Educational change : the case of Newfoundland

Text in English, abstract in English and Afrikaans / Dramatic changes in Newfoundland's environment and global developments during the past decade, significantly influenced growing demands for restructuring the education system of Newfoundland. Responding to these demands, Newfoundland educators succeeded in creating a single unified non-denominational education system which became fully operational at the beginning of the 1998/99 school year. This achievement has been hailed by the majority of Newfoundlanders as a monumental landmark in the provinces' lengthy experience with denominational education. As well, it is viewed as pivotal in achieving educational excellence and ensuring that children receive a relevant education that will prepare them for the demands of the next century. The former education system (which consisted of four separate denominational school systems operated jointly by the church and the state) had become too cumbersome and inefficient, thus adversely affecting the quality of education. This thesis looks in particular at the contextual realities and perspectives that influenced the demands for changing the system. Such factors as the declining school population, economic conditions, technological developments, as well as legal and political issues have distinctly changed the Newfoundland society during the past number of years, hence the necessity to restructure the education system. The thesis furthermore discusses the proposed government model for restructuring the system and highlights the proposals for improving education. It also focuses briefly on the minority rights issue in Canada, as this has bearing on the legal rights of the church to educate in Newfoundland and its current role within the new structure. An evaluation of Newfoundland's educational reform initiatives (which includes the views of key educators in Newfoundland on these issues), deals with some of the problem areas which currently exist within the new system. However, the focus centres mainly on the obvious improvements in such areas as management, organization, parent involvement, curriculum development, educational achievement and accountability. The impact of these reforms on the social, educational and political dimensions of the Newfoundland society will only become evident in time, yet they hold the promise of having a lasting impact on educational achievement. The remarkable feature of the whole reform process is, that it was achieved from within. / Die ingrypende veranderings wat die Newfoundlandse gemeenskap oor die afgelope dekade ondergaan het, tesame met ontwikkelings op wereldvlak, het aanleiding gegee tot toenemende eise om die onderwysstelsel van Newfoundland te herstruktureer. Gevolglik onderneem die Newfoundlandse regering 'n omvattende herondersoek van die onderwys wat lei tot die vorming van 'n enkele, openbare, ge'integreerde onderwysstelsel wat aan die begin van die skooljaar 1998/99 in werking tree. Hierdie prestasie word as 'n besondere keerpunt in die onderwys deur Newfoundlanders beskou, aangesien die behoud en vooruitgang van die Newfoundlandse gemeenskap en onderwys daardeur verseker word. Voorheen het die onderwysstelsel uit vier afsonderlike kerkskoolstelsels bestaan wat gesamentlik deur die staat en kerk op alle vlakke beheer en bestuur is. Hierdie eiesoortige struktuur het die onderwys al hoe meer belemmer en opvoedkundiges genoodsaak om dit te hersien. Hierdie studie kyk eerstens na die vergestaltende faktore en lewensbeskouings wat die onderwys in Newfoundland ten diepste raak. Faktore soos dalende geboortegetalle, ekonomiese toestande, tegnologiese en staatkundige ontwikkelings dra veral by tot die veranderde leefwereld van die Newfoundlander en noop die regering om die onderwysstelsel daarby aan te pas en 'n onderwysmodel vir die toekoms te ontwerp. Hierdie onderwysmodel wat alle komponente asook die struktuur van die onderwysstelsel aanraak, word vervolgens ontleed. Aandag word ook gewy aan die kwessie van minderheidsregte in Kanada, omdat dit die kerk se reg om onderwys in Newfoundland te bedryf, raak. Laastens word die onderwyshervormings vanuit sekere perspektiewe in oenskou geneem en die standpunte van sommige Newfoundlandse opvoedkundiges word gestel. In die slotbeskouing word ook enkele probleme ge'identifiseer. Die bespreking word egter hoofsaaklik gewy aan aspekte van die onderwys wat alreeds verbetering toon soos onder andere onderwysbeheer en onderwysorganisasie, ouerbetrokkenheid, curriculumontwikkeling en onderwyskundige ontwikkeling. Die toekoms sal bepaal hoe hierdie omvangryke en omvattende onderwysveranderings die sosio-kulturele dimensies van die Newfoundlandse gemeenskap sal be'invloed, terwyl dit die belofte inhou om 'n dinamiese verbetering te bewerkstellig. / Educational Studies / D. The influence of a changing school environment on school management

South Africa, a country in transition, is characterised by drastic policy shifts in the social, economic and political arenas. These policy shifts are also directed towards educational reform. The South African Schools Act of 1996 is the first step towards educational change. Other changes focus on the curriculum, new appraisal procedures for educators, and the establishment of the South African Council for Educators. All of the above constitute a new working paradigm for school principals. This study sought to determine the influence of this changing school environment on school principals. It looked at how principals perceive the change and examines the impact of change on their management role. A literature study was made of the restructuring process in the USA and in England and Wales. The transformation of the South African education system was also examined. A qualitative investigation was pursued with secondary school principals. Data gathering was done through participant-observation, questionnaires and in-depth interviews. Data was analysed, discussed and later synthesised. The major findings with respect to the SA Schools Act are: * * The lack of capacity of governing body members to participate meaningfully at meetings. Principals believe the ban on corporal punishment has weakened their authority. * School fees and fundraising pose a problem to some principals. * Most principals welcome the code of conduct for learners. * Schools have not developed language policies. * Principals accept the freedom of conscience clause in the Act. * SRC's are not very effective. The other findings are: * * * Power relations between and among various stakeholders impact negatively on school management. A breakdown in the culture oflearning and teaching especially in former DET and HOD schools. Teachers are not adequately trained to handle OBE and the new system of assessments. Para ampliar esse conhecimento, realizou-se uma revisão integrativa da literatura nacional, por meio das bases de dados LILACS e SCIELO, relativa ao período de 2000 a 2009, sobre o trabalho domiciliar, as condições em que ele acontece e suas repercussões na saúde dos trabalhadores, com o propósito de contribuir para o desenvolvimento de ações de vigilância em saúde para esta categoria de trabalhadores. A amostra utilizada possui 11 trabalhos, de diversas regiões do país. O estudo evidenciou que tanto em metrópoles como em cidades de médio porte, ou mesmo em pequenas cidades da Zona Rural, os trabalhadores em situação de trabalho precário, incluídos aí os trabalhadores domiciliares, tiveram sua saúde afetada pelas condições em que executavam suas atividades. Observou-se que o trabalho domiciliar é fruto da exclusão social e nele encontramos diversos fatores de riscos para a saúde dos trabalhadores. De modo agravante esses fatores de riscos à saúde se estendem além dos próprios trabalhadores, atingindo seus familiares, particularmente idosos e crianças, considerados mais vulneráveis aos efeitos deletérios para a saúde, decorrentes da exposição a que estão sujeitos. Constatou-se a subtração de direitos fundamentais à dignidade da pessoa humana, a negação da equidade, da justiça e da cidadania. É importante ressaltar também que o trabalho domiciliar não deve ser visto como um fenômeno isolado; o mercado de trabalho absorveu essa modalidade de trabalho, promovendo a naturalização da sua precariedade, conformando-o como importante alternativa ao trabalho convencional. Os resultados sugerem que a relação entre trabalho e doença é um processo complexo e dinâmico e que o Sistema Único de Saúde, através das ações de vigilância em saúde dos trabalhadores, pode contribuir para melhorar ou minimizar estasituação. Embora o mundo do trabalho seja muito heterogêneo, há que se conhecer, discutir, refletir e buscar soluções viáveis nos diversos órgãos do governo, no sentido de resgatar o direito ao trabalho decente, à saúde, à proteção social, enfim, à dignidade dos trabalhadores que estão à margem da sociedade e invisíveis aos olhos do Estado. / In the context of globalization, the home-based work is incorporated into the Brazilian productive restructuring process and needs to be unveiled. Aiming to increase knowledge on the issue of home-based work, was held an integrative literature review of studies published in SciELO and LILACS databases, in Portuguese, in the years 2000 to 2009. The goal was to organize, to systematize and to analyze the scientific production on the home-based work, the conditions in which it happens and the impact on the workers’ health, with the objective of contributing for the development of a politics for the surveillance of home-based workers’ health. The sample consisted of eleven articles, from several areas of the country. The findings evidenced that, in a similar way despite of the size of the city, the workers in precarious labor conditions, including the home-based workers, had their health affected by the conditions in which they made their job. It was also observed that the home-based work, where we can find different risk factors for workers’ health, is a consequence of social exclusion. In an aggravating way, these risk factors extend to the workers’ families, especially elders and children, more vulnerable to the harmful effects. It was possible to verify the subtraction of fundamental human rights, the negation of equity, justice and citizenship. It’s also important to emphasize that home-based work should not be regarded as an isolated phenomenon; the labor market absorbed this form of work, promoting the naturalization of its precariousness, conforming it as an important alternative to conventional labor. The results suggest that the relation between work and health is a dynamic and complex process and the Unified Health System (SUS) may contribute, through surveillance actions for the home-based workers, to improve the scenery. Although the work’s world is very heterogeneous, we must know, discuss, reflect and search for feasible solutions in the various government agencies, in order to redeem the rights to a decent work, to health, to social protection, finally to dignity, to the workers that are on the fringes of society and invisible to the State’s eyes.

Peut-être l'épopée d'Alexandre le Grand a t-elle contribué à construire cet objectif quasi mystique. Quoi qu'il en soit, le XIXe siècle est celui de sa rationalisation. L'invention de la locomotive et celle du navire à vapeur permettent d'amorcer un processus de mise en réseau du monde. Sur les cinq continents, les villages, les villes et les ports s'interconnectent progressivement, engendrant une mondialisation des flux commerciaux et humains. Ce mouvement est orchestré par les grandes puissances européennes, dont le pouvoir est fondé sur la conquête de nouveaux marchés et sur l'importation des matières premières essentielles à leur essor. Londres et Bombay forment alors deux pivots incontournables, permettant de rediriger les flux en circulation à l'échelle trans-continentale. Entre ces deux points, Suez joue le rôle d'interface entre la mer Rouge et la Méditerranée. Au cours de la seconde moitié du XIXe siècle, l'espace balkanique est progressivement intégré à ce système-monde. Maybe Alexander the Great's conquests contributed to forge this quasi-mystical aim. Wherever it comes from, the XIXth century is the one of its rationalization. Inventions such as steam locomotive and steamship allow to begin a global networking process. On five continents, villages, cities and ports, are progressively interconnected, generating a globalization of human and trade flows. This movement is orchestrated by the major European powers, whose expansion is based on the conquest of new markets and on the importation of natural resources required for their development. London and Mumbay play at that time a pivotal role, allowing to reroute flows in circulation at the inter-continental scale. Between these two major cities, Suez is an unavoidable crossing point between the Mediterranean and the Red Sea. During the second half of the XIXth century, the Balkan space is progressively integrated to this world-system. In that region, the introduction of railway induces a radical restructuring of power relations, whether political, economical or military. For this reason, the establishment of railways in the Balkans results from an interlacing of influencing strategies, articulated at various scales. This thesis sets out to highlight them.

This research‟s analysis has its starting point with the contemplation on the binomial of the mitigation of work and the costs reduction present in this form of hiring workers, so as to attend to the logics of the capitalist restructuration, in a total disagreement with the conceptions of cooperativism. Three pivotal questions are elected for the comprehension of the phenomenon. In the first one, the cooperativism‟s historical trajectory is rescued, since its original conception, ideological aspects, global expansion, and the way through which it was implanted in Brazil, in addition to recovering international organisms‟ conceptions, those of the International Cooperative Alliance and the International Labor Organization (ILO), and the national legislation that concerns the cooperatives. In the second pivotal question, the relevant transformations in the capitalist means of production and their effects in the world of work are discussed, being emphasized the outsourcing process and its effects, among which the mitigation and the discussions that bring together disgraced workers of informality. Also discussed in this topic is whether the Labor Cooperatives consist of an alternative to insert workers into the market or if they contribute to deplete work relations once it reduces costs for the hiring company and the service taker. In the third pivotal point, it is presented a theoretical-conceptual discussion on the cost of work and the social duties in the employment relations as well as the cost of the work coming from associated workforce and the way how they influence the form how private companies and public entities hire their employees. The figures of Brazilian cooperativism, and especially in the state of Maranhão are evidenced as well as the discussion over the role that workforce cooperatives possess, they being subspecies of Labor Cooperatives before the new law of cooperatives as a way to correct the presented distortions. / Este trabalho centra-se no estudo das cooperativas de mão de obra no Maranhão, no período de 1990 a 2010, que a exemplo dos demais estados brasileiros, proliferou como forma de intermediação de mão de obra para atender às necessidades de terceirização de empresas privadas e entes públicos. A análise desta pesquisa tem como ponto de partida refletir sobre o binômio da precarização do trabalho e redução de custos presentes nessa forma de contratação de trabalhadores, para atender à lógica da reestruturação capitalista, em completo desacordo com as concepções do cooperativismo. Elegem-se três eixos centrais para a compreensão do fenômeno. No primeiro eixo, resgata-se a trajetória histórica do cooperativismo, desde a sua concepção originária, aspectos ideológicos, expansão mundial, e modo como foi implantado no Brasil, além de recuperar as concepções de organismos internacionais, da Aliança Internacional do Trabalho e da Organização Internacional do Trabalho OIT e a legislação nacional que trata das cooperativas. No segundo eixo trata-se das transformações relevantes no modo de produção capitalista e seus reflexos no mundo do trabalho, com enfâse para a terceirização e seus efeitos, dentre os quais a precarização e as discussões que aproximam os trabalhadores precarizados da informalidade. Discute-se neste tópico se as cooperativas de mão de obra se constituem em alternativa para inserir trabalhadores no mercado ou se contribuem para precarizar as relações de trabalho a pretexto de reduzir custos para as empresas contratantes e a tomadora de serviços. No terceiro eixo apresenta-se uma discussão teórico-conceitual sobre o custo do trabalho e dos encargos sociais nas relações de emprego, o custo do trabalho da mão de obra associada e o modo como influenciam a contratação de trabalhadores pelas empresas e pelo poder público. Apresentam-se os números do cooperativismo brasileiro e no Estado do Maranhão e retoma-se a discussão sobre o papel das cooperativas de mão de obra, como subespécie das cooperativas de trabalho diante da nova lei das cooperativas como forma de corrigir as distorções apresentadas.

Além da aferição do tempo médio de cada uma das etapas previstas na Lei de Recuperação de Empresas (deferimento do processamento da recuperação judicial, concessão da recuperação judicial e encerramento do processo após cumprimento de todas as obrigações previstas no plano que se vencerem até dois anos depois da concessão da recuperação judicial), busco também verificar se, de fato, alguma sociedade requerente conseguiu se recuperar. Para tanto, considerarei recuperada a sociedade que, após o encerramento do processo, estiver cumprindo plenamente o seu plano de recuperação, sem que tenha havido qualquer requerimento posterior de falência. Considerando que a Lei de Recuperação de Empresas já está no seu sétimo ano de vigência, bem como o fato de o legislador ter idealizado o processo para que dure no máximo 3 anos, entendo não haver óbices à adoção do conceito supra, tendo em vista que já haver tempo suficiente para o início e encerramento desse tipo de processo. Diante disso, o presente estudo observou que o tempo médio para cumprimento das etapas ultrapassa o limite do razoável, bem como que nenhuma sociedade conseguiu se recuperar até o desfecho da pesquisa, havendo casos, inclusive, de convolação da recuperação judicial em falência. / This study focus on analyzing the judicial recovery proceedings from its beginning, since The New Business Restructuring and Bankruptcy Law's effectiveness (February of 2005) until June 31st, 2011, when its use started on the enterprise matters court of the State of Rio de Janeiro. The analyzes will be done through all phases predicted on the New Business Restructuring and Bankruptcy Law, such as the acceptance of the process of Judicial Recovery, the granting of the judicial recovery and the closure of the process after fulfillment of all obligations predicted on the recovery plan in the period limit of 2 years after the granting of the judicial recovery plan. This analyzes also confirm if any Company had in fact been able to recover after this process. For this purpose, it shall be considered recovery a Company that has fulfill it plans after the Regarding the 7th anniversary of The New Business Restructuring and Bankruptcy Law closure of the process without a claim of bankruptcy in this period., as well as the Brazilian Legislator planned processing to last no more than three years, from my point of view there are no reasons which can obstruct the referred concept adoption as there is time enough to initiate and conclude the processing. Therefore, this study had observed that average time to conclude all processing stages exceed the reasonable time and there was no company able to recover itself until the closure of this study, having indeed cases of conversion of the Judicial Recovery into bankruptcy.

De nos jours, la restructuration est une réalité incontournable qui contribue audéveloppement et à la compétitivité des sociétés in bonis. En général, elle résulte d’une décisionprise par les dirigeants sociaux. Toutefois, sa réalisation peut contrevenir à l’exécution des droits descréanciers antérieurs des sociétés concernées par l’opération. Pour préserver leurs droits, cescréanciers disposent de nombreuses mesures de protection issues aussi bien du droit commun quedu droit spécial. L’identification du fondement de cette protection, à savoir la force obligatoire desengagements pris avant la restructuration de la société débitrice, permet de vérifier l’efficacité decette protection. / Restructuring is a reality that contributes to the development and competitiveness ofcompanies in bonuses. It usually results from a decision taken by the companies executives. Itsimplementation, however, may undermine the enforcement of former creditors’ rights by thecompanies involved in the transaction. To preserve their claims, those creditors have manysafeguards from both the common law and the special law. The identification of the basis of suchprotection, namely the binding commitments made before the restructuring of the debtorcompanies, enable the verification of this protection’s effectiveness.
