Kenya and Zimbabwe: issues of democracy, electoral violence and civil participation

ABSTRACT Democracy can be a useful tool in Africa. It can open channels for foreign aid and ultimately development. Many African countries have struggled with the changes and expectations that democracy brings. They have opted for authoritarian regimes or one party state regime. Zimbabwe and Kenya represent some of these countries. Such countries have been unable to promote or perfectly place liberal democracy within their societies. The most salient issue in the democratization process of Africa has been the post colonial state. Transitions into democracy have not always gone well at all in fact many transitions remain stagnant. This research investigates the problems surrounding the attainment of democracy in Africa, using the cases of Kenya and Zimbabwe. It seeks to understand the obstacles and challenges to the democratization processes in the two countries by focusing on the 2007/2008 contested elections as well as previous elections, and the attempts by external actors to deal with the results of the elections. The citizens of Kenya and Zimbabwe have both been affected and impacted by the lack of democracy that has existed in each country. This research also investigates the role of citizen participation in the electoral process. For both countries to succeed in all regards there is a pressing need for regime change and institution building.

Zur Begründung führte sie aus: „Die Europäische Kommission sieht die Freiwilligentätigkeit als gelebte Bürgerbeteiligung, die gemeinsame europäische Werte wie Solidarität und sozialen Zusammenhalt stärkt… Freiwilliges Engagement spielt in so unterschiedlichen Bereichen wie Bildung, Jugend, Kultur, Sport, Umwelt, Gesundheit, Sozialwesen, Verbraucherschutz, humanitäre Hilfe, Entwicklungspolitik, Forschung, Chancengleichheit und Außenbeziehungen eine maßgebliche Rolle“. Das Centre Européen du Volontariat geht in seinem Jahresbericht von 2010 von mehr als 100 Millionen ehrenamtlich Tätigen in ganz Europa aus. Diese Umstände bieten einen willkommenen Anlass, Umfang, Inhalt, Geschichte und auch problematische Aspekte freiwilliger Arbeit im Bereich der Kultur am Beispiel der Landeshauptstadt Dresden zu reflektieren.

從法制規範論中國聽證會制度 / A study on China’s hearing system based on the norm of legal system

中國大陸從民主國家引進「聽證會」制度,是一種「有組織、有結構」的表達機制。要瞭解中國「聽證會」制度的全貌與意涵,首先掌握民主國家聽證理論,並在「民主政治」、「自然正義」、「正當法律程序」及「公開與公民參與」等立論原則,來加以探索民主國家對聽證之成因與面貌。另在文獻蒐集與探討中,從1993年至今,完整編織中國「聽證會」的發展背景動機和歷史演變,透過聽證理論與「聽證會」發展之比對分析,藉以說明中國與民主國家在「聽證」觀點上之差異。 在現行中國聽證會制度之法制規範上,從「聽證會」在中國大陸司法、行政立法過程之相關會議資料,和中央、地方近年來之施行情形,探求其制度正處於何種地位,瞭解中國「聽證會」之地位後,陸續歸納中國憲法內相關對聽證的立憲基礎,還有全國人大、全國人大常委會、國務院及地方等行政立法機關,在司法、行政立法聽證的法律規章之聽證法源依據,進而分析聽證在大陸的適法範圍及功能。另由司法賠償、行政立法及行政處罰之聽證個案實例,進一步深層瞭解「聽證會」實際操作面向。 文內採用文獻探討法,就已蒐集中國大陸司法、行政立法聽證之意涵、種類、政策基礎、規範原則、運作程序等百篇文獻,對與主題有關的縱向因素之因果關係加以整理、掌握,並藉以分析聽證之本質內涵,在透由探討與發現問題,將有系統對中國聽證會在司法聽證、行政立法聽證及民主政治等方面的問題影響加以整理說明。最後提出結論與建議,以提供問題解決方向。 / Communist China adopts the hearing system, a well organized and structured expression mechanism, from the western democracies in 1993. With this background, understanding the hearing theories of the western democracies becomes the prerequisite to study the full context and implications of China’s hearing system. Those who are interested in the creation of the western hearing system must realize that the system is based on theories such as democracy, natural justice, due process of law, and public civil participation. With thorough researches of documents and analyses, the motivation and history of China’s hearing system shall be studied and the differences between China and the western democracies shall be analyzed by comparing the theories and evolution of the two hearing systems. In order to identify with the role of China’s current hearing system, related materials collected from several important meetings carried out by China’s judicial and administrative-legislative authorities, as well as implementation of hearing at the central and local levels are investigated. When this investigation is concluded, how hearing system functions within the scope of China’s constitution will be induced. Furthermore, how hearings are functioned and supported by China’s existing laws when they are performed at National People Congress (NPC), NPC’s Standing Committee, State Council and local authorities will also be examined. Case studies of hearings regarding to judicial compensation, administrative-legislative and administrative penalties are provided to further help understand the real performance of the hearing activities in China. The literature review methodology is taken on in this thesis . Over one hundred periodicals, papers, and documents on the subject of hearing are collected and studied. These materials include the definition, types, principles, norms and procedures of China’s judicial and administrative-legislative hearings. By studying the literature and identifying the cause and effect, a systematic explanation of the correlation between China’s judicial and administrative-legislative hearing structure and democracy is concluded and possible solutions are recommended.

This thesis deals with the topic of civic participation in society and how participation this society develops and influences. The theoretical part is concerned with explaining the concepts, history and general knowledge that are related to participation. The grip and exploration of the region is described in the work from European, republic, district and consequently the regional context. The thesis is focused on the region Litoměřice, which is described in aspect of participation in detail. In the practical part of the thesis is the Litoměřice region studied by questionnaire survey. There are questions set and answered. With these issues is expressed effort to find out whether the value of gender, age and education tend to influence the participation rate among residents in the Litoměřice region. The detected data are processed and evaluated as a basis for presenting the conclusions.

The study was made both with theoric references and field research. The field research refers to a protestant group that assists people that live in streets in the west zone of Rio de Janeiro, in the Guaratiba neighborhood, doing a work called "Sop?o". The general Purpose of this work is to produce a reflection about the causes of religious volunteer assistencialist practices nowadays, in relation both to the insufficient public policies and to the historic context of the engagement of civil society. Therefore, the dissertation analyses the volunteer works of social action of protestant churches under two principal prospects, or two hypotheses. The first shows the volunteer work like assistentialist and philanthropic, that works like an answer to the insufficient public policies - in this case, we will appropriate of Welfare State conceptions. The second shows the volunteer work like an assistance provided by protestant religious associations that appear, in this case, like civil society associations, resultants of the movement of civil participation that grow up starting in the 90's with the new Constitution, and promoter of public policies. / A presente disserta??o apresenta um estudo sobre trabalhos volunt?rios de a??o social relacionados ? quest?o da pobreza urbana na sociedade contempor?nea brasileira. Trata-se de um estudo de caso, no qual a pesquisa foi feita tanto com base em referencial te?rico como em pesquisa de campo. A pesquisa emp?rica tem como refer?ncia um grupo protestante que assiste moradores de rua na Zona Oeste do Rio de Janeiro, mais especificamente no bairro de Guaratiba, realizando um trabalho denominado ?Sop?o?. O objetivo geral desse trabalho ? aprofundar a reflex?o sobre as motiva??es das pr?ticas assistenciais volunt?rias religiosas na contemporaneidade, relacionando-as tanto ao contexto de insufici?ncia das pol?ticas p?blicas do estado do Bem Estar Social, como ao contexto hist?rico do engajamento da sociedade civil para com a pobreza urbana no Brasil. Sendo assim, analisou-se os trabalhos volunt?rios de a??o social das igrejas protestantes sob duas principais perspectivas, que se desdobram em duas hip?teses a serem testadas. A primeira delas entende o trabalho volunt?rio como assistencialista e filantr?pico, que surge como resposta e alternativa ? insufici?ncia de pol?ticas p?blicas por parte do Estado ? nesse caso nos apropriamos das concep??es do Estado do Bem Estar Social para basear a hip?tese. El marco político español de la década de 1960 hubo de adaptarse a los nuevos valores y actitudes sociales que cambiaban más allá del contexto jurídico. La Ley de Asociaciones de 1964 creó un espacio legal, con las restricciones propias del franquismo, para una extraordinaria proliferación de viejas y nuevas formas de asociación. Una voluntad asociativa que generó espacios de sociabilidad, contribuyendo al mismo tiempo a la reconstrucción de la sociedad civil, sirviendo de base legal para la gestión de unos nuevos movimientos sociales que participaron en el proceso político de transición a la democracia en España.El estudio de las asociaciones civiles a lo largo del periodo comprendido entre 1964-1986, permite observar además la evolución de la sociedad española entre el franquismo y la consolidación democrática, con toda la serie de cambios que se producen en un país que en poco tiempo alcanzará las pautas globales del mundo occidental. / The political Spanish framework of the decade of 1960 had to adapt to the new values and social attitudes that were changing faster than the juridical context. The law of associations of 1964 created a legal space, with the own restrictions of the Franco's regime, for an extraordinary proliferation of old and new forms of association. An associative will that generated spaces of sociability, contributing at the same time to the reconstruction of the civil society, using as legal base for the management of new social movements that took part in the political process of the Spanish transition to democracy. The study of the civil associations along the period among 1964-1986 shows in addition the evolution of the Spanish society between the Franco's regime and the democratic consolidation, with the whole series of changes that are produced in a country that in a little time will reach the global guidelines of the Western World.
