An analysis of those requisites was made with the purpose of showing that some of them are obsolete due to the arrival ofthe Federal Constitution in 1988 and that others should have their application restricted to the repairing of punitive damages, since their origin is and they are connected in the matter ofvalue to the restitutory Law. From the analysis conducted, we conclude that: can not be applied requisites that taper with the restitutory Law; that the punitive damages' purpose protects superior value of alI society' s interest that superposes the material values; that the parts find themselves in situation of inequity when it comes to work contract; that work is essential good for workers and the entire society; and that is why specific requisites are a necessity, as well as the application of the punitive-pedagogic aspect, reaching the prohibitive function of the Law, which, materializes through significant values for reparation / Este trabalho tem como objetivo fazer uma releitura crítica dos requisitos adotados pela maior parte da doutrina e da jurisprudência para fixação do valor da reparação do dano moral. Fez-se uma análise desses requisitos com o intuito de demonstrar que alguns estão superados pelo advento da Constituição Federal de 1988 e outros devem ter sua aplicação restrita à reparação dos danos materiais, eis que oriundos e guardam conexão axiológica com o direito restituitório. Da análise procedida concluiu-se que: não podem ser aplicados requisitos que se afinam com o direito restituitório; que o instituto do dano moral protege valor superior de interesse de toda a sociedade que se sobrepõe aos valores materiais; que as partes encontram-se em situação de desigualdade no contrato de trabalho; que o trabalho é bem essencial aos trabalhadores e à toda sociedade; por isso é que há necessidade de requisitos específicos e de aplicação do caráter pedagógico-punitivo, com alcance da função proibitiva do Direito, o que se materializa através de valores significativos para a reparação

Orientador: Élcio Trujillo / Banca: Euclides Celso Berardo / Banca: Luiz Antonio Soares Hentz / Resumo: O presente trabalho tem por objetivo discutir os motivos pelos quais o Estado deve arcar com os prejuízos causados pelo erro judiciário na sentença penal absolutória, já que, a depender da fundamentação dessa decisão judicial, a vítima ficará impossibilitada de pleitear do próprio agente do crime o ressarcimento dos danos causados pelo fato criminoso. Argumenta-se que, se por um lado o processo é instrumento de consecução e aplicação da justiça, não se pode olvidar que a solução dos conflitos intersubjetivos de interesses foram entregues a órgãos integrantes do Estado, personificados nos juízes. Desse modo, a decisão acerca do mérito do processo reside na convicção do julgador. Entretanto, ao contrário do que se pensava, esta não é formada simplesmente por aspectos próprios da pessoa do julgador, mas deriva do somatório das condutas verificadas no decorrer do processo, seja por atividade instrutória própria do juiz, seja pela intervenção das partes da relação jurídica processual. Por isso se afirma que não deve o julgador, jamais, se afastar dos elementos de convicção contidos nos autos. Essa afirmação se justifica, na medida em que o ordenamento jurídico brasileiro adotou a regra do livre convencimento motivado. De fato, existe um princípio implícito na relação jurídica processual, consistente num dever de conduta ética das partes. Contudo, e a despeito da existência do citado princípio, é plenamente possível que as partes venham a se utilizar de condutas que induzam o magistrado a erro, levando, inclusive, à absolvição do réu, quando, no caso, a condenação se impunha. Desse modo, a depender do fundamento da absolvição, nem mesmo poderá ser proposta a ação de reparação civil pelo fato criminoso, restando a vítima, assim, sensivelmente prejudicada. Como o... (Resumo completo, clicar acesso eletrônico abaixo) / Abstract: This paper is due to discuss why State should assume the responsibility for the losses caused by a false judgment that led to an acquittal, since, depending on the motivation of the sentence, the victim could be unable to suit the criminal for the reparable injuries related to the crime. It is pleaded that, although a law suit is an instrument used to pursue justice, it must not be forgotten that the pacification of the conflicts of interest were ceded to state officers, the judges. So, the decision on the merits lies on the beliefs of the judge. However, in spite of what was considered true, these beliefs are not composed only by personal aspects regarding to the judge, but they arise from a sum of conducts that occur during the proceedings, by the diligence of the judge or by the activity of the parties. That is why it is said that the judge should never disregard the indicia produced during a lawsuit: because, in Brazil, the rule called "free but justified persuasion" is valid. In fact, there is an unwritten principle that guides the relation between the parties - the obligation to behave ethically. However, and despite the existence of the aforementioned principle, it is absolutely possible that the parties behave in such a way that leads the judge to a mistake, which can even cause an erroneous acquittal. In this case, depending on the motivation of the sentence, the reparation suit would not even be possible. The victim would bare, therefore, his losses. As the law in vigor does not bring a solution to this problem, the present paper analyzes a way to guarantee to the victim the right to a reparation lawsuit - otherwise, he would suffer two injuries: the crime itself and the conduct of the parties that guided the judge to an erroneous acquittal. / Mestre

To accomplish this goal, it was necessary to take into account not only the political players that act in this process – among others: State, Army, Veteran's Associations and society – as well as the fluctuations and appropriations of their memory. Traumatic memories of the veterans about this event arise through different ways of self-writing – with special emphasis on journals, letters and interviews – and lead to the notion of the duty of memory in the fight for reparation and recognition. / O presente trabalho procura investigar como se configura atualmente o campo da disputa memorial sobre a participação da Força Expedicionária Brasileira (FEB) durante a Segunda Guerra Mundial. Para isso, foi preciso levar em conta não apenas os sujeitos políticos que atuam nesse processo – entre outros: Estado, Exército, Associações de veteranos e sociedade – como também as flutuações e apropriações de memória das quais se valem. As memórias traumáticas que os veteranos guardam desse episódio ganham voz através das diversas modalidades da escrita de si – com destaque para os diários, as correspondências e entrevistas – e remetem à noção do dever de memória na luta por reparação e reconhecimento.

La réparation des dommages environnementaux en droit international concerne le droit international public et le droit international privé. Considérant qu’une réparation efficiente des dommages environnementaux est difficilement réalisable par le seul biais du droit international public, la méthode du droit international privé contribue à une meilleure réparation des dommages. La limite du droit international public est liée à la difficulté d’harmoniser les règles matérielles environnementales dans les cadres nationaux, régionaux et internationaux. Une autre raison est le faible contrôle du déplacement des entreprises ainsi que la difficulté de les rendre responsables pour les dommages environnementaux commis. Le droit international de l’environnement nécessite un ensemble d’outils juridiques, publics et privés, ayant comme objectif la protection de l’environnement. Les outils publics comme les traités et les mécanismes de surveillance institutionnalisés doivent opérer en complémentarité avec les outils privés comme la responsabilité civile et l’arbitrage privé. L’utilisation du droit international privé permet d’organiser un ensemble de normes appartenant à différents espaces juridiques. Cette méthode permet l’utilisation, dans un Etat, de mesures juridiques prévues dans le système juridique d’un autre État sans qu’une uniformité ne soit exigée. Le droit international privé, par le biais d’une fonction environnementale accordée aux règles de conflit de lois et de juridictions, conduit à une meilleure interaction entre les espaces normatifs et entre les différentes branches du droit, ce qui favorise une coopération plus efficace pour la protection de l’environnement. / The reparation of environmental damages in international law concerns public and private international law. Due to the fact that efficient reparation of environmental damages is hardly achieved only by public international law, private international law methods can be used to fill the gaps of the former law field. Public international law limits are related to the difficulty of harmonising substantial environmental rules on national, regional and international context. Another reason is that it is hard to control company’s international movements and to hold them liable for damages committed. International environmental law depends on some public and private legal instruments in order to protect the environment. Public instruments such as treaties and Secretariats' mechanisms of control must work jointly with private instruments such as liability and arbitration. Private international law application is useful to organise rules from different legal orders. This methode enables the use of legal measures of one State in another State without looking for uniformity. Private international law, by the environmental function of conflict of laws and conflict of jurisdictions rules, paves the way towards a better interaction between different normative orders and between different law fields. It leads to a more effective cooperation for environmental protection.

L’augmentation des moyens relatifs aux droits de l’homme devant la Cour internationale de Justice pose la question de la forme juridique que prend leur application dans le cadre d’un contentieux de la responsabilité interétatique et généraliste. La procédure de la Cour, conçue en vue de la défense d’intérêts étatiques subjectifs, paraît impropre à tenir compte des relations juridiques complexes dans lesquelles s’établit la responsabilité de l’Etat pour violation des droits de l’homme « internationalement garantis », et se limitant aux rapports de responsabilité bilatéraux entre les Etats parties au différend. Pourtant, au lieu de penser les liens juridiques en cause en fonction des seuls Etats parties au litige et dans des termes d’extériorité de l’individu, la Cour raisonne dans une logique de corrélation. Des relations tripartites émergent entre l’Etat auteur de la violation, les autres Etats également créanciers et débiteurs des obligations, et l’individu titulaire de droits. Mais alors qu’elle est prête à préciser ces relations juridiques, voire à les conceptualiser, la Cour n’en dénature pas pour autant sa fonction juridictionnelle traditionnelle. L’individu est certes pris en compte dans l’engagement de la responsabilité entre Etats : il n’en reste pas moins marginalisé au stade de la mise en oeuvre proprement dite de la responsabilité, mise en oeuvre centrée sur l’Etat et définie par le droit international public. Cette conception particulière de la responsabilité de l’Etat pour violation des droits de l’homme souligne que celle-ci ne saurait être réduite à la relation entre l’individu et l’Etat, dont les autres Etats ne seraient au mieux que les garants désintéressés, mais qu’elle détermine aussi et directement les rapports entre Etats. / The increasing number of human rights based claims before the International Court of Justice raises the question of their implementation in the framework of generalist and interstate litigation. The procedure of the Court has been thought and conceived for the defense of subjective interests of States. Therefore, the Court seems unable to take into account the complex legal relationships in which lies State responsibility for “internationally guaranteed human rights” violations and its scope, limited to bilateral responsibility amongst State parties. But, instead of conceiving the legal connections in dispute as to the only State parties or as external to the individual, the Court endorses a correlation approach. Tripartite relations emerge between the State perpetrator of the human rights violation, other States which are equally creditor and bearer of the obligations infringed and the individual who holds the rights. However although the Court is ready to clarify or even conceptualize the legal relationships involved, it does not distort its traditional judicial function. While the individual is taken into account in the incurrence of State responsibility it is nevertheless marginalized in its implementation, which continues to be centered on the State and defined by public international law. This particular conception of State responsibility for human rights violations underlines that it cannot be reduced to the relation between the individual and the State, for which other selfless States would stand guarantor as the most, but that it also and directly determines interstate relations.

"Whereas victims of ordinary crimes such as theft, robbery, assault or murder find it easier to obtain redress, victims of the most serious violatons such as war crimes, genocide and crimes against humanity receive less attention insofar as their redress is concerned. Apart from some exceptional cases where victims of serious human rights abuses had their right to redress vindicated, there has not been an effective and comprehensive way of redressing victims of gross human rights violations. In Africa for instance, victims' redress in post-Apartheid South Africa and post-genocide Rwanda have been problematic. Thus, it is meaningful investigating how effectively the victims' right to reparation can be implemented in case of gross and systematic human rights violations. Preliminary to the above interrogation are questions such as: what are gross and systematic human rights violations? What are international standards regarding redress for the victims of such abuses? The case studies of Sierra Leone and the DRC will be closely analysed as an empirical foundation for these questions. ... This study consists of five chapters. Chapter one draws the context in which the study emerges. It provides the foundation and the structure of the dissertation.
