Previous issue date: 2008-01-14 / This master's degree dissertation in Public Politics approaches the notion of person
with deficiency, equality of chances, discrimination against the person with
deficiency, affirmative action, the right To the difference for the politics of quotas in
the used companies with one hundred or more (in the terms of the Federal Law nº
8,213/91 and art. 35 of Federal the Decree nº 3,298/99) in the perception of the great
employers and the people with deficiency in São Luís of the Maranhão. It takes for
empirical field the obliged local companies to fulfill to the politics of quotas and the
representatives of public agencies DRT-MA, MPT-MA, SINE-MA, INSS and MPE, of
the Advice of Right, ONGs, the social movements and workers with deficiency. This
study it adopts for secular clipping the period enters the year of 2000 until October of
2007. The study if it initiates with a boarding of the deficiency in the legal panorama
and the public politics, analyzing the reception of Conventions nº the 111/58 and nº
159/83 of the OIT in Brazil and the National Plan of Human Rights to the light of the
National Politics of Integration of the Carrying Person of Deficiency and if it deepens
when approaching the paradigms of attention to the person with deficiency in Brazil
comparing with the context place. Later it approaches the politics of quotas in the
companies as instrument of the National Politics of Integration of the "Carrying
Person of Deficiency" (Law nº 7,853/89) in Is Luís-MA and the vision of its diverse
local citizens. It concludes pointing that, even so it has registered diverse conceptual
advances and practical also in the local context, the politics of quotas in the
companies implemented as affirmative action under the responsibility of the DRT-MA
still did not obtain to fulfill its objective declared in São Luís, which is: to eliminate all
distinction, exclusion or preference that have for effect annular or to modify the
equality of chances in the inserting, profession or employment relationship in the
companies with more than 100 used the carrying people of deficiency and the
workers rehabilitated for the social welfare. / Esta dissertação de Mestrado em Políticas Públicas aborda a noção de pessoa com
deficiência, igualdade de oportunidades, discriminação contra a pessoa com
deficiência, ação afirmativa, o direito à diferença para a política de cotas nas
empresas com cem ou mais empregados (nos termos da Lei Federal nº 8.213/91 e
do art. 35 do Decreto Federal nº 3.298/99) na percepção dos grandes empregadores
e das pessoas com deficiência em São Luís do Maranhão. Toma por campo
empírico as empresas locais obrigadas a cumprir a política de cotas e os
representantes dos órgãos públicos DRT-MA, MPT-MA, SINE-MA, INSS e MPE, dos
Conselhos de Direito, de ONGs, dos movimentos sociais e de trabalhadores com
deficiência . Este estudo adota por recorte temporal o período entre o ano de 2000
até outubro de 2007. O estudo se inicia com uma abordagem da deficiência no
panorama legal e nas políticas públicas, analisando a recepção das Convenções nº
111/58 e nº 159/83 da OIT no Brasil e o Plano Nacional de Direitos Humanos à luz
da Política Nacional de Integração da Pessoa Portadora de Deficiência e se
aprofunda ao abordar os paradigmas de atenção à pessoa com deficiência no Brasil
comparando com o contexto local. Posteriormente aborda a política de cotas nas
empresas como instrumento da Política Nacional de Integração da Pessoa
Portadora de Deficiência (Lei nº 7.853/89) em São Luís-MA e a visão de seus
diversos sujeitos locais. Conclui apontando que, embora tenha registrado diversos
avanços conceituais e práticos inclusive no contexto local, a política de cotas nas
empresas implementada como ação afirmativa sob a responsabilidade da DRT-MA
ainda não conseguiu cumprir o seu objetivo declarado em São Luís, qual seja: elidir
toda distinção, exclusão ou preferência que tenha por efeito anular ou alterar a
igualdade de oportunidades na relação de emprego ou de profissão, bem como de
inserir nas empresas com mais de 100 empregados as pessoas portadoras de
deficiência e os trabalhadores reabilitados pela previdência social.

La notion de non-discrimination en droit public français / The notion of non-discrimination in French public lawCharruau, Jimmy 12 December 2017 (has links)
C’est en tant que principe du droit de l’Union européenne et de la Convention européenne des droits de l’Homme que la non-discrimination est souvent étudiée. Rattachée au droit français, la notion a fait l’objet d’analyses qui, pour la plupart, se sont limitées à un critère (sexe, race,etc.) ou à un domaine en particulier (fonction publique, marchés publics, etc.). On saisit l’intérêt d’une étude globale de la non-discrimination en droit public français ; et ce d’autant plus que si la notion émerge, sa mise en oeuvre rencontre des difficultés qui tiennent aux spécificités de ce droit par rapport au principe d’égalité. Adapté à la culture juridique anglosaxonne, ce principe attire la suspicion : il entraînerait avec lui des conséquences a priori peu compatibles avec l’universalisme français. Le principe d’égalité ne semble pourtant plus entièrement suffire pour répondre aux réalités sociales. Les juges recourent aux dérogations, au risque d’affaiblir la norme. Et la doctrine se livre à des acrobaties conceptuelles pour en minimiser l’importance. La non-discrimination offre de ce point de vue des perspectives utiles au droit français en alliant interdiction active des discriminations et promotion des différenciations. Au fond, la notion ne vise rien d’autre que la recherche de l’intérêt général, ou plus exactement de l’ « utilité commune » (article 1er de la Déclaration de 1789). Au-delà des préjugés, elle s’avère conforme à notre tradition juridique. Forte d’une dimension holistique et plus centrée sur la manière de vivre en commun que sur l’exacerbation de droits strictement catégoriels, la non-discrimination mériterait d’être élevée à la dignité constitutionnelle. / Non-discrimination is often studied as a principle of both European Union law and European Convention on Human Rights. In French law, the notion has been the subject of analyses which have mostly been limited to a criteria (sex, race, etc.) or to a particular field (public service, public contracts, etc.). We can see the significance of a global study of non-discrimination in French public law ; all the more that if the notion is appearing, it is still difficult to implement it, due to the specificities of French law regarding the principle of equality. Adapted to the Anglo-Saxon legal culture, this principle attracts suspicion : it would trigger some consequences which would not be seen at first as befitting French universalism. However, the principle of equality does not seem to be sufficient in itself to address social realities. Judges use derogations, risking to weaken standards. And the doctrine has to adjust through conceptual feats to minimize its scope. Non-discrimination offers, from this point of view, useful perspectives for French law by combining active prohibition of discrimination and promotion of differentiation. Basically, the notion only aims to seek general interest, or more precisely the "common utility" (article 1 of the Declaration of 1789). In spite of appearances, non-discrimination is in agreement with our legal tradition. Because it has a holistic dimension and it is focusing more on how to live together than on making categorical rights worse, non-discrimination deserves to be raised to constitutional dignity.

[pt] Esta tese tem por objetivo avaliar parte do discurso público, acadêmico e
institucional, que fundamentou a moralidade legitimadora das cotas raciais. São
destacadas incialmente duas correntes teóricas distintas, de origens anglo-saxônica
e germânica, que dominaram parte do discurso público sobre o tema, quais sejam:
as teorias liberais de justiça distributiva e as teorias do reconhecimento. A partir
dos autores expoentes de cada uma dessas teorias, a saber: John Rawls, Charles
Taylor e Axel Honneth, busca-se compreender se essas teorias são capazes de
articular um conjunto de ideias e valores que possam subsidiar não apenas a
moralidade das cotas raciais, como também fornecer instrumentos que ajudem a
desenhar os objetivos e alcances dessas políticas. Nesse sentido, três hipóteses
foram contempladas: as cotas raciais são políticas resumíveis ao escopo normativo
das teorias de justiça distributiva; as cotas raciais podem produzir um tipo de
reconhecimento intersubjetivo capaz de gerar mudanças simbólicas e estruturais
para além da mera distribuição; as cotas raciais são uma modalidade de política
pública capaz de conciliar os objetivos dispostos de ambas as teorias,
independentemente de suas eventuais incongruências ou conformidades. Ao
reconstruir a genealogia do discurso filosófico que fundamentou a legitimidade de
tais políticas públicas, almeja-se reconstruir também as promessas e
potencialidades que as cotas raciais possuem, lançando-se mão da ideia de crítica
imanente como método de investigação da realidade social. Logo, aponta-se como
conclusão que as ações afirmativas, sobretudo as cotas raciais, podem mesclar
efeitos que representem melhorias redistributivas dos recursos sociais e materiais
fundamentais em cadeia, como igualmente um reconhecimento em sentido amplo,
abrangidas aqui as mudanças estruturais no acesso aos mesmos recursos. / [en] This thesis aims to evaluate part of the public, academic and institutional
discourse, which founded the legitimizing morality of racial quotas. Initially, two
distinct theoretical currents are highlighted, both from Anglo-Saxon and Germanic
origins, which dominated part of the public discourse on the subject, namely: the
liberal theories of distributive justice and the theories of recognition. Based on the
exponent authors of each of these theories, namely: John Rawls, Charles Taylor
and Axel Honneth, we seek to understand whether these authors can articulate a set
of ideas and values that can support not only the morality of racial quotas, but also
provide instruments that help designate the goals and reach of these policies. In this
sense, three hypotheses were considered: racial quotas are policies that can be
summed up in the normative scope of theories of distributive justice; racial quotas
can produce a type of intersubjective recognition capable of generating symbolic
and structural changes beyond mere distribution; racial quotas are a type of public
policy capable of reconciling the objectives set out in both theories, regardless of
their eventual inconsistencies or conformity. By reconstructing the genealogy of
the philosophical discourse that founded the legitimacy of such public policies, it is
also sought to reconstruct the promises and the potential that racial quotas have,
making use of the idea of immanent criticism as a method of investigating social
reality. Thus, it is pointed out as a conclusion that affirmative actions, especially
racial quotas, can have mixed effects that represent redistributive improvements of
fundamental social and material resources in a chain, as well as recognition in a
broad sense, including structural changes in access to their resources. / [fr] Cette thèse vise à évaluer une partie du discours public, académique et
institutionnel, qui a fondé la moralité légitimante des quotas raciaux. Dans un
premier temps, deux courants théoriques distincts sont mis en évidence, d origine
anglo-saxonne et germanique, qui ont dominé une partie du discours public sur le
sujet, à savoir: les théories libérales de la justice distributive et les théories de la
reconnaissance. Sur la base des auteurs de chacune de ces théories, à savoir: John
Rawls, Charles Taylor et Axel Honneth, nous cherchons à comprendre si ces
auteurs sont capables d articuler un ensemble d idées et des valeurs qui peuvent non
seulement soutenir la moralité des quotas raciaux, mais aussi fournir des
instruments qui aident à concevoir les objectifs et la portée de ces politiques. En ce
sens, trois hypothèses ont été envisagées: les quotas raciaux sont des politiques qui
peuvent se résumer dans le cadre normatif des théories de la justice distributive; les
quotas raciaux peuvent produire une forme de reconnaissance intersubjective
capable de générer des changements symboliques et structurels au-delà de la simple
distribution ; les quotas raciaux sont une modalité de politique publique capable de
concilier les objectifs énoncés dans les deux théories, indépendamment de leurs
éventuelles incohérences ou conformités. En reconstituant la généalogie du
discours philosophique qui a fondé la légitimité de telles politiques publiques, on
cherche également à reconstituer les promesses et le potentiel des quotas raciaux,
en utilisant l idée de critique immanente comme méthode d investigation de la
réalité sociale. Par conséquent, il est souligné comme conclusion que les actions
positives, en particulier les quotas raciaux, peuvent mélanger des effets qui
représentent des améliorations redistributives des ressources sociales et matérielles
fondamentales dans une chaîne, ainsi qu une reconnaissance au sens large, y

Previous issue date: 2009-11-23 / The master s degree dissertation demonstrates the person with deficiency path in the search of the recognition of his rights, focusing the protection foreseen in several international diplomas destined to the reconstruction of the human values, in the the Federal Constitution of 1988 and in several infraconstitutional laws. It defines the person with deficiency in our juridical system, enlarging the list of the Ordinances ns. 3.298/1999 and 5.296/2004, based in the international legal system and in the jurisprudence. The development of the concepts of human dignity, equality and non discrimination are the foundations for the creation of affirmative actions, seeking to the social inclusion of the persons with deficiency, and they are object of a fast approach. In Brazil, the equalization of access opportunities to the job market for persons with deficiency is looked for through the adoption of a system of quotas or legal reserve. The Brazilian system of quotas forces to the persons with deficiency recruiting in the formal market of work, through contract between employee and employer, or through the use of reserved vacancy in public contest. The compulsory nature of person with deficiency recruiting, the increase of the fiscalization by the Labor Department and by the Labor Public Prosecution Service and the recruitings without any planning are cause of legal and social questions. To guarantee the economical function of the companies and to motivate the Brazilian system of quotas, this work proposes the adoption of fiscal and social security measures, the creation of subsidies and the alteration of the Law n. 8.742/93, in order to increase the forecast of a temporary suspension of the payment of the benefit of the special attendance when of the beginning of a labor activity of any species, until the person with deficiency returns to the inactivity. The person with deficiency social inclusion is accompanied of a series of important subjects, treated by the work, that should be faced by the State and by the whole society / A dissertação de mestrado demonstra a trajetória da pessoa com deficiência na busca do reconhecimento de seus direitos, enfocando a proteção prevista em diversos diplomas internacionais voltados à reconstrução dos valores humanos, na Constituição Federal de 1988 e em diversas leis infraconstitucionais. Define quem é a pessoa com deficiência em nosso ordenamento jurídico, ampliando o rol constante nos Decretos ns. 3.298/1999 e 5.296/2004, com fundamento no ordenamento internacional e na jurisprudência. O desenvolvimento dos conceitos de dignidade humana, igualdade e não discriminação são os fundamentos para a criação de ações afirmativas, visando à inclusão social das pessoas com deficiência, e são objeto de uma rápida abordagem. No Brasil, busca-se a equiparação de oportunidades de acesso ao mercado de trabalho da pessoa com deficiência, através da adoção de um sistema de cotas ou reserva legal. O sistema de cotas brasileiro obriga à contratação de pessoas com deficiência no mercado formal de trabalho, por meio de contrato entre empregado e empregador, ou através da utilização de vaga reservada em concurso público. A obrigatoriedade de contratação de pessoas com deficiência, o aumento da fiscalização do Ministério do Trabalho e do Ministério Público do Trabalho e as contratações sem qualquer planejamento são causa de questionamentos legais e sociais. Para garantir a função econômica da empresa e incentivar o sistema de cotas brasileiro, propõe este trabalho a adoção de medidas fiscais e previdenciárias, a criação de subsídios e a alteração na Lei n. 8.742/93, no sentido de acrescentar a previsão de uma suspensão provisória do pagamento do benefício da assistência especial, quando do início da atividade laboral de qualquer espécie, até que a pessoa com deficiência volte à inatividade. Previous issue date: 2010-06-09 / This paperwork is the result of a research that intends to investigate possible relations
between Law and development, based upon an empiric study of the affirmative actions
implemented by the Brazilian federal universities, mainly by means of the reservation of
enrollment slots to minorities on its admission exams (social and racial quotas), but through
the perspective of Court s decisions on the matter. The research focused on the analysis of
whether or not such affirmative actions were held constitutional by the Regional Federal
Courts of Brazil and by the Brazilian Supreme Court. Also the research intended to verify if
such Courts recognized these quotas as public policies or affirmative actions (and thus if
this recognition made them adopt a more detailed judicial review of such programs).
Furthermore the research intended to study how the apparent conflict between the
Executive Branch (universities) and the Legislative Branch, on whether a specific law is
needed in order to authorize the adoption of such affirmative actions, was settled and how
Courts acted when called to impose affirmative actions in the event of an omission by the
Executive Branch. In addition to these specific issues, and assuming that affirmative actions
are State policies directed to assure equality and, thus, reduce poorness and prejudice,
aiming to promote social development, the main purpose of the research was to examine if
such elements were part of the judicial debate that was studied and what was its importance
on the examined decisions. We have verified that, considering absolute numbers, the quotas
affirmative action is held constitutional by Federal Courts in Brazil. But by analyzing the
decisions in each region of the Country we have noticed that a consensus on the subject is
far and that there is no precedent of the Brazilian Supreme Court on the matter. In general,
the Court s decisions value university autonomy on the implementation of affirmative
actions, recognizing that such attribution does not belong only to the Legislative Branch,
assessing such measures as public policies (and eventually, in more cases than anticipated,
establishing or modulating these policies), although this assessment does not imply a
deeper judicial review of the quotas programs, examining all its aspects. Beyond the debate
on the constitutionality of the studied affirmative actions, the research detected a number of
other problems related to its application, such as, for instance, the lack of a general and
common provision on who could be considered a student from a public school in order to
benefit from the social quotas, what suggests the need for a federal law determining the
guidelines (standards) in order for such affirmative actions to be adopted by the federal
universities in Brazil. Nonetheless, the debate on the constitutionality of such policies is
marked by a clear discussion on its contribution or not to the development of the Country
and, although that is not the main issue discussed on the decision, it is a strong element on
the appreciation of the matter / Este trabalho é o resultado de uma pesquisa voltada a investigar possíveis correlações entre
Direito e desenvolvimento a partir do estudo de um caso concreto: a implantação de ações
afirmativas nas universidades federais brasileiras, especificamente por meio da reserva de
vagas a minorias em seus vestibulares (cotas sociais e raciais), mas analisando a perspectiva
da jurisprudência a respeito do assunto. O levantamento realizado tinha como objetivo
examinar se essas medidas eram tidas como constitucionais pelos Tribunais Regionais
Federais e pelo Supremo Tribunal Federal, se essas Cortes reconheciam tais medidas como
políticas públicas ou ações afirmativas (e se esse fato as induzia a realizar um controle
judicial mais pormenorizado desses programas). Adicionalmente, a pesquisa buscou estudar
como se decide o conflito de competência entre o Poder Executivo (universidades) e o
Poder Legislativo a respeito da necessidade ou não de lei específica autorizando a adoção
de ações afirmativas pelas universidades e qual era a postura dos Tribunais no caso de
existir pedido de implantação de ação afirmativa em virtude de omissão administrativa.
Além desses aspectos pontuais, a hipótese maior que pautou a pesquisa cujos resultados ora
se apresentam partia da premissa de que ações afirmativas são medidas de Estado voltadas
à promoção da igualdade material com redução de desigualdades econômicas e sociais,
visando o desenvolvimento nacional. Nesse contexto, examinou-se se esses elementos
estavam presentes ou não nos debates judiciais estudados e qual era o peso que tinham na
decisão dos magistrados. Constatou-se que, em número absoluto de decisões analisadas, as
cotas são tidas como constitucionais, porém examinando-se o conjunto de decisões em cada
região do País, percebe-se que o assunto está longe de alcançar um consenso, não havendo
ainda pronunciamento definitivo do Supremo Tribunal Federal sobre o tema. Em geral, a
jurisprudência valoriza a autonomia universitária na implantação de ações afirmativas,
afastando o possível conflito de competência com o Legislativo e reconhecendo tais ações
como políticas públicas (e em mais casos do que se supunha o próprio Judiciário fixou ou
modulou tais políticas), embora isso não implique uma revisão judicial mais aprofundada
desses programas, contemplando todos os seus aspectos. Para além da discussão a respeito
da constitucionalidade dessas ações afirmativas, a pesquisa levantou uma série de outros
problemas relacionados à sua aplicação, como, por exemplo, a ausência de uma
padronização a respeito de quem pode ser considerado estudante egresso do ensino público
para ser beneficiário das cotas sociais, o que sugere a necessidade de uma lei federal
fixando diretrizes (standards) para implantação dessas ações pelas universidades federais.
Todavia, o debate sobre a constitucionalidade dessas medidas é pautado por uma discussão
a respeito da sua contribuição ou não para o desenvolvimento do País, não sendo o
fundamento principal das decisões, mas um elemento fortemente presente no exame da
questão

Previous issue date: 2017-05-08 / Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / Será apresentada através desta dissertação, a pesquisa de mestrado iniciada no primeiro semestre de 2015, no Programa de Pós-Graduação em Estudos da Linguagem, da Universidade Estadual de Ponta Grossa (UEPG). Cujo objetivo principal consiste em analisar os discursos e encaminhamentos presentes nos embates, que resultaram na Resolução UNIV. Nº 17 de 9 de dezembro de 2013 da UEPG. Os objetivos secundários consistem em contextualizar a elaboração da atual resolução, através de investigações das articulações e manifestações, que contribuíram para que os Movimentos Sociais fossem ouvidos durante o Conselho de Ensino, Pesquisa e Extensão e do Universitário, que ocorreu no final do ano de 2013. Por último, analisaremos o desdobramento da atual resolução, a cartilha informativa sobre as políticas de cotas na UEPG. Para este fim, na fundamentação epistemológica, discutiremos sobre a temática das políticas de cotas, através do eixo teórico-metodológico da Análise Crítica do Discurso (ACD), baseando-nos em Fairclough (2005 e 2008), Van Dijk (2001, 2008 e 2005), Magalhães (2005), Ottoni (2007), Pereira (2011), Sales (2012), Resende e Ramalho (2005), Pagano e Magalhães (2005) e Marcuschi (2008). Também refletiremos sobre a relação entre discurso e poder dentro de um sistema social de desigualdade racial, pautando-nos em: Van Dijk (2001, 2008 e 2010), Muniz (2009), Oliveira (2006), Moita Lopes (2013), Rivas e Diez (2014) e Blommaert (2006). A metodologia impregnada foi de base qualitativa, a qual também envolveu Estudo de Caso, Pesquisa Documental e ACD. Desta maneira, apresentaremos as análises que realizamos em diferentes tipos de textos que registraram o Conselho Universitário de 2013. Em nossas considerações, apresentamos algumas conclusões baseadas em tudo o que discutimos durante nossas reflexões teóricas, onde avaliamos a trajetória que a presente pesquisa seguiu até então, junto com algumas considerações acerca dos resultados obtidos. / It will be introduced trough this dissertation, the research of the master program started in the first semester of 2015, in the Postgraduate Programs of the Language Studies, of the State University of Ponta Grossa (UEPG). Which key objective consists in analyzing the discourses and directions present, in the follow Resolution UNIV. N° 17 of 19th, December 2013 of the UEPG. The supporting objectives consists on the contextualization and elaboration of the current resolution, trough investigations of demonstrations that contributed for the social movements to be heard at the meeting of the Conference of Education, Research and Extension and the University, that happened by the end of 2013. In conclusion, we will analyze what followed the current resolution, the introductory textbook about quotas at UEPG. To do so, in the epistemology we will discuss about the theme of quotas trough the theoretical and methodological axis of the Critical Analysis of Discourse (CDA), based in Fairclough (2005 and 2008), Van Dijk (2001, 2008 and 2005), Magalhães (2005), Ottoni (2007), Pereira (2011), Sales (2012), Resende and Ramalho (2005), Pagano and Magalhães (2005) and Marcuschi (2008). Also, we will be reflecting about the relation between discourse and power within a social system of the racial inequality based in, Van Dijk (2001, 2008 and 2010), Muniz (2009), Oliveira (2006), Moita Lopes (2013), Rivas and Diez (2014) and Blommaert (2006). The impregnated methodology was of qualitative base, which also implicated in Case Study, Documentary Research and CDA. By this mean, we will be introducing the analysis that we realized in different kind of texts that registered the the University Conference of 2013. In our considerations, we introduced some based conclusions in all that was discussed during our theoretical reflections, where we evaluate the trajectory that the present research followed until then, along with some conclusions of the obtained results.

Seu objetivo foi entender, compreender, analisar o papel dessas ações e/ou o sentido que tem para os egressos dessa Instituição de Ensino Superior privada, no Brasil, conveniada com o Centro Ecumênico de Cultura Negra (CECUNE). De forma secundária, ela objetivava conhecer, pelo estudo sistemático, a ancestralidade africana; aproximar as relações entre raça/etnia e classe social; compreender o caminho/processo das lutas do povo negro afro-gaúcho e brasileiro; analisar os caminhos dessas ações no mundo, especificamente no Brasil e nos Estados Unidos. Foi feito um estudo de caso – de natureza qualitativa – mediante coleta de dados por meio de questionários, entrevistas, encontro de egressos e análise de documentos dos locais da pesquisa. Foram entrevistados professores do The John Lewis Warfield Center for African and African American Studies at The University of Texas at Austin – USA e analisada a produção bibliográfica desse país sobre a temática. Como resultados, foram descobertos costumes locais cotidianos oriundos do passado africano que deixaram suas contribuições em nossa sociedade; nos tempos da escravidão, lutas quilombolas emergiram na/para abolição das desigualdades. Os conceitos das ações afirmativas se diferenciam – em amplitude e metas – na educação, no mercado de trabalho e na diversidade do convívio em espaços sociais. Concluiu-se que as relações raça-etnia-classe formam o tripé onde se destacam como sentidos da ação afirmativa para os egressos: futuro profissional; futuro familiar e pessoal; realização de um sonho; possibilidade de reconstrução da identidade; oportunidade única; elevação da autoestima; retratação cultural; avanço socioeconômico e perspectiva de vida. / This dissertation has the central concern with the affirmative actions in the Brazilian society and problematizes: "What meanings do the affirmative actions have to former students of the Instituto Metodista Porto Alegre (IPA-RS)?" Its objective was to understand, grasp, and analyze the affirmative actions role and/or meaning to former students of this Brazilian private college institution, affiliated to the Centro Ecumênico de Cultura Negra (CECUNE). Secondly it aimed at knowing the African ancestrality through a systematic study; at approaching the relations between race/ethnicity and social class; at grasping the path/process of Black people´s struggles in Rio Grande do Sul and in Brazil; at analyzing the ways of those actions in the world, specifically in Brazil and in the United States. A case study was performed – in qualitative terms – by collecting data through questionnaires, interviews, meetings with former students, and analysis of documents from the research sites. Were also interviewed professors of The John Lewis Warfield Center for African and African American Studies at The University of Texas at Austin – USA and analyzed the bibliographic works about the thematic produced in this country. As a result, were found daily local habits arisen from the Africans past, which bring contributions to our society; in slavery times, maroon struggles emerged to abolish racial inequalities. Affirmative actions concepts differ – in ampleness and goals – in education, in labor market and in the diversity of social contact in social spaces. The conclusion was that race-ethnicity-social class relations form the tripod where the meanings of affirmative actions to former students are highlighted: professional future; family and personal future; a dream fulfillment; ways of identity reconstruction; unique opportunity; self-esteem improvement; socioeconomic progress, cultural withdrawal and life perspective. / La tesis tiene el punto central en las acciones afirmativas en la sociedad brasileña y problematiza: "¿Qué sentidos tienen para los egresos del Instituto Metodista Porto Alegre (IPA-RS) las Acciones Afirmativas?" Objetivo: entender, comprender, analizar su papel y/o sentido para egresos de esta Institución de Enseñanza Superior privada en Brasil, conveniada al Centro Ecumenico de Cultura Negra (CECUNE). Previous issue date: 2017-09-13 / Não recebi financiamento / The main objective of this research was to construct guidelines for a future formulation of policies of access and permanence for students from disadvantaged economic sectors, based on the current legislation, that intend to enter in the courses of master academic and doctorate. This was done through the collection of information on the lattes platform and on institutional sites, both of free access, and also through questionnaires applied to undergraduate and graduate coordinators. It was also part of this objective to verify what are the current institutional policies geared specifically to graduate students. Finally, the following proposals for guidelines for actions for access were elaborated: a) Increased dissemination of UFSCar's research groups to motivate undergraduate students to join these groups; b) Offer of language courses for UFSCar undergraduates who wish to enter the master's and doctoral courses; c) Assistance in the elaboration of research projects, both at the undergraduate level (CI projects) and at the postgraduate level (Master's projects, mainly). Actions for permanence: d) Improvement of UFSCar infrastructure to meet people with special needs; e) Encouraging the active participation of postgraduate students in the discussions involving scholarship, housing, food and transportation; f) Expand the offer of scholarships that take into account socio-economic criteria, in addition to the academic criteria. For both of them: g) To create spaces for discussion at UFSCar that deal with the problems of access and permanence in postgraduate courses of students from economically disadvantaged social strata, involving teaching staff, technical-administrative staff, undergraduate students and graduate students. / O objetivo principal desta pesquisa foi construir diretrizes para uma futura formulação de políticas de acesso e permanência para estudantes oriundos de setores econômicos desfavorecidos, com base na legislação atual, que pretendem ingressar nos cursos de mestrado acadêmico e de doutorado. Isto foi realizado através da coleta de informações na plataforma lattes e em sites institucionais, ambos de livre acesso, e também por meio dos questionários aplicados aos coordenadores de graduação e de pós-graduação. Também fez parte deste objetivo verificar quais são as atuais políticas institucionais voltadas especificamente para pós-graduandos. Por fim, foram elaboradas as seguintes propostas de diretrizes de ações para o acesso: a) Maior divulgação dos grupos de pesquisa da UFSCar para motivar o ingresso dos alunos de graduação nesses grupos; b) Oferta de cursos de idiomas para os alunos de graduação da UFSCar que pretendem ingressar nos cursos de mestrado e doutorado acadêmicos; c) Auxílio na elaboração de projetos de pesquisa, tanto em nível de graduação (projetos de IC) como em nível de pós-graduação (projetos de mestrado, principalmente). Ações para a permanência: d) Melhoria da infraestrutura da UFSCar para atender pessoas com necessidades especiais; e) Incentivo à participação ativa de discentes de pós-graduação nas discussões que envolvem bolsa, moradia, alimentação e transporte; f) Ampliar a oferta de bolsas que levem em consideração critérios socioeconômicos, além dos critérios acadêmicos. Para ambos: g) Criar espaços de discussão na UFSCar que tratem da problemática de acesso e permanência na pós-graduação, de estudantes de camadas sociais economicamente desfavorecidas, envolvendo servidores docentes, servidores técnico-administrativos, alunos de graduação e alunos de pós-graduação.
