Capital requirements and bank profitability : A comparison between the large Swedish banks and niche banks

Purpose: The purpose of this study is to describe and explain the relation of changes in capital requirements on the profitability of Swedish banks. Method: A mixed model approach is used. The quantitative approach is con-ducted through the collection and analysis of statistics from Swe-dish banks and financial institutions. The qualitative research ap-proach is used to obtain further insights into the Swedish banking system and how banks are managing capital requirements. This is conducted through interviews with respondents from a large bank, a niche bank, and the Riksbank. Analysis: The analysis is made on yearly data from 1999 to 2015. Return on equity and net interest margin are individually used as dependent variables. The independent variables are various capital ratios which are defined by the Basel framework. The results from the quantitative analysis are in line with the findings from the qualita-tive interviews. Conclusion: On one hand, capital requirement ratios seem to have a negative and statistically significant correlation with the Return on Equity for both large banks and niche banks. On the other hand, capital re-quirement ratios seem to have a positive and statistically significant correlation with the Net Interest Margin for niche banks.

Understanding Corporate Governance in the Financial Sector through Multiple -Theory : - A study of SFSA disciplinary cases towards financial organizations

Purpose: Understand different needs for accountability and governance among financial firms,based on environmental and structural factors. Design/methodology/approach: By using disciplinary reports published by SFSA the interpretation of corporate governance regulation will be studied. Findings: The study identified important corporate governance factors which can be explained and understood by analyzing through the multiple-theory. Complex environmental aspects, such as regulations and multiple stakeholders, demands for extensive internal and external controls. However, the aspect of knowledge does not seem to be fully explained by previous studies. Originality/value: The result could be a contribution to further discussions on how regulations can develop. Moreover, the result can add empirical data to further develop the multiple-theory.

Strategy-making trends : a case study of the financial regulator in Namibia

Thesis (MBA)--Stellenbosch University, 2014. / Research on strategy has been focusing at organisational level, mostly on practices such as strategic planning, strategy workshops and consultancy practices. With the emergence of strategy-as-practice, the focus has been redirected to explore beneath organisational-level processes and bring to the fore the role that people play in the practice of strategy. This research project looked at the practice of strategy within the Namibia Financial Institutions Supervisory Authority (NAMFISA), the financial regulator in Namibia. Strategy is seen within this research project as something that is ‘done’ by actors who are referred to as ‘practitioners’ of strategy. Strategy-as-practice research is a relatively new field of strategy research. This assignment has aimed to add to the fast growing body of knowledge in the strategy-as-practice research field and it forms part of a collaborative between the University of Stellenbosch Business School (USB) and The Narrative Lab. The researcher explored how strategy is practised within NAMFISA, as the case study company. The assignment points out the strategy actors, the practices and processes they follow as well as the tools they use to plan and execute the NAMFISA strategy. The researcher took an activity-based view and paid special attention to practitioners, practices and praxis (Jarzabkowski, 2005) involved in strategising as well as the manner in which NAMFISA ‘does’ strategy. The system aspects of Biomatrix theory, namely environment, ethos, aims, processes, structure, governance and matter, energy and information (Mei), as described by Dostal, Cloete and Járos (2005), were also integrated into the research wherever they were deemed to affect the practice of strategy at NAMFISA. The above-mentioned aspects, in conjunction with the elements of the activity-based view and the strategising matrix (Jarzabkowski, 2005), shaped the basis for the analysis which was done using the ATLAS.ti tool. After the first analysis, a second analysis was performed using SenseMakerTM Explorer, another qualitative analysis tool which helped in gaining an in-depth understanding of the findings obtained using the ATLAS.ti tool. During the second analysis exercise, the respondents were requested to self-index their own narratives about the strategy activities at NAMFISA. Practices were found to be dominated by planning and discussions and praxis occurred predominantly at the meso level within NAMFISA. As the practice of strategy is entrenched, procedural strategising was found to be the most dominant of the strategising matrix, followed by interactive. No element of preactive strategising was observed. Planning was done by the executive and middle managers, mostly at annual strategic retreats. The use of external consultants was minimal. The research concluded with recommendations for further studies on strategy-as-practice research in Southern Africa.

Penningtvätt : En kvalitativ studie om banksektorns förebyggande arbete mot penningtvätt / Money Laundering : A qualitative study on the banking sector's preventive work against money laundering

De senaste åren har Finansinspektionen rapporterat nya fall kring penningtvätt där etablerade storbanker har stått i rampljuset i negativ bemärkelse. Rapporterade fall av penningtvätt ökar årligen inom Sverige och detta kan betyda att det finns brister inom det förebyggande arbetet mot penningtvätt eller att banker bland annat, har blivit bättre på att upptäcka penningtvätt. Banker och Finansinspektionen befinner sig på frontlinjen för vårt finansiella system och därför är det väsentligt att dessa aktörer innehar verktyg och metoder för att förhindra penningtvätt som utgör ett hot mot det finansiella system och den allmänna demokratin. Årligen rapporterar Finanspolisen att det tvättas ca 130 miljarder kr inom den svenska ekonomin och att de nuvarande trenderna dessvärre inte pekar på en nedgång. Syftet med denna studie är att bidra till en ökad förståelse kring hur banker arbetar i förebyggande syfte mot penningtvätt och hur de samspelar med Finansinspektionen för att få bukt med denna brottslighet. För att samla in datamaterialet genomfördes totalt sex semistrukturerade intervjuer med anställda från tre storbanker inom Sverige och en intervju med en anställd från Finansinspektionen. Det empiriska resultatet tydliggjorde att bankerna förlitar sig mycket på användningen av interna verktyg som kundkännedom - KYC och att kundkännedom är ett omfattande verktyg som innefattar ett flertal sekretessbelagda element som alla har ett identiskt syfte, att kartlägga och identifiera risker. Slutsatserna visar att det sker ett omfattande arbete i förebyggande syfte mot penningtvätt där banker årligen avsätter miljontals kronor för att göra ett gediget arbete. Det riskbaserade förhållningssättet till regelverken innebär att det fortfarande lämnas utrymme för banker att förbättra sina interna processer i det förebyggande arbetet mot penningtvätt, trots det faktum att det finns en medvetenhet om att brottslingarna ligger steget före. Samtidigt kan detta kompenseras av mer vägledning i de föreskrifter som ges av Finansinspektionen. En annan väsentlig slutsats vi har kommit fram till är att samspelet med Finansinspektionen inte alls fungerar på samma sätt som Finansinspektionen förmedlar att det gör. Den viktigaste delen av detta samarbete gick ut på att tillföra varandra med nya rapporter och föreskrifter, inte att samspela med andra aktörer för att få bukt med penningtvätt. / In the last couple of years, The Swedish Financial Supervisory Authority have reported new cases of money laundering where established major banks have been in the limelight in a negative sense. Reported cases of money laundering are increasing annually in Sweden, which indicates that there are shortcomings in the preventive work against money laundering or that banks are better at finding money laundering cases. Banks and The Swedish Financial Supervisory Authority are at the forefront of the preventive work against money laundering and therefore it is essential that these organizations possess tools and methods to prevent the emergence of money laundering and identify risks that pose a threat to our financial system and thus to the general democracy. Annually, The Financial Police reports that about SEK 130 billion is laundered in the Swedish economy and that the current trends unfortunately do not point to a decline. The purpose of this study is to contribute to an increased understanding of how banks work in preventive purpose against money laundering. As well as how banks interact with The Swedish Financial Supervisory Authority to overcome money laundering. In order to collect the data, a total of six semi-structured interviews were conducted with employees from three established banks within Sweden and one from The Swedish Financial Supervisory Authority. The conclusions show that a great deal of work is done in a preventive purpose against money laundering where banks allocate millions of SEK every year to do a solid job. Banks rely heavily on the use of internal tools such as know your customer and internal regulations which is a tool that can be used to get customer awareness. But in practice, the riskbased approach to the regulations means that banks still need to improve their internal processes in the preventive work despite the fact that criminals are considered to be one step ahead. At the same time, this can be offset by more guidance in the regulations that the Swedish Financial Supervisory Authority has as a task, to make sure that the banks are following the rules in the market. Another significant conclusion we have reached in the study is that the interaction with The Swedish Financial Supervisory Authority does not work at all in the same way that The Swedish Financial Supervisory Authority mediates that it does. The most important part of this collaboration was to provide each other with new reports and regulations, and not to interact with other organization such as banks to overcome money laundering.

La pertinence du modèle français de la société civile professionnelle pour le notariat iranien / Relevancy of the French model of professional partnership for the Iranian notary

L’Iran est un pays à double visage, à la fois traditionnel et moderne. Le notariat y est exercé de façon traditionnelle et pourtant le développement économique du pays exigerait un notariat moderne. Ce notariat est aujourd’hui exclusivement pratiqué de façon individuelle. D’où une série de difficultés. Il importe de chercher un autre modèle. Le droit iranien s’est déjà inspiré du droit français dans le domaine du droit civil mais aussi dans l’organisation de la fonction de notaire. C’est donc tout naturellement que nous nous sommes tournés vers la France pour étudier d’autres modes d’exercice du notariat. En effet, après plusieurs années d’exercice à titre individuel, cette profession y est aujourd’hui pratiquée de façon collective selon plusieurs modèles. L’exercice au sein d’une Société Civile Professionnelle a particulièrement retenu notre attention. Il s’agit alors d’analyser les avantages et les inconvénients de cette société particulière du droit français pour constater que ce type de société peut être adapté, après certains aménagements, au notariat iranien. Au préalable, il convient d’implanter la notion de société et les règles applicables à la société civile du droit français qui nourrissent la règlementation de base de la Société Civile Professionnelle.Dans la première partie de cette recherche, l’évolution du notariat français est abordée. L’apparition des difficultés d’exercice a poussé ce notariat à accueillir favorablement la Société Civile Professionnelle comme nouveau mode d’exercice de la profession par la loi de 1966. L’étude du fonctionnement de cette société a bien démontré que l’exercice de la profession en société ne change rien à la force de l’acte notarié ni au rôle et à l’influence du notaire, et même, que le service rendu à la clientèle est bien meilleur.Dans la deuxième partie, après avoir rappelé l’histoire du notariat iranien et sa définition, l’étude de son fonctionnement actuel et des difficultés qui en résultent, démontre la nécessité d’implanter la Société Civile Professionnelle du droit français comme nouveau mode d’exercice. Or, dans la mesure où il y a une confusion entre la notion d’indivision et de société dans le Code civil iranien, et cela malgré l’existence des sociétés commerciales dans le Code de commerce iranien, il est apparu essentiel de distinguer ces notions afin de les organiser. C’est ainsi que tout est prêt pour implanter et adapter les règles applicables à la société civile française. Finalement, face à des sociétés professionnelles non organisées dans le droit iranien, il a fallu les organiser et les adapter au notariat iranien. Grâce à cette étude il peut être proposé au législateur iranien un nouveau modèle d’exercice du notariat adapté aux besoins d’une société moderne avec une législation pouvant s’étendre à d’autres sociétés professionnelles ou commerciales, occasion aussi de clarifier la notion de « société » et d’« indivision ». / Iran is a two-faced country, both traditional and modern. Notary position is there exercised in a traditional way, but yet the economic development of the country requires modernization of this profession. Today, the notary position is exclusively practiced individually. Hence a serie of difficulties. Therefore, it is important to look for another model. If Iranian law has already been inspired by French law in the field of civil law, it also influenced the organization of the functions of notary. It is therefore natural for Iran to turn to France to study other modes of exercise of this profession. Indeed, after several years of individual practice, the position of notary is now practiced collectively according to several models. Practicing within a “Professional Partnership” (ie: “Société Civile Professionnelle”) particularly caught our attention. We aim at analyzing the advantages and disadvantages of this typical French form of partnership to observe that this particular type of partnership can be adapted, after some adjustments, to the Iranian notary practice. At the outset, the French concepts of “Company” and the French regulation specifically applicable to the “Civil Partnership”, at the heart of the “Professional partnership” regulation should be introduced.In the first part of this research, the evolution of the French notary profession is addressed. Appearance of practice difficulties pushed the notaries to welcome the “Professional Partnership” as the new mode of practicing with the 1966 Act. The study of how this partnership is operating has shown that exercising the profession of notary within a partnership does not change the strength of a deed or the role and influence of the notary, but rather that there is a better service provided to the customer.In the second part, after recalling the history of the Iranian Notary profession and its definition, the study the common way of exercising and its resulting difficulties, demonstrates the need to implement the Professional Partnership French regulation as the new mode of practice. However, insofar as Iranian Civil Code merges the notions of Joint-ownership (“indivision”) and Civil Partnership, despite the existence of Commercial Partnership in the Iranian Commercial Code, it was essential to distinguish these notions in order to organize them. At the time, everything seems ready to implement and adapt the French rules applicable to the French Civil Partnership. Finally, facing unorganized professional partnerships under Iranian law, this work allows to organize and adapt a new model to the Iranian Notaries. Through this study, a new model for notary practice can be proposed to the Iranian legislature that is adapted to the needs of a contemporary society. Such a research may then be extended to other professional or commercial partnerships and was also an opportunity to clarify the legal concepts of "partnerships" and "joint-ownership".

Förväntningsgapet : Vad revisionsinsatsen i HQ Bank innebär för förväntningsgapet

Problem: That the stakeholder’s expectations don´t answer to what auditors can and may do have been a problem for several years. This problem was defined for the first time by Liggio at 1974. Since 1974 there have been several researches about the expectation gap for auditors. Purpose: The purpose of our study is to research what the audit effort in HQ Bank means for the expectation gap. Theory: The theories in our study discuss the audit profession, the definition of the expectation gap, how trust develops between individuals, the regulations that the authorities discuss and a review of earlier researches in this subject. Method: We have done a qualitative study in which we interviewed approved auditors at PwC and Convensia in addition we interviewed the chief lawyer at the Swedish financial supervisory authority to answer our purpose. Conclusions: The conclusion of our study is that the expectation gap exists between the auditors and the stakeholders. Another conclusion is that the incidents in HQ Bank have influenced the expectation gap in a negative direction, to reduce the expectation gap we suggest that adjustments of the regulations must be done and that the auditors themselves must inform their stakeholders what auditors can and may do. / Problem: Att intressenters förväntningar på revisorn inte svarar mot vad revisorn faktiskt kan och får göra har varit ett problem för revisorsyrket i många år. Detta problem definierades först av Liggio 1974. Sen dess har flertalet forskningar gjorts inom ämnet förväntningsgap. Syfte: Vår studie syftar till att undersöka vad debatten om revisionsinsatsen i HQ Bank innebär för förväntningsgapet. Teori: Uppsatsens teoretiska referensram behandlar teorier som beskriver revisorsyrket, definition av förväntningsgapet, hur förtroendet utvecklas mellan individer, de lagändringar som diskuteras samt en översikt av tidigare forskning inom ämnet. Metod: För att besvara syftet gjorde vi en kvalitativ studie där vi intervjuade godkända revisorer på PwC och Convensia revision. Dessutom intervjuade vi Finansinspektionens chefsjurist. Slutsatser: Denna studies slutsatser blev att det råder ett förväntningsgap mellan revisorerna och dess intressenter. Vi har även kommit fram till att händelserna i HQ Bank har påverkat förväntningsgapet i en negativ riktning, för att få bukt med förväntningsgapet anser vi att det krävs ändring av regelverken tillsammans med att revisorerna själva upplyser deras intressenter om vad en revisor faktiskt kan och får göra.

How to Improve the Swedish Corporate Bond Market / Hur man kan förbättra den svenska företagsobligationsmarknaden

In late Mars 2020, Covid19was declared to be a pandemic by the World Health Organization.The following crisis negatively affected the overall economy and also the Swedish corporate bond market. Generally, corporate bonds have been described as secure investments during turbulent market conditions, but now they decreased in value rapidly. The sellpressure was of unprecedented measures and it became difficult and costly for companies to issue new corporate bonds in order to refinance operations. Meanwhile, it became difficult for investors to sell their holdings as the liquidity deteriorated. Shortly after, the Swedish National Bank declared the Swedish corporate bond market to be highly dysfunctional. Moreover, the Swedish National Bank and the Financial Supervisory Authority identified some characteristics of the Swedish corporate bond market that contributed to the severe market stress, namely; (1) Limited liquidity and a small market (2) Lacking transparency and unreliable price information (3) Most issuers lacking a credit rating (4) A homogeneous group of investors and (5) Real estate companies constituting a large share of total issuers. These characteristics are defined as the five areas of concern in this thesis. This qualitative study is based on interviews with market participants. The objective is to identify which area of concern should be prioritized in order to improve the Swedish corporate bond market and which improvement measure is deemed most effective. The results show that transparency is the area of concern that should be prioritized. Nevertheless, the new selfregulations that will be implemented July 1st, 2021 with the purpose to improve transparency is not deemed to be enough, but rather a step in the right direction. Therefore, an iterative process is suggested, continuously evaluating and adjusting, ensuring that transparency improves but not to such an extent that liquidity is negatively impacted. / I mars 2020 deklarerade Världshälsoorganisationen att spridningen av Covid19 hade utvecklats till en pandemi. Krisen påverkade hela världsekonomin negativt och även den svenska företagsobligationsmarknaden. Företagsobligationer har generellt beskrivits som säkra investeringar under turbulenta marknadsförhållanden, men nu förlorade de sitt värde mycket snabbt. Försäljningstrycket var enormt och gjorde att det blev dyrt för företag att emittera nya obligationer och refinansiera sin verksamhet. Samtidigt blev det svårt för investerare att sälja sina innehav då likviditeten snabbt försämrades. Strax därefter uppgav Riksbanken att företagsobligationsmarknaden var högst dysfunktionell. Vidare identifierade Riksbanken och Finansinspektionen fem karaktärsdrag på den svenska företagsobligationsmarknaden som kan ha bidragit till den stressade marknadssituationen. Karaktärsdragen var följande; (1) Begränsad likviditet och en liten marknad (2) Bristande transparens och opålitlig prisinformation (3) Faktumet att många emittenter saknar kreditbetyg (4) En homogen grupp av investerare (5) Majoriteten av emittenterna utgörs av fastighetsbolag. De fem identifierade karaktärsdragen har definierats som de fem problemområdena i följande uppsats. Uppsatsen är en kvalitativ studie baserad på intervjuer med marknadsaktörer. Målet är att identifiera vilket av de fem problemområdena som bör prioriteras i arbetet mot en förbättrad företagsobligationsmarknad samt att fastslå vilka förbättringsåtgärder som anses vara mest effektiva. Resultaten visar att transparens är de problemområde som bör prioriteras men att den nya självregleringen som skall implementeras den första juli år 2021 med syftet att förbättra transparensen anses vara otillräcklig. För att förbättra transparensen föreslås en iterativ process med kontinuerlig utvärdering och anpassning av regleringar. Genom en iterativ process kan man även säkerställa att transparenskraven inte blir så pass strikta att de påverkar likviditeten negativt.

金融監理制度對商業銀行利潤效率之影響--亞洲12國之實證分析 / Effects of Financial Supervision Regimes on Commercial Banks’ Profit Efficiency in 12 Asian Countries

金融監理制度影響一國商業銀行經營績效的相關議題,一直受到學者與政府當局的重視,為瞭解亞洲地區銀行業在中央銀行與監理單位不同管理下的利潤效率,找出最適的制度設計,本研究根據Huang、Huang與Liu(2014)提出之隨機共同利潤邊界(stochastic meta-profit frontier),採用兩階段估計法,蒐集中國大陸、香港、印度、日本、韓國、馬來西亞、巴基斯坦、菲律賓、新加坡、斯里蘭卡、泰國以及阿拉伯聯合大公國等十二國商業銀行資料,分成開發中和已開發國家兩個群組,將環境變數納入無效率模型中,進行實證分析,比較不同群組的利潤效率差異,發掘影響效率的主要變數與方向,從而獲得重要政策意涵。 根據實證分析結果,中央銀行介入銀行監理程度越高,商業銀行利潤效率越低;金融監理單位整合程度越高,商業銀行利潤效率越高;中央銀行獨立程度越高,商業銀行利潤效率越低;已開發國家群組的平均技術缺口比率與共同邊界技術效率值皆高於開發中國家群組,符合預期。共同利潤效率最高的是日本,最低的是韓國。平均而言,各國若在共同利潤邊界上從事生產,能提升41.9%至75%的利潤。 / The effects of degrees of financial supervision on performance of commercial banks have long been important issues and drawn much attention to academic researchers and government authorities. This study applies the stochastic meta-profit frontier, recently developed by Huang, Huang, and Liu (2014), to estimate and compare profit efficiencies of commercial banks from 12 Asian countries, i.e., Mainland China, Hong Kong, India, Japan, South Korea, Malaysia, Pakistan, Philippines, Singapore, Sri Lanka, Thailand, and United Arab Emirates. We divide the sample countries into two groups, i.e., developing and developed countries. This enables us to further investigate the effects of different supervisory systems, enforced by central banks (CB) and supervisory authorities, on commercial banks’ profit efficiencies, as well as to make a suggestion about the optimal supervision regimes in the area. Note that a set of supervisory indices are considered as environmental variables that explain profit inefficiency. Using the two-stage estimation procedure, the empirical results are summarized as follows. First, it is found that bank’s profit efficiency decreases with the increase in a CB’s supervision sectors. Second, the unification of supervisory authority has positive effect on bank’s profit efficiency. Third, the more independent is the CB, the less profit efficient the commercial bank is. Fourth, banks in the group of developed countries are found to have higher technology gap ratios and meta-profit efficiencies than those in the group of developing countries, as expected. Fifth and finally, Japan and South Korea has the highest and the lowest level of meta-profit efficiency, respectively. Evidence is found that if an average commercial bank were adopting the best technology, it can earn roughly 41.9% to 75% more profits than otherwise.
