The replacement of the doctrine of pith and marrow by the catnic test in English Patent Law : a historical evaluation

This dissertation is a historical evaluation of the movement of the English courts from the doctrine of pith and marrow to the Catnic test in the determination of non-textual infringement of patents. It considers how and why the doctrine was replaced with the Catnic test. It concludes that this movement occurred as a result of the adoption by a group of judges of literalism in the construction of patents while another group dissented and maintained the correct application of the doctrine. Although the Court of Appeal and the House of Lords initially approved the literalist approach, they, after realising its untennability, adopted the dissenters’ approach, but, ultimately, adopted the Catnic test in which features of the dissenters’ approach were included. The dissertation concludes that the doctrine of pith and marrow, correctly applied, should have been retained as the Catnic test creates uncertainty and confusion. / Mercantile Law / LL. M.

The goal of this study is to evaluate, in which manner the Non-Israelites turn to Yahweh. It works with a combination of narrative analysis and intertextuality. The book of Jonah contains two symmetrical parts (1-2 and 3-4), each part containing three scenes, each scene relating to a scene in the other part: 1.1-3 // 3.1-3a; 1.4-16 // 3.3b-10; 2.1-11 // 4.1-11. The structure of 1.4-16, including the inner development of the mariners, shows that a conversion of the Seamen to Yahweh is intended. In the same manner the structure of 3.3b-10 and the positive characterization of the Ninevites show that a conversion to the one true God is intended. These results are each confirmed by an intertextual analysis of 1.14 and 16 and of the faith, the repentance and the God who relents. Result: The book of Jonah teaches that Non-Israelites can have a relationship with Yahweh. This is possible through an Israelite, becoming reality by conversion of the Heathen. / Ziel der vorliegenden Studie ist zu erheben, in wieweit sich die Nichtisraeliten (Seeleute und Niniviten) dem wahren Gott zuwenden. Sie geht methodisch mit einer Kombination aus Erzähltextanalyse und Intertextualität vor. Das Jonabuch besteht aus zwei symmetrischen Hälften (Jon 1-2 und 3-4) mit je 3 Szenen, die einander gegenüberstehen: 1,1-3 // 3,1-3a; 1,4-16 // 3,3b-10; 2,1-11 // 4,1-11. Die Struktur der Seeszene (Jon 1,4-16), sowie die innere Entwicklung der Seeleute zeigen, dass eine Bekehrung zu Jahwe intendiert ist. Diese Einsicht wird von der intertextuellen Analyse von Vers 14 und 16 bestätigt. Ebenso erweist die Struktur der Niniveperikope (3,3b-10) und die positive Charakterisierung der Niniviten eine Bekehrung zum wahren Gott, ein Ergebnis, das von der intertextuellen Analyse des Glaubens, der Buße, sowie der Reue Gottes gestützt wird. Ergebnis: Das Jonabuch lehrt, dass Menschen außerhalb Israels eine Beziehung zu Jahwe haben können, vermittelt durch einen Israeliten und realisiert, wenn sich die Heiden bekehren. / Biblical and Ancient Studies / M. SAMMANFATTNING Bakgrund Elevers grupparbeten utgör en betydande del av HKK-undervisningen. Tidigare forskning kring elevers grupparbeten i allmänhet är omfattande, men forskning gällande elevers grupparbeten inom HKK är ytterst begränsad. Som utpräglat processämne är det av största vikt att eleverna ges möjlighet att träna på praktiska moment inom hem- och konsumentkunskap (HKK), för att eleverna ska kunna utveckla kunskap i handling vilket sedermera ska bedömas av undervisande lärare. Syfte Syftet med studien var att utforska lärares uppfattningar, upplevelser och erfarenheter av grupparbete i HKK. Metod Kvalitativa intervjuer genomfördes med tio HKK-lärare runtom i Sverige. Intervjuerna analyserades med stöd av kvalitativ innehållsanalys. Resultat Det mest framträdande resultatet i studien var att arbetsformen grupparbete var dominerande i såväl praktiskt som teoretiskt arbete inom HKK. Ramfaktorer påverkade, styrde och begränsade undervisningen. Samarbete, kamratlärande, trygghet och praktisk träning var främsta syften med grupparbeten inom HKK. Det sociala klimatet, elevernaskunskapsnivå och särskilda behov var de faktorer som främst togs i beaktning vid sammansättning av elevgrupper. Lärarnas arbete kring elevgruppernas varaktighet skilde sig åt. Observationer var den vanligaste bedömningsformen när elever arbetade i grupp. Bedömning av elever som arbetade i grupp upplevdes vara svårt och utmanande bland lärarna i studien. Slutsats Grupparbete som undervisningsmetod framstår som rådande kutym inom ämnet. Studien påvisade brister med denna undervisningsmetod, främst utifrån bedömningsaspekten. Med mer noggrant uttänkta strategier för varför, hur och när det vore lämpligt att använda grupparbete som undervisningsmetod anser vi att HKK-läraren har möjlighet att höja kvaliteten på såväl undervisning som bedömning. / ABSTRACT  Background Students' group work constitutes a significant part of the teaching in Home and Consumer Studies (HCS). Previous research on students 'group work in general is extensive, but research on students' group work within HCS is extremely limited. As a distinct process subject, it is of the utmost importance that students are given the opportunity to practice practical elements in HCS, so that students can develop ”knowledge in action”, which will be assessed by the teacher.  Objective The aim of the study was to explore the teachers’ perceptions and experiences regarding group work in HCS.  Method Qualitative interviews were conducted with ten teachers in HCS within Sweden. The interviews were analyzed on the basis of content analysis.  Results The most prominent result in the study was that group work was dominant in both practical and theoretical work within HCS. Framework factors influenced, controlled and limited teaching. Cooperation, peer learning, safety and practical training were the main purposes of group work within HCS. The social climate, the students' level of knowledge and special needs were the factors that were mainly taken into account when composing student groups. The teachers' work on the duration of the student groups differed. Observations were the most common form of assessment when students worked in groups. Assessment of students who worked in groups was perceived as difficult and challenging among the teachers in the study.  Conclusion Group work as a teaching method appears to be the prevailing custom within the subject. The study demonstrated shortcomings with this teaching method, mainly based on the assessment aspect. With more carefully thought out strategies for why, how and when it would be appropriate to use group work as a teaching method, we believe that the HCS teacher has the opportunity to raise the quality of both teaching and assessment.

Buscamos conhecer a trajetória profissional destes médicos desde a escolha da medicina como profissão até o encontro com a filosofia e a prática dos Cuidados Paliativos. Com este intuito, realizamos entrevistas semiestruturadas,colhidas segundo a metodologia de História Oral de Vida. Foram entrevistados seis médicos de diferentes especialidades que ocupam cargos diretivos em uma das associações profissionais voltadas para a disseminação e legitimação política e social dos Cuidados Paliativos no Brasil. Os depoentes se destacam no cenário nacional no que diz respeito às discussões sobre esta temática e mantêm contato com importantes instituições internacionais. Por esta razão, chamamos o conjunto de entrevistados de elite médica paliativista. Percebemos uma pobre interlocução entre os médicos paliativistas, o que se reflete na ausência de uma identidade integrada desse grupo profissional. Os entrevistados acentuaram as competências humanitárias necessárias ao bom exercício da Medicina Paliativa, mas, no entanto, não foram explicitadas as competências específicas a este campo profissional, que justificariam seu reconhecimento pelas entidades médicas competentes comouma nova área de atuação ou especialidade.

Re/membering: articulating cultural identity in Philippine fiction in English / Re/membering: l'articulation de l'identité culturelle en littérature philippine anglophone

This dissertation examines how Philippine (or Filipino) authors emphasise the need for articulating or “re/membering” cultural identity. The researcher mainly draws from the theory of Caribbean critic, Stuart Hall, who views cultural identity as an articulation which allows “the fragmented, decentred human agent” to be considered as one who is both “subject-ed” by power but/and one who is capable of acting against those powers (Grossberg 1996 [1986]: 157, emphasis mine). Applied to the Philippine context, this writer argues that, instead of viewing an apparent fragmented Filipino identity as a hindrance to “defining” cultural identity, she views the “damaged” (Fallows 1987) Filipino history as a the material itself which allows articulation of identity. Instead of reducing the cultural identity of a people to what-they-could-have-been-had-history-not-intervened, she puts forward a vision of identity which attempts to transfigure these “damages” through the efforts of coming-to-terms with history. While this point of view has already been shared by other critics (such as Feria 1991 or Dalisay 1998:145), the author’s contribution lies in presenting re/membering to describe a specific type of articulation which neither permits one to deny wounds of the past nor stagnate in them. Moreover, re/membering allows one to understand continuous re-articulations of “new” identities (due to current migration), while putting an “arbitrary closure” (Hall) to simplistic re-articulations which may only further the “lines of tendential forces” (such as black or brown skin bias) or hegemonic practices.<p><p>Written as such (with a slash),“re/membering” encapsulates the following three-fold meaning: (1) a “re-membering”, to indicate “a putting together of the dismembered past to make sense of the trauma of the present” (Bhabha 1994:63); as (2) a “re-membering” or a re-integration into a group and; as (3) “remembering” which implies possessing “memory or … set [ting] off in search of a memory” (Ricoeur 2004:4). As a morphological unit, “re/membering” designates, the ways in which Filipino authors try to articulate cultural identity through the routes of colonisation, migration and dictatorship. <p><p>The authors studied in this thesis include: Carlos Bulosan, Bienvenido Santos, N.V.M. Gonzalez, Nick Joaquin, Frank Sionil José, Ninotchka Rosca, Jessica Hagedorn, and Merlinda Bobis. Sixty-years separate Bulosan’s America is in the Heart (1943) from Hagedorn’s Dream Jungle (2003). Analysis of these works reveals how articulation is both difficult and hopeful. On the one hand, authors criticize the lack of efforts and seriousness towards articulation of cultural identity as re/membering (coming to terms with the past, fostering belonging and cultivating memory). Not only is re/membering challenged by double-consciousness (Du Bois 1994), dismemberment and forgetting, moreover, its necessity is likewise hard to recognize because of pain, trauma, phenomena of splitting, escapist attitudes and preferences for a “comfortable captivity”. <p><p>On the other hand, re/membering can also be described as hopeful by the way authors themselves make use of literature to articulate identity through research, dialogue, time, reconciliation and re-creation. Although painstaking and difficult, re/membering is important and necessary because what is at stake is an articulated Philippine cultural identity. However, who would be prepared to make the effort?<p>------<p><p>Cette thèse démontre que, pour les auteurs philippins, l’articulation ou « re/membering » l'identité culturelle, est nécessaire. Le chercheur s'appuie principalement sur la théorie de Stuart Hall, qui perçoit l'identité culturelle comme une articulation qui permet de considérer l’homme assujetti capable aussi d'agir contre des pouvoirs (cf. Grossberg 1996 [1986]: 157). Correlación entre conocimientos sobre consecuencias de la obesidad y grado de actividad física en universitarios

Introducción. El objetivo del presente estudio es determinar si existe correlación entre los conocimientos sobre las consecuencias de la obesidad y el grado de actividad física de las personas. Métodos. Se realizó un estudio transversal analítico durante los años 2013 y 2014. Participaron 215 alumnos de pregrado seleccionados por conveniencia no relacionados a carreras del campo de la salud en una universidad de Lima, Perú. Se evaluó el grado de actividad física utilizando el International Physical Activity Questionnaire (IPAQ) y el nivel de conocimientos sobre consecuencias de la obesidad utilizando la escala Obesity Risk Knowledge-10 (ORK-10). También, se consignó las fuentes de información de donde obtuvieron el conocimiento para responder dicho cuestionario. Resultados. La mediana de edad fue 20 (rango intercuartílico=4) y 63% eran mujeres. De acuerdo al IPAQ, 53,9% realizaban actividad física alta, 35,4%, moderada y 10,7%, leve. Se encontró una correlación muy baja (rs=0,06) entre el puntaje del ORK-10 y la cantidad de equivalentes metabólicos/minuto consumidos por semana, pero no era significativa (p=0,38). Las personas informadas por medios de comunicación y por personal de salud obtuvieron mayores puntajes en el ORK- 10 que quienes se informaron por otras vías (p<0,05). Conclusiones. La correlación entre los conocimientos sobre consecuencias de la obesidad y el grado de actividad física es muy baja. Es necesario utilizar enfoques multidisciplinarios que incluyan todos los determinantes de la realización de actividad física para poder lograr cambios en la conducta de la población.

Uncanny modalities in post-1970s Scottish fiction : realism, disruption, tradition

This thesis addresses critical conceptions of Scottish literary development in the twentieth-century which inscribe realism as both the authenticating tradition and necessary telos of modern Scottish writing. To this end I identify and explore a Scottish ‘counter-tradition’ of modern uncanny fiction. Drawing critical attention to techniques of modal disruption in the works of a number of post-1970s Scottish writers gives cause to reconsider that realist teleology while positing a range of other continuities and tensions across modern Scottish literary history. The thesis initially defines the critical context for the project, considering how realism has come to be regarded as a medium of national literary representation. I go on to explore techniques of modal disruption and uncanny in texts by five Scottish writers, contesting ways in which habitual recourse to the realist tradition has obscured important aspects of their work. Chapter One investigates Ali Smith’s reimagining of ‘the uncanny guest’. While this trope has been employed by earlier Scottish writers, Smith redesigns it as part of a wider interrogation of the hyperreal twenty-first-century. Chapter Two considers two texts by James Robertson, each of which, I argue, invokes uncanny techniques familiar to readers of James Hogg and Robert Louis Stevenson in a way intended specifically to suggest concepts of national continuity and literary inheritance. Chapter Three argues that James Kelman’s political stance necessitates modal disruption as a means of relating intimate individual experience. Re-envisaging Kelman as a writer of the uncanny makes his central assimilation into the teleology of Scottish realism untenable, complicating the way his work has been positioned in the Scottish canon. Chapter Four analyses A.L. Kennedy’s So I Am Glad, delineating a similarity in the processes of repetition which result in both uncanny effects and the phenomenon of tradition, leading to Kennedy’s identification of an uncanny dimension in the concept of national tradition itself. Chapter Five considers the work of Alan Warner, in which the uncanny appears as an unsettling sense of significance embedded within the banal everyday, reflecting an existentialism which reaches beyond the national. In this way, I argue that habitual recourse to an inscribed realist tradition tends to obscure the range, complexity and instability of the realist techniques employed by the writers at issue, demonstrating how national continuities can be productively accommodated within wider, pluralistic analytical approaches.

戰後在海外發展的台灣獨立運動,藉由抨擊國民黨政府在台灣的施政、質疑關於台灣地位歸屬中國的論述,對國民黨政府統治台灣的「正當性」與「合法性」構成雙重挑戰。雖然國民黨政府在公開場合中,總是強調所謂的「台獨運動」不過是「一小撮人」的「荒謬主張」,是「分裂祖國」的「險惡陰謀」,這些從事台獨的運動者甚至被稱為「叛國者」;然而,海外台灣獨立運動在1960年代快速發展乃至1970年初,美國、日本、加拿大與歐洲等地台獨組織整合成立「世界台灣獨立聯盟」(World United Formosans for Independence,W.U.F.I),將海外台獨運動帶入另一波新階段卻也是不爭的事實,如此之發展自然非國民黨政府所樂見。在反對任何形式「台獨」的原則下,國民黨政府究竟採取怎樣的因應策略來「對付」此一情勢,便是值得深究的課題,而本文將集中探討美國台獨運動的案例。 本研究將利用各單位所典藏之「外交部檔案」,輔以海外台獨團體所發行的刊物、文宣、時人的回憶錄、口述訪談等資料,試圖以較系統性的方式探討國民黨政府如何從面對突發「海外台獨」案例後,開始摸索因應原則,進而在具體案件中實踐,事後檢討成效、修訂策略,又此歷程中反映出哪一些的侷限與挑戰,國民黨政府又是如何設法(或無法)克服或跨越,乃至確立一套因應機制,整合性地運用各種手法的過程。 本文透過分析一手史料並將視野置於「島外」,不僅為海外台獨運動的發展歷史提供一個「官方觀點」的面向,也為國民黨政府在台灣的統治機制提供一個更全面的觀點。 / By criticizing the KMT rule in Taiwan, questioning the claim about Taiwan being retroceded to China, overseas Taiwan Independence Movement brings double challenges to the KMT government in Taiwan. In public, the KMT government always claims that the so-called “Taiwan Independence Movement” is just an absurd proposition claimed by merely a handful of people as well as a malicious scheme to separate Taiwan from the motherland, and participants in Taiwan Independence Movement are labeled as“seditious elements’’. However, overseas Taiwan Independence Movement grew rapidly in the 1960s. In the early 1970s, groups in the United States, Japan, Canada and Europe worked together to establish the “World United Formosans for Independence’’ (W.U.F.I), which brought overseas Taiwan Independence Movement to a new stage, a fact the KMT government doesn’t want to face. The strategies the KMT government, opposing any type of“Taiwan independence”adopts in response to the situation is a topic deserving in-depth study, and this thesis will focus on the case of the United States. This thesis consults materials such as the archives of the Ministry of Foreign Affairs, magazines, oral materials, memoirs and reminiscences of those who were involved in Taiwan Independence Movement. It resorts to a more systematic methodology to explore how the KMT government faces the challenges that the overseas Taiwan Independence Movement brings about. It attempts to uncover the strategies the KMT government adopts in different stages in the process of dealing with various actions launched by the activists. By analyzing the primary sources and focusing its perspective on events "outside the island ", this thesis not only gives an “official perspective” on the development of the overseas Taiwan Independence Movement, but also provides a more comprehensive viewpoint about the ruling mechanism of the KMT government in Taiwan.

A Holistic Approach to the Ontario Curriculum: Moving to a More Coherent Curriculum

This study is an interpretive form of qualitative research that is founded in educational connoisseurship and criticism, which uses the author’s personal experiences as a holistic educator in a public school to connect theory and practice. Key research questions include: How do I, as a teacher, work with the Ontario curriculum to make it more holistic? What strategies have I developed in order to teach a more holistic curriculum? What kinds of difficulties interfere with my practice as I attempt to implement my holistic philosophy of education? This dissertation seeks to articulate a methodology for developing holistic curriculum that is in conformity with Ontario Ministry guidelines and is also responsive to the multifaceted needs of the whole student. The research findings will serve to inform teachers who wish to engage in holistic education in public schools and adopt a curriculum that is transformative while still being adaptable within mainstream education.
