The concept of inter-country adoptions was reintroduced into the South African legal sphere in The Minister of Social Welfare and Population Development v Fitzpatrick 2000 3 SA 422 (CC), where the constitutionality of section 18(4)(f) of the Child Care Act 74 of 1983, which prohibited inter-country adoptions, was successfully challenged. The decision evoked criticism from all around the world, some in favour of inter-country adoptions and others not.
In considering this decision, one also has to keep in mind section 28(1)(b) of the Constitution of the Republic of South Africa, 1996 which affords every child the right to family care or parental care, or to appropriate alternative care when removed from the family environment.
The aim of this paper is to investigate the inner workings of inter-country adoptions, which are regulated by the Hague Convention on Protection of Children and Co-operation in Respect of Intercountry Adoption of 1993 and, nationally, the Children’s Act 38 of 2005. This thesis is concerned with cultural connection and its role in creating cultural permanence when planning for Indigenous children and youth in care. Its goal is to mitigate the current path of disconnection and imbalance for Indigenous children and youth in care and to recommend an ecological, holistic approach to child welfare practice. It comprises a literature review that documents theories and practices to support belonging, cultural permanence, and cultural identity for Indigenous children while supporting meaningful connections with family, culture, and community. This information and analysis will be applied to the care of children and youth being served by Northwest Inter-Nation Family and Community Services Society (NIFCS) in British Columbia. The study’s findings will highlight guidance to assist social workers in centering cultural traditions that promote cultural strengths, resiliency, and a sense of belonging for Indigenous children and youth. This thesis will provide suggestions for interacting with the Indigenous community, parents, relatives, workers, and other delegated agencies. This study explores the possibilities of rewriting the text of a complex novel as a film
script. Film is an important contemporary artform but the actuality of the thematic
content of contemporary Afrikaans novels is not well represented in current films. In
this study an adaptation of the novel, The long silence of Mario Salviati by Etienne
van Heerden (2000) ,t o a script is made in an attempt to provide the Afrikaans
scriptwriter with a workable method. The theme which features prominently in the
adaptation is the experience of identity in the post-colonial and/or post-apartheid era
in South Africa.
Theoretical reflection on the problem of adaptation is essential before the chosen
novel can be turned into a script, since the scriptwriter has to make certain
adjustments during the process of adaptation. The adaptation of a novel to a script
implies the translation of a written, descriptive text into a visual text. When a
complex novel such as The long silence of Mario Salviati is rewritten as a script, a
detailed analysis of the novel must be undertaken in order to identify the relevant
ideological content, the important themes and underlying meanings which should be
retained in the film script. In order to find appropriate visual images for the thematic
content of the novel, contributions of semiotics to film studies are studied and
implemented in the process of visualisation.
The chosen theme for the script of The long silence of Mario Salviati is "Identity,
hybridity and liminality in the Tallejare community". This theme features
prominently in many narratives about post-colonial and post-apartheid issues;
therefore theoretical reflections on the concepts of liminality and hibridity are
included in the study.
There are two main sections in the dissertation. In the first section aspects of
scriptwriting are analysed and discussed in order to develop a workable method for
scriptwriters. The study entertains the hope that more contemporary Afrikaans novels
will be adapted for the big screen or television by the film industry. This is necessary
to ensure that the experience of South African identity is represented adequately in
the Afrikaans film industry.
The second section of the dissertation contains the film script, which is an adaptation
of the novel The long silence of Mario Salviati by Etienne van Heerden. The script

The lion and the frigate bird: visual encounters in KiribatiGilkes, Brian Eric, pharoseditions@bigpond.com January 2010 (has links)
In order to explain some of the paradoxes and mysteries of the artist's cross cultural experience in Kiribati, he constructed an Artist's Book depicting through visuality, anecdote and reflection, his research process, engaging with current visual perceptions through negotiation with the past. In Kiribati previous encounters with Europeans and Islanders was dominated by English and I Kiribati with significant contributions by French missionaries. Each viewed the other through cultural filters of identity, which were informed by concepts of myth-historical, often heroic pasts, modified by contemporary purpose such as power, trade, evangelism or personal gain. The method of transmission of beliefs about the past differed fundamentally as the Europeans were predominately informed by writing and the I-Kiribati by orality and performance. The non-literary epistemology of the I Kiribati contributed to a cosmology of non-iconic symbols that defined belief systems and social structures. These symbols connected place and space with time, self and group identities. The research found that the all surrounding visual symbol system of sacred meeting house (maneaba), dwelling (bata) and canoe (waa and baurua)) could be partly understood as an ongoing struggle since Deep Time, between the forces of the Ocea n represented by Bakoa, The Shark, and that of the triumph of the coming onto the Land and its people (aba) represented by Tabakea, The Turtle. The performative outcome of this triumph and the spirit of identity (Te Katai ni Kiribati) it engenders is expressed primarily in the ubiquitous I Kiribati Dance. The Artists Book is inspired by the creative classic I Kiribati form of oratory known as Te Kuna, using a structure analogous to the symbolic forms of narrative of Oceanic Voyaging traditionally employed by the I Kiribati. Differences in visual perceptions across cultural interface are understood not only as having the potential for conflict but also as providing positive dynamic force by the interchange of understood differences. The project contributes specifically to the ethnography of English and I Kiribati, semiotic systems and visual epistemologies, indicating directions towards positive outcomes in cross-cultural encounters.

Cultural typologies and design meanings: a case study of Chinese media and entertainment websites from SingaporeSoh, Choi Yin, Art, College of Fine Arts, UNSW January 2007 (has links)
The Internet offers new ways of imaging and 'imagining' national belonging and cultural identities in contemporary Chinese societies such as Singapore. The Chinese society is also a key representative in Tu Wei-Ming's first symbolic universe - including China, Hong Kong and Taiwan - under a 'Cultural China' (Tu 1994). Various cultural discourses indicate that this nation-state is capable of managing culture to maintain national competitiveness within global capitalism (Wee 2000, Chua 1995). This 'local national cultural ism' is significantly manifested in Chinese media and entertainment websites from Singapore. Within the Asia Pacific region, the notion of an emerging 'pan-Chinese' cultural identity for commercial exchange and interaction with regional and global markers has been an appealing economic construct (Nyiri 1999). In Singapore the Chinese media and entertainment websites employ design strategies to attract foreign investors and cater for local 'heartlanders' with success. The Singapore media sire is carefully scrutinized, presented and aligned with its economic policies and agendas in presenting the country as a young and vibrant society. Although media and entertainment form a key aspect of popular culture in contemporary Singapore, the visual communication and content of the websites also provide an 'institutional memory' and design strategies which emphasize the distinctiveness of cultural identity. This is research interrogates the perception of 'Chinese' identity by Singaporean youth in a pilot study which analyses user responses to a prototype for interface design in web-based communication. In addition, a comparative analysis of three design components - colour, icon/symbol and visual metaphor ??? is examined with reference to the social construction of local, 'glocal' and cultural meanings in the media and entertainment websites-from Hong Kong, Shanghai and Singapore. The research concurs with current literature that cultural identity is mediated by design and communicative strategies to resonate with the target audience. Although the design strategies for representing a 'pan -Chinese' identity have yet to be explored, 'Cultural China' plays a major role in regional/global economic development.

Η πολυπολιτισμική σύνθεση της κοινωνίας και η συνακόλουθη αρχή του σεβασμού της διαφορετικότητας έχουν εμφανέστατα μεταφερθεί στην εκπαίδευση, η οποία είναι άρρηκτα συνδεδεμένη με το κοινωνικό περιβάλλον όπου συντελείται.
Οι δημογραφικές αλλαγές έχουν προφανώς αντίκτυπο στο εκπαιδευτικό σύστημα, το οποίο καλείται να διαδραματίσει σημαντικό ρόλο στη δημιουργία προϋποθέσεων αποδοχής και αναγνώρισης του πλουραλισμού και της ετερότητας ως βασικών γνωρισμάτων των σύγχρονων κοινωνιών. Η εκπλήρωση του ρόλου αυτού απαιτεί προσαρμογή του ίδιου του εκπαιδευτικού συστήματος στα νέα δεδομένα κοινωνικοποίησης που χαρακτηρίζουν την εποχή μας. The demographic changes have an obvious impact on the educational system. Which is summoned to a role of creating conditions of acceptance and recognition of pluralism and otherness as the basic characteristics of modern societies. The fulfillment of this role requires adjustments to the educational system itself towards the new data of social inclusion that characterizes our societies. Expect of the simultaneous adjustments to the legal framework, changes are also required concerning the curriculum, the offered programs, the teaching material, the supplement of teachers and executives of education with modern knowledge and abilities which will make them capable of using the right method and following the needed strategies so their educational and leading work is effective. The principals role is defining for the smooth and effective function of a school intercultural education can reach its goals if theirs is a change of attitudes in educational dynamic as much on an executive level as in teaching and educational practice.
In this thesis the given question is whether each principal of each school unit has the required qualifications and abilities to react accordingly concerning his work, meaning whether or not he has intercultural and leading capabilities and confidence concerning intercultural issues about working with foreign speaking students.

A representação da cultura brasileira teuto-gaúcha na literatura sul-rio-grandense contemporâneaMombach, Clarissa Kristen January 2008 (has links)
Este estudo consiste numa reflexão acerca da identidade cultural no contexto contemporâneo, mais especificamente, da cultura brasileira teuto-gaúcha e da sua representação na literatura sul-rio-grandense contemporânea. Para tanto, realizou-se um levantamento de obras da literatura gaúcha mais recente que focalizam os imigrantes e descendentes alemães como personagens centrais da narrativa, dentre as quais se selecionou um corpus constituído pelos livros A asa esquerda do anjo (1981), de Lya Luft, e Valsa para Bruno Stein (1986), de Charles Kiefer. A partir da análise realizada, percebeu-se que a cultura teuto-gaúcha é representada através de uma ambigüidade marcante na vida dos protagonistas, oriunda do entre-lugar de sua condição intervalar, constituída pela herança cultural alemã e pela vivência no contexto brasileiro. De um modo geral, a presença da cultura teuto-gaúcha pode ser notada no emprego da língua alemã, na rigidez dos costumes e comportamentos familiares, no preconceito interétnico e de gênero, na culinária e na religião defendida e posteriormente abandonada (no caso de Bruno Stein). Desse modo, tornam-se evidentes as marcas da imigração germânica – iniciada a partir de 1824 – na literatura contemporânea produzida no Rio Grande do Sul. Tal cultura, traduzida pelos seus descendentes e integrada ao contexto brasileiro, deu origem à cultura híbrida teuto-gaúcha, própria do grupo em questão, cujos representantes ainda se fazem notar, conforme atestam os romances analisados. / The present research is a reflection about the cultural identity in the contemporary context, more specifically, about the Teuto-Gaucha Brazilian culture and its representation on the contemporary riograndense literature. For this reason, it was researched books on the gaucha literature which focus the immigrants and German descendents as main characters in the narrative. Among these books it was selected a corpus consisting from A Asa esquerda do anjo (1981), by Lya Luft, and Valsa para Bruno Stein (1986), by Charles Kiefer. Based on the performed analysis, it was noticed that the Teuto-Gaucha culture is represented through a stressed ambiguity in the main characters life, which came from an in-between place condition, consisting of the German culture heritage and the life in Brazil. In general, the presence of the Teuto-Gaucha culture can be observed in the use of the German language, in the strictness of the customs and behaviors, in the ethnic and genre prejudice, in the food and religion defended and later abandoned (in the case of Bruno Stein). This way it is clearly perceived the marks of the German immigration – which began in 1824 – on the contemporary literature written in Rio Grande do Sul. This culture, translated by the German descendents and integrated into the Brazilian context, created the hybrid Teuto-Gaúcha Brazilian culture, specific from this group, whose members are still visible, considering the novels analyzed.

The objective of this article is to review and analyze the different arguments and legal excuses made by the Government and the private sector in Peru, this for the purpose of that the first-mentioned institution fails or avoids its juridical obligation of execute the preview consultation process for the indigenous peoples in Peru, this whenever the State is going to adopt a legislative or administrative measure susceptible that will affect directly to the indigenous peoples. In summary, this article seeks to analyze about the juridical problems founded at the moment of the implementation of the preview consultation process in our Legal System. If we consider that Convention 169 ILO, and the right to consult has been in force since February 2nd of 1995, and the Constitutional Court established on binding jurisprudence that the Convention in question is a norm that no needs a legislative development for its effectiveness, thus we can conclude that, rather than arguments is about legal excuses. / El objetivo del artículo es revisar y analizar los diferentes argumentos y pretextos jurídicos utilizados por el Gobierno y el sector privado en el Perú, para que el primero incumpla o evada su obligación jurídica de realizar el proceso de consulta previa con los pueblos indígenas en el Perú, esto cada vez que el Estado prevé adoptar una medida legislativa o administrativa susceptible de afectar directamente a los pueblos indígenas. En buena cuenta lo que hace el artículo es analizar los problemas jurídicos encontrados al momento de implementar la consulta previa en nuestro ordenamiento jurídico. Si tenemos en cuenta que el Convenio 169 de la OIT, y el derecho a la consulta estaban vigentes, y eran exigibles en el Perú desde el 2 de febrero del año 1995, y que el Tribunal Constitucional ha dicho en jurisprudencia vinculante, que el referido convenio es una norma que no necesita desarrollo legislativo para desplegar sus efectos normativos, podemos concluir, que más que argumentos, se trata de pretextos jurídicos.
