Srovnání právních úprav ochrany přírody v České republice a Spolkové republice Německo v kontextu unijního práva / The comparison of the legal regulations of nature conservation in the Czech Republic and in Germany in the context of the EU law

The doctoral thesis is thematically focused on a particular area of the environmental law, nature conservation. The first chapter presents selected significant international conventions and EU regulations, e.g. the Birds Directive and the Habitats Directive. The other parts deal with a comparison of the constitutional framework of environmental protection and nature conservation including the introduction of the general principles of the nature conservation in Federal Act on the Conservation of Nature and Landscape. Other chapters are focused on a comparison of general and specific nature conservation. The thesis contains selected decisions of the Court of Justice of the European Union against Germany. In the conclusion, the answers to questions are given, the introduced legislation is compared and substantial differences in both legal systems are discussed.

La lutte contre le terrorisme, ainsi que ses conséquences sur la sphère des droits de l'Homme, n'est pas un thème nouveau en Europe. Cependant, depuis les attentats du 11 septembre 2001 perpétrés sur le sol des Etats-Unis, «confirmés» par ceux de Madrid en 2004 et Londres en 2005, elle n'a jamais incarné une telle priorité. La majeure partie des mesures prises par l'Union européenne tombe sous le titre de la coopération en matière pénale, c’est-à-dire sousl’ex-troisième Pilier, parmi lesquelles la décision-cadre sur la lutte contre le terrorisme, la décision-cadre sur le mandat d'arrêt européen et les accords entre l'Union européenne et les Etats-Unis d'Amérique sur l'extradition et l'assistance juridique mutuelle. Sur base des mesures européennes, certains Etats, historiquement non concernés par ce phénomène, ont été pressés à adopter des mesures anti-terroristes alors que d’autres y ont vu une légitimation pour renforcer leur corpus juridique déjà existant. Quel est l'impact des mesures européennes et de celles prises par les Etats sur le délicat équilibre entre la sécurité et la liberté ? En d'autres termes, quel est le rôle de l'Etat de droit : une limitation à ces mesures ou, un principe visant au renforcement du combat contre le terrorisme? / The fight against terrorism, as well as its consequences in the field of Human Rights, is not a new theme for Europe. However, since the terrorist attacks of September the 11th 2001 in the United States of America, “confirmed” by the ones of Madrid in 2004 and London in 2005, it has never embodied such a priority. The larger part of the measures taken by the European Union falls under the heading of cooperation in criminal matters, i.e. within the scope of the former Third Pillar, among which the framework decision on combating terrorism, the framework decision on the European arrest warrant and the agreements between the European Union and the United States of America on extradition and mutual legal assistance. On basis of the European measures, some States, not historically concerned by terrorism, have been compelled to carry out counter-terrorism measures whereas, others have seen a legitimation to reinforce their existing body of law. What is the impact of the European measures and the ones taken by States on the delicate balance between security and liberty? In other words, what is the role of the Rule of Law: a limitation to those measures or, a principle aiming to the strengthening of the fight against terrorism?

Ne bis in idem dans les discours croisés des cours supranationales sur la justice pénale / Ne bis in idem at the crossroads of the discourses of supranational courts regarding criminal justice

Ne bis in idem est bien défini dans les droits nationaux comme un principe fondamental du procès pénal selon lequel un individu ne peut pas être poursuivi deux fois pour les mêmes faits. Mais, en passant au niveau international, le principe familier se change en objet juridique non identifié. Les cours supranationales qui l'abordent en matière pénale (Cour interaméricaine des droits de l'homme, Cour européenne des droits de l'homme, Cour de justice de l'Union européenne, Cour pénale internationale) interprètent des formulations disparates de ne bis in idem à partir desquelles elles forgent leurs variantes. Si l'identité de ne bis in idem semble alors se déliter, il ne s'agit pas d'une disparition. Modelé par les discours de ces cours qui se croisent, se rencontrent ou s'ignorent, ne bis in idem se métamorphose. Au-delà des variantes il est possible d'identifier des mouvements communs dans la fabrique de ne bis in idem : la recherche de cohérences spatiale et temporelle ainsi que le besoin de répondre à la dialectique du bis et de l'idem. De plus, la métamorphose est tantôt création tantôt déconstruction. Les cours consacrent ne bis in idem autant qu'elles le malmènent en établissant de nouveaux contournements. Par exemple, elles permettent de plus en plus de rejuger pour lutter contre l'impunité après une parodie de procès. Ces mouvements contraires conduisent à interroger la nature ambivalente de ne bis in idem entre facettes garantiste et structurelle et entre règle et principe. Enfin, ne bis in idem étant un catalyseur de leurs échanges, cette étude offre une perspective unique sur le rôle des cours supranationales dans l'internationalisation de la justice pénale. / Ne bis in idem (prohibition of double jeopardy) is well defined in national legal frameworks as a fondamental principle of criminal proceedings according to which an individual cannot be prosecuted twice for the same conduct. But, when moving to the international level, the familiar principle becomes an unidentified legal object. The supranational courts that deal with it in criminal matters (Inter-American Court of Human Rights, European Court of Human Rights, Court of Justice of the European Union and International Criminal Court) interpret disparate ne bis in idem formulations from which they construct their variations. If the identity of ne bis in idem then seems to be diluting, it is not disappearing. Shaped by the discourses of these courts that cross paths, meet or ignore each other, ne bis in idem is metamorphosed. Despite the variants, it is possible to identify common movements in the making of ne bis in idem : the search for spatial and temporal coherency and the need to respond to the dialectics of bis and idem. Moreover, metamorphosis is construction as much as deconstruction. The courts enshrine ne bis in idem as much as they circumvent it by establishing new limits and bypasses. For instance, they allow more and more a second procedure to fight impunity if the first procedure constituted a sham trial. These contrary movements lead to questioning the ambivalent nature of ne bis in idem between its two facets as guarantee and structural element and between rule and principle. Finally, as ne bis in idem is a catalyst for their exchanges, this study offers a unique perspective on the role of supranational courts in the internationalization of criminal justice.

Office du juge administratif et questions préjudicielles : recherche sur la situation de juge a quo / The role of the administrative judge and the question of preliminary issues

Les questions préjudicielles interrogent l’office du juge administratif qui les formule.Accessoires du procès au principal, elles pourraient être considérées comme des questions annexes etsecondaires. Cette étude de contentieux administratif, fondée sur l’analyse systématique de lajurisprudence administrative, vise à démontrer le contraire. Remarquables tant par leur variété que parleurs incidences sur le procès, les questions préjudicielles restent souvent perçues comme descomplications de procédure inutiles visant à retarder la résolution du litige. Cette étude prend le partid’expliciter comment le juge administratif au principal en vient à construire une question préjudicielle,et quel en est le fondement juridique. De ce point de vue, si les parties au litige jouent bien souvent unrôle essentiel dans le relevé d’une exception, c’est en dernière analyse, le juge au principal qui détientle pouvoir de formulation de la question. Par ailleurs, la mise en oeuvre des questions préjudicielles,traditionnellement présentée comme paralysant l’office du juge, apparaît sous un nouveau jour. Loind’immobiliser l’office du juge au principal, l’étude minutieuse du droit positif révèle les importantspouvoirs que possède encore le juge a quo dans la maîtrise du procès dont il est compétemment saisi.Enfin, la réception par le juge a quo de la décision préjudicielle correspond à un partage de lasouveraineté juridictionnelle impliquant l’édiction d’un acte juridictionnel issu d’un processus decodécision. Cette étude livre un éclairage sur le fonctionnement et la complexité d’un mécanisme icitraité sous l’angle de l’office du juge lorsqu’il se place en situation de juge a quo. Elle permetégalement d’envisager les principales problématiques juridiques relatives à la fonction juridictionnelle. / Preliminary issues challenge the role of the administrative law judge who formulates them.They are regarded as being accessory to the principle case at bar. They may even be perceived assecondary issues. This study of administrative litigation, based on a systematic analysis ofadministrative case law, aims to establish the opposite. Preliminary issues are characterized by theirdiversity as well as by their influence on the lawsuit, however, they are often perceived as useless andcumbersome procedural complications aiming to delay the resolution of the dispute. This study aimsto explicit the process by which the administrative law judge builds a preliminary issue and what is thelegal foundation of such an issue. From this angle, albeit the fact that the parties to the main disputeplay an essential role, it is the judge, who mainly retains the power to formulate the preliminary issue.This analysis challenges the traditional portrayal of preliminary issues as paralyzing the judicial“office”. To the contrary, far from immobilizing the “office of the judge”, an in depth study of positivelaw reveals the extensive powers that the judge a quo possesses with regards to the case at bar.Finally, the reception by the judge a quo of the preliminary ruling corresponds to a sharing of juridicalsovereignty implying the passing of a juridical act emanating from a process of co-decision. Thisstudy aims to shed light on the functioning and the complexity of a mechanism rarely examined fromthis angle. This study equally allows for an exploration of the main legal issues relating to the judicialfunction and the “Office” of the administrative law judge when placed in the situation of judge a quo.

La validité substantielle de la norme pénale / The substantial validity of the criminal norm

La norme pénale valide est celle qui possède la capacité de déployer ses effets. Elle est celle qui autorise le déclenchement des poursuites, le prononcé des condamnations et l'exécution de peines. En premier lieu, il a fallu montrer ce qui paraît s’imposer d’instinct : loin de se résumer au respect d'exigences formelles, la validité de la norme pénale dépend directement de la conformité à des exigences substantielles, portées par la Constitution et les conventions européennes. La preuve de la part substantielle de validité est apportée en deux temps. D’abord, l’entrée en vigueur de la règle pénale est subordonnée à sa bonne insertion dans la hiérarchie des normes. Ensuite, les normes répressives irrégulières sont systématiquement invalidées.En second lieu, la composante substantielle de la validité de la norme pénale a de multiples conséquences, qui sont tantôt bénéfiques, tantôt problématiques. En effet, les principes qui conditionnent substantiellement la validité de la norme pénale assoient la légitimité de la répression. En revanche, l’avènement du pouvoir prétorien, dans une discipline en quête de stabilité, soulève de nombreuses difficultés. Pour les surmonter, proposer des clefs de résolution s’est révélé nécessaire. / The valid criminal norm is the one that is able to have a legal impact. It allows for the commencement of a prosecution, the imposition of a sanction, and the enforcement of sentences. Firstly, we had to demonstrate what seems manifest: far from being only a matter of respecting the formal requirements, the validity of a criminal norm depends directly on its compliance to substantial requirements that are contained in the French Constitution and the European conventions. The substantial proportion of the validity is demonstrated in two steps. The entry into force of the criminal rule is at first subordinated to its correct integration in the hierarchy of norms. Then, the improper repressive norms are systematically invalidated. Secondly, the substantial part of the validity of the criminal norm has several consequences that are in some cases beneficial but not in others. Indeed, the principles that substantially determine the validity of the criminal norm make the punishment legitimate. However, the emergence of the judge-made law raises many difficulties in a discipline that yearns for stability. In order to overcome them, it appeared necessary to suggest some key elements of resolution.

Unexpected consequences for the Swedish signals intelligence in the light of the European Court of Justice’s case law? : An analysis of the implications the joined cases La Quadrature du Net and others and the case Privacy International might have for the Swedish signals intelligence

The Court of Justice of the European Union has in its case law been strict in its approach towards Member States’ legislative measures providing for retention of and access to data relating to electronic communications. In recent case law the Court has made clear that also such provisions with the object of safeguarding national security need to comply with EU law and the Court’s jurisprudence. This might mean that the Swedish cable-based signals intelligence is within the scope of EU law contrary to the previous conception. It is decisive for whether the Swedish signals intelligence is within the scope of EU law whether the requirement on the providers of electronic communications systems to transfer all signals crossing the Swedish border to collaboration points, in order for the signals intelligence to be carried out, is to be interpreted as a requirement on the providers to process personal data. If within the scope of EU law, a great majority of the Swedish signals intelligence could be disproportionate in the light of the Court’s case law and thus contrary to EU law. Since the signals intelligence is considered to be an indispensable tool to solve all tasks the Swedish foreign intelligence encompasses this could affect the capability of the foreign intelligence.

The aim of this thesis is to describe the fundamental issues related to the future accession of the European Union to the European Convention for the Protection of Human Rights and Fundamental Freedoms and to provide an overall understanding of the issue. To fulfil this objective, the first part of the thesis deals with the current situation in the european human rights protection system. It introduces the protection system of the Council of Europe as well as the system of protection provided by the European Union. This part aims to describe relationships between them and also gives the overview of the development of the question of accession and of the main features defining the autonomy of the European Union law. The second part then turns the attention to the legal instruments which make it possible European Union to accede. This part provides an analysis of the Accession agreement on the accession of the European Union to the Convention for Protection of Human Rights and Fundamental Freedoms which contains legal, institutional and technical solutions of the European Union's incorporation into the Convention system. Dialogue of the Courts in Europe: Interactions between the European Court of Human Rights, the Court of Justice of the European Union and the Courts of the ECHR Member States

Aufgrund des wachsenden Bedarfs an kohärenter Interaktion zwischen dem Europäischen Gerichtshof für Menschenrechte, dem Gerichtshof der Europäischen Union und den Gerichten der EMRK-Mitgliedstaaten, untersucht diese Arbeit die Problematik von Kompetenzkonflikten, die die Glaubwürdigkeit der europäischen und nationalen Gerichtshöfe untergraben und die Effektivität des gerichtlichen Rechtsschutzes in Europa schwächen, und schlägt die Lösungen vor, um Rechtsprechungskonflikte zwischen den Gerichtshöfen zu verringern. Es erfolgt eine Betrachtung der Fragen, wie Inkonsistenzen der gerichtlichen Rechtsprechung der europäischen und nationalen Gerichte vermieden werden können, wie der Beitritt der EU zur EMRK angegangen werden kann und wie das Piloturteilsverfahren des EGMR und nationalen gerichtlichen Überprüfungsverfahren wirksam funktionieren kann. Die Arbeit kommt zu dem Schluss, dass es für die Koordination der Zusammenarbeit zwischen den Gerichten wichtig ist, ihre Interaktionen zu verstärken, indem bewährte Verfahren auf allen Ebenen ausgetauscht werden. Um eine tiefere Integration der Staaten in die europäische und internationale Gemeinschaft zu erreichen und das Risiko von sich widersprechenden gerichtlichen Entscheidungen zu reduzieren, wird von den Mitgliedstaaten erwartet, dass sie ihre Verpflichtungen aus dem EU-Recht und der EMRK verlässlich erfüllen, und die europäischen Gerichtshöfe werden ihrerseits die Möglichkeit eines Eingriffs in die Souveränität der Staaten ausschlieβen lassen. Nur wenn einvernehmlich beschlossene Lösungen angenommen werden, wird eine größere Kohärenz in Rechtsprechung der europäischen und nationalen Gerichtshöfe erreicht und ein einheitliches System zum Schutz der Menschenrechte gewährleistet. / In light of the growing need to establish a coherent relationship between the European Court of Human Rights, the Court of Justice of the European Union and the courts of the ECHR member states, this study explores the challenges of jurisdictional competition that undermine the credibility of the courts and weaken the effectiveness of judicial protection of fundamental rights in Europe, and suggests ways to reduce emerging judicial tensions between these courts. It examines how to avoid inconsistencies in judicial practices of the European and national courts, how to approach accession of the EU to the ECHR, and how to ensure effective functioning of the pilot judgment mechanism and national judicial review procedures. It concludes that in order to coordinate cooperation between the courts it is important to strengthen their interactions through adhering to best practices at all levels. To pursue deeper integration of states into the European and international community and minimise the chance of rendering contradicting judgments by the courts, member states are expected to comply faithfully with their obligations under EU law and the ECHR, and the European courts shall exclude the possibility of encroachment on state sovereignty. Only if mutually agreed solutions are adopted will a greater consistency in their case law be achieved and a uniform system of protection of human rights ensured.

The thesis called "Reasons for restricting of the free movement of services" is focused on one of the fundamental freedoms of internal market, free movement of services, both in terms of theory and especially from the perspective of The Court of Justice of the European Union. In five chapters of the thesis is analysed the general characteristics of the free movement of services, the relationship to the other freedoms of the internal market and the legal basis of this freedom in the primary and secondary legislation of the European Union. First chapter is focused on historical development of the internal market of European Union and on principles on which internal market operates. Second chapter of this thesis defines the term "services" and examine the relationship to the other freedoms of the internal market as well as the legal basis of the free movement of services in the primary and secondary legislation of the European Union. Third chapter of the thesis is focused on the restrictions of the free movement of services, direct and indirect discrimination, non- discriminatory restrictions and also on the harmonization of standards.
