Esta dissertação trata da atuação do advogado Eloar Guazzelli em casos políticos durante a ditadura civil-militar (1964-1979). A Justiça Militar teve papel relevante durante a ditadura, já que ao mesmo tempo enquadrava os inimigos do regime e lhe dava uma fachada legal e democrática. Por outro lado, ao manter as instituições jurídicas, permitia aos advogados um espaço de manobra, abrindo-lhes a possibilidade de vitórias e ganhos. Assim existe um paradoxo na atuação dos advogados de presos políticos: uma vez que faziam oposição ao regime, contribuíam para sua manutenção, já que davam legitimidade. A dissertação responde questões sobre os processos políticos em que Guazzelli atuou. Um dos objetivos é o de apresentar quem eram os clientes de Eloar em casos políticos durante a ditadura civil-militar. Além disso, busca-se reconstituir o cotidiano do advogado de presos políticos, mostrando as relações criadas entre advogado e cliente e advogado e Justiça Militar. São analisadas também as argumentações que Guazzelli utilizava para obter ganhos nesta corte. / This dissertation deals with the role of the lawyer Eloar Guazzelli in political affairs during the civil-military dictatorship (1964-1979). The military justice system played a significant role during the dictatorship, since both fit the enemies of the regime and gave a legal and democratic front. On the other hand, while maintaining the legal institutions, lawyers allowed a space for maneuver, and opens up the possibility of victories and earnings. So there is a paradox in the actions of lawyers of political prisoners: once opposed the scheme, contributing to its maintenance as it gave legitimacy. This work answers questions about the political processes that acted Guazzelli. One goal is to present customers who were Eloar in political affairs during the civil-military dictatorship. In addition, we seek to reconstruct the daily life of a lawyer for political prisoners, showing the relationships created between lawyer and client and lawyer and military justice. Are considered the arguments that Guazzelli used to gain in this court.

Existe uma série de pressupostos que apontam para a impossibilidade de aplicação desses novos modelos alternativos na Justiça Militar dos estados; dentre os quais se destacam a hierarquia e a disciplina como princípios que garantem a regularidade das instituições militares. Ocorre que os princípios constitucionais fundamentais ao exercício da plena cidadania no Estado Democrático de Direito deve servir de parâmetro para toda legislação pátria, inclusive a legislação militar. Além disso, a atividade de segurança pública, sendo exercida diretamente na sociedade, demanda um tratamento diferenciado ao policial militar. Por outro lado, nota-se uma crescente e inevitável demanda pela aplicabilidade da justiça restaurativa e, mais uma vez, a figura do policial militar somente aparece como agente de fomentação desse novo paradigma, assim como ocorre na mediação como “carro chefe” da filosofia do policiamento comunitário. Ao problema de tese formulado, levanta-se a hipótese – ao final confirmada - de que os militares dos estados podem ser beneficiários da justiça restaurativa e dos mecanismos consensuais em respeito aos princípios constitucionais fundamentais para o exercício pleno da cidadania no Estado Democrático de Direito. Entendimento lastreado em sua atividade de segurança pública que não se relaciona com a ideologia militar que lhes fora outorgada, posto que: a) o fato das Polícias Militares dos estados serem constitucionalmente previstas como força auxiliar e reserva do exército não é suficiente para que lhes sejam vedadas garantias e direitos constitucionais fundamentais; b) a hierarquia e disciplina não são exclusivas das corporações militares, portanto não são justificativas para vedação de institutos despenalizadores e/ou mecanismos consensuais na esfera policial militar. No entanto, elas representam conteúdos simbólicos repletos de valores e princípios que reforçam sofismas que permeiam o Direito Militar; c) os policiais militares, apesar de possuírem estética militar, têm seu mister profissional voltado para segurança pública como atividade de caráter civil, não guardando semelhança com a atividade fim das Forças Armadas; d) as justificativas utilizadas para o impedimento da aplicação dos benefícios de uma justiça consensuada aos policiais militares têm essência cultural e ideológica, resultando em constantes injustiças para esses profissionais de segurança pública; e) os entraves causados pela ideologia militar podem ser superados por meio de um acordo que mitigue o status social da categoria. No tocante às questões de viés metodológico, ressaltam-se o uso da vertente teórica jurídico-dogmática e do raciocínio hipotético-dedutivo. No campo procedimental, a tese se vale, especialmente, de literatura direta ou transversal à temática, bem como de dados do Judiciário Militar do Estado de Minas Gerais. Por fim, a hipótese de pesquisa levantada é corroborada e desenvolvida em termos conclusivos. / The purpose of this thesis is to address the following problem: is there a possibility of applying consensual and restorative mechanisms in the State Military Justice? There are a number of assumptions that point to the impossibility of applying these new alternative models in the military justice of the states; among which stand out the hierarchy and discipline as principles that guarantee the regularity of military institutions. It follows that the constitutional principles fundamental to the exercise of full citizenship in the Democratic State of Law should serve as a parameter for all domestic legislation, including military legislation. In addition, the public security activity, being carried out directly in the society, demands a differential treatment to the military policeman. On the other hand, there is a growing and inevitable demand for the applicability of restorative justice, and once again the figure of the military police officer only appears as an agent for fomenting this new paradigm, just as it occurs in mediation as “ “Of the philosophy of community policing. To the problem of the thesis formulated, the hypothesis - finally confirmed - arises that the military of the states can be beneficiaries of the Restorative Justice and the consensual mechanisms in respect to the constitutional principles fundamental for the full exercise of the citizenship in the Democratic State of Right. This understanding is based on their public security activity, which is not related to the military ideology granted to them, since: a) the fact that the military police of the states are constitutionally foreseen as an auxiliary force and reserve of the army is not enough to ensure that they are guaranteed fundamental constitutional rights and guarantees; b) hierarchy and discipline are not exclusive to military corporations, therefore they are not justifications for the prohibition of decriminalizing institutes and / or consensual mechanisms in the military police sphere. However, they represent symbolic contents replete with values and principles that reinforce sophisms that permeate Military Law; c) military police officers, despite possessing military aesthetics, have their professional mission turned to public safety as a civil activity, not keeping a resemblance to the activity of the Armed Forces; d) the justifications used to prevent the application of the benefits of a consensual justice to the military police have a cultural and ideological essence, resulting in constant injustice to these public security professionals; e) the obstacles caused by military ideology can be overcome by means of an agreement that mitigates the social status of the category. Regarding the questions of methodological bias, the use of the legal-dogmatic theoretical and deductive hypothetical reasoning is emphasized. In the procedural field, the thesis is based, in particular, on direct or transversal literature, as well as data from the Military Judiciary of the State of Minas Gerais. Finally, the research hypothesis raised is corroborated and developed in conclusive terms.

Investigamos as relações e identidades etnoculturais aí engendradas, considerando os conflitos como pontos privilegiados para a análise das interdependências entre os indivíduos e os seus grupos de pertencimento. Num jogo cambiável de escalas, contemplamos os valores e as expectativas dos envolvidos nesses embates cotidianos e as políticas públicas relacionadas à imigração, à ocupação de territórios fronteiriços e à segurança nacional. O trabalho pretende ser também um exercício teórico-metodológico de problematização da atuação da Justiça, especialmente a Militar, bem como do uso da fonte judiciária. / This analysis is based on a sequence of conflicts occurred in 1900 in the colony General Carneiro (PR) among military soldiers who were there in service of Strategic Roads Commission in order to build a carriageway road which could link Porto da União da Vitória to the city of Palmas, and Polish immigrants. Disrespecting strict thematic limits, we built a social history of this tense border area, which merge military history and immigration and include the soldiers of the army and European immigrants as the main characters. We investigated the relationships and ethnocultural identities engendered there, considering the conflict as key points for the analysis of the interdependencies among individuals and their belonging groups. In a switchable playing scales, we are going to contemplate the values and expectations of those involved in these daily encounters and public policies related to immigration, occupation of border areas and national security. This assignment also aims to be a theoretical-methodological exercise of questioning the actions of Justice, especially the military and the use of judicial source.

La justice militaire en temps de paix : L’activité judiciaire du conseil de guerre de Tours (1875-1913) / Military justice in time of peace : The judicial activity of the War Council of Tours (1875-1913)

La justice militaire est un champ historique encore peu exploré, y compris par les spécialistes de la justice en France. Les travaux récents menés sur le sujet témoignent cependant d'une actualité historiographique réelle. A partir de l'activité judiciaire du conseil de guerre de Tours entre 1875 et 1913, nous revenons sur les débats autour de la réforme de la justice militaire qui ont marqué la vie politique en France, notamment entre l'affaire Dreyfus et la Grande Guerre. Ces débats, qui n'ont rien de franco-français, sont alors particulièrement vifs au Parlement et au sein de sociétés comme la Société générale des Prisons. Pointant les nombreux dysfonctionnements de cette justice d'exception, ils aboutissent à de nombreux projets ou propositions de loi entre 1898 et 1913. S'appuyant sur une base de données constituée à partir des registres de jugements du conseil de guerre de Tours et enrichie par l'ouverture des dossiers de procédure, cette étude suit la marche de la procédure militaire. Elle se penche sur la légitimité de la justice militaire lors des premières décennies de la IIIe République, la compétence des tribunaux militaires en temps de paix, l'instruction, les prévenus et les infractions poursuivies, le déroulement de l'audience, les garanties procédurales, les peines prononcées et leur exécution. Faisant le choix d'étudier les pratiques judiciaires, elle examine les articulations entre les différents modes de règlement des conflits au sein de l’armée (infra-judiciaire, discipline et justice) ainsi que les logiques ou stratégies répressives pour réguler des peines particulièrement lourdes, considérées et/ou dénoncées comme telles. / The historical field of military justice is rarely explored even by specialists of justice in France. Recent research on this subject has revealed however that genuine historiographical issues are at stake. Taking the judicial activity of the WarCouncil of Tours between 1875 and 1913 as a starting point, the debate returns to the reform of military justice which had an impact on French political life especially from the Dreyfus affair to the Great War. These debates, which were not uniquely French, were particularly lively in Parliament and among societies such as the Société Générale des Prisons. They pointed out the numerous dysfunctions of unconventional justice and led to many bills of parliament between 1898 and 1913. Based on the judgement records and open case files of the War Council of Tours, this study follows the path of military procedure. It looks into the legitimacy of military justice during the first decades of the Third Republic, the competence of military courts in time of peace, investigation, the defendants’ offences, hearing procedures, procedural guarantees,sentences given and their execution. Taking judiciary practices as a focus, it studies the different ways of resolving conflict within the army (infra-judicial, discipline and justice) together with repressive logic and strategies to regulate heavy penalties, considered or denounced as such in particular.

Since the coup of March 31st 1964, the STM has participated in the process of juridical-political punishment installed then. By editing the Institutional Act No. 2, in 1965, the Castelo Branco’s government has delegated to the Military Justice the trial of crimes against national security, seeking to solve problems generated by the tangle of legislation that defined by then the attributions of the STM e the Federal Supreme Court (STF in portuguese) in the judgment of offenses in the 'revolutionary' political conjuncture. According to the methodology adopted in this study, the Military Justice, as a whole, and the STM, in particular, have acted in this period by three distinct approaches: as a Corporative Justice (CJ), i.e., by judging military crimes; as a Regime Justice (RJ), directed towards the prosecution and trial of opponents to the regime, in cases of attacks against national security and against the administrative probity; and as a Political-corporative Justice (PCJ), by judging people charged with military offenses, but with a political motivation. Throughout the thesis, it was tried also to follow the manner the Court has behaved vis-à-vis the political and juridical changes that had inflicted in its structure and competence. As shown by this study, the impact of laws on the functioning of the STM is not immediate. The sluggishness of the justice and the procedural dynamics generated a lag between the governmental proposals and the judgments. One of the direct consequences of this phenomenon was the fact that the STM, mostly by acting as regime Justice, had to deal, simultaneously, with national security laws that would superpose and coexisted in the same juridical realm. It was verified that the decision-making pattern of the STM to judge each category tended to reproduce the decision of the Military Audits. This fact allows us to relativize the widespread thesis that the Court acted as a place of greater serenity and complacency towards those who were found guilty in the first instance. / O presente trabalho tem como objetivo analisar a atuação do Superior Tribunal Militar (STM), segunda instância da Justiça Militar brasileira, entre os anos de 1964 e 1980, no processo de construção de uma nova ordem jurídica e no julgamento de crimes militares, políticos e político-militares. Após o golpe de 31 de março de 1964, o STM teve importante participação no processo de punição jurídico-política então instaurado. Com a edição do Ato Institucional nº 2, em 1965, o julgamento de crimes contra a segurança nacional foi transferido para a Justiça Militar, buscando reordenar problemas gerados pelo emaranhado legislativo que definia até então as atribuições do STM e do Supremo Tribunal Federal (STF) no julgamento de delitos vinculados à conjuntura política 'revolucionária'. Segundo a metodologia adotada neste trabalho, a Justiça Militar como um todo, e o STM em particular, atuaram nesse período por meio de três lógicas distintas: como Justiça corporativa (JC), ou seja, julgando crimes militares; como Justiça do regime (JR), direcionada para o processo e julgamento de opositores do regime, em casos de atentado contra a segurança nacional e contra a probidade administrativa; e como justiça político-corporativa (JPC), julgando incriminados em delitos militares, mas por motivação política. Ao longo da tese, buscamos também acompanhar a maneira como o Tribunal se comportou frente às mudanças políticas e jurídicas, que incidiram em sua estrutura e competência. Como demonstramos no trabalho, o impacto da produção legislativa sobre o labor do STM não foi imediato. A morosidade da justiça e a dinâmica processual geraram um descompasso temporal entre as propostas governamentais de modificação da estrutura jurídica e os julgamentos. Uma das consequências diretas desse fenômeno foi o fato de o STM, principalmente ao atuar como Justiça do regime, ter que lidar, ao mesmo tempo, com leis de segurança nacional que se superpunham e coabitavam o mesmo campo jurídico. Verificamos, ainda, que o padrão decisório do STM ao julgar em cada uma das categorias tendia a reproduzir as decisões das Auditorias Militares, dado esse que nos permite relativizar a difundida tese de que o Tribunal atuou como um espaço de maior serenidade e complacência para com os condenados em primeira instância.

The choice of this organ as an object of investigation is essentially, due to its importance in the legal architecture of the regime, mainly after the alterations established by the second Institutional Act, that transferred to the Military Justice the competence to prosecute and judge civil accused of crimes against the national security. The main analytic focus concentrated in the political judgments realized by this instance and the empirical material consisted essentially in primary fonts, of documentary character. / O objetivo central desta pesquisa é entender as relações estabelecidas entre a primeira instância da Justiça Militar brasileira as auditorias militares e o aparato repressor montado pelo regime militar brasileiro no período de institucionalização que se inicia com a edição do segundo Ato Institucional, em outubro de 1965 e termina com a publicação do quinto Ato Institucional, em dezembro de 1968. A escolha deste órgão como objeto de investigação se deve, essencialmente, à sua importância na arquitetura jurídica do regime, principalmente depois das alterações estabelecidas pelo segundo Ato Institucional, que transferiu para a Justiça Militar a competência para processar e julgar civis acusados de crimes contra a segurança nacional. O foco analítico principal se concentrou nos julgamentos políticos realizados por esta instância e o material empírico consistiu essencialmente em fontes primárias, de caráter documental.

The purpose of this thesis is to compare the Trial of major Nazi war criminals before International Military Tribunal with others trials held in American occupation zone in the Exclusive American jurisdiction (concretely the so called Subsequent Nuremberg trials and the Dachau trials) and to find the similarities between them. The thesis is divided into the six chapters, which are further divided into the subchapters. The first chapter describes the situation during and after the Second World War and the considerations of the Allied powers about the method of the punishment of the Nazi war criminals, which was necessary. The second chapter deals with the creation of the Charter of the International Military Tribunal. This law was created with the joint efforts of the most prominent lawyers from the United States of America, Soviet Union, Great Britain and France. The Charter included new categories of crimes, which were the reaction to the unprecedented extensity of Nazi atrocities. This "Nuremberg charter" helped greatly in the development of the International criminal law. In the second chapter, the reasons for choosing Nuremberg as the location of the trials are also taken in consideration.
