[pt] O debate em torno da legitimidade da jurisdição constitucional em detrimento da vontade majoritária, que o Legislativo representa, tem sido objeto de estudo no direito nacional e estrangeiro. No Brasil, a expansão da jurisdição constitucional preocupa estudiosos do tema que vêem no protagonismo do Supremo Tribunal Federal riscos ao processo democrático. Neste cenário, a busca pela efetividade da Constituição, a judicialização dos direitos e as novas ameaças enfrentadas pelas sociedades contemporâneas, conferem ao Judiciário um papel ainda mais proeminente. Através do estudo de casos e da análise de alguns ordenamentos estrangeiros, a presente dissertação examina o fenômeno da correção legislativa de decisão judicial, como um meio capaz de equilibrar a sensível relação entre esses dois Poderes e restabelecer a harmonia do processo decisório constitucional. / [en] The debate about the legitimacy of judicial review to frustrate the majority s will as expressed by a democratically elected legislature has been the object of study and criticism in both national and foreign Law. In Brazil, some scholars argue that the expansion of the Supreme Court s judicial review power may undermind the democratic process itself. In this scenario, the search for effectiveness of the Constitution, the judicialization of rights and the new threats faced by contemporary societies, give the Judiciary a more prominent role. Through case studies and an analysis of foreign legal systems, this thesis examines the overrides of Supreme Court decisions by Legislature as a mean through which the equilibrium between the Judicial and Legislative branches are rebalanced and harmonized within the constitutional decision-making process.

Právní a zdravotně sociální aspekty činnosti OSPOD jako ustanovených opatrovníků v zámu nezletilých dětí

The Czech Republic as a signatory of the Convention on the Rights of the Child has vested the practice of state administration in the field of care for minor children to municipalities with extended powers, where the protection of the rights and legitimate interests of minor children is safeguarded by state authorities of social and legal protection of children (ASLPC hereinafter). These authorities are incorporated to the extent laid down by the Act on Social and Legal Protection of Children (Act No 359/1999 Coll., as amended). The position and roles of ASLPC and their competence and jurisdiction are also regulated by the same act. The position of workers of these authorities and its legal embodiment is equally important. Regarding professionality, there are high demands on these workers. In the Czech Republic, significant changes in legislature have been made over the past three years. These amendments have led to the strengthening of the rights of minor children and to the establishing of new tools for their protection. In connection with the adoption of new substantive regulation of family law, which is now exhaustively dealt with by the Act No 89/2012 Coll., the Civil Code, new procedural rules have been established regarding protection of rights of minor children. Such procedural legislation includes (apart from the long-existent Act No. 99/1963, the Code of Civil Procedure) the Act No 292/2013 Coll., on Special Civil Proceedings. The decision-making regarding minor children has been vested mainly by the state into the competence of courts. The courts appoint the locally relevant ASLPC as a guardian who then represents the interests of minor children. The purpose, interwoven with and derived from the first one, was to explore the opinions of selected social workers of ASLPC and of district court judges regarding the defined problems occurring during the work of ASLPCs and courts while protecting the interests of minor children. These particularly include: the use of the tool of precautionary measure; problems of different territorial jurisdiction of courts and ASLPCs; processing of complaints regarding bias in various phases of the proceedings; professional training of workers of ASLPC It is evident from the proposals of both judges and ASLPC workers that it is necessary to unify territorial jurisdiction. The courts are suggesting the priority criterion of the address where the child mainly resides. ASLPC workers suggest the official permanent residence as the prime criterion. Bias causes problems in all phases of proceedings. It is obvious that courts take differing approaches towards the solution of this problem (some courts solve the problem of bias complaints filed by the parties while other courts do not) and for ASLPC workers it is difficult to assess how to act when such complaint is raised against them. The training of ASLPC workers - workers are obliged to educate themselves and their employer is obliged to finance such training. Not all ASLPCs are able to provide training in the required extent - due to financial reasons (the average costs of education of one employee pose from 9,169 to 13,400 CZK annually and they cover approximately 6 days of training). The heavy work-load caused by insufficient numbers of ASLPC employees prevents them from completing such compulsory training. As part of the examination of the "participation of a collision guardian in court proceedings" it has been found out that irregular participation of the worker in the proceedings (absence from participation in appeals proceedings); incomplete reports (directed to courts) from surveys in families. Based on comprehensive examination of the problems of territorial jurisdiction, it was recommended that requests are independently recorded and financial compensation is provided for ASLPCs who are requested to represent minors in front of courts, to draft proposals for precautionary measures.

A pesquisa levou em consideração as contribuições de importantes autores na formação de uma consciência hermenêutica do Direito voltada à aproximação e comunicação entre o dever-ser normativo com o ser da realidade social, promovendo o desenvolvimento de uma perspectiva pluralista da sociedade e da própria atividade jurisdicional. A forma de abordagem ocorre sob o prima do contexto de uma sociedade complexa e plural no qual se insere a figura do intérprete oficial e suas dificuldades na busca pela decisão mais justa ao caso concreto. Nesse caminho, procura-se afastar alguns mitos da realização democrática dos direitos fundamentais no Brasil e ainda conformar outros deles à teoria delineada no trabalho, dando os contornos principais de uma atividade interpretativa viável ao julgador mesmo em cenário social, à primeira vista, desfavorável.

The taxation of electronic commerce and the implications for current taxation practices in South Africa

This study analyses the nature and implementation of electronic commerce in order to identify possible problems for taxation and pinpoint those problems which may be relevant to South Africa. Solutions suggested by certain countries and institutions are evaluated for possible implementation in South Africa. The study suggests that although current taxation legislation in South Africa is apP'icable to electronic commerce transactions it is not sufficient to cater effectively for this type of business. The conclusion reached Is that international co-operation is essential in finding solutions. The Appellate Division has recently found that the employment relationship not necessarily terminates similarly to the common law contract of employment, but may subsist after termination of the contract of employment. The industrial court does not easily accept that it has been deprived of its unfair labour practice jurisdiction where terminations of employment take place in consequence of a lock-out. The motive of the employer seems to be decisive. In line with both the trend in first world countries and principles established by the courts in South Africa, the Constitution and especially recent labour legislation significantly curtail the bargaining power of the employer because it is progressively being believed that the employer has sufficient economic power to his disposal. / Die omskrywing van die uitsluiting in wetgewing omvat sekere handelinge {onder andere beeindiging van dienskontrakte) wat deur die werkgewer met 'n sekere doel verrig moet word. The Zuma case - important as the first decision of the Constitutional Court - is primarily concerned with the constitutionality of section 217(l)(b)(ii) of the Criminal Procedure Act. In trying to fmd an answer to this question, the Constitutional Court also addressed other important issues. In this dissertation the Constitutional Court's decision on the constitutionality of section 217(1)(b)(ii) is examined, as well as important general principles laid down by the Court regarding incompetent referrals by the Supreme Court; constitutional interpretation; reverse onus provisions and the right to a fair trial; as well as the application of the general limitation clause. A closer look is taken at adherence to these principles in subsequent Constitutional Court decisions, and finally a conclusion is reached on the value of the Zuma case. / Law / LL.M. (Law)

O presente trabalho pretende analisar alguns reflexos da incorporação dos influxos da nova ordem globalizada e do neoliberalismo na ordem jurídica nacional. Será demonstrado que os valores sugeridos ainda que essa sugestão tenha caráter quase cogente pelo Banco Mundial, por meio de sua atividade paranormativa, são incorporados pela ordem legal brasileira através de reformas processuais que priorizam a justiça quantitativa. Essas reformas, somadas a outros fatores tais como o aumento das demandas levadas ao Poder Judiciário, a influência da economia na análise do Direito, a utilização equivocada, irrefletida e mecânica de discursos de fundamentação prévia, a pobreza do ensino jurídico e a submissão dos juízes ao que ditam os tribunais, resultam em um patamar de jurisdição padronizada. Paralelamente a esse processo, a população carcerária brasileira cresce em acelerado ritmo, o que pode ser relacionado com o avanço dos valores neoliberais e da retração do estado do bem estar social.Diante desse quadro, é proposto, como forma de aproximação da teoria jurídica com a prática forense e de maneira a proporcionar abertura do direito penal ao mundo dos fatos, a dogmática funcional redutora, de modo que o Direito Penal atue como dique de contenção do estado de polícia que subjaz a cada estado de direito. Ademais, propõe-se que essa adoção se dê nas salas de aula dos cursos de direito, utilizando-se, tanto quanto possível, de diversos recursos didáticos para tornar mais palpáveis e inteligíveis os conceitos e ideias propostos. / This study aims to analyze some consequences of the new global order and the neoliberalism influence inBrazilian legal system.It will be demonstrated that the values suggested even though this suggestion is, in fact, an obligation by the World Bank, through his paranormative activity, are incorporated by the Brazilian legal system through changes in procedure law, which focus only in quantitative justice. These reforms, added to others factors, such as the growth in the number of cases led to the judiciary, the economy influence in law analysis, the equivocate, unreflective and mechanic comprehension and use of the previously set foundation of judicial decisions, the poor quality law education and the judges submission to the Courts, result in a standardized jurisdiction. Simultaneously, the encarcerated population has grown swiftly, phenomenon that can be related to neoliberalism values widespread and to the weakening of the welfare state.Considering this scenario, as a way to approximate theory and practice of the law and to allow the opening of penal law to exterior facts,it is proposed reductive functional penal law dogmatic, so that penal law can act like a dike that holds the police state that hibernate within every constitutional state. Moreover, it is proposed the use of this theory initiates in law courses, using, as much as possible, several didactics resources to make easier to understand these concepts and ideas.

Thefore, this dissertation is based on theorical studies developed around the subject in Italy and Brazil. Considering the fact that the fundamental rights face a problem of implementation, being decreased its normative force when there are legislative partial omissions lacking constitutional justification creating privileges to certain individuals or social/economical groups over others, the method of additive interpretation according to the Constitution can be used in order to realize the principle of equality. In tax matters the subject is even more relevant in the way that it represents an important role in the economy. Partial legislative omissions can generate inequalities, favoring certain taxpayers in relation to others in similar legal situation. In these cases the privilege may have a negative impact on economic order restricting values related to the basis of market competition. In that which concerns education, the 1988 Constitution is the result of a historical-normative process which, since the days of the Lusitanian Empire wavering between distinct levels of protection warrants in some way the educational process. Nevertheless, not even the State s oldest commitment to education has been fully achieved, namely, the annihilation of illiteracy. Even as other fundamental social rights, education is inflicted with the lack of effective political will to reach its fulfillment, and this is reflected in the production of doctrine and jurisprudence which reduce the efficacy of these rights. The objective of this work is to analyze what part is to be played by the constitutional jurisdiction in the reversal of this picture in regards to the fulfillment of the fundamental social right to education. Therefore it is indispensable to present a proper conception of constitutional jurisdiction its objectives, boundaries and procedures and that of the social rights in the Brazilian context so as to establish its relationship from the prism of the right to education. The main existing obstacles to the effective action of constitutional jurisdiction on the ground of social rights are identified and then proposals so as to overcome them are presented. The contemplative and constructive importance of education in the shaping of the individual as well as its instrumental relevance to the achievement of the democratic ideal through the means of the shaping of the citizen is taken into account. The historical context which leads to the current Brazilian educational system is analyzed, tracing the normative area and the essential content of the fundamental right to education aiming to delineate parameters for the adequate development of the constitutional jurisdiction in the field. This jurisdiction must be neither larger nor narrower than that which has been determined by the Constitution itself. Its activity has been in turns based on a demagogic rhetoric of those fundamental rights which present a doubtful applicability, or falling short of that which has been established showing an excessive reverence to the constituent powers. It is necessary to establish dogmatic parameters for a good action of this important tool of constitutional democracy, notably in regards to the fundamental social right to education, for the sake of its instrumental role in the achievement of the democratic ideals of liberty and equality / O direito fundamental social ? educa??o possui extensa reda??o constitucional, sendo declarado como direito de todos no T?tulo dedicado aos direitos e garantias fundamentais e, posteriormente, dissecado no Cap?tulo da Ordem Social dedicado exclusivamente ao tema, onde s?o garantidos direitos espec?ficos e impostos deveres fundamentais ? fam?lia, ? sociedade e ao Estado.
