We are facing the problems of climate change, the unfair share and over use of Earth’s resources. Global North overuses, Sweden has an ecological footprint of four planets. The challenge is to change our lifestyles. This thesis is trying out a method to diffuse ideas of sustainable development (SD) and for citizen participation. I created a future vision of a sustainable neighborhood inspired by Jane Jacobs and the concept of densification. This I presented to three homogenous focus groups: the next-door neighborhood, home owners and people in rentals. Free discussion then followed, and then a questionnaire. The findings where that the participants, fifteen of sixteen, thought the method gave them new ideas, allowed them to share their knowledge, and that it was a good method for participation. I thought that it was a ‘fun’ method. Focus groups research works more the way people normally interact, as did the literature show. I could see the learning process, that Patsy Healey describes, the creation of cultures, and also how the issue of SD was explored. It was time consuming to recruit participants. The tendency was that volunteers liked to talk, had an interest in planning, although not all in favor of SD. Many resembled me, in age and cultural background. The method could be useful to deepen dialog with citizens, especially in an early stage of planning. The vision should be ‘daring’ to spur good discussions, that may land in a compromise on SD. / Vi står inför klimatförändringar, den ojämna fördelningen och överanvändningen av jordens resurser. Nord överanvänder, Sverige har ett ekologiskt fotavtryck på fyra planeter. Utmaningen är att ändra vår livsstil. Denna uppsats prövar en metod för att sprida idéer om hållbar utveckling och för medborgardeltagande. Jag skapade en vision för ett hållbart grannskap inspirerad av Jane Jacobs och begreppet förtätning. Denna presenterade jag för tre homogena fokusgrupper: de i närmsta grannskapet, de som ägde sitt boende och de som hyrde. Sedan följde fri diskussion och sedan en enkät. Resultatet blev att deltagarna, femton av sexton, tyckte att metoden gav dem nya idéer, tillät dem att dela sina kunskaper och att det var en bra metod för deltagande. Jag tyckte att det var en ’rolig’ metod. Forskning med fokusgruppers fungerar mer som man vanligen umgås, vilket även litteraturen visade. Jag kunde se lärandeprocessen, som Patsy Healey beskriver, skapandet av kulturer och också hur begreppet hållbar utveckling undersöktes. Det var tidskrävande att rekrytera deltagare. Tendensen var att de frivilliga gillade att prata, var intresserade av planering, men inte alla positiva till hållbar utveckling. Många påminde om mig, i ålder och kulturell bakgrund. Metoden kan vara användbar till att fördjupa dialogen med medborgare, speciellt i ett tidigt stadie av planering. Visionen ska vara ’vågad’ för att sätta igång bra diskussioner och landa i en kompromiss i hållbar utveckling.

L'intérêt général dans le système de la Convention européenne des droits de l'Homme / The general interest in the system of the European Convention on Human rights

Le phénomène de désétatisation de l’utilisation de la notion d’intérêt général conduit à s’intéresser au rôle que cette notion joue dans le cadre du système de la Convention. Dans le contexte de la Convention européenne des droits de l’Homme, l’intérêt général ne se manifeste pas seulement comme un concept consubstantiellement lié à l’État. En effet, la nature indéterminée, flexible et fonctionnelle de l’intérêt général permet l’utilisation de cette notion par les divers acteurs du système conventionnel et facilite, par conséquent, son intégration dans ce même système. Face à une diversité des utilisateurs de la notion d’intérêt général, l’utilisation effectuée par la Cour européenne des droits de l’Homme se démarque en particulier en raison de son pouvoir d’interprète authentique. Cela permet de s’interroger sur l’existence d’une conception de l’intérêt général propre au système de la Convention ainsi que sur les fonctions que l’intérêt général occupe dans le cadre de ce système. / The phenomenon of destatization of the use of the notion of general interest raises questions with regard to the role that this concept plays in the system of the European Convention on Human Rights. In the context of the European Convention, the general interest does not manifest itself as a concept consubstantially linked to the State. Indeed, the indeterminate, flexible and functional nature of the general interest allows the use of this concept by various actors of the system of the European Convention and facilitates its integration into this system. Faced with the diversity of users of the concept of general interest, the use by the European Court of Human Rights stands out in particular because of its power of authentic interpretation. This makes it possible to question the existence of a conception of the general interest specific to the system of the Convention and to research the functions of general interest in this context.

La gestion collective des droits des auteurs : ses formes imposées par la loi hongroise et française / Collective rights management ordered by law in Hungarian and French copyright law

Le mécanisme complexe qu’est la gestion collective a pour objectif de permettre l’exploitation licite des œuvres en y associant les auteurs. Elle peut ainsi être vue comme une forte contrepartie lors de la négociation des licences octroyées aux utilisateurs (avant tout professionnels), ainsi qu’un outil de suivi des utilisations grâce à la collecte et à la distribution des droits. Paradoxalement, la gestion collective constitue également une limitation, au sens large du terme, au monopole de l’auteur. Cette seconde caractéristique est d’ailleurs beaucoup plus marquée lorsque la gestion collective résulte de dispositions législatives.Notre thèse consiste donc en une réflexion sur l’ambiguïté de la gestion collective, laquelle se révèle particulièrement problématique dans les cas où la gestion collective est exigée par la loi. Cette technique de gestion est avant tout une limitation imposée au monopole de l’auteur en vue notamment de concilier ses intérêts avec ceux du public. Il y a lieu de mentionner cependant que l’introduction de la gestion collective par le législateur peut parfois s’avérer être le seul moyen d’exploitation des œuvres. Dans ce cas, la soumettre au régime propre des limitations aboutiraient à un résultat contraire à l’objectif visé.L’intérêt de ce sujet, et de cet angle de recherche particulier, tient également au fait que le législateur envisage la gestion collective comme une réponse à certaines questions du droit d’auteur contemporain, telles que l’utilisation des œuvres orphelines ou la numérisation des livres indisponibles. Il convient alors de démontrer les particularités du régime afférent à la gestion collective et de la positionner au sein du droit d’auteur. Ceci revêt une importance particulière car la notion de gestion collective, telle qu’elle résulte des lois française et hongroise n’est pas homogène. Elle englobe (i) la gestion collective obligatoire des droits exclusifs ainsi que (ii) la gestion collective des licences légales ou droits à rémunération, (iii) la gestion collective étendue et (iv) la gestion collective non étendue ouvrant un droit de sortie. Ainsi, il convient de traiter non seulement de la structure et du fonctionnement de la gestion collective, mais également et avant tout des droits patrimoniaux, afin de pouvoir démontrer l’intérêt de les gérer par le biais du système de gestion collective.Cette thèse est construite autour de l’analyse de la gestion collective régie par la loi française et hongroise, car ces deux pays disposent de systèmes juridiques différents au sein de la tradition civiliste. Ce travail illustre donc deux approches distinctes de la gestion collective imposée par la loi, ce qui a nécessité d’une part, l’étude de textes législatifs, de jurisprudences et de doctrines propres à ces deux pays, et d’autre part, l’analyse des textes régissant le droit d’auteur international et européen.Dans cette optique, la première partie est consacrée à la théorie générale de la gestion collective et aux limitations en droit d’auteur, et pose la question de la gestion collective comme limitation apportée aux droits de l’auteur. Nous concentrons ensuite notre attention sur la notion même de gestion collective imposée par la loi, de sorte à déterminer si la gestion collective peut être considérée comme une limitation au droit exclusif de l’auteur (deuxième partie) ou s’il s’agit simplement d’une garantie pour la mise en œuvre de ses droits (troisième partie). / The complex mechanism of the collective management of copyrights seeks to facilitate lawful uses of protected works by associating the authors. It can therefore be seen as a strong asset when negotiating licenses granted to (mainly professional) users, and a useful mechanism for monitoring uses through the collection and distribution of license fees and levies. Paradoxically though, collective management imposes also a limitation on the exclusive rights of authors in the broad sense, because it restricts the exercise of economic rights. This latter feature is much more highlighted when the collective management proceeds from the initiative of the legislator.Our thesis is a reflection on the ambiguity of collective management of copyrights ordered by law. The collective exploitation of economic rights is first and foremost a restriction on the exclusive rights of the authors meant to reconcile their interests with those of the public. It should be mentioned, however, that the introduction of collective management by law may sometimes prove the only means of exploitation of works. In this case, the submission of the solution to the special regime of limitations would lead to a result that is contrary to the objective of the collective management.The aims of this specific research focus lies in the fact that the legislator is considering collective management as a response to some questions of today’s copyright law, such as the use of orphan works or digital uses of out-of-commerce books. It is in that sense essential to analyse the details of collective management as ordered by law, and its place within the wider copyright system. This is particularly important because the concept of collective management, as it results from French and Hungarian laws, is not uniform. It includes (i) the mandatory collective management of exclusive rights, (ii) the collective management of statutory licenses or rights to remuneration, (iii) extended collective management, and (iv) the collective management with possibility of opting out. It also means that one should not only examine the collective rights-management system, but the economic rights licensed by the collective management organisations in order to demonstrate the reasons for introducing this mechanism as well.The present thesis thus provides a comparative analysis of collective management as stated in French and Hungarian copyright laws, as these two countries belong to different legal traditions within the civil law system. Our work sheds light on two distinct approaches to the collective management of copyrights ordered by law, through the study of legislative texts, jurisprudence, and doctrines specific to these two countries, as well as the analysis of the texts governing the international and European Union copyright law.In this respect, the first part of our thesis is concentrates on the general theory of collective management and limitations in copyright, where we discuss whether collective management can be seen as a limitation placed on authors’ economic rights. The two main parts of the thesis then focus on the concept of collective management ordered by law to examine whether collective management might be considered a limitation to the exclusive rights of authors (second part) or a simple guarantee for exploiting these rights (third part).

Ein Beitrag zur Modellierung von Dampfreformern für erdgasbetriebene Brennstoffzellenheizgeräte

Eine kompakte und effiziente Wasserstofferzeugung aus verfügbaren Energieträgern ist für die Marktfähigkeit von Brennstoffzellenheizgeräten essentiell. Der Auslegung von Reformern für PEM-Brennstoffzellen kommt eine große Bedeutung zu, da bei diesem Brennstoffzellentyp keine interne Reformierung möglich ist. In dieser Arbeit werden die mathematische Modellierung der Dampfreformierung von Erdgas, die Rolle der eingesetzten Katalysatoren und die Problematik von Wärme- und Stofftransportprozessen untersucht. Für fünf kommerzielle Nickel- und einen Rhodiumkatalysator werden die Kinetik, die effektive Wärmeleitfähigkeit und der Diffusionskoeffizient ermittelt. Unter Verwendung dieser Werte wird in einem Einzelpartikelmodell die Existenz und Signifikanz von intra- und extrapartikulären Stoff- und Temperaturgradienten evaluiert. Daraus werden für ein quasihomogenes Reaktormodell Modellparameter abgeleitet, die eine exakte Simulation unter Berücksichtigung der relevanten Phänomene zulassen. Schließlich wird ein Reaktormodell erstellt, welches mit Messwerten aus einem Versuchsreaktor validiert und für eine Sensitivitätsanalyse verwendet wird.

Housing in South Africa : the challenge to provide sustainable, integrated, affordable housing

Thesis (MBA (Business Management))--University of Stellenbosch, 2009. / ENGLISH ABSTRACT: Section 26 of the Constitution of South Africa states that all South Africans should have the basic right of access to adequate housing. The task of housing the people of South Africa is the responsibility of the state, who is empowered to utilize all legislative and economic resources at its disposal, in order to achieve this right to housing in all forms. Though the state has mobilised resources and manpower to achieve these objectives, many challenges remain in the facilitation and provision of adequate affordable housing. These challenges relate to the understanding of the complex legislative systems and mechanisms governing the delivery of housing in this country. The functions of various tiers of government and the interventions designed to alleviate the housing backlog are increasingly becoming less effective. The involvement of the private sector in the delivery of sustainable integrated affordable housing is therefore crucial as this enormous challenge cannot be achieved by the government alone. These challenges are numerous and diverse and this study highlights the main structural issues to which both the public and private sectors are exposed to. This relates to availability of land, affordability, subsidy constraints, access to funding and the limitations of development planning. The aim of this study is to determine how this range of challenges is affecting the delivery of sustainable integrated affordable housing. A survey of leading developers in the Western Cape has been conducted to determine the main factors which are retarding and hampering progress. The findings of the study reveals that government interventions in the housing sector though marginally progressive, are not conducive to alleviating the structural problems in this environment. As a result the ability of private sector developers to perform in this market is eroded due to the unsustainable and complex problems associated with this environment. As the need for housing grows, a greater awareness and understanding of the problems and challenges associated with the delivery of sustainable integrated affordable housing is needed to provide a platform for the creation of adequate housing in this country. AFRIKAANSE OPSOMMING: Artikel 26 van die Grondwet van Suid-Afrika stel dat alle Suid-Afrikaners die reg op toegang tot geskikte behuising het. Die taak van die behuising van die mense van Suid-Afrika is die verantwoordelikheid van die staat, wat toegerus is om alle wetgewende en ekonomiese hulpbronne tot sy beskikking te gebruik om hierdie reg tot behuising in al sy vorme te verwesenlik. Alhoewel die staat hulpbronne en mannekrag gemobiliseer het om hierdie doelwitte te bereik, bestaan daar steeds vele uitdagings in die fasilitering en verskaffing van geskikte en bekostigbare behuising. Hierdie uitdagings het betrekking op die begrip van die komplekse wetgewende stelsels en meganismes wat die lewering van behuising in hierdie land beheer. Die funksies van verskeie vlakke van regering en die intervensies wat ontwerp is om die behuisingsagterstand te verlig, raak al hoe minder effektief. Die betrokkenheid van die privaatsektor in die lewering van volhoubare, geïntegreerde en bekostigbare behuising is kritiek omdat die regering nie hierdie enorme uitdaging alleen kan verrig nie. Die uitdagings is talryk en divers, en hierdie studie werp lig op die vernaamste strukturele kwessies waaraan beide die openbare en privaatsektore blootgestel word. Dit het betrekking op die beskikbaarheid van grond, bekostigbaarheid, subsidiebeperkings, toegang tot befondsing en die tekortkominge van ontwikkelingsbeplanning. Die doel van hierdie studie is om vas te stel hoe hierdie reeks uitdagings die lewering van volhoubare, geïntegreerde en bekostigbare behuising affekteer. ’n Opname van toonaangewende ontwikkelaars in die Wes-Kaap is gemaak om vas te stel wat die hooffaktore is wat vordering vertraag en belemmer. Die bevindinge van die studie onthul dat regeringsintervensies in die behuisingsektor, hoewel marginaal progressief, nie bevorderlik is vir die verligting van strukturele probleme in hierdie omgewing nie. Gevolglik word die vermoë van die privaatsektor-ontwikkelaars om in hierdie mark te slaag, verweer weens die onvolhoubaarheid en komplekse probleme wat met hierdie omgewing gepaard gaan. Soos die behoefte aan behuising groei, word ’n groter bewustheid en beter begrip van die probleme en uitdagings, wat gepaard gaan met die lewering van volhoubare, geïntegreerde behuising, benodig om ’n platform daar te stel vir die skepping van geskikte behuising in hierdie land.

Rights and obligations of the agricultural land ownership The purpose of my thesis is to make a summary of rights and obligations of the agricultural land ownership, describe and evaluate problems related to status of agricultural land owner. The thesis is composed of seven chapters, each of them allows to come to know aspects of the land ownership. Chapter One generally represents an ownership of the land with accent on a constitutional right, because proprietary right is one of the basic human rights. Because everybody has the right to own property and nobody can be deprived unlawfully of the property. Resume Rights and obligations of owners the agricultural land The purpose of my thesis is to describe rights and obligations of owners of agricultural land. The thesis is composed of four chapters. Chapter One describes the historical evolution of the ownership of the land in Czech republic and impact of this evolution on current structure of ownership to land. European Copyright Law and the Text and Data Mining Exceptions and Limitations : With a focus on the DSM Directive, is the EU Approach a Hindrance or Facilitator to Innovation in the Region?

We are in a digital age with Big Data at the heart of our global online environment. Exploiting Big Data by manual means is virtually impossible. We therefore need to rely on innovative methods such as Machine Learning and AI to allow us to fully harness the value of Big Data available in our digital society. One of the key processes allowing us to innovate using new technologies such as Machine Learning and AI is by the use of TDM which is carried out on large volumes of Big Data. Whilst there is no single definition of TDM, it is universally acknowledged that TDM involves the automated analytical processing of raw and unstructured data sets through sophisticated ICT tools in order to obtain valuable insights for society or to enable efficient Machine Learning and AI development. Some of the source text and data on which TDM is performed is likely to be protected by copyright, which creates difficulties regarding the balance between the exclusive rights of copyright holders, and the interests of innovators developing TDM technologies and performing TDM, for both research and commercial purposes, who need as much unfettered access to source material in order to create the most performant AI solutions. As technology has grown so rapidly over the last few decades, the copyright law framework must adapt to avoid becoming redundant. This paper looks at the European approach to copyright law in the era of Big Data, and specifically its approach to TDM exceptions in light of the recent DSM Directive, and whether this approach has been, or is, a furtherance or hindrance to innovation in the EU.

Aferição da mobilidade física: relações entre resultados de testes referidos e observacionais / Assessing of physical mobility: relations between results of referred and observation tests

Objetivo: Analisar relações entre testes referidos e observacionais. Métodos: Estudo transversal, idosos institucionalizados, de 60 anos ou mais, independentes e estado cognitivo íntegro. Aplicou-se questionário sócio-demográfico, questões referidas (subir escadas e abaixar/ajoelhar-se) e dois instrumentos observacionais (caminhar rápido e de habilidade para levantar/ sentar). Resultados: Convidados 92 idosos, oito recusaram e um desistiu durante o teste. Amostra com 83 idosos, predomínio do sexo feminino (58%), media e mediana de idade 78 anos, e desvio padrão de 8,4 anos. As limitações referidas são bastante próximas (71% e 65%) e nas observadas, detectamos um valor menor para caminhar rápido (54%). Convergência entre os instrumentos referidos e medida observada, habilidade para levantar de uma cadeira, foram encontradas. Identificou-se o mecanismo fisiológico ligado à predominância da força muscular dos membros inferiores. Diferenças entre os instrumentos referidos e a medida observada caminhar rápido foram observadas porque caminhar rápido exige também equilíbrio, além de força, que é de diferente intensidade daquela para subir escadas ou abaixar. Discutiu-se a possibilidade de complementariedade entre as abordagens referidas e observacionais. Conclusão: Na comparação de testes observacionais e referidos, a concordância favorece a interpretação, desde que se consiga identificar explicação fisiológica. A constatação de resultados divergentes requer uma análise mais complexa, pois incluiu a possibilidade de complementariedade entre testes / Objective: To analyse the relationships between the results of tests referred and observational. Methods: Study sectional, institutionalized elderly, of 60 years or older, who are independent and cognitive status intact. Applied to be a socio-demographic questionnaire, referred questions (to climb stairs and lower/kneeling up) and two observational instruments (to fast walk and ability to lift/sit down). Results: 92 elderly were invited, eight declined and one withdrew during the test. The sample was 83 elderly, and the predominance was female (58%). The ages ranged from 61 to 98 years with mean and median of 78 years. The referred limitations are very close (71% and 65%). Already in observed, there is a smaller value to fast walk (54%). Associations between referred instruments and observed measurement ability to lift and sit down were found. Identifying the physiological mechanism linked to the prevalence of muscular strength of the lower limbs. Differences between the referred instruments and the observed measurement to fast walk was observed, this because the fast walk also requires balance, and strength, which is different from that intensity to climb ladders or down.
