Darbo objektas – Marijampolės savivaldybės greta ,,VIA Baltica“ kelio žemės paėmimas visuomenės poreikiams. Tyrimo tikslas – nustatyti žemės paėmimo visuomenės poreikiams projektų rengimo problemas. Tiriamasis darbas atliekamas analizuojant teisės aktus, teritorijų planavimo dokumentus ir statistinius duomenis. Tyrimui įgyvendinti iškelti uždaviniai:
1. Išnagrinėti teisės aktus, reglamentuojančius žemės paėmimą visuomenės poreikiams;
2. Nustatyti žemės paėmimo visuomenės poreikiams projektų rengimo problemas;
3. Išanalizuoti situacija susijusią su ,,VIA Baltica“ keliu;
4. Statistiškai išnagrinėti šalia ,,VIA Baltica“ kelio paimamus visuomenės poreikiams žemės sklypus.
Tyrimo metodika: Siekiama išanalizuoti žemės paėmimo visuomenės poreikiams procesą, bei nustatyti problemas susijusias su žemės paėmimu visuomenės poreikiams projekto rengimu ir išnagrinėti žemės paėmimo visuomenės poreikiams atvejį Marijampolės savivaldybėje atlikta literatūros šaltinių analizė, dokumentų analizė, sisteminė analizė, panaudoti loginis-analitinis, lyginamasis ir kiti moksliniai metodai. Tyrimo rezultatai:
• Pirmojoje darbo dalyje išnagrinėti žemės paėmimo visuomenės poreikiams teisiniai pagrindai ir procedūros, teisės aktai, reglamentuojantys žemės paėmimą visuomenės poreikiams, išanalizuojamos ir aptariamos problemos susidariusios paėmant žemę visuomenės poreikiams.

[toliau žr. visą tekstą] / The work object is the land acquisition for public needs, i.e. for ”Via Baltica” road in Marijampolė district. The aim of the research is to define the plan preparation problems of land acquisition for public needs. Research work is conducted by analyzing legislation, territory planning documents and statistic data. The objectives for the implementation of the study are as follows:
1. To investigate the legislation governing land acquisition for public needs;
2. To identify the plan preparation problems of land acquisition for public needs;
3. To analyze the situation in relation to ”Via Baltica” road;
4. To analyze statistically the land acquisition for public needs near ”Via Baltica” road.
Research methodology: The aim is to analyze the land acquisition for public needs as a process, and to identify the plan preparation problems associated with the land acquisition for public needs and to examine the case of the land acquisition for public needs in Marijampolė district. The literature review, document analysis, system analysis is conducted, and logical, analytical, comparative and other scientific methods are used in the study. The investigation results are as follows:

Assessment of the determinants of access to land for development in Mutale Local Municipality of Limpopo ProvinceMakhubele, Brilliant 18 September 2017 (has links)
MRDV / Institute for Rural Development / The study was carried out to assess the community-perceived determinants of access to land for development in Mutale Local Municipality. It was conducted in the Makuya and Mutele Traditional Authority areas of the former Mutale Local Municipality. All the views relating to access to land for housing, agriculture and business development expressed during the Vhembe District Land Development Summits and Forum meetings held in 2008, 2010 and 2014 were consolidated. Using this information, a questionnaire comprising entirely closed-ended answers requiring responses on a Likert-type scale of 1 (strongly agree) to 5 (strongly disagree) was prepared. The questionnaire was administered through focus group discussions in community workshops during which youth (male and female), women, men and community leaders were the respondents. Open-ended questions were also administered focusing on the factors hindering or enabling access to land, and solutions that the community perceived needed to be taken. Mean and mode for each response were calculated. Chi-Square tests for association were conducted to determine whether there was any association in the responses obtained from the traditional authority areas. Kruskal Wallis and Mann-Whitney tests were conducted to determine the level of agreement of perceptions respondents with Vhembe district land development summits resolutions among youth, adults and community leaders. There were no statistically significant differences (P > 0.05) in perception of issues relating to access to land for housing, agriculture and business development of land development. Thus, the issues are real and should form a solid basis for planning interventions that might unlock access to land for different types of uses. Moreover, improving transparency and deepening community participation and consultation over classification and sale of unoccupied land could minimise the likelihood of potential land conflict.

Paradigm shift from land redistribution to use of redistributed land for poverty alleviation and sustainable development in South AfricaSihlangu, Precious January 2021 (has links)
Thesis (LLD.) -- University of Limpopo, 2021 / Access to land in South Africa has become a pressing concern and one that needs
special attention. This is so despite the advent of democracy in 1994 which brought
legislative frameworks and other measures promoting access to land. This study seeks
to demonstrate the importance of accessibility of land to ensure realization of socio economic rights through productive use of land and consequently contribute to poverty
alleviation and sustainable development in South Africa. The study examines
adequacy of access to land and productive use of such land by evaluating the
effectiveness of delivery of land reform program. The study emphasises that
productive use of land should be strengthened in order to ensure acceleration of
realization of sustainable socio-economic rights such as provision of food and better
living conditions for land reform beneficiaries. The study further encourages the need
to strengthen legislative measures and compliance in order to improve the delivery of
post-settlement support services to land reform beneficiaries. The Legislation such as
Restitution of Land Rights Act, Provision of Land and Assistance Act , Extension of
Security tenure Act and Land Adjustment Act were promulgated and mainly aimed at
addressing and regulating the allocation or distribution of land to persons or
communities who were previously dispossessed of their land and further made
provisions for instances where one or more persons claim ownership of land, but do
not have registered title deeds in respect thereof, and to provide for incidental matters.
There is a need for radical enforcement of laws, legislation, and regulations promoting
access to land through restitution, redistribution and strengthening tenure reform in
order to realize the delivery and enjoyment of socio-economic rights through
productive use of land. This study reviews laws and regulations in an attempt to utilize
land as a tool to alleviate poverty and accelerate sustainable development in South
Africa, which will enable people to gain access to essential services particularly in rural
areas. Therefore, there is a need to ensure that redistributed land is used productively
to improve the lives of land reform beneficiaries

An analysis of the benefits of the growth in tourism to the local communities in the Panorama region, Mpumalanga ProvinceMonakhisi, Ngwako Philemon 29 February 2008 (has links)
In recent decades tourism has asserted its importance as the biggest employer
and foreign exchange earner in both the developing and developed countries.
Consequently, there has been increasing attention to tourism development as a
strategy to stimulate economic growth, local economic development and poverty
alleviation, especially in the developing countries. This study was undertaken
with the objective of determining the direct benefits of the growth in tourism to
the local communities in the vicinity of protected areas in South Africa's
Mpumalanga Province.
The tourism sector is strategically located within the economic mainstream as it
links easily with other sectors of the economy such as agriculture, hospitality,
transport and entertainment. It has added advantages, including the fact that the
tourist product is consumed at the destination. This offers local communities
opportunities in job creation, skills development, economic empowerment and
social development.
The study found that meaningful involvement of local communities in the
tourism industry through ownership of tourism-related enterprises was almost
non-existent. There were no meaningful linkages between the industry and the
local communities other than the communities' supply of unskilled labour.
There were also no programmes aimed at harnessing the phenomenal growth in
South Africa's tourism for the economic empowerment of local communities.
The economic empowerment of local communities need not be achieved through
the ownership of tourism-related enterprises only, but may also include
shareholding, outsourcing, affirmative procurement and social responsibility
programmes by the industry.The continued marginalisation of the local communities by the tourism industry
was attributed to unsatisfactory progress with the industry's transformation.
The launch of the Tourism Black Economic Empowerment Charter and Scorecard
in 2005 provided impetus for the transformation of South Africa's tourism
industry. However, more work still needs to be done in the identified areas of
ownership and control of tourism-related businesses, distribution of tourism
benefits and the development of tourism-related skills and entrepreneurial
culture in local communities.
The role of the private sector in stimulating community involvement in tourism
is particularly important. The private sector is singled out because of government
policy that tourism development would be regulated by government and be
private-sector driven. Furthermore, the private sector has the capacity and the
resources to mobilise, not only to improve the attractiveness and marketing of a
destination and the overall management of the tourism industry, but also to

Previous issue date: 2010-10-28 / This paper proposes a study about the interpretation of legal provisions that establish the new regulatory framework of one of the mean legal institutions of official performance allusive to agrarian reform, that is the expropriation by social interest to the agrarian reform. This reform is also known as agrarian expropriation, especially under the perspective of the consequences of collective occupation of rural property in the process of inspection or administrative assessment, or
that is about to judge the respective action of agrarian expropriation. One concern that guided this study was to indicate the list of government initiatives to try to contain conflicts in the field, as well as to check to the most diverse jurisdictional understandings these incursions resulted. As theoretical support of this work, the normativity, the relevance of the principle of human dignity and of the nature
protection and the centrality that the principle of social function bears in the current stage of "evolution" of parental rights were analyzed. This occurred without forgetting that there was an expansion of the content, inserted in a context of class struggle, a process of flows and inflows, advances and setbacks. We sought to accomplish an interpretation
more in line with the normativity of the constitutional provisions, in view of the binding and normative force of the constitutional principles, especially of the social function of property. The intention was to resolve the apparent conflict between fundamental rights, since the balance between the respective constitutional values, aiming to achieve the right to access to land as social right, therefore, fundamental right. / O presente trabalho propõe um estudo sobre a interpretação dos dispositivos legais que constituem o novo marco normativo de um dos principais institutos jurídicos de atuação oficial alusivo à reforma agrária, que é a desapropriação por interesse social para fins de reforma agrária. Esta também é conhecida por desapropriação agrária, notadamente sob o prisma das consequências da ocupação coletiva do imóvel rural em vias de vistoria ou avaliação administrativa, ou que está por ajuizar a respectiva ação de desapropriação agrária. Uma preocupação que norteou o presente trabalho foi indicar o rol de iniciativas governamentais na tentativa de conter os conflitos no campo, bem como verificar os mais diversos entendimentos jurisdicionais que estas incursões ocasionaram. Como suporte teórico do trabalho, analisaram-se a normatividade, a relevância do princípio da dignidade da pessoa humana e da proteção à natureza e a centralidade que o princípio da função social ostenta no atual estágio
de evolução do direito pátrio. Isso sem desprezar que houve uma ampliação do conteúdo, inserido num contexto de luta de classe, num processo de fluxos e influxos, avanços e retrocessos. Southern Africa is experiencing land conflicts themselves in very different ways between state and
stakeholders, within and between communities, within families, and specially within singular
persons. The conflict of interests in the right to land in southern Africa with particular reference to
Mozambique becoming a major issue and evidence conflicts at various levels of society and some
of them are quite destructive.
The present thesis seeks to address some juridical aspects on access, tenure and land use rights.
Land problems have clear roots in the dispossession of Africans under colonialism and apartheid,
and the powerful legacy this has left both in terms of outright suffering and also in the historical
memory. Land issues are probably the most contentious topic in Mozambique since the
independence in 1975. In Southern Africa and Mozambique in particular, one of the most profound
causes of such struggles has related to the tenure, the ownership and control of land. In fact the
right to land is the major issue in many societies and in Mozambique the unlimited interest in land
are quite similar, due the fact that majority of people are peasant or agriculturists.
Land is therefore a very strategic socio-economic asset, particularly in poor societies like
Mozambique where wealth and survival are measured by control of and access to land. However,
land is also a state symbol and source of political influence and power. The Law in Mozambique
retains the principle that land is the property of the state and cannot be sold or mortgaged, but it
attempts to adjust this legacy from the socialist past to the reality of a market economy. Despite
existing land law the government still not enable to control the access and right of use of land. The
situation is compounded by a weak or non functioning judiciary system. / Os problemas sobre o direito de acesso, posse, propriedade, uso e aproveitamento da Terra, constituem matéria de debate actual a nível internacional, com realce para a região da Africa Austral e Moçambique em especial. É uma matéria que preocupa os governos e a população em geral, por a terra ser um bem de grande utilidade sócio-económica e política. Moçambique possui um regime jurídico sobre terra (lei nº-19/97 de 1 de Outubro, seu Regulamento e Anexo Técnico), no entanto, ela é lacunosa e carece de reforma afim de se adaptar à realidade dos problemas que se levantam no âmbito da posse, uso e aproveitamento e dos conflitos emergentes. Alguns factores do surgimento de conflitos no âmbito do processo da posse, uso e aproveitamento da terra resultam no entanto, da perda de confiança dos particulares em relação aos órgãos do aparelho do Estado que lidam com matérias sobre terras, devido a burocracia e a corrupção praticada por alguns funcionários. A terra em Moçambique é propriedade do Estado, o que implica uma maior responsabilidade por parte do governo, na sua gestão. O actual regime jurídico sobre a terra, carece de concertação de alguns aspectos fundamentais do ponto de vista legal. Trata-se da harmonização da legislação pertinente sobre terras. As leis promulgadas sobre a matéria embora defendem a necessidade de gestão da terra que beneficie os seus utilizadores, tal vontade, entretanto, não têm produzido efeitos satisfatórios.
