Supremo Tribunal Federal tornou-se o guardião da Constituição brasileira, bem
como, através de análise jurisprudencial, o que a referida Corte extrai de tão
relevante competência. / [en] This present study has the purpose is to analyze the guardian of the
Constitution in Brazil, beginning with theoretical basis analyzis, from the history
of brazilian constitutional control and even criticism of the established model in
the Constitution of 1988. Thus, the study intention was to investigate how the
Supreme Court became the guardian of the Brazilian Constitution, as well, by
jurisprudential analysis, what referred Court extracts of such relevant competence.

Desde a promulgação da atual Constituição da República Federativa do Brasil, em cinco de outubro de 1988, percebe-se que o fenômeno do ativismo judicial tem ganhado força nos Tribunais brasileiros nos mais variados assuntos, entre eles o direito político-eleitoral. Este trabalho visa a evidenciar este fenômeno no Brasil, mais precisamente por meio do estudo pormenorizado do caso da verticalização das coligações partidárias. A atuação do Tribunal Superior Eleitoral, em fevereiro de 2002, a respeito da verticalização provocou o debate sobre o ativismo judicial na Imprensa, no Congresso Nacional e também entre juristas e cientistas políticos. A manutenção da interpretação do TSE pelo Supremo Tribunal Federal, por duas vezes, só veio a arregimentar ainda mais discussões sobre o tema. Houve movimentação por parte do Legislativo e de Partidos Políticos no sentido de extirpar definitivamente tal interpretação judicial do ordenamento jurídico brasileiro. Assim sendo, este trabalho compõe-se de análises sobre decisões de tribunais superiores (TSE e STF) em que o fenômeno do ativismo judicial foi identificado. De modo a contextualizar dogmaticamente a análise das decisões, serão abordados aspectos constitucionais e legais concernentes à Justiça Eleitoral, demonstrando como as decisões sobre a verticalização ultrapassaram a competência judicial sobre a matéria. Para contextualizar as decisões analisadas na jurisprudência dos tribunais superiores, serão retomados os julgamentos proferidos pelo Tribunal Superior Eleitoral e pelo Supremo Tribunal Federal em fidelidade partidária, regras de propaganda eleitoral, requisitos de elegibilidade (certidão de quitação eleitoral) e número de vereadores em cada município brasileiro. Por fim, a análise das decisões dos tribunais superiores a respeito da verticalização será contraposta aos limites legais e constitucionais previamente estudados, evidenciando, assim, o fenômeno do ativismo judicial no direito eleitoral. / Since the promulgation of the Constitution of the Federative Republic of Brazil, in October 5, 1988, the (phenomenon known as) judicial activism has built-up in strength on the Brazilian courts, being discussed in many cases, including those related to Election Law. This thesis intends to demonstrate this phenomenon occurrence in Brazil, more specifically by studying the case of vertical party coalitions. The performance of the Superior Electoral Court concerning the verticalization, in February 2002, raised the debate on judicial activism on the press, the Congress and also among jurists and political scientists. The preservation of the Superior Electoral Courts interpretation by the Supreme Federal Court has raised even more debates on the subject. Furthermore, the Legislative Power and some political parties also tried to exclude this judicial interpretation from the Brazilian legal system. Thus, this thesis consists on the analysis of superior courts decisions in which the phenomenon has occurred. Focusing on the its dogmatic contextualization, constitutional and legal aspects of the Electoral Justice will be discussed, demonstrating how the decisions on verticalization exceed the jurisdiction on that matter. To contextualize the decisions with the superior courts jurisprudence, the rulings of Supreme Federal Court and the Superior Electoral Court on party loyalty, campaign advertising, elegibility, and the maximum number of deputies in each Brazilian municipality will be examined. Finally, the analysis of the superior courts decisions concerning the verticalization will be faced in opposition to the legal and constitutional limits previously examined, demonstrating the existence of the judicial activism phenomenon on the Election Law.

[pt] O garantismo penal busca a interpretação do Direito Penal e Processual Penal em consonância com a Constituição, assegurando a todos os cidadãos, inclusive aqueles que respondem a processos, os direitos e garantias individuais, limitando o poder estatal. O direito penal deve ser fulcrado em princípios como
legalidade estrita (devendo ser feita a análise da tipicidade de forma conglobante), materialidade e lesividade dos delitos, responsabilidade pessoal, contraditório, a presunção de inocência dentre outros, não podendo intervir de forma violenta contra o acusado, sob pena de estar contribuindo para o aumento da violência. Prisão não é solução contra crimes. Deve-se investir mais em políticas públicas efetivas. A liberdade é a regra. Prisão, exceção. Deve o magistrado, quando a prisão não for adequada e necessária, aplicar outras cautelares. As prisões cautelares devem servir ao processo, observando-se as regras processuais e princípios constitucionais. Na garantia da ordem pública, deve-se demonstrar o perigo na liberdade de forma concreta. As decisões do Tribunal de Justiça de Minas devem estar em consonância com as decisões garantistas do Supremo Tribunal Federal. / [en] The Penal Guaranteeism persuits the Criminal Law and Procedures
interpretation in line with the Constitution, assuring all the citizens, including the
ones whom respond to proceedings, the rights and individual guarantee, limiting
the State power. The criminal law must be established to principles such as
strict legality, (must be made the analysis of the typical features in an encompass
way), materiality and how the offences prejudice, personal responsibility,
contradictory, the presumption of innocence among others, do not taking part in a
violent way against the accused, under penalty of being contributing to the
violence increase. Arrest is not the solution against crimes. It must be more
invested in effective public policies. Freedom is the rule. Arrest, an exception. The
magistrate must apply interim measures when the arrest is not suitable or
necessary. The interim measures must serve the proceeding, taking into account
the procedural rules and the constitutional principles. In the public order
assurance statement, it must be shown the danger in freedom in a concrete way.
Court of Justice of the Estate of Minas Gerais decisions must be in line with the
decisions from the garantists of the Supreme Court.

com a promulgação da atual

em tensão Estado de

procedimentalismo de Habermas, cuja ênfase no processo

defesa do Judiciário como protetor das condições

besides to amplify interpretative possibilities, increased
the authority of Brazilian
Supreme Court in judicial review. To analyse this
phenomenon, that causes a shock
between Law State and Democracy, it takes theoric
debate among the
substantialist perspective of Dworkin about democracy and
Judicial Review and the
procedimentalism of Habermas, whose emphasis in democratic
process results in
defense of Judicial Branch as guardian of necessary
conditions for democracy
maintenance. Habermas supposes rationalized potential of
dialogue with a wide
Constitution interpreters community to produce correct
decisions. So, this premise -
judicial expansion in Brazil - and this theoric option
that bets in dialogue derived
from public sphere in the materialization process of
constitutional dispositives, this
dissertation analyses how Brazilian constituent conceived
Brazilian Supreme Court
and its access way, for after verify, through Supreme
Court decisions, if this
tribunal adopts an orientation that favour or not the
emergency dialogue of public
sphere, notably through recognition of interpreters

Previous issue date: 2015-11-13 / CAPES - Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / O tema desenvolvido na tese é a conciliação no Juizado Especial Federal, microssistema da Justiça Federal. A pesquisa tem como pressuposto o entrelaçamento das ideias de justiça conciliativa, democratização e incremento do nível de cidadania da sociedade brasileira. Começando pelas metamorfoses do contexto sócio-jurídico da pós-modernidade e suas consequências para o monopólio estatal do direito e da justiça, reescrito a partir do pluralismo jurídico e da policontexturalidade, são analisadas as crises do Estado do Bem-Estar Social: política, ideológica, filosófica, financeira e demográfica, afetando drasticamente o nível das prestações sociais, que são a sua essência. As principais externalidades negativas da retirada do Estado do Bem-Estar Social, para os fins da tese, são a limitação e a consequente judiciarização dos direitos sociais. A resposta da Administração da Justiça, na terceira onda globalizada de reformas sobre a acessibilidade à justiça, de Cappelletti e Garth, no Brasil veio com os Juizados Especiais, concebidos para serem uma justiça de proximidade, informal e conciliativa. A judiciarização exacerbada dos direitos sociais previdenciários, no entanto, impactou de maneira prejudicial a funcionalidade do Juizado Especial Federal, cuja estrutura deficitária não consegue atender à demanda em prazo razoável e com a qualidade desejada. O Juizado Especial Federal tende, então, a ordinarizar o procedimento, abandonando os seus princípios estruturantes: sumariedade, oralidade e consensualidade. Distante, não consegue ser uma justiça informal, nem conciliativa. Sem uma teoria da administração do conflito típico do Juizado Especial Federal, que tem o poder público como parte e direitos de natureza patrimonial como objeto, a ideia fundamental de consensualidade resume-se ao voluntarismo e ao esforço pessoal de alguns de seus juízes. Sem incentivo, as procuradorias públicas nunca se engajaram totalmente na política judiciária de tratamento adequado de conflitos do Conselho Nacional de Justiça e, quando participam, é apenas com o propósito de economizar em prejuízo de direitos líquidos e certos que deveriam satisfazer na íntegra. O contributo mais relevante da tese é propor uma virada procedimental para que a audiência prévia de conciliação, momento e oportunidade por excelência da aproximação das partes e do diálogo entre estas, seja efetivamente designada pelos juízes, conforme dispõem os arts. 16 e 17 da Lei n° 9.099/95, 334 do Novo Código de Processo Civil (NCPC) e 27 da Lei de Mediação e Conciliação, levando-se a sério o princípio constitucional da consensualidade nos Juizados Especiais (art. 98, I, da Constituição da República Federativa do Brasil - CR). / The thesis develops the theme of conciliation in Special Federal Court, a micro system of the Federal Justice. The research presupposes the intertwining of the ideas of conciliative justice, democratization, and the increase of the level of citizenship in Brazilian society. The crises of the State of Well Being – political, ideological, philosophical, financial, and demographic –, which drastically affect the level of the social services that are its essence, are analyzed in the context of the metamorphosis of the post-modern socio-juridical context and its consequences to the State monopoly of Law and justice, which was rewritten as from juridical pluralism and multi-contextualization. To the purposes of this thesis, the main negative externalities of the withdrawal of the State of Well Being are the limitation of social rights and their consequent bringing to courts. The Administration of Justice’s response to that, in Cappelletti’s and Garth’s third globalized wave of reforms on the accessibility to justice, came, in Brazil, with the Special Courts, conceived as an informal and conciliative proximity justice. The overwhelming volume of litigation on social security rights, however, has negatively impacted the functionality of Federal Special Court, whose deficient structure cannot answer to the demand on reasonable time and with the desired quality. These courts tend, then, to simplify their procedure, abandoning their structuring principles of summarization, orality, and consensuality. By being distant, they are unable to function as either an informal or a conciliation justice. Without a theory on the administration of the typical conflict of the Special Federal Courts, which has the State as a litigant and rights of patrimonial nature as object, the fundamental idea of consensuality resumes itself to the voluntarism and personal effort of some of their judges. With no encouragement, public attorneys have never fully engaged in Brazil’s National Council of Justice’s (Conselho Nacional de Justiça) judiciary policy of adequate treatment of conflicts, and, when they do join in the litigation, it is with the sole purpose of saving on financial damages that arise from unquestionable rights that should be fully satisfied. This thesis’ most relevant contribution is to propose a procedural turn so that the preliminary conciliation hearing, which is the ideal moment and opportunity to bringing the litigants together and establishing a dialogue between them, is effectively designated by judges, as is disposed by articles 16 and 17 of Law no. 9099/1995, 334 of NCPC, and 27 of the Law on Mediation and Conciliation (Law no. 13140/2015), taking the constitutional principle of consensuality on Special Courts seriously (article 98, I, of the Brazilian Constitution).

Previous issue date: 2017-04-07 / The Brazilian Constitution of 1988 provided the Brazilian Courts of Accounts with
important competencies for the external control of public expenditures, including the
function of judging the accounts of those who use, collect, store, and administer public
resources, and the power to impose sanctions and order the return of amounts spent
improperly. At the same time, the 1988 Brazilian Constitution, through its Article
5, guarantees to all individuals that the State can only deprive them of their assets and
rights if it faithfully follows certain specific principles (“normas-princípio”) of due legal
process, adversarial system and full defense. Disrespecting directly such principles,
the TCU Organic Law (Law 8.443/92) structured the Federal Court of Accounts in such
a way as to give to thejudges (”Ministers”) of the Court the role of auditing, accusing,
instituting, instructing, administering the evidence and deciding on its accusatory
proceedings against individuals. Moreover, the Law established a process in which the
parties cannot: produce their evidence; analyse the evidence presented by their
accusers/judges; be heard; or even appeal to a forum that has not already reviewed
and decided on their case. Therefore, it is necessary to change Law 8.443/92 to enable
the creation of a structure and process in the Federal Court of Accounts that is fair (as
well as the laws of all other state and municipal Courts of Accounts), including among
the responsibilities of the members of the Public Prosecutor's Office of Accounts
auditing, accusing, and guaranteeing that the parties produce fully their evidence and
counter-evidence, freeing the Ministers to fulfill the exclusive function of judging
impartially, based on the procedural dialectic / A CRFB/88 entregou aos Tribunais de Contas brasileiros importantes competências
para o controle externo dos gastos públicos, incluindo a função de julgar as contas
daqueles que usarem, arrecadarem, guardarem e administrarem recursos públicos,
podendo-lhes aplicar sanções e condenar à devolução de valores irregularmente
dispendidos. Ao mesmo tempo, a CRFB/88 garantiu, por meio do artigo 5o, a todos os
indivíduos que o Estado somente lhes possa privar de seus bens e direitos caso siga
fielmente as normas-princípio do devido processo legal, do contraditório e da ampla
defesa. Desrespeitando frontalmente tais princípios, a Lei Orgânica do TCU (Lei n.
8.443/92) organizou seu aparato de forma a incluir nas atribuições de seus Ministros
o papel de fiscalizar, acusar, instaurar, instruir, gerir as provas e decidir seus
processos acusatórios contra os indivíduos, além disso a referida Lei estabeleceu um
processo em que as partes não conseguem: produzir suas provas; acompanhar as
provas produzidas pelos seus acusadores e ao mesmo tempo julgadores; serem
ouvidas; e nem recorrerem para instância que não já as tenha fiscalizado e julgado.
Portanto é necessário mudar a Lei n. 8.443/92 para viabilizar tanto uma organização
como um processo justo no Tribunal de Contas da União, assim como as leis de todas
as demais Cortes de Contas estaduais e municipais, colocando nas competências dos
membros do Ministério Público de Contas as fiscalizações e as acusações, garantindo
às partes produzir amplamente suas provas e contraprovas, libertando os Ministros
para cumprir a função exclusiva de julgar imparcialmente, a partir da dialética
processual

A análise dos efeitos indiretos externos dos precedentes do STF e STJ (1996 a 2011) acerca da Lei de Diretrizes e Bases de 1996 (LDB-1996) parte do conteúdo e natureza do direito à educação que definem a posição jurídica dessa lei nacional materialmente constitucional, que tem promovido mutação universalizante-focalizante do direito à educação previsto na Constituição. Resultantes do caráter abstrativizado do precedente judicial das cortes superiores, os efeitos indiretos externos (indirect effect external) configuram o impacto político das decisões judiciais, no momento pós-decisões judiciais (the aftermath of judicial decisions), verificando-se nos casos em que o governo generaliza uma decisão da corte, mediante a alteração da política pública e, para alguns autores, têm a potencialidade de beneficiar aqueles que não têm recursos para litigar (GAURI; BRINKS). No ciclo de judicialização das políticas públicas (the life-cycle of public-policy litigation), a eficácia expansiva do precedente implica comandos que influenciam a ampliação do direito social àqueles potenciais demandantes. No contexto de ativismo judicial e buraco negro legislativo, a questão se o Judiciário prejudica ou contribui para a política democrática é analisada segundo os conceitos de accountability e responsividade diante dos impactos políticos dos precedentes judiciais a exigir o diálogo interinstitucional entre os poderes. Empiricamente, analisam-se os casos paradigmáticos das cotas raciais do STF de 2012 e os efeitos indiretos externos dessas decisões configurados na resposta política dada pela aprovação da Lei nº 12.711/12 e do Decreto nº 7.824/12. Metodologicamente, após o mapeamento temático dos acórdãos do STJ e do STF de 1996 a 2011 acerca da LDB-1996 (obtidos através da pesquisa com o critério legislativo nos sites www.stf.jus.br e www.stj.jus.br), afere-se a potencialidade desses efeitos políticos nos casos paradigmáticos do STF e STJ a evidencisar como/se promove: restrição/ampliação de políticas públicas; (des)consideração dos recursos financeiros; efeito multiplicador; e/ou acesso ou qualidade do ensino. / The analysis of indirect effect external of Supreme Federal Court STFs and Superior Court of Justice STJs cases in the period of 1996-2011 about the 1996 National Education Law (LDB-1996) begins with the right to education content and nature that define the substantial constitutional position, which has promoted informal interpretation changes based on the focalization and universalization of the constitutional right to education. Resulting from the abstract character of higher courts rulings and considering, the aftermath of judicial decisions, specifically its indirect effect external, shapes its political impact that and take place \"where government generalizes a decision of the court, by changing public policy\" and, for some authors, with the potential to benefit those who can not afford to litigate (GAURI; BRINKS). In the life-cycle of public-policy litigation the expansive compliance implies commands that influence the expansion of social rights to those potential plaintiffs. La grande majorité des causes tranchées par la Cour fédérale relève du droit de l’immigration. Environ 80% des causes plaidées devant la Cour fédérale sont en matière d’immigration. La plupart des causes qui se rendent à la Cour fédérale aboutissent au renvoi de la personne concernée. La requête en sursis est généralement le dernier recours que la personne peut exercer afin d’éviter ou à tout le moins retarder son renvoi du Canada. Près de 800 de ces requêtes en sursis ont été décidées par la Cour fédérale en 2008. Malgré un si grand nombre de causes et malgré le rôle important que ces requêtes peuvent jouer dans la vie d’une personne, aucun auteur n’a organisé et présenté les règles législatives et jurisprudentielles qui s’appliquent à ces procédures. Aucun livre, article ou commentaire n’a été rédigé sur ce sujet. De même, il n’existe aucun cours d’université ni de formations professionnelles sur les requêtes en sursis. Le droit des sursis consiste exclusivement de la jurisprudence des cours fédérales. Ainsi, on s’attend à ce qu’un avocat prépare une requête en sursis intuitivement. Toutefois, à cause de la nature urgente de cette procédure, il est pratiquement impossible pour un avocat inexpérimenté de se préparer adéquatement et de bien représenter les intérêts de son client. Beaucoup de causes ayant un fort potentiel sont perdues par manque d’expérience de l’avocat ou à cause d’une préparation inadéquate. La jurisprudence émanant de la Cour fédérale relativement aux sursis semble être incohérente et parfois même contradictoire. Ce livre organise, présente et explique de façon claire et concise le droit des sursis. Plus particulièrement, nous examinerons en détail les trois types de sursis – les sursis législatifs, administratifs et judiciaires. Tant les juges que les plaideurs trouveront cet ouvrage de référence utile dans la préparation et l’adjudication des causes. / The vast majority of cases heard and determined by the Federal Court of Canada relate to immigration law; approximately 80% of the cases adjudicated by the Federal Court of Canada are immigration matters. Most immigration cases that reach the Federal Court of Canada eventually result in the individual’s removal. A motion for a stay of removal is generally the last recourse a person can seek in order to avoid or, at least, delay his or her removal from Canada. Nearly 800 such motions were adjudicated by the Federal Court of Canada in 2008. Despite such a considerable number of cases and the important role these proceedings play in a person’s life, no author has ever attempted to organize and present the legislative and jurisprudential rules that govern stays. No books, articles or commentaries have been written to analyze the cases rendered on motions for a stay of removal. No document compiling decisions relating to stay of removal has ever been prepared. Similarly, universities and other institutions do not offer courses or professional development training on this subject. The law relating to stays consists exclusively of cases decided by the Federal Court. A lawyer is expected to prepare a stay motion almost intuitively. Yet, the urgent nature of these proceedings makes it practically impossible for inexperienced counsel to conduct adequate research and properly represent the interests of their client. Hence, many strong cases are lost due to a lack of experience and inadequate preparation. Many excellent lawyers practicing immigration law refuse to introduce such proceedings before the Federal Courts because they are not familiar with the principles governing stays. The law of stays in an immigration context resembles a legal patchwork because the case law is often inconsistent and at times contradictory. This book organizes, presents, and explains, in a clear and concise manner, the law of stays. In particular, this book examines the three types of stays: legislative, administrative and judicial. Judges and practitioners alike will find this quick reference tool very useful when dealing with motions for a stay of removal.

Previous issue date: 2017-09-29 / Este trabalho investiga a atuação do amicus curiae no âmbito do controle concentrado de constitucionalidade e, mais particularmente, nas arguições de descumprimento de preceito fundamental (ADPFs) cujo mérito foi julgado pelo Supremo Tribunal Federal (STF) até julho de 2017. Inspirado em estudos empíricos que se debruçaram sobre o amicus curiae no direito norte-americano, especialmente no âmbito da Suprema Corte, são examinadas onze ADPFs, levantando-se os argumentos trazidos pelos principais atores do processo, aí inclusos os amici curiae, e verificando como esses argumentos reverberaram nas decisões da Corte. A dissertação está organizada em três capítulos. Os dois primeiros são de caráter propedêutico, ao passo que o terceiro encerra o centro da investigação. Naqueles, examinam-se, respectivamente, os traços principais da ADPF e do amicus curiae. Neste, procede-se ao exame detalhado das onze ADPFs selecionadas. As principais conclusões do estudo são as seguintes: os amici curiae apresentam argumentos novos no processo, embora invariavelmente também retomem argumentos já expressos por outros atores do processo; os argumentos dos amici são levados em consideração nas decisões dos ministros, embora de modo irregular e, por isso, imprevisível; não há correlação entre o desfecho majoritariamente defendido pelos amici em um dado processo e a decisão do STF, de modo que a chamada “teoria do barômetro” não é apta a explicar o impacto dos amici no processo decisório no universo aqui considerado. / This work investigates the participation of the amicus curiae in the Brazilian system of abstract judicial review, more particularly in the so-called arguição de descumprimento de preceito fundamental (literally, Claim of Non-Compliance with a Fundamental Precept, an action aimed at countering the violation of a fundamental constitutional norm, hereafter ADPF). The scope of the investigation is all the ADPFs having been decided with prejudice until July 2017, which amounts to eleven cases. The major source of inspiration for this work was a set of US empirical studies devoted to the amicus curiae, especially in the context of Supreme Court cases. The arguments raised by the different participants of the trial are listed and confronted with the votes of the Brazilian Supreme Court (Supremo Tribunal Federal, STF) ministers. The dissertation is divided in three chapters. The first two are introductory, examining the key features of the ADPF and of the amicus curiae in Brazilian law, whereas the third comprises the empirical examination of the ADPFs. The main results of the study are: the amici curiae have presented many new arguments in the context of each case, although they never fail to repeat arguments already voiced by other participants; the arguments of the amici are taken in consideration in the votes, but in an irregular and therefore unpredictable way; there is no correlation between the outcome expected by the amici in a case and the Court’s decision, which renders the so-called “Barometer Theory” unable to explain the impact of the amici on the decision process, at least within the set of decisions examined in this investigation.

[pt] O tema da pesquisa é o Supremo Tribunal Federal, enfrentando a seguinte questão: o modelo de escolha dos ministros do STF deve ser alterado ou mantido? A investigação tem por objetivo chaves para essa indagação. A relevância do tema é justificada pela importância, no cenário nacional, do Supremo Tribunal Federal, que, além de se encontrar no vértice do Poder Judiciário, encontra-se presente, de forma crescente, na vida contemporânea da sociedade brasileira. São objetivos intermediários da pesquisa: verificar por que o Senado brasileiro, nos séculos 20 e 21, até o momento, jamais deixou de aprovar a escolha dos presidentes da República; quem são os ministros do período mais recente, adotando-se como delimitação temporal os trintas anos do período de redemocratização iniciados em 1985; e, finalmente, por que o Brasil mudou tanto desde 1891 e a forma de escolha dos ministros do STF nunca foi alterada, bem como de que maneira o aparente paradoxo existente entre um sistema institucional dinâmico e um modelo de escolha conservador pode nos revelar o caráter do sistema institucional brasileiro. Ao final, respondendo ao objetivo geral, avalia-se quais são as alterações com maior viabilidade de serem introduzidas, tanto por cambio formal do modelo, quanto pelo modo de sua efetivação e acompanhamento pela sociedade. A seguir, é feita contribuição própria, apontando caminhos para ensejar e motivar a participação da sociedade civil no processo. Encerrando o trabalho, após desvendar os caminhos que levam homens e mulheres para a Corte Suprema brasileira, que, por sua vez, determinam os caminhos que a própria Corte percorrerá, é feito, em considerações finais, um esforço interpretativo que sugere o que pode a escolha dos ministros do Supremo Tribunal Federal, enquanto fenômeno sócio-político, revelar sobre o Brasil contemporâneo. / [en] The research theme is the Brazilian Supreme Court, facing the following question: should the model of choosing the justices be altered or maintained? The goal of the investigation is finding keys to this question. The relevance of the theme is justified by the importance, in the national scene, of the Brazilian Supreme Court, which not only is at the top of the Judiciary Power, but finds itself increasingly present in contemporary brazilian society life. Intermediate goals of the research are: investigate why the brazilian Senate, from the 20th and 21st century until present day, has never disapproved the choice of presidents of the Republic; who are the most recent ministers, setting as temporal delimitation the thirty years of redemocratization starting in 1985; and finally, why did Brazil change so much since 1891 and the model of choosing justices was never altered, as well as how the apparently existing paradox between an institutional dynamic system and a conservative model of choice can reveal the character of the Brazilian institutional system. In closing, while answering the main goals, an review on the alterations with most viability of being introduced in provided, both by formal model switching as well as by method of execution and followup by society. After that, a personal contribution is made, pointing paths to give rise and motivate participation of the civil society in this process. Finishing the research, after unveiling the paths that lead men and women to the Brazilian Supreme Court, paths that determine the course of the Court itself, an effort is made, as final considerations, suggesting what the choice of ministers of the Brazilian Supreme Court, as a social-political phenomena, reveal about contemporary Brazil.
