Barnets rättigheter i Svenska kyrkan : Hur införandet av barnkonsekvensanalyser har implementerats i församlingsinstruktioner

This thesis has studied how the decision of the Church of Sweden to introduce Child Impact Assessments has changed the way children and adolescents are mentioned in Pastoral instructions. Using quantitative and qualitative content analysis and the theory of implementation, it has studied how often children and adolescents are mentioned and how the rights of the child are concretized in the latest versions of the Pastoral instructions in the 13 Cathedral Parishes. Central to this study are the three foundational perspectives on the rights of the child: a Child’s-rights perspective, a Children’s perspective, and A Child’s perspective.   The thesis concludes that while the overall frequency of references to children and adolescents in the Pastoral instructions has doubled since the introduction of Child Impact Assessments, the parishes have not satisfactorily considered the rights of the child, since only a few instructions have made use of the three perspectives. The thesis argues that, in order for the parishes to fully implement the Church’s decision, and to better consider the rights of the child in their future work, there is a need for educative efforts towards staff in the parishes.

Barn i familjehemsvård har rätt till stabil vård. Trots detta blir familjehemsvården inte alltid kontinuerlig och resulterar i sammanbrott, vilket försätter barnet i en ännu mer utsatt situation. Uppsatsen syftade till att undersöka barnsekreterares erfarenheter och upplevelser av barnperspektivet och barnets perspektiv vid sammanbrott i familjehemsvård. Sex barnsekreterare intervjuades utifrån en kvalitativ intervjuguide med vinjetter som komplement. Resultatet analyserades utifrån de teoretiska perspektiven barndomssociologi och utvecklingsekologi. Resultatet kan sammanfattas med att barnperspektivet och barnets perspektiv säkerställdes genom att barn får vara delaktiga och göra sin röst hörd med stöd av de metoder som används i socialtjänstens generella arbete med barn. En möjlighet var att barn gavs utrymme att påverka det dem kunde. En begränsning som framkom var vuxenperspektivets företräde. / Children in foster care have the right to stable care. Despite this, care does not always become continuous and results in placement breakdown, putting the child in an even more vulnerable situation. The aim of this study was to examine child welfare social workers' experiences and perceptions of the child perspective and the child's perspective in the event of a breakdown in foster care. Six child welfare social workers' were interviewed based on a qualitative interview guide with complementary vignettes. The result were analysed based on the theories of childhood sociology and developmental ecology. The result can be summarised in that a child perspective and the child's perspective were ensured by children being allowed to participate and make their voices heard with the support of the methods used in the social services general work with children. An opportunity was that children were given space to influence what they could. One limitation that emerged was the preference of the adult perspective.

Esmeralda, som även kom att kallas ”lilla hjärtat”, påträffades avliden hos sina biologiskaföräldrar kort efter att vården av henne enligt LVU upphörde. Som ett resultat av Esmeraldastragiska öde presenterades reformen lex lilla hjärtat, vilken resulterade i flertal lagändringarsom trädde i kraft den 1 juli 2022. Denna studie syftar till att undersöka om och i sådant fall ivilken utsträckning lex lilla hjärtat har fått betydelse för rättstillämpningen. Studien hargenomförts med hjälp av en kvalitativ forskningsmetod och med dokument i form av domarsom behandlar upphörandet av vård av unga enligt LVU 2 § som datainsamlingsmetod.Domarna valdes ut genom ett målstyrt urval och bearbetades genom en tematisk analys. Deteoretiska utgångspunkter som använts i studien är rättssociologi, socialkonstruktivism ochbarndomssociologi. Resultatet från studien visar att lex lilla hjärtat har fått betydelse förrättstillämpningen, dock inte i tillräcklig utsträckning med hänsyn till förväntade effekter.Inledningsvis har det konstaterats att lex lilla hjärtat har medfört aktualiserade krav vidupphörande av vård enligt LVU 2 §. Fortsättningsvis har barnrätten fått en förstärkningmedan beaktandet av föräldrarnas intresse snarare har försvagats. Däremot visar studien attdet fortsatt föreligger brister i hänsynstagandet som görs till principen om barnets bästa samtbarnets perspektiv. / Esmeralda, also called “lilla hjärtat” was found dead at her biological parents house shortlyafter the care of her under the Care of Young Persons Act, ended. As a result of Esmeralda'stragic fate the reform “lex lilla hjärtat” was presented. This led to several changes in the lawthat came into effect on July 1 2022. The purpose of this study is to examine whether and towhat extent “lex lilla hjärtat” has had an impact on the application of law. This study hasbeen based on a qualitative method with documents consisting of verdicts that process thetermination of the care of young persons act, as the data collection method. The verdicts wereselected through a purposive selection and processed with a thematic analysis. The theoreticalperspective that has been used in this study is sociology of laws, social constructivism andchildhood sociology. The result of the study show that “lex lilla hjärtat” has had an impact onthe application of law, although not the expected level of impact. First of all, “lex lillahjärtat” has resulted in higher requirements regarding the termination of the care of youngpersons act. Furthermore the children's rights have been strengthened while the parents'interests have gotten a weakened position. However, this study shows that there is still a lackof consideration to the principle of the best interest of the child and the child's perspective.

This essay delves into the question of whether the desire to understand children in their thought process can lead adults into interpret children ́s thoughts through their own worldview. It explores the idea whether it is futile to believe in the possibility of fully understanding and if we could benefit by surrender that notion.  Inspired by Camus ́essay The myth of Sisyfos and Nagel ́s exploration of the subjective nature of experience in What is it like to be a bat? this essay grapples with the concept of absurdity and the question if Camus and Nagels ideas of absurdity can be helpful for adults in their challenge to grasp a child ́s perspective. Through an exploration of absurdity and a critical examination of adult’s belief in their ability to understand children, specifically concept such as child’s perspective in childhood sociology, this essay aims to shed light on the complex relationship between children and, adults emphasizing the importance of humility and recognizing the inherent limitations of whether a human being fully can understand another human being regardless age. Furthermore, the children ́s book Gropen is used to make visible the ideas about how the realities of children and adults are expressed.

Barnets Bästa : – om rättssäkerhet i Högsta domstolens vårdnadstvister

The purpose of this study was to explore if and how the Swedish Supreme Court are using the concept “the child’s best interest”. This concept is used a lot in Swedish legislation, but it needs interpretation every time it´s used and is often perceived as unclear. This makes it interesting to see how this affects the individual child´s legal rights. Furthermore I want to see if the Supreme Court listen to the child´s own opinion and if not, are there any justifications to why not. The study has a quantitative starting point, where I have gone through a number of judgments and then chosen seven out of a qualitative point where there has been a discussion from the Supreme Court around the individual and the best interest of the child for the individual child and the methods of analysis used in this study are social constructionism, legal sociology and analysis of the idea. The study shows a lack of consistency among the professionals of what the concept really stands for, which negatively affects the legal rights for the individual child. The solution is a closer collaboration between social workers, judges and lawyers to make the concept clearer and more applicable.
