Encontros psi-jurídicos na Defensoria Pública do Estado de São Paulo: entre saberes, transversalidades e itinerários de formação / Psycho-legal encounters at Defensoria Pública do Estado de São Paulo: amidst-knowledges, transversalities and formative itineraries

Through intervention-research methodology strategy based upon diaries and narratives construction, it was undertaken the attendance of professionals practices at Defensoria Pública, between 2011 and 2013. From the perspective of this route, it was chosen organizational arrangements to keep up with psycho-legal encounters and mismatches at Defensoria Pública, as following: the working stream of a CAM team, in São Paulo; the triage, where the requests that come to the organizations are assessed; and the formative itineraries. At the triage the most important focus of analisis was: a) the relationship with the user when it was questioned the production of disadvantage subjectivity and it was identified, in dealing with mental health cases, the construction of a amidst-knowledge and one legal assistance that tends to comprehensive care; b) how the requests were dealt with when it is questioned the legal-non-legal-psychosocial segmentation as well the high rate of requests involving families sent to the CAM. Concerning the training itineraries, it is presented certain formative experiences (project of a group with the public defenders, interferences from the human rights and situations that surround the research) that present the power of training as a resource to evoke certain opening in the transversality coefficient and the merging of the amidst and collective practices perspective. The theoretical references of this study are: Foucault s thinking (especially in discipline concepts, power-knowledge relations and ways of subjectivation); the notion of transversality coefficient, by Félix Guattari; and French Institutional Analyses. The research undertaken open paths to question the psycho-legal field notion as a closed unity and identity, and to think in the amidst-professional and amidst-discipline interferences evoked by transversal resources forged in the working stream and in the training itineraries that suppose the permanent exercise of the amidst-positions and enable the differentiation set / Esta pesquisa analisa os encontros entreprofissionais na Defensoria Pública do Estado de São Paulo, tomando a experiência dos Centros de Atendimento Multidisciplinar (CAM), um dos lócus de atuação interdisciplinar entre psicólogos, assistentes sociais e defensores públicos na organização. Através da estratégia metodológica da pesquisa-intervenção que contou com a elaboração de diários e de narrativas, empreendeu-se o acompanhamento das práticas profissionais na Defensoria Pública, entre 2011 e 2013. A partir deste percurso, foram escolhidos arranjos organizacionais para acompanhar os encontros e desencontros psi-jurídicos na Defensoria Pública, quais sejam: o processo de trabalho de uma equipe CAM, localizada na cidade de São Paulo; a triagem, onde se ordenam os pedidos que chegam à organização; e os itinerários de formação. Na triagem privilegiou-se analisar: a) a relação com o usuário quando se problematizou a produção de subjetividade hipossuficiente e se identificou, na atenção aos casos de saúde mental, a construção de um entre saberes e de uma assistência jurídica que tenda à atenção integral; b) o modo de organização das demandas quando problematizamos as separações jurídico-não jurídico-psicossocial, bem como o elevado número de questões envolvendo famílias direcionadas ao CAM. Em relação aos itinerários de formação, apresentamos certas experiências formativas (projeto de grupo com defensores públicos, interferências dos direitos humanos e situações que permearam a pesquisa) que mostram a potência da formação enquanto dispositivo, ao suscitar certa abertura do coeficiente de transversalidade e a emergência das dimensões entre e coletiva das práticas. Os operadores conceituais do estudo se apoiam no pensamento foucaultiano (especialmente nos conceitos de disciplina, relações de saber-poder e modos de subjetivação), na noção de coeficiente de transversalidade, de Félix Guattari, e na Análise Institucional Francesa. A pesquisa empreendida abre caminhos para problematizar a noção de campo psi-jurídico, como uma unidade fechada e identitária, e para pensar nas interferências entreprofissionais e entredisciplinas provocadas pelos dispositivos transversais forjados no processo de trabalho e nos itinerários de formação que supõem o permanente exercício do entre posições e possibilitam o jogo da diferenciação

Assistência-assessoria jurídica universitária e direitos da mulher : (trans)formações possíveis

Este estudo analisa a formação profissional na assistência e assessoria jurídica universitária que trabalha com direitos da mulher. A análise do estudo toma a experiência forjada pelo Grupo 8 - Generalizando (G8G) do Serviço de Assessoria Jurídica Universitária da Faculdade de Direito da Universidade Federal do Rio Grande do Sul (UFRGS) para problematizar a formação profissional nesse contexto. A formação profissional é tomada como referência por ampliar e abarcar a formação acadêmica, uma vez que o grupo é composto por estudantes de Direito e de Psicologia, advogados, advogadas e psicólogas que trabalham voluntariamente no Serviço. A proposta metodológica utilizada nessa pesquisa contemplou as ferramentas da pesquisa-intervenção e a experimentação fotográfica, baseada nas estratégias da intervenção fotográfica. A fotografia colocou-se no processo de pesquisa, inserida em um longo acompanhamento junto ao grupo, e mostrou-se como disparadora do dispositivo da visibilidade, potencializando que os sujeitos da pesquisa falassem sobre suas experiências através de outra linguagem que não a jurídica. O momento das oficinas de fotografia com a produção de fotografias pelos sujeitos da pesquisa configurou-se em um espaço no qual questões referentes à formação profissional, enquanto experiência de si e trabalho de si sobre si mesmo, puderam ser explicitadas e, sobretudo, compartilhadas. Os efeitos desse estudo apontam para a elaboração de um trabalho ético, produzido por uma experiência de dobrar-se sobre si para produzir-se sujeito de sua própria conduta. Estas transformações tornaram-se possíveis na medida em que, ao trabalharem com direitos da mulher e com gênero, aqueles e aquelas que fazem parte do G8G foram convocados e convocadas a produzirem outros modos de fazer Direito, através das composições de assistência e assessoria e Direito e Psicologia, tensionando as noções de público-privado. As transformações possíveis passam pela construção do “afetar-se” como elemento da formação jurídica, tensionando as noções de neutralidade e de imparcialidade sustentadas pelo discurso jurídico. Dessa forma, este estudo possibilitou “dar a ver” outra formação jurídica que se forja com outros modos de fazer Direito e de fazer Psicologia no contexto da assistência e da assessoria jurídica universitária em direitos da mulher. / This study analyses the professional training in legal university assistance and advice that works with women rights. A social work training programme for caregivers of infants in San Bernardino County, California

This research concentrates on the developing, implementing, and evaluating of a practical training program for the caregiver of an infant in order to provide in the infant’s primary needs and development. The research problem of quality care for the infant during the time that his mother is working was identified and discussed in chapter 1. Intervention research was used as research methodology. This methodology implies a combined quantitative and qualitative approach. The first part of this research (chapters 2&3) addresses the problem analysis and information gathering linked to the development of a theoretical basis for the intervention model. Infancy as developmental stage is discussed as well as the developmental tasks that the infant must achieve during this phase in order to grow and develop as a self-actualized individual (chapter 2). It is essential for the caregiver to gain knowledge and skills about infancy, the needs and the developmental tasks of this phase. The tasks, roles, and responsibilities of the caregiver were discussed in chapter 3. The second part of this research (chapter 4) is related to the design of the intervention program, the conducting of a pilot test and the refining of the intervention. This in-home care program is theoretically funded, and it is divided practically into the five workdays of the week, in accordance with the five developmental tasks that the infant must achieve in this developmental phase. Ten caregivers willingly participated in this intervention program. In chapter 5, the empirical findings with the development and implementation of the training program for in-home care of an infant are discussed. From the information gathered during the focus groups with the mothers of infants and caregivers as well as the results from the questionnaires from pre-tests and post-tests, the researcher came to the conclusion that the research problem of quality caretaking of an infant for the time his mother is working is addressed. Through internalizing theoretical knowledge and practical skills during the training program, the caregivers are able to care optimally for an infant at home. They are equipped with play techniques and mediums which are adapted within the gestalt approach and supported by relevant aids. The caregiver is able to stimulate the infant’s developmental needs and tasks in this developmental phase. A Training programme for intermediaries for the child witness in South African Courts

This study concentrates on the development, implementation and evaluation of a research based training program for intermediaries in South African courts in order to improve the intermediary’s knowledge and understanding of the role and duties of an intermediary. The motivation for this study had its origin in the fact that the adversarial nature of court proceedings is a major stumbling block for the child witness. The research problem, namely that there is no national research based training program for intermediaries in South Africa, was discussed. Intervention research was used as research methodology and a two phase research approach was undertaken. A quantitative survey research design was used during the phases. The research question formulated for the first phase was: What are the duties and role of an intermediary? 54 magistrates and 34 prosecutors who attended four workshops, completed a self-structured questionnaire. This data complemented the literature study and both were used to compile a training program for intermediaries. The quantitative approach was also used for phase two of the study. A quasi-experimental one-group pretest-posttest design was used. An assessment by means of a questionnaire was done before the training program started and was repeated again after the presentation of the training program to determine the effectiveness of the program The research hypotheses that was formulated was: If an intermediary is trained according to a research-based training program, the intermediary’s knowledge of her role in assisting the child before and during the trial in a South African court will be improved. A five-day training program was implemented. The hypothesis was confirmed after the data had been analyzed and compared to the literature. In chapter two the legal system of South Africa, in respect to the child, was discussed and in chapters three, four and five all aspects of child development were discussed with specific emphasis on the child witness that needs to testify in a separate courtroom. Cognitive development and language development in the context of the child witness were discussed. This information was used to develop a training program. In chapter six the development of a training program was discussed with specific attention being given to outcomes based education. In chapter seven all the data that was collected was quantified, analyzed and interpreted. The conclusion could be drawn that the respondents did show improvement of their skills and knowledge of an intermediary, his/her duties and theoretical knowledge. They also showed that their practical skills had improved by attending the training program. The conclusion could therefore be made that the intermediary training program was successfully implemented and complied with the requirements of an outcomes based training program. The findings obtained indicate that trainers of intermediaries throughout South Africa can successfully apply the developed training program. Cette thèse s'intéresse à la diffusion des systèmes de contrôle de gestion, définis comme un ensemble d'indicateurs de performance, de mécanismes incitatifs et de dispositifs de contrôle, dans le secteur de l'eau urbaine. Le sujet nous a paru digne d'intérêt du fait des forts enjeux économiques, sociaux et environnementaux du secteur. Une recherche-intervention menée auprès de l'opérateur public d'eau urbaine ougandais a constitué notre principal terrain, analysé à travers le prisme de la sociologie néo-institutionnelle, dans une démarche abductive et interprétative. En mobilisant le concept de logique institutionnelle, l'institutionnalisation de contrats de performance a été interprétée comme liée à la domination de la logique de marché. Nous avons mis en évidence le rôle du contexte socio-politique et des prescriptions des bailleurs de fond dans ce changement institutionnel. Les systèmes de contrôle de gestion apparaissent comme des vecteurs structurant la matérialisation de la logique de marché, en structures, rôles et pratiques organisationnels. Une fois encastrés, ils contraignent l'innovation institutionnelle. Des acteurs du champ organisationnel s'en sont saisis pour conduire un travail institutionnel visant à légitimer leur existence, gagner de l'influence et maintenir l'ordre social. A l'issue de cette recherche, nous proposons d'élargir le modèle de changement institutionnel de Greenwood et al. (2002) par une analyse multi-niveau (société, champ et organisation) et l'intégration d'un nouvel objet : « l'outil de gestion » (Hatchuel et Weil, 1992). Sur le plan empirique, ce nouveau cadre invite à déconstruire les notions de public, privé, performance et service public, afin d'éviter les ambigüités qui limitent la portée des travaux menés sur le secteur de l'eau urbaine. Enfin, cette thèse constitue une mise en garde contre une focalisation sur la performance qui peut détourner des enjeux essentiels et spécifiques du secteur. / This PhD thesis focuses on the diffusion of management accounting systems in the urban water sector. These are defined as a set of performance indicators, performance incentive mechanisms, and control practices. This topic is of particular interest considering the strong economic, social and environmental challenges of this sector. Intervention research carried out within the Ugandan urban water utility was our main focus. We analysed the case through the neo-institutional sociology lense in an abductive and interpretative approach. Using the concept of institutional logic, we interpreted the institutionalisation of performance contracts as associated with the domination of a market logic. We highlighted the key role of funding agencies’ recommendations and the socio-political context in this institutional change. The management accounting systems appear as vehicles structuring the materialisation of the market logic into organisational structures, roles, and practices. Once embedded, they constrain institutional innovation processes. Actors from the organisational field have used them to carry out an institutional work, aiming at legitimating their existence, gaining influence and sustaining social order. As the outcome of this research, we propose to expand upon the institutional change model of Greenwood et al. (2002). To do so, we suggested including a multi-level analysis (society, organisational field and organisation) and a new concept: “management tool” (Hatchuel and Weil, 1992). Empirically, this new framework challenges the notions of public, private, performance, and public service to prevent misconceptions limiting the significance of further research on the urban water sector. Finally, this PhD thesis warns against a focus on performance, which may divert from the essential and specific challenges of this sector.

The development of a protocol for the management of child abuse and neglect

Philosophiae Doctor - PhD / The primary intent of this study was to seek solutions to the practical problems experienced by practitioners in their management of child abuse cases. A fundamental problem regarding the current management of child abuse is that there is no guarantee that a child entering the child protective system will be dealt with in terms of a set procedure and/or protected against further abuse. To address this problem in the Western Cape, the Intervention Research (IR) methodology (Rothman & Thomas, 1994) was used to develop a Protocol for the Multi- Disciplinary Management of Child Abuse and Neglect. The protocol was designed for agencies that intervene in instances of child abuse. It establishes criteria and procedures for interdisciplinary co-ordination and effective case management, delineates the professional roles and responsibilities and provides step-by-step intervention procedures. The Intervention Research Design and Development methodology provided a useful framework to apply social science research methods to child protective practice and policy reform. IR focuses on the design of practice guidelines for intervention and policy reform. It can be conducted in a diversity of practice settings and therefore enhances collaborative efforts and inter-agency exchange among practitioners and among practitioners and universities. The study evolved through six phases involving inter-as well as intra-disciplinary activities. These activities were guided by systematic and deliberate research procedures, techniques and instruments. The research phases included: problem analysis; information gathering and synthesis; the development and design of the protocol; testing the protocol through a process of workshops and finally, the launch and dissemination of the protocol. A core element of the study was the active participation and collaboration of a broad range of key stakeholders, including: victims of child abuse, their families, service providers, and policy makers. The methods and instruments used were therefore designed to enhance participation and included interviews, workshops and observation of court processes. The bottom-up approach and collaborative design enhanced the level of contextual relevance, ownership and the commitment of stakeholders. As a demonstration of this commitment, the protocol has been endorsed by the Ministry of Justice and the Ministry of Health and Social Services of the Western Cape. The Department of Social Services has committed financial support to the project and is pilot testing it in three districts. The study cautions that protocols alone cannot eradicate and solve all the problems in the child protective field and asserts that there is an urgent and critical need to develop and to implement a National Strategy on Child Abuse. Such a National strategy should include legislation that supports and enforces all aspects of a national policy on child abuse. At minimum, national policy should ensure consistent political will and leadership. This means that broad statements about the obligations of politicians and state officials is not enough. These should be followed by specific accountability and measuring mechanisms for enforcement. State policy should also provide guidelines for standardized and appropriate working conditions, recruitment and training of staff. Furthermore, it should provide for a broad array of effective and accessible services to all children and families and the co-ordination of such services. Finally, legislation should include specific obligations regarding the appropriation of adequate and flexible funding to see that commitments made to children are realised.

Short-term structured play therapy with the latency-aged child of divorce

The purpose of this study was to develop and test the efficacy of a short-term structured play therapy treatment program for latency-aged children of divorce between six and twelve years of age. Following parental divorce latency-aged children often manifest disturbed emotional and behavioural functioning in several areas of their lives including issues such as self-image problems and poor academic functioning. In many instances, problems are acute and necessitate effective help in a relatively short time. Several play therapy modalities exist for children with some focusing on problems stemming from divorce. However, due to their complex, unstructured and lengthy nature, most of the treatment programs reviewed were relatively ineffective for most social workers. Increasingly families have little time and/or limited financial resources to commit to long-term therapy. A literature review showed a clear need for a shorter, less complex treatment program to solve the problem of limited finances and time constraints of parents seeking help for their children. A seven-stage, short-term structured play therapy program was developed for this study, including a pre-and post-treatment assessment, which focused on the main areas of dysfunction prominent among latency-aged children of divorce. The program was implemented by treating a female latency-aged child from a divorced family. The findings showed that the short-term structured play therapy program developed for this study appears to be effective in dealing with necessary and important psychological tasks facing children of divorce. The treatment program worked effectively with a female latency-aged child and facilitated psychological and emotional movement in a relatively short period of time. For social workers specialising in child play therapy the treatment program will be easy to use since all activities are clearly structured and explained with materials utilised in the sessions easy to obtain.
