Esta tesis de máster trata del discurso de la política comercial del presidente de Bolivia Evo Morales, con respecto a la negociaciones del pilar comercial del Acuerdo de Asociación entre la Comunidad Andina y la Unión Europea. Mediante un análisis del discurso de Morales, se responde a las preguntas de cómo puede caracterizarse el discurso de Morales, en qué se fundamenta y qué fines estratégicos tiene. El hilo conductor del trabajo es que Bolivia tiene un presidente que representaría la imagen social de los pueblos originarios y cuando Europa propone un nuevo proyecto como el Acuerdo de Asociación, este proyecto sería percibido como neocolonialista, donde es Europa quien decide en los asuntos internos de su socio latinoamericano. Se analizan 23 declaraciones de Morales, concluyendo que las alusiones a la Colonización es la característica más central de su discurso y que este tema ha afectado la posición de Bolivia en las negociaciones.

With National Telecommunications & Information Administration (NTIA) Advanced Wireless Services (AWS-3) auction of frequencies in the 1695-1710 MHz, 1755-1780MHz, and 2155- 2180MHz bands, users of the Aeronautical Mobile Telemetry (AMT) band from 1755- 1850MHz, known as Upper L-Band, could be greatly affected. This paper takes an initial look at how the 1755-1780MHz band will be used by the cellular carriers and presents some preliminary testing results of adjacent channel (band) interference that could be experienced by AMT users. This paper should be considered as the stepping off point for future interference discussions, required analysis, and further testing.

Robotization as a driver of increased labour productivity and economic convergence or divergence in the European Union / Industrirobotar, produktivitet och ekonomisk sammanhållning

During the years 2004-2014, the manufacturing sector within the EU countries witnessed an increase in the utilization of industrial robots, where robot density per worker approximately doubled. Considering that this is a rather recent event, studies investigating how much industrial robots impact labour productivity are still rare. At the same time, one of EU’s outspoken goals is that of working to foster productivity and economic convergence between the member states. Given the above premises, we have investigated the relation between the adoption rate of industrial robotics within the EU and its effect on labour productivity. Secondly, we have made a predictive convergence model, in terms of labour productivity. We have collected data from several sources, including the Industrial Federation of Robotics and EU KLMS, in order to build a dataset for our quantitative analysis. We have then used statistical methods such as multiple regressions and 3 stage least square analysis (3sls) to estimate our system of interdependent equations model. The results show that implementation of industrial robotics in the manufacturing sector is a driver of labour productivity. The model finally predicts upward labour productivity divergence between the member states in the years 2015-2025, assuming that the determining factors of labour productivity grow at the same pace in our forecast period as in our data sample. / Under åren 2004-2014 fördubblades i genomsnitt antalet industrirobotar per arbetare i tillverkningsindustrin inom EU. Eftersom detta fenomen är relativt nytt, är studier som undersöker industrirobotars påverkan på arbetarproduktivitet fortfarande sällsynta. Samtidigt är ett av EU:s uttalade mål att arbeta för att främja konvergens mellan medlemsländerna inom produktivitet och andra ekonomiska mått. Med ovanstående förutsättningar har vi undersökt förhållandet mellan ökad användning av industriell robotik inom EU och dess effekt på arbetskraftsproduktiviteten. För att bygga en model för vår kvantitativa analys har vi samlat in data från flera källor, inklusive Industrial Federation of Robotics och EU KLMS. Vi har sedan använt statistiska metoder såsom multipel regression och 3-stegs minsta kvadratanalys (3sls) för att estimera vårt system av ekvationer. Resultaten visar att ökad användning av industriell robotik i tillverkningssektorn driver ökad arbetskraftsproduktivitet. Därefter analyserar vi även den aktuella konvergensriktningen för arbetarproduktivitet, och vår modell förutspår uppåtgående arbetsproduktivitetsdivergens, under förutsättning att de ingående faktorerna för arbetskraftsproduktivitet växer i samma takt under vår prognosperiod som under dataunderlagsperioden. / Durante gli anni che vanno dal 2004 al 2014 il settore manifatturiero degli stati appartenenti all’Unione europea è stato testimone di un aumento dell’utilizzo dei robot industriali: la densità di robot utilizzati per ciascun lavoratore è raddoppiata. Considerato che questo è un fenomeno abbastanza recente, gli studi che investigano quanto i robot industriali influiscono sulla produttività lavorativa sono ancora rari. Allo stesso tempo, uno degli obiettivi dichiarati dall’Unione europea è quello di stimolare la convergenza economica tra gli stati membri. Date queste premesse, abbiamo studiato la relazione tra il tasso di adozione dei robot industrali nell’Unione europea e il suo effetto sulla produttività del lavoro. Inoltre, abbiamo sviluppato un modello di previsione della convergenza in termini di produttività lavorativa. Abbiamo raccolto i dati da diverse fonti, tra cui la federazione industriale della robotica ed EU KLEMS, in modo da costruire un dataset per la nostra analisi quantitativa. In seguito abbiamo usato dei metodi statistici come la regressione multipla e la l’analisi dei minimi quadrati a tre stadi (3sls) per testare il nostro sistema di equazioni indipendenti. I risultati mostrano che l’implementazione dei robot industriali nel settore manifatturiero è un elemento motore della produttività lavorativa. Infine, il modello prevede una divergenza della produttività tra i Paesi membri negli anni 2015-2025, assumendo che i fattori determinanti della produttività crescano allo stesso modo nel periodo della previsione rispetto al periodo del nostro campione.

Detection of Denial of Service Attacks on the Open Radio Access Network Intelligent Controller through the E2 Interface

Open Radio Access Networks (Open RANs) enable flexible cellular network deployments by adopting open-source software and white-box hardware to build reference architectures customizable to innovative target use cases. The Open Radio Access Network (O-RAN) Alliance defines specifications introducing new Radio Access Network (RAN) Intelligent Controller (RIC) functions that leverage open interfaces between disaggregated RAN elements to provide precise RAN control and monitoring capabilities using applications called xApps and rApps. Multiple xApps targeting novel use cases have been developed by the O-RAN Software Community (OSC) and incubated on the Near-Real-Time RIC (Near-RT RIC) platform. However, the Near-RT RIC has, so far, been demonstrated to support only a single xApp capable of controlling the RAN elements. This work studies the scalability of the OSC Near-RT RIC to support simultaneous control signaling by multiple xApps targeting the RAN element. We particularly analyze its internal message routing mechanism and experimentally expose the design limitations of the OSC Near-RT RIC in supporting simultaneous xApp control. To this end, we extend an existing open-source RAN slicing xApp and prototype a slice-aware User Equipment (UE) admission control xApp implementing the RAN Control E2 Service Model (E2SM) to demonstrate a multi-xApp control signaling use case and assess the control routing capability of the Near-RT RIC through an end-to-end O-RAN experiment using the OSC Near-RT RIC platform and an open-source Software Defined Radio (SDR) stack. We also propose and implement a tag-based message routing strategy for disambiguating multiple xApps to enable simultaneous xApp control. Our experimental results prove that our routing strategy ensures 100% delivery of control messages between multiple xApps and E2 Nodes while guaranteeing control scalability and xApp non-repudiation. Using the improved Near-RT RIC platform, we assess the security posture and resiliency of the OSC Near-RT RIC in the event of volumetric application layer Denial of Service (DoS) attacks exploiting the E2 interface and the E2 Application Protocol (E2AP). We design a DoS attack agent capable of orchestrating a signaling storm attack and a high-intensity resource exhaustion DoS attack on the Near-RT RIC platform components. Additionally, we develop a latency monitoring xApp solution to detect application layer signaling storm attacks. The experimental results indicate that signaling storm attacks targeting the E2 Terminator on the Near-RT RIC cause control loop violations over the E2 interface affecting service delivery and optimization for benign E2 Nodes. We also observe that a high-intensity E2 Setup DoS attack results in unbridled memory resource consumption leading to service interruption and application crash. Our results also show that the E2 interface at the Near-RT RIC is vulnerable to volumetric application layer DoS attacks, and robust monitoring, load-balancing, and DoS mitigation strategies must be incorporated to guarantee resiliency and high reliability of the Near-RT RIC. / Master of Science / Telecommunication networks need sophisticated controllers to support novel use cases and applications. Cellular base stations can be managed and optimized for better user experience through an intelligent radio controller called the Near-Real-Time Radio Access Network (RAN) Intelligent Controller (RIC) (Near-RT RIC), defined by the Open Radio Access Network (O-RAN) Alliance. This controller supports simultaneous connections to multiple base stations through the E2 interface and allows simple radio applications called xApps to control the behavior of those base stations. In this research work, we study the performance and behavior of the Near-RT RIC when a malicious or compromised base station tries to overwhelm the controller through a Denial of Service (DoS) attack. We develop a solution to determine the application layer communication delay between the controller and the base station to detect potential attacks trying to compromise the functionality and availability of the controller. To implement this solution, we also upgrade the controller to support multiple radio applications to interact and control one or more base stations simultaneously. Through the developed solution, we prove that the O-RAN Software Community (OSC) Near-RT RIC is highly vulnerable to DoS attacks from malicious base stations targeting the controller over the E2 interface.

L'ASEAN et l'UE dans la coopération de sécurité non traditionnelle : le cas du mécanisme de gestion de catastrophes de l'ASEAN

Ce mémoire examine, à l’appui de la théorie de rôles, l’influence de l’UE dans la construction du mécanisme de gestion de catastrophes de l’ASEAN. Contrairement à la plupart de recherches menées sur la relation UE-ASEAN, ce mémoire accorde une attention particulière aux échanges UE-ASEAN dans le domaine de sécurité non-traditionnelle, notamment dans la gestion de catastrophes. À travers nos observations, nous constatons que l’influence de l’UE dans la construction de la politique de sécurité non traditionnelle de l’ASEAN n’est ni monotone, ni constante. Son influence prend souvent forme de commanditaire et d’exemplaire, tandis que lors du lancement ou de l’exécution du projet, l’influence de l’UE cède la place à celle de l’ASEAN elle-même, qui assume constamment la responsabilité de lancer l’initiative et de mettre en place les mesures politiques. Ce mémoire contribue non seulement à remesurer l’influence de l’UE sous forme de différents rôles mais aussi à souligner l’implication des autres acteurs régionaux dans la construction de politiques régionales de l’ASEAN : ils sont tous des acteurs importants dans le développement, l’évolution et l’accomplissent des politiques régionales de l’ASEAN dans la sécurité non- traditionnelle. / Using role theory, this dissertation examines the influence of the EU in the construction of the ASEAN disaster management mechanism. Unlike most research on the EU-ASEAN relationship, this dissertation pays particular attention to EU-ASEAN exchanges in the field of non-traditional security, notably in disaster management. My observations show that the EU's influence in shaping ASEAN's non-traditional security policy is neither monotonous nor constant. Its influence often takes the form of sponsor and exemplar, while at the launch or execution of the project, the EU's influence gives way to that of ASEAN itself, which constantly assumes responsibility for launching the initiative and implementing the policy measures. This dissertation not only helps to re-measure the EU's influence in the form of different roles, but also to highlight the involvement of other regional players in the construction of ASEAN regional policies: they are all important actors in the development, evolution and achievement of ASEAN regional policies in non-traditional security.

Depuis 1999, l’Union européenne a inauguré une nouvelle approche dans ses relations avec l’Amérique latine et les Caraïbes. A cet égard, le premier sommet Union européenne – Amérique latine – Caraïbes, dit « sommet de Rio » marque un tournant grâce au lancement du « partenariat stratégique ». Dans ce cadre, toutes les organisations régionales d’intégration économique situées dans cette zone géographique, et non pas uniquement le MERCOSUR, apparaissent comme des partenaires importants. Le changement obéit autant à des contraintes externes qu’à une stratégie extérieure. Dans le domaine des échanges commerciaux, le but déclaré est d’atteindre « une libéralisation mutuelle des échanges » sur une base équitable et mutuellement profitable tout en défendant certaines valeurs communes. Cependant, le cadre juridique longtemps en vigueur s’est avéré inadapté à l’avènement d’une ambition économique et politique d’une telle ampleur. Par conséquent, l’Union européenne se trouve confrontée au défi de réformer les cadres juridiques de ses relations avec les organisations régionales d’intégration économique d’Amérique latine et des Caraïbes. La thèse analyse l’évolution et la restructuration actuelles des instruments juridiques des relations entre l’Union européenne l’Amérique latine et les Caraïbes. / Since 1999, the European Union began a new competitive approach in its relationships with Latin America and the Caribbean. In this respect, the first step has been made in the European Union-Latin America and Caribbean’ Summit [Rio Summit (1999)] with the launch of a new partnership called “Strategic Partnership”. In this context, all organisations of regional economic integration – not only the MERCOSUR the most competitive one – are considered as important partners. The change is due to external constraints as well as an external strategy. In the field of commercial exchanges, the goal is to attempt “mutual liberalisation of exchanges” on a fair and mutually profitable basis, defending at the same time “common values”. However, the traditional legal framework of the relations is obviously unsuitable for such an ambitious economic and political project. So, from a legal aspect, the European Union is confronted with the challenge of reforming the contractual frameworks of its relations with regional economic integrations in Latin America and in the Caribbean. The issue concerns an analysis of the evolution and restructuring of existing legal instruments of the European Union’s relations with Latin America and the Caribbean. / Desde 1999, la Unión Europea instauró un nuevo enfoque en sus relaciones con América Latina y el Caribe. En este enfoque llamado “estratégico”, todas las organiza-ciones comarcales de integración económicas ubicadas en esta zona geográfica y no úni-camente el MERCOSUR, se pueden ver como interlocutores importantes. La primera cumbre Unión Europea /América latina/Caribe (cumbre de Rio) es una fecha importante en la evolución de las relaciones gracias al lanzamiento “de la colaboración estratégica”. En lo que toca a los intercambios comerciales, la meta declarada es alcanzar una “liberalización mutual de los intercambios” a partir de una base equitativa y mutualmente provechosa de-fendiendo a la vez ciertos valores comunes. Sin embargo, el marco jurídico en vigor durante una larga temporada se ha reve-lado inadecuado para el advenimiento de una ambición económica y política de esta impor-tancia. Por consiguiente, la Unión Europea se enfrenta hoy en día al desafío jurídico de la renovación del marco convencional de sus relaciones con las organizaciones de integración económica de América Latina y del Caribe. El asunto se refiere a un análisis de las rela-ciones exteriores de la Unión Europea desde el punto de vista de los desafíos jurídicos. La médiation des différends civils en droit de l'Union Européenne et ses incidences sur les droits français, anglais et grec / Mediation of civil disputes in the European Union law of and its impact on French, English and Greek law

Aujourd’hui l’Union européenne favorise la règlementation de la médiation par une démarche générale sous la directive n° 2008/52/CE sur certains aspects de la médiation en matière civile et commerciale et par une démarche sectorielle sous la directive n° 2013/11/UE relative au règlement extrajudiciaire des litiges de consommation et le règlement n° 524/2013/UE en ligne des litiges de consommation. Cette tendance législative apparaît comme une exigence d’améliorer l’accès à la justice en réduisant son coût, sa lenteur et sa complexité. La question qui se pose est de savoir dans quel cadre juridique la médiation facilite la résolution amiable des différends ainsi que l’accès à la justice en réduisant le déséquilibre qui caractérise les rapports juridiques, dès lors qu’on écarte la protection juridictionnelle. La réponse appelle l’analyse de la règlementation de la médiation dans le droit de l’Union européenne et dans les droits nationaux examinés. Le droit de l’Union implique que les États membres prennent les mesures nécessaires pour l’application correcte d’une directive (article 288 § 3 TFUE) ; l’application du droit de l’Union européenne devant être assurée sous le respect des principes d’équivalence et d’efficacité. Comment cela peut-être garantie ? La réception du droit de l’Union européenne a contribué à atténuer les ambivalences préexistantes autour du concept de la médiation et a ainsi facilité la mise en place d’une référence commune à la médiation, si elle n’a pas permis une transposition homogène. Dans les trois systèmes étudiés la médiation se manifeste globalement en tant que « phénomène conventionnel », mais qui se situe au carrefour du droit substantiel et processuel. Si l’entier du processus s’exprime de manière conventionnelle, la convention de médiation, acte fondateur du processus, relève d’une dimension duale, à la fois conventionnelle et processuelle Quelle sera la liaison future entre médiation et justice traditionnelle ? La volonté de ne plus laisser la règlementation de la médiation au domaine privé, mais de lui réserver une place centrale dans les règles étatiques parait claire dans les trois systèmes nationaux. Cette « processualisation » de la médiation conduira-t-elle à l’émergence d’« un droit à la médiation » ? Quel rôle contient désormais le droit d’accès au juge (article 6 § 1 Convention EDH et 47 de la Charte européenne des droits de la Charte des droits fondamentaux) autour du développement législatif de la médiation ? Les réponses nécessitent l’analyse du régime qui donne accès à la médiation et du cadre processuel qui garantit l’accomplissement « légitime » de son processus. Le développement opportun de la médiation exige que les personnes qui assurent sa mise en œuvre puissent justifier d’une formation sérieuse en la matière, ainsi qu’un statut fiable pour inciter les intéressés d’y recourir. Quel est le statut du médiateur ? La comparaison des droits nationaux nous permettra d’envisager le meilleur modèle régulateur pour encadrer les compétences du tiers intervenant. Mais un système de médiation réellement efficace s’est traduit par un aboutissement efficace. Comment se valorise-t-il l’ « accord amiable », l’issue négociée en droit, voire en résolution extrajudiciaire d’un différend ? Y a-t-il un contrôle de légalité de l’accord issu de la médiation et si oui, comment ce contrôle se manifeste-t-il ? Les réponses relèvent de l’analyse du régime de l’accord issu de la médiation. / With regard to the Directive n° 52/2008CE of the European Parliament and the Council of 21 May 2008 in certain aspects of mediation in civil and commercial matters, as well as the Directive 2013/11/EU of the European Parliament and of the Council of 21 May 2013 on alternative dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC also the Regulation (EU) n°524/2013 of the European Parliament and the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC (Regulation on consumer ODR), this thesis examine the main lines for the development of mediation set out by the European Union. How the tendency to develop mediation within Europe, represented by the directive the European texts above has been reflected in the three legal systems examined? How mediation works in systems where law is rigid and its infringement is being severely sanctioned (civil law applied in France and Greece) and how does it work in common law (applied in the United Kingdom)? Mediation law is nowadays largely presented as a flexible way to avoid court’s costs, longevity and complexity. But should it be integrated in procedural law as a kind of complementary justice within the courts? Can positive law, courts and amiable dispute resolution cooperate in an effective manner? An effective cooperation of public justice and mediation could be of major importance for the improvement of procedural law, as access to justice is not always guaranteed. Public justice has not always being successful, since the severe application of law has been proven unable to create a social and dynamic legal system. Thus, it often cultivates “bitterness” against judicial adventure. In this regard, mediation promises a profound change in the way of settling disputes. However, the idea of a “private” justice based in contract law does not go without mistrusts. The imbalance between the parties is usually obvious in contract law and fosters the strongest party. The question then is to know if a secure legal framework of mediation based on the particularities of national legal systems could facilitate its proper implementation. The main concept of the thesis is to present a legal structure of mediation combined by the European law’s directives and their implementation in the three national laws. But the nature, the process, as well as the relation of mediation with courts are examined in parallel with the conformity of mediation in the article 6 § 1 of the European Convention of Human Rights, the fundamental right of a public hearing by a tribunal.

La tesi analizza le politiche di promozione della democrazia messe in atto dall'Unione Europea, al fine di inquadrare queste ultime nell'ambito del dibattito sulla dimensione internazionale dei processi di democratizzazione. L'opera si divide in due parti. La prima parte, teorica, pone le basi per la comprensione dei concetti di democrazia, democratizzazione, e dell'influenza del sistema internazionale sui processi di democratizzazione. La seconda parte, empirica, applica tali nozioni, e la definizione di politiche di promozione della democrazia, al caso specifico. Obiettivo della tesi è quello di mostrare la peculiarità dell'azione dell'UE nell'ambito delle politiche di promozione della democrazia. / The thesis analyses EU's democracy promotion policies in order to put these latter in relation to the wider debate on the international dimension of democratization. It is divided into two parts. The first, mainly theoretical draws the foundations for the understanding of the concepts of democracy, democratization, and the international dimension of democratization. The second part, empirical, apply these notions and the definition of democracy promotion policies, to the specific case of the EU. The goal is to show the peculiarity of EU's action in this field.
