Este estudo aborda os planos diretores do Município de Diadema, na Região Metropolitana de São Paulo, aprovados após a Lei Orgânica Municipal de 1990, seguindo a nova ordem constitucional estabelecida pela Constituição Federal de 1988 e pela Constituição Estadual de 1989. O objeto da pesquisa é a análise do projeto de lei de 1991 para plano diretor (não aprovado) e dos planos diretores aprovados em 1994, 1998, 2002 e 2008, enfocando os instrumentos da política urbana neles contidos, bem como seus resultados alcançados durante os 15 anos de vigência do novo quadro legal e de gestão da política urbana na cidade. Este período inclui a importante promulgação do Estatuto da Cidade, lei federal 10257/2001, que norteou os ajustes introduzidos na versão de 2002. Ao final do processo investigativo são apresentadas entrevistas que registram a visão de representantes de entidades da comunidade e do poder público municipal sobre os referidos planos, seus instrumentos e os resultados obtidos. / This study addresses the master plans of the Municipality of Diadema, in the São Paulo Metropolitan Region, Brazil, developed in response to the rulings of the Municipal Organic Law of 1990, pursuant to the new constitutional guidelines in the Brazilian Constitution of 1988 and São Paulo State Constitution of 1989. By analyzing the bill that proposed a master plan in 1991 (rejected) and examining the master plans approved in 1994, 1998, 2002, and 2008, this study sought to describe the urban policy instruments included in these approaches along with results achieved during the 15 years under the new legislation and urban policy management in the municipality. This period also marked the promulgation of the City Charter under Federal Law 10257/2001, which guided the amendments to the 2002 plan. The study includes interviews with representatives of community organizations and municipal authorities who reveal the views they hold on these urban plans, their instruments, and results achieved.

A questão do aborto por de fetos malformadosno Brasil é problemática, face a ausência de legislação que permita a interrupção da gestação. Tais tipos de aborto são considerados ilegais, já que o Código Penal vigente prevê somente duas possibilidades de interrrupção: risco de vida para a mãe e em decorrência de estupro. A presente pesquisa objetivou analisar os casos de fetos malformados cujas mães foram atendidas no HCRP/USP e propor na Justiça ospedidos de interrupção destas gestações quando assim desejassem. Conclui-se que ainda há falta de informação por parte dos médicos em relação a possibilidade de indicação deste tipo de gestação, ainda que o quadro tenha melhorado e que quanto mais os magistrados conhecem e têm acesso ao que a medicina pode lhes oferecer, maior a probabilidade de deferimento destes Alvarás. / The issue of abortion by the malformed fetuses in Brazil is problematic, given the absence of legislation allowing the interruption of pregnancy. These types of abortion are illegal, since the current Penal Code provides only two possibilities for interrupcion: a life-threatening for mother and as a result of rape. This study aimed to examine the cases ofmalformed fetuses whose mothers were assisted in HCRP / USP and propose the Justice requests for interruption of pregnancies when so wished.) It follows that there is still lack of information fromdoctors regarding possible indication of this type of pregnancy, though the picture has improved and that the more judges know and have access to what medicine can offer them, the more probability of acceptance of these documents.

Freedom of transit and pipeline gas : can the World Trade Organization provide a viable legal framework for the development of an international gas market?Pogoretskyy, Vitaliy January 2015 (has links)
This study discusses how the World Trade Organization could promote the development of an international gas market by playing a more prominent role in regulating rights essential to effective pipeline gas transit. Gas transit is network-dependent in the sense that it cannot be established without the existence of pipeline infrastructure in the territory of a transit State and the ability to access this infrastructure. Nevertheless, at an inter-regional level, there are no sufficient pipeline networks that would allow gas to travel freely from a supplier to the most lucrative markets. The existing networks are often operated by either private or State-controlled vertically-integrated monopolies that are usually reluctant to release unused pipeline capacity to their potential competitors. These obstacles diminish the gains from trade for States endowed with scarce and relatively immobile natural resources, such as gas, including developing land-locked countries that rely on revenues from gas exports. These obstacles can also undermine Members’ energy security and their sustainable development achieved by shifting domestic production from dirty fuels to cleaner energy sources – namely gas. From a technical perspective, gas transit can be established by invoking what is referred to in this study as ‘third-party access’ and/or ‘capacity establishment’ rights. The first main question that this thesis analyses is, therefore, whether, and, if so, how these rights are regulated by WTO rules relevant to transit, including: GATT Article V:2 (first and second sentences) establishing the principles of freedom of transit and non-discrimination, the ‘non-violation complaint’ provision under GATT Article XXIII:1(b), and the GATS. This question has not been answered by WTO panels or examined sufficiently by scholars. The key contribution of this study to the existing academic literature on energy transit lies in the fact that this study analyses the above rules through the prism of systemic integration of WTO law sources with other relevant rules of public international law, including principles of general international law and treaties regulating transit. By contrast, previous researchers discussed the regulation of third-party access and capacity establishment rights from a limited perspective of WTO law. The second main question examined in this study is how WTO transit rules could be improved through a legislative reform to regulate particular aspects of trade in pipeline gas better – namely third-party access and capacity establishment rights. This question is answered by exploring two options: the codification of the existing principles of general international law relevant to these rights in the WTO legal system and the progressive development of WTO transit rules through the expansion of additional commitments of Members on energy services under the GATS. While this study analyses the relationship between WTO transit obligations and inherent ancillary rights (namely third-party access and capacity establishment rights) implied in these obligations in the context of trade in pipeline gas, the conclusions reached here may have practical application in other areas of network-bound trade, such as trade in electric power.

The Implementation of the Individuals with Disabilities Education Act in a Virtual Public Charter SchoolClifford, Sarah E 18 May 2018 (has links)
The Individuals with Disabilities Education Act (IDEA) guarantees certain rights and protections to students with disabilities enrolled in public schools, and to their families. Even though virtual schools are one of the fastest growing trends in public k-12 education, there is evidence that these schools may not be fully implementing IDEA for enrolled students with disabilities. There has been some concern regarding the appropriateness of virtual education for student with disabilities, as well as some concern for the spectrum of services being offered in virtual schools. This case study examined the implementation of special education supports and services in one public virtual k-12 school in the United States. Interviews, document review, and participant observations were used to collect data. Findings indicated that components of IDEA were not being universally implemented for students with disabilities. Limited programming options, large special education caseloads, and an over-dependence on parents and other non-teacher adults limits students’ access to Free and Appropriate Public Education, Least Restrictive Environment, and Individualized Education Plans. Issues were also identified in the provision of Appropriate Evaluation, Parent Participation, and Procedural Safeguards. Regardless of documented challenges, benefits to virtual education were noted. Parent, faculty and staff participants reported being happier with virtual school than brick-and-mortar. Faculty enjoys easy access to a multitude of academic data. Relationships and communication among community members was reported to be stronger than what was previously experienced in brick-and-mortar schools. Faculty, staff and parent participants discussed students’ emotional and physical safety as a benefit of virtual education.

A cours des dernières décennies, le Conseil de sécurité, agissant en vertu du chapitre VII de la Charte des Nations Unies, a autorisé l'adoption de diverses mesures de nature ou de portée économique, dans la sphère des États ou territoires non-étatiques, à l'issue de conflits armés. Il a ainsi promu la stabilisation économique, via des réformes économiques d'envergure, dans des zones post-conflictuelles telles que le Bosnie-Herzégovine, le Kosovo, le Timor oriental ou l'Irak. Il a intégré des principes de bonne gouvernance économique dans des régimes de gouvernance transitoires au Liberia ou aux deux Soudan. Il a développé une gamme de stratégies de consolidation de la paix de plus en plus sophistiquée pour stabiliser l'exploitation des ressources naturelles comme le bois, le pétrole ou les diamants, dans les États comme la Sierra Leone, la République démocratique du Congo ou la Côte d'Ivoire. Toutes ces interventions, plus ou moins intrusives, dans la sphère économique interne des États soulèvent des questions d'ordre juridique importantes. Dans cette étude nous nous sommes intéressés à deux questions essentiellement, à savoir, l'ordre juridique international, tel que nous le connaissons aujourd'hui, dispose-t-il de tous les matériaux nécessaires et indispensables pour encadrer et réglementer toute activité de reconstruction économique entreprise par le Conseil de sécurité ou ses agents d'exécution sur la base du chapitre VII d la Carte des Nations Unions ? Et si oui, comment et dans quelle mesure un tel cursus est-il appréhendé en pratique par les différents acteurs ? Les réponses apportées à cette problématique nous ont conduit, dans un premier temps, à déterminer l'existence , sinon la portée du corpus juridique pertinent, et ensuite, à analyser son impact sur la nature et la portée des pouvoirs susceptibles d'être exercé dans ce contexte. Educator's Technology Integration Barriers and Student Technology Preparedness as 21st Century ProfessionalsPine-Thomas, Joy Anne 01 January 2017 (has links)
Millions of dollars have been spent to acquire educational computing tools, and many education, government, and business leaders believe that investing in these computing tools will improve teaching and learning. The purpose of this quantitative study was to determine whether charter school educators face technological barriers hindering them from incorporating technology into their classrooms. If they experienced self-efficacy issues integrating technology in their classrooms and if they believed their students were technologically prepared as 21st century professionals. A 5-point Likert scale survey, validated by a pilot study, was completed by 61 charter high school teachers. Their responses were analyzed, scores from the individual mean responses were used to calculate the total mean; and a parametric t test used to determine if the null or alternative hypothesis could be rejected. The theoretical foundation for this study was Cubans' and Brickners' first- and second-order barriers to change. In one charter school stratum, teachers experienced barriers integrating technology into their classes, while teachers in the other charter school strata did not. There was statistical significance in teachers' beliefs about their skills integrating technology into their classes and their students being technologically prepared as 21st century professionals. The results of this research could lead to positive social change by providing valuable information to help charter school administrators identify teachers who are experiencing barriers and how they can improve teacher's professional development integrating technology into their classrooms.

Journalism, Ethics and Accountability: Evaluating the Virtues of Self-RegulationBreit, Rhonda, n/a January 2004 (has links)
This dissertation questions whether the current system of journalistic self-regulation in Australia can give effect to ethical journalism given the conceptual paradigms that have informed its understanding of journalism and journalism ethics. It argues the ideological focus of journalistic self-regulation has constrained the current system's ability to encourage ethical journalism. By taking a grounded theory approach to developing an alternative theory of journalism, this study attempts to fill a void in the reform of journalistic self-regulation in Australia by first highlighting the shortfall in recent reviews. It then argues reform must address the ideological focus of the journalism industry. This means looking at the ideologies espoused in the industry codes. It also means looking at the ideologies that frame how values reflected in the codes are interpreted. In summary, my aim in this dissertation is to articulate a praxis-driven theory of journalism by which to examine the suitability of the Australian self-regulatory environment to give effect to ethical journalism. This will be done by: mapping the current system of journalistic self-regulation; distilling the ideological foci of contemporary interpretations of journalism and journalism ethics; postulating an alternative theory of journalism as practice; evaluating the current system of self-regulation in light of the theory of journalism as practice; and recommending an alternative model of self-regulation that takes account of the theory of journalism as practice. The grounded theory approach to this study involves a textual analysis of a representative sample of self-regulatory codes to identify deficiencies in the way philosophical understandings of identity and ethics have been applied to journalism. By highlighting the gaps in the conceptual paradigm that frames the current theories of journalism and journalism ethics, I offer insights into key problems facing industry self-regulation. Given its grounding in substantive data analysis, the theory developed in this study is able to offer significant insights into ways of improving journalistic self-regulation to encourage ethical journalism. By categorising the self-regulatory codes according to ideology, I aim to explain how core journalistic values can be marginalized. Thus, this study aims to reveal problems with the way in which journalism self-regulation has been conceptualised and operationalised. In this way, it uses the tools of meta-ethics and normative ethics to analyse an ethical problem. Thus the grounded theory emerging from this study falls into the conceptual category of applied ethics. This approach offers a flexible methodology that allows the development of an emergent theory based on raw data derived from the various codes that operate within the journalistic self-regulatory environment. The research problem starts broadly, looking at the ability of the current system of journalistic self-regulation to encourage ethical journalism. The focus of the study is on organizational ideology and conceptions of journalism, rather than individual values of journalists. Through a process of constant comparison I will focus the research problem, constructing a theoretical framework to evaluate whether the current system of journalistic self-regulation can encourage ethical journalism. To achieve these objectives, the study will canvass both process (the ability of self-regulation to give effect to ethical journalism) and action (building a theoretical framework for conceptualising reform). A grounded theory approach offers a way of categorising conceptions of journalism and self-regulation allowing me to develop an alternative theory of journalism that promotes a holistic approach to journalism ethics. This study does not purport to offer final solutions to the ethical problems within Australian journalism. It does, however, aim to present an alternative pathway towards reform of journalistic self-regulation in Australia that focuses on encouraging ethical journalism and expanding the theoretical paradigms that shape current approaches to ethics.

The main question in this research project is whether regional integration promotes the rule of law in ASEAN. The thesis has adopted a functional, rather than conceptual, approach to understanding the rule of law and its development in regional integration. While the approach reflects an instrumentalist function of the rule of law, the study provides a holistic and interdisciplinary approach taking account of the legal, insitutional, and political processes in the state, the region, and international relations to show the motivations and interests of member states in adopting a peculiar type of regional arrangement. The research project has taken the European Union for comparison, not as a model in the strict sense, to identify the development of legal and institutional processes that build the foundation of the rule of law and the factors that drive the evolution of state-like constitutionalism. Common legal tradition of the rule of law, leadership role of key member states, and regional institution building ??? are the main processes in the development of the rule of law in the EU and are either lacking, different, or weak in the context of ASEAN. However, an evolving form of the rule of law exists in ASEAN. The rule of law in ASEAN integration is designed to provide a stable and coherent framework for interstate relations among member states and to achieve effective implementation of the member states??? economic commitments. ASEAN has adopted an instrumentalist conception of the rule of law and one based on ???thin??? constitutionalism, as reflected in the ASEAN Charter. The features of the rule of law in ASEAN are ??? state-controlled, limited, evolutionary and resting on soft legal regime. ASEAN has chosen a different path at regional integration and globalization has offered new techniques of the rule of law. Regionalism in ASEAN remains statist in character and the ASEAN Way is still entrenched. There are significant developments towards adopting a broader basis of regional cooperation and opportunities for developing the rule of law in ASEAN. To broaden the function of the rule of law in regional integration, as a mechanism of accountability and as a form or restraint, ASEAN needs to adopt initiatives aimed at expanding political participation and respect for human rights. The European Union offer points of learning for ASEAN in achieving a broader function for the rule of law in ASEAN integration.

Aim: By studying the evolution of the market for package holidays over time we hope to get an understanding of the trends that have characterized the market. By doing so, we can get an idea of where the market is moving towards the future. This knowledge is essential for market participants to establish appropriate strategies that follow market trends. Method: We have used qualitative interviews with people involved in the charter industry. Result & Conclusions: The market is characterized by an increase in Internet orientation, where the travel directory and the physical travel agents are becoming less important. The understanding of climate impacts of travel has increased. More people of the third-generation buy package travels and countries in North Africa and Asia are growing in popularity. We believe the market in the coming years will be characterized by lower prices and lower quality. Travel directories will be replaced by promotional flyers. Marketing will be aimed at the third generation. It will be difficult for physical retailers to retain customers. Interest in countries such as Vietnam, Malaysia and Egypt will increase. Suggestions for future research: “A study of the physical dealer prospects” and “Studies on the consumers’ willingness to pay for environmentally friendly charter” would be interesting. Contribution of the thesis: An increased understanding of the trends in the charter industry. Denna kunskap är nödvändig för att charterbolagen ska kunna upprätta relevanta strategier som följer marknadens utveckling. Metod: Vi har använt oss av kvalitativa intervjuer med personer verksamma inom charterbranschen. Resultat och slutsats: Marknaden karaktäriseras av en ökad internetorientering, där resekatalogen och de fysiska resebyråerna blir allt mindre betydelsefulla. Även kunskapen om resandets klimateffekter har ökat. Allt fler personer av den äldre generationen köper charterresor och länder i Nordafrika och Asien växer i popularitet. Vi bedömer att marknaden de kommande åren kommer att kännetecknas av lägre priser och sämre kvalitet. Resekatalogen ersätts av reklamblad. Marknadsföring kommer att riktas till den äldre generationen. Det blir svårt för fysiska återförsäljare att behålla kunder. Intresset för länder som Vietnam, Malaysia och Egypten kommer att öka.
