Magistro baigiamajame darbe analizuojamas priėmimo į valstybės tarnybą procesas Lietuvoje ir Airijoje. Pirmoje dalyje yra analizuojami Lietuvos priėmimo į valstybės tarnybą aspektai, istorinė valstybės tarnybos raida, dabartinė teisinė bazė, reglamentuojanti priėmimą, bei pats priėmimo procesas, taip pat pabrėžiamos problemos, su kuriomis susiduriama priėmimo procese. Antroji dalis atskleidžia Airijos priėmimo į valstybės tarnybą aspektus. Analizuojama teisinė bazė bei pagrindinių institucijų, įgyvendinančių priėmimo į valstybės tarnybą politiką, funkcijos. Aptariamas priėmimo į valstybės tarnybą procesas bei su tuo susijusios problemos. Trečioje dalyje yra lyginami įvairūs priėmimo į valstybės tarnybas abiejose šalyse aspektai. / The purpose of this Master Thesis is to analyse recruitment processes in Lithuania and Ireland. First part of the Thesis analyses recruitment policy implemented in Lithuania, its’ historical evolution, legislative background and current recruitment system and problems which occur while recruitment procedures are in process. In second part Irish recruitment policy is examined, functions of most important institutions involved in recruitment policy implementation discussed, and recruitment process explained. In third part, policies implemented in both countries are compared.

Išanalizuotas personalo organizavimo procesas Socialinės apsaugos ir darbo ministerijoje, pateiktos personalo organizavimo tobulinimo galimybės. Ministerijoje personalo organizavimas išanalizuotas pagal šiuos etapus – personalo atranka ir priėmimas, tarnybinės veiklos vertinimas, mokymas bei kvalifikacijos kėlimas, skatinimas. / Human resources are of great importance in any institution as the operating efficiency of the institution depends on capacity, use of potential of such resources and an adequate organisation process. The present Master‘s Thesis summarises the theoretical background of staff organisation and provides a review of the civil service system of the Republic of Lithuania. The staff organisation process in the Social Security and Labour Ministry was analysed and measures of the staff organisation improvement are presented. The staff organisation in the Ministry was analysed by stages, i.e., staff selection and recruitment, civil servants’ performance appraisal, training, qualification improvement and stimulation.

Em uma sociedade cada vez mais complexa e sofisticada, e em nosso contexto com especial atenção às relações empresarias e econômicas, há cada vez menos espaço para um olhar ancorado em representações estanques. Por conta disso, e com o advento das International Financial Reporting Standard (IFRS) no Brasil, suportada pela Lei n° 11.638/07, iniciou-se uma nova visão contábil priorizando evidenciação mais refinada visando refletir mais fidedignamente as transações das empresas. Talvez o que melhor simbolize esse novo enfoque seja o viés principiológico das IFRS. Entretanto, a inquietação surge quanto a um ponto específico de sua efetiva implementação na sociedade. Se o incentivo ou o direcionamento das avaliações que o recém-egresso se submete em relação ao seu conhecimento contábil, tanto no exame de suficiência como na busca por colocação no mercado de trabalho via concurso público, poderia estar desalinhada aos novos ideais buscados pelas IFRS por meio dos princípios. Com base na teoria da avaliação, Preskill e Torres (1999) alertam que a avaliação precisa integrar o aprendido à prática da sociedade. Da mesma forma, Patton (1997) relembra que é fundamental que o avaliador enfrente o desafio de fazer avaliações que sejam correlacionadas em sua aplicação e úteis. Com a vinculação da nova visão principiológica com a teoria da avaliação, através das definições apresentadas pelos autores acima, foi então analisado, utilizando-se do método Delphi, se as provas de credenciamento contábil e as provas dos principais concursos públicos federais têm utilizado em maior número as questões principiológicas. Os resultados, porém, evidenciaram o contrário, mostrando que há uma maior cobrança de regras nas provas analisadas, ou seja, nestes exames, ainda existe a predominância do modelo regramental apenas sob o manto das IFRS. Deste modo, percebe-se uma possível existência de descompasso entre os ideais relacionados às IFRS e o direcionamento indutor das avaliações de recém-egressos e de profissionais da área contábil. / In an increasingly complex and sophisticated society, and in our context with special attention to business and economic relations, there is lesser space for an anchored view in stationary representations. In this regard, and with the advent of the International Financial Reporting Standard (IFRS) in Brazil, supported by Law No. 11,638 / 07, a new accounting approach was initiated prioritizing disclosure that is more refined in order to reflect more accurately corporate transactions. Perhaps, what best symbolizes this new approach is the principles bias of IFRS. However, the concern arises related to a specific point of its effective implementation in society. If the incentive or direction of the assessments that a new graduate undergoes in relation to his / her accounting knowledge, both in the professional entry exam and in the search for placement in the job market (civil servant), could be misaligned with the new principle ideals defended by IFRS. Based on evaluation theory, Preskill and Torres (1999) warn that evaluation needs to integrate learning and society practice. Similarly, Patton (1997) recalls that it is critical that an evaluator faces the challenge of making evaluations that are correlated in their application and useful. By linking this new principiological vision with evaluation theory, through the definitions presented by the authors above, professional entry exams and tests as part of civil servant selection have been analyzed by Delphi method to find out if they have used principiological questions in larger numbers. The results, however, indicate the opposite idea. They showed that there is a bigger charging of rules in the tests that were analyzed, in other words, there is still a predominance of the rule model with a single difference: now under IFRS cloak. Thus, there is a possible existence of mismatch between the ideals related to IFRS and the inductive orientation of the assessment directed to new graduates and professionals in the accounting area.

【研究目的】 管理理論從素樸的績效評估過渡到發展性的績效管理,反映了從集權控制轉向分權參與的趨勢,一方面更加著重於人力資源發展,對政府部門而言,目的尚在鞏固文官的中立能力。惟我國以績效管理為名進行考績制度的改革時,似乎仍執著於命令與控制手段的討論。準此,本研究首先檢討現行考績參與機制的良窳,再探詢公務人員對於考績制度民主化的認知,以此剖析制度轉變可能遭遇的困境,最後依據實務可行性重構參與式考績制度。 【研究問題與研究方法】 本研究採質化方法逐一針對研究問題分析之,分別為考績制度是否有體現民主價值的必要?考績委員會是否有助組織管理的民主化?公務人員是否認同考績制度體現民主價值?如何從民主行政角度設計參與式考績制度?本研究以次級資料及文獻分析法論證考績制度體現民主價值的必要性及考績委員會的制度起源;再從深度訪談法分析考績委員會是否發揮功能,以及公務人員對考績制度民主化的認知及接受度;最後綜合所有質性資料提出參與式考績制度的改革建議。 【研究發現】 本研究從理論與訪談論證考績制度的權力集中化將扼殺文官的專業能力,而考績委員會雖企求藉民主參與確保程序正義,卻仍將上下從屬的權力結構複製進獨立委員會,失卻水平制衡的功能。而以部分機關試行績效管理的經驗及深度訪談的假設性詢問發現,行政人員普遍無法接受考績制度開放民主參與,僅期盼獲悉考核原委,故仍將制度正義寄託在考核者身上。推其原因在於集體行動的邏輯、橫向組織力量的匱乏,以及家長式領導的文化,使組織民主遭到實用性價值的貶低。最後本研究在不侵犯管理權威的前提下,從資訊公開角度主張考核資訊透明化及考績委員會「實質參與」,作為考績制度改革的建議。

That said, the current paper aimed at analyzing the expansion effects on the Brazilian Professional Educational Scientific and Technological Network in the organizational culture under the perspective of civil servants of IFPB. It is a qualitative and quantitative study based on a case study with a descriptive approach. Data were collected through a semi open questionnaire which was sent to all the civil servants who attend the Rectory through the institutional e-mail and which was anonymously and voluntarily answered by using the electronic form Google Drive. The answers aimed at characterizing the civil servants’ profile, identifying satisfaction levels, their perception in relation to the organization culture and the expansion process set at IFPB and to verify whether the civil servants have influenced somehow the construction of a new institution of if they have been influenced by it. The results have pointed that the civil servants are fully satisfied with their work nor with the existing culture. The vast majority sees the IFPB’s EPCT expansion as positive and fruitful, however, they indicate that it has been poorly planned and disorganized, permeated by a hierarchy and bureaucratic organizational culture that has been crystalized in the institution. Another significant group see themselves as influencing a new culture at IFPB, despite the hindrances and barriers that they face on a daily basis. To sum up, the results have pointed to the need of new managerial practices that value the organizational culture that is centered on the human being as a vector of organizational change. / Considerando uma visão de cultura organizacional no serviço público instalada na opinião da sociedade e diante do cenário de expansão da Rede Federal de Educação Profissional, Científica e Tecnológica (EPCT) brasileira, verificou-se a oportunidade de realização de um estudo sobre a expansão da Rede Federal de EPCT e sua relação com a cultura organizacional do Instituto Federal da Paraíba - IFPB. O presente estudo teve como objetivo analisar os efeitos da expansão da Rede Federal de Educação Profissional, Científica e Tecnológica (EPCT) na cultura organizacional sob a ótica dos servidores técnico-administrativos do IFPB. Trata-se de uma pesquisa qualitativa e quantitativa, baseada em um estudo de caso com enfoque descritivo. Os dados foram coletados através de questionário semiaberto, enviado a todos os servidores técnico-administrativos, lotados na Reitoria, através do e-mail institucional respondido anônimo e voluntariamente, por meio do formulário eletrônico Google Drive, com a finalidade de caracterizar o perfil do servidor, identificando níveis de satisfação e percepção dos servidores em relação à cultura organizacional e ao processo de expansão no IFPB; buscou-se também verificar se o servidor tem exercido influência na construção de uma nova cultura na instituição ou se tem sido por ela influenciado. Os resultados indicaram que os servidores não estão plenamente satisfeitos no trabalho e nem com a cultura existente. A maioria percebe a expansão da Rede Federal EPCT no IFPB de forma positiva e proveitosa, porém, indica que a mesma se deu de forma pouco planejada e desorganizada, permeada por uma cultura organizacional hierárquica e burocratizada cristalizada na instituição. Outro grupo significativo se percebe influenciando uma nova cultura no IFPB, apesar das dificuldades e barreiras enfrentadas no cotidiano. Por fim, os resultados apontam para a necessidade de novas práticas de gestão que valorizem a cultura organizacional centrada no ser humano como vetor de transformação organizacional.

Pois retomar a trajetória histórica desses movimentos no Brasil é importante para compreender a sua relevância nas relações trabalhistas. Os movimentos sindicais influenciaram também a organização dos servidores técnico-administrativos em educação, em relação à busca pela conquista de seus direitos. Neste trabalho é mostrado o contexto atual do sindicalismo no setor público, a partir do movimento sindical SINTUFEPE – Sindicato dos Trabalhadores das Universidades Federais de Pernambuco, procurando identificar os principais aspectos envolvidos. Através de lutas, das manifestações dos funcionários públicos e movimentações que muitos direitos foram conquistados. Neste trabalho também é trazido à tona a problemática do direito de greve do servidor público, já reconhecido constitucionalmente, contudo, a inexistência ainda da regulamentação por lei específica, os servidores são submetidos à mesma lei que rege o direito de greve no setor privado. / This study focuses on questions about the trade union movement, rescuing in its historical and in its main events. Because resuming the historical trajectory of these movements in Brazil is essential to understand its relevance in labor relations. The union movements influenced have also influenced the organization of technical admnistrative servers from the education, in the search for the conquest of their rights. This work shows the current context of trade unionism in the public sector, from the trade union movement SINTUFEPE - Union of Workers of the Federal University of Pernambuco, trying to identify the main issues involved. Across fights, and manifestations from civil servants and their movements, that many rights were conquered. This work also brought up the issue of the right of the public servant to strike. Even thought it is already constitutionally recognized, the absence of a specific law, causes that public servants still be submitted to the same laws governing the right to strike in the private sector.

Lorsque les fonctionnaires adoptent des comportements fautifs, qui entravent le bon déroulement des missions publiques, l’Administration est en droit d’exercer une action disciplinaire à leur encontre. Par ce biais, l’Administration contrôle, compense ou neutralise les déviances risquant de nuire à l’action publique et à son image. En toute logique, les modalités d’exercice des pouvoirs disciplinaires varient selon les États, conformément aux dispositions propres à chaque fonction publique. Il est rare de trouver une conformité absolue entre les divers régimes disciplinaires. L’objet de la présente thèse est de comparer et d’identifier les caractéristiques propres à l’action disciplinaire applicable dans la fonction publique en France et au Liban, en faisant un rapprochement entre cette dernière action et l’action pénale. Il s’agit ainsi d’observer dans quelle mesure les principes généraux régissant l’action pénale peuvent fournir des éléments de perfectionnement du régime disciplinaire, que ce soit français ou libanais, en le rendant plus équitable. / When public civil servants engage in misconduct, which hinders the proper conduct of public duties, the Administration is entitled to exercise disciplinary action against them. In this way, the Administration controls, compensates or neutralizes the deviations likely to harm the public action and its image. Logically, the procedures for the exercise of disciplinary powers vary according to the state, in accordance with the provisions of each civil service. It is rare to find absolute conformity between the various disciplinary systems. The purpose of this thesis is to compare and identify the characteristics of the disciplinary action applicable in the civil service in France and Lebanon, bringing the latter action closer to criminal action. It is thus necessary to observe to what extent the general principles governing criminal prosecution can provide elements for the improvement of the disciplinary system, whether French or Lebanese, by making it more equitable.

Den subnationella tjänstemannarollen i Bryssel? : En studie som undersöker regionala tjänstemän på representationskontor i Bryssel / The role of the subnational civil servant in Brussels? : A study of regional civil servants working at representative offices in Brussels

The purpose of the thesis is to study the role of the subnational civil servant and their discretions in a Multilevel Governance context, based on how it differs from the traditional role of the civil servant in Sweden. This is done by studying officials at Swedish Regional Representation Offices in Brussels through the method of semi-structured interviews. The theoretical framework is based on research about traditional activities and role of the public administration, but also in the differences of duties between politicians and officials. Furthermore, the thesis is constructed on Europeanization research and a Multilevel Governance approach, where regional actions in a multi-level system can be clarified and explored by the dimensions of Europeanization: the download-, crossload- and upload dimension. The methodological assessment tool consists of a content analysis, where the collected interview data is compared and discussed using a constructed ideal type of the Weberian role of a civil servant. The respondent's descriptions and views of their role in Brussels is the main focus of the analysis.   To summarise, the regional officials in Brussels consider their scope of discretion as broad. Furthermore, the results illustrate that is not possible to distinguish the role of the sub-national civil service in Brussels, based on the designed ideal type. It’s because of the complexity of the Multilevel Governance system. The results show a significant variation between the respondent's experiences and descriptions of their duties at the office in Brussels. The official’s which are working with a tougher line of lobbying in Brussels, experience their role as both political and apolitical, where the civil servant role enters the political sphere. By working with lobby activities that imply the duty of a politician, they describe their role between the administration and the political sphere. When the officials are working with lobby initiatives in Brussels, they are acting as the political voice of the home organization, but always with a clear lobby mandate from their politicians. / Uppsatsens syfte är att analysera den subnationella tjänstemannarollen och dess handlingsutrymme i ett flernivåsystem, utifrån hur den skiljer sig från den traditionella tjänstemannarollen. Detta görs genom att studera tjänstemän på regionala representationskontor i Bryssel, utifrån semi-strukturerade intervjuer.   Uppsatsen tar ett teoretiskt avstamp i den traditionella förvaltningsverksamheten och i skillnaden mellan politikers och tjänstemäns uppdrag- samt rollfördelningen i den offentliga förvaltningen. Vidare utgår studien från europeiseringsforskning och har en multilevel governance ansats, där ett regionalt handlande i ett flernivåsystem förklaras i europeiseringsprocessernas download-, crossload- och upload-dimensioner. Det metodologiska analysverktyget består av en innehållsanalys av det empiriska intervjumaterialet. Intervjumaterialet jämförs och diskuteras utifrån en konstruerad idealtyp av den weberianska tjänstemannarollen, där fokus är intervjupersonernas uppfattningar och beskrivningar av sin roll i Bryssel. Sammanfattningsvis går det inte att urskilja den subnationella tjänstemannarollen i Bryssel utifrån den idealtyp som konstrueras. Tjänstemännens arbete i ett flernivåsystem är alltför komplext och det finns en betydande variation i hur tjänstemännen beskriver och upplever sin tjänstemannaroll. Generellt sätt uppfattar tjänstemännen i Bryssel sitt handlingsutrymme som brett. Tjänstemän som arbetar med en hårdare linje av påverkansarbete upplever att tjänstemannarollen går in i den politiska sfären och blir både politisk samt opolitisk. Den subnationella tjänstemannarollen upplevs befinna sig mellan administrationen och politiken, då påverkansuppdraget i Bryssel liknar en politikers, men där tjänstemännen är ett politiskt språkrör med ett tydligt påverkansmandat.

La médecine illibérale entre droit public et droit privé / The medical practice under subordination between public and private law

Malgré son organisation d’inspiration libérale, la profession de médecin accepte depuis longtemps l’exercice sous forme illibérale. Ce mode d’exercice médical concerne tous les médecins, aujourd’hui nombreux, exerçant leur art au profit et pour le compte d’un employeur public ou privé. Il présente la particularité d’être organisé selon une bipartition théorique faisant la différence entre les médecins dont l’exercice est soumis au droit public, et ceux dont l’exercice relève du droit privé. L’organisation de l’exercice médical subordonné reprend en effet le schéma selon lequel les agents publics doivent être distingués des salariés de droit privé, conséquence de la dualité droit public/droit privé qui caractérise le système juridique français. Cependant, tout comme la différenciation entre les agents publics et les salariés de droit privé s’est affaiblie, celle existant en théorie entre les médecins illibéraux de droit public et les médecins illibéraux de droit privé a perdu de sa pertinence, tant ces deux catégories de professionnels se sont rapprochées, liées en pratique par une même notion : la subordination. Les différentes branches du droit applicables aux médecins illibéraux ont été réciproquement attirées les unes par les autres et ont évolué par des mécanismes d’emprunts mutuels. Ce mouvement d’attraction, dont le développement a fait naître un mode d’exercice médical illibéral uniformisé, marque l’abolition de la distinction entre médecine subordonnée de droit public et médecine subordonnée de droit privé / Despite being organized on a liberal inspiration, the medical profession can be practiced through a subordinate relationship. This way of practicing the medical profession includes every doctor who fulfills his professional duties in the profit and for a public or private employer. It is unique by its organization, according to a theoretical division making the difference between doctors ruled by public laws, and doctors who practice under private laws. It follows a particular scheme, in which civil servants are differenciated from salaried employees ruled by private laws, a direct result, typical of the french legal system, of the traditional duality between public and private law.However, like the differenciation between civil servants and salaried employees ruled by private laws, which has lost most of its strongness, the separation between subordinate doctors ruled by public laws and subordinate doctors ruled by private laws is not relevant anymore, because these two types of doctors, linked by one key concept, the subordination, have kept getting closer over time. The different rules that apply to the subordinate doctors have reach out to each other and have progressed with mutual borrowings. These attraction moves have created a homogeneous medical practice, by erasing the differences between subordinate doctors ruled by public laws and those who are governed by private laws

The master thesis analyzes the Act No. 234/2014 Coll., On Civil Service, from the aspect of related legislation, Act No. 312/2002 Coll., On Public Officials of the Local Self-Government Units. When the Law On the Civil Service came into force, at the beginning of last year, two categories of officials were created. On the one side there are civil servants who are in service of the Czech Republic, on the other side there are officials who are employed by local self-government units. The analysis is focused on five areas, where it is possible to compare the method of legislation under both laws. After review of these selected areas, the application problems of the civil service are identified. At the end of the thesis, there are legislative proposals for changes that are inspired by relevant legislation.
