As relações de gênero nas práticas de justiça : igualdade e reconhecimento em processos de guarda de crianças e adolescentes

A guarda compartilhada era desconhecida até o ano 2000, no Tribunal de Justiça do Rio Grande do Sul (SIMIONI, 2007). Em 2014, a Lei 13.058 altera o Código Civil (2002) para dispor que o tempo de convívio com os filhos deverá ser dividido de forma equilibrada com a mãe e com o pai, sempre tendo em vista as condições fáticas e os interesses de crianças e adolescentes. No contexto legislativo brasileiro, houve uma ruptura com o padrão sistemático de atribuição da guarda às mulheres. Essa ruptura se reflete nas práticas de justiça? A partir dessa pergunta, essa tese demonstrou, com base em pesquisa empírica e revisão bibliográfica, que há uma invisibilidade das desigualdades de gênero, em relação às demandas judiciais de guarda de crianças e adolescentes. O conceito de gênero é a ferramenta analítica que articulou as representações e as práticas sociais e legais. A condição pós-moderna do direito possibilita o reconhecimento da diversidade de vivências familiares da contemporaneidade, não havendo mais espaço para um modelo de família universal. As contribuições epistemológicas trazidas pela teoria do reconhecimento são temperadas pelo ‘paradoxo legal brasileiro’ (KANT DE LIMA, 1995), em que a ordem constitucional igualitária é aplicada de maneira hierárquica pelo sistema de justiça. A dimensão moral em torno do reconhecimento da qualidade ou do status social de um homem-pai em demandas de guarda de crianças e adolescentes norteia o debate. As mudanças relativas às funções parentais contemporâneas apontam para um engajamento na parentalidade masculina a partir da confrontação e depreciação, da desconstrução do reconhecimento ao modelo de parentalidade feminina. / The shared custody was unknown until the 2000 year for the Court of Justice of the Rio Grande do Sul (SIMIONI, 2007). In the year of 2014, the Law 13.058 amending the Civil Code (2002), to provide that the time of acquaintanceship with the children must be divided in equal form for the mother and the father, always observing the factual conditions, and the interests of children and adolescents involved. In the brazilian legislative context, there was a rupture with the systematic pattern of attribution of custody to the women. Does this rupture reflects in justice's practices? Starting from this question, this thesis has demonstrated, based on empirical research and in bibliographic revision, that there is an invisibility of gender inequality, in relation to the lawsuits of custody of children and adolescents. The concept of gender is the analytical tool that has articulated the representations and the legal and social practices. The postmodern condition of law makes capable the recognizing of the diversity of family in the contemporaneity, and there is no more space for a model of universal family. The epistemological contributions, that were given by the Theory of Recognition, they are tempered by the ‘brazilian legal paradox’ (KANT DE LIMA, 1995), in which the egalitarian constitutional order is applied in hierarchical ways by the system of justice. The moral dimension on the recognition of quality or on the social status of a father-man in lawsuits of custody of children and adolescents directs the debate. The related changes to the contemporary parental functions lead to a commitment in male parenthood, starting from the confrontation and the depreciation, from the deconstruction of recognition to the model of female parenthood.

[pt] A presente pesquisa, um estudo de natureza qualitativa acerca da violência escolar, teve como objetivo principal conhecer, interpretar e compreender as relações entre pares permeadas por práticas agressivas que atualmente são conceituadas como bullying. O estudo foi realizado em uma escola pública de ensino médio da rede estadual do Rio de janeiro. Buscamos investigar a percepção dos professores e dos estudantes acerca do bullying enquanto um tipo específico de violência escolar. A principal hipótese da pesquisa é que os altos índices de casos de bullying estão diretamente relacionados à dificuldade dos estudantes em reconhecer e conviver com as diferenças culturais e identitárias que são construídas e reconstruídas no ambiente escolar. Nessa perspectiva, para compreender a motivação que está por trás das práticas de agressão investigamos o bullying como uma intolerância em relação à diferença. Percebemos que a intolerância à diferença é insuficiente para explicar a gravidade das agressões e buscamos, além disso, investigar o bullying como um comportamento maliciosamente banal, que se origina da incapacidade de pensar e refletir sobre o significado e as consequências das ações. Tal incapacidade é resultante, entre outros fatores, de um projeto moderno de sociedade que não valoriza uma proposta educacional voltada para o pensamento e para reflexão. Considerando a intolerância e a banalidade como expressões motivadoras e explicadoras do bullying, utilizamos a Teoria do Reconhecimento de Charles Taylor e Axel Honneth e o conceito de Banalidade do Mal de Hannah Arendt para fundamentar nossa hipótese principal. Como procedimentos metodológicos, além de uma extensa revisão bibliográfica, foram realizadas observações do campo, aplicação de questionários e entrevistas semiestruturadas com 08 professores e 10 estudantes que se voluntariaram para a pesquisa. A pesquisa concluiu que os estudantes conhecem o bullying e são afetados por esse tipo de violência, mas não confiam na escola como instituição capaz de ajudá-los a enfrentar o problema. Os professores sabem identificar os casos de bullying, mas não se preocupam em compreender os motivos que levam a essa prática, quando muito se limitam a pensar em estratégias de enfrentamento. A gestão escolar nega a ocorrência do bullying e interpreta os conflitos e agressões entre pares como brincadeiras rotineiras do cotidiano escolar. A pesquisa apontou também que a problemática do bullying configura-se como um tema marginalizado e banalizado na escola. / [en] This is a qualitative study on school violence. This research aimed at knowing, interpreting and comprehending the aggressive actions also known as bullying that happen among peers. This work took place at a public high school in the state of Rio de Janeiro. We intended to investigate the teachers and students perceptions concerning bullying as a type of school violence. Our hypothesis was that higher rates of bullying actions are related to the students difficulties at recognizing and dealing with cultural and identity difference that is built and rebuilt in the school environment. In order to comprehend the motives that were behind those aggressive actions, we investigated bullying as intolerance towards difference. We perceived that intolerance to difference is not enough to explain the severity of these aggressive acts. Thus, we investigated bulling as a maliciously trivial behavior. The source of this kind of behavior is a result of the inability to think and to reflect upon the meaning and the consequences of those aggressive acts. This inability is also a result of a modern society project that does not give the right value to an educational approach aimed at thinking and reflecting. We considered that intolerance and the banality of evil as expressions that motivate and explain bullying. We use the Theory of recognition by Charles Taylor and Axel Honnet and the concept of banality of evil by Hanna Arendt as a basis to our main hypothesis. As our methodological choices, we have had an extensive literature review, along with field observation, questionnaires and semistructured interviews with eight teachers and ten students who volunteered. As a conclusion to this work, we found that students know what bullying is, they know the practice and they are affected by this kind of violence, however they do not completely trust on their school asan institution that could be able to help them face the problem. Teachers know how to identify the bullying cases, but they do not mind comprehending the reasons that lead to those actions. At most, they think of some strategies in order to face the problem. The school management denies that bullying occurs and interprets these conflicts and aggressions as routineplays that normally take place at school. This research also pointed out that bullying is a sidelined and a trivialized theme at school.

Nesse sentido, foi realizada uma pesquisa exploratória, do tipo estudo de caso e de caráter qualitativo, com ex-alunos, beneficiários do Programa de Bolsas de estudo do Colégio Metodista Americano, onde procurei avaliar a relação existente entre a oportunidade da Bolsa de estudo e o ingresso em um campo de possibilidades que viabilize o processo de emancipação desses sujeitos. Para isto foram consideradas diversas condições do campo social, econômico e cultural, do grupo familiar no período em que esses jovens receberam a oportunidade, traçando-se paralelos com as condições em que hoje se encontram. Para tanto, inicialmente, discutimos o desenvolvimento histórico do trabalho doméstico no país, partindo dos fundamentos da sociedade brasileira, da confluência de raça, classe e gênero na sua conformação e do debate teórico consolidado, com o intuito de perceber o seu quadro atual de exclusão social. Em seguida, enfocamos a constituição das relações de trabalho no Brasil e o papel que o Estado assumiu para a inserção do país no sistema capitalista e para a formação do trabalho livre como realidade ampla e concreta, com a finalidade de compreender como emerge na sociedade brasileira a temática da cidadania e os seus efeitos para a classe trabalhadora e, mais precisamente, para as trabalhadoras domésticas. Nessa linha, as teorias do reconhecimento, partindo-se de Charles Taylor, Axel Honneth e Nancy Fraser, surgem como substrato teórico consistente para compreender, de um lado, como se estruturam na contemporaneidade as desigualdades históricas incidentes sobre a dinâmica das relações de trabalho doméstico e, por outro lado, como enfrentar os seus dilemas para a desconstrução simbólica e material dessa realidade. Tais teorias articulam desigualdades de cunho socioeconômicos e valores culturais que reproduzem e tornam legítimas o reconhecimento denegado das trabalhadoras domésticas, razão pela qual o debate acerca do racismo institucional se faz necessário. Por fim, cotejamos as mudanças na sua inserção sociojuridica com a agenda de representação sindical, com o propósito de demonstrar como tal agenda se move pelo binômio redistribuição - reconhecimento, sendo que a inclusão incompleta das trabalhadoras domésticas é uma construção cujo substrato regulatório está no Estado brasileiro. / The current research has as its main axis the analysis of how the fight for the female domestic workers’ recognition, in the field of labor law, showcases the institutional racism of the Brazilian State through an incomplete inclusion. To do so, at first we discussed the historical development of domestic labor in the country, from the fundamentals of the Brazilian society, confluence of race, class and gender in its formation; and from the consolidated theoretical debate, aiming to notice its current state of social exclusion. Then, we focused on the constitution of the work relations in Brazil and the role that the State assumed towards the insertion of the country in the capitalist system and for the formation of free labor as a wide and concrete reality. The goal was to understand how the theme of citizenship comes up in the Brazilian society as well as its effects for the working class and, more precisely, for the female domestic workers. Thus, the theories of recognition, from Charles Taylor, Axel Honneth and Nancy Fraser emerge as a consistent theoretical framework to understand, on the one hand, how the historical iniquities that strike the dynamics of domestic labor relations are structured. On the other hand, they help us understand how to face their dilemmas for the symbolic and material deconstruction of such reality. Those theories articulate socioeconomic iniquities and cultural values that reproduce and legitimize the recognition that is denied for the female domestic workers – which is the reason why the debate about institutional racism is necessary. Lastly, we connected the changes in the sociojuridical insertion of the female domestic workers with their agenda of union representation, aiming to show how such agenda moves through the binomial redistribution-recognition. The incomplete inclusion of those workers is a construction whose regulatory framework lies in the Brazilian State.

[pt] A presente Tese de Doutorado procede à articulação da Teoria do Reconhecimento e da Teoria da Justiça como Análise da Sociedade, de Axel Honneth, como via de análise crítica de práticas sociais e instituições que estabeleçam padrões sociais de afirmação e negação do outro nas relações intersubjetivas, construídas e estendidas entre as gerações. O enfoque temático toma por objeto os conflitos intergeracionais e suas postulações de rompimento ou preservação de legados ou heranças entre as gerações passadas, as gerações presentes e as gerações futuras visando desenvolver abordagem que os situe em uma dimensão normativa ligada à teoria moral, mas não dissociada da expressão da ação social. A compreensão dos conflitos intergeracionais como lutas por reconhecimento intergeracional, perpassando igualmente conflitos situados em uma luta por reconhecimento intrageracional, com reconstrução normativa de práticas sociais e instituições, permitirá conceber a autorrealização intergeracional. A autorrealização intergeracional, interligada à definição de eticidade formal de Honneth, articula ações morais e ações sociais, além de fornecer critérios de identificação de patologias sociais e mecanismos de negação do reconhecimento nas interações sociais. / [en] The present doctoral research perform articulation between the Recognition Theory and the Theory of Justice as an Analysis of Society, by Axel Honneth, as a path for critical analysis of social practices and institutions that establish social patterns of affirmation and refusal for the other into intersubjective relationships built and extended over the generations. The thematic focus takes as object the intergenerational conflicts and his postulations of disruption or preservation of legacy or inheritance among past, present and future generations in order to develop one approach that put them in a normative dimension linked to moral theory but not dissociated from social action expression. Understanding of intergenerational conflicts as struggle for intergenerational recognition, also including conflicts situated in the struggle for intragenerational recognition, accompanied by the normative reconstruction of social practices and institutions, allow conceive the intergenerational selfrealization. The intergenerational selfrealization, linked to Honneth s formal conception of ethical life, articulates moral and social actions, besides providing criteria for identification of social pathologies and mechanisms of negative recognition in social interactions.

Professionellas arbete med social isolering bland vuxna med högfungerande autism : En kvalitativ studie om professionellas arbetssätt och upplevelse av social isolering hos vuxna med högfungerande autism

Syftet med studien är att undersöka huruvida professionella med koppling till LSS-verksamheter inom Eskilstuna kommun upplever vuxna med högfungerande autism som socialt isolerade, vilka bakomliggande faktorer de professionella anser orsaka social isolering samt hur de arbetar för att bemöta detta. Omfattningen av forskning som finns om social isolering hos vuxna med högfungerande autism är liten. Den forskning som finns tyder på att personer inom autismspektrumet ofta upplever begränsningar i sina sociala förmågor, vilket bidrar till svårigheter i sociala interaktioner samt bibehållandet av relationer. Dessa svårigheter kan leda till ett undandragande beteende som kan resultera i social isolering. För att besvara syfte och frågeställningar har semistrukturerade intervjuer med professionella från olika LSS-verksamheter utförts. Analys av det insamlade materialet har skett utifrån Honneths teori om erkännande samt Saleebeys styrkefoukserade förhållningsätt till socialt arbete. Resultatet visar i huvudsak på att de professionella upplever att social isolering är ett förekommande fenomen inom målgruppen där de bakomliggande faktorerna anses vara erfarenhet av misslyckanden i sociala interaktioner, social ångest samt stigmatisering av personer med funktionsnedsättningar. Resultatet tyder på att de professionella arbetar med att individanpassa insatserna efter den enskildes behov för att kunna kompensera för dennes svårigheter. / The purpose of this study is to investigate whether professionals from Eskilstuna municipality who work with people with disabilities perceive adults with high-functioning autism as socially isolated, what underlying factors the professionals consider causing social isolation and how they work towards meeting the individuals need for support. The research available on social isolation in adults with high-functioning autism is limited. The available research indicates that people with autism often experience limitations in their social abilities, which contributes to difficulties in social interactions and relationships. These difficulties can contribute to evasive behavior that can result in social isolation. In order to answer the purpose, semi-structured interviews with professionals from various occupations within social work were conducted. Analysis of the collected material has been based on Honneth's theory of recognition and Saleebey's strengths perspective. The results mainly show that the professionals experience social isolation as a common phenomenon within the target group where the underlying factors are considered to beexperience of failures in social interactions, social anxiety and stigmatization of people with disabilities. The results indicate that professionals work to adapt the environment to support the individual's needs in order to be able to compensate for their difficulties.

The aim of this essay was to describe how school social workers can help and support students with parents who abuse alcohol or other drugs. We wanted to see how school social workers room for action is presented and how it affects their work with students living with parents who are abusing. We used a qualitative method to elucidate how school social workers handle this issue in a more profound way. By conducting semistructured interviews with six school social workers in one province in southern Sweden we gained exhaustive and detailed answers. In the analysis we used street level bureaucracy and theory of recognition. The result showed that the school social workers regard their overarching room of action as very wide inside school but limited outside. At school the school social worker can support the students with supportive counseling and adapted school attendance. One important task of the school social worker is to help the student to get in contact with other organizations for example, support groups for children. We also found that cooperation is an important part as the school social workers describe themselves as “the spider in the web” with the task of connecting and sharing knowledge with other personnel and organizations. The relation with the student is important to be able to support the students or guide them further. School social workers also regard school as a good place to detect and identify these students, but that it can be difficult to know who these students are. If a specific plan for working with students whose parents abuse alcohol or drugs would affect the school social workers work is difficult to say since none that we interviewed in this study had experience of one.

Previous research shows that people with severe disabilities often are neglected in the work of enhancing user participation. It is shown that even though professionals increase the possibility for user participation in their work, it is not necessary that the users receive it. This study aims to show how professionals working for people with disabilities applies user participation in their everyday work. We used a qualitative exploratory method and interviewed ten social workers within service administration and supportive housing, located at three different municipalities in the region of Stockholm. Using Shier’s participation model in combination with theory of recognition we got similar results as previous research. The social workers have a great intention in enhancing user’s participation in their work, though organizational structures stand in their way. That drives them to use what is known as “silent knowledge”, a combination of their personality, previous experience and their ingenuity.
