Rewarding inventive ingenuity through patent ownership as part of the Australian innovation strategy

The government has indicated that innovation fosters economic growth and is essential to maintaining a competitive position in international markets. Patents are the preferred mechanism by which the Australian Government and other governments encourage their nationals to protect their innovations. The question of the entitlement was raised in several cases in the Federal Court of Australia where there has been a failure to name all of the inventors on a patent grant (non-joinder) or where persons were mis-named as inventors, who were not and consequently have no interest in a grant (rnis-joinder). In both cases, parties who were not themselves daiming an entitlement to the invention, brought objections based on a number of grounds, including entitlement. The results have been the revocation of the patent in the case on the non-joinder of an inventor and in the case of mis-joinder, the preliminary view of a judge of the Federal Court has been, that the patent would be invalid through lack of entitlement. The result is that competitors are permitted to 'exploit' the invention, as the subject matter is not protected by a patent. The implications are far reaching, For example, where a research team in collaboration with another develops an invention but omits the inventive contribution of even one member of one team or includes a person who has not made an inventive contribution in the patent grant, the patent will be invalid. In these circumstances, the author considers that the result produces a disincentive to innovate. Consideration of this area in other jurisdictions reveals that the U.S. and the U.K. have recognised this as an unsatisfactory state of affairs. As a result, Congress in the U.S. made provision in their Patent Code in the early 1950's, that in the case of error or mistake giving rise to a non-joinder or mis-joinder of inventors, the patent would not be invalid but could be rectified by the Director of Patents and Trade Marks (the 'Director'). In the U.K., the Comptroller has powers to deal with a wide variety of cases involving entitlement to ownership of a patent. The situations include but are not limited to cases where some but not all of the persons entitled to the grant have been granted the patent, i.e. non-joinder, or where a person entitled to be granted a patent, has been granted a patent together with a person who is not entitled, i.e. mis-joinder. The thesis will focus on the non-joinder and mis-joinder of inventors, but the U.K. provision addresses a wider field of parties entitled, whether entitled as inventors or on some other basis. In addition, the U.K. and Germany have made provision restricting the persons who are able to challenge a patent on entitlement grounds. This is restricted to those persons having an interest in the patent, rather than open to any person, as is the case in Australia. The Australian decisions have been determined on historic cases dating back to the 17th century. It is timely to consider amendments which will overcome revocation of patents under Australian law, for what is essentially a matter between the persons interested. These amendments will accordingly encourage innovation, particularly in an environment where intellectual property has taken on greater importance and where the identification of the inventor has become more complex as collaborations in research become more common.

Não raras vezes, empreendedores, administradores públicos, juízes e todos os demais operadores do direito se veem em situações que contrapõem a estabilidade das relações jurídicas e a confiança legítima do comportamento estatal à necessidade de proteger o meio ambiente equilibrado para as presentes e futuras gerações. A revisão de licenças ambientais ainda vigentes é exatamente um dos campos onde essa análise tem espaço. Seja em circunstâncias provisórias ou definitivas, seja advinda de uma nulidade anterior ou de um fato ulterior, em determinadas hipóteses a iminência de dano ambiental faz com que o poder público não possa esperar o término da vigência do ato autorizativo para agir. Ao longo do texto, fixam-se as premissas para examinar cinco espécies de revisão: suspensão, modificação, cassação, invalidação e revogação das licenças ambientais, todas orientadas por algumas ideias comuns, mas cada uma delas com suas especificidades. Apresentam-se, outrossim, alguns contrapontos ao cabimento dessas medidas, notadamente a garantia constitucional de proteção do direito adquirido, não como objeção indiscriminada à atuação estatal, mas como forma de limitação dessa nos estreitos contornos traçados pelos princípios envolvidos. A further review of existing environmental permits is one of the fields where this analysis has room. Whether in temporary or definitive circumstances, whether arising from an earlier invalidity or an ulterior fact, under certain circumstances the imminence of environmental damage means that the government can not expect the expiration date of the primitive act to take action. Throughout the text, the assumptions set up to examine five species for revision: suspension, modification, revocation, invalidation and revocation of environmental licenses, all guided by some common ideas, but each with its specificities. They appear, moreover, some counterpoints to the appropriateness of these reviews, notably the constitutional guarantee of protection granted, not as indiscriminate objection to state action, but by way of limitation in this narrow contours outlined by the principles involved. In most European legal systems, drafting a will is subject to formal requirements. In the same way, most European legal systems prescribe formal requirements for the revocation of a will. However, Swedish law is unique in this respect as it does not prescribe formal requirements for the revocation of a will. For the revocation of a will, Swedish law only requires that the testator has unequivocally announced that the disposition no longer expresses his ultimate will. This is stated in the 5th Section of the 10th Chapter of the Swedish Inheritance Code. Under Swedish law, it is therefore only a question of proof whether the testator has revoked his will. However, it may be difficult to assess whether the testator has intended to revoke his will when the testator is alleged to have revoked his will informally. Therefore, the main purpose of this thesis is to examine how the assessment of whether the testator has intended to revoke his will is carried out under current Swedish law. To achieve the purpose of this thesis, a traditional legal dogmatic method is used. This means that the material used is limited to the traditional Swedish sources of law. These are legislation, preparatory works, case law and Swedish legal doctrine. Since Swedish law does not prescribe any formal requirements for revoking a will, a will can be revoked in an unlimited number of ways. It has therefore been necessary to limit the scope of this thesis to the most common ways of revoking a will. For this reason, this thesis only covers the revocation of a will by executing a new will, by physical destruction of a will, by strikeouts and inscriptions on the will, by oral statements made by the testator and by the revocation of a previously revoked will. Consequently, other ways of revoking a will are not closer analysed. The analysis shows that no general conclusions can be drawn on how to assess whether the testator intended to revoke his will. Instead, the assessment depends on the way in which the testator is alleged to have revoked his will. However, the analysis also shows that some more specific conclusions can be drawn. It can be concluded from Swedish case-law that a high standard of proof is required for a revocation allegedly made by an informal measure. However, this does not apply if the will has been destructed. In such cases, there is instead a presumption that the will has been destructed by the testator with the purpose of revoking the will. Consequently, the burden of proof is reversed when the will has been destructed. The analysis also shows that it often can be uncertain whether the testator has intended to revoke his will by an informal measure. This is because there may be no reliable evidence of the testator’s intention in such cases. Therefore, the con-clusion is that a testator who wishes to revoke his will should do so by executing a new will which expressly states that the will is revoked. By doing so, the testator significantly reduces the risk of future disputes concerning the validity of the will.

POTERE PUBBLICO E AUTOTUTELA AMMINISTRATIVA / Public authority and autoprotection powers

La tesi ha per oggetto l’autotutela amministrativa, specialmente quella c.d. decisoria “spontanea”, ovvero quell’insieme di poteri che consentono all’amministrazione di riesaminare i propri provvedimenti e di rimuoverli a vario titolo.
Di questi poteri si è indagato il fondamento dogmatico e positivo. La questione del fondamento è stata per lunghi anni affrontata dalla dottrina e dalla giurisprudenza in termini totalmente pre-critici e non problematici: l’esistenza di questi poteri era semplicemente scontata e le riflessioni sulla loro base giuridica si esaurivano perlopiù nella constatazione della loro necessità nell’immemore consenso circa la loro ammissibilità. Negli ultimi anni, invece, una parte degli Autori ha disconosciuto la natura implicita e per così dire “originaria” di questi poteri e ne ha perciò patrocinato la stretta riconduzione al principio di legalità: in altre parole, l’annullamento e la revoca non sarebbero affatto conseguenza della c.d. inesauribilità del potere amministrativo – negata da questa dottrina – e sarebbero perciò oggi ammissibili unicamente nei casi e nei modi disciplinati dalle due norme introdotte nella legge sul procedimento nel 2005. Ciò a garanzia della certezza dei rapporti giuridici e del legittimo affidamento dei destinatari dei provvedimenti ampliativi. Secondo un filone ricostruttivo in pare contrastante con il primo, altri Autori hanno inteso valorizzare gli elementi de iure condito a favore della obbligatorietà dell’avvio del procedimento di riesame, auspicandone contemporaneamente la generalizzazione, nell’ottica di una più complessiva trasformazione dell’annullamento d’ufficio in un nuovo istituto ibrido, rispondente alla funzione di alternative dispute risolution system o, se si vuole, di ricorso gerarchico. Per le stesse ragioni, l’istituto dovrebbe perdere il carattere ampiamente discrezionale, in favore di una vincolatezza totale o parziale. Questo secondo “fronte di attacco” alla ricostruzione tradizionale intende offrire soluzione al venir meno del sistema dei controlli di legalità sull’azione amministrativa. Lo studio ha sottoposto a verifica entrambi i filoni evolutivi richiamati, discostandosi dal secondo e, pur accogliendo parte delle argomentazioni ad esso sottostanti, anche dal primo. Quanto alla teoria dell’esauribilità del potere amministrativo, oggetto della prima linea evolutiva, si è ritenuto di condividere le considerazioni circa la tutela dell’affidamento degli interessati e della stabilità dei rapporti giuridici. È parsa tuttavia meglio rispondente alle categorie generali e alle esigenze del sistema (anche sulla base di una visione del diritto amministrativo quale “diritto dei terzi”, per natura volto alla tutela dell’interesse generale e non solo dell’interesse privato particolare coinvolto dall’esercizio del potere) la conservazione della tradizionale inesauribilità del potere, seppur assai mitigata, nella pratica, con riferimento all’esercizio dei poteri di ritiro degli atti favorevoli ai privati il cui affidamento sia concretamente meritevole di tutela. La natura discrezionale dell’annullamento d’ufficio (e della revoca), sottoposta a critica dalla seconda linea evolutiva, viene difesa sia sul piano del diritto positivo e pretorio (attraverso la riconduzione dei principali casi di annullamento c.d. doveroso al modello generale), sia sul piano delle categorie generali, a partire dalla natura dei poteri coinvolti e dall’analisi delle posizioni giuridiche dei soggetti interessati dai procedimenti di secondo grado. / The thesis focuses on the Italian system of so called autoprotection or selfprotection. This expression refers to the powers of public administration to revoke its own acts when deemed necessary to repair a vice of legitimacy or a vice of opportunity, without being bind to resort to the courts. Given the aim of this powers – the same of first grade powers plus a semi-judicial one – they are usually meant by judges and scholars as “widely discretionary”. Furthermore, it has always been believed that the choice to activate the correspondent proceeding is totally free for public administration; consequently, a demand of interested parties does not make binding the start of the procedure, opposite to what happens with administrative appeal proceedings. In recent years ECJ, ECHR and national case law has emboldened the limits to selfredress, making clear that legitimate expectations and the public interest to legal certainty must be taken into consideration and given sufficient protection. Lately, also the Legislator followed, making the annulment and the revocation harder to be put in effect when the first act is favorable to the addressed subject. In such cases, the revocation cannot be ordered for a mere reconsideration of already known circumstances (ius poenitendi) but only if new ones show up. At the same time, ex officio annulment is precluded after 18 months from the issuing of the first act, instead of the previous general limit of a “reasonable time”. On the other hand, the case law has apparently pointed out some hypothesis of mandatory annulment, such as for “anticomunitarian acts” and cost-producing acts. Based on these two orientation, some scholars suggested a global rethinking of the self-protection, its bases and its rules. The study analyzes the case law and the latest legislative reforms, proving that no mandatory annulment exists in the Italian legal system. Therefore, nor the ECJ principle of equivalence nor other principles require that selfredress become generally obliged. The thesis also aims to prove that selfprotection remains a discretionary power, in order to ensure that the contrasting needs (the rule of law on the one hand, and the legal certainty and legitimate expectation on the other hand) can be properly balanced in every decision, according to the Constitutional provision of article 97, which requires that both impartiality and good administration are pursued.

Support consumers' rights in DRM : a secure and fair solution to digital license reselling over the Internet

Consumers of digital contents are empowered with numerous technologies allowing them to produce perfect copies of these contents and distribute them around the world with little or no cost. To prevent illegal copying and distribution, a technology called Digital Rights Management (DRM) is developed. With this technology, consumers are allowed to access digital contents only if they have purchased the corresponding licenses from license issuers. The problem, however, is that those consumers are not allowed to resell their own licenses- a restriction that goes against the first-sale doctrine. Enabling a consumer to buy a digital license directly from another consumer and allowing the two consumers to fairly exchange the license for a payment are still an open issue in DRM research area. This thesis investigates existing security solutions for achieving digital license reselling and analyses their strengths and weaknesses. The thesis then proposes a novel Reselling Deal Signing (RDS) protocol to achieve fairness in a license reselling. The idea of the protocol is to integrate the features of the concurrent signature scheme with functionalities of a License Issuer (LI). The security properties of this protocol is informally analysed and then formally verified using ATL logic and the model checker MOCHA. To assess its performance, a prototype of the RDS protocol has been developed and a comparison with related protocols has been conducted. The thesis also introduces two novel digital tokens a Reselling Permission (RP) token and a Multiple Reselling Permission (MRP) token. The RP and MRP tokens are used to show whether a given license is single and multiple resalable, respectively. Moreover, the thesis proposes two novel methods supporting fair and secure digital license reselling. The first method is the Reselling Deal (RD) method which allows a license to be resold once. This method makes use of the existing distribution infrastructure, RP, License Revocation List (LRL), and three protocols: RDS protocol RD Activation (RDA) protocol, and RD Completion (RDC) protocol. The second method is a Multiple License Reselling (MLR) method enabling one license to be resold N times by N consumers. The thesis presents two variants of the MLR method: RRP-MR (Repeated RP-based Multi-Reselling) and HC-MR (Hash Chain-based Multi-Reselling). The RRP-MR method is designed such that a buyer can choose to either continue or stop a multi-reselling of a license. Like the RD method, the RRP-MR method makes use of RP, LI, LRL, and the RDS, RDA, and RDC protocols to achieve fair and secure reselling. The HC-MR method allows multiple resellings while keeping the overhead on LI at a minimum level and enable a buyer to check how many times a license can be further resold. To do so, the HC-MR utilises MRP and the hash chain cryptographic primitive along with LRL, LI and the RDS, RDA and RDC protocols. The analysis and the evaluation of these three methods have been conducted. While supporting the license reselling, the two methods are designed to prevent a reseller from (1) continuing using a resold license, (2) reselling a non-resalable license, and (3) reselling one license a unauthorised number of times. In addition, they enable content owners of resold contents to trace a buyer who has violated any of the usage rights of a license bought from a reseller. Moreover, the methods enable a buyer to verify whether a license he is about to buy is legitimate for re-sale. Furthermore, the two methods support market power where a reseller can maximise his profit and a buyer can minimise his cost in a reselling process. In comparison with related works, our solution does not make use of any trusted hardware device, thus it is more cost-effective, while satisfying the interests of both resellers and buyers, and protecting the content owner's rights.
