Previous issue date: 2010-05-13 / This work carries out a juridical analysis of the
administrative sanction declaration of ineligibility. This is a type of penalty
regulated in Law 8,666/93, which applies to private bidders and contractors
that intentionally or culpably cause harm to the public interest, or transgress
principles and rules that govern the juridical system of Administrative Law.
The study is based, clearly, on the text of the Law, with
emphasis on the content of the sanctioning act, through the use of the
deductive method, identifying within the functions of the State the
administrative function through to the exercise of sanctioning activity in
relations between parties to contracts, and bidding procedures.
We conclude that it is possible to apply this sanction, in
accordance with the legislation in force, without the need for the inclusion of
new rules.
The lack of academic works on this subject, and its
relevance today, prompted us to analyze the declaration of ineligibility / O trabalho tem por fim analisar juridicamente a sanção
administrativa - declaração de inidoneidade. Trata-se de uma espécie de
penalidade prevista na Lei 8.666/93, aplicável aos particulares licitantes e
contratados que, dolosa ou culposamente, causarem prejuízo ao interesse
público ou transgredirem princípios e regras informadores do regime jurídico
de Direito Administrativo.
O estudo parte, por óbvio, do texto da Lei, com ênfase
ao conteúdo do ato sancionador, para mediante utilização do método
dedutivo, identificar dentre as funções do Estado a função administrativa até
o exercício da atividade sancionadora nas relações contratuais e nos
procedimentos licitação.
Concluímos pela possibilidade de se aplicar tal
sanção, consoante a legislação vigente, sem necessidade de inclusão de
novas regras.

atualidade encorajou-nos a detalhar a declaração de inidoneidade

A percepção dos pregoeiros sobre o seu trabalho em um Instituto Federal de Educação, Ciência e TecnologiaVIANA, Valter Fernando 20 February 2018 (has links)
A função de pregoeiro surgiu com a edição da Lei 10.520/00, com o advento da modalidade de
pregão. Com a adesão cada vez maior a essa modalidade, buscou-se trazer maior eficiência e
transparência às compras governamentais, o que culminou em uma maior responsabilidade
atribuída ao pregoeiro, o principal agente de licitações no pregão. Com procedimentos rígidos
previstos na legislação, a atividade exige que o pregoeiro seja diligente em relação a todos os
atos que compõe o processo, bem como receba treinamento adequado e atualização constante
em relação à legislação. Diante das atividades de compras públicas e das responsabilidades do
pregoeiro, buscou-se investigar quais são as percepções do pregoeiro sobre o seu trabalho na
condução dos processos licitatórios de um Instituto Federal de Educação, Ciência e Tecnologia.
A metodologia aplicada na pesquisa consistiu de revisão bibliográfica, observação participante
e aplicação de um questionário eletrônico junto a uma amostra dos pregoeiros daquela
Instituição. A pesquisa constatou que a Instituição estudada possui 114 pregoeiros designados
e que realizou em 2016 mais de 700 de pregões eletrônicos. Outro dado levantado pela pesquisa
foi que os pregoeiros consideram não ter o suporte institucional necessário para o desempenho
da função (treinamento, suporte operacional e jurídico e incentivo financeiro), que eles
permanecem na função em média três anos, sugerindo assim, uma evasão da função pelos
servidores mais antigos. Como proposta de intervenção, foi elaborado um perfil ideal para o
servidor que desempenha a função de pregoeiro bem como a concentração da quantidade do
número de pregões. Essas medidas possibilitam uma racionalização do número de pregões,
gerando economia de escala, poder de negociação e competição dos fornecedores, e com um
menor número de pregoeiros designados é possível direcionar a função para os servidores com
maior afinidade com a área e aderência ao perfil desejado, e também liberar os outros servidores
anteriormente designados para o desempenho de outras funções administrativas. / The profession “Auctioneers” has rise for Law nº 10.520/00, afterward of range of business
auction in govern companies. The popularity of this profession becoming too much more
known, and efforts to accurate to efficiently and transparence in auctions on government
companies were necessary, to add much more responsibility and increase the role of
Auctioneers in supply chain on their auctions on companies. The mainly process is rigid and it has previewed on regiment of laws, which the labor of Auctioneerss must be resilient about
every process chains of his work to complete his job. The training and improvements must be done to guarantee quality and keeps the Auctioneers on rules of law enforcement and updated, regarding every changes in legal system and rules about his duties. Considering the activities of public purchase and duties of Auctioneers, research and investigation must were carry on, to check and make surveillance to perceive what should be done on Auctioneers roles, his job and conduct on Auctions process at Instituto Federal de Educação, Ciência e Tecnologia. The methodology was applied in bibliography research that aftermath to observe the members of work group and insert electronic questionnaire on group of Staff Auctioneerss from the Institute. The research concluded that Institution has 114 Auctioneerss on duty and They have done more than 700 electronic auctions on 2016.Otherwise, the surveillance data, shown that Auctioneerss considering haven´t enough support from their Institution, as well as to help them to do their obligation as a Auctioneers nor on their job, for e.g (Training and courses, Operational and Law support, and finally bonus for his high quality by professionalism to reach the goals of the Government company), and employees usually in duty on their mission (as Auctioneers) stands about three years at least, which suggesting that the profession is abandoned by ancient employees on Institution. Whereas all the fact presented, was offer a proposal to intervention to build a profile about the employees that act as Auctioneers and account the numbers of auctions that have been done on Organization. These surveillance enable to control the numbers of auctions done for employees as well as improving economy, afterward to set free others employees to accept many others missions in administrative branches of the company and organization.

Spatial Analysis Of Mega-event Hosting: Olympic Host And Olympic Bid CitiesErten, Sertac 01 January 2008 (has links) (PDF)
The aim of this dissertation is to provide a new perspective to the analysis of megaevent / host city relationship. The significance of the research subject depends on the
interest in hosting mega-events such as the Olympic Games and the World Fairs, which generate a competition among cities. Turkish cities are recently being involved in this competition. In addition to that, mega-events have large-scale and long-term impacts on the built environment, which has not been thoroughly discussed in urban studies. The methodology which is based on a qualitative analysis comprises three steps: a historical analysis made on the Olympic host cities, and two case studies. The first case is Athens as the 2004 Olympic city, the second case is Istanbul as an Olympic bid city since 1990. This study recognizes but qualifies the concept of megaevent hosting. It is shown that mega-event hosting is a capacity-building process, whilst it has a potential to generate overdose investments problem in the built environment. The most significant conclusion of the study is that the ability of coping with this problem is correlated with the ability of absorbing the investments made.

Syftet med studien har varit att undersöka om det är möjligt att tillämpa en beslutsmodell för att lösa ett problem avseende anbudsstrategi vid offentlig upphandling. När ett företag har en kund som omfattas av lagen om offentlig upphandling gäller särskilda regler vid upphandlingar. För ett företag är det viktigt att känna till dessa regler vid inlämning av anbud. Detta är dock oftast inte tillräckligt för att vinna en upphandling, eftersom det då också gäller att deras produkts jämförelsepris är lägre än konkurrenternas. En beslutsmodell, baserad på data från tidigare upphandlingar, har tagits fram för att kunna underbygga ett verktyg gällande anbudsstrategi. Beslutsmodellen är uppbyggd av diverse teorier som beslutsmatris, beslutsträd, lognormal fördelning och förväntat monetärt värde. Tillvägagångssättet har bestått av insamling av information och data via intervjuer, samt andra källor såsom litteratur, artiklar, uppsatser och upphandlingar, där metoden design science har använts. Utifrån en generell beslutsmatris och ett beslutsträd samt beräkningar har beslutsmodellen kunnat tas fram. Beslutsmodellen är i första hand avsedd för att underbygga ett verktyg för företag som är leverantör av eldrivna rullstolar men skulle även kunna appliceras i andra typer av upphandlingar. Beslutsmodellen kan ge stöd till ett verktyg som i sin tur skulle kunna användas av beslutsfattare. Beslutsfattarna får dock inte endast utgå från dess information, som är baserad på tidigare upphandlingar, utan bör också analysera konkurrenternas nutidssituation. When a company has costumers comprehended by the laws in public procurement, there are certain rules involved. For a company it is important to be aware about these rules, when setting their bids. Though this is often not enough for a winning procurement, because of the fact that the products comparison prices need to be lower than the competitors'. A decision model, based on data from earlier procurements, has been developed to reinforce a tool with bidding strategies. The decision model is composed by various theories, like decision matrix, decision tree, lognormal distribution and expected monetary value. The procedure through the study has contained data and information acquisition via interviews and other references like literature, articles, thesis and procurements. Based on a general decision matrix and a decision tree, as with calculations, the decision model has been generated. The decision model is mainly designed to reinforce a tool for companies supplying electric wheelchairs to costumers but could also be applicable in other types of procurements. The decision model could be a support when constructing a tool, which consequently could be used by decision makers. The decision makers can however not only adopt the ideas based on earlier procurements. They also need to analyse the competitors’ situations in present time. 由於網際網路的興起,網路使用人口便快速地攀升,同時帶動網際網路在商業應用的發展,以網際網路為基礎的電子商務也成為資訊社會中一種嶄新形態的商業行為。在此環境中網路競標逐漸形成一種網路消費的模式,而本研究則試圖以消費者的角度來探討網路競標此一交易的行為。
本研究從國內外的網路競標現況以及相關研究理論進行文獻的探討,經過整理後,決定以情境因素、消費者購買涉入、接受創新態度、與人口統計變數來探討消費者的網路競標意願是如何受到這些變數的影響。
本研究的主要結果發現:
1.在溝通情境下,以「產品提供的豐富性」、「產品搜尋的效率性」、和「產品資訊的豐富性」對消費者的網路競標意願最具有影響力。
2.在購買情境下,以「目標商品價格低於個人預算」與「目標商品結標期限將至」最能影響消費者的網路競標意願。
3.購買涉入程度愈高的消費者,其參與網路競標的意願也愈高。
4.創新接受態度愈高的消費者,其參與網路競標的意願也愈高。
5.曾經參加過網路競標以及每日上網時數較多的消費者,也有較高的網路競標意願。
最後根據研究結果,本研究對於競標網站的經營業者提出以下的6點建議與策略:
1.針對女性消費者的需求,提供所需商品或設計專屬網站。
2.多元的交易付款方式。
3.強化網站的使用功能與知名度。
4.熱門商品宜縮短其競標期限。
5.針對高購買涉入消費者的行銷策略。
6.吸引低創新接受態度消費者的行銷策略。 / The appearance of Internet has contributed to rapid growth of both surfer population and business applications. As a result, the Internet-based E-commerce has become a new business practices in the information society. Under the impact, the new consumption trend of online bidding is growing rapidly. This thesis takes a look into the new online transaction-online bidding in terms of the perspective of consumer behavior.
This thesis compiles documents such as current foreign and domestic online bidding status, relevant researches, and related theories, to construct the operating framework on it, which is to study the impact of situational factors, consumer purchasing involvement, innovativeness, and demographic variation on online bidding intention.
The following points are the major discoveries of this thesis:
1.Among all the factors of communication situation, "product variety," "efficiency in product searching," and "accessibility to product information" are the most influential factors on consumers' online bidding intention.
2.Among all the factors of purchase situation, consumers are most interested in online bidding when "prices of desired products are lower than personal budget" and "deadlines for bidding are approaching."
3.Consumers with higher purchasing involvement have higher online bidding intention than those who with lower purchasing involvement.
4.Consumers inclined to adopt innovations are more willingly to participate in online bidding.
5.Consumers who have experiences of online bidding and those who spend more time surfing on the Internet have higher intention on online bidding.
Based on the findings, this thesis proposes several reference suggestions and approaches for online bidding websites.
1.To provide products women need or establish websites designed exclusively for women.
2.To accept various ways of payment.
3.To strengthen functions and publicity of websites.
4.To shorten the bidding term of popular products.
5.The marketing strategy to attract consumers with high purchasing involvement.
6.The marketing strategy of appealing to consumers with low innovativeness.

Byggnadsinformationsmodellering (BIM) i praktiken : En studie av BIM i praktiken hos Peab Bygg Öst 1Pinto Dias dos Santos, Hewan Nayoli January 2018 (has links)
Detta examensarbete skrevs under höstterminen 2014 i samarbete med Peab region Bygg Öst 1 i Stockholm och syftar till att utreda hur dem arbetar med BIM i praktiken. Examensarbetaren fördjupar sig i ämnesområdet BIM och hur användningen av den 3D tekniken kan se ut i praktiken i arbetslivet. För att avgränsa arbetet skrevs det om byggnadsinformationsmodellering BIM, vid tre skeden i byggprocessen, anbud- och kalkylskede, projektering, produktion samt visualisering som sker vid olika tillfällen under hela byggprocessen. Arbetet innehåller även en redogörelse för investering av 3D skrivare hos Peab Bygg Öst 1, syftet med investeringen är bland annat för att utveckla ett arbetssätt med 3D teknik och visualiseringar framöver. Anledningen till att arbetet behandlar olika skeden är för att erhålla bred inblick och förståelse om ämnesområdet. Rapporten behandlar frågeställningar som syftar till att identifiera BIM som teknik och arbetssätt, hur Bygg Öst 1 arbetar med BIM i praktiken samt hur man vill arbeta med det framöver. Arbetet innehåller även redovisning av ett internt projekt som examensarbetaren utförde hos företaget. Interna projektet syftar till att utveckla anbud och kalkylskedet med BIM. Arbetet är baserat på studier i ämnet samt platsbesök på projekt inom Bygg Öst 1. Resultaten som erhölls från intervjustudierna visar hur man arbetar med BIM vid de olika pågående projekten för bland annat kollisionshantering, arbetsberedningar samt olika typer av visualiseringar med mera. Sammanfattningsvis syftar BIM till att effektivisera, såsom att reducera eventuellt uppkommande fel och säkerställa moment i byggprocessen. En jämförelse av litteratur- och intervjustudierna medförde förståelse för ämnesområdets användningsområden och omfattning. BIM är ett brett ämnesområde och det praktiska tillvägagångssättet med 3D tekniken kan tillämpas på olika sätt hos ett företag, vilket kan vara beroende av ambition och arbetssätt hos företaget. När man implementerar BIM i arbetssättet medför det inte direkta lösningar eller strategier att tillämpa i ett företag, utan implementeringen av BIM i arbetssättet kommer med utmaningar. På grund av ämnesområdets omfattning kan det vara viktigt att man har specifika mål och en tydlig bild om vad som vill uppnås med resultatet av implementeringen i arbetssättet. Det är även viktigt att veta hur mycket inverkan resultatet kommer ha på tids- eller ekonomiska besparingar. På så sätt är det möjligt att erhålla förståelse om hur implementeringen av tekniken kan ske och vilka vinningar som kan erhållas. / This thesis was written during the autumn term 2014 in cooperation with Peab region Bygg Öst 1 in Stockholm. The writing aims to investigate how they work with Building Information Modeling, BIM, in practice and increase understanding in how you can use the 3D technology in the professional working life. In order to define the thesis it has been written about three stages in the construction process: offer- and costing stage (construction bidding), projecting (preconstruction phase) and production (construction execution). Besides that the thesis also includes how BIM is used for visualization of the project and a report containing an investment of 3D printer has also been fulfilled. Additionally, the thesis also contains a description of an internal project that the writer has performed in the company. The internal project aims to develop the offer- and costing stage with BIM. The writing is based on studies on the subject and visits to some of Bygg Öst 1 ongoing projects. Results from the interview studies indicate that Peab Bygg Öst 1 in Stockholm is working with BIM for example collision handlings, preparation for big parts in the production, different types of visualizations and more. In short, the technology is used for ensuring the occasions in the construction process to improve the efficiency. The comparing of the literature and the interview study led to an understanding of the field of the subject and how wide it is. BIM is a broad topic and this 3D technology can be applied in work methods in different ways. The technique does not provide ready-made solutions or strategies to implement in a company, it has been learned that the implementation comes with some challenges. Because the technique is broad it may be beneficial that there are specific goals about what should be achieved in the result of the implementation of BIM in the construction process in order to ensure what achievements obtained with the help of the technology.

Previous issue date: 2015-01 / This paper analyzes in what proportion the criteria inserted in law 12.527111, known as the Law of Information Access, are attended by the Integrated System of Management Acquisition- SIGA in the state o f Rio de Janeiro. This research is based on item IV of article 8 of the aforementioned law, which determines the compulsory disclosure of the expense records, together with bidding procedures and the contracts, aimed specifically to providing transparency of public spending. The undertaking of public purchases on the internet is an implementation of electronic governance, a most advanced political dimension of the electronic government that provides a number of advantages such as speed in the bidding process. Moreover, dealings effected over a system are easily tracked by audits. Information registered in a single environment ensures the integrated fulfillment of rulesand decreases errors. Electronic bidding is currently, the most widely used modality by Public Administration since it meets demands for more transparency in public acts. The transparency required by society, the changes in legislation, and the technological evolution mal(e the analysis presented in tbis study recommended. In this context, stands out the relevance o f the electronic procurement website analysis of Rio de Janeiro State, the Integrated System of Management Acquisition - SIGA. In arder to create a parameter between SIGA and the systems used by other states, information available in tradings that happened during the year o f 2014 were analyzed. This broad research was made in arder to distinguish the Integrated System of Management Acquisition - SIGA, of Rio de Janeiro State, creating a scale of transparency. In this scale, our website was in fourth place, tied with the state of Amazonas, staying behind São Paulo, Rio Grande do Sul, and Mato Grosso. The qualitative methodology favored an evaluative reading of the use of SIGA, in pursuit of meeting a public policy of significant social impact by the sclccted modality due to rapid results and the participative opening to citizenship surveillance. The intervicws stressed this characteristic inherent to the qualitative posture of the study, with perceptions and timely information. The final considerations highlight advances and limitations in the existing govermnental system of electronic bidding. Nevertheless SIGA, although consolidated and in use since 2009 for ali state authorities of Rio de Janeiro, still needs improvements that will be embedded during 2015,when further research will follow up on new developments. / Esta Dissertação analisa em que medida os critérios contidos na Lei 12.527/11, conhecida como a Lei de Acesso à Informação, são atendidos pelo Sistema Integrado de Gestão de Aquisições – SIGA, do Estado do Rio de Janeiro. O pilar desta pesquisa é o inciso IV do art. 8º da referida Lei, que determina a divulgação dos registros de despesas, juntamente com os procedimentos licitatórios e os contratos celebrados, objetivando especialmente, transparência dos gastos públicos. A efetivação das compras públicas através da internet, é uma implementação da governança eletrônica, dimensão política mais avançada do governo eletrônico, proporcionando inúmeras vantagens como a celeridade nos processos licitatórios. Além disso, as transações efetuadas por meio de sistema são facilmente rastreáveis por auditorias. As informações registradas em um ambiente único garantem o cumprimento integrado de normas diminuindo erros. O pregão na forma eletrônica é, atualmente, a modalidade mais utilizada pela Administração Pública, pois vem ao encontro das demandas por transparência nos atos públicos E a análise apresentada neste trabalho É recomendada por destacara relevância da análise do site de compras eletrônicas do Estado do Rio de Janeiro, o Sistema Integrado de Gestão de Aquisições – SIGA. Para criar um parâmetro entre o SIGA e os sistemas utilizados por outros Estados, foram analisadas informações disponibilizadas nos pregões ocorridos durante o ano de 2014. Esta pesquisa mais ampla objetiva balizar o SIGA, do Estado do Rio de Janeiro, montando um ranking de transparência E o site ficou em quarto lugar, empatado com o Estado do Amazonas, atrás de São Paulo, Rio Grande do Sul e Mato Grosso.A metodologia qualitativa favoreceu a leitura valorativa do emprego do SIGA, em busca do atendimento a política pública de significativo impacto social da modalidade enfocada devido a resultados rápidos e abertura participativa de acompanhamento cidadão.As entrevistas reforçaram essa característica inerente à postura qualitativa do estudo, com percepções e informações oportunas.As considerações finais destacam avanços e limitações nos sistemas de compras eletrônicas governamentais existentes. O Siga, embora consolidado, em uso desde 2009, por todos os órgãos estaduais do Rio de Janeiro, necessita, ainda, aperfeiçoamento a implantar-se durante 2015, quando novas pesquisas devem acompanhar o movimento.

Previous issue date: 2014-12-11 / Brazilian government recently passed legislation instituting a new regulatory framework for the pre-salt reserves. These areas should be negotiated through a profit-share bidding auction. Motivated by this new rules, we present a model of share bidding auction under affiliation, demonstrating the existence of a monotone pure-strategy equilibrium in this structure and characterize its equilibrium bidding function. In addition, we prove that it generates an expected revenue at least as large as the usual fee bidding auction. Next, we introduce in the models a function representing a royalty rate that is contingent to the value of the object. This instrument permits an improvement of expected revenue of both models, making the gap between them shrink. Finally, analyzing this new regulatory framework from the viewpoint of the theoretical and numerical results obtained, we conclude that the former oil regime was more appropriate and lucrative to Brazilian government. / O governo brasileiro recentemente aprovou uma legislação instituindo um novo marco regulatório para as reservas petrolíferas do pré-sal. Segundo as novas regras, estas áreas deverão ser licitadas mediante um leilão de partilha de lucro. Motivado por esta mudança, apresentamos um modelo de leilão de partilha sob afiliação, demonstrando a existência de um equilíbrio monótono em estratégias puras e caracterizando a solução. Alem disso, provamos que este mecanismo gera receita esperada maior ou igual a um leilão de primeiro preço usual. Em seguida, introduzimos no modelo uma função representando taxas de royalties que dependem do valor do objeto. Este instrumento permite uma elevação na receita esperada de ambos os modelos, fazendo com que a diferença entre eles encolha. Finalmente, analisando o novo marco regulatório sob o ponto de vista dos resultados obtidos, concluímos que o antigo modelo de concessão utilizado pelo governo brasileiro é mais adequado e lucrativo.

Previous issue date: 2017-03-17 / O presente trabalho tem como objetivo a análise do estudo de caso do projeto de Parceria Público-Privada (‘PPP’), regida pela Lei nº 11.079/2004, referente à ‘Concessão Administrativa para a construção, operação de serviços ‘bata cinza’ e manutenção de Complexos Hospitalares de São Paulo’. Para tanto, foi analisado todo o processo administrativo para o desenvolvimento e concretização do projeto, incluindo a fase de Manifestação de Interesse Privada - MIP; as providências adotadas pelo Governo do Estado de São Paulo para a estruturação da PPP; o procedimento licitatório; e a assinatura do contrato, que representa o modelo final da PPP. Da análise deste processo administrativo, foi possível perceber certas particularidades atinentes a cada fase do processo de contratação pública, especialmente sobre alguns riscos apresentados pelos particulares, tal como o risco da governança entre os serviços ‘bata-branca’, de responsabilidade da equipe médica, e os serviços ‘bata-cinza’, de responsabilidade da concessionária. Assim, a presença do mencionado risco no modelo pesquisado é prova que fatores políticos e sociais estão presentes na modelagem de projetos, cabendo aos seus responsáveis compatibilizar os interesses por meio de estrutura contratual adequada. Pretende-se, portanto, analisar quais os mecanismos utilizados para superar o referido risco, de modo que o estudo sistematizado possa servir de dado para projetos com semelhante característica. Por fim, serão apresentadas informações e análise crítica sobre aspectos destacados ao longo do processo administrado objeto da pesquisa. / This work aims the case study about private-public partnership, ruled by Lei nº 11.079/2004, about public concession for construction, ‘gray coat’ and São Paulo hospital complex maintenance. Therefore all public procedure was analyzed for the development and execution, including the Private Expression of Interest, the São Paulo Government providences for the private-public partnership conclusion, the bidding procedure and final agreement for the contract. From the analysis it was possible to detect particularities for each stage of the public contract, especially about risks pointed by the private partner, like managing risks among ‘white coat’ services, medical team responsibilities, and ‘gray coat’ services, private partner responsibilities. This mentioned risk presence proves that political and social factors are elements of the project model, being up to the developers to make compatible the interests through the right contractual structure. At last, info and critical analysis about the highlights during the public procedure will be presented.

Previous issue date: 2011-08-11 / The delay in the conclusion of the public construction projects, that are frequently paralyzed, as well as the foreseen cost rise, may highlight the existence of recurrent technical, financial, political, administrative or judicial problems, which were originated even before hiring a firm. Therefore, this paper aims to analyze how the bidding and engineering work contracts refereeing legislation, within the Powers of Union, of States and Municipal district, contributes so that the solutions taken from designs do not get fully attended during the process of public construction ventures. Such a purpose, which initially required additional knowledge on public construction projects and design process, which was achieved with the execution of the literature review and the case studies, that in turn involved three public contracting companies and three contracted firms, as a way to get different perceptions of the same process. The evidence obtained from the contract bidding analysis, properly validated with answers from series of questions applied to contracting party and contracted, along with the literature review provided the conclusion of this work, as well as the creation of a proposal that aims to reduce the problems related to the accomplishment of the solutions taken from designs of public construction projects. / O atraso na conclusão de empreendimentos públicos de construção, freqüentemente paralisados, bem como a elevação dos custos inicialmente previstos, pode evidenciar a existência de problemas recorrentes de natureza técnica, financeira, política, administrativa ou jurídica originados mesmo antes das contratações. Nesse sentido, este trabalho tem por objetivo analisar como a legislação referente às licitações e contratos de obras e serviços de engenharia, no âmbito dos Poderes da União, dos Estados e dos Municípios, contribui para que soluções adotadas em projeto não sejam plenamente atendidas no processo de produção de empreendimentos públicos de construção (EPCs). Tal propósito, que inicialmente requereu conhecimentos adicionais sobre os empreendimentos públicos de construção e sobre o processo de projeto, foi alcançado com a realização da revisão bibliográfica e dos estudos de caso, que por sua vez envolveram, como forma de obter percepções diferentes de um mesmo processo, três entidades contratantes de EPCs e três empresas contratadas para tais obras e serviços. As evidências obtidas da análise de editais de licitações dos contratantes, devidamente validadas pelas respostas de questionários aplicados aos contratantes e contratados, juntamente com a revisão bibliográfica proporcionaram a conclusão deste trabalho e a elaboração de uma proposta que visa reduzir os problemas relacionados ao atendimento das soluções de projeto no processo de produção de EPCs.
