Moradia adequada e dignidade humana na experiência espacial / Adequate housing and human dignity in space experience

A gênese, evolução e conteúdo das noções \"moradia adequada\" e \"moradia digna\" foi investigado nas resoluções e relatórios da Organização das Nações Unidas (ONU); nos indicadores de habitação e nas Constituições dos países da América Latina; na produção acadêmica compilada em grandes repositórios; nas Sentencias de Tutela da Corte Constitucional da Colômbia. Agentes da política urbana que utilizam indistintamente essas noções, e embora sejam expressões equivalentes, seu abarcamento conceitual se difere. O objetivo desta pesquisa depara por elementos socioespaciais que configurassem a dimensão da dignidade na moradia, e que consideramos que vai mais além do padrão de moradia adequada; tomando o contexto colombiano por referência. Construir a abordagem histórica e institucional do conceito de \"moradia adequada\", determinar fatores socioespaciais que poderiam lesar a integridade do morador que habita em espaços inadequados, e discorrer sobre os elementos diferenciadores, relacionados à moradia adequada e à moradia digna, são os objetivos específicos. Vários âmbitos e agentes foram investigados: a ONU que dita diretrizes mandatórias sobre assentamentos humanos para os países-integrantes, e instaura o indicador \"direito à moradia adequada\", com o Pacto Internacional de Direitos Econômicos, Sociais e Culturais (PIDESC) de 1991. Os institutos estatísticos de 21 países da América Latina, que alojam metodologia e dados sobre indicadores de habitação, e consideram que o conteúdo da moradia adequada corresponde às variáveis que cada país aplica, mais as do indicador do Pidesc. Essas variáveis de habitação também são conteúdo material do direito à moradia, adjetivada como adequada, digna ou decente, nas constituições vigentes destas nações. A produção acadêmica que afirma que o conteúdo do direito à moradia adequada é a constituída no Pidesc de 1991, e que o problema da habitação deve ser debatido num marco de direitos. A prática jurídica e o entendimento do cidadão sobre o direito à moradia digna observam-se no âmbito social quando o morador interpõe demandas perante um juiz em sentencias de tutela da Corte Constitucional da Colômbia, na forma de fatos que violam o direito à moradia digna e, em certas ocasiões, a dignidade. Pelo que investigamos, nas sentencias, pela relação da dignidade com o espaço, na interação entre os indivíduos, e quando se está em busca de acesso a habitação; para encontrar três objetos de proteção da dignidade instaurados nas sentencias de tutela. Assim, descobrimos elementos socioespaciais recorrentes em uma sentencia quando se debate sobre a violação ao direito à moradia, com os quais poderíamos indagar pela proteção à integridade do homem no espaço, quando se está na busca de recursos espaciais como a moradia: morador vulnerado (demandante); agente vulnerador (demandado); objeto espacial em litígio; pretensão do demandante sobre esse objeto; conduta do vulnerador e elementos nos quais esse escuda a sua conduta; consequências da violação ao direito, observadas como dano à pessoa e dano ao patrimônio; a percepção a respeito das lesões pela violação ao direito à habitação. Esses elementos socioespaciais configuram fatores de observação da dimensão da dignidade na moradia, que - como proposta da tese - nomeamos como a dignidade na experiência espacial. / The genesis, evolution and content of the notions of \"adequate housing\" and \"decent housing\" were researched from ONU\'s resolutions and reports; from housing indicators and constitutions of Latin American countries; from academic production compiled in great repositories, from constitutional court writ judgments for protection of constitutional rights of Colombia. Areas of urban policy that use indistinctively these notions, and even though being equivalent, their conceptual limitation differs. The objective of this research discovers socio- spatial elements that shape the dimension of dignity in housing and that we consider goes beyond the standard of adequate housing; taking the Colombian context as reference. The specific objectives are to build the historical and institutional approach of the concept of \"adequate housing\", to determine socio-spatial factors that could undermine the inhabitant\'s dignity that dwells in inadequate spaces and to expatiate in differentiator elements related to the adequate housing and the decent housing. Several areas were explored: United Nations that dictates mandatory regulations concerning human settlements for country members establishes the indicator \"right to an adequate housing\" with the International Covenant on Economic, Social and Cultural Rights (ICESCR) of 1991. The statistics institutes of 21 countries in Latin America, which hold methodology and data concerning housing indicators, and consider that the content of adequate housing, correspond to the variables that each country applies, plus the elements of the indicator \"adequate housing\" of ICESCR. These habitation variables are also material content of the right to housing, adjectivized as adequate, dignified or decent, in the current constitutions of these nations. The academic production stating that housing must be adequate according to indicators and discussed in a rights framework. The citizen\'s legal practice and understanding of the right to a decent housing is present in the social area with the inhabitant that files a suit before a judge, in Constitutional Court judgments of Colombia, in the form of facts that violate the right to housing, and on certain occasions, dignity. For this reason, we explore judgments due to the relationship between dignity and space, in the interaction between individuals when the access to housing is being pursued; to find three objects of dignity protection introduced in the writ judgments. That is how we discover recurring socio-spatial elements in a writ judgment when the violation of the right to housing is being debated, with which we could inquiry for the protection to the integrity of people in the space, when they are looking for space resources like habitation: undermined inhabitant (claimant); undermining agent (defendant); space object disputed; claimant\'s claim over that object; undermining agent\'s conduct and elements on which he shields his conduct; consequences of violating that right, observed as harm to the person and harm to the heritage; the perception about the injury by violation of the right to housing. These socio-spatial elements shape the factors to observe the dimension of dignity in housing, which, as proposal of this thesis, we denominated as dignity in space experience.

Výkon a rozhodnutí ve věcech rodinněprávních / Enforcement of judgments in family cases

The issue of the enforcement of judgments in family cases is a topical issue in our society, since the various changes this legal area has recently experienced. The main change in the procedural field was the separation of so-called undisputed proceedings into a new Act on Special court proceedings, while the Civil Procedure Code remained a subsidiary act. This new Act also contains the sole regulation of the enforcement proceeding in cases relating to domestic violence and in cases of child custody, since these two areas are the most distinct from the enforcement of other pecuniary and non-pecuniary performance. In the first two chapters, the thesis focuses on the background of the enforcement proceedings as well as on its development, principles and functions. The second chapter ends with the outline of the enforcement in the Act on Special court proceedings. The third chapter deals with the enforcement of judgements in domestic violence cases, focusing particularly on the Police Eviction Instrument and the Special Preliminary ruling on the Protection against Domestic Violence. Their subsequent enforcement is then evaluated and analyzed. Puisqu’il est désormais avéré que les différents arguments avancés par les parlements de la monarchie à l’époque moderne afin de légitimer leur prétention à vérifier librement les édits royaux avaient des racines médiévales, il n’était pas injustifié de rechercher si leur propension à élever leurs arrêts de règlement au rang de véritables lois n’était pas, elle aussi, déjà en germe au Moyen Âge tardif. Une enquête dans les archives du parlement de Paris contemporaines du règne de Charles VI (1380-1422) et de la double monarchie franco-anglaise (1422-1436) permet de confirmer cette hypothèse. Il en ressort en effet qu’au tournant des XIVe et XVe siècles, dans le milieu parlementaire parisien, on considérait non seulement que par sa jurisprudence la « cour souveraine et capitale du royaume » dégageait des règles qui faisaient lois, mais en outre que les arrêts de règlement qu’elle édictait, ou du moins certains d’entre eux, étaient des actes normatifs souverains, voire constituaient de véritables ordonnances royales. Cette faculté reconnue à la cour suprême d’être un véritable co-législateur était au demeurant logique et naturelle, si l’on prend la peine de la replacer dans le contexte à la fois institutionnel, politique et idéologique du temps. / Since it is now recognized that the various arguments put forward by the parliaments of the monarchy in modern age in order to legitimize their claim to freely check the royal edicts had medieval roots, it was not unjustified to inquire whether their inclination to raise their regulation judgments to the rank of actual laws was not, similarly, already raising in the Late Middle Ages. An investigation of the archives of the Parliament of Paris contemporaneous with the reign of Charles VI (1380-1422) and with the double Franco-English monarchy (1422-1436) confirms this hypothesis. The investigation indeed shows that, at the turn of the 14th and 15th centuries, in the Parisian parliamentary environment, it was considered not only that, by its jurisprudence, the “sovereign and capital court of the kingdom” emanated regulations which made laws, but also that the regulation judgments it enacted, or at least some of them, were sovereign normative acts, or even constituted genuine royal rulings. This acknowledged ability of the Supreme Court to be a genuine co-legislator was, as it happens, logical and natural, if one takes the trouble to place it in the institutional, political, and ideological context of the period.

Judgments of Social Dimensions of Faces in Individuals with High-Functioning Autism

The aim of the present study was to investigate if individuals with high-functioning autism differ from typically developing (TD) individuals in judgments of social dimensions from faces. Thirty-two individuals with high functioning autism and sixty-seven TD individuals rated 196 synthetic faces representing 7 social dimensions. Overall, both groups performed similarly on the judgment tasks. However, some group differences emerged for ratings of Competence and Likeability in the Autism Spectrum Disorder (ASD) group. Furthermore, alexithymia, or emotion-blindness, was found to be a possible indicator of ability to judge social dimensions in the ASD group. Implications of present results in relation to prior and future research on social interaction on the autism spectrum are discussed.

The harmonisation of rules on the recognition and enforcement of foreign judgments in the southern African customs union

Doctor Legum - LLD / The Member States of the Southern African Customs Union (SACU) have set as their objectives, amongst others, the facilitation of cross-border movement of goods between the territories of the Member States and the promotion of the integration of Member States into the global economy through enhanced trade and investment. Different approaches to the recognition and enforcement of foreign judgments by Member States and the risk of non-enforcement may lead to legal uncertainty and increased transaction cost for prospective traders, which ultimately act as non-tariff barriers to trade in the region. Trade is critical to Southern Africa, and the ideal is that barriers to trade, of which uncertainty concerning the recognition and enforcement of foreign judgments among Member States is one, should be removed. Certainty, predictability, security of transactions, effective remedies and cost are important considerations in investment decision-making; and clear rules for allocating international jurisdiction and providing definite and expedited means of enforcing foreign judgments will facilitate intraregional as well as interregional trade. In addition to trade facilitation, a harmonised recognition and enforcement regime will consolidate economic and political integration in the SACU. An effective scheme for the mutual recognition and enforcement of civil judgments has been regarded as a feature of any economic integration initiative likely to achieve significant integration. While the harmonisation of the rules on the recognition and enforcement of foreign judgments has been given priority in other regional economic communities, in particularly the European Union, any similar effort to harmonise the rules on recognition and enforcement of Member States have been conspicuously absent in the SACU – a situation which needs to receive immediate attention. The thesis considers the approaches followed by the European Union with the Brussels Regime, the federal system of the United States of America under the ‘full faith and credit clause’; the inter-state recognition scheme under the Australia and New Zealand Trans-Tasman judicial system; as well as the convention-approach of the Latin American States. It finds that the most suitable approach for the SACU is the negotiation and adoption by all SACU Member States of a multilateral convention on the recognition and enforcement of foreign judgments, comparable to the 1971 Convention of the Hague Conference on Private International Law; the EU Brussels I Regulation and the Latin-American Montevideo Convention, as complemented by the La Paz Convention. It is imperative that a proposed convention should not merely duplicate previous efforts, but should be drafted in the light of the legal, political and socio-economic characteristics of the SACU Member States. The current legislative provisions in force in SACU Member States are compared and analysed, and the comparison and analysis form the basis of a proposal for a future instrument on recognition and enforcement of foreign judgments for the region. A recommended draft text for a proposed Convention on the Recognition and Enforcement of Foreign Judgments for the SACU is included. This draft text could form the basis for future negotiations by SACU Member States. / South Africa

La présente thèse explore l’espace formel de l’enseignement de la musique en Grèce actuelle en tant qu’un espace de confrontation et de négociation de sens autour du musical. L’introduction de la musique traditionnelle au sein de cet espace sert de paradigme à une étude sur « la gestion de l’altérité musicale » à partir d’une enquête ethnographique de terrain (observation participante et entretiens non directifs), qui s’intéresse plus particulièrement aux conditions de cohabitation entre des enseignants-musiciens aux parcours différents, aux conditions donc de cohabitation entre des pratiques d’apprentissage, des discours et des imaginaires qui tantôt s’entrecroisent, tantôt se concurrencent. L’objectif ultime de ce travail est, à cet égard, de mettre en évidence que les façons dont les individus se représentent la musique et tout ce qui s’y rattache, forment un système symbolique qui renvoie à la manière dont ils se définissent eux-mêmes et ils se situent envers les autres. / The present thesis explores the formal space of music education in Greece as an area of confrontation and negotiation of meanings around music. The introduction of Greek traditional music in this educational space serves as a paradigm for a study on “the management of musical otherness”, based on a field survey (participant observation and non-directive interviews) which focuses in particular on the conditions of cohabitation between teachers-musicians with different musical trajectories, thus on the conditions of cohabitation between learning practices, discourses and imaginaries which sometimes intertwine, sometimes they compete with one another. In this regard, the ultimate aim of this work is to bring to light that the ways individuals represent music and everything related to it, form a symbolic system referring to the manner in which they define and situate themselves in relation to others.

The recognition and enforcement of European civil and commercial judgements in South Africa

(International Commercial Law) / Legal judgements against unsuccessful defendants are handed down around the world on a daily basis, but their enforcement can become a complicated matter when the enforcement of the judgement must occur outside the territorial boundaries of the state from which it emanates. The purpose of this paper is to determine the enforceability of judgements of the European courts whereby the jurisdiction of the court was determined in terms of Brussels I. This paper begins with an in-depth discussion of the principles of recognition and enforcement of foreign judgements and the purpose it serves within the context of private international law. The second chapter discusses recognition and enforcement of foreign judgements in South Africa. The requirements and the criteria necessary to fulfil such requirements will be discussed under this heading. The third chapter considers the various grounds of jurisdiction available to the plaintiff in approaching a court of a European Union State. Each ground will be followed by a discussion on the enforceability of a judgement, founded on such a ground of jurisdiction, in terms of the South African principles of recognition and enforcements of foreign judgements and whether the requirements discussed in the preceding chapter have been met. Chapter 4 provides concluding remarks relating to the matters discussed in the body of this paper.

It is assumed that behind apparent impartiality/neutrality, the judge leaves clues of ideological positions on the surface of the decision that can sustain or prevent relations of domination guided by a practice of educational segregation/exclusion of persons with disabilities. The relevance of this study comes from the need to contribute to overcoming paradigms of exclusion and segregation, which from hegemonic conceptions, inferiorize and stigmatize people with disabilities, preventing their access to the common classes of the regular education system. The research methodology falis within the domain of Criticai Discourse Analysis - CDA, developed by Fairclough. However, the language and law interface imposes a directed look at the modes of operation of ideology in the perspective of decolonial studies, considering the objective of this research. It is noted that the lack of success of ADI 5357 is marked by ruptures of colonial thought, notably by the presence of signs of decoloniality in the reasoning of the Rapporteur's vote, while the defeated vote is marked by a colonial discourse. / A presente pesquisa tem como objetivo identificar os indícios de colonialidade/descolonialidade nos fundamentos do voto do Relator e do voto vencido na ADI 5357 no que concerne ao direito à educação inclusiva. Parte-se do pressuposto de que por trás de uma aparente imparcialidade/neutralidade, o julgador deixa pistas de posições ideológicas na superfície da decisão proferida que podem sustentar ou impedir relações de dominação orientadas por uma prática de segregação/exclusão educacional de pessoas com deficiência. A relevância desse estudo advém da necessidade de contribuir para a superação de paradigmas de exclusão e segregação, que a partir de concepções hegemónicas, inferiorizam e estigmatizam as pessoas com deficiência, impedindo o seu acesso às classes comuns da rede regular de ensino. A metodologia de pesquisa inscreve-se no domínio da Análise Crítica do Discurso - ACD, desenvolvida por Fairclough. Entretanto, a interface linguagem e direito impõe um olhar voltado para os modos de operação da ideologia na perspectiva dos estudos descoloniais, considerando o objetivo desta pesquisa. Constata-se que a falta de êxito da ADI 5357, está marcada por rupturas do pensamento colonial, notadamente pela presença de indícios de descolonialidade na fundamentação do voto do Relator, enquanto que o voto vencido está marcado por um discurso colonial.

Genom nålsögat : En studie av rättssäkerhet i överklaganden av beslut om ekonomiskt bistånd till förvaltningsdomstolarna / Through the eye of a needle : A study of legal certainty in appeals to the Administrative courts concerning decisions about social assistance

Syftet med denna studie har varit att granska rättssäkerheten i tillämpningen av mål om ekonomiskt bistånd enligt 4 kap. 1 § Socialtjänstlagen i förvaltningsdomstolarna, med fokus på Förvaltningsrätten i Stockholm. Studien visar att överklagandefrekvensen har ökat under åren 2013–2018 i alla förvaltningsrätter och att ändringsfrekvensen var 11 procent. Väldigt få mål fick prövningstillstånd i kammarrätterna och i Högsta förvaltningsdomstolen och under en procent av målen fick bifall.Till Förvaltningsrätten i Stockholm överklagades drygt två procent av socialtjänstens avslagsbeslut om ekonomiskt bistånd, vilket kan jämföras med andelen överklaganden av socialförsäkringsmål som var 43 procent. Av besluten som överklagades fick tre procent av de klagande bifall. En närmare granskning av 100 domar från Förvaltningsrätten i Stockholm år 2018 visade att störst chans att få bifall har de mål som handlar om vad som är ett behov enligt Socialtjänstlagen. De mål som rör att den klagande själv anses kunna tillgodose behovet eller inte anses medverka i utredningen hade minst chans att få bifall. Förekomst av bevis samvarierade med bifall för båda parter. Vilka de klagande är eller om barn finns i hushållet påverkade inte utfallet och barns behov belystes inte alls. Vilken enhet och domare hos Förvaltningsrätten som dömt i målet samvarierade också med utfallet.Analysen utifrån rättssäkerhet visar att den ur ett formellt perspektiv är hög. De flesta fick avslag och besluten var därmed förutsebara. Rättssäkerheten minskade dock genom utfallets samvariation med vilken enhet och domare som dömt. Ur ett materiellt perspektiv på rättssäkerhet innebar 71 procent av avslagen att den enskilde inte tillförsäkrades en skälig levnadsnivå. Krav ställdes på den klagande som gjorde att bedömningen kom att handla om vad den klagande kunde ha gjort för att tillgodose behovet själv, inte huruvida denne faktiskt kunde det. Detta tillsammans med att högre beviskrav eventuellt ställdes i dessa mål gör att rättssäkerheten ur ett materiellt perspektiv kan ifrågasättas.
