我國檔案法立法過程之研究 / A Study on the Legislative Process of Archives Act in Taiwan

檔案法的產生,是我國檔案事業重要的里程碑,一個法律的出現,並非孤立存在,必須將其與社會、政治或歷史發展的脈絡一同對照,賦予時代的生命力,才能彰顯法律制定的意義,以及其中蘊含的強烈歷史意識。本研究內容主要為我國檔案法制定的過程,運用歷史研究法及訪談法,暸解我國檔案法制定的過程與階段、檔案法草案版本的內容、理念意涵與制定精神、檔案法制定與政治、社會或歷史背景的關連性,以及檔案管理檔案法制定後的修正情形。 檔案法的制定始於民國76年,至民國88年制定完成,期間經歷國史館、行政院及立法院階段,共費時12年時間,制定過程產生的草案版本,主要有國史館版、行政院版、林濁水版、曹爾忠版及李慶雄版,影響檔案法制定的因素包含:始於重視歷史紀錄的保存、奠定行政制度的基礎、反映我國民主時代的變遷經過;檔案管理局對於檔案法制定後的修正重點為解決業務瓶頸問題,紓解集中管理的沉重業務量,包含機關自行管理定型化書表、檔案目錄公布機制、機關檔案銷毀目錄分及審查機制等。 本研究提出八點建議,包含:蒐集檔案法制定過程所產生之文件、整合檔案相關資源、提升檔案主管機關的位階、積極推動國家檔案館設立,並研擬明確法源依據、建立分級管理機制、擴大檔案的定義與範圍、加強私文書的蒐集及人員經費制度化。 / The subject of this research is the process and phrase of Archives Act establishment in Taiwan. By applying historical research method and interview method, this research elaborates the version of Archives Act draft, the essence of legislation and its relationship between politics, society and history. Last, the text tells the situation in revising Archives Act after its legislation. The legislation of Archives Act was started from 1987 and finished in 1999 through the phrase of Academic Historica, Executive Yuan and Legislative Yuan, total 12 years. During the establishment, the draft is mainly from Academic Historica, Executive Yuan, Lin,Cho-Shui , Tsao,Erh-Chang and Lee,Ching-Hsiung. When formulating the Archives Act, it considers the preservation of historical record, foundation of administrative system and reflection of Taiwan democracy transition .In order to resolve operation bottleneck, release heavy loading of mass management, National Archives Administration revised the Archives Act in some ways like autonomic management of table by each institution, publishing mechanism of archives catalog and examining mechanism of institute archive destroying catalog, etc. This research raises 8 points as suggestion, collecting the document which was generated during establishment of Archives Act, raising level of archives administrative institute, setting up National Archive institute, drawing up definite authority of law, making mechanism of classified management, expanding the definition and range of archives, improving the collection of private edition and institutionalizing member and fund.

Advocating electronic records: archival and records management promotion of new approaches to long-term digital preservation

For over forty years, archivists and records managers have developed and advocated numerous theories and methodologies for the preservation of authentic and reliable organizational digital records. Many different tools, standards, and guidelines have been created to enhance and safeguard the content and context of digital records across multiple migrations. In addition, several archives have been able to create and sustain full-scale digital preservation programs. However, in spite of these successes, most archives and records management programs are not yet capable of preserving digital records indefinitely. Long-term archival digital preservation advocacy is defined as efforts undertaken by archivists and records managers to convince others, inside and outside their professions, to support the concepts, methodologies, and resources necessary to implement long-term digital preservation. Advocacy as a political- and policy-focused activity to convince a targeted audience to act is distinguished from archival “public programming” that is centered around outreach, publicity, exhibitions, and reference services. Advocacy for long-term digital preservation has not been widely successful, as evidenced by the relative small number of fully supported and fully functional archival digital preservation programs. As a result, the potential for a “dark age” characterized over the long term by a dearth of surviving, readable, and contextualized digital records is very real. This thesis explores why advocacy efforts have created only limited success, as well as what might be done to improve this situation. It rethinks long-term digital preservation as an issue of advocacy and will, as well as one of technology, strategy, or theory. Chapter One opens the thesis with a brief discussion of computers and digital records, placing advocacy efforts within a historical and technological context. Chapter Two presents an intellectual history of long-term digital records preservation advocacy literature and practice, demonstrating how advocacy “messages” have been formulated, disseminated, and “sold.” It also illustrates the multitude of informational resources and technological “solutions” that are now available to assist archivists and records managers in undertaking long-term digital preservation activities. Chapter Three tests the resonance of advocacy efforts through a series of surveys which I conducted with archivists and records managers from a variety of government, corporate, educational, and other institutions, as well as follow-up interviews with Manitoba-based records professionals. Survey questions were developed based on my examination of long-term digital preservation advocacy literature in Chapter Two, while interview questions were based on the responses of survey participants. Chapter Four concludes the thesis with a series of recommendations on improving long-term digital preservation advocacy. It argues for archivists and records managers to increase their personal commitment to long-term digital preservation, which includes having the will to embrace change and get started. Records professionals must also produce more practical internal guidance to assist archivists and records managers in undertaking preservation activities. In addition, the development and delivery of external advocacy “messages” must be improved, so that advocacy arguments better resonate with those responsible for funding organizational records management and archival preservation programs for digital records.

Enhancing visibility and accessibility of public archives repositories in South Africa

Despite the importance of the visibility and accessibility of public archives repositories, various scholars agreed that these repositories in eastern and southern Africa are not known to and are accessed by few people. This study utilised the concept of soft power as a framework to examine the visibility and accessibility of public archives repositories in South Africa with the view to suggest ways to enhance it. A quantitative approach, informed by post-positivist paradigm was employed, using questionnaires, interviews, content analysis and observation of landmarks to collect data. Public archives repositories in South Africa, Friends of Archives, legislation, annual reports, and landmarks were the universe of analysis whereas archivists working in public programming sections, deputy director of Friends of archives, 2012 to 2016 annual reports, archival legislation, social media links and the public display signage of the Limpopo, Mpumalanga, National Archives and Records Services of South Africa (NARSSA), National Film, Video and Sound Archives (NFVSA), served as a unit of analysis or source of information. The study revealed that collaboration with a good partner, especially civil society, was a key for successful public programming at the lowest cost. Whereas the KwaZulu-Natal, Mpumalanga and Western Cape landmarks are visible, the study found that NARSSA, NFVSA, Free State, Limpopo, Northern Cape, North-West and Eastern Cape archives repositories could not easily draw potential users to archives. Furthermore, only Northern Cape and Western Cape provincial archive are active on social media through their departments. The study recommended a visibility and accessibility framework that will provide a foundation and insight on how best public archives could develop and implement integrated and yet impactful public programming activities with less expenses. / Information Science / M. O contexto onde se inserem e a ordem que lhes é dada podem influenciar no entendimento e uso de seus atributos e foi essa tensão o que procuramos apreender no âmbito de sua classificação, atividade que permite ao documento passar posteriormente às fases que completam seu tratamento em uma unidade informacional. Partimos da premissa de que mesmo com as discussões e pesquisas acerca do documento fotográfico, ainda podemos verificar constantes dúvidas que impõe desafios aos profissionais e pesquisadores atuantes na área de Ciência da Informação. Estas dúvidas se refletem no modo em que o pesquisador de imagens irá recuperar uma fotografia e as informações contidas nesta. Desse modo, primeiramente realizamos um estudo conceitual do termo classificação e de como este pode ser compreendido na ciência e em arquivos, bibliotecas e museus delineando como os caminhos deste termo influenciaram e participaram do processo de consolidação de cada um destes campos. Para tanto, realizamos uma pesquisa primeiramente bibliográfica e posteriormente exploratória no Arquivo Público do Estado de São Paulo, SP, Biblioteca Mario de Andrade, SP e no Museu Paulista, SP, para verificar os processos de classificação nestas instituições. Baseados na observação feita em cada instituição e no levantamento de documentos e manuais utilizados por estas, construímos nossa discussão com base no preceito de que todas as normas vigentes em arquivos, bibliotecas e museus podem englobar objetos tão singulares como os documentos fotográficos. Chroniques libanaises. Étude des mécanismes de la mémoire (1914-2014) / Lebanese chronicles. A study of the mechanisms of memory (1914-2014)

La littérature moderne ne cesse de puiser dans l’Histoire, notamment du XXe siècle, avec toutes les mutations qui l’ont traversée. Certes, le retour du récit après la rupture causée par le Nouveau Roman, s’impose avec la publication de la somme philosophique de Ricoeur, Temps et récit (1983-1984), « qui montre les limites d’une analyse structurale et rappelle la fonction anthropologique majeure de l’activité narrative ». En effet, les écrivains contemporains en quête d’identité, reconnaissent la nécessité de revoir le contexte historique de chaque période de leur vie ou de la vie des autres. Il est intéressant, dans cette perspective, de remarquer les récits retraçant l’Histoire du Liban, à partir du début de la Première Guerre Mondiale, date où des voix libanaises s’élèvent pour demander que le Liban soit éventuellement placé sous la protection française. Le cas de la chronique libanaise est un cas particulier parce qu’on attend depuis 2001 la mise en œuvre d’un livre d’Histoire agréé au Liban. Cette étude insiste avant tout sur la convivialité, l’unité du pays, et la meilleure compréhension de l’autre et cherche à travers la littérature, à trouver un terrain d’entente. Les textes d’écrivains libanais, de Salah Stétié, d’Amin Maalouf, d’Alexandre Najjar, de Jacqueline Massabki, et d’écrivains français comme Sorj Chalandon et Richard Millet, permettent de cerner l’Histoire libanaise de différents angles de vue. Loin de prétendre redresser tel quel le passé du Liban, ces écrivains en font la base de leur narration. / Modern literature continues to get inspiration from History, especially from the history of the twentieth century, with all the changes that marked it. Certainly, the return of the narrative after the rupture caused by the New Roman (Nouveau Roman), is highlighted with the publication of the philosophical sum of Paul Ricoeur, Time and Narrative (1983-1984), "which draws the limits of a structural analysis and recalls the major anthropological function of narrative activity ". Indeed, contemporary writers in search of identity recognize the need to review the historical context of each period of their lives or the lives of others. Thus, autobiography, as well as biography of others, is inseparable from history. The case of the Lebanese chronicle is exceptional, especially in the shadow of the controversy over the implementation of a unified book of History in Lebanon. This has been the case since 2001 and each party privileges his own version of history. This study emphasizes first of all the value of conviviality, the unity of the country, and the better understanding of the other and seeks, through literature, to find common ground. And to understand and live lucidly, one must face, according to Nietzsche, the tragic, even fate, this "dose of coldness, lucidity, hardness". Lebanese French-speaking writers and readers share the will to understand the past that haunts their destiny and to grasp the evolution of time. It is therefore remarkable to see the Lebanese history rising through a bouquet of observations, testimonies, comments and questions.The texts of Lebanese writers Salah Stétié, Amin Maalouf, Alexandre Najjar, Jacqueline Massabki, and French writers like Sorj Chalandon and Richard Millet, help to identify the Lebanese history of different angles of view. Far from pretending to correct Lebanon's past as such, these writers make it the platform of their narrative.

Com isso em mente, define-se como objetivo geral para este estudo promover o diagnóstico sobre o desenvolvimento e implementação do Sistema de Arquivos da UFJF (SIARQ-UFJF) e a política de arquivos adotada pela mesma, de maneira a revelar as falhas dos procedimentos escolhidos que resultam na precarização da gestão e preservação de documentos da vida funcional dos servidores no âmbito da CAP, cenário primordial onde deu-se esta pesquisa. Assim, com o objetivo de identificar os elementos que constituem tais problemas, abordamse autores relacionados ao eixo teórico de arquivologia e política de arquivos universitária. Nesse sentido, destacam-se as contribuições de teóricos como Theodore Schellenberg, Heloísa Bellotto, Jean-Yves Rousseau e Carol Couture, dentre outros. O debate teórico se amplia com a análise de diretrizes e documentos veiculados pela UFJF que esclareçam em que medida estão ocorrendo as discussões sobre a implantação de uma gestão documental universitária. A metodologia de pesquisa adotada é de natureza quali-quantitativa, com uso do viés do caso de gestão, utilizando como instrumentos a aplicação de questionários em servidores da CAP e a realização de entrevistas com gestores da PROGEPE e de outros setores que possuem relevância no cenário das políticas estratégicas dedicadas à gestão documental. A presente pesquisa permitiu concluir, conforme se verificará no decorrer do texto, que ocorre uma configuração inconclusa da política de arquivos a nível institucional, em atendimento aos postulados teóricos e metodológicos recomendados, bem como falta de priorização do trabalho de gestão documental por parte de gestores e detentores do poder decisório, refletindo na ausência de esforços sérios e comprometidos no avanço da implementação da política de arquivos. Em virtude disso, apresenta-se ao final desta dissertação um Plano de Ação Educacional (PAE) composto de recomendações e ações visando fortalecer as práticas de gestão documental na CAP e imbuir seus servidores com conhecimentos e responsabilidades nesse respeito. / This dissertation was developed under the Professional Master in Management and Evaluation of Public Education (PPGP) of the Center for Public Policies and Education Evaluation of the Federal University of Juiz de Fora (CAEd/UFJF). The management case studied discusses the practical ways and implications of adopting a university archives policy dedicated to thinking about the management of documents produced and received by the UFJF, taking as an analysis subject the Coordination of Personnel Administration (CAP) and, in a certain way of degree, the Pro-Rector's Office of People Management (PROGEPE) to which it belongs. In this scenario, there are challenges posed by the context of the planned and executed expansion made possible by the Federal University Restructuring and Expansion Plans Support Program (REUNI). With this in mind, it is defined as general objective for this study to promote the diagnosis about the development and implementation of the Archives System of the UFJF (SIARQ-UFJF) and the archives policy adopted by it, in order to reveal the failures of the chosen procedures that result in the precariousness of the management and preservation of documents belonging to the professional life of the public servants within the scope of the CAP, the priomordial scenario where this research was given. Thus, in order to identify the elements that constitute such problems, this work approaches the authors related to the theoretical axis of archivology and university archives policy. In this sense, the contributions of theorists such as Theodore Schellenberg, Heloísa Bellotto, Jean-Yves Rousseau and Carol Couture, among others, stand out. The theoretical debate expands with the analysis of guidelines and documents conveyed by the UFJF that clarify the extent to which discussions are taking place regarding the implementation of a university documents management. The research methodology adopted is of a qualitative and quantitative nature, using the bias of the management case, using as instruments the application of surveys in CAP's servants and interviews with managers of PROGEPE and other sectors that have relevance in the scenario of the strategic policies dedicated to the documents management. This research led to the conclusion, as it will be verified throughout the text, that there is an unfinished configuration of the archives policy at institutional level, in compliance with the recommended theoretical and methodological postulates, also lack of prioritization on document management work by managers and holders of the decision-making power, reflecting in the absence of serious and committed efforts to advance the implementation of the archives policy. As a result of this, an Educational Action Plan (PAE) composed of recommendations and actions is presented at the end of this dissertation, aiming to strengthen the document management practices in the CAP and imbue its employees with knowledge and responsibilities in this regard.
