[pt] CRIANÇAS E ADOLESCENTES REFUGIADAS E SOLICITANTES DE REFÚGIO NO MUNICÍPIO DO RIO DE JANEIRO: DESAFIOS E PERSPECTIVAS PARA A PROTEÇÃO SOCIAL / [en] REFUGEES AND ASYLUM SEEKERS CHILDREN AND ADOLESCENTS IN THE CITY OF RIO DE JANEIRO: CHALLENGES AND PROSPECTS FOR SOCIAL PROTECTIONROBERTA GOMES THOME 12 December 2019 (has links)
[en] The present dissertation analyzed the challenges and perspectives of the social protection of refugee children and adolescents and refugee applicants in the city of Rio de Janeiro, based on the actions of governmental and non-governmental actors. Therefore, a qualitative approach was undertaken based on interviews with twelve professionals from institutions focused on serving the refugee population and those that make up the Child and Adolescent Rights Guarantee System. In understanding the data collected, we use national and international regulations that regulate the protection of refugees and children and adolescents. The research allowed to discuss the connections between local integration and access to social policies, focusing on the actions and strategies of insertion and the practical and administrative-legal difficulties experienced by this population. The results point to the potential of the intervention of the institutions with this public, but also reveal that the normative frameworks alone are not sufficient for the consolidation of their rights. We conclude that there are still challenges to be faced in the field of social policies that serve this social group whose specificities must be recognized in the development of their services with a view to redressing one more of social inequities.

[en] (DES)CONSTRUCTIONS OF THE INVISIBILIZATION OF REFUGEES IN RIO DE JANEIRO: AN APPROACH ON CULTURAL INTEGRATION / [pt] (DES)CONSTRUÇÕES DA INVISIBILIZAÇÃO DOS REFUGIADOS NO RIO DE JANEIRO: UMA ABORDAGEM ACERCA DA INTEGRAÇÃO CULTURALLETICIA CRISTINA PEREIRA DE CASTRO 17 April 2020 (has links)
[en] From the last decades to the present day, the flow of refugees to Brazil has been increasing. Concerned about the inclusion of refugees within the city, government, institutions and civil society are working to integrate this group of people. Although there are various forms of integration, the most targeted approach since then is economic integration, ie obtaining employment in the host country and consequent economic empowerment of the refugee. Thus, other forms of integration as important as this are eventually forgotten. This work, with the aim of contributing to the debate of public policies aimed at the integration of
forced immigrants, starts from the premise that the lack of attention to the cultural policies related to the integration of refugees in Rio de Janeiro are connected to the difficulties of belonging and visibility within the city. Within this work, firstly, the importance of this debate in the present day is discussed, followed by a bibliographical review that discusses integration processes and the importance of culture in this scenario. Secondly, the report brings, in its case study, a more indepth look at the displacement of Congolese in this context and how the teaching of the Portuguese language is a key element in cultural integration. Finally, some recommendations are made, emphasizing the preponderance of the performance of governmental actors, so that the integration process is done in a more humaneway.

[pt] VENEZUELANOS/AS NO BRASIL: ACOLHIMENTO E CONTROLE – FACES DA POLÍTICA DE PROTEÇÃO AOS REFUGIADOS / [en] VENEZUELANS IN BRAZIL: RECEPTION AND CONTROL – FACETS OF REFUGEE PROTECTION POLICYANA GABRIELA DE PAIVA GONCALVES 04 August 2022 (has links)
direcionamentos dados pelas políticas migratórias brasileiras durante a pandemia e
No caso brasileiro, a
as migrações internacionais.
modos de vida / [en] This master s thesis is the result of a documentary and bibliographic research
conducted during the global pandemic caused by COVID-19 (2020-2022). The
objective of this work was to qualitatively analyze the directions given by Brazilian
migration policies during the pandemic and its repercussions on the Venezuelan
nationality group, since this is the largest migratory flow to Brazil in this period.
We used documentary analysis as a methodological tool, which enabled the
gathering of legal- normative documents related to the humanitarian reception of
Venezuelan migration by the Brazilian State in the period from 2018 to 2021 and
after an overview of the material produced by federal agencies, we selected the
documents to be analyzed in the context of the pandemic. The countries of the
Global-South have been the main routes of migration of Venezuelan citizens and
what we can observe regarding the implemented migration policies, is that the ways
of conceiving and executing them are very diverse and are linked to the process of
regional formation, and social, political and economic aspects of each country,
despite international humanitarian protection and refugee treaties. In the Brazilian
case, the reception of Venezuelan migrants is crossed by the militarization and
regulation of the borders and by precarious practices of reception, even though there
is a change of paradigm in the legal framework that moves towards the
consolidation of Brazil with a more democratic and protective legislation in relation
to international migration. During the pandemic, we can see an inflexion in the
reception of migrants as of the closing of territorial borders by successive
interministerial ordinances under the pretext of epidemiological prevention. Given
the setbacks in the guarantee of rights, it was observed that the design of migration
policy today is still fragmented and contradictory, with challenges and problems
that do not guarantee the migrant and/or refugee universal access to the Brazilian
social protection system. The lack of implementation of intersectoral public policies
in the three spheres of government that welcome migrants based on their
specificities, vulnerabilities, demands, desires and ways of life.

[en] ASYLUM AND EPISTEMIC INJUSTICE IN BRAZIL / [pt] REFÚGIO E INJUSTIÇA EPISTÊMICA: UMA ANÁLISE A PARTIR DO BRASILFLAVIA RODRIGUES DE CASTRO 28 May 2020 (has links)
[en] This thesis is the result of a research on asylum as epistemic injustice, analyzed through the Brazilian eligibility process and the practices of media representation in the country. The concept of epistemic injustice is intimately related to two crucial epistemic practices: conveying knowledge to others and making sense of our own social experiences. Hence, the two main aims of the research are the analysis of knowledge production in the bureaucratic process of eligibility (or refugee status determination process, RSD) and the investigation on how the Brazilian mainstream media represents refugees. To this end, the pluralistic research methods used consist of interview-based fieldwork and corpus linguistics with the help of specific software. The thesis therefore analyzes the space of epistemic practices that have an impact on the refugee category and may contribute to the production of injustices, affecting the lives of asylum seekers and refugees in Brazil.

[pt] A RESPONSABILIDADE DE PROTEGER (R2P) COMO FORMA DE GARANTIA DA SEGURANÇA HUMANA E PREVENÇÃO DA EMIGRAÇÃO / [en] THE RESPONSIBILITY TO PROTECT (R2P) AS A WAY OF GUARANTEEING HUMAN SECURITY AND PREVENTING FORCED EMIGRATION, TAKING SOVEREIGNTY AS RESPONSIBILITYLEONARDO DA CUNHA BARRETO PEREIRA 18 May 2022 (has links)
Além disso, a segurança
Embora seja importante a
[en] Migrations are population movements that exists since the beginning of
humanity and were responsible for shaping the society. Migrants need and should
be welcomed with dignity, but it is also important to analyze the causes of their
migration as a way of ensuring that people only migrate at their free agency. No
human being should be forced to migrate, to leave their country in order to seek for
a decent living condition, exposing themselves to the numerous risks and problems
that this type of migration brings with it. A study of how the responsibility to protect can be an useful tool to prevent forced migrations taking human security as a goal to be guaranteed and sovereignty interpreted as a responsibility, not an absolute
right of the sovereign. In addition, human security through the analysis of situations
inherent to its absence will be considered as an important early warning system in
the search for a way of action with fewer side effects by detecting human
insecurities in the early stages. A briefly analyze of some specific cases where the
responsibility to protect has been used or not, is important. However, the focus will
be prognostic with focus on the potential of the concepts and principles, even if in
the past they have been misused. As will be shown, many of the problems in
applying the responsibility to protect came from political issues rather than from
the concept itself.

[pt] A GRAVE E GENERALIZADA VIOLAÇÃO DE DIREITOS HUMANOS: A PROTEÇÃO (INTER)NACIONAL DA PESSOA HUMANA E A CONSTRUÇÃO DA DEFINIÇÃO AMPLIADA DE REFUGIADA(O) NO BRASIL / [en] THE GROSS AND GENERALIZED VIOLATION OF HUMAN RIGHTS: THE (IN-TER)NATIONAL PROTECTION OF THE HUMAN PERSON AND THE CONSTRUCTION OF THE EXTENDED REFUGEE DEFINITION IN BRAZILADRIANA FERNANDES BASILIO 18 June 2021 (has links)
[en] The present study undertook an analysis about the concept of Gross and Generalized Violation of Human Rights (GGVDH), in an attempt to understand what the foundations of the extended definition of refugee are and how it has been constructed in Brazil. Through a bibliographic and documental research, the data used in this Master s Thesis was collected from the following sources: theses, dissertations, books and articles; reports from government, international and non-governmental organizations; treaties, declarations and legislation. This thesis sought to present the international protective architecture of the human person, investigating its connections with the various mechanisms of International Human Rights Law, their complementariness, regimes, regional and national applications to then, explore the refuge trajectory in Brazil, not only until the construction of the GGVDH concept by the government, but also its recognition. Initially, the international legal framework was presented, their interdependence and relevance to the human protection, culminating in the Cartagena Declaration (1984) and its revision processes. Subsequently, it demonstrated the Brazilian history in terms of refuge, up until the period of re-democratization and incorporation of the GGVDH concept by the Law n 9.474/1997. Finally, it presented a brief analysis of the refugee status recognition under GGVDH in Brazil, in an attempt to map the gov-ernment’s position in relation to this definition, its application and limitations, pointing out some nuances and conclusions.

[en] PERFORMATIVE TRACES IN HUMANITARIAN RECEPTION: MIGRATION AND ASYLUM OF VENEZUELAN LGBTI+ PEOPLE IN OPERAÇÃO ACOLHIDA / [pt] RASTROS PERFORMATIVOS NO ACOLHIMENTO HUMANITÁRIO: MIGRAÇÃO E REFÚGIO DE VENEZUELANAS LGBTI+ NA OPERAÇÃO ACOLHIDARICARDO PRATA FILHO 31 August 2023 (has links)
população no território brasileiro.
Enquanto a lógica humanitária traz consigo as narrativas e protocolos
da crise, da emergência estabelecendo pressa e reforçando ausências constitutivas;
[en] This PhD thesis investigates the humanitarian reception of LGBTI+ people from
Operação Acolhida (2018-2022) as a response from Brazil to the flow of
Venezuelan migrants and refugees in the country, thinking about an overview of
the services offered and the issues that arise in the encounter and integration of this
population in the Brazilian territory. An approach to Judith Butler s performativity
supported by Jacques Derrida will be used as an analytical strategy to understand
the practices, discourses, protocols and rules undertaken in this case thinking about
the reiteration of norms of gender, sex and sexuality, humanitarianism and the State.
In this sense, the text is a partial framing of performative reiterations of the
Operação Acolhida that can (re)create unintentional (im)possibilities for
Venezuelan LGBTI+ migrants and refugees. The LGBTI+phobic social reality
brings with it local and international cultural crossings in which gaps, silences,
segregation and violence prevail. While the humanitarian logic brings with it the
narratives and protocols of crisis, of emergency, establishing haste and reinforcing
constitutive absences; and the State brings with it the demand for containment,
management and government of populations and spaces, creating (un)welcoming
narratives. In this normative and regulatory overlap of the reception context of
Operação Acolhida, the LGBTI+ migrant and refugee population needs medium
and long-term integration and policies that guarantee their rights in the country.
Employability, health and social assistance demands multiply in a universe in which
short-term thinking is centrally reproduced. The limits, problems and advances of
the humanitarian logistical structure are the focus of this work and will outline the
research findings, pointing to a reflection around the adaptation of protocols and a
dialogic critique.

[pt] O PAPEL DA SOCIEDADE CIVIL ORGANIZADA NA INTEGRAÇÃO DE REFUGIADOS NO BRASIL / [en] THE ORGANIZED CIVIL SOCIETY S ROLE IN THE INTEGRATION OF REFUGEES IN BRAZILCAROLINA D ABREU SARMENTO 30 March 2023 (has links)
Dentro desse contexto, o trabalho ressalta a dinâmica do
Assim, no
[en] This dissertation investigates how Brazilian Civil Society Organizations (CSOs)
develop the local integration of refugees, and to what extent they are willing to take on
responsibilities that originally belong to the State under the national and international
commitments signed by it. Within this context, this work highlights the tripartite or shared
responsibility model s dynamics that enable this assignment of responsibility from the State to
the CSOs. To pursue this argument, this work relies on a literature review and interviews
carried out in the field throughout the research. Firstly, this work will analyse the commitments
of International Refugee Law and the current Brazilian legislation regarding refuge and
migration. Then, this work follows by exposing a brief discussion of the concept of local
integration. Finally, this dissertation will look at the role of organized civil society in the local
integration of refugees in Brazil. In this part, this work will consider the perspectives brought
by interviewees to advance its argument, and then, conclusions are exposed from the evidence.

[pt] O ACOLHIMENTO DE CRIANÇAS REFUGIADAS DESACOMPANHADAS NAS AMÉRICAS: UM ESTUDO COMPARADO ENTRE OS PROCESSOS DE PROTEÇÃO E ACOLHIDA DE BRASIL E EUA / [en] THE RECEPTION OF UNACCOMPANIED REFUGEE CHILDREN IN THE AMERICAS: A COMPARATIVE STUDY BETWEEN THE PROTECTION AND RECEPTION PROCESSES IN BRAZIL AND THE USACAROLINA FRANCA TRISTAO BATISTA 18 April 2023 (has links)
de fronteiras / [en] The Americas are experiencing the worst refugee crisis in history,
characterized by the elevated presence of unaccompanied children. This work seeks to
conduct a comparative study between reception policies for this group, considering
Venezuelans in Brazil and nationals from the Northern Triangle of Central America in
the USA. It was examined whether the reception processes and their applications are
inclusive and adequate for unaccompanied minors, in light of the guidelines of
reference organizations in the area. This study concludes that the Brazilian reception
process aims to be receptive and inclusive, following the principle of the best interest
of the child. However, the procedures lack more robustness and structure to be
effective. Reception policies in the US are more mature and have the resources
available for implementation. However, the reception is hostile, similar to
the detention process, with no institutional distinction between refugee child protection
and border control.

[pt] DA CONSTITUIÇÃO DOS REGIMES DE REFÚGIO À GESTÃO MIGRATÓRIA MILITARIZADA DA OPERAÇÃO ACOLHIDA / [en] FROM THE CONSTITUTION OF THE REFUGEE REGIMES TO THE MILITARIZED MIGRATORY MANAGEMENT OF OPERATION WELCOMEMOISES DA SILVA ANDRIOLO 09 November 2021 (has links)
[en] This work presents a historical constitution of the refugee protection regimes, in their three spheres - global, regional, and national – assuming its complementarity in consolidating the protection to the forced displacement. Starting from a constructivist presupposition, this approach will present the refuge protection framework as historical constructs fostered within social interactions, and which are in a continuous flow of specification over the new human needs. From this constructivist perspective that integrates interdisciplinary approaches to the international studies, the word regime will be used, in relation to the constructions of protection, with norms, principles and procedural pathways, around the theme of refuge. Thus, framed by a chronological structure, this research will start from the broader sphere of the 1951 Convention, passing through the sphere Regional, to culminate in the framework of national refugee protection. Special focus will be given to the regional sphere in expanding the definition of refugee, which takes place in Latin America, through the 1984 Cartagena Declaration, to overcome the Eurocentric limits of the classic definition. This approach of the region is connected to Brazil, which incorporates in law 9.474/97 the international classical definition and the expanded definition of serious and widespread human rights violations in Cartagena. Tracing this path, this dissertation presents, within the framework of the national refugee regime, the Brazilian response to the flow of Venezuelans, through the Operation Welcome. Therefore, we will analyze the axes of this Brazilian militarized migratory management, which occurs with strong prominence of the Armed Forces. Thus, this work highlights the simultaneity of the humanitarian and security logic of this national response, which demonstrates ambivalence between protecting the Venezuelans and protecting ourselves from them.
