Charles University, Faculty of Law, Department of European Law Prague, March 2013 The aim of the dissertation is to analyse the role of the European Commission in the legislative process of the European Union with the focus on procedures for adoption of legally binding Union acts. The European Commission is one of the main institutions of the European Union. It represents and upholds the interests of the EU as a whole and manages the day-to-day business of implementing EU policies. However, to limit the role of the European Commission to that of an executive body would be misleading. Its role in the EU institutional system is much broader than that. The European Commission is the most important legislator among the EU institutions and is also empowered with an almost exclusive power to submit drafts of EU legal acts. The rule-making power of the European Commission could be seen from two different points of view. In a narrow sense of the word it could be seen as a power conferred on the European Commission by the Treaties to propose drafts and to adopt EU legal acts implementing legally binding Union acts. D’une manière générale, la fonction administrative contentieuse peut être appréhendée comme l’ensemble des juridictions chargées de connaître des litiges résultant de l’activité des autorités administratives. Elle represente l’activité juridictionnelle en matière administrative. Par conséquent, la fonction administrative contentieuse doit s’appréhender tant sous l’angle d’une juridiction, que sous celle de son juge. L’institution d’une fonction administrative contentieuse en Côte d’Ivoire remonte à l’époque coloniale. Cependant, à l’instar de la plupart des ex-colonies françaises, ce n’est qu’au lendemain de l’indépendance en 1960, que la fonction administrative contentieuse ivoirienne s’est affirmée en tant que fonction juridictionnelle autonome à l’égard du système français. La procédure administrative non contentieuse, comme la procédure administrative contentieuse dont il est question dans l’étude ont connu de grands progrès tant en France que dans les pays francophones d’Afrique pour lesquels le système de juridiction administrative comme le droit qu’il vise à contrôler ont longtemps constitué, selon la belle formule de Jean RIVERO, un bon « produit d’exportation » français. La Côte d’ivoire n’échappe pas à ce constat. Aussi l’étude de la fonction administrative contentieuse en Côte d’Ivoire a pour objet de dessiner la physionomie générale de la justice administrative ivoirienne un demi siècle après son institution afin d’en souligner les éléments de permanence ou de changement. / Generally speaking, the contentious administrative function can be arrested as all the jurisdictions asked to know disputes resulting from the activity of the authorities. Česko-německý fond budoucnosti jako instrument veřejné diplomacie / Czech-German future fund as an instrument of the public diplomacy

This diploma thesis examines changes, which the Czech-German Future Fund went through during its almost 20 years of functioning. The first part the author dedicated to theoretical concepts, which shed light on study of the Czech-German Future Fund. These theoretical concepts are reconciliation and public diplomacy. Thereafter are in tis thesis described efforts to compensate victims of National Socialism in Czechoslovakia and in the Czech Republic. This part of thesis is followed by description of the Czech-German Future Fund and its history. Based on this German-Czech Declaration of Mutual Relations and their Future Development of 1997 was the fund's mission to compensate victims of National Socialism, who didn't receive a compensation until then. The fund fulfilled this mission after 10 years of its function and also went through by many changes during almost 10 years of its functioning. The author describes these changes on which is based description of the project policy development of Czech-German Future Fund. After that the diploma thesis concentrates on changes in individual fund project groups, which are supported by the fund. Predicting locations for urban tree planting

Indiana University-Purdue University Indianapolis (IUPUI) / The purpose of this study was to locate the most suitable blocks to plant trees within Indianapolis, Indiana’s Near Eastside Community (NESCO). LiDAR data were utilized, with 1.0 meter average post spacing, captured by the Indiana Statewide Imagery and LiDAR Program from March 13, 2011 to April 30, 2012, to conduct a covertype classification and identify blocks that have low canopies, high impervious surfaces and high surface temperatures. Tree plantings in these blocks can help mitigate the effects of the urban heat island effect. Using 2010 U.S. Census demographic data and the principal component analysis, block groups with high social vulnerability were determined, and tree plantings in these locations could help reduce mortality from extreme heat events. This study also determined high and low priority plantable space in order to emphasize plantable spaces with the potential to shade buildings; this can reduce cooling costs and the urban heat island, and it can maximize the potential of each planted tree.

Administrator Perceptions of the Community College Mission in the State of Mississippi and How it may be Influenced by the Addition of Community College Baccalaureate Programs

For many years, community colleges that chose to offer community college baccalaureate (CCB) programs were looked upon in a negative light (Rice, 2015). However, as the need for specialized baccalaureates within specific fields and job markets have continued to grow (McKee, 2005), CCB programs are becoming more widely accepted throughout the United States. In spite of this paradigm shift, Mississippi is one of the remaining states that have not embraced the idea of CCB programs, in spite of its statistical deficiency in regards to baccalaureate degree holding citizens (Williams, 2010). The focus of this study was to explore the perceptions of community college administrators in Mississippi with regards to the influence of CCB programs to the community college mission of institutions in their state. This study indicates that administrators in Mississippi recognize the benefits of offering CCB programs, but do not want CCB programs to take away from the well-established statewide higher education system through mission creep. Many of the strong position statements received overwhelmingly neutral responses. In contrast, Administrators who chose to give their opinion indicated that they are not familiar with how CCB programs are implemented, and do not believe that Mississippi is ready for CCB programs across the state. However, respondents felt that the community college mission is always evolving, should meet students’ needs, and varies from location to location. The findings also show that administrators are favorable to the piloting of CCB programs at a few (1-2) institutions, even though they believe the programs will take funding away from current programs and do not want community colleges evolving into 4-year institutions. The study also concludes that there is a significant difference between institution size and survey questions #18 and #20. There is also a significant difference between length of time in the community college sector and survey questions #15, #17, and #18.

From the "rising tide" to solidarity: disrupting dominant crisis discourses in dementia social policy in neoliberal times

As a social worker practising in long-term residential care for people living with dementia, I am alarmed by discourses in the media and health policy that construct persons living with dementia and their health care needs as a threatening “rising tide” or crisis. I am particularly concerned about the material effects such dominant discourses, and the values they uphold, might have on the collective provision of care and support for our elderly citizens in the present neoliberal economic and political context of health care. To better understand how dominant discourses about dementia work at this time when Canada’s population is aging and the number of persons living with dementia is anticipated to increase, I have rooted my thesis in poststructural methodology. My research method is a discourse analysis, which draws on Foucault’s archaeological and genealogical concepts, to examine two contemporary health policy documents related to dementia care – one national and one provincial. I also incorporate some poetic representation – or found poetry – to write up my findings.
