A modulação temporal de efeitos como técnica de decisão possibilita ao Supremo Tribunal Federal a mitigação dos efeitos retroativos da declaração de inconstitucionalidade, ao mesmo tempo em que resguarda o princípio da supremacia da Constituição. Nos casos em que há mudança de jurisprudência, atua como importante mecanismo de salvaguarda das legítimas expectativas dos jurisdicionados na estabilidade dos julgados do Tribunal Constitucional. Em ambas as hipóteses, concretiza o princípio da segurança jurídica, inclusive na sua vertente subjetiva, a proteção da confiança legítima e assegura a melhor realização dos interesses públicos, próprios de uma sociedade pluralista. / The prospective doctrine as a decision technique makes possible the mitigation of the retroactive effects of the unconstitutionality declaration to the Brazilian Federal Supreme Court, at the same time it protects the Constitution supremacy principle. In cases with statement of overruling precedents, it plays an important role in protecting the legitimate expectations of the citizens in the stability of the Constitutional Court precedents. In both cases, it enforces the principle of legal certainty, including its subjective aspect, the legitimate confidence protection and it assures the best fulfilment of the public interests that are typical of a pluralist society.

The opening of Peru to foreign markets in the past 20 years is a consequence of the signature of several Free Trade Agreements (FTA) with our main partners in business, both on a bilateral and multilateral level. In this article, on the one hand, important changes to customs regulations concerning obligations arose from the signature of several FTA will be analyzed and, on the other hand, a comparative analysis regarding regulations about facilitation of commerce and customs procedures contained in FTA signed with our main Asian partners in business will be developed. / La política de apertura comercial que el Perú ha venido impulsando desde hace más de 20 años ha originado la suscripción de sendos acuerdos comerciales con nuestros principales socios comerciales tanto a nivel bilateral como multilateral. En el presente artículo, de un lado, se desarrollan los importantes cambios generados en la normativa aduanera con ocasión de las obligaciones emanadas de la suscripción por parte del Perú de diversos TLC; y, de otro, se efectúa un análisis comparativo de las disposiciones en materia de facilitación del comercio y procedimientos aduaneros contenidas en los TLC suscritos con nuestros principales socios comerciales del Asia.

Apesar de o direito ser feito para trazer estabilidade à sociedade e garantia a seus membros, hoje em dia no Brasil esse propósito não se verifica adequadamente como deveria. Este trabalho se concentra na segurança jurídica, uma expressão no direito romanogermânico que contém a idéia de como o direito deve dar ao povo um sentido de certeza e também embasa a coisa julgada e o controle de constitucionalidade. Na verdade, o sentido de estabilidade no direito brasileiro está em crise. Este estudo procura saber o motivo e tenta achar uma resposta na doutrina e nas decisões do Supremo Tribunal Federal para entender como isso afeta a coisa julgada e o controle de constitucionalidade. A conclusão leva à idéia de que o modelo de controle difuso de constitucionalidade sem a vinculação obrigatória dos precedentes, combinado com um enfoque no controle concentrado e abstrato de constitucionalidade é a causa de vários problemas, afetando não apenas o conceito de coisa julgada mas também trazendo danos à segurança jurídica. / Altough law is made to bring stability to the society, and assurance for its members, nowadays in Brazil its purpose is not occurring properly and as it should do. This work focuses on legal security, a term in civil law that contains the idea of how law must give people a sense of certainty, and also supports the res judicata and judicial review. Actually, the sense of stability in Brazilian law is in crisis. This study wonders why and tries to find an answer in jurisprudence and in the Supremo Tribunal Federal (Brazilian supreme court) decisions to understand how it affects the institutes of res judicata and judicial review. The conclusion leads to the idea that a judicial review model without stare decisis combined with the classic civil law constitutional court is the cause of several problems, affecting not only the concept of res judicata but also damaging the legal security.

Trata sobre a relação entre interpretação e a mutação constitucional, destacando necessidade de se reconhecer as transformações constitucionais pela evolução da jurisprudência. The fixedterm contract to meet the temporary need of exceptional public interest is an exception, but there are two situations that lead its declaration: the extension of contracts beyond the time limit allowed by law, when there is no more the aspect of temporary need or hiring to work on activities that are not included on the exhaustive list of the law authorizing. In these cases, the majority jurisprudential understanding is that the contract must be declared invalid retroactively and the worker has only the right entitled to payment of the consideration agreed, upon in relation to the number of hours worked, respected the value of the minimum wage, and the values related to FGTS deposits. This placement, however, forsake an employee who acted in good faith and relied on the legitimacy of actions taken by the state, besides did not do reference about the punishment of the agent responsible for the unlawful administrative act. The systematic reading of the constitutional text reveals the necessity to maintain legal certainty, which is effective, in this case, with the protection of the worker in the face of the nullity of recruitment by the Public Administration. To do so, must be declared the invalidity of the contract with effects ex nunc, preserving the factual situation to the past tense statement, with the State ordered to compensate the work done with all sums, other than those typical of remission without cause, because the termination of the contract was made by virtue of its declaration of invalidity. / A Constituição brasileira estabelece como regra para investidura em cargos e empregos públicos a aprovação prévia em concurso público, sob pena de nulidade. O contrato por tempo determinado para atender a necessidade temporária de excepcional interesse público é uma exceção, mas há duas hipóteses que ensejam sua nulidade: a prorrogação dos contratos para além dos prazos autorizados pela legislação, quando não mais existe o aspecto temporário da necessidade ou a contratação para atuar em atividades que não estão relacionadas no rol taxativo da lei que a autoriza. Nestes casos, o entendimento jurisprudencial majoritário é de que o contrato deve ser declarado nulo retroativamente e o trabalhador tem direito apenas ao pagamento da contraprestação pactuada, em relação ao número de horas trabalhadas, respeitado o valor da hora do salário mínimo, e dos valores referentes aos depósitos do FGTS. Este posicionamento, contudo, desampara o trabalhador que agiu de boa-fé e confiou na legitimidade dos atos praticados pelo Estado, além de ser omisso no tocante à punição do agente responsável pelo ato administrativo inválido. A leitura sistemática do texto constitucional revela a necessidade de manutenção da segurança jurídica, o que se efetiva, nesta hipótese, com a proteção deste trabalhador em face da nulidade de contratação pela Administração Pública. Para tanto, deve-se declarar a invalidade da contratação com efeitos ex nunc, resguardando a situação fática pretérita à declaração, sendo o Estado condenado a indenizar o trabalho prestado com todas as verbas contratuais trabalhistas, excluindo-se aquelas típicas da dispensa imotivada, pois a extinção do contrato se deu em virtude de sua declaração de nulidade.

En droit communautaire, les notions « souples », « élastiques », les « mots à sens multiples » ,dont le contenu est déterminé non pas par leur auteur mais par leur interprète, sont nombreux. <p>Parmi ces notions « floues », certaines, à la fois conceptuelles et fonctionnelles, sont intentionnellement indéterminées parce qu’elles permettent une mesure des comportements et des situations en termes de normalité et nécessitent, pour leur application aux cas d’espèce, des références exogènes au droit. C’est le cas, par exemple, des notions de « bon père de famille », de « bonnes mœurs », de « délai raisonnable », d’« abus de droit », de « confiance légitime », ou encore d’ « ordre public ». <p>Ce type particulier de notion indéterminée constitue un standard. <p>La question se pose de savoir si, et dans quelle mesure, les standards présentent des particularités dans l’ordre juridique de l’Union européenne, du point de vue de leur substance, c’est à dire de leur contenu, et du point de vue de leur fonction.<p>Il apparaît, d’abord, que la spécificité substantielle du standard n’est que partielle. <p>En effet, certains standards sont marqués par une forte coloration communautaire en ce qu’ils touchent au noyau dur de l’intégration communautaire et à la répartition des compétences au sein de cet ordre juridique (les notions de subsidiarité, de coopération loyale notamment). Commuting time choice and the value of travel time

In the modern industrialized society, a long commuting time is becoming more and more common. However, commuting results in a number of different costs, for example, external costs such as congestion and pollution as well as internal costs such as individual time consumption. On the other hand, increased commuting opportunities offer welfare gains, for example via larger local labor markets. The length of the commute that is acceptable to the workers is determined by the workers' preferences and the compensation opportunities in the labor market. In this thesis the value of travel time or commuting time changes, has been empirically analyzed in four self-contained essays. First, a large set of register data on the Swedish labor market is used to analyze the commuting time changes that follow residential relocations and job relocations. The average commuting time is longer after relocation than before, regardless of the type of relocation. The commuting time change after relocation is found to differ substantially with socio-economic characteristics and these effects also depend on where the distribution of commuting time changes is evaluated. The same data set is used in the second essay to estimate the value of commuting time (VOCT). Here, VOCT is estimated as the trade-off between wage and commuting time, based on the effects wage and commuting time have on the probability of changing jobs. The estimated VOCT is found to be relatively large, in fact about 1.8 times the net wage rate. In the third essay, the VOCT is estimated on a different type of data, namely data from a stated preference survey. Spouses of two-earner households are asked to individually make trade-offs between commuting time and wage. The subjects are making choices both with regard to their own commuting time and wage only, as well as when both their own commuting time and wage and their spouse's commuting time and wage are simultaneously changed. The results show relatively high VOCT compared to other studies. Also, there is a tendency for both spouses to value the commuting time of the wife highest. Finally, the presence of hypothetical bias in a value of time experiment without scheduling constraints is tested. The results show a positive but not significant hypothetical bias. By taking preference certainty into account, positive hypothetical bias is found for the non-certain subjects.

La rétroactivité de la jurisprudence. Recherche sur la lutte contre l'insécurité juridique en droit civil / The retroactivity of the case law. Study on the legal certainty in French private law

La rétroactivité étant un mode d’application d’une règle de droit dans le temps, il convient de se demander en premier lieu si le juge crée des règles de droit afin de savoir si la jurisprudence est rétroactive ou seulement déclarative. Pour répondre à cette interrogation, il a paru nécessaire de définir la règle de droit comme la règle ayant vocation à être utilisée par un juge pour trancher un litige. Puis, pour savoir si plus précisément le juge posait de telles règles de droit, il a été fait recours aux règles de reconnaissance de Hart, invitant à regarder l’attitude du législateur, du juge et du peuple pour voir si la jurisprudence était considérée comme source du droit. La réponse est affirmative en ce qui concerne celle de la Cour de cassation. Il devient alors nécessaire en deuxième lieu de s’interroger sur la cause de cette rétroactivité. La théorie naturaliste, soutenant que toute règle de droit est naturellement rétroactive, et la théorie mécaniste, expliquant la rétroactivité par la nécessité pour le juge d’appliquer la règle créée au litige qui lui est soumis, ont paru devoir être écartée. Le fondement de la rétroactivité serait la théorie de l’incorporation, dont l’application aux créations jurisprudentielles et aux changements d’interprétation serait justifiée par la prohibition des arrêts de règlement. Dès lors, et en troisième lieu, comment lutter contre l’insécurité juridique produite par la rétroactivité jurisprudentielle ? Deux solutions paraissent efficaces : soit permettre à la Cour de cassation de rendre des arrêts de règlement, soit introduire une sorte de référé législatif permettant à la Cour de cassation de demander au législateur de modifier la norme, plutôt que d’opérer un revirement rétroactif. Puisqu’il nous paraît opportun de conserver une complémentarité entre la loi et la jurisprudence, seule la création d’un référé-suggestion semble être une solution satisfaisante au problème de la rétroactivité de la jurisprudence. / As retroactivity constitutes an application process of the law in time, it is worth first asking whether a judge's rulings are considered as a rule of law whether such case law is retroactive or declarative. To answer this question, it seemed necessary to define the rule of law as the rule that is intended to be used by a judge to settle a dispute. Then, to check whether the judge do make such rules of law, the Hart recognition rules were applied, inviting us to look at the attitude of the legislator, the judge and of the people to see if case law was considered as a source of law. The answer is yes with respect to the French Supreme Court's case law (Cour de cassation). It then becomes necessary to question the cause of this retroactivity. The naturalistic theory, which provides that any rule of law is naturally retroactive; and the mechanistic theory which justifies retroactivity by the need for the judge to apply the rule created by its ruling to the dispute brought before him had to be excluded. The basis of retroactivity would be the incorporation theory, the application of which to case law as well as to changes in interpretation would be justified by the prohibition of regulatory judgements (arrêts de règlement). Therefore one may wonder how to avoid the legal uncertainty produced by the retroactivity of case law ? Two solutions seem to be effective: either to enable the French Supreme Court to make regulatory judgements, or to introduce a kind of legislative summary proceedings enabling the French Supreme Court to request from the legislator to amend the rule, instead of creating a retroactive overruling decision. As it seems appropriate to maintain the complementarity between statutory law and case law, the creation of a legislative summary proceeding appears to be the only satisfying solution to the case law retroactivity issue.

The unilateral determination of price in contracts of sale governed by the Consumer Protection Act 68 of 2008

The purpose of this dissertation is to investigate the application of the common law rule prohibiting unilateral price determination in contracts of sale governed by the Consumer Protection Act. The unilateral determination of price has been a controversial issue for an extended period of time. This controversy is traced back to Roman law where different translations and interpretations are given to the texts dealing with the unilateral determination of price in a contract of sale. The majority of the Roman-Dutch writers preferred the view that regarded a contract granting a discretion to one of the parties to determine the price as void. Subsequently, this view was incorporated into South African law. During the 1990s the Supreme Court of Appeal questioned whether the rule should still form part of South African law. An overview of the case law indicates that the courts have been prepared to allow contractual price discretions provided such discretions refer to an objective external standard or reasonableness. There are also indications that the courts would imply that the discretion should be exercised reasonably, except in the case of clearly unfettered discretions. Recently, the Consumer Protection Act 68 of 2008 ("the CPA") has made substantial amendments to the law of sale in respect of contracts governed by the CPA. The dissertation investigates the influence of the CPA on the rule governing unilateral price determinations in such sales. It also investigates the consumer's fundamental rights to disclosure of information and fair, just and reasonable terms and conditions. Legal uncertainties and issues arising from the provisions of the CPA are identified. Finally, a comparative study with English law is undertaken which provides a comparative basis from which possible solutions are extracted and proposals made to address the uncertainties and issues emanating from the CPA. Deep Learning for Whole Slide Image Cytology : A Human-in-the-Loop Approach

With cancer being one of the leading causes of death globally, and with oral cancers being among the most common types of cancer, it is of interest to conduct large-scale oral cancer screening among the general population. Deep Learning can be used to make this possible despite the medical expertise required for early detection of oral cancers. A bottleneck of Deep Learning is the large amount of data required to train a good model. This project investigates two topics: certainty calibration, which aims to make a machine learning model produce more reliable predictions, and Active Learning, which aims to reduce the amount of data that needs to be labeled for Deep Learning to be effective. In the investigation of certainty calibration, five different methods are compared, and the best method is found to be Dirichlet calibration. The Active Learning investigation studies a single method, Cost-Effective Active Learning, but it is found to produce poor results with the given experiment setting. These two topics inspire the further development of the cytological annotation tool CytoBrowser, which is designed with oral cancer data labeling in mind. The proposedevolution integrates into the existing tool a Deep Learning-assisted annotation workflow that supports multiple users.
