Hegel e a formação para a liberdade

A presente dissertação analisa o modo como Hegel concebe e defende um modelo de formação do indivíduo para a liberdade. Com tal propósito em vista, a dialética do senhor e do escravo é analisada, inicialmente em um estudo sobre as circunstâncias em que tal situação ocorre, e, posteriormente, com o propósito de apontar de que modo este tema da filosofia hegeliana contribui para a caracterização de sua perspectiva no que diz respeito à questão da formação de um indivíduo livre. Em um segundo estágio, são apresentadas as diferentes instâncias pelas quais passa o indivíduo em seu percurso de formação, e é analisado em que medida tais instâncias cumprem os objetivos a elas atribuídos. Nesse contexto, o trabalho é objeto de especial atenção, sendo apresentado como meio de libertar o indivíduo de suas necessidades. São expostas as relações existentes entre as necessidades e os meios para a satisfação das mesmas, assim como um dos impedimentos à satisfação das necessidades, a pobreza. Em seguida, as soluções propostas por Hegel são apresentadas, e igualmente o são as críticas que lhe podem ser interpostas. Como desenvolvimento subseqüente, estuda-se o surgimento da plebe como resultado da pobreza, e, vinculado a este tema, como seria possível combater o comportamento egoísta que se apresenta tanto entre os membros da plebe quanto entre os membros de diferentes grupos da sociedade. Também são avaliados os motivos apresentados para justificar a punição dos criminosos e a possibilidade de que a punição esteja vinculada à formação do indivíduo para a liberdade. Por fim, na conclusão são reunidos os resultados parciais para elaborar uma análise conjunta do projeto de Hegel e igualmente da cogência dos argumentos que o apóiam. / The present dissertation analyzes how Hegel conceives and defends a model of formation for freedom of the individual. Taking this purpose in view, the master-slave dialectic is analyzed, initially in a study about the circumstances in which this situation takes place, and, posteriorly, with the purpose of pointing out how this issue of Hegelian’s philosophy contributes for a characterization of his perspective regarding the question of the formation of a free individual. In a second stage, are presented the many instances through which the individual goes in his or her journey of formation, and it is analyzed in which extent such instances fulfill the objectives ascribed to them. In this context, the work is an object of especial attention, being presented as a means of freeing the individual from his or her needs. The existing relations between the needs and the means for satisfying them are exposed, as well as one of the impediments to the satisfaction of the needs, poverty. On the sequence, the solutions proposed by Hegel are presented, as well as the critiques that can be interposed to them. As a subsequent development, the emergence of the rabble, as a result of poverty, is studied, and, connected to this issue, how it would be possible to fight the selfish behavior that is presented either in the members of the rabble or in the members of the many groups of the society. Also the reasons presented in order to justify the punishment of the criminals are evaluated, as well as the possibility that the punishment is bonded to a formation of the individual for freedom. At last, in the conclusion the partial results are assembled, in order to elaborate a complete analysis of Hegel’s project, as well as of the cogency of the arguments that support it.

The considered assumption is that the process of creation of laws about sanction management in Brazil is recurrent the selection of prisons sentences, and the management way created by LEP (Law of Penal Execution) is subject of few proposals of legislative reform. This study includes an empirical research of legislative proposals presented to National Congress between 1984 and 2011 related to the enforcement of criminal sanction. The second chapter of the dissertation contains a quantitative analysis of these proposals, through the systematization of general data (type of proposition, length of the procedure for approval, federal state of origin and author) to identify, when possible, the increase or decrease trend of social exclusion through the use of more or less frequence of imprisonment. The qualitative analysis focus on the concepts of management of criminal sanction and individualization of punishment. The third chapter introduces the concept of management of criminal sanction, review of legislative historical creation of legal degree to accomplishment of sanction until the creation of LEP in 1984, and reinforces a qualitative study of task divisions about accomplishment of sanction from an empirical material. The fourth chapter introduces the idea of individualization of sanction, as approached in a judicial activity, which interacts in a dynamic and constant way with legislative and administrative activities, especially while the accomplishment of prison sentencing. From this concept, new legislative proposals present a new arrangement of distribution of tasks among the three powers regarding enforcement of criminal sanction. The conclusion of this dissertation is that the creation process of criminal laws in Brazil recognizes the use of freedom private sanction, considering the extension of minimum prison quorum or the extinction of subjective rights, in a situation that the judge has no many possibilities to actuate in case. / A presente dissertação tem por objetivo compreender a atividade legislativa e a articulação entre os Poderes Legislativo, Judiciário e Executivo no momento de cumprimento da pena pelo condenado. Parte-se da hipótese de que no processo de criação de leis sobre gestão da sanção no Brasil é recorrente a seleção de penas prisionais e que a atividade de determinação da quantidade e da qualidade da pena no caso concreto é objeto de disputa entre legislador, juiz e administrador penitenciário. Para investigar esta hipótese, a pesquisa comporta um levantamento empírico de proposições legislativas apresentadas no Congresso Nacional entre 1984 e 2011 relacionadas ao cumprimento da sanção criminal. O segundo capítulo da dissertação contém uma análise quantitativa destas proposições, por meio da sistematização dos dados gerais (tipo de proposição, tramitação, estado de origem e autor) e identifica, quando possível, as medidas tendentes a ampliar ou reduzir a exclusão social por meio do uso mais ou menos frequente da pena de prisão. O terceiro capítulo introduz o conceito de gestão da sanção, revisa o histórico legislativo de criação de um diploma legal voltado ao cumprimento da pena até a criação da LEP (1984) e empreende um estudo qualitativo sobre a divisão de tarefas sobre cumprimento da pena a partir do material empírico. O quarto capítulo apresenta a ideia de individualização da pena, conceito abordado da perspectiva de uma atividade judicial que interage de forma dinâmica e constante com as atividades legislativas e administrativas, especialmente durante o cumprimento da pena de prisão. A partir deste conceito são retomadas proposições legislativas que, em alguma medida, abordam o arranjo ou o rearranjo da divisão de tarefas entre os três poderes. Ao final, conclui-se que o processo de elaboração de normas penais no Brasil valoriza o uso da pena de privativa de liberdade, por meio da ampliação das frações mínimas prisionais ou da vedação de direitos subjetivos, situação na qual o juiz tem pouco espaço para atuar no caso concreto.

An analysis of the emotions of anger and fear in the undisputed Pauline letters

In the 1980s, in the discipline of Classical studies in the field of Greco-Roman philosophy, the scholars showed renewed interest in the subject of the emotions. The outcome of their research reinstated the cognitive function in emotions. The research also recognised that the values and beliefs in the emotions are culturally conditioned. This outcome opened the possibility of discovering the values of a culture by analysing the emotions. Another outcome of the research showed that the interpretation of a lexical term, designating an emotion, did not necessarily imply the same meaning universally. The knowledge of the emotions in this discipline influenced numerous branches of academic study. It was noted that this did not apply to New Testament studies and therefore became an opportunity for a research subject, namely: An Analysis of Emotions of Anger and Fear in the Undisputed Pauline letters. The purpose was to determine their meanings within the context of Imperial Roman values. The analysis was based on Aristotle's definition of anger and fear. This approach also required a study of social conditions in the provincial Roman cities in which Paul had formed communities. The study was dependent on the emotional language used by Paul in his undisputed letters. Louw-Nida New Testament Greek-English Lexicon based on Semantic Domains was used to locate the words that expressed the emotional concepts of anger and fear. Through the centuries the parental authority has dwindled from the absolute power of the father to the rights of autonomy of the child. At present in the South African law the parental authority is still largely determined by the common law and can be described as the sum total of rights and obligations which parents enjoy in relation to their children. Guardianship and custody are the separate incidents of parental authority. The Child Care Act 74 of 1983, The Constitution of the Republic of South Africa 108 of 1996, The Guardianship Act 192 of 1993, The Choice on Termination of Pregnancy Act 92 of 1996, the ratification of the United Nations Convention on the Rights of the Child 1989 by South Africa on 16 June 1995 and case law have contributed to increasing limitations on the exercise of parental authority. A balance needs to be found between the parental authority and the rights of the child to ensure that neither is absolute. Adolescents' perspectives of discipline problems at a secondary school in Gauteng

Problem behaviours amongst adolescent learners continue to affect the goals of effective education. The current study sought to investigate adolescents’ perspectives of discipline problems at a secondary school in Gauteng. A mixed method research design was followed during which questionnaires, focus groups and interviews directed the empirical investigation. The findings revealed two areas for addressing and improving the discipline problems of the secondary school, namely improving extrinsic factors and improving the current discipline system. Based on the findings, it was suggested that the school encourage greater parent involvement and improve parent-teacher communication. Creating a positive school identity and developing teachers further was proposed. An improved discipline system based on a positive learning approach was recommended. This included clarifying the discipline system to all role players, standardising discipline procedures throughout the school and improving follow up procedures regarding learner discipline. / Psychology of Education / M. The abolition of corporal punishment in S v Williams and Others 1995 (3) SA 632 (CC) provided the state with the impetus to consider alternative sentencing options. Unsystematic efforts by the government to reform the juvenile justice system have failed abysmally. The government was forced to review its policies on juvenile sentencing. An examination of international trends reveals the imposition of stricter measures of punishment for serious and violent juvenile offenders. Community-based sentencing options are used mainly for first-time offenders. The focus has also shifted from punishment and retribution to prevention and treatment. It is advocated that serious and violent juvenile offenders be incarcerated in secure-care facilities and/or juvenile prisons and that community-based sentencing options be utilised for first-time offenders. The theoretical part also contain psychosocial characteristics of senior age, which includes psychological aspects and specifics of social work in prison. Research section includes interviews with convicted seniors that focus on the evaluation of psychosocial work with them. The aim of thesis is make a conclusion whether the theoretical bases correspond with actual practice.
