1945年《聯合國憲章》賦予國家有義務針對彼此爭端協議和平解決爭端之方法,並且有權自由選擇和平方法解決爭端。1982年《聯合國海洋法公約》進一步確認《聯合國憲章》的和平解決爭端規範,並在尊重國家主權原則的前提下,特別載明一套關鍵維持世界海洋法制穩定存續的強制爭端解決規定。
中國大陸與東協各國於2002年針對日益激化的南海爭端簽訂《南海各方行為宣言》,其中明文重申《聯合國憲章》以及《海洋法公約》等國際法規範下的和平解決爭端原則。爾後,南海爭端隨著大國政治的發展與抗衡而顯得更加動盪,菲律賓進一步在2013年初將與中國大陸的南海爭端提交到《海洋法公約》強制仲裁程序來解決。因此,本文探討既存的《南海行為宣言》是否構成強制仲裁庭的管轄權障礙,來保障國家有自主選擇爭端解決方式的權利?又《南海行為宣言》在陸菲南海爭端中扮演何種和平解決爭端的角色,並且其意義與不足之處為何?
在此問題意識下,首先就爭端標的進行分析,採取以國際關係及仲裁庭的角度來檢視陸菲南海爭端的性質。以國際關係的角度來檢視能發揮以下三個作用:一、理解爭端國在國際政治中的實力評估;二、檢視小國採取司法利用,以及與大國結盟以增加抗衡大國之談判籌碼及獲取法律正當性的策略;三、同時考量所涉爭端的政治與法律性質。另一方面,以仲裁庭的角度來檢視則能瞭知法院如何以國際公法原則來判斷爭端性質。
其次整理《海洋法公約》爭端解決機制以及《南海行為宣言》的內容,分析《海洋法公約》強制爭端解決機制設計的立意與《南海行為宣言》的制訂脈絡,得出《南海行為宣言》在《海洋法公約》的規範下僅為一載有「斡旋」精神的協議,爭端解決的責任仍舊交由簽署國解決。
此外,進一步再藉由仲裁庭的裁判,來分析《南海行為宣言》的法律性質。最後本文發現,中國大陸與東協各國所制訂的《南海行為宣言》僅為一重申既存和平解決規範精神的不具法律拘束力之文件,且未替簽署國創設必須由談判來解決爭端的義務。
最後,對於《南海行為宣言》作出整體評價,其彰顯具有國際法所承認之斡旋精神,展現其類似軟法性質的衝突預防之功能,然而《南海行為宣言》不具有法律實質拘束力,因而無法排除基於《海洋法公約》所提起的強制司法管轄。縱然如此,在「跨國法制歷程」概念中,《南海行為宣言》並非毫無建樹,其為透過各國「互動」而產生一行為模式之規範,然而《南海行為宣言》制訂後至仲裁庭啟動期間,並未使得相關國家對該規範進行有力「內化」的工程,使得該項規範的原則無法發揮效用。然此部分之推論尚待進一步詳細論證分析。
綜上所述,本文透過對於《南海行為宣言》之相關分析,認為我方在擬定未來南海政策時應在尊重各國主權原則的前提下,提升自身國家綜合實力以增加對外談判之籌碼,同時應增進國際法中關於和平解決爭端之研究,有效在各種方面落實國際法爭端解決規範的內化進程。

The Southern African Development Community (SADC) is a regional economic community established by Treaty in 1992 and comprising fifteen southern African countries. The Tribunal, SADC’s judicial organ, is situated in Windhoek, Namibia and became operational in 2005. The Tribunal enjoys a wide mandate to hear and determine disputes between states, states and SADC, and between natural and legal persons and states or SADC. It is mandated to develop its own jurisprudence having regard to applicable treaties, general rules and principles of public international law, and principles and rules of law of member states. Being new in the field, the Tribunal has not as yet developed a significant jurisprudence although it has delivered a number of judgments some of which are referred to in the study. The Tribunal is expected to develop its own jurisprudence having regard to the jurisprudence developed by other international courts involved in the judicial settlement of disputes. The study offers a comparative review and analysis of the jurisprudence of two selected courts: the International Court of Justice (ICJ) and the Court of Justice of the European Union (ECJ). The focus is on four selected areas considered crucial to the functioning of the Tribunal and the selected courts. The study discusses the parties with access to the Tribunal and compares this with access to the ICJ and ECJ. The jurisdiction of the Tribunal is contrasted with that of the two selected courts. The sources of law available to the Tribunal are discussed and contrasted to those of the two courts. Lastly, the enforcement of law in SADC is contrasted to what applies in relation to the selected courts. In each selected area, similarities and differences between the Tribunal and the two courts are noted and critically evaluated. Further, rules and principles developed by the two selected courts are explored in depth with a view to identifying those which could be of use to the Tribunal. Disposal with an Investment Claim JUDr. Filip Černý International investment protection is very special legal discipline which stands at the borderline between public and private, international and national (domestic) law. The intersections between these legal areas produce a vast range of questions on the applicable law and the nature of the legal institutes inherent to investment protection. The legal system of investment protection is founded on a matrix consisting of bilateral and multilateral treaties and simultaneously shares some of the customary origins inherent to diplomatic protection of foreigners. The particularity of the investment protection system is given by the existence of the diagonal relations between the host state and the investor of the other state. The combination of the public international law sources and the diagonal relations developing inside the public international law matrix induce questions on the nature of such rights and obligations arising inside of the investment protection system among its actors. Author analyses these relations with an aim to determine the nature of the investment claim as a prerequisite for a volitional disposal of the investment claim by the investor.

L’action en justice intentée en matière de Responsabilité Sociale de l’Entreprise révèle certaines limites lorsque les justiciables parties prenantes souhaitent protéger leurs intérêts. Par une juridicisation du droit de la RSE à mi-chemin entre la soft law et la hard law, l’action en justice des parties prenantes pourrait être véritablement efficiente. Dès lors, les mécanismes processuels traditionnels sont insuffisants lorsqu’il s’agit d’agir en justice dans ce domaine. C’est notamment à travers l’intérêt et la qualité à agir en justice des parties prenantes que des aménagements de la procédure civile vont être véritablement nécessaires. Des améliorations supplémentaires telles que l’instauration d’une action de groupe élargie au domaine de la RSE et davantage américanisée permettrait notamment aux parties prenantes d’assurer leur défense grâce à un dispositif nouveau très efficace. De plus et par la voie extrajudiciaire des modes alternatifs de règlement des litiges, les acteurs de la RSE peuvent également décider de porter le différend qui les oppose hors de la connaissance du juge étatique. Ce choix d’action peut être révélateur d’une préférence pour une justice davantage négociée. Ces propositions semblent être indispensables à la mise en œuvre d’une action en justice efficace en matière de RSE. Les parties prenantes pourront alors agir en justice de manière inédite afin de parachever leur protection. Les nécessités juridiques et sociales actuelles semblent ainsi faire évoluer le droit afin que les parties prenantes puissent bénéficier d’une action en justice considérée comme un véritable contre-pouvoir face à l’entreprise. / Legal actions brought to court concerning Corporate Social Responsability reveal certain limits when litigants’ stakeholders wish to protect their interests. The Corporate Social Responsability law falls between soft law and hard law. Going through CSR law’s judicalization could really make litigation of stakeholders efficient. Usual processual mechanisms are insufficient once an action has to be brought to court dealing with CSR. The civil procedure will need some changes, specifically relating to legal standing and stakeholder interest. Some added improvement would allow stakeholders to ensure their legal defence thanks to this new and efficient legal device. The setting up of a collective action including a CSR with more resemblance to the American one would represent one such improvement. Moreover, stakeholders can decide to settle the matter out-of-court with an extrajudicial approach, using alternative dispute resolution. This choice could amount to a more negotiated inflection of justice. These proposals seem to be necessary to settle an efficient legal action concerning CSR. In this way stakeholders will be able to litigate in a whole new way in order to consolidate their protection. Current legal and social needs seem to make the law evolve so that stakeholders benefit from a legal action which can be considered as a real countervailing power against a corporation.

D’une manière générale, la fonction administrative contentieuse peut être appréhendée comme l’ensemble des juridictions chargées de connaître des litiges résultant de l’activité des autorités administratives. Elle represente l’activité juridictionnelle en matière administrative. Par conséquent, la fonction administrative contentieuse doit s’appréhender tant sous l’angle d’une juridiction, que sous celle de son juge. L’institution d’une fonction administrative contentieuse en Côte d’Ivoire remonte à l’époque coloniale. Cependant, à l’instar de la plupart des ex-colonies françaises, ce n’est qu’au lendemain de l’indépendance en 1960, que la fonction administrative contentieuse ivoirienne s’est affirmée en tant que fonction juridictionnelle autonome à l’égard du système français. La procédure administrative non contentieuse, comme la procédure administrative contentieuse dont il est question dans l’étude ont connu de grands progrès tant en France que dans les pays francophones d’Afrique pour lesquels le système de juridiction administrative comme le droit qu’il vise à contrôler ont longtemps constitué, selon la belle formule de Jean RIVERO, un bon « produit d’exportation » français. La Côte d’ivoire n’échappe pas à ce constat. Aussi l’étude de la fonction administrative contentieuse en Côte d’Ivoire a pour objet de dessiner la physionomie générale de la justice administrative ivoirienne un demi siècle après son institution afin d’en souligner les éléments de permanence ou de changement. / Generally speaking, the contentious administrative function can be arrested as all the jurisdictions asked to know disputes resulting from the activity of the authorities. Assessment and analysis of wildfires with the aid of Remote Sensing and GISVorster, Willem Adriaan 12 1900 (has links)
Wildfires destroy large tracts of veld and forest land every year in South Africa. These fires can be devastating, resulting in loss of human lives, the destruction of property and the loss of income, for example the forest fire in the Sabie district in Mpumalanga in 2007 which destroyed about 7% of South Africa’s forested areas. There are frequently legal disputes with respect to the origin of wildfires, the extent of the fire and the land cover destroyed by the fires.
The forensic capabilities of remote sensing in detecting and analysing post-wildfire characteristics have become an important contribution towards solving such legal disputes and in understanding wildfire characteristics. These post fire products can be used as evidence in court cases. Most of the time those court cases came up a few years after the fire event. By then, little or no evidence can be found on the terrain where the fire was. Remote sensing archives provide a reliable source of data that can be used to analyse these events after these long intervals.

Child care and contact evaluations : psychologists' contributions to the problem-determined divorce process in South AfricaThemistocleous, Nicola 06 1900 (has links)
Disputes concerning care and contact arrangements for the minor children of divorcing couples present special challenges for professionals in the legal and psychological professions. Care and contact (custody) disputes, which are complex undertakings, are a point of debate in the professional arena in South Africa. Clinical psychologists are often included in the professional cohort that assists the high court, as the upper guardian of minor children, in the decision making process regarding contested care arrangements of children. This field is further challenged by the lack of training programmes and practice guidelines, the intense adversarial nature of disputes and litigation processes, as well as the increase in board complaints levelled against psychologists at the Health Professions Council of South Africa. These challenges contribute to the reluctance of psychologists to become involved in care and contact matters. This study therefore aimed first to explore the current practices and contributions of clinical psychologists in care and contact disputes in South Africa, and second to evaluate the procedures used by clinical psychologists to inform their recommendations to the court. In such matters, clinical psychologists adhere to the best interest of the child (BIC) principle. The final aim of the study was to identify and propose guidelines for a model of better practice. The study was guided by a Constructivist Epistemology and a Social Constructionist paradigmatic framework. A qualitative research approach was employed. Data were collected through face- to-face interviews with clinical psychologists and advocates and were analysed using Thematic Network Analysis of Attride-Stirling. The findings, which indicated that that the practices of psychologists are plenteous, revealed significant shortfalls in current practices. In addition, the findings designated that creating a universal model for care and contact evaluations to fit with the legal professions’ empiricist tendency poses a paradigmatic dilemma and a practical challenge. Southern Africa is experiencing land conflicts themselves in very different ways between state and
stakeholders, within and between communities, within families, and specially within singular
persons. The conflict of interests in the right to land in southern Africa with particular reference to
Mozambique becoming a major issue and evidence conflicts at various levels of society and some
of them are quite destructive.
The present thesis seeks to address some juridical aspects on access, tenure and land use rights.
Land problems have clear roots in the dispossession of Africans under colonialism and apartheid,
and the powerful legacy this has left both in terms of outright suffering and also in the historical
memory. Land issues are probably the most contentious topic in Mozambique since the
independence in 1975. In Southern Africa and Mozambique in particular, one of the most profound
causes of such struggles has related to the tenure, the ownership and control of land. In fact the
right to land is the major issue in many societies and in Mozambique the unlimited interest in land
are quite similar, due the fact that majority of people are peasant or agriculturists.
Land is therefore a very strategic socio-economic asset, particularly in poor societies like
Mozambique where wealth and survival are measured by control of and access to land. However,
land is also a state symbol and source of political influence and power. The Law in Mozambique
retains the principle that land is the property of the state and cannot be sold or mortgaged, but it
attempts to adjust this legacy from the socialist past to the reality of a market economy. Despite
existing land law the government still not enable to control the access and right of use of land. The
situation is compounded by a weak or non functioning judiciary system. / Os problemas sobre o direito de acesso, posse, propriedade, uso e aproveitamento da Terra, constituem matéria de debate actual a nível internacional, com realce para a região da Africa Austral e Moçambique em especial. É uma matéria que preocupa os governos e a população em geral, por a terra ser um bem de grande utilidade sócio-económica e política. Moçambique possui um regime jurídico sobre terra (lei nº-19/97 de 1 de Outubro, seu Regulamento e Anexo Técnico), no entanto, ela é lacunosa e carece de reforma afim de se adaptar à realidade dos problemas que se levantam no âmbito da posse, uso e aproveitamento e dos conflitos emergentes. Alguns factores do surgimento de conflitos no âmbito do processo da posse, uso e aproveitamento da terra resultam no entanto, da perda de confiança dos particulares em relação aos órgãos do aparelho do Estado que lidam com matérias sobre terras, devido a burocracia e a corrupção praticada por alguns funcionários. A terra em Moçambique é propriedade do Estado, o que implica uma maior responsabilidade por parte do governo, na sua gestão. O actual regime jurídico sobre a terra, carece de concertação de alguns aspectos fundamentais do ponto de vista legal. Trata-se da harmonização da legislação pertinente sobre terras. As leis promulgadas sobre a matéria embora defendem a necessidade de gestão da terra que beneficie os seus utilizadores, tal vontade, entretanto, não têm produzido efeitos satisfatórios. É, pois, neste contexto, que a presente tese cujo título é Alguns Aspectos do Regime Jurídico da posse e do Direito de uso e aproveitamento da terra e os conflitos emergentes em Mçambique, pretende contribuir na contínua abordagem sobre a problemática da posse da terra e dos conflitos emergentes. 近十年來,北京已轉變它在東南亞區域的外交政策,希望與東盟成員國家能維持一定的良好關係,並發展出一個和平又互利的戰略夥伴關係。1997年到2012年之間,中國與東盟從建立對話機制開始,雙方實質上的經貿投資與聯合計畫都快速增長。從多方面顯示:不僅在政治、經濟與維持區域安全等方面,中國與東盟成員都已共享務實的合作成果,近來更大力拓展雙方的互連互通與交通基礎建設,期使共同邁向實質的中國-東盟戰略夥伴關係。
南中國海周邊各國的利害與衝突不一,是個複雜的區域;而中國與東盟成員之間的對話機制與合作關係的基礎上,有助於減緩此一緊張情勢。本報將採用文獻分析的定性研究方法告指出(實際上)(1)北京的東南亞外交政策正面臨的主要挑戰是有東盟以外國家新勢力的強力介入或是舊有勢力的急速恢復,進而互相抗衡。(2)中國被稱為有過分自信的政策規劃期間,北京在推動與東盟戰略夥伴關係,實際上中國與東盟成員關系都已共享務實的合作成果。 / Abstract
China-ASEAN relations have been transformed over the last decade by Beijing’s aim to create a stable neighboring environment as outlined in its state policy of peaceful development. This relationship has been embodied in a series of joint plans and statements with ASEAN between 1997 and 2012. In the three areas of politics and security, economy, and connectivity and infrastructure, the paper will show the relationship has followed a similar pattern, that is cooperation has been deepened according to China’s aims for its relationship with Southeast Asia. While relations have continued to develop in these areas, constant focus on the issues of assertiveness and territorial disputes, particularly over the last 3 years, means that progress and development in the relationship often receives little attention. The South China Sea is a complex issue, however security-related dialogue between China and ASEAN member states will be shown to have mitigated this problem to a certain extent. The paper will show that the challenges to Beijing’s policy lies with countries from outside the sub-region and their return, or growing role in Southeast Asian affairs, and that in fact during the period when China has been labeled more ‘assertive’ its relationship with ASEAN has deepened and developed as planned. In its use of materials the paper will employ the qualitative research method of document analysis.
