Abstracts in English, Afrikaans and Southern Sotho / The prevalence of hate victimisation in South Africa remains unknown, as does its full impact. Anecdotal evidence, borne out by recent research findings, suggests hate-based attacks on non-nationals have increased in recent years, distinctly reflecting a picture of heightened vulnerability. For several reasons, the severity of such victimisation, and their physical and psychological impact, go mostly unseen. Hate-motivated incidents, such as hate speech and intentional unfair discrimination, are possible precursors to additional criminal victimisation. Records of such incidents can be helpful to demonstrate both a context of harassment and evidence of escalating patterns of violence. Worldwide, under-reporting of hate victimisation is a longstanding concern and requires an urgent solution. In South Africa, under-reporting has contributed to the nonrecognition of hate crime as a separate crime category. Towards aiding in finding a solution, this study explored the psychological barriers to reporting xenophobic victimisation to relevant authorities. The study, furthermore, explored with a group of victims who experienced xenophobia whether they reported victimisation, the reasons for reporting and under-reporting, and their thoughts and opinions on the workability of a third-party reporting mechanism. Non-probability sampling, specifically applying convenience and purposive sampling was used to obtain 19 participants for the four semi-structured focus groups. While all participants reported being victimised because of their nationality, the study found that multiple psychological barriers prevent such victims of xenophobia from reporting victimisation to authorities. Many of the participants do not believe in the workability of third-party reporting mechanisms. / Dit is onbekend hoe algemeen viktimisering op grond van haat in Suid-Afrika voorkom, en daarom ook wat die volle impak daarvan is. Onlangse navorsingsresultate dui egter daarop dat aanvalle op nielandsburgers wat uit haat voortspruit, toegeneem het die afgelope paar jaar, wat hulle groter kwesbaarheid duidelik weerspieël. Die intensiteit van hierdie viktimisering, asook die fisieke en sielkundige impak daarvan word in die meeste gevalle om verskeie redes ook nie bekendgemaak nie. Voorvalle wat uit haat voortspruit, soos haatspraak en doelbewuste onregverdige diskriminasie, is moontlik voorlopers van verdere kriminele viktimisering. Die optekening van sulke gevalle kan help om bewys te lewer van die teisteringskonteks, sowel as van patrone van toenemende misdaad. An exploration of alcohol abuse as a risk factor for Intimate Partner Violence in Kibera, KenyaKariuki, Lydiah Wanjiru 05 1900 (has links)
The purpose of this study was to explore the influence of alcohol abuse on intimate
partner violence (IPV) committed in Kibera, Kenya. The study is premised on the high prevalence of IPV and alcohol abuse in Kenya, especially among informal settlement dwellers. Kenya is geographically located in Eastern Africa. Kibera is an informal settlement in the country’s capital city, Nairobi, and is plagued by extreme poverty, unemployment and crime. A qualitative approach was implemented and a case study research design employed. Non-probability sampling, using purposive and snowball techniques, was used to select research participants. A total of 32 female victims of IPV made up the sample used in the study. Although the study did not intend to exclude males from the sample, no male victims of IPV could be located. Semi-structured interviews were held individually with each participant. Ethical considerations were actively applied throughout the duration of the study. The raw data collected were thematically analysed. The findings of the study revealed that most of the participants were under 40 years old, married, and had at least one child. Their educational levels were limited, and their occupations as well as their partners’ occupations generated low incomes. Physical and psychological abuse were cited as the most common types of abuse. However, sexual abuse was still prevalent and in some cases was extended to the children.
The physical and psychological impacts were identified as the most prevalent effects of IPV. The effects on the children and family were also explored. The study found a strong link between alcohol use and IPV. However, alcohol use and/or abuse could not be identified as the only causal factor of IPV. Interestingly, the participants’ experiences highlighted the patriarchal and cultural milieu significant to Kibera. It was found that the patriarchal nature maintained in Kibera is one of the factors contributing to IPV and its perpetuation. / Utafiti huu ulilenga kuchunguza athari za pombe kwa dhuluma zinazosababishwa na mpenzi unayeshiriki naye ngono (IPV) katika eneo la Kibera nchini Kenya. Social workers’ personal safety challenges and coping strategies employed during social work service delivery : suggestions for promoting social workers’ personal safetyZimunya, Shingirayi 29 March 2021 (has links)
Social work, as a profession, is critical for societies as it aims to promote social change and development, as well as social cohesion and the empowerment and liberation of people. Whereas the working conditions of social workers have been the focus of previous research, the topic of social workers’ personal safety challenges and the coping strategies employed during social work service delivery seems to be sparsely researched and documented in indigenous literature. In view of this, I designed a research project aimed at exploring the personal safety challenges that social workers encounter and the coping strategies they employ during social work service delivery from a qualitative research approach with a collective case study design, coupled with an explorative, descriptive, contextual and phenomenological research design, with a view to proffer suggestions for promoting social workers’ personal safety. From the conception of the research project, up until its finalisation which culminated in this research report, I observed the ethical principles of informed consent, anonymity, and confidentiality in the context of the management of information.
I employed semi-structured interviews as a data collection method from a sample of 14 purposively selected social workers in the employ of one government Department and three non-profit organisations in the Tshwane region. Data was analysed using Tesch’s (1990) steps and data verification was done through Gibbs’ (2008) model. I utilised Schlossberg’s (1981) Transition Process Model as the theoretical lens in this study. Based on the findings presented in this research report, it is evident that social workers face various challenges in terms of their personal safety, ranging from being physically attacked and being at the receiving end of aggressive behaviour from distressed, frustrated, and hostile service users, to facing risks to their personal safety in the social work offices and whilst on the road during fieldwork or in the communities they serve. The various coping strategies that social workers employ as way of dealing with the incidents and situations in which their personal safety is compromised include speaking to a supervisor, colleagues, friends, or a therapist; using their personal faith; remaining calm and withdrawing from the unsafe situation; and enlisting the help of the police or ensuring that they are accompanied by colleagues when doing fieldwork. The research findings included the suggestions proffered by the research participants on how to promote the personal safety of social workers and these are directed at employer organisations and social workers themselves. In addition, recommendations are provided which are directed towards social work practice; social work education and training; and continuous professional development. Le droit international pénal est né de l'engagement de la responsabilité pénale individuelle des principaux criminels de la Seconde guerre mondiale. Aux Tribunaux de Nuremberg et de Tokyo, ont succédé dans les années 1990 les deux juridictions ad hoc pour l'ex-Yougoslavie et le Rwanda, créées par le Conseil de sécurité des Nations Unies, avant l'avènement d'une juridiction indépendante, permanente et à vocation universelle en 1998 : la Cour pénale internationale. Parmi les actes sous-jacents constitutifs de crimes de guerre, de crimes contre l'humanité et de génocide, une constante apparaît : l'intégrité physique et mentale. En l'absence de définition uniforme dans les systèmes juridiques nationaux, cette notion se définit sur la base des dispositions statutaires et se précise grâce à la jurisprudence des juridictions internationales pénales. Érigeant un véritable droit à l'intégrité physique et mentale en matière de génocide et de crimes de guerre, la jurisprudence des Tribunaux ad hoc utilise également la notion pour compléter la liste des actes sous-jacents constitutifs de crimes contre l'humanité et définir d'autres infractions. Les Chambres vont même jusqu'à protéger cette intégrité en dehors de toute incrimination. Ce droit soulève des questions de sécurité juridique tout en démontrant l'autonomie du droit international pénal / The roots of international criminal law may be found in the individual criminal liability of the major criminals of the Second World War. The Nuremberg and Tokyo International Military Tribunals were followed in the 1990's by the two ad hoc Tribunals for Former Yugoslavia and Rwanda, created by the United Nations Security Council, and then in 1998 by an independant and permanent tribunal with a universal vocation : the International Criminal Court. Among the underlying acts of war crimes, crimes against humanity and genocide, a leitmotif stands out : physical and mental integrity. Without a uniform definition in national legal systems, this notion is defined on the basis of statutory provisions and becomes clear in the international criminal tribunals' case law. Establishing an autonomous right to physical and mental integrity in terms of genocide and war crimes, the case law of ad hoc tribunals alsouses the notion to complete the liste of underlying acts of crimes against humanity and to define some other crimes. Chambers are also protecting this integrity without any incrimination. Because beyond physical and mental integrity of victimes, arises the question of the physical and mental integrity of other actors of conflicts and proceedings : soldiers, humanitarian workers, witnesses and accused.Studying the right to physical and mental integrity in international criminal case law uncovers the emergence of a right unknown to national legal systems as such. This right raises questions of legal certainty as much as demonstrates the autonomy of international criminal law.

Select psychosocial risk factors contributing to domestic violence against women in Tshwane, South AfricaDreyer, Cherie 11 1900 (has links)
South Africa has among the highest rates of physical and sexual violence against women in the world. Research indicates that understanding the causality of domestic violence is very complex and the measurement of risk factors are deemed challenging. Yet, it is important to understand and identify the risk factors associated with domestic violence to effectively prevent it. This phenomenological research study aimed to investigate the lived experiences of female domestic violence victims and sought to identify risk factors (e.g. alcohol and drug abuse, violence in the family of origin, personality factors, cultural differences, socio-economic factors, and the impact of pregnancy) that may have contributed to the occurrence of domestic violence in their intimate relationships .The participants were selected based on purposive and convenience sampling and also their willingness to participate. The sample consisted of six participants between the ages of 18 – 45 years old, residing in Tshwane, South Africa. The data were obtained through semi-structured interviews. A qualitative methodological design was used to collect and explore information about the participants’ personal experiences with domestic violence. Hycner’s explicitation process was employed to identify the four main themes, namely the participants’ experience of domestic violence; socio economic factors; cultural differences, and domestic violence during pregnancy. Each main theme was comprised of sub-themes.
The findings of this study differed slightly in comparison with the existing body of literature that highlight substance abuse as one of the highest risk factors for the occurrence of domestic violence in intimate relationships. In this study, other risk factors such as pregnancy and socio-economic factors played a much bigger role than substance abuse as the key risk factors that contribute to the occurrence of domestic violence. / INingizimu Afrika ingenye yamazwe omhlaba anamazinga aphezulu odlame nokuhlukunyezwa kwabesimame ngokocansi. Le principe de complémentarité entre la cour pénale internationale et la juridiction pénale nationale / The principle of complementarity between the international criminal court and the national criminal jurisdictionAshnan, Almoktar 16 June 2015 (has links)
L’objet de cette recherche est d’analyser le principe de complémentarité, de montrer la spécificité de la notion et d’en étudier la mise en œuvre à la lumière de la pratique de la Cour Pénale Internationale (CPI) afin de mettre en évidence les obstacles juridiques et politiques. Selon l’article 1er du Statut de Rome, la Cour est complémentaire des juridictions pénales nationales pour le crime de génocide, les crimes contre l’humanité, les crimes de guerre et le crime d’agression. Dans le cadre de ce principe, les juridictions nationales ont la priorité mais la compétence de la Cour prend le relais lorsqu’un État ne dispose pas des moyens techniques ou juridiques nécessaires pour juger et punir les auteurs desdits crimes ou bien s’il mène un procès truqué. Dès lors, le régime de complémentarité vise à mettre fin à l’impunité à l’égard des personnes impliquées dans les crimes les plus graves qui touchent l’ensemble de la Communauté internationale. Le Statut de Rome, notamment par les dispositions de son article 17, indique comment mettre en œuvre la complémentarité selon les critères de recevabilité qui sont l’incapacité, le manque de volonté et la gravité. Les articles 18 et 19, pour leur part, fournissent le mécanisme de décision préjudicielle sur la recevabilité et la contestation. Par ailleurs, le rôle du Conseil de sécurité face à la complémentarité est aussi considéré comme un élément essentiel pour bien comprendre l’effectivité et l'impact juridique de cette Cour. En effet, les pouvoirs que le Statut de Rome et le chapitre VII de la Charte des Nations Unies confèrent au Conseil lui permettent de saisir la CPI, de suspendre son activité, d’imposer aux États de coopérer avec la Cour, ou encore de qualifier un acte de crime d’agression, et ceci bien que l'indépendance de l’enquête et du procès soit l’épine dorsale de toute la justice pénale, si celle-ci veut être efficace. / The purpose of this research is to analyse the principle of complementarity, to show the specific character of the notion and to study its implementation in the light of the practice of the International criminal court (ICC) in order to highlight the political and legal obstacles. In accordance with Article 1, the Court is complementary to national criminal jurisdictions for crime of genocide, crimes against humanity, war crimes, and crime of aggression. Under this principle, national jurisdictions have priority over ICC but the Court’s jurisdiction takes over when a State lacks the technical or legal means, which are necessary to try and punish the perpetrators of such crimes, or if a rigged trial took place. Therefore, complementarity aims to bring an end to impunity for those responsible for the most serious crimes of international concern. The Rome Statute, namely with the provisions of Article 17, indicates how to implement complementarity according to the criteria for admissibility which are inability, unwillingness and seriousness. Articles 18 and 19, for their part, provide the mechanism of preliminary ruling regarding admissibility and challenge. Furthermore, the role of the Security Council regarding complementarity is also considered as essential to understand the effectiveness and the legal impact of this Court. Powers which are conferred under the Rome Statute and chapter VII of the United Nations Charter allow the Security Council to refer a situation to the ICC, to suspend an ICC investigation, to require States to cooperate with the ICC, or to qualify a crime as aggression, and this despite the fact that the independence of the investigation and of the trial is the backbone of criminal justice ensuring it is efficient.

<p>Савремени концепти међународног кривичног права одавно су напустили правне оквире, начела и традицију очувања светског мира, јер се међународно право више не примењује, оно се тумачи и то на онај начин који одговара политичким струјама у међународним односима.<br />На који начин је дошло до вулгаризације међународног кривичног права и у којој мери је оно изражено најприближније говоре случајеви покренути пред међународним кривичним судовима. Анализом рада међународних кривичних судова у смислу: конституисања суда, дефинисања материјалних и процесних норми, извођењу доказа, изменом и допуном Правилника о поступку и доказима, истицању одређених кривичних дела, различитим стандардима и начину вредновања наступелих последица, националниј припадности субјеката у поступку... могу се препознати многи проблеми који су дискредитовали постојање начелних питања истине, објективности и правичности. У овим начелима налазе се потенцијална решења ефикасности међународних кривичних судова, али стиче се утисак да би решењем ових проблема правда била достижна и за оне који су проузроковали низ озбиљних сукоба у свету. Сходно томе, потребно је запитати се да ли међународна заједница уопште жели да постоји институција као што је Међународни кривични суд?<br />Међународни кривични судови, до сада су више личили на институције које су биле подређене медијским кампањама усмереним против унапред етикетираних држава и носиоца њихове суверене власти, што се у великом броју случајева показало као идеалан параван за покретање агресивних ратова. Ако је Међународни кривични суд надлежан, између осталог, и за дела агресије, због чега целокупна међународна заједница ћути и ништа не предузима по питању окупације аутономне покрајне Косова и Метохије и не супротстави се рушилачким идеологијама припајања суседним државама. Зар то не представља рушилачки фактор безбедности и мира у региону? Већина држава у свету, а посебно у Европи, има сличних проблема који су мање или више транспарентни, али уколико се настави садашњим путем слична судбина могла би и њих да задеси.<br />Да би међународни кривични судови били у могућности да обављају функцију због које су основани њихова надлежност треба да искqучи сваки вид економске и политичке зависности. Своју надлежност судови треба да заснивају на правилима бона фидес којима би као Судови региона своју правну снагу црпили из кодификованог међународног кривичног права и постулата обичајних правних правила. U ovim načelima nalaze se potencijalna rešenja efikasnosti međunarodnih krivičnih sudova, ali stiče se utisak da bi rešenjem ovih problema pravda bila dostižna i za one koji su prouzrokovali niz ozbiljnih sukoba u svetu. Shodno tome, potrebno je zapitati se da li međunarodna zajednica uopšte želi da postoji institucija kao što je Međunarodni krivični sud?<br />Međunarodni krivični sudovi, do sada su više ličili na institucije koje su bile podređene medijskim kampanjama usmerenim protiv unapred etiketiranih država i nosioca njihove suverene vlasti, što se u velikom broju slučajeva pokazalo kao idealan paravan za pokretanje agresivnih ratova. Ako je Međunarodni krivični sud nadležan, između ostalog, i za dela agresije, zbog čega celokupna međunarodna zajednica ćuti i ništa ne preduzima po pitanju okupacije autonomne pokrajne Kosova i Metohije i ne suprotstavi se rušilačkim ideologijama pripajanja susednim državama. Zar to ne predstavlja rušilački faktor bezbednosti i mira u regionu? Većina država u svetu, a posebno u Evropi, ima sličnih problema koji su manje ili više transparentni, ali ukoliko se nastavi sadašnjim putem slična sudbina mogla bi i njih da zadesi.<br />Da bi međunarodni krivični sudovi bili u mogućnosti da obavljaju funkciju zbog koje su osnovani njihova nadležnost treba da iskquči svaki vid ekonomske i političke zavisnosti. Svoju nadležnost sudovi treba da zasnivaju na pravilima bona fides kojima bi kao Sudovi regiona svoju pravnu snagu crpili iz kodifikovanog međunarodnog krivičnog prava i postulata običajnih pravnih pravila. Takve sudove je moguće uspostaviti, pod uslovom da se postojeći politizovani birokratski sistem sudija i tužilaca u međunarodnim krivičnim sudovima zameni novim regionalnim rešenjima i koncepcijama nezavisnih mehanizama kontrole.</p> / <p>Modern concepts of international criminal law have long since left the legal frameworks, principles and tradition of preserving world peace, because international law is no longer applicable, it is interpreted in a way that is consistent with political currents in international relations.<br />How has the vulgarisation of international criminal law come about and to what extent is it most closely illustrated by cases brought before international criminal courts. By analyzing the work of international criminal courts in terms of: constituting a court, defining substantive and procedural norms, presenting evidence, amending the Rules of Procedure and Evidence, highlighting certain criminal offenses, different standards and the way of evaluating the consequences, the national affiliation of the subjects in the proceedings ... many problems can be identified that have discredited the existence of fundamental questions of truth, objectivity and fairness. These principles provide potential solutions to the effectiveness of international criminal courts, but the impression is that by resolving these problems, justice would be attainable for those who have caused a number of serious conflicts in the world. Accordingly, one has to wonder if the international community wants an institution such as the International Criminal Court at all?<br />International criminal courts have so far been more like institutions subordinate to media campaigns against pre-labeled states and holders of their sovereign power, which in many cases proved to be an ideal front for launching aggressive wars. If the International Criminal Court has jurisdiction over, among other things, acts of aggression, for which reason the entire international community is silent and does nothing about the occupation of the autonomous provincial Kosovo and Metohija and does not oppose the destructive ideologies of annexation to neighboring countries. Doesn't that represent the destructive factor of security and peace in the region? Most countries in the world, and especially in Europe, have similar problems that are more or less transparent, but if they continue along the same path, a similar fate could befall them.<br />In order for international criminal courts to be able to perform the function for which they were founded, their jurisdiction should exclude any form of economic and political dependence. Courts should base their jurisdiction on bona fides rules which, as the Courts of the Region, derive their legal power from codified international criminal law and the common law rules. Such courts can be established, provided that the existing politicized bureaucratic system of judges and prosecutors in international criminal courts is replaced by new regional solutions and concepts of independent control mechanisms.</p>

A criminological exploration of female drug mules incarcerated in Kgoši Mampuru II and Johannesburg female correctional centresMnguni, Nokonwaba Zandile 14 January 2021 (has links)
Abstract in English, Xhosa and Tswana / The recognition of the role of females in drug trafficking was established more than 30 years ago and there are notable cases of women undertaking leading roles in this crime for almost 100 years. This phenomenon has gained popularity in South Africa as is evidenced by the number of women who are found and incarcerated for smuggling drugs into or out of South Africa. The purpose of this study was to gain an in-depth understanding of the female drug mule phenomenon and explain the reasons why female drug mules are involved in drug smuggling. The objectives of the study were to develop a profile for female drug mules incarcerated in South African correctional centres, specifically Kgoši Mampuru II and Johannesburg Female Correctional Centre; to establish risk factors for being recruited and used as drug mules; to explain the mules’ motivations for being involved in drug smuggling; to determine the physical and emotional impact drug smuggling has on the drug mules; and to determine the methods used by drug mules to smuggle drugs. A qualitative research approach, with the use of one-on-one semi-structured interviews, was used to obtain information from participants. The sample comprised 20 diverse female offenders incarcerated at Kgoši Mampuru II and Johannesburg Correctional Centres. The data from the schedule of interview questions were analysed using thematic analysis, coding and categorising. It is envisaged that this research will be of significance to the criminal justice system, as recommendations on deterrence and preventative measures regarding the use of females as drug mules may be made from the findings. The general findings of this research demonstrate that a female drug mule, in the context of this study, is an African or Spanish woman that is open to methods that can produce various streams of income to support her children and family. Secondly, the findings in this dissertation revealed that women are recruited as drug mules because of their vulnerable economic state. Lastly, the most common method used to smuggle drugs revealed by participants in this research is through luggage concealment. Through this study, an in-depth insight into the history and life circumstances of female drug mules is provided. This will also help society to understand why some individuals are at risk of being recruited as mules or are motivated to engage in drug smuggling. Domestic Violence AdvocacyWood, Leila Grace January 2014 (has links)
Indiana University-Purdue University Indianapolis (IUPUI) / Advocacy, in the form of direct service, is a critical type of intervention to help intimate partner or domestic violence survivors. Little is known the best practices for social workers and other helping professionals to assist survivors of domestic violence who present for services at shelters, non-residential outreach, and legal settings. This dissertation reviews relevant research related to domestic violence direct services, which is also called advocacy. The study also outlines a brief overview of the history, theory, and paradigms of thought related to the movement to end intimate partner violence. The research project used the grounded theory method to conduct and analyze semi-structured, in-depth interviews with advocates at domestic violence agency to answer the research question: What constructs and practices inform the delivery of direct services to survivors of domestic violence from shelter and non-residential service advocates? A total of 22 women working primarily with domestic violence survivors in shelters and non-residential agencies participated in the dissertation study. Participants came from one Midwestern and one Southwestern state. The interviewees had a range 1-20 years of experience in the field of domestic violence advocacy. Eighteen of 22 participants had experienced some sort of intimate violence in their lifetime. Several important findings emerged. Advocates typically enter the field because of personal motivations. The empowerment and strengths-based perspective are important to the delivery of advocacy services, as is belief in hope. Advocates typically endorse a survivor centered approach to their work. Data analysis revealed a concurrent process of advocacy that occurs within advocates and between advocates and survivors. This parallel process is marked in the earlier state of assessing and grounding; in the middle stage of establishing and affirming; and the ending stages of hoping and reflecting. These findings suggest the importance of personal experiences, hope, and reflection in the delivery of advocacy services. Community collaboration and support are essential to maintaining services that are aimed at the individual needs of survivors. More research is needed about the perceptions of services among survivors of domestic violence.
