Äventyrsgenrens funktioner från fiktionsprosa till interaktiv fiktion : En intermedial jämförelse mellan fyra verk / The Adventure genre’s functions from fiction prose to interactive fiction : An intermedial comparison between four works

The purpose of this thesis is to apply the adventure formulas laid out by John G. Cawelti and the dramatis personae written by Vladimir Propp to the traditional adventure books Le Tour du monde en quatre-vingts jour (1874) and Treasure Island (1883) and the interactive fictions The Secret of Monkey Island (1990) and 80 Days (2014), both in the adventure genre. After they have been applied, I will compare Le Tour du monde en quatre-vingts jour with 80 Days and Treasure Island with The Secret of Monkey Island by how the formulas and dramatis personae work and evolve in the fictions. To start things off, I will present the four works and then go through the relevant parts of Cawelti’s formula and Propp’s dramatis personae. Thereafter, I will explain what interactive fiction might be by using Espen J. Aarseth’s Cybertext. Important concepts will be clarified as well.    The analysis in this thesis starts afterwards. Le Tour du monde en quatre-vingts jour and 80 Days will be the first two works to be analysed after Cawelti and thereafter Propp. When that is done, I will conclude what I have found. The same process will be done with Treasure Island and The Secret of Monkey Island. After that, I will make a concluding comparison between 80 Days and The Secret of Monkey Island and finally conclude whether Cawelti and Propp can be applied to interactive fiction.

Cette thèse avance une hypothèse nouvelle à l’énigme du décor de la Galerie François 1er de Fontainebleau, teste son efficacité sur la totalité de ses 16 unités originelles, cadres compris, et argumente la question de sa vraisemblance. Elle repose sur l’analyse de l’unité décrochée de l’extrémité Ouest en 1639, le Bacchus et Vénus de Rosso, aujourd’hui au MNHA de Luxembourg. Ce tableau est un unicum qui relève des mirabilia . Sous le voile d’une scène érotique, il traite de façon sophistiquée un adage récent d’Erasme, ici écourté : sans Bacchus, Vénus se refroidit. Par art de mémoire plastique, il « mémorise » aussi le schéma de la Monarchie céleste, tel que figuré dans la Treschrestienne Cabale metrifiee (1519) de Jean Thenaud et commenté dans son Traicte de la Cabale (1521), deux manuscrits commandés par François 1er . Par trois motifs en bas du tableau, il indique son mode d’emploi discursif qui s’appuie sur Erasme, puis Cues, puis Bonaventure. Enfin, c’est une peinture fabriquée comme les images artificielles irradiantes du De triplici vita de Ficin, mais sans effet magique. Ce tableau est le centre d’un dispositif à la fois intellectuel, matériel, et pratique, qui relie les 16 unités originelles et invite les princes Valois-Angoulême à une réception spécifique pour verbaliser eux-mêmes le programme de discours organisé. La base intellectuelle de ce dispositif est théologique : elle repose sur le verset de saint Paul (1 Co, XIII, 12), et se réfère à Erasme, Cues, et Bonaventure. Sa particularité est de transposer les concepts mentaux de ces penseurs chrétiens à un décor peint et stuqué, et ce, par serio ludere alors très prisé, en termes d’inventions formelles et d’usages inédits des images, pour générer les discours du programme. Parmi ces inventions, la plus remarquable est la pratique plastique de l’art de mémoire suivant ses règles classiques, dans toutes les unités, cadres compris. Le programme expose la vérité du pouvoir de la monarchie-très-chrétienne, par trois analogies spéculaires au pouvoir de la Monarchie céleste. Il définit des valeurs morales princières, mais aussi deux ambitions politiques majeures, le pouvoir absolu et l’accès à l’imperium mundi par de nouveaux arguments. Il forme le « miroir du prince » secret de la nouvelle dynastie Valois-Angoulême. Ce « miroir » cite aussi le « théâtre » de Giulio Camillo acheté par le Roi en 1530 et éclaire son fonctionnement resté énigmatique. Nous proposons Jean Thenaud associé à Rosso comme concepteurs. / This thesis puts forward a new hypothesis concerning the enigma of the décor of the Francis I Gallery in the royal palace of Fontainebleau, tests whether this hypothesis works for all 16 of its original units, frames included, and considers the question of its likelihood. It is based on an analysis of the unit removed from the western end of the gallery in 1639, Rosso Fiorentino’s Bacchus, Venus and Cupid, now hanging in the MNHA in Luxembourg. This painting is a unicum that falls into the mirabilia category. Behind the erotic scene lies a sophisticated depiction of a recent - here shortened - adage of Erasmus: without Bacchus, Venus grows cold. Using the art of memory, it also “memorises” the paradigm of the heavenly monarchy portrayed in Jean Thenaud’s Treschrestienne Cabale metrifiee (1519) and commented on in his Traicte de la Cabale (1521), two manuscripts commissioned by Francis I. The three motifs at the bottom of the work indicate its discursive modus operandi, drawing on Erasmus, then De Cues, then Bonaventure. It is a painting constructed like the radiant images of Marsilio Ficino’s De triplici vita, but without magical effect. This painting is at the centre of a simultaneously intellectual, material and practical device, linking the 16 original units and inviting a specific reception from the Valois-Angoulême princes so that they can themselves express the organised discursive programme. The intellectual basis of this device is theological in nature: it is founded on the verse of Saint Paul (1 Corinthians 13:12), and refers to Erasmus, De Cues and Bonaventure. It is unique in that it transposes the mental concepts of these Christian thinkers to a painted, stuccoed décor, following the serio ludere maxim, very popular at the time, in terms of formal inventions and original use of images to generate the programme’s rhetoric. The most remarkable of these inventions is the plastic practice of the art of memory, following its classic rules, in all the units, including the frames. The programme exposes the truth of the power of the very-Christian monarchy, via three analogies to the power of the heavenly Monarchy. It defines princely values, as well as two major political ambitions, absolute power and access to the imperium mundi using new arguments. It forms the secrete “mirror for the prince” of the new Valois-Angoulême dynasty. This “mirror” also cites the “theatre” of Giulio Camillo bought by the King in 1530 and illuminates its enigmatic function. We propose Jean Thenaud, supported by Rosso, as the creators.

Entre Sociologie politique et Anthropologie religieuse, cette thèse tente de comprendre l’interaction entre « Religion locale et pouvoir politique» dans la perspective de consolidation du pouvoir en Afrique, plus précisément au Gabon. Elle met l’accent sur la gestion du pouvoir politique en Afrique et analyse les rapports du rite initiatique Ndjobi avec le pouvoir politique dans la communauté Mbede. Ce champ thématique est déconstruit jusqu’à la nation gabonaise à travers l’initiation et l’implication des politiques locaux aux religions locales. Le rite Ndjobi serait une contre-offensive locale visant à réparer l’univers social et à protéger les Mbede. C’est un élément fondamental au maintien de l’ordre à travers le symbolisme de l’Okèlè é Ndjobi qui est l’affirmation par laquelle un initié prend à témoin le sacré et la vérité de la déclaration qu’il profère devant le panier contenant les reliques du Ndjobi. Pour un chef traditionnel, ce rite serait un moyen de compenser une déficience constitutionnelle de son pouvoir politique afin d’entretenir chez ses sujets initiés respect et surtout crainte. Le serment du Ndjobi serait un contrat politique de confiance à un chef de village, à un responsable politique initié à ce rite. A travers cette déconstruction, cette religion locale pourrait être appréhendée comme un support du pouvoir politique gabonais à l’échelle nationale. Les serments se font avec des paroles ; mais en Afrique noire, ces paroles ne sont pas légères. Elles permettent d’agir sur soi, sur les autres et sur le monde concerné comme une contrainte comparable à une épée de Damoclès. Cette contrainte s’exerce d’une manière subtile et imposée avec quelques négociations intra-politiques liées à la « politique du ventre » pour que l’initiation ne s’apparente pas à un acte subi et sorcellaire aux yeux de la population. La sorcellerie comme une sanction du rite Ndjobi est vécue par l’ensemble des Mbede et des initiés politiques, comme une menace permanente d’agression visant leurs corps, leurs biens et leurs familles. En effet, certains chefs traditionnels dit « Nga Mpugu» choisissent la ruse, la fraude, les crimes rituels, la possession matérielle comme moyen politique afin non seulement de contrôler la population, mais aussi de manipuler les envies de pouvoir de leurs adeptes et de leurs proches collaborateurs. En Afrique, « gouverner c’est prévoir » et prévoir, c’est mettre en place un mécanisme permettant d’éviter d’être surpris par l’ennemi qui peut être un proche. Ce serait, en fait, la mise en fonction d’une « Démocratie traditionnelle ». C’est dans ce sens que cette thèse peut s’inscrire dans la perspective de compréhension et d’analyse du politique en Afrique noire à travers les religions locales comme fondement du pouvoir politique malgré l’arrivée actuelle des obédiences religieuses modernes et des parrainages / On horseback between political Sociology and political Anthropology, this thesis try to understand the interaction enter "local Religion and political Power» with the prospect of consolidation of the power Africa, more exactly in the Gabon. It underlines the management (direction) of the power politics and analyzes the relationship enter the initiation rite Ndjobi and the political power in the community Mbede. This thematic field is deconstructed up to the Gabonese nation through the initiation and the implication of the politics premises within this religion. The rite Ndjobi would be a local counter-offensive to repair the universe social and to protect Mbede. It is a fundamental element in the maintenance of law and order through the symbolism of Okèlè é Ndjobi that is the assertion by which an initiated calls in to witness the sacred and the truth of the statement which he utters in front of the basket containing the relics of Ndjobi. For a traditional leader, this rite would be a way to compensate for a constitutional deficiency of its political power to maintain at its introduced subjects respect and especially been afraid, fault of whom its power could widely be imaginary. The oath of Ndjobi would be a political reliable contract to a village headman, to a politician introduced to this rite. Through this demolition, this local religion appears as a support of the Gabonese political power on a national scale and even money regional. Even if the oaths are made with words; but in Black Africa, these words are not light. They allow to act on one, on the others and on the world concerned as a constraint comparable to a sword of Damocles. The constraint practiced in a way subtle and imposed with some intra-political negotiations bound to the «politics of the stomach " So that the initiation undergone is not similar to an act of the witchcraft in the eyes of the population. The witchcraft as a penalty of the rite Ndjobi is lived by all the Mbede and the political initiated, as a threat perms of aggression aiming their bodies, at their goods and at their families. Indeed, every traditional leader says "Nga Mpuhu" always chooses the guile, the fraud, the ritual crimes, the material ownership as political way to make not only control the population, but also to manipulate the desires for power of her followers and for her close collaborators. In Africa, "you saddle today and ride out tomorrow" and plan, it is to set up a mechanism allowing to avoid being was a surprise by the enemy who, generally, is always a close relation. It would be, in fact, the putting according to a "traditional Democracy ". Le contentieux du transfert de connaissances dans les relations entre l'Union européenne et la Chine / Knowledge transfer litigation and arbitration in European Union – China relationships

Face à la mutation des modalités des échanges internationaux et à l'accentuation du commerce de biens intellectuels entre entreprises de traditions différentes, des réajustements des modèles contractuels et un réordonnancement des modes de règlement des différends semblent inévitables. La nature juridique incertaine des connaissances secrètes, en Chine et dans l’Union européenne est un obstacle à la formalisation de leur transfert et par conséquent à la définit ion d’un cadre de résolution des différends adapté. Si les propositions de lois et de direct ive se multiplient pour définir cette notion et son régime, l’approche retenue est souvent limitée à la dimension délictuelle de la divulgation de la connaissance. La recherche menée, tout en tenant compte des atteintes portées au secret, se focalise principalement sur le transfert volontaire de connaissances. Pour répondre aux besoins des acteurs du commerce international, ces opérations ne peuvent plus être limitées aux seuls contrats de « communication de savoir - faire ». Si les notions de « bien intellectuel » et de « possession intellectuelle »permettent de justifier théoriquement d’autres formes contractuelles, les droits chinois et européen se réfèrent aux cessions et licences de connaissances. Ces opérations, souvent insérées dans un ensemble contractuel complexe et réalisées entre parties de cultures différentes,peuvent engendrer des différends variés. Lorsque ces différends apparaissent,le degré de confidentialité assuré devant les juridictions nationales étudiées ne permet pas de répondre aux attentes légitimes des parties. Les différences de cultures processuelles des parties et la culture chinoise du règlement amiable des différends invitent aussi à éviter le recours aux juridictions nationales. Les combinaisons entre médiat ion et arbitrage, par leur grande flexibilité procédurale, peuvent fournir un cadre de résolut ion adapté aux exigences tant économiques que culturelles des parties. Dans cet esprit, la thèse propose la mise en place d’un Règlement de M²arb avec un médiateur–expert, garant de la confidentialité du processus de résolut ion des différends. / Facing the evolution of international trade and the development of intellectual proper ty trade between companies from different backgrounds, contractual model readjustments and a reordering of dispute resolution systems seems unavoidable. The unsettled legal status of secret knowledge in China and in the EU can be an obstacle to the formalization of their transfer and therefore inhibits the definition of a suitable framework for resolving disputes. Legislators and scholars are currently debating proposals of laws and directives to elaborate this concept and its regime, but only address issues liketor t and disclosure of secret information. Legal scholarship to date has mainly been focused on the voluntary transfer of knowledge and has taken intoaccount the damage caused to secrets. To meet the needs of business operators, these operations should not be limited to "know-how communication contracts” (contrats de communication de savoir - faire). The concepts of “ intellectual good” and " intellectual ownership" theoretically justifyother types of contracts, while Chinese and European laws refer to assignment and license of trade secret . These operations, often provided for in a complexs et of contracts between parties from different cultural backgrounds, can lead to a wide variety of disputes. When disputes occur, national courts do not always provide a level of protect ion of confidential information that meets parties’ expectations. Differences in procedural cultures as well as the Chinese culture of amicable dispute settlement prevent the parties from relying on national courts. The combinations between mediation and arbitration, by their procedural flexibility, can provide a suitable dispute resolution framework taking into account economic and cultural considerations. Therefore, this thesis proposes M² arb Rules that introduce a mediator-expert with a mission of securing knowledge confidentiality during the dispute resolution process.

The dissertation in hand is about the theological researches about the mission of the German Mennonite - Brethren - Church in Karaganda I Kasachstan from 1956 to 2000. The existing socialism with its atheistical values affected adversely the lives of the Christians and prevented them from missionary work. In spite of that mission was able to be practised. Experienced preachers and teachers in the church prepared the missionary work by instructing the Christians to be effective witnesses for the Lord. This was achieved by the training of young preachers. regular pronouncements of the Gospel and the work with children and young persons. The Christians retained this method until the middle of the 70ies when the regid laws concerning the missionary work were mitigated. Commited brothers. young persons, preachers and singers visited lonely Christians and churches in remote villages, had personal conversations with unbelievers and organized evangelizations. South African company law is currently the object of comprehensive review. One o f the areas under scrutiny is that of corporate governance. Control over management is vital in the interests of the company itself, its shareholders and its creditors. Effective accountability should be balanced against the need to allow those who manage a certain measure of freedom and discretion in the exercise of their function. Company directors are subject to various duties. This thesis concentrates on their fiduciary obligation. It is suggested that this sui generis obligation is owed to the company as a separate entity. Interests of other groups may sometimes merit con­ sideration. Against the background o f a com parative investigation, a "corporate opportunity" is defined as any property or economic opportunity to which the com­ pany has a claim. South African law protects a company’s claim to an opportunity if it is in the company’s line of business and if the company has justifiably been relying upon the director(s) to acquire it or to assist in its acquisition for the company. The application of established fiduciary principles suffice to resolve corporate opportunity matters. Essentially the application o f these rules amount to a determination whether the director has complied with his fundamental duty to act in the company’s best interests. There seems to be no need for a separate doctrine of corporate opportunities.' A director should only be absolved from liability on account of the company’s inability to pursue an opportunity or its rejection by the company if there was no real conflict of interest. The appropriation of corporate opportunities should not be ratifiable, both because the ratification constitutes a fraud on the minority, and because the decision to ratify cannot be regarded as being in the interests of the company. The relationship between the appropriation of corporate opportunities, misuse of confidential information and competition is investigated. These aspects fre­ quently overlap, but should be distinguished because their bases, and accordingly their appropriate remedies, may differ. Effective control may benefit by a restatement of directors’ fiduciary duties in the Companies Act. To this end certain amendments to the Act are recommended. / Mercantile Law / LLD

Entre Hippocrate et De Coubertin: les obligations professionnelles des médecins face au dopage sportif

Le contexte particulier du dopage suscite de nombreuses questions à l'égard des obligations et de la responsabilité des médecins. Suivant le Code médical du Mouvement olympique (2005), les médecins doivent respecter les principes de l'éthique médicale et ceux de l'éthique sportive, comme le fairplay. Il arrive parfois que l'éthique sportive entre en conflit avec l'éthique médicale. Les médecins sont alors confrontés à d'importants dilemmes qui peuvent engager leur responsabilité professionnelle et civile. Ces dilemmes se situent notamment au niveau de l'obligation de soins et du secret professionnel. Par exemple, les médecins peuvent-ils prescrire des médicaments pour contrer les effets néfastes du dopage afin de préserver la santé des athlètes ? La question de la recherche sur l'amélioration de la performance est également préoccupante. En raison du caractère clandestin de cette recherche, il y a lieu de se demander si les médecins qui y participent respectent leurs obligations professionnelles. L'analyse des principaux instruments normatifs applicables en l'espèce démontre que les médecins ne doivent pas être placés dans une situation telle qu'ils doivent refuser de suivre des athlètes de crainte d'être accusés de dopage. De plus, le secret professionnel devrait être maintenu lorsqu'un médecin suit un athlète dopé afin de préserver la relation de confiance. Finalement, l'analyse du contexte de la recherche portant sur l'amélioration de la performance révèle que les médecins ne respectent pas toujours leurs obligations. Les médecins fautifs risquent donc d'engager leur responsabilité professionnelle et civile et de faire face à des sanctions sévères. / The particular context of doping raises many questions regarding the obligations and the liability of physicians. According to the Medical Code of the Olympic Movement (2005), physicians must respect the principles of medical ethics as well as those of sport ethics, such as fair play. Sometimes, sport ethics conflicts with medical ethics. Therefore, physicians are confronted with important dilemmas, which could engage their professional and civil liability. These dilemmas concern, in particular, the duty of care and professional secrecy. For example, could physicians prescribe drugs to counter the side effects of doping in order to preserve the health of the athletes? Issues surrounding research on the improvement of performance is also of interest. Because of the often clandestine nature of this research, it should be asked whether physicians who participate respect their professional obligations. An analysis of the principal normative documents applicable demonstrates that physicians should not be placed in a situation where they would refuse to treat athletes because of fear of accusations of doping. Moreover, professional secrecy should be maintained when a physician follows an athlete in order to preserve the relation of trust. Finally, the analysis of the context of the research on the improvement of performance reveals that physicians don't always respect their obligations. These physicians might engage their professional and civil liability and face severe sanctions.

The role of a writer in selected metafictional novels Bc. Eva Šulcová Abstract This diploma thesis deals with the genre of metafictional novel. The aim of the diploma thesis is to identify various internal motivations for the usage of metafiction technique in literature and to describe the role of a writer. The first part summarizes the theoretical background of the genre and formulates some characteristic features of metafictional novel (emphasized vicariousness of the narrative, reflection of the creative act, personality of the writer, or the problematized relationship between reality and fiction), which were all illustrated by the analysis of André Gide's novel The Counterfeiters. The second part consists of interpretations of three metafictional novels. The interpretations aim at a complex analysis of the author and at a description of various functions of the metafiction technique as a constituent of the work's meaning. Gide uses metafiction to display the discrepancy between reality and illusion, thus uncovering hypocrisies of society and passing judgement on it. To Čapek, metafiction is a tool for applying multiperspectivity to his storyline, thus creating a metaphor of varying epistemic principles. An exploration of the chasm in the protection of classified information in South African government departments

The chasm in the protection of classified information in South African government indicates that all the departments have at their disposal information that is to some extent sensitive in nature and obviously requires security measures. This study shows that government officials who in their official duties come to contact with classified information are either vulnerable or are implementing the security controls incorrectly. It is also clear that in the absence of a comprehensive statutory framework, the government departments’ classified information has resulted in an unstable and inconsistent classification and declassification environment. The statutory framework would, in addition to other things, address the rising threat of espionage and antagonistic activities, the selling of information and the protection of critical records in government, without hindering the constitutional rights of citizens to access information.
