Le pilori au Moyen âge dans l'espace français / The Pillory during the Middle Ages in French Area

Au cours du XIIe siècle, au cœur des villes du royaume de France rendues prospères par les développements des échanges commerciaux, apparaît un nouveau monument qui incarne l’autorité du haut justicier local et son emprise sur l’espace urbain. Ce poteau armorié, appelé dès l’origine « pilori », est certes un instrument pénal qui permet d’exposer les criminels à la vindicte populaire. Ses usages sont pourtant plus riches que sa fonction punitive. Le pilori est aussi un outil de prévention du scandale, une institution au service de la paix du marché, où il est implanté, ainsi qu’un symbole de l’état du rapport de forces entre les différentes juridictions urbaines. Alors qu’il est central dans le paysage urbain, l’étude de ce signe de justice a longtemps été délaissée par l’historiographie. Le renouveau continu de l’histoire de la justice médiévale depuis les années 1990 invite à l’analyser avec le même sérieux dont les fourches patibulaires ont récemment bénéficié. Pour rendre compte de la pluralité de facettes du pilori et de la peine qui porte son nom, nous avons privilégié une approche anthropologique, centrée sur les parcours des agents confrontés à ces objets juridiques. Cela nous a amené à explorer les stratégies discursives des juges et juristes qui ont contribué à l’invention du pilori, puis à sa rapide diffusion dans tout le royaume. Nous observons ensuite comment les sens et usages de la peine d’exposition évoluent à mesure que de nouvelles juridictions s’en emparent. En parallèle, nous décrivons la prise en charge du rituel d’exposition par le public, moment de refondation, autour du personnel de justice et aux dépens du condamné, d’une confiance commune. Enfin, une sociographie des condamnés au pilori débouche sur une réflexion plus large visant à brosser le devenir des infâmes dans la société médiévale. / During the 12ᵗʰ century, at the heart of the French kingdom’s towns that thrive thanks to the development of trade, a new monument, embodying the local high justice and its foothold on the urban space, emerges. While this armorial stake, called « pillory » from the beginning, is indeed a penal device used to submit criminals to popular punishment, it has many other uses. The pillory also prevents scandals, helps protect peace on the market, where it stands, and embodies the balance of power between the different urban jurisdictions. Despite the pillory’s central location in the urban landscape, its study has been long neglected by historiography. The ongoing renewal of medieval justice studies since the 1990s encourages an analysis of the pillory as thorough as the recently-studied gallows have been. In order to expose the many facets of both the pillory and the punishment bearing the same name, an anthropological approach was favored, focusing on the stories of all the different people who were faced with these objects of justice. This brought us to explore the storytelling strategies of the judges and lawyers who contributed to the pillory’s invention and its subsequent fast spread throughout the entire kingdom. We then observe how the meanings and uses of the public exhibition sentence evolve as new jurisdictions make it their own. In the meantime, we describe how the public takes over the penal ritual, and how it rebuilds trust in each other. Finally, a sociography of the convicted to the pillory leads to broader thoughts on the fate of the infamous in medieval society.

Prosecution of grave violations of human rights in light of challenges of national courts and the International Criminal Court: the Congolese dilemma

"Although the United Nations (UN) has often been pivotal in forging the international response to serious human rights crimes in such settings, the justice gap in countries such as the Democratic Republic [of] Congo (DRC) (the focus of this study) underscores the need for more systematic UN efforts. The war in the DRC has resulted in one of the world's worst humanitarian crisis with over 3.4 million displaced persons scattered throughout the country. An estimated 3.5 million people have died as a result of the war. The armed conflict has been characterised by appalling widespread and systematic human rights violations, including mass killings, ethnic cleansing, rape and the destruction of property. The most pressing need to be addressed is the question of justice and accountability for these human rights atrocities in order to achieve a durable peace in the country and also in the Great Lakes region (Rwanda, Burundi, Uganda, Angola and the DRC, to name just a few). In this respect, this study will address the grave human rights violations committed in the DRC and the mechanisms for dealing with them. It is particularly true in post-conflict situations where justice systems have been either partially or completely destroyed, that national courts are not capapble of arriving at a uniform stance, or willing to provide justice for atrocities in the immediate future. As a result, international justice seems to be a crucial and last resort that must continue to be fortified against efforts to undermine it. ... Development of a model to facilitate effective psychological services for offenders in long-term incarceration in Vhembe District, Limpopo Province, South Africa

Increasingly, research points to the negative effects of incarceration among offenders, particularly in adult facilities. Literature published since 2000 suggests that incarceration fails to meet the developmental and criminogenic needs of offenders and is limited in its ability to provide appropriate rehabilitation. Incarceration often results in negative behavioural and mental health consequences such as suicidal thoughts and attempts. Suicide is often the single most common cause of death in correctional settings. The psychological impact of incarceration and its implications for post-prison, free world adjustments are substantial. The severe behavioural problems of offenders are a result of complex and interactive individual and environmental factors which elicit and maintain offending behaviour. The study sought to develop a model to facilitate effective psychological services among offenders in long-term incarceration correctional services. The study consisted of two phases, namely the empirical phase and conceptualisation phase. In phase one, which was the empirical phase, a qualitative approach was employed. The study utilised phenomenological, explorative, and contextual designs. The study population comprised of male offenders who were serving their long-term incarceration in the Vhembe District at Limpopo Province. Thirty offenders and one clinical psychologist were purposively selected. Data were collected from participants using semi-structured interviews. In-depth information about their experiences physical and mental risks of being incarcerated, as well as the coping mechanisms they used during incarceration was collected. Unstructured interviews were used to collect information about psychological services that are being rendered at correctional centres and their effectives from the only psychologist who participated in the study. Field notes as well as observations were also used methods of data collection. Data analysis was done using Interpretative Phenomenological Analysis and Thematic data analysis. Relevant ethical principles were adhered to. Informed consent was sought from participants prior to the commencement of the study. The study further maintained the aspect of confidentiality and privacy since it was dealing with human subjects and sensitive issues. Issues of trustworthiness; credibility, dependability, transferability and conformability were ensured. The study findings revealed that most of the offenders were not very happy with the kind of mental health services they received from the correctional centres. They reported that correctional centres had a potential to make one totally insane. However, for one to make sense of what is happening at the correctional centres, one would need to receive mental vi health services. Furthermore, the study also discovered that one of the correctional centres is not providing offenders with mental health services and this makes it difficult for offenders to cope with their long-term incarceration since rehabilitation is not taking place. Findings also showed that offenders in one of the two centres were at a greater risk of contracting communicable diseases at the correctional centre due to overcrowding, poor health care system and poor hygiene. Concept analysis was done using Dickoff, James and Wiedenbach, (1968) guidelines. The framework adopted six guidelines that were used in theory development. A model was developed using the Walker and Avant (1995) framework to enhance the effectiveness of facilitation of psychological services at Thohoyandou correctional services and Kutama-Sinthumule Maximum correctional centre. The researcher recommends that mental health policies should be implemented to enhance and scale up mental health services in both correctional centres. / NRF

Hodnocení efektů probační práce z pohledu pracovnílů a klientů / Evaluation of Probation Effects from Perspective of Workers and Clients

The diploma thesis deals with the evaluation of the effects of probation work and brings new knowledge about their effectiveness. It presents data obtained using semi-structured interviews with six probation officers and six former clients of the Probation and Mediation Service. The aim of the research is to identify and map the factors that lead to effective probation work and whether, or to what extent, the view of officials with the views of clients in their views on these factors and their use coincides. The main results include that the most significant factor influencing cooperation is the human approach of officials to clients, their support and positive motivation. The effectiveness of probation work very significantly affects the client's internal motivation to change his current situation and lead a proper lifestyle, this internal motivation is a significant element that results in the termination of an individual's criminal career. A significant finding concerns the excessive workload of probation officers, mainly in the territory of Prague, which prevents more intensive cooperation and thus greater success of probation supervision.

Représentations sociales de la punition corporelle et pratiques de soutien de futurs psychoéducateurs auprès des familles, dont celles issues des communautés noires

Cette étude qualitative porte sur les représentations et les pratiques des futurs psychoéducateurs québécois quant aux situations de punitions corporelles et d’abus physiques rencontrés dans leur pratique professionnelle. Elle permet de s’y intéresser d’abord de manière générale, puis de manière spécifique en abordant la pratique professionnelle en contexte interculturel, soit auprès de familles issues des communautés noires. Les communautés noires sont surreprésentées au sein des systèmes de protection de la jeunesse au Québec, au Canada et ailleurs. À Montréal, elles sont surtout signalées par des professionnels oeuvrant auprès de ces familles, mais l’évaluation mène plus souvent à la fermeture des dossiers que pour les autres groupes ethnoculturels. Il apparaît donc essentiel de s’intéresser aux représentations et aux pratiques des professionnels afin d’éclairer le soutien offert aux familles et l’éventuelle décision de signalement. Un total de vingt-trois étudiants universitaires de deuxième cycle ont pris part à des entretiens de groupe semi-dirigés. Une analyse thématique à catégorisation mixte a par la suite été réalisée. Les résultats mettent de l’avant que les futurs psychoéducateurs rencontrés entretiennent une attitude défavorable à l’égard de l’utilisation de la punition corporelle. Toutefois, leur niveau de tolérance et de compréhension à cet égard est nuancé selon diverses caractéristiques des situations évoquées. L’ajout de la composante culturelle constitue un élément de compréhension supplémentaire qui peut avoir une influence sur leurs pratiques professionnelles. Enfin, la discussion propose des réflexions en lien avec la place à accorder à la culture dans l’intervention et le malaise qui caractérise la pratique professionnelle dans un tel contexte. / This qualitative study looks at the representations and practices of Quebec future psychoeducators in situations of corporal punishment and physical abuse encountered in their professional practice. The study begins by examining the topic generally and then explores it more specifically when the family belongs to a Black community. Black communities are overrepresented in the child protection systems in Quebec, elsewhere in Canada and in other countries. In Montreal, members of these communities are reported mainly by professionals working with them. It would therefore appear essential to take a closer look at professionals’ representations and practices in order to shed light on the support offered to families and the decision to report them or not. 23 master’s-level university students took part in semistructured group interviews. A thematic analysis was then conducted using a mixed-categorization approach. Results suggest that the future psychoeducators surveyed are against the use of corporal punishment, but that their level of tolerance and understanding in this regard depends on various characteristics of the situations described. The cultural component is an additional factor that can help in understanding and that can have an influence on their professional practices. Finally, the discussion offers reflections about the place to be given to culture in the intervention and the unease that characterizes professional practice in such a context.

What are the power relations between the fashion company Na-kd, influencers, and the general public? This study problematizes and concretizes the events surrounding the fashion company Na-kd that took place at the end of 2020 and is further discussed as an example of so-called cancel culture. The study explores the cancel culture phenomenon through the theoretical framework of Michel Foucault; including power, punishment, and discipline. By way of a Foucauldian discourse analysis, we have identified three main discourses: the boycott discourse, the violation discourse, and the discourse regarding subject positions. The analysis also identified the following subject positions as active partakers in the discourse: followers, company, influencer, woman, and boycotter which are discussed and analyzed in terms of how they relate to one another. The study’s key findings include the problematic use of boycott culture as a concept and whether it can be applied to companies or not, the shift of responsibility from company to influencers (i.e. individuals), and how great the power of the followers actually is. / Hur ser maktförhållandena ut mellan Na-kd, influerare och allmänheten? Studien problematiserar och konkretiserar händelserna kring modeföretaget Na-kd som ägde rum i slutet på 2020, och diskuteras vidare som ett exempel på bojkottskultur. Vidare i studien så utforskas bojkottskultur som fenomen utifrån det teoretiska ramverket Michel Foucault innefattande makt, straff och disciplin. För skapandet av en enhetlig undersökning så används Michel Foucaults diskursanalys, där tre huvuddiskurser identifieras: bojkottsdiskursen, diskursen om överträdelser inom fallet och subjektspositioner. Avslutningsvis diskuteras de identifierade subjektspositionerna; följare, företag, influerare, kvinna och bojkottare och hur dessa i förlängningen relaterar till varandra. Studiens huvudsakliga resultat  utmynnar i huruvida bojkott som begrepp går att applicera på ett företag eller inte, hur förflyttningen av ansvar från företaget till influerare sker och hur stor följarnas makt faktiskt är.

Militär kreativitet : en militär konstform?

Kreativitet är en förmåga som Försvarsmakten önskar att militär personal behärskar och använder. Samtidigt saknas en tydlig beskrivning av vad militär kreativitet är, hur det ska tolkas och om det påverkas av yttre påverkansfaktorer. Trots vikten av att officerare ska kunna behärska kreativitet i en militär kontext, återfinns det inte en entydig sammanhållen definition av begreppet att förhålla sig till. Syftet med denna studie var att bidra till en djupare förståelse för militär kreativitet och de drivkrafter som påverkar kreativiteten i en militär kontext. De två frågeställningar som ligger till grund för studien var: Hur tolkas kreativitet i en militär kontext av yrkesofficerare i Försvarsmakten? Vilka drivkrafter hämmar alternativt stimulerar kreativitet i en militär kontext hos den enskilde yrkesofficeren? Frågeställningarna undersöktes genom intervjuer med yrkesofficerare i Försvarsmakten och analyserades i enlighet med en Grounded Theory-ansats. Studiens resultat visar att det finns en militär kreativitet som uppstår då militär personal befinner sig i en militär kontext och ständigt tänker nytt. Mer specifikt kan denna militära kreativitet definieras som: när militär personal på ett nytt och nyttigt eller generativt sätt skapar progression i en militär kontext. Denna studie bidrar således med att belysa progression som en viktig utgångspunkt för förståelsen av militär kreativitet. Studien visar också att den organisatoriska miljön har en central betydelse för den militära kreativiteten eftersom den stimulerar eller hämmar den militära personalen i sitt utövande. Studiens resultat pekar särskilt på att förekomsten av negativ korrigering, eller bestraffning, inom Försvarsmakten har en påtagligt hämmande effekt på militär kreativitet. / Creativity is an ability that the Swedish Armed Forces want their military personnel to master and use. At the same time, there is no clear description of what military creativity is, how it should be interpreted and whether it is influenced by external influencing factors. Despite the importance of officers being able to master creativity in a military context, there is no unambiguously coherent definition of the term to relate to. The purpose of this study was to contribute to a better understanding of military creativity and the driving forces that influence creativity in a military context. The two questions that form the basis of the study were: How is creativity interpreted in a military context by professional officers in the Armed Forces? What driving forces inhibit or stimulate creativity in a military context of the individual professional officer? The issues were examined through interviews with professional officers in the Swedish Armed Forces and analyzed in accordance with a Grounded Theory approach. The results of the study show that there is a military creativity that arises when military personnel are in a military context and constantly think new. More specifically, this military creativity can be defined as: when military personnel in a new and useful or generative way create progression in a military context. This study thus helps to shed light on progression as an important starting point for the understanding of military creativity. The study also shows that the organizational environment is central to military creativity because it stimulates or inhibits military personnel in their practice. The results of the study indicate in particular that the presence of negative correction, or punishment, within the Swedish Armed Forces has a significant inhibiting effect on military creativity.

1. RESUMÉ Aim of this work was afer to effect of education on repeated criminal activity made of prisoners of age 18-26. For gears of this work I specificity triple style of education, that is mean education in functional family, in functionless family and institutional care. And effect of particular educations scope I showed by researched in prison Horní Slavkov. We can say, that young prisoners belongs to the group of prisoners, which can be somehow affected. Their preparing for return to the sociality is absolutely necessary. It is evident, that every group of young prisoners has own specifics gained through education. We can't affect this way of education, so it is important to influence on young prisoners in the execution of punishment. This influence works through programmes of treatment in the prisons. That's why I would like to appeal to create this programmes individualy especially for young prisoners. I deal with this ways of treatment on prisoners in the age 18 - 26 in the last part of this work. I offer several variations which should provide or at least increase better resocialization of young prisoners to the society and through this lower number of recidivist in this age group. Alternativní tresty v ČR / Alternative sanctions in the Czech Republic.

This diploma thesis deals with alternative sanctions in the Czech Republic. It primarily focuses on the cooperation between relevant actors during the process of decision-making about the type of sanction, its execution and supervision, and also concentrates on possible changes of its use after the amendment of criminal law in 2010. To give a complex view on given issue, the thesis also shortly focuses on alternatives to sanctions and diversions of criminal proceedings. System of alternative sanctions is framed by criminal policy and criminal law of the Czech Republic and factors that have influence on functioning of the system are determined. Those factors are multinational structures (OSN, EU, Council of Europe), level of registered criminality, forms of criminality and public opinion. Despite the fact, that Czech criminal law contains quite wide enumeration of alternative sanctions, there are still opinions that they are not used enough and that imprisonment is still preferred and it causes overcrowding of prisons and it is burden for state budget. Judges and prosecutors advocate themselves and claim that the problem is not on their side but rather the conditions of alternative sanctions which are poorly regulated and so it discourages from their use. The thesis analyzes selected issues in the U.S. criminal justice system, and the solutions proposed by American libertarians. First, it introduces libertarianism as a whole, based on both contemporary and historical sources. The thesis then examines the real influence of libertarians on U.S. politics, and the possibility that libertarian proposals might be adopted. It analyzes the successes of the U.S. Libertarian Party and introduces movement and factions in the two major parties, Republican and Democratic, and today's influential politicians who at least partially promote libertarian proposals. In the final, pivotal chapter, the thesis uses the theoretical base provided in the first chapter to analyze the shortcomings of the U.S. criminal justice system, and the solutions and changes that libertarians propose. The structure of this analysis follows the generally accepted structure of the system itself, dealing with criminal law and its enforcement through policing, courts and corrections.
