Critical analysis of victims' rights before international criminal justice

"The establishment of the International Criminal Court (ICC) in Rome in 1998 is a milestone for humanity and a watershed in the life of victims of ongoing violations or wars. The Preamble to the Rome Statute of the ICC acknowledges that 'during this century [20th century] millions of children, women and men have been victims of unimaginable atrocities that deeply shock the conscience of humanity'. This dissertation explores the development and state of victims' rights in international criminal law. ... The study consists of five chapters. Chapter one will provide the context in which the study is set. It oulines the basis and structure of the study. Chapter two endeavours to define some of the basic concepts central to the study: victim, witness, compensation, reparation, redress, restitution, etc. This chapter will give a brief overview of victims' rights in the domestic system. It will also analyse the right to an effective remedy in international law with specific focus on the UN human rights system and on regional systems. Chapter three will outline victims' rights before the ad hoc international criminal tribunals and hybrid courts. These tribunals and courts are the International Criminal Tribunal for the Former Yugoslavia (ICTY), International Criminal Tribunal for Rwanda (ICTR), Special Court of Sierra Leone (SCSL), Extraordinary Chambers in the Courts of Cambodia (ECC), and the Special Pannels for Serious Crimes in East Timor (SPSC). Ernst Alexander hat sich sowohl als experimentell als auch theoretisch äußerst fähiger Assistent von Georg von Hevesy im Institut für Physikalische Chemie der Universität Freiburg um die Entwicklung der Röntgenfluoreszenzanalyse verdient gemacht, habilitiert und wurde 1933 kurz nach seiner Ernennung zum Privatdozenten entlassen. Er ging an die Hebräische Universität Jerusalem, wo er das Arbeitsgebiet Experimentalphysik mit einer Institutswerkstatt aufgebaut, wesentliche Beiträge zur Röntgenstrukturanalyse geleistet und als Hochschullehrer fähige Wissenschaftler hervorgebracht hat. Während der kriegerischen Auseinandersetzungen stellte er Ersatzteile erst für die britische und dann für die israelitische Armee her. Ungeachtet seiner In Freiburg und in Jerusalem erbrachten Leistungen waren 1956 Institutsdirektor R. Mecke und der Dekan bei der Beurteilung seines Wiedergutmachungsantrages nicht bereit, ihm einen positiven Verlauf seiner akademischen Laufbahn zu bescheinigen, wenn er in Deutschland seine Arbeit hätte fortsetzen können. / Ernst Alexander was an assistant of George de Hevesy in the institute of physical chemistry of the university in Freiburg. He was a skillful experimenter with broad knowledge. He has done important contributions in the development of x-ray fluorescence analysis and has been qualified to give lectures at the university. In 1933 shortly after his appointment as lecturer he was dismissed. He went to the Hebrew University of Jerusalem, where he founded the laboratory of experimental physics with a workshop, where he dealt with x-ray structural analysis. During the war he produced spare parts for the British and later for the Israeli army. In 1956 he applied for reparation, but the head of the institute, R.Mecke and the dean did not accept that he would obtain a professorship if he must not leave Germany.

(in English): The aim of the work was to describe the experience of the providers of assistance to victims of crime with the use of the law in their practice. The experience and the views of the providers were obtained in the form of a questionnaire survey. As a source of data for addressing service has been utilized to view all registered entities providing their services to the victims of the crimes on the web site of the Ministry of justice. The work was focused on the practical application of selected provisions of act no. 45/2013 Coll. and from its results revealed that providers in your practice are finding that the provisions relating to particularly vulnerable victims, are defined too narrowly. Also the communication between the provider and the police is not yet ideally set.

An Evaluation of Recidivism Rates for Resolutions Northwest's Victim-Offender Mediation Program

Victim-offender mediation, a component of restorative justice, has been a valuable tool for rehabilitating juvenile offenders since the late 1970s. Victim offender mediation brings crime victims and offenders together to reach agreements for restitution and community healing. Resolutions Northwest, a non-profit organization in Multnomah County, offers a victim-offender mediation program to juvenile offenders and their victims. The purpose of this study was to analyze the recidivism rates for juvenile offenders who went through Resolutions Northwest's victim-offender mediation program as opposed to offenders who went through the traditional justice system. It was hypothesized that the participants in this program would have lower recidivism rates than the juvenile offenders who were not given this restorative justice option. Records on juvenile offenders who successfully completed the victim-offender mediation program were collected from Resolutions Northwest. These records were then compared to a secondary data set. This secondary data was from the Tri-County Juvenile Information System database, supplied by the Multnomah County Department of Adult and Community Justice to Professor William Feyerherm as part of the Casey Foundation supported Juvenile Detention Alternative Initiative. It was found that 41.6% of the Juvenile Detention Alternative Initiative group reoffended within one year of their original arrest. In comparison, only 20.3% of the Resolutions Northwest group reoffended within a year of their victim-offender mediation program completion. It was also investigated as to whether the juveniles in both groups reoffended a second, third or even fourth time within a one year period. The explorations into second, third and fourth reoffenses yielded similar results in that the juveniles from Resolutions Northwest had significantly lower recidivism rates than those from the Juvenile Detention Alternative Initiative group.

[pt] A presente dissertação analisa movimentos de mães e familiares de vítimas de violência letal de Estado no Rio de Janeiro em sua interação com o Estado autor da violação. A partir de uma abordagem teórica que mobiliza pesquisadoras de antropologia urbana, segurança pública e sociologia que estudam especificamente violência de gênero e movimentos de mães vítimas de violência de Estado, como Adriana Vianna e Juliana Farias, e articulando-as com as teorias de Judith Butler e Donna Haraway sobre processos de corporificação, o trabalho se apoia nos depoimentos de mães e familiares, colhidos de entrevistas e grupos focais. A dissertação propõe, então, a luta desses movimentos por Memória, Verdade, Justiça e Reparação como uma esfera de produção de redes de solidariedade que, coletivamente, ao se exporem publicamente, reivindicam a esfera de aparecimento e a condição de enlutável para os seus filhos e parentes executados, produzindo a afirmação de que suas vidas são dignas de reconhecimento e proteção. A pesquisa defende a ambivalência da relação das mães e familiares com o Estado, que pode ser, a um só tempo, ambiente de violência e suporte, e, ao mesmo tempo, busca o entendimento de que esses movimentos, em suas demandas específicas e generificadas ao Estado, ainda que mobilizem normas e representações que são estruturalmente seletivas, reconfiguram esse espaço de representação. O trabalho conclui, então, que esses movimentos realizam disputas e deslocamentos importantes na arena do Estado, que não é uma arena homogênea e, sim, uma arena formada performativamente e passível a reformulações críticas. / [en] This dissertation analyzes the movements of mothers and family members of victims of lethal State violence in Rio de Janeiro in their interaction with the State responsible for the violation. Based on a theoretical approach that mobilizes urban anthropology, public safety and sociology researchers who specifically study gender violence and movements of mothers victims of State violence, such as Adriana Vianna and Juliana Farias, articulating them with the theories of Judith Butler and Donna Haraway about processes of embodiment, the work is based on the testimonies of mothers and family members gathered from interviews and focus groups. The dissertation proposes the struggle of these movements for Memory, Truth, Justice and Reparation as a sphere of production of solidarity networks that, collectively, by publicly exposing themselves, claim the sphere of appearance and the grievability for their executed relatives, producing the claim that their lives are worthy of recognition and protection. At the same time, the research defends the ambivalence of the relationship between mothers and family members and the State, which can be, at the same time, an environment of violence and support, and understand that these movements, in their specific and gendered demands to the The State, even though they mobilize norms and representations that are structurally selective, reconfigure this space of representation. The work concludes, then, that these movements carry out important disputes and displacements in the State arena, which is not a homogeneous arena, but an arena that is also performatively formed and susceptible to critical reformulations.

En rullande cykel : Cykelreparation för den oinsatte

It is no secret that the world is facing major climate challenges. One of the aspects that can contribute to a greener future is to reconsider our means of transport. That bicycles is part of the solution and also contributes to the public health is something that is gaining more and more traction in society. An aspect though, that has received far too little attention and is the basis of this work is broken-down, stationary bicycles. Something that neither benefits the individual nor society at large. What this work aims to explore is why this happens, how it can be avoided and how to get bike owners to actually repair their bikes. This through a user-centered design process that is based on the users' situation and needs. This project is a bachelor’s thesis within industrial design engineering that has been carried out during spring 2022 at Luleå University of Technology. Through a user-centered process based on several methods such as guerilla interviews, participatory observation, and context research, a broad picture of the current situation was created. Based on this, creative methods such as brainstorming and workshops were then used to create a large number of ideas based on the users' needs. A thorough idea evaluation, mockups and a dot-voting then sifted these ideas down to a final concept where wireframes and prototyping ensured that the concept could be realized. The result of the project was the following; users don’t repair their bikes because they are insecure, lack knowledge and do not trust their abilities. They consider repairing to be a project that feels tedious and difficult to begin with. The users need a simple, clear solution that creates security and presents relevant information. The solution landed in the concept  A rolling bicycle consisting of two parts and a total of three steps. The first part is a number of posters to create incentives to repair one's bike and the second part an application that contains both a guide before the repair, but also instructions during the repair itself. The flow is a result of the needs and function analysis that was carried out and whose components are intended to meet the needs and conditions of users to get more people to fix their bike. / Att världen står inför stora klimatutmaningar är ingen hemlighet. En av de aspekter som kan bidra till en grönare framtid är att se över vårt val av transportmedel. Att cykeln är en del av lösningen och som även bidrar till folkhälsan är något som får allt större plats i samhället. En aspekt som fått allt för lite uppmärksamhet och som är grunden till detta arbete är trasiga, stillastående cyklar. Något som varken gynnar individen eller samhället i stort. Det här arbetet utforskar varför detta sker, hur det kan undvikas och hur man kan få cykelägare att faktiskt reparera sin cykel. Detta genom en användarcentrerad designprocess som utgått från användarnas situation och behov. Projektet är ett examensarbete på kanditatnivå inom utbildningen teknisk design. Projektet har utförts under läsperiod 4, vårterminen 2022 på Luleå tekniska universitet. Genom en användarcentrerad process grundad i flertalet metoder såsom gerillaintervjuer, deltagande observationer, och kontextundersökning skapades en bred bild av nuläget. Baserat på detta gjordes sedan kreativa metoder såsom brainstorming och workshops för att skapa ett stort antal idéer utifrån användarnas behov. En grundlig idéavaluering, mockups samt en dot-voting sållade sedan ner dessa idéer till ett slutkoncept där wireframes och prototypande såg till att konceptet kunde förverkligas. Resultatet av arbetet blev följande; användarna reparerar inte sina cyklar för att de är osäkra, saknar kunskap och inte litar på sin egen förmåga. De anser lagning vara ett projekt som känns jobbigt och svårt att påbörja. Användarna har ett behov av en enkel, tydlig lösning som skapar en trygghet och presenterar relevant information. Denna lösning landade i konceptet En rullande cykel som består av två delar och totalt tre steg. Den första delen är ett antal affischer för att skapa incitament till att laga sin cykel och den andra delen en applikation som innehåller både en guide inför reparation, men också instruktioner under själva reparationen. Detta flöde är ett resultat av den behovs och funktionsanalys som utfördes och vars komponenter har som avsikt att bemöta användarnas behov och förutsättningar för att få fler att laga sin cykel.

Effektivisering av ROT - produktionen : En tids-, kostnads- och miljömässig analys / Streamlining of the ROT production : A time, cost and environmental analysis

Att effektivisera byggproduktionen är idag en högst relevant fråga då västvärldens länder har satt upp stränga miljömål för de kommande decennierna. Byggsektorn står för en oproportionerligt stor del av miljöbelastningen i dag och en effektivisering av branschen skulle utöver miljöaspekterna även leda till tids- och kostnadsbesparingar, något som det anses finnas stor potential till. En annan del i effektiviseringsarbetet är digitaliseringen som i samband med den rådande pandemin av SARS-CoV-2 har ökat inom produktionen med lösningar som digitala möten. Detta är ett steg i samma riktning som branschen sakta har gått åt den senaste tiden med en ökad användning av digitala hjälpmedel. Syftet med examensarbetet är att i samarbete med M3 Bygg AB ta reda på hur man kan effektivisera ROT-produktionen. Arbetet behandlar ämnen som slöserier, S-kostnader och planering för att identifiera eventuella brister som påverkar produktionen. Utöver detta så undersöks digitaliseringen och vilken påverkan den har haft på produktionen samt om den bör utökas i framtiden. Arbetet undersöker även hur erfarenhetsåterföringen kan förbättras inom M3 Bygg. Allt detta kulminerar i ett kapitel med rekommendationer på hur produktionen kan förbättras och sist görs även reflektioner på vad rekommendationerna skulle få för miljömässiga påföljder. Rekommendationerna är baserade på omfattande litteraturstudier inom produktionseffektivisering, digitalisering och miljö samt utskickade frågeformulär och intervjuer genomförda på M3 Bygg. Den huvudsakliga filosofin för produktionseffektivisering som behandlas är Lean. Resultaten från frågeformulären har avslöjat att de mest kritiska slöserierna är onödiga transporter, onödigt arbete, väntetider och onödiga förflyttningar. Det har även framkommit hur respondenterna på M3 Bygg ställer sig kring frågor angående bland annat planeringsarbetet, S-kostnader, väderberoende, erfarenhetsutbyte och digitalisering. Intervjuerna har sedan gett mer fördjupade resonemang kring detta där orsaker, konsekvenser och lösningsförslag legat i fokus. Åtgärdsförslag och andra rekommendationer för att effektivisera produktionen samt slutsatser presenteras i slutet. Dessa omfattar samtliga ämnen som behandlas i rapporten och förhoppningen är att de ska kunna hjälpa M3 Bygg och andra företag inom ROT-branschen att effektivisera sin produktion i takt med att vi rör oss mot ett hållbarare samhälle. / Due to the fact that the western world has set up strict environmental goals for the coming decades it is now more important than ever for the construction industry to make its production more efficient. The construction industry is responsible for an unproportionally large environmental impact and even if we put that fact aside, making the industry more efficient would still be of benefit due to the time and money it would save. Another aspect related to efficiency is digitization which is something that has become more prevalent than ever in the wake of the current SARS-CoV-2 pandemic with things like digital meetings. This is in line with the overarching trend where digitization has become more widespread in recent times. The aim of this thesis is to elucidate how the construction industry can become more efficient. This is being done in collaboration with M3 Bygg AB. The thesis deals with topics like waste and planning in order to identify potential deficiencies that can affect the production. Beyond that the thesis examines the way digitization has impacted the construction industry so far and how it could impact it in the future. Lastly it also examines how learning experiences can be more efficiently transmitted within the company of M3 Bygg and beyond. All of this will culminate in a chapter where recommendations are presented concerning how the production can become more efficient and lastly in what way the recommendations may have an impact on our environment. The recommendations are based on extensive research regarding production efficiency, digitization and environmental impact as well as questionnaires and interviews with employees on M3 Bygg. The main philosophy for production efficiency that was studied and used for this thesis is Lean. The results from the questionnaires have revealed that the most critical types of waste are unnecessary transportation, unnecessary work, waiting and unnecessary motion. They have also revealed how the employees on M3 Bygg think regarding topics like planning, weather dependency, exchange of learning experiences and digitization. The interviews that followed engaged these topics on a deeper level where cause and effect was discussed as well as solution proposals. Lastly the thesis presents a range of recommendations and conclusions regarding how the production can become more efficient. The recommendations encompass all of the topics described above and the hope is that they will aid M3 Bygg and other construction companies in their endeavors to become more efficient so that we as a society can move towards a more tenable future.

A model for implementation of restorative justice in the South African correctional system

This report is the culmination of literature study and semi-structured interviews which assisted in developing a Model for Implementation of Restorative Justice in the South African Correctional System. The study explores the use of Restorative Justice as part of rehabilitation in a prison setting. Literature focuses mainly on Restorative Justice as part of diversion, in cases of first offenders and less serious offences. Restorative Justice with sentenced offenders has been gaining momentum, though. Diversity in terms of language, cultural and religious practice as well as social background, should be considered as it affects the decision to enter into a Restorative Justice process. Restorative Justice with sentenced offenders is challenging and in the main a largely unsupported field. The study draws on experience from other countries, while at the same time advocate for uniquely South African practice. The involvement of the most important role players, namely victim, offender and the community is emphasized. Attitude and insufficient training seem to be some of the challenges for the implementation of Restorative Justice. Successes are reported in the few sites where Restorative Justice is implemented in the Correctional System, but a change of mindset, of being open to possibilities other than lock-up and punish in the entire Criminal Justice System is needed. Restorative Justice in the Correctional System seems to have been approached as yet another new programme, and not as a paradigm shift for the entire Criminal Justice System. Dealing with conflict in a restorative way should be at the front end of the chain, with young children whose behaviour can be directed, as changing behaviour of adults proves to be difficult. Repentance and forgiveness in different cultures and spiritual backgrounds are some of the issues that are grappled with, although forgiveness is nowhere indicated as a requirement for a successful Restorative Justice process. Voluntary participation is required from victims and offenders with support from communities. It remains a deeply spiritual and individual journey for those who choose to turn away from anger, fear and hatred, and start the process of personal healing and restoration.
