A search for life-giving marriage : the Imbusa initiation rite as a space for constructing wellbeing among married Bemba women of Zambia.

This empirical study analyses whether and how the Imbusa initiation rite is used to construct ‘subordinate femininities’ among married Bemba women of Zambia. Imbusa initiation rite is very significant for Bemba and Zambian women despite the many changes that have significantly altered their religio-cultural practices. It is something that makes every parent proud of their daughter because it is more or less a public declaration that they have raised their daughter with good morals as understood by Bemba people. This study has used two frameworks, first, African women theologies because African women theologies draw their sources from rites, rituals, songs, proverbs, riddles and so on. Secondly, I used status construction within social psychological theory because those with authority in groups define the outcomes and expectations of their group. For instance, banacimbusa among the Bemba people determine what should comprise the teachings in Imbusa and how an initiated woman has to behave in marriage. Utilizing mixed methods, the aim was to understand women’s views about ways in which the Imbusa rite contribute to the identity of Bemba and other Zambian women in marriage. I have proposed a framework for a life-giving marriage; first the need for banacimbusa who are gender sensitive in their teachings; second, African feminist Imbusa pedagogy, teachings that equip women for dialogue in marriage. Au lendemain de la renaissance juridique du XIIe siècle et de la redécouverte des compilations de Justinien, les juristes médiévaux s’attachent à bâtir un principe général de prohibition des donations entre époux. Dès la première moitié du XIIIe siècle, civilistes et canonistes assouplissent cependant les restrictions, passant ainsi d’une prohibition stricte à un simple système de révocabilité. Les praticiens français, répondant aux demandes de conjoints soucieux de protéger le survivant, ont contribué à l’affaiblissement des entraves romaines et canoniques : serment promissoire, clause de renonciation, donation par personne interposée constituent autant d’expédients, parfois même empiriques et frauduleux. En dépit de ce long glissement doctrinal et des palliatifs élaborés par les notaires, des interdictions ont longtemps persisté dans la plupart des législations territoriales, rédigées et inlassablement réformées à l’aune du droit romain, du Moyen Âge central au début de l’Époque moderne. / Immediately following the juridical renaissance of the 12th century and the rediscovery of the Justinian codification of Roman law, medieval jurists were committed to creating a general principle prohibiting donations between spouses. As early as the first half of the 13th century, however, civil law experts and canonists modulated the restrictions, thereby moving from strict prohibition to a simple system of revocability. French practitioners, responding to requests from married people concerned to protect their surviving spouse, contributed to weakening the constraints of Roman and canon law; promissory oaths, renunciation clauses and donations through an intermediary comprised such contrivances, which were sometimes even improvised and fraudulent. Despite this long doctrinal slide and the palliatives drawn up by notaries, such interdictions persisted over a long period of time in most territorial legislations, redrafted and repeatedly reformed according to the standards of Roman law from the high Middle Ages to the beginning of the modern times.

La figure de l’épouse fait partie intégrante du genre épique, dont les œuvres homériques ont élaboré le modèle pour la littérature gréco-romaine. L’importance accordée à l’eros féminin, et particulièrement conjugal, est l’un des aspects sur lesquels repose l’évolution de la généricité épique, d’œuvre en œuvre. À l’époque flavienne, Valérius Flaccus et Stace confèrent un rôle déterminant à deux figures féminines, celle de Médée dans les Argonautiques et celle d’Argie dans la Thébaïde, et présentent, tous deux, d’autres facettes de l’eros conjugal dans leur épisode lemnien, dont Hypsipyle est l’héroïne centrale. Cette présence accentuée du féminin peut être rapprochée de la réflexion contemporaine sur l’éthique conjugale menée dans le domaine philosophique, notamment par Musonius Rufus. Sur le plan littéraire, dans le contexte de la latinité d’argent, elle manifeste un questionnement des normes du genre, qui se traduit par une représentation de l’épouse selon des modèles autres qu’épiques : celui du genre tragique et de l’élégie romaine, particulièrement des Héroïdes d’Ovide. À la confluence de trois traditions littéraires, épique, tragique et élégiaque, le rôle des figures féminines témoigne d’un renouvellement de l’épopée, dont l’élaboration de critères d’analyse portant sur les notions de genre, de généricité et d’intergénéricité permet de donner l’entière mesure. / The character of the wife is a central feature of the epic genre, for which Homer's poems stand as a model in Greek and Latin literature. The major role the feminine eros, especially towards a husband, plays in those works is one of the aspects on which the evolution of epic genericity relies, evolving from one poem to another. During the Flavian Age, Valerius Flaccus and Statius gave two feminine characters a major part in their poems : one is Medea in The Argonautics, the other Argia in Statius' Thebaid. Besides, both poets also illustrate other aspects of husband and wife eros in the Lemnian episode, which stages Hypsipyle as its heroine. From a philosophical point of view, we can see how this emphasized presence of feminine characters matches contemporary philosophers' theories on ethics within marriage, such as Musonius Rufus' thoughts. From the point de view of literature however, considering its setting in the Age of Silver latinity, we can consider this presence as a questioning of epic generic codes, which shows in the way wives are represented, according to the patterns of tragedy and of the Roman elegy, particularly of Ovid's Heroids. Therefore in the wake of three literary traditions - epic, tragedy, elegy -, the role of feminine characters shows the renewal of the epic, which we can fully study by creating criteria of analysis bearing on the notions of genre, genericity and intergenericity.

The precondition, namely a contribution to the maintenance or increase of the estate of the other, and the interpretation of the words of the act, however, results in a curtailment of the court's discretion to order a just and equitable distribution. Contribution should play a role on the same level as all the other relevant factors. Misconduct should play a restricted role in a redistribution order. However, in certain cases it would be inequitable to ignore misconduct as a factor. The misconduct of the party against whom the redistribution is sought should not play a role. D.Litt. et Phil. / In recent research studies that have been done within the cadre of family sociology, researchers have emphasised the fact that the role of the man in the family is an important topic. This interest in the role of the husband/father has been facilitated by significant trends and changes of our time, manifesting world-wide, as well as in South Africa. These trends, such as the continuous rise in the rate of married women entering the labour market and the accompanying issues raised by changes in terms of the spouses' participation in household and childcare responsibilities, affect family life extensively. More researchers and theorists are now focussing on the shift from the man's role in the family as sole breadwinner to that of the active nurturant father within the context of a marital relationship characterised by companionship and an equal partnership between the spouses. For several decades the focus in South Africa, as in the case of other countries, fell on the increasing interface between work and family life, within the work/family spillover model, as experienced by the working married woman and how her marital and familial relationships are influenced by it. While it is clear from these research results, especially from those studies conducted in South Africa, that most men are no longer the sole or primary breadwinner in the family, it is less clear what new patterns of commitment and involvement these men are developing with regard to their family life. A related methodological shortcoming of sociological research on the husband/father role to date is that much of these research projects have relied on the wife/mother's report on her husband's attitude towards domestic responsibilities, his spousal and paternal conduct and the quality of the father-child relationship. As a result of this perspective on the changing role of the husband/father, the question arose as to what the situation in South Africa might be. The aim of this research was to shed light on the man's perception of his roles as husband and father in the dual-earner family and to what extent this perception may or may not stand in relationship to his experience of marital integration. In this quantitative research project the respondents were selected from the Gauteng area by means of purposive and snowball sampling.

Les inégalités entre époux en droit iranien de la famille / Inequalities between spouses in Iranian family law

Au moment de l’élaboration du projet de la loi de la protection de la famille en 2007, il semblait exister un consensus général parmi les politiciens, les religieux, les universitaires et les activistes des droits de la femme, sur la nécessité de réformer les dispositions légales iraniennes concernant la famille. Pourtant, en dépit des attentes, la nouvelle L.P.F. a totalement maintenu la même structure de rapport entre les époux que celle qui avait été régie par les dispositions antérieures. Ces inégalités étant fondées sur le droit imamite, ont été justifiées depuis la fin des années 1960, par la théorie de non similitude exposée par Ayatollah Motahari. Selon la théorie de non similitude, du fait de leur différence de nature, l’homme et la femme ne peuvent pas avoir le même rôle : à la femme, le rôle de reproduction de la vie au sein de l’instance familiale, à l’homme la reproduction de la richesse afin de subvenir aux besoins de la famille. A travers l’étude des inégalités dans rapports personnels et patrimoniaux des époux, l’étude montre que cette division du travail n’assure pas une vie conjugale pacifique, digne et équilibrée. L’étude montre aussi que la protection matérielle de l’épouse dure uniquement durant la vie du mari. Par ailleurs, les mesures matérielles de protection théoriquement accordées à l’épouse, sont, en pratique, très difficiles à percevoir. En outre, cette compensation matérielle n’est pas suffisante pour réparer le dommage moral subi par celle-ci / At the time of drafting the family protection bill in 2007, there seemed to be a general consensus among politicians, religious, academics and women's rights activists on the need to revise the Iranian family law legislation. However, despite the anticipations, the new family protection law, has totally maintained the same structure of relation between the spouses as that which had been enacted in previous legislations. These inequalities, based on imamite law, have been justified since the end of the 1960s by the theory of non-similarity between man and woman, set forth by ayatollah Motahari. According to the theory of non-similarity, because of their difference in nature, men and women can not have the same tasks. To woman, the role of reproduction of life within the family; to man, the reproduction of wealth in order to provide for the needs of the family. But, the fact that several pecuniary relations between the spouses were affected by the new family protection law proves that from the point of view of the Iranian legislator, the balance which was supposed to dominate the relation between the spouses was disturbed. The study of inequalities in the personal and patrimonial relations of the spouses, the study shows that this division of task does not ensure a peaceful, dignified and balanced married life. The study also proves that the material protection of the wife lasts only during the life of the husband. On another note, the materiel protection measures that are theoretically granted to the wife, are practically very difficult to perceive. Furthermore, such material compensation is not sufficient to recompense for the non-pecuniary damage suffered by her

Empirically, self-employed persons often operate with the support of their partners or other household members as co-workers in the firm. The formal or informal employment of the marriage partner in particular seems to have a lot of advantages, such as fiscal benefits and low wage costs. But from a theoretical point of view, these advantages are jeopardized by serious cooperation problems: If the spouse of the self-employed decides to work in the jointly-run business, former qualifications are lost. Hence a one-sided dependence on the part of the co-working spouse arises, which increases with the amount of relation-specific investments. Hence the actors are confronted with a cooperation problem, because the decision for co-working requires trust concerning the future action of the self-employed. Within this framework, this paper is focused on the determinants which influence the decisions concerning collaborating in the business of a self employed life’s companion as well as the extent of labor provided in the case of co-working. It can be assumed that the three types of determinants investigated in this paper affect the assignment of a spouse or cohabitation partner in the business of a self-employment person: (1) economic determinants which are individual productivity and human capital of the life’s companion, (2) the situation of the family and the household, and (3) characteristics of the entrepreneur and the firm. Based on a sample of self-employed empirical analysis indicates that trust and specialization play a crucial role in explaining co-working of the life’s companions of self-employed persons. This thesis focuses on harmonisation of work and family life of female university graduates at beginning of their careers and at the time when they were taking care of babies up to five years of age. I have chosen this topic not only because it is rather an actual topic but also because I'm personally attached to it. My feminist research analysis is based on the theory of power and knowledge as is it described by Foucault and Butler. I was interested in original families of my communication partners where they grew up and where they adopted their social habits and behaviour. In the light of this social process, I have analysed what powers they had to face in their original families in terms of usage of gender stereotypes based on patriarchal layout of our society and preferential existence of one gender over the other. I have also focused on current families of my communication partners and on power relationships on the basis of which the process of harmonisation of professional and family life of my communication partners takes place, both in their private and public space. I have also analysed how social habits and behaviour gained during their childhood are implemented. This thesis aims to investigate the differences between what collocations are used for ‘husband’ and ‘wife’ in films and contemporary culture. The comparison spans through different decades and the decades will also be compared and analysed. The thesis will investigate if the collocates reflect the societal change and if so, can the results relate to existing power structures/gender roles? The background for the thesis consists of information about marriage history, films and their influence on culture, what a collocation is and previous research on collocation. The method used for this thesis was Corpus-Assisted Discourse Studies which includes both corpus studies and discourse analysis. Consequently, a more in-depth understanding of the results and tables were given. To classify the collocates collected from the Movie Corpus (which represents movies) and the Corpus of Historical American English (representing culture) the results are presented Caldas-Coulthard and Moon’s categorisation schema. After this, in the discussion, the proportional distribution is presented because the corpora are different sizes and this way they can be compared correctly. The conclusion is that movies reflect culture somewhat, but it lacks in some areas. However, some patterns can be found. ‘Wife’ and ‘husband’ are discussed differently, and the difference in collocates shows that. Moreover, the results seem to reflect typical stereotypes that do exist and has existed.
