This article reflects on the treaty-making power of the Congress and the President of the Republic in light of the Peruvian domestic law and International Law (particularly within the framework of the Vienna Convention of 1969 on the Law of Treaties) taking into account the discussions that arose betweenthe legislative and the executive powers regarding the ratification of the Extradition Treaty between Peru and France of 2016. The domestic law applicable to the conclusion of a treaty in Peru establishes that the President of the Republic is the only one who has the power to express the consent of the State to be bound by a treaty through ratification, which has internationallegal effects. The Congress has the power to approve treaties whose provisions are related to topics listed in Article 56 of 1993 Peruvian Constitution. The Congress’ legislative approval implies a parliamentary control regarding the acts of the President. However, Congress cannot compel the President to ratify a treaty (as it was discussed regarding the Extradition Treaty between Peru andFrance) neither issue the ratification. / Este artículo reflexiona en torno a las atribuciones para celebrar tratados que tienen el Congreso y el Presidente de la República a la luz del derecho interno peruano y del Derecho Internacional (en especial, de la Convención de Viena de 1969 sobre Derecho de los Tratados), teniendo en cuenta las discusiones que surgieron entre el Poder Legislativo y el Poder Ejecutivo con respecto a la ratificación del Tratado de Extradición entre la República de Perú y la República Francesa de 2016. Las normas internas aplicables a la celebración de tratados en el Perú establecen que el Presidente de la República es el único que está facultado para expresar el consentimiento del Estado en obligarse por un tratado al ratificarlo, lo cual tiene efectos jurídicos internacionales. La atribución del Congreso de aprobar los tratados cuyas materias están previstas en el artículo 56 de la Constitución Política del Perú de 1993 implica el control parlamentario a los actos del Presidente. No obstante, el Congreso no puede obligar al Presidente de la República a ratificar un tratado (como se discutió con relación al Tratado de Extradición entre la República de Perú y la República Francesa) ni es competente para emitir una ratificación.

L’objet de ce travail est d’éclairer l’esthétique et l’éthique de la poétique de Francis Ponge à partir de la notion de Nature. La première partie étudie la notion de Nature chez Ponge en tant que monde extérieur et son matérialisme qui, fortement influencé par le matérialisme antique, est caractérisé par l’antimétaphysique. Cette partie met également en relief le rapport étroit entre sa pensée matérialiste et la pensée immanente spinoziste, résumée dans l’expression de « Dieu ou la Nature ». Les aspects immanents des choses dans ses œuvres peuvent être mieux saisis, en effet, à l’aide de la notion d’« immanence » spinoziste. La deuxième partie explore, quant à elle, la relation entre la Nature et la littérature et le développement d’un nouveau lyrisme matérialiste chez Ponge. Pour lui, la littérature se naturalise et la Nature se littérarise. Son approbation de la Nature se traduit par sa contresignature apposée aux choses.Son nouveau lyrisme matérialiste, qui s’oppose au lyrisme traditionnel, se caractérise autour de notions telles que la vibration, l’aspiration, ou la « réson ». La troisième partie, enfin, examine le nouvel humanisme de Ponge ainsi que son éthique.La relation entre la Nature et l’homme s’articulera autour de thèmes éthiques essentiels comme l’altérité, le nouvel humanisme et le salut de l’homme. Son éthique consiste à vivre heureux. Nous l’aborderons à travers différents thèmes tels que la sagesse antique, l’harmonie du « non-soi » et du « soi », l’éthique de la joie, le hasard et la liberté. / The purpose of this study is to examine the aesthetics and the ethics of Francis Ponge’s poetry through the notion of Nature. The first part examines the concept of Nature in Ponge as the outside world and his materialism which, heavily influenced by ancient materialism, is characterized by the anti-metaphysical. This part also explore the close relationship between his idea and Spinoza’s immanent idea, summarized in the expression of "God, or Nature". The immanent aspects of things in his work can be fully understood with the help of the concept of "immanence" of Spinoza. The second part examines the relationship between Nature and literature and the development of Ponge’s new materialist lyricism. For him, literature becomes naturalized and nature becomes literarized. The approval of nature is reflected in his countersignature for things. His new materialist lyricism, contrasted with the traditional lyricism, is characterized by notions such as vibration, aspiration, "réson". The third part will focus on the new humanism and the ethics of Ponge. The relationship between Nature and man will be treated primarily on certain essential themes of ethics such as otherness, the new humanism and the salvation of man. His ethics is to live à happy life. Various topics, such as ancient wisdom, the harmony of the "non-self" and the "self", the ethics of joy, chance and freedom, will be discussed.

My thesis contains essays on voting theory, market structures and fiscal federalism: (i) One Person, Many Votes: Divided Majority and Information Aggregation, (ii) Runoff Elections and the Condorcet Loser, (iii) On the Influence of Rankings when Product Quality Depends on Buyer Characteristics, and (iv) Redistributing Income under Fiscal Vertical Imbalance.<p><p>(i) One Person, Many Votes: Divided Majority and Information Aggregation (joint with Micael Castanheira)<p>In elections, majority divisions pave the way to focal manipulations and coordination failures, which can lead to the victory of the wrong candidate. This paper shows how this flaw can be addressed if voter preferences over candidates are sensitive to information. We consider two potential sources of divisions: majority voters may have similar preferences but opposite information about the candidates, or opposite preferences. We show that when information is the source of majority divisions, Approval Voting features a unique equilibrium with full information and coordination equivalence. That is, it produces the same outcome as if both information and coordination problems could be resolved. Other electoral systems, such as Plurality and Two-Round elections, do not satisfy this equivalence. The second source of division is opposite preferences. Whenever the fraction of voters with such preferences is not too large, Approval Voting still satisfies full information and coordination equivalence.<p><p>(ii) Runoff Elections and the Condorcet Loser<p>A crucial component of Runoff electoral systems is the threshold fraction of votes above which a candidate wins outright in the first round. I analyze the influence of this threshold on the voting equilibria in three-candidate Runoff elections. I demonstrate the existence of an Ortega Effect which may unduly favor dominated candidates and thus lead to the election of the Condorcet Loser in equilibrium. The reason is that, contrarily to commonly held beliefs, lowering the threshold for first-round victory may actually induce voters to express their preferences excessively. I also extend Duverger's Law to Runoff elections with any threshold below, equal or above 50%. Therefore, Runoff elections are plagued with inferior equilibria that induce either too high or too low expression of preferences.<p><p>(iii) On the Influence of Rankings when Product Quality Depends on Buyer Characteristics<p>Information on product quality is crucial for buyers to make sound choices. For "experience products", this information is not available at the time of the purchase: it is only acquired through consumption. For much experience products, there exist institutions that provide buyers with information about quality. It is commonly believed that such institutions help consumers to make better choices and are thus welfare improving.<p>The quality of various experience products depends on the characteristics of buyers. For instance, conversely to the quality of cars, business school quality depends on buyers (i.e. students) characteristics. Indeed, one of the main inputs of a business school is enrolled students. The choice of buyers for such products has then some features of a coordination problem: ceteris paribus, a buyer prefers to buy a product consumed by buyers with "good" characteristics. This coordination dimension leads to inefficiencies when buyers coordinate on products of lower "intrinsic" quality. When the quality of products depends on buyer characteristics, information about product quality can reinforce such a coordination problem. Indeed, even though information of high quality need not mean high intrinsic quality, rational buyers pay attention to this information because they prefer high quality products, no matter the reason of the high quality. Information about product quality may then induce buyers to coordinate on products of low intrinsic quality.<p>In this paper, I show that, for experience products which quality depends on the characteristics of buyers, more information is not necessarily better. More precisely, I prove that more information about product quality may lead to a Pareto deterioration, i.e. all buyers may be worse off due.<p><p>(iv) Redistributing Income under Fiscal Vertical Imbalance (joint with Marjorie Gassner and Vincenzo Verardi)<p>From the literature on decentralization, it appears that the fiscal vertical imbalance (i.e. the dependence of subnational governments on national government revenues to support their expenditures) is somehow inherent to multi-level governments. Using a stylized model we show that this leads to a reduction of the extent of redistributive fiscal policies if the maximal size of government has been reached. To test for this empirically, we use some high quality data from the LIS dataset on individual incomes. This diploma thesis focuses on drug approval efficiency. It is obvious that the drug approval process is lengthy and expensive. The question that arises is whether the length of the drug approval process, as well as associated costs, leads to better safety. The first part briefly summarizes the history of the drug regulation and the drug legislative in the Czech Republic. Also focuses on the theory of economic regulation and the theory of bureaucracy. The second part deals with the drug approval process for new drugs, describes preclinical and clinical testing in relation to the analysis of Sam Peltzman. The third part compares drug approval process in different markets. The last part summarizes off-label prescribing, especially in pediatric.

Le phénomène de conventionnalisation du droit de la famille, plus précisément le rôle assigné à la volonté individuelle lors d'un divorce se développe de manière exponentielle. Les sources des obligations conventionnelles étant multiples, il convient de définir les éléments qui les composent. Le contrat ne constitue pas l’unique source des obligations conventionnelles. Cette catégorie doit comprendre l’ensemble des actes juridiques conventionnels. Ceux-ci se définissent comme des manifestations de volonté produisant des effets de droit.En droit du divorce, nombreux sont les accords de volontés que les époux peuvent conclure afin de régler les conséquences patrimoniales et extra-patrimoniales de leur rupture. Cette place croissante, accordée par la loi aux volontés individuelles dans l’aménagement des conséquences du divorce, invite à s’interroger sur la qualification des accords conclus par les époux. L’étude des obligations conventionnelles nées du divorce permet de démontrer que des contrats de droit commun s’épanouissent dans le droit du divorce et que parallèlement des conventions du divorce, caractérisées par l’intervention du juge, se développent en marge des principes issus du droit des contrats.En définitive, dans un contexte où est promue la liberté individuelle, les contrats de droit commun constituent un instrument privilégié pour des époux qui souhaitent organiser les conséquences patrimoniales de leur rupture. Cependant, l’ordre public familial inhérent au domaine extra-patrimonial persiste. À cet égard, il faut souligner que la théorie générale des obligations n’a pas vocation à mettre en péril l’état des personnes qui par nature doit demeurer indisponible. / The phenomenon of conventionalisation of family law and more precisely the role assigned to individual will in divorce has been increasing exponentially. As the sources of conventional obligations are multiple, it appears essential to define the variouselements that make up this specific group. Contracts are not the only source of conventional obligations. This last category should include all conventional legal acts which can be defined as expressions of will intending to produce legal effect.In divorce law, the voluntary agreements spouses are allowed to conclude in order tosettle the patrimonial and extra-patrimonial consequences of their separation are numerous. The growing importance given by law to individual will in order to settle the consequences of divorce calls for the examination of the genuine qualification ofspouses’ agreements. The analysis of the conventional obligations originating from divorce demonstrates that common law contracts flourish in divorce law while, at the same time, divorce agreements develop on the fringes of the guiding principles of contract law. Regarding these conventions, judges’ interventions add to individual willso as to reach perfect agreements. Eventually, in a context where individual freedom is promoted, common law contracts are a privileged tool for spouses who wish to organize themselves the patrimonial consequences of their separation. However, matrimonial public order legislation remains and cannot be dissociated from the extra-patrimonial field. In this regard, it should be noted that the general theory of the law of obligations does not intend to endanger the status of persons which must inherently remain inalienable.

L'objet de cette thèse est l'étude des aspects algorithmiques du vote par approbation. Il s'agit principalement d'une étude théorique des enjeux computationnels soulevés par le vote par approbation dans des contextes de décisions variés. Cependant, j'étudie aussi des questions plus proches de la théorie classique du choix social et je conduis de brèves études expérimentales.Dans un premier temps, l'étude se porte sur une famille générale de règles de vote pour les élections de comités et les référendums multiples à l'aide du vote par approbation. Dans un second temps, je porte mon attention sur un contexte plus général, le vote par approbation sur domaines combinatoires en se basant sur des préférences conditionnelles. Finalement, je me place dans le cadre du vote avec préférences incomplètes pour étudier les problèmes de vainqueurs possibles et nécessaires dans le vote par approbation. / The subject of this thesis is the study of computational aspects of approval voting. Most of the works are theoretical results about computational issues raised by approval voting, in many different settings. However, I also study some questions that are more related to classical choice theory, and some problems are investigated through experimental analysis.Firstly, I study a general family of rules for approval voting in the context of committee elections and multiple referenda. Secondly, I focus on a more general setting, approval voting in combinatorial domains, based on conditional preferences. Finally, I consider approval voting in the context of incomplete preferences, to study the possible and necessary winner problems.

The study focused on the challenges facing school governing bodies in the Vhembe district in the implementation of finance policies. Through the provision of the South African Schools Act, 84 of 1996, the school governing body is entrusted with the responsibilities of establishing and managing the school fund. The research was a multi-site case study of the Vhembe district. Purposive sampling of schools was conducted. Semi-structured interviews, observations and document analyses were carried out. The findings suggest that the finance personnel and committees at school level were not well established, trained and thus became dysfunctional. The researcher recommends that finance policies should be amended, finance committees trained and continuous monitoring of finances provided by the circuit and district officials. The study was also characterized by a number of limitations, including difficulties in understanding financial terminology by some participants and fear of handing in financial documents for examination. / Educational Leadership and Management / M. The goal of this master's thesis "Gender analysis of textbooks" (in relation to choice of profession) is to introduce a gender analysis of three textbooks "Civics Education" used in the 8th grade of primary schools. I focus on presence of gender stereotypes and gender prejudice that could influence a choice of further education of schoolboys and schoolgirls and therefore their choice of future profession. In the thesis I consider the general education system as one of the crucial socialization tool of the society. It represents an institution that keeps power to maintain gender stereotypes and at the same time has got the power to change them. I examine illustrations and texts of mentioned textbooks through gender optics, and using qualitative and quantitative analysis.
