Assistidos e tutelados : o benefício de prestação continuada e a produção de sujeitos in/capacitados

A presente tese tem como temática principal a implicação das políticas compensatórias para Pessoas com Deficiência, entre as quais o Benefício de Prestação Continuada (BPC). Se, após avaliação social e perícia médica, essas pessoas forem avaliadas como incapacitadas para vida autônoma e para o trabalho, passam a receber do Governo Federal um benefício no valor de um salário mínimo. O problema de pesquisa que subsidia meus questionamentos foi assim definido: quais os efeitos da política de Benefício de Prestação Continuada e seus desdobramentos, como BPC escola e BPC trabalho, nos processos de escolarização, trabalho e produção de autonomia de jovens com deficiência intelectual na contemporaneidade? Para aprofundar as respostas ao problema da pesquisa, levantei as seguintes questões: como as estratégias biopolíticas de governamento da população com deficiência intelectual operam nas políticas compensatórias? Como os programas sociais para pessoas com deficiência, BPC, BPC escola e BPC trabalho, colocam em funcionamento tecnologias de in/exclusão? Como as maquinarias político-assistenciais e compensatórias estão produzindo sujeitos assistidos, mas tutelados? A partir disso, três eixos foram priorizados: família, autonomia e trabalho. No tema em questão, são visibilizadas situações em que um programa social instituído para incluir vem produzindo exclusão. Para enfrentar esse processo, são apresentadas algumas alternativas governamentais. Na linha teórica dos Estudos Culturais, de caráter qualitativo, é utilizado, como uma das ferramentas de investigação, o Grupo de Diálogo com jovens com Deficiência Intelectual que participam de um Programa de Trabalho Educativo (PTE) da Rede Municipal de Ensino de Porto Alegre. Esse Programa tem conseguido subjetivar alguns desses jovens através do trabalho, tornando-os mais autônomos e produtivos. The survey makes visible situations where a social program set to include have produced exclusion and on the other hand has some alternative government built to face this process. Research in theoretical line of Cultural Studies, qualitative, used as one of the research tools Dialogue Group with young people with intellectual disabilities who participate in an educational work program – PTE the Municipal Network of Porto Alegre Education. Research shows that they have been subjectified the work, making them more autonomous and productive, contradicting the main criteria for granting of this benefit - BPC.

An HIV and AIDS group work programme empowering adolescents for the possible death of their caregivers / Korita Olivier

The overarching objective of this study was to develop and empirically evaluate an HIV and AIDS group work programme empowering adolescents to deal with the possible death of their parents/caregivers. This thesis comprised five sections: Section A contains the problem statement, research objectives and the procedures that were followed. Furthermore the limitations of this study were discussed, the definitions of key words were given and an exposition was given of the composition of the research report. The problem statement can be condensed as follows: The large and growing number of adolescents affected by HIV and AIDS makes knowledge concerning their needs essential so as to provide effective interventions. A better understanding of the emotional, social and health needs of adolescents of HIV-infected parents is essential. Responses to adolescents affected by HIV and AIDS should address their needs. Programme development must be done in response to adolescents' needs via their active participation in the entire process. The problem statement led to five research aims. The concurrent embedded strategy was used in this study and was implemented with a mixed method design model. Interviews and questionnaires were used to collect qualitative and quantitative data simultaneously. Literature studies were conducted on the themes HIV and AIDS, adolescence, the needs of adolescents and group work. Section B consists of four articles that together formed the report on the research outcomes. Each article was a report on a particular sub-project of the research and had, as a self-contained unit, an own research aim, research method and report. Each article was linked to the central aim, the objectives and the content of the umbrella research project. The four articles were: > ARTICLE 1: A profile of adolescents' households infected with or affected by HIV and AIDS: A comprehensive profile of adolescents' households infected with or affected by HIV and AIDS was drafted, based on the results gained from interviews with and the completion of questionnaires by 169 households. Data collected and discussed included various demographic data regarding the households, their health and well-being, school attendance as well as information on child-headed households. > ARTICLE 2: The needs of adolescents in households infected with or affected by HIV and AIDS: The needs of adolescents whose caregivers are infected with or affected by HIV and AIDS were discussed. Various basic and developmental needs of adolescents were discussed as well as specific needs they may experience when their caregivers become infected with or affected by HIV and AIDS. > ARTICLE 3: An HIV and AIDS group work programme empowering adolescents to deal with the possible death of their parents/caregivers: An HIV and AIDS group work programme was developed, preparing adolescents for the death of their parents/caretakers and empowering them with skills to be able to deal with it. A needs assessment was done on a large number of adolescents from households infected with or affected by HIV and AIDS. The selection of members for this programme, as well as guidelines for group work with adolescents, were discussed. This article focused mainly on the themes and contents of the designed group work programme. > ARTICLE 4: The evaluation of an HIV and AIDS group work programme empowering adolescents for the possible death of their parents/caregivers: The programme was implemented with 8 adolescents in an experimental group and 8 adolescents in the control group. The Child Functioning Inventory High School (CFI-HIGH) and the Generalized Contentment Scale (GCS) were used as quantitative measuring instruments at two occasions with both groups. The experimental group was also qualitatively and quantitatively evaluated by means of a self-developed questionnaire. Section C provided a summary of the findings and conclusions of the research report in total and some recommendations are provided. Section D consisted of various addenda, such as questionnaires and measuring instruments that were used. SYNOPSIS The thesis has a form of a theoretical study with significant relation to practice in professional volunteer supervision in Kladno Volunteer Center. The thesis is divided in 7 parts. Part One is focused on the definition of basic terms such as volunteer, voluntary work. This part deals with the issue of awarding of volunteers. Part Two is devoted to the basic terminology of social pedagogy, including the definition of free time, the phenomenon, which is very important for both voluntary work and social pedagogy. Part Three is centered at history of social pedagogy and voluntary work. Key intersections of the two studied phenomena and their evolution are described. Part Four describes voluntary activities as a social phenomenon. Subparts are focused on the attitude of society towards voluntary work, the myths associated with it, as well as the volunteer work motivation. In part Five, I was trying to grasp volunteering as a tool of social pedagogy. The subparts combine my findings acquired from books and my own practical experience. Part Six is an analysis of a specific case of "Pět P" programme practice. Part Seven - the final one - includes a small scale empirical research. The single parent family in an inner city context is confronted with a problematic life situation. The demands, which are brought about by single parenthood as well as residence in an inner city environment, often lead to inappropriate parenting. The single parent child is often disrupted on an emotional and social level as a result. In many cases the child handles this disruption inappropriately. The single parent family has a need for resources in the community in order to ensure the continuous emotional, social, psychic and physical well being of its separate members. Involvement in gestalt group work can already be regarded as such an important resource available to the single parent child. Through this research study an investigation was made into the efficiency of a gestalt group work programme in the empowerment of the single parent child to handle the negative experiences of the single parent situation, such as feelings of guilt, anger, confusion, fear, inadequacy, loss, and sorrow and depression. Gestalt group work offers an opportunity to the child to share feelings and experiences regarding the single parent situation within the group context and to receive support from the therapists and other group members. This process strengthens the child’s inner self and the child is empowered to self-support. A complete and refined gestalt group work programme was developed and evaluated from the findings of a literature study and empirical study. The process of intervention research was followed during the empirical study. Data was obtained from seven single parent children in their late middle childhood years in an inner city context and their single parents. The combined quantitative-qualitative approach was used for this purpose according to the dominant-less-dominant model of Creswell. The single-systems design was used to test the effectiveness of the programme. The quantitative findings were obtained by self-developed questionnaires for the child respondents and their single parents, before and after the gestalt group work programme. The qualitative findings were obtained by unstructured observation during the gestalt group work sessions. According to the integration of the quantitative and qualitative findings, the conclusion can be made that the gestalt group work programme brought about an improvement in the child respondents’ emotional and social levels of functioning and their appropriate handling of feelings. The findings obtained, suggest that the developed gestalt group work programme can be implemented with confidence with single parent children in their late middle childhood years in an inner city context. Parisavtalets inverkan på utsläppsrättigheter : En undersökning av handeln med utsläppsrätter och dess förenlighet med Parisavtalets klimatmål / The impact of the Paris agreement on emission rights : An analysis of emissions trading and its compatibility with the Paris Agreement’s objective

Syftet med uppsatsen är att undersöka nyttjande- och överlåtelserätten av utsläppsrätter samt om dessa kan inskränkas under åberopande av Parisavtalet. Parisavtalet är ett internationellt klimatavtal som trädde i kraft år 2016. Avtalet innebär huvudsakligen att ingående parter ska uppnå målet att begränsa den globala temperaturökningen till 1,5 grader Celsius, genom att minska utsläpp av växthusgaser. Avtalets målsättningar innebär inga skyldigheter för parterna, men trots det lades avtalet till grund för en nederländsk dom mot energikoncernen Shell år 2021. Domen innebär för Shell att minska utsläppen med 45 % fram till år 2030 i syfte att uppfylla Parisavtalet, vilket inskränker Shells utsläppsrättigheter. I artikel 3 utsläppshandelsdirektivet uttrycks att innehavaren av en utsläppsrätt har en rätt att släppa ut ett ton koldioxidekvivalenter. I artikel 12 utsläppshandelsdirektivet uttrycks att innehavaren har en rätt att överlåta utsläppsrätter till fysiska och juridiska personer inom unionen. När domen mot Shell inskränker nämnda artiklar, väcks intresset för dels hur exklusivt utsläppsrätter ägs, dels hur rätten att överlåta kan inskränkas. I Sverige regleras utsläppsrätter i lag (2020:1173) om vissa utsläpp av växthusgaser. Sverige har under lång tid framstått som en förebild i att visa resten av världen att man kan föra en offensiv klimat- och miljöpolitik och att fortsätta vara ett välfärdsland. Trots det, kommer Sverige under år 2022 inte lyckas uppfylla sin del av Parisavtalet om inte kraftigare minskningar genomförs, varför rättigheter om utsläpp kan komma att inskränkas även här. Kortfattat framgår följande av uppsatsen. Endast innehavandet av en utsläppsrätt innebär inte en juridisk rätt att släppa ut. För det erfordras tillstånd. Tillståndet är villkorat och utsläppsrätten måste nyttjas inom den tilldelade handelsperioden, vilket innebär att ett exklusivt ägande inte kan anses föreligga. Således uppfyller inte en utsläppsrätt Elgebrants villkor för begreppet egendom. Överlåtelserätten, som innebär en oinskränkt rätt att överlåta utsläppsrätter, faller emellertid under ett undantag vid tillämpning av Parisavtalet. Vidare har överlåtelserätten betydelse för statliga intäkter och företags överlevnad. En successiv minskning av växthusgaser är nödvändig för ett hållbart samhälle. Parisavtalet visar sig kunna inskränka nyttjande- och överlåtelserätten i Sverige under vissa förutsättningar. Försiktighetsprincipen, i 2 kap. 3 § miljöbalken, får även betydelse i frågan.
