The Replaceability Argument : An evaluation of a utilitarian argument for the permissibility of purchasing meat

The thesis is an evaluation of a utilitarian argument for the permissibility of purchasing meat. The argument, which I call the replaceability argument, rests on four premises: 1. Meat purchases cause animals to be brought into existence. 2. The animals brought into existence by meat purchases live lives of positive final value. 3. If the first two premises are true, then meat purchases cause at least as good consequences as any alternative act. 4. If meat purchases cause at least as good consequences as any alternative act, then meat purchases are permissible. The first three premises are examined while the fourth one, representing consequentialism, is assumed to be true. The evaluation results in the conclusion that the argument is unsound because all of the premises evaluated turn out to be either doubtful or false.

A hipótese do trabalho é a de que o Supremo Tribunal Federal utiliza argumentos consequencialistas para admitir e julgar o controle de constitucionalidade de leis e normas orçamentárias. A tese é dividida em duas partes. Na primeira são tratados os temas que fundam a análise argumentativa das decisões judiciais. A argumentação jurídica é proposta como lente de exame das decisões judiciais, especialmente o ramo da retórica. De acordo com esse referencial teórico, os tribunais e juízes buscam convencer o auditório de que produzem a decisão mais adequada possível. É ressaltada a importância do argumento na formação do precedente, no que há de fundamental nas decisões (ratio decidendi) e no que é periférico (obiter dictum). O argumento consequencialista é visto diante de diversas teorias que o propõem, como o utilitarismo e o pragmatismo, com destaque, em capítulo próprio, para a teoria de Neil MacCormick, que propõe um consequencialismo essencialmente jurídico. Em sua segunda parte, a tese explora os temas que levarão às conclusões da hipótese. Em primeiro lugar, as características marcantes da produção de leis e normas orçamentárias, sua natureza jurídica e seu fundamento de validade. É revisto o controle de constitucionalidade dessas normas no ordenamento brasileiro, sendo pontuadas as particularidades e limites pertinentes ao seu controle principal. E por fim, no último capítulo, são analisadas pormenorizadamente as decisões que o Supremo Tribunal Federal produziu no controle principal de leis e normas orçamentárias, demarcando a presença de argumentos consequencialistas e buscando estabelecer quais são os precedentes vigentes no direito brasileiro. Ao fim, conclui-se que o controle de constitucionalidade principal é a via mais adequada nas matérias orçamentárias; que o precedente estabelecido no Supremo Tribunal Federal é o de possibilidade de controle de constitucionalidade principal de normas orçamentárias por ADI e ADO, não por ADPF; e que o tribunal usa adequadamente, na maioria das vezes, os argumentos consequencialistas, porquanto estes predominam (ratio decidendi) nas decisões mais importantes sobre a matéria. / The hypothesis of this work is that the Supreme Court uses consequentialist arguments to admit the judicial review of budgetary laws. The thesis is divided in two parts. In the first, the themes that underlie the argumentative analysis of judicial decisions are discussed. Legal argumentation is proposed as a lens for examining decisions, especially rhetoric. According to this theoretical framework, the courts and judges seek to convince the audience that they produce the most appropriate decisions possible. It highlights the significance of the argument in shaping the precedent, in what is crucial in decisions (ratio decidendi), and what is peripheral (obiter dictum). The consequentialist argument is analyzed according to the various theories that underlie it, such as utilitarianism and pragmatism, especially, in a separate chapter, according to Neil MacCormicks theory, that offers an essentially legal consequentialism. In its second part, the thesis explores the issues that lead to the conclusions of the hypothesis. Firstly, the salient features of the production of budget laws, its legal status and fundament of validity. The judicial review of these laws in the Brazilian legal system is revised, and the limits and particularities of its main control are punctuated. And finally, in the last chapter, the decisions produced by the Supreme Court in the main judicial review of budgetary laws are minutely explored, the existence of consequentialist arguments is indicated, and it seeks to establish the precedents existing in Brazilian law. It concludes, lastly, that the abstract judicial review is the most suitable option in budget matters; that the precedent set in the Supreme Court is about the possibility of the abstract judicial review of budgetary laws by ADI and ADO, but not ADPF; and that the court properly uses, most often, consequentialist arguments, and they predominate (ratio decidendi) in the most important decisions about it.

A presente dissertação possui por objeto discutir o controle judicial da atividade normativa das agências reguladoras no direito brasileiro. O trabalho é dividido em três partes. Na primeira, é analisa a evolução do princípio da separação de poderes ao longo dos séculos XIX e XX, bem como a receptividade dele no início do século XXI, notadamente em virtude do processo de retirada do Estado da intervenção direta na economia, como prestador de serviços aos cidadãos, e sua recolocação como regulador das atividades econômicas. Também é analisada na primeira parte como tais mudanças econômicas e sociais implicaram em uma alteração do papel do Poder Judiciário que, inicialmente criado como o menos ativo dos poderes, tornou-se órgão central para a efetivação dos direitos da democracia contemporânea. Na segunda parte, é analisada a atividade normativa das agências reguladoras, com a defesa da tese da delegação legislativa, bem como com a verificação dos requisitos procedimentais e materiais que devem ser observados pelas agências reguladoras na expedição dos atos normativos e de como tais requisitos acabam por limitar a discricionariedade dos entes reguladores. Na terceira parte, é feita a verificação do controle judicial da regulação, tendo como premissas a adoção pelo direito brasileiro do sistema da unidade de jurisdição e as diferenças funcionais entre o Judiciário e a Administração no estabelecimento de políticas públicas, com a defesa de que o controle judicial dos atos normativos das agências reguladoras deve se dar de modo negativo, ou seja, sem que o Judiciário possua competência para a estipulação da política regulatória a ser seguida, e de forma responsiva, ou seja, com a análise das consequências do controle judicial sobre o setor regulado, devendo o magistrado analisar não apenas os aspectos de legalidade do normativo questionado, mas também a finalidade do sistema regulado e os impactos que a decisão judicial terá sobre ele. / The object of the current thesis is to discuss the judicial control of the normative activity of the regulatory agencies according to Brazilian law. This paper is divided into three parts. At first, the evolution of the principle of the separation of powers across the Nineteenth and the Twentieth century will be analyzed, as well as the reception of such principle in the early Twenty-one century, especially due to the process of disengagement of the State from the direct intervention in the economy (as a provider of services to the citizens) and its replacement as a regulator of economic activities. Also in the first part, it will be analyzed how such economical and social changes caused a modification of the role of the Judiciary branch which, initially, was created as the less active of the State powers, becoming the central body for the effectiveness of the contemporary democracy rights. The second part analyzes the normative activity of the regulatory agencies, with the defense of the thesis of legislative delegation, as well as with the verification of the procedural and material requirements that must be observed by the regulatory agencies in the issuance of normative rulings and how such requirements end up limiting the discretion of the regulatory bodies. In the third part the verification of the judicial control of such regulation is carried out, having as its premises the adoption, by Brazilian law, of the unity of jurisdiction system and the functional differences between the Judiciary branch and the Public Administration in the establishment of public policies, being defended that the judicial control of the regulatory agencies normative rulings must be made in a negative manner, i.e., without the Judiciary having the competence for the stipulation of the regulatory policy to be followed, as well as in a responsive manner, i.e., with the analysis of the consequences of the judicial control over the regulated sector, being the magistrate responsible for analyzing not only the aspects of legality of the questioned normative rulings, but also the objective of the regulated system and the impacts of the judicial decision on it.

ABSTRACT The purpose of this essay is to contribute to an understanding of how ethical theories manifest in the political debate in Sweden, where the focus is on the debate on surrogacy. This to contribute with an understanding of the relation between ethics and politics. The purpose will also be to contribute with and understanding of the potential differences in the use of the concept “freedom” in the political discourse in Sweden. The ethical theories that was part of this paper where consequentialism, deontological ethics and ethics of care. In order to answer this questions, propositions regarding the subject of surrogacy from all the parties who are represented in the Swedish parliament where analyzed.  During this paper I discovered that all three of the ethical theories where manifested in motions from every party and in all the different positions in the matter, regarding surrogacy, even if the arguments differed. When it came to how the concept “freedom” was used, there were no clear pattern regarding which party who used it in a certain way. However, I could see that arguments related to negative freedom were mostly used as the head arguments while arguments related to positive freedom was more used to back up the head arguments. There were also no clear pattern regarding how the concept of freedom was used in relation to the parties’ respective position on surrogacy.

The TRIPS Agreement and Access to HIV Medications: An ethical discussion

With over 30 million people infected with HIV today, it has become an epidemic. Without a cure, HIV continues to be a threat to health and development. In 1994, the TRIPS Agreement, administered by the World Trade Organization came into effect. The Agreement which aims inter-alia to increase patenting in order to promote research and development has been questioned in it's effects on affordable access to HIV medications in the least-developed and developing countries. In this thesis, the TRIPS Agreement's purposes are thus analysed according to two ethical theories and their modern versions, deontology and utilitarianism/consequentialism. This analysis is made in order to seek the ethical responsibilities that the World Trade Organization has in relation to the TRIPS Agreement. The thesis findings conclude through the careful consideration of each ethical theories, and by asking additional questions than those offered in the theories, that the WTO has the ethical responsibility to reform the TRIPS Agreement so as to, at the least, not include pharmaceutical products.

Due to the fact that Scripture is the authoritative Word of God (Belgic Confession. Article 5), the infallible written Word of God. is and stays the basis for Christian ethics. Scripture is not just another single source for Christian ethics among other sources, but it is the decisive source among all other sources. The question then arises - how is it possible in the ever-changing life situation of the modem day context of society? In an ever increasing secularized society places the Christian life and also the Christian ethics under more pressure. The acceptance of the authority of Scripture is therefore indispensable for Christian ethics. Scripture does however not present a text as an absolute answer for every possible or similar ethical problem. The deep-seated principles of Scripture must be exposed. From these principles norms should be derived that is applicable to the modem problem. The problem statement that follows from this culminates as the following: Can a thematic analysis of the Biblical dogma present a fundamental working foundation for Christian ethics in modem day society and serve as a corrective for the problematic approaches of a biblicistic as well as an over critical view of Scripture for the basis of ethics? The central theoretical argument of the study is the following: A thematic analysis of the Biblical dogma can indeed present a fundamental, working foundation for Christian ethics in modem day society and can serve as a corrective for the problematic approaches of a biblicistic as well as an over critical view of Scripture for the basis of ethics. In the second chapter the definitions of what could be defined as Christian ethical perspectives and principles is examined. In other words, the purpose of the chapter is to examine and to give a broad overview of the understanding of ethics, morality, morals etc. The qualified deontological approach is chosen due to the fact that normative approach with its focus on Scripture as authoritative therein plays a big role. The third chapter focuses on which view of Scripture and use of Scripture is normally applied in Reformed ethics in the use or interpretation of Scripture. Special attention is given to the authority of Scripture, view of Scripture and an attempt is made to convey the hermeneutical points of departure (axioms) in order to derive an intra-biblical use of Scripture. The chapter comes to the conclusion that even though the Christian ethicist does have in theory at his disposal a biblical-founded hermeneutical model it does not safeguard him against a faulty use or interpretation of Scripture in practice in the fourth chapter the present-day Scriptural principles that serves as basis and cadre for the interpretation of Scripture in light of the answering of Christian ethical questions is examined. In light of the present-day situation seems that although there is a sound hermeneutical axiom that serves as filters in the interpretation of Scripture in the reformed ethics, in practice either a biblicistic or a Criticism of Scripture approach to Scripture is chosen. The approaches of the fundamentalistic/biblicistic and Criticism of Scripture is examined and m e s to the conclusion that both, in their own way, does bring the authority and the message of Scripture in disrepute. In the event of the fundamentalistic and biblicistic approach the divine inspiration character of Scripture is overemphasized and all Scriptural Utterances is treated on the same level to such an instance that everything is sanctioned. In the event of the Criticism of Scripture the human fallible character is again overemphasized to the extent that the normative authority of Scripture for Christian ethics is not taken into account . The chapter comes to the conclusion mat a "third way” must be examined to circumvent the many pitfalls of either a fundamentalistic/biblicistic of Criticism of Scripture in the interpretation of Scripture in light of a modem day ethical problem. In the fifth chapter an adjudication and evaluation of the quality of the use or Interpretation of Scripture in light of capital punishment within the biblical view of a right to life is given as a representative of modem day ethical problems. In light of the principles given in Chapter 3 and 4 it is shown that Scripture is most often misused despite fair hermeneutical principles Only to reflect the ethicist own preconceived ideas. The last chapter indicates an approach that might possibly serve as an alternative/valid use or interpretation of Scripture in reformed ethics other than a typical biblicistic/fundamentalistic or Criticism of Scripture approach. The chapter draws to the conclusion that the contextual-paradigmatic approach is at this time the only capable approach of acknowledging the proper interpretation of Scripture to shed some light on the ethical problems of modem day society, without stepping into the boundaries of either a biblicistic/fundamentalistic of Criticism of Scripture interpretation of Scripture. The contextual-paradigmatic approach succeeds in preventing the ethicist to misinterpret Biblical texts that seems to be of importance to the debate of capital punishment and to make a scientific contribution lo important debates in South Africa today, especially those related to the interpretation of the Bible and its use in the development of South Africa. In this way an attempt is made to contribute towards and to provide guidelines for a healthy and responsible society and for the functioning of Christians within the current South African state. The research, in the first moment, seeks to expose the reality of the health system and the jurisprudential positioning about the right to medical care, after, to seek the pragmatist consequentialism, the behavioral analysis of the right and the economic analysis of the right, tools that enable an extended view of the subject, insofar as the Brazilian jurist, as a rule, does not worry about possible external effects of decisions - the consequences in the real world. In this work the focus is on the jurist, seeks to demonstrate that concern with consequences external to the law are not part of his daily life. It also seeks to analyze the behavior of the jurist, what its context, what its motivational state and what the consequences that influence the emission of a certain behavioral pattern, in order to explain why the choice of short term solution prevails, in the case, immediate health care, to the detriment of the long-term consequences, a so-called contingency-trap situation. / Este trabalho propõe uma nova visão para a judicialização da saúde, tema que tem grande apelo popular e gerado uma série de problemas aos gestores da saúde, por implicar distorções orçamentárias, escapar às regras normais de escolha a que são submetidas todas as decisões coletivas que tratam de políticas públicas, bem como por tornar desiguais os beneficiários do sistema de saúde. A pesquisa, em primeiro momento, procura expor a realidade do sistema de saúde e o posicionamento jurisprudencial acerca do direito à assistência médica, para, após, buscar no consequencialismo pragmatista, na análise comportamental do direito e na análise econômica do direito, ferramentas que possibilitem uma visão ampliada do tema, na medida em que o jurista brasileiro, em regra, não se preocupa com possíveis efeitos externos das decisões – as consequências no mundo real. Neste trabalho o foco está no jurista, procura demonstrar que preocupação com consequências externas ao direito não fazem parte do seu dia a dia. Busca, ainda, analisar o comportamento do jurista, qual seu contexto, qual seu estado motivacional e qual o quadro de consequências que influenciam a emissão de determinado padrão comportamental, de modo a expor o porquê predomina a escolha de solução de curto prazo, no caso, assistência imediata de saúde, em detrimento das consequências de longo prazo, situação chamada de contingência-armadilha.

Etisk fondförvaltning : en studie av fem svenska fondbolag / Ethical fund management : a study of five Swedish management companies

Allt fler privata och institutionella investerare väljer att placera pengar i etiska fonder. Fondbolag världen över erbjuder sina kunder att investera i fonder som går i enighet med sina egna moraliska värderingar. Redan under 1700-talet kom idén om att investera etiskt. Syftet med denna typ av ekonomisk förvaltning har dock förändrats något de senaste decennierna. Idag råder det inget tvivel om att åsikter går isär om vilka bolag som bör få ingå i en etisk fond.Den tidigare forskningen visar att fondförvaltarna främst använder sig av två metoder när de avgör vilka bolag som skall ingå i de etiska fonderna. Dessa två metoder kallas för negativ och positiv screening. Även fondbolagen som ingick i denna uppsats använde sig av positiv respektive-negativ-screening.I den här uppsatsen undersöks de moraliska aspekter som finns kring etiskt fondsparande. Det sker även en gransking av hur fondförvaltarna väljer ut de bolag som skall ingå en etisk fond, samt vilka konsekvenser detta får för fonden ur ett moralfilosofiskt perspektiv. Denna uppsats beskriver dessa två principiellt olika tillvägagångssätt, där båda dessa påvisas vara problematiska. Detta gör att det går att det starkt går att ifrågasätta deras legitimitet.Uppsatsen har bidragit till att undersöka och beskriva huruvida dessa screeningsmetoder är etiskt hållbara genom att använda två olika moralfilosofiska infallsvinklar.Positiv screening är en allt för godtycklig metod som ger upphov till allt för många subjektiva bedömningar för fondförvaltarna. Dessutom bortser positiv screening från om företag har dåliga sidor, utan den fokuserar endast på styrkorna hos ett bolag. Detta gör att icke ansvarstagande bolag kan följa med.Negativ screening är en allt för motsägelsefull metod eftersom att den inte helt tar avstånd från de branscher som den försöker att stänga ute. Bland annat så stänger den inte ute underleverantörer till företag som exkluderas med denna metod. Fondbolagen tillåter också att vissa procent av omsättningen får komma från de branscher man försöker att stänga ute vilket gör att negativ screening förlorar sitt syfte. Dessutom är det tveksamt om fondbolagen överhuvudtaget bör utesluta spelbranschen, alkoholbranschen, eller pornografibranschen på enbart moralfilosofiska grunder.Vidare har även uppsatsen kommit fram till att det är de institutionella kunderna som driver utvecklingen framåt och att de har en stark påverkan på vilka branscher som väljs bort genom negativ screening.

The last chapter indicates an approach that might possibly serve as an alternative/valid use or interpretation of Scripture in reformed ethics other than a typical biblicistic/fundamentalistic or Criticism of Scripture approach. The chapter draws to the conclusion that the contextual-paradigmatic approach is at this time the only capable approach of acknowledging the proper interpretation of Scripture to shed some light on the ethical problems of modem day society, without stepping into the boundaries of either a biblicistic/fundamentalistic of Criticism of Scripture interpretation of Scripture. The contextual-paradigmatic approach succeeds in preventing the ethicist to misinterpret Biblical texts that seems to be of importance to the debate of capital punishment and to make a scientific contribution lo important debates in South Africa today, especially those related to the interpretation of the Bible and its use in the development of South Africa. In this way an attempt is made to contribute towards and to provide guidelines for a healthy and responsible society and for the functioning of Christians within the current South African state.
