[pt] O Poder Judiciário brasileiro está sendo inundado por uma onda de ações
relacionadas ao direito fundamental à saúde, deparando-se, recentemente, com um
problema de grande repercussão constitucional, que é a obrigatoriedade de
fornecimento de medicamentos de alto custo pelo Estado. Na tentativa de
distribuir o pesado ônus de fornecimento de medicamentos de alto custo, alguns
Estados estão utilizando o instituto do chamamento ao processo para incluir os
demais entes federados à lide, o que não vem sendo admitido na jurisprudência.
Dentro desse contexto fático e jurídico, desenvolve-se a presente dissertação em
três capítulos, para analisar a saúde pública no Brasil e o fenômeno da
judicialização de fornecimento medicamentos de alto custo pelo Estado. O estudo
também apoia-se em dados estatísticos relacionados às ações judiciais envolvendo
o direito à saúde – mas precisamente sobre fornecimento de medicamentos pelo
Estado do Espírito Santo –, o que comprova a importância econômica e social do
tema, tendo em vista as possibilidades materiais do Estado na efetiva e satisfatória
promoção do direito à saúde da população. Dedica-se o capítulo final à
demonstração da viabilidade do chamamento ao processo dos demais entes
coobrigados solidariamente, para distribuição do ônus pelo fornecimento de
medicamentos de alto custo, como instrumento de efetivação, não apenas do
devido processo legal, senão, também, do princípio constitucional da
solidariedade social. / [en] The Brazilian Justice Power has been flooded by a wave of lawsuits
related to the fundamental right of health, facing, recently, a problem of great
constitutional repercussion, which is the obligatorily of high cost medicine
supplyment by the State, over which will be decided the new paths for Brazilian
public health, especially in regards to the reach of the principles of wholeness. In
an attempt to distribute the heavy cost of supliment of high cost medicine, some
States are using the calling to the process of the other federate agents to integrate
the whole, which hasn t been permitted in the jurisprudence, over the argument of
being a mere proselyting tool. In this factual and juridical context, the present
dissertation is done in three chapters, to analyze, at first, the public health in
Brazil, in the second, the matter of the judge mentation of the suppliment of high
cost medicines to the State; and, in third, the admissibility of the calling to the
process in these demands. The study is based in the statistic data research related
to the lawsuits involving the right to health, supported, also, in the analysis of
concrete cases, which proves the academicals, political, economic and social
importance of the subject, keeping in mind the speeches regarding the material
possibilities of the State in the effective and satisfactory availability of health
rights to the population. This final chapter is dedicated to the demonstration of the
availability of the calling to the process of the other agents co-obligated in
solidarity, for the distribution of the cost for the suppliment of high cost medicine,
as an instrument of effectuating, not just the legal lawsuit, as well as the
constitutional right of social solidarity.

[pt] O presente trabalho aborda, sob a perspectiva do alargamento da
democracia participativa, a atuação da Promotoria de Justiça de Tutela Coletiva da
Saúde da Capital do Rio de Janeiro junto ao Conselho Municipal de Saúde do Rio
de Janeiro. Para isso, dividimos este estudo em três partes. Na primeira, tratamos
das premissas fundamentais do nosso objeto, ressaltando a importância do
movimento da reforma sanitária na conquista de novos direitos na área da saúde,
principalmente, na criação e institucionalização de canais de participação popular.
Na segunda, abordamos especificamente o caráter deliberativo do Conselho
Municipal de Saúde do Rio de Janeiro e analisamos os debates dos conselheiros
para verificar em que medida a atuação do Ministério Público é levada em
consideração em seus argumentos. Na terceira, examinamos o papel do
Ministério Público como instrumento de controle externo e sua importância na
viabilização da democracia participativa dos conselhos de saúde. / [en] This thesis analysis, from the perspective of the increasing of popular
participation, the work of the Public Attorney encharged of the Public Health care
system and the Municipal Health Council in the Rio de Janeiro city. Therefore, we
have divided this work in three parts. The first one is about some import
preliminary points such as the sanitary reform and the new rights related to public
health care. This reform has created important ways of popular participation in the
area. In the second part, we analyzed the deliberative aspect of the Municipal
Health Council and how the arguments set by the Public Attorney are taken into
consideration by said Council. In the final part, we have examined the role of the
Public Attorney in the external control and how it can enable popular participation
in the Municipal Health Council.

Previous issue date: 2006-11-30 / The access to health products and services is guaranteed by the Federal Constitution of
1988, that allows its supplying for both State and private initiative.
Contrary to the constitutional determination we face a social crises once it is note
everyone that have access to medicines and health plans that make accessible health
treatments. The supply of those utilities by the State is much inferior of the need of the many
miserable people that lives in Brazil.
The work analyses the medicines and health plans price control that takes place in
Brazil by the Medicines Chamber and by the National Supplementary Health Agency
respecting the Brazilian economic order system created by the Federal Constitution of 1988
with the targets of population access increasing also mandatory according to the Federal
Constitution of 1988.
The Constitutionality analyses of those price controls is done through the study of the
national legal system the economic analyzes of those markets and the relation between those
two aspects of the study object.
The work development includes the debate about public services and the State powers
over the private renders of those services by permission or concession and the difference
between them and the private agents that renders services non privative to the State.
At the end the micro-economic aspects of the medicines and health plans are analyzed
to understand the impacts and limits of the State Regulation on those and the of the price
control mechanisms used today.
The conclusion of the work is for the unconstitutionality of the prices control by
offending the free competition and free initiative principles, among others, and by being
useless to fulfill the constitutional task for the State Regulation that is the increasing of the
population acess to those prod ucts and services / O acesso aos produtos e serviços de saúde é garantido pela Constituição Federal de
1988, que dispõe que estes serão fornecidos tanto pelo Estado quanto pela iniciativa privada.
Todavia, a despeito da determinação constitucional, temos uma crise social, pois nem
todas as pessoas têm acesso aos medicamentos e planos de saúde que viabilizem tratamentos
de saúde, cujo fornecimento pelo Estado é muito menos abrangente do que o necessário às
hordas de miseráveis que vivem no Brasil.
O trabalho analisa o controle de preços de medicamentos e de planos de saúde
realizados no Brasil, respectivamente pela Câmara de Medicamentos e pela Agência Nacional
de Saúde Suplementar, em face da sistemática da ordem econômica brasileira, colocada pela
Constituição Federal de 1988, bem como, pelos objetivos de ampliação de acesso a produtos e
serviços de saúde também impostos pela Constituição Federal de 1988.
A análise de constitucionalidade dos mencionados controles de preços é realizada por
meio do estudo do sistema jurídico nacional, da avaliação econômica dos mercados em
questão e da inter-relação entre esses dois aspectos do objeto estudado.
Ao longo do trabalho se discorre sobre os serviços públicos e os poderes do Estado em
relação aos prestadores privados destes serviços sejam concessionários ou permissionários
dos serviços públicos e os diferencia dos agentes privados que prestam serviços não privativos
do estado.
Por fim são analisados aspectos microeconômicos dos mercados de medicamentos e
planos de saúde para entender o impacto e os limites da regulação estatal destes e dos
mecanismos de controle de preços ali empregados.
A conclusão considera o controle de preços inconstitucional, por ferir os princípios da
livre concorrência e da livre-iniciativa, entre outros, e por sua ineficácia comprovada para
atingir a finalidade constitucional da regulamentação estatal que é a ampliação de acesso da
população a esses produtos e serviços

Previous issue date: 2007-11-08 / The Federal Constitution of 1988 proclaimed the right health as the right of all and
guaranteed by the State, guaranteed by social and economic politics that aim the reduction of
the risk of illness and other aggravate and to the universal and equal access to the actions
and services for its promotion, protection and recovery . It adopted an ample concept of
health, conceiving it as physical and mental well-being of the human being and its adequacy
in social lifre.
For the accomplishment of this state duty the Constitution established the Only System of
Health - SUS, integrated by all the federative beings, and fixed principles and rules apply to it.
With the edition of the Federal Law 8.080/90 - Organic Law of the Health - and, after, of the
Federal Law 8.142/90, had beginning the process of construction of the System, that is not
completed yet.
The changes and inovations that were inserted throught this process causes all the questions
that guides to this present study. With all this changes, it is questioned, if with these
modifications had evolved in the direction of the concretion of the principles that had
originally used to it as base or if, the opposite, modify the politician-constitutional option
inserted in the in the effective Federal Constitution.
The studies accomplished guides for the change of the central lines of direction of the SUS
Only System of Health - beyond the concrete reduction of the public sphere in the scope of
the System. It has a visible and gradual removal between the of the SUS and its expression in
the legal system. If in one hand, did not happen in the theory, a rupture of the constitutional
normative structure, in the other hand, clearly has a redirecionament of theu health public
politics of universal, complete and equal, resolting a unify serious threat of a definitive
disruption with the estruturantes beddings of the public politics of health.
Even thought the fact of the constitutional principles that informs the SUS, is still supported
by its managers, is clear the trend of the public politics to orient itself by a new boarding that
emphasizes the results and it promotes the values of the efficiency and the economy
rationality.
Built as a nature system of monopoly public state, the SUS goes thought, by the concrete plan,
all the innovators experiments of management that involves the joint between the public
sectors and the private for the rendering of services of health.
The effective form of state provision - direct and exclusive - comes being substituted for
another model where the State starts to be the fiscalize and to co- ordinate the established
duties / A Constituição Federal de 1988 proclamou a saúde como "direito de todos e dever do Estado,
garantido mediante políticas sociais e econômicas que visem à redução do risco de doença e
de outros agravos e ao acesso universal e igualitário às ações e serviços para sua promoção,
proteção e recuperação". Adotou um conceito amplo de saúde, concebendo-a como bem-estar
físico e mental do indivíduo e a sua adequação na vida em sociedade.
Para a realização desse dever estatal a Constituição instituiu o Sistema Único de Saúde - SUS,
integrado por todos os entes federativos, e fixou os princípios e regras a ele aplicáveis. Com a
edição da Lei Federal 8.080/90 - Lei Orgânica da Saúde - e, após, da Lei Federal 8.142/90,
teve início o processo de construção do Sistema, que ainda não se completou.
As mudanças e inovações introduzidas no decorrer deste processo suscitam as indagações que
norteiam o presente estudo. Questiona-se se estas modificações evoluíram na direção da
efetivação dos princípios que originalmente lhe serviram de base ou se, ao revés,
desconfiguram a opção político-constitucional consubstanciada na vigente Constituição
Federal.
Os estudos realizados sinalizam para a mudança das diretrizes centrais do SUS, além da
concreta redução da esfera pública no âmbito do Sistema. Há um visível e progressivo
afastamento entre a realidade do SUS e sua expressão no ordenamento jurídico. Se, de um
lado, não houve, no plano teórico, uma ruptura da estrutura normativa constitucional, por
outro ocorreu um claro redirecionamento da política pública de saúde universalizante, integral
e equânime, consubstanciando séria ameaça de um definitivo rompimento com os
fundamentos estruturantes da política pública de saúde.
Apesar do fato de os princípios constitucionais que informam o SUS serem ainda sustentados
por seus gestores, é clara a tendência da política pública de orientar-se por nova abordagem
que enfatiza os resultados e promove os valores da eficiência e da racionalidade econômica.
Edificado como um sistema de natureza pública estatal monopolista, o SUS passa, no plano
concreto, pelo aprofundamento das experiências inovadoras de gestão que envolve a
articulação entre os setores público e privado para a prestação de serviços de saúde. O modelo
de provisão estatal - direta e exclusiva vem sendo substituído por um modelo em que o
Estado passa a ser o coordenador e fiscalizador de serviços estabelecidos

Previous issue date: 2008-06-12 / Procuradoria Geral do Estado de São Paulo / The new role of the State which was brought forth by the current Federal Constitution (CF) compels that it not only guarantee, but also put the social rights into effect. This lead to a new set of problems that had not existed before, such as how to provide the rights of distributive nature that everyone is entitled. Although this is not a new responsibility, it still presents uncertainties and distinct interpretations concerning its scope, especially regarding the way to require the accomplishment of this new responsibility. This work discusses the role of the State concerning the duty of health , included in the CF. Primarily questioning if pharmaceutical assistance services, and the right of medicines to be provided by the State, are included in duty of health based on the warranty and advantages guaranteed by the Consumer Legislation. To study this State responsibility and its scope, this work discusses what would be the right of health and conjecture as to the form of its effectiveness, by performing a critical analysis of the interpretation of that right by the Judiciary power. This generally considers the conflicts under the individual perspective, according to Commutative Justice, without taking into the consideration that it is Social Law, applied to the whole society, where the rule to be applied should be Distributive Justice. Finally, this work analyzes the conclusion reached and the demand for drugs presented by the people, in an attempt to formulate a practical applicability, while considering that it is a right f the whole society, and that man and their dignity is the paradigm established as the central by the CF / O novo papel do Estado trazido pela atual Constituição Federal (CF), compelindo-o a não só garantir, como também efetivar os direitos sociais, leva a uma nova problemática até então inexistente, qual seja, a de como ele deve cumprir a tarefa de provedor desses direitos de natureza distributiva, a que todos fazem jus. Apesar de não ser uma atribuição tão nova, existem incertezas e interpretações díspares quanto à sua abrangência e especialmente à forma de se exigir o seu cumprimento. O enfoque do trabalho é o papel do Estado no tocante ao dever de saúde constante na CF, indagando se nesse dever está incluída a prestação de assistência farmacêutica e se é possível exigir medicamentos do Poder Público, utilizando-se das garantias e vantagens estipuladas na legislação consumerista. Para estudo dessa atribuição e aferição de sua abrangência, procura-se fazer um exame sobre o que seria o direito à saúde e conjecturar quanto à forma de sua efetivação, realizando uma análise crítica da interpretação desse direito pelo Poder Judiciário, que em geral analisa as lides sob a ótica individualista, aplicando-se a justiça comutativa, sem considerar que se trata de um direito social, destinado a toda a sociedade, em que a regra a ser aplicada deveria ser a da justiça distributiva. Ao final, faz-se uma análise entre a conclusão do trabalho e as demandas por medicamentos formuladas pela população, levando-se em consideração tratar-se de um direito de toda a sociedade e que o homem e a sua dignidade é o paradigma estabelecido como central na CF

Previous issue date: 2008-10-22 / This study was aimed to analyse the access of medicines as an essential part of the
right to health and, consequently, the right to life, including the current debate regarding
the Judiciary role to implement them. The content of the human dignity principle and its
legal effectiveness allow identifying the close link between its essential nucleus and the
right to health. Social right of the second generation of the fundamentals human rights,
the right to health is privilegedly guaranteed by the Federal Constitution of 1988, which
recognizes its public relevance, the immediate applicability of the norms that assure the
right to health, and the solidarity of the public authorities in their obligation to take care
of people s health.
By the legislation in force, it is possible to verify that the main objections concerning the
Judiciary performance can be surpassed. They are: the principle of separation of
powers, discritionarity of public administration in choosing which medicines integrate the
public lists, budgetary principles and rules that guide the public revenues and
expenditures and budgetary limits to implement socials rights. Through the study of the
minimum threshold and its intrinsic relation to the core of human dignity, which includes
the right to health, it is concluded that the right to health and the access to medicines
are subjective public rights and may be required judicially. More than that, if it s
necessary to preserve the health and the worthy life, the Judiciary must guarantee that
health public system (Unified Health System) supplies the medicine demanded, even if it
does not integrate the health public system list of medicines, under penalty of violating
the essence of the Federal Constitution / Este trabalho dedica-se à análise do acesso aos medicamentos como parte essencial
do direito à saúde e, conseqüentemente, do direito à vida, incluindo o atual debate
acerca do papel do Poder Judiciário para sua efetivação. O conteúdo do princípio da
dignidade da pessoa humana e sua eficácia jurídica permitem identificar a estreita
ligação entre o seu núcleo essencial e o direito à saúde. Direito social da segunda
geração de direitos humanos fundamentais, o direito à saúde está garantido pela
Constituição Federal de 1988 de forma privilegiada, que reconhece sua relevância
pública, a aplicabilidade imediata das normas que o abrigam e a solidariedade dos
entes públicos no dever de cuidar da saúde das pessoas.
A partir do ordenamento jurídico vigente, as principais objeções à atuação do Poder
Judiciário podem ser superadas. São elas: o princípio da separação dos poderes, a
discricionariedade administrativa na eleição daqueles medicamentos integrantes das
listas públicas, os princípios e as regras orçamentárias que regem as receitas e
despesas públicas e os limites orçamentários para implementar os direitos sociais,
reserva do possível . Por meio do estudo do mínimo existencial e de sua intrínseca
relação com o núcleo da dignidade da pessoa humana, onde está obrigatoriamente
incluído o direito à saúde, conclui-se que o direito à saúde e o acesso a medicamentos
são direitos públicos subjetivos, podendo ser exigidos judicialmente. Mais do que isso,
sendo necessário preservar a saúde e a vida digna, o Judiciário deve garantir que o
Sistema Único de Saúde forneça o medicamento em questão, ainda que não
pertencente às listas públicas, sob pena de descumprir a essência da Constituição
Federal

System, a complex network of healthcare and public services has been able
to guarantee universal access of this Right to Health to all Brazilian citizens.
The principal objective of this dissertation is to analyze one of the more
problematic aspects of the project: the production and accessibility of
medication.
We will discuss the trajectory made by the Brazilian pharmaceutical
industry under the theoretical perspective of historical New Institutionalism,
demonstrating the established path dependence, and discuss possible
alternatives for the national production of medication, considering the
necessities faced by the country.
From the historical/descriptive perspective, we will discuss how the
worldwide pharmaceutical industry was formed and solidified and which
artifices are utilized to maintain the oligopoly of the sector. The dissertation
will explore the limitations of the current model of national medication
production and the influence of intellectual property within the perspective of
the institutional economy. We will compare with the development of the
sector in India, which until the 1970 s had a panorama very similar to that of
Brazil, and which, in thirty years, developed into a large producer of generic
medication for world-wide distribution. In conclusion, we will discuss the
opinion of several authors consulted and interviewed regarding the
development perspectives of this sector / O acesso a medicamentos é parte integrante do direito à saúde,
estabelecido de modo bastante amplo pela Constituição brasileira. Por meio
do Sistema Único de Saúde, instituiu-se no Brasil uma complexa rede de
atendimento e oferta de serviços públicos de saúde que têm buscado
garantir a universalidade do acesso a esse direito a todos os cidadãos
brasileiros. Esta dissertação tem como objetivo principal analisar um dos
aspectos mais problemáticos desse projeto de universalização do direito à
saúde: a produção e acesso aos medicamentos.
Buscamos compreender a trajetória percorrida pela indústria
farmacêutica brasileira sob a perspectiva teórica do neo-institucionalismo
histórico, demonstrando o path dependence estabelecido e discutir as
possíveis alternativas para a produção nacional de medicamentos diante das
necessidades enfrentadas pelo país.
Sob a perspectiva histórico-descritiva, discutiremos como a indústria
farmacêutica mundial se formou, se solidificou e quais os artifícios utilizados
para manter o oligopólio do setor. A dissertação explora as limitações do
atual modelo de produção nacional de medicamentos e a influência do
respeito à propriedade intelectual sob a perspectiva da economia
institucional. Comparamos com o desenvolvimento do setor na Índia que, até
os anos 1970, tinha um panorama muito similar ao brasileiro e, em trinta
anos, tornou-se o grande celeiro de produção de genéricos para o mundo.
Ao finalizar, discutimos a opinião de autores consultados e entrevistados
sobre as perspectivas de desenvolvimento do setor

do Sistema Único de Saúde, instituiu-se no Brasil uma complexa rede de
atendimento e oferta de serviços públicos de saúde que têm buscado
garantir a universalidade do acesso a esse direito a todos os cidadãos
brasileiros. Esta dissertação tem como objetivo principal analisar um dos
aspectos mais problemáticos desse projeto de universalização do direito à
saúde: a produção e acesso aos medicamentos.
Buscamos compreender a trajetória percorrida pela indústria
farmacêutica brasileira sob a perspectiva teórica do neo-institucionalismo
histórico, demonstrando o path dependence estabelecido e discutir as
possíveis alternativas para a produção nacional de medicamentos diante das
necessidades enfrentadas pelo país.
Sob a perspectiva histórico-descritiva, discutiremos como a indústria
farmacêutica mundial se formou, se solidificou e quais os artifícios utilizados
para manter o oligopólio do setor. A dissertação explora as limitações do
atual modelo de produção nacional de medicamentos e a influência do
respeito à propriedade intelectual sob a perspectiva da economia
institucional. Comparamos com o desenvolvimento do setor na Índia que, até
os anos 1970, tinha um panorama muito similar ao brasileiro e, em trinta
anos, tornou-se o grande celeiro de produção de genéricos para o mundo.
Ao finalizar, discutimos a opinião de autores consultados e entrevistados
sobre as perspectivas de desenvolvimento do setor

[pt] Introdução: A promoção das políticas públicas voltadas à implementação dos direitos sociais (saúde inclusive) lida com a difícil tarefa de distribuir os limitados recursos estatais aos anseios da população, notadamente quando se busca implementar os direitos cujo custo é elevado. Constatou-se que os sujeitos de pesquisas biomédicas, ao final do estudo, têm sido negligenciados no acesso aos benefícios terapêuticos do medicamento ou procedimento para cuja aprovação colaboraram. Finda a pesquisa, há muitas demandas contra o Estado, formuladas pelos sujeitos participantes do ensaio. Objetivos: discutir os posicionamentos judiciais atinentes ao controle jurisdicional de políticas públicas no fornecimento de medicamentos ao participante da pesquisa, após o encerramento do estudo. Métodos: levantamento qualitativo, no sentido de identificar um norte interpretativo e, a partir dele, elaborar um posicionamento crítico e propor um standard decisório que, além juridicamente respaldado, seja eticamente consentâneo aos parâmetros de conduta nos procedimentos envolvendo o participante de pesquisa, de modo a reconhecê-lo como sujeito moral digno ao igual respeito e consideração. Resultados: o levantamento jurisprudencial efetuado não pode fornecer uma ratio decidendi clara no tema. Discussão: o Estado tem dever constitucionalmente assumido de garantir a assistência integral à saúde, portanto, possui legitimidade para ser demandado em ações nas quais o participante da pesquisa busca, ao final do estudo, a continuidade do fornecimento do medicamento. Porém, tanto a Resolução CNS número 466/2012, como a Declaração de Helsinque, que impõem regras a serem cumpridas pelos pesquisadores e patrocinadores, asseguraram aos participantes acesso aos produtos ou agentes obtidos. Considerações finais: o participante da pesquisa titulariza direito subjetivo ao fornecimento do medicamento após o encerramento. Estado e atores da pesquisa (patrocinador e instituição) são devedores solidários dessa obrigação. A demanda direcionada em face de um, ou sua condenação, autoriza o chamamento ou regresso em face do outro. / [en] Introduction: The promotion of public policies aimed at implementation of social rights (including health) deals with the difficult task of distributing limited state resources to popular expectations, especially when one seeks to implement the rights which cost is high. It was found that the subjects of biomedical, researches at the end of the study, have been neglected in accessing therapeutic benefits of the drug or procedure which they cooperated for its approval. Ending the research, there are many claims against the State, formulated by the subjects participating in the trial. Objectives: To discuss matters pertaining to the judicial control of public policies for the supply of medicines to the research participant, after the end of the study. Methods: A qualitative survey to identify an interpretive north, and from it develop a critical approach and propose a decision-making standard that besides being legally backed, also being ethically consistent to the standards of conduct of procedures involving the research participant, in order to
recognize it as a moral subject worthy of equal respect and consideration. Results: The case-study carried out can not provide a clear ratio decidendi in the topic. Discussion: the state has assumed constitutional duty to ensure integrate health care, therefore has standing to be sued in actions which the participant within the survey seeks at the end of the study, the continuity of medicine supply. However, both the CNS Resolution No. 466/2012, and the Declaration of Helsinki, which impose rules to be observed by researchers and sponsors, assured the participants access to products or agents obtained. Final considerations: the research participant securitization subjective right to supply the drug after closure. State and research actors (sponsor and institution) are joint debtors of this obligation. The lawsuit directed to one, or its condemnation authorizes the call or return in the face of the other.

Previous issue date: 2006-10-24 / Conselho Nacional de Desenvolvimento Científico e Tecnológico / The present dissertation has for objective the study of the social workers' practices in the Units of Municipal Services of Health of Sorocaba State of São Paulo and its contribution in the guarantee of the rights to health. This object of the research had for context the perspective Brazilian socio-historical, focusing the relationships among the Social Service, the Health and the Social Rights. The methodology included the bibliographical research about the central themes of the study, which are, Social Service, Health, Social Rights and Citizenship; more a documental research (laws, plans etc.), and the research of field with quantitative and qualitative character. It was used as methodological procedures, questionnaire and interviews semi-structured. The analysis of data was based in three nuclei: nucleus of conceptions, nucleus of guarantee of right and nucleus of limits and possibilities. For the nucleus of guarantee of right, three axles of insertion were used: actions of character of emergency; education and information in health; mobilization of the community and planning and assessorship. The results were obtained evidenced that the social workers know the rights to the health and try to execute them in their practices, with prominence to the rights the information. The results denoted still, fragility in the warranty of the rights the health, front the fragmented characteristics, punctual and focused in the social workers' practices, with emphasis in the individual actions due to internal and external factors. Those practices demand a collective commitment and shared among the many professionals that work with SUS (Unique System of Health) and the users of the services, making possible, like this, conditions to contribute in the construction, enlargement and warranty of the rights to the health, to the citizenship / A presente dissertação tem por objetivo o estudo das práticas dos assistentes sociais nas Unidades de serviços municipais de saúde de Sorocaba/ SP e sua contribuição na efetivação dos direitos à saúde, na perspectiva sócio-histórica brasileira, focando as relações entre o Serviço Social, a Saúde e os Direitos Sociais. A metodologia abrangeu a pesquisa bibliográfica sobre os temas centrais, quais sejam, Serviço Social, Saúde, Direitos Sociais e Cidadania, bem como a pesquisa documental (leis, planos etc.), e a pesquisa de campo, de caráter quanti-qualitativo. Foram utilizados como procedimentos metodológicos, questionário e entrevista semi-estruturada. A análise dos dados fundamentou três núcleos: núcleo de concepções, núcleo de efetivação e núcleo de limites e possibilidades. Para o núcleo de efetivação, foram utilizados três eixos de inserção: ações de caráter emergencial; educação e informação em saúde; mobilização da comunidade e planejamento e assessoria. Os resultados obtidos evidenciaram que os assistentes sociais conhecem os direitos à saúde e buscam efetiva-los em suas práticas, com destaque ao direito à informação. Os resultados denotaram, ainda, uma fragilidade na efetivação dos direitos à saúde, face às características fragmentadas, pontuais e focalistas das práticas dos assistentes sociais, com ênfase nas ações individuais. Essas práticas exigem um compromisso coletivo e compartilhado entre os diversos profissionais que operacionalizam os SUS (Sistema Único de Saúde) e os usuários dos serviços, possibilitando, assim, condições para contribuir na construção, ampliação e efetivação dos direitos à saúde, à cidadania
