caractère éminemment contractuel, à la place de société en participation, ne faudrait-il pas plutôt l’appeler contrat de société en participation ? Il s’agit dès lors de lui reconnaître son caractère de contrat à part entière, un contrat nommé du Code civil. La jurisprudence semble aller dans ce sens. / The joint-venture company cannot be analysed like a typical firm. It cannot be dissolved; it is solved or cancelled, as is any partnership agreement. Its strength, its reality, remains in the contract freely chosen by the participants, both in its elaboration and in the very organization of the firm, which consists in an intermediate situation between a classic contract and an “institution firm”. It is the application of the principle of will autonomy. In such a case, the “affectio societatis” is as close as it gets to the notion of “jus fraternitatis”, at least during the elaboration of the statutes which some authors name the “affectio contractus”. Eventually, because of this eminently contractual character, instead of joint-venture firm, should we not call it a firm participation partnership? What’s at stake here is the acknowledgment of its full contract character, as a contract named by the Civil code. The jurisprudence seems to go in that direction.

Dentro de uma abordagem cultural, esta pesquisa de campo do tipo qualitativa tem como objetivo geral problematizar as estratégias utilizadas pelos gestores públicos para justificar e viabilizar o projeto da Via Mangue, mais especificamente no que diz respeito à expulsão dos moradores das referidas localidades, refletindo as táticas dos sujeitos na recepção do mesmo. Como objetivos específicos, a pesquisa visa Analisar: de que forma eram produzidos e praticados os espaços, assim como as sociabilidades no bairro de Boa Viagem, dando atenção especial à experiência dos moradores das localidades “Xuxa” e “Deus nos Acuda”; problematizar os discursos dos gestores públicos enquanto parte das estratégias no contexto das relações de forças sociais, nos quais a inclusão social e a dignidade dos moradores das localidades aparecem como argumentação para implantação do projeto da Via Mangue; analisar como a população das localidades “Xuxa” e “Deus nos Acuda” se apropriou do projeto da prefeitura, com suas táticas e astúcias, na luta pela recriação de espaços e de identidades. Estes objetivos foram discutidos, respectivamente, numa estrutura de três capítulos consecutivos e articulados entre si. Para operacionalizar as análises, utilizei como principais conceitos os de “espaço”, “lugar”, “tática”, “estratégia” e “apropriação” de Michel de Certeau; de “identidade” na obra de Stuart Hall e Tomaz Tadeu da Silva. No que diz respeito à natureza das fontes, este trabalho pode ser inserido no campo da história oral, uma vez que tem como fontes os relatos de memória dos ex-moradores das localidades “Xuxa” e “Deus nos Acuda”. Foram utilizadas também como fontes adicionais publicações jornalísticas impressas e eletrônicas. Foram feitas entrevistas, observações simples de campo, análises fotográficas, além de pesquisas bibliográficas. A metodologia de procedimento utilizada foi a Análise de Discurso. Os dados coletados e suas análises levam à conclusão de que a expulsão dos moradores das já referidas localidades constituiu um processo marcado por contradições que não eliminou, mas apenas deslocou fronteiras de segregação espacial, além de provocar o desenraizamento cultural e a precarização das condições socioambientais daqueles moradores. A população expulsa, no entanto, não teve uma atitude passiva diante das estratégias do poder público, tendo desenvolvido, ao invés disso, uma atitude produtiva e determinante na recriação do seu cotidiano, o que “rachou ao meio” as estratégias do poder público, o qual terminou por colher resultados diferentes dos planejados. / In this dissertation I analyze the impacts imposed on the daily life of residents in two poor neighborhoods in Recife -PE, called "Xuxa" and "Deus os Acuda". These inhabitants were expelled by the government from the area which they occupied in the edges of the Boa Viagem mangroves, because of the construction of the Via Mangue. This road was proposed to solve, according to its creators, problems related to urban mobility , environmental preservation and public housing in the southern area of Recife. In a cultural approach, this qualitative research aims to discuss the strategies used by public managers to justify and facilitate the Via Mangue project, specifically regarding to the expulsion of the inhabitants of these areas, reflecting the tactics of the subjects in the reception of this. The specific objectives are: to analyze how were produced and practiced spaces, as well as sociability in Boa Viagem district, giving special attention to the experience of the residents of the localities "Xuxa" and "Deus nos Acuda"; problematize the discourses of public managers as part of the strategies in the context of relations of social forces, in which the social inclusion and the dignity of the residents of the localities appear as arguments for the implementation of the Via Mangue project; to analyze how the population of "Xuxa" and "Deus nos Acuda" appropriated the city hall project, its tactics and gimmicks in the struggle for recreating spaces and identities. These objectives were discussed in a structure of three consecutive and connected chapters, respectively. To perform the analysis, I used the concept of "space", "place" , "tactic" , "strategy" and "ownership" according to Michel de Certeau , the concept of "identity" according to Stuart Hall and Tomaz Tadeu da Silva. This work can be classified as oral history because its sources are reports of former residents’ memories from "Xuxa" and "Deus nos Acuda". Furthermore, print and electronic journalistic publications were used as sources. Interviews, field observations, photographic analyses and literature searches were performed. The method used was Discourse Analysis. I concluded that the expulsion of the residents from the localities was a process marked by contradictions which did not eliminate, but shifted boundaries of spatial segregation and caused cultural rootlessness and impaired the environmental conditions of those residents. The expelled population, however, did not have a passive attitude towards the strategies of the government, instead, they developed a productive and peremptory attitude in the recreation of their daily life, braking the strategies of the government which resulted differently than originally planned.
