Witchcraft discourse in South Africa has increasingly permeated all social structures, thereby becoming a real threat to the process of reconstruction and development. The neglect of witchcraft accusations and their resultant consequences can cause the country to lose all it
gained as a result of the liberation struggle. In this study I examine the historical developments of witchcraft accusations around the world in general, and in South Africa in particular as well as the threats they pose to society. I analyse five broad areas:
1) The inborn h tendency to scapegoat; jealousy; and the role religion plays in the
escalation of these problems;
2) The African world-view and its consequences on interpersonal relationships;
3) Colonial and missionary attempts to suppress the African world-view;
4) Ways and means of containing the conflicts arising from the witchcraft problem; and
5) Summary of findings.
The research was occasioned by the untold suffering victims of witchcraft accusations have to undergo in the three Northern Provinces of South Africa. Because of the cruelty and misery such accusations cause the poor people of these rural provinces urgent attention is
needed to contain them, especially since such accusations have not diminished despite all governmental efforts to curtail them. At the centre of witchcraft accusations there are stress, hatred, vindictiveness, and aspirations to become famous. The fear that one may be
victimised by either being accused of witchcraft or being bewitched is very real even today. The relevance of the study is apparent when one considers the feelings of helplessness that paralyses the opponent of this carnage, such as government and the churches.
A number of resources should thus be employed to counter would be put into it. This threat which is aggravated by the abject poverty prevalent in the rural communities of the three Provinces. The prevailing conditions of abject poverty play a definite role in the creation, promotion and escalation of the scourge. Policy makers should therefore have clear grasp of the extent to which poverty has influence on society in any effort to contain witchcraft accusations.
I conclude the study by ~ecommending transformational paths to the Government, NonGovernmental Organisations and other Community Leaders to follow in attending to improve the lot of the poor. This is done by highlighting ten findings that emerged during the study. The findings were the result of analyses of archival records, literature and case studies on witchcraft accusations. Because the subject of witchcraft is so wide and emotive I have employed several sociological and anthropological theories to cover as wide a field as possible. The
incorporation of so many theoretical approaches into the study presents on interpretive and analytical explanation of the causes, effects and containment of witchcraft accusations. The overall conclusion is encapsulated by the title of the study Moloi ga a na mmala (A witch

Die vorliegende Arbeit analysiert den Umgang mit dem Tatbestand der Holocaust-Leugnung durch die Europäische Union (EU) und den Europäischen Gerichtshof für Menschenrechte (EGMR). Derzeit befinden sich diese in einer heiklen Situation: Sie müssen das Gedenken an ein für die europäische Identität zentrales historisches Ereignis – den Holocaust – pflegen und schützen und zugleich die Achtung der Grundrechte, insbesondere der Meinungsfreiheit, gewährleisten. Diese besondere Situation erfordert eine gründliche Untersuchung des europäischen Umgangs mit dem Tatbestand der Holocaust-Leugnung. Der erste Teil der Dissertation steckt den Anwendungsbereich der europarechtlichen Verpflichtungen zur Kriminalisierung der Holocaust-Leugnung ab. Bewertet wird insbesondere die Bedeutung des Rahmenbeschlusses 2008/913/JHA über Rassismus und Fremdenfeindlichkeit für die EU-Mitgliedstaaten. Dabei werden einige Beispiele der Umsetzung in staatliches Recht dargestellt. Der zweite Teil der Arbeit befasst sich mit der Rechtsprechung des EGMR und untersucht das Verhältnis zwischen dem Tatbestand der Holocaust-Leugnung und der Meinungsfreiheit mit dem Ziel, die Grundsätze, nach denen Staaten verpflichtet sind, entsprechende Äußerungen zu kriminalisieren, herzuleiten. Die übergreifenden Ziele der Untersuchung sind: a) den Charakter des Zusammenspiels zwischen EU und EGMR herauszuarbeiten; b) zu ermitteln, ob die jeweiligen Positionen gegensätzlich oder komplementär sind; c) die Rechtsnatur und den Inhalt der für die Mitgliedstaaten begründeten Verpflichtungen zu bestimmen; d) herauszuarbeiten, ob eine europaweite Kriminalisierung verpflichtend ist oder lediglich gefördert werden soll; und e) ob beziehungsweise unter welchen Bedingungen ein mit Kriminalstrafe sanktioniertes Verbot der Holocaust-Leugnung erstrebenswert wäre. / The present study aims to analyse the legal treatment of the crime of denialism by the two main actors in European justice, namely, the European Union (‘EU’) and the European Court of Human Rights (‘ECtHR’). Presently, these two systems find themselves in a delicate position: they must cherish and protect the memory of an historical event – the Holocaust – which is central to Europe’s own identity, while simultaneously promoting respect for fundamental rights such as the freedom of speech. This unique balance raises a need for a thorough investigation into Europe’s approach to the crime of denialism. The dissertation’s first section seeks to measure the scope of EU-imposed obligations to make denialism a crime. Notably, the impact on EU Member States of the Framework Decision 2008/913/JHA on racism and xenophobia is assessed, with illustrations of a few archetypal examples of domestic implementing legislation. The second part of the dissertation turns to the jurisprudence of the ECtHR to examine the relationship between Holocaust denial as a crime and the right to freedom of expression, with a view to deducing the principles under which States must comply in the criminalization of this kind of utterance. The work’s overall goals are to assess: a) the nature of interactions between the EU and ECtHR; b) whether their positions on denialism are better portrayed in terms of contrast or mutual support; c) the legal nature and content of the obligations originating for the Member States; d) whether a Europe-wide criminal prohibition on denialism is dictated or simply encouraged; and e) whether such a prohibition would be desirable, and if so, under what conditions.

Recognition Denied: An Examination of UK and US Foreign Policy towards the Republic of CroatiaLjubic, Maria Christina 02 May 2013 (has links)
This thesis examines the development of decision making taken by two countries, the United Kingdom and the United States, in response to Croatia’s declaration of independence from Yugoslavia. The focus is on the recognition process and the reasoning and rationale used by the government officials and diplomats of the United Kingdom and United States to arrive at their policy decisions and opinions. The concentration is mainly on events from the early 1990s until mid 1992. Topics explored include matters such the politics behind non-recognition, democratic social norms, respect for human rights and Western national interests.
The thesis first hypothesizes, then analyses, which International Relations theory, that is, realism or constructivism, possesses the best capacity explain why these nations initially withheld their recognition of Croatia’s independence before moving to accept the Republic of Croatia as an independent state. The role of the International Relations theories is to offer an interpretation and understanding of these events and decisions. Subsequently, they are judged on their ability to do so. The thesis finds that via the insight of scholars, analysts and theoretical perspectives that both the John Major government of the UK and the George H.W. Facilitating forgiveness: an NLP approach to forgiving is an attempt at uncovering features of the blocks that prevent people to forgive. These blocks to forgiveness can be detected in the real life situations of the six individuals who told me their stories. The inner thoughts, feelings and the subsequent behaviour that prevented them from forgiving others is clearly uncovered in their stories. The facilitation process highlights the features that created the blocks in the past thus preventing forgiveness to occur. The blocks with their accompanying features reveal what needs to be clarified or changed in order to eventually enable the hurt individuals to forgive those who have hurt them. The application of discourse analysis to the stories of hurt highlights the links between the real life stories of the individuals within their contexts with regard to unforgiveness to the research findings of the existing body of knowledge, thereby creating a complexly interwoven comprehensive understanding of the individuals' thoughts, feelings, and behaviours in conjunction with their developmental phases within their socio-cultural contexts.
Neuro-linguistic-programming (NLP) is the instrument with which forgiving is facilitated in the six individuals who expressed their conscious desire to forgive, because they were unable to do so on their own. Their emotions had the habit of keeping them in a place in which they were forced to relive the hurtful event as if it were happening in the present. Arresting the process of reliving negative emotions requires a new way of being in this world. The assumption that this can be learnt is based on the results from a previous study, in which forgiveness was uncovered by means of the grounded theory approach as a cognitive process (Von Krosigk, 2000). The results from the previous research in conjunction with the results and insights from this research study are presented in the form of a grounded theory model of forgiveness. / Psychology / D. Frans Vredenrijk Engelenburg (1863-1938) played a major role in the development and expansion of Afrikaans and the Afrikaans academic culture - especially in the northern part of South Africa. As a Dutch intellectual, lawyer and journalist in the nineteenth century South African Republic (Transvaal), he in particular played an important role as advisor and opinion maker from the 1890s onward. One of his biggest achievements was the key role that he played in the establishment of De Zuid Afrikaanse Akademie voor Taal, Letteren en Kunst in 1909. This study is the first part of a more comprehensive biographical project on the life of Engelenburg and the role he fulfilled in the history of the Akademie and South Africa until the thirties of the twentieth century. Since the 1600s the Engelenburg family has played a prominent role in the community where they lived. Aside from the high positions they had held for centuries before, they had in the fourth and again in the sixth generation married into noble families. This contributed to their important position in the community. Due to circumstances Engelenburg was not raised in the Engelenburg milieu. A family break in 1836 was the cause that Engelenburg's father, as a baby, was spirited away from this family milieu. Engelenburg received an extraordinarily good schooling. The solid intellectual foundation already laid then, to a large extent determined the course of his life. He was at the Stedelijk Gymnasium Arnhem when he met Marie Koopmans-De Wet (1834-1906), an aunt by marriage who lived in Cape Town, when on a visit to Europe. She was his soul mate and acted as a mentor and advisor to Engelenburg. The friendship strengthened with the years. He already at school had the desire to visit South Africa one day. His parents' divorce when he was still a student at the University of Leyden, steered his life in a very different direction than what he had foreseen for himself. The divorce was to a large extent the reason that, although he had studied law, he discarded the notion of a career in law after only a year. His decision to follow a career in journalism affected the rest of his life. The Transvaal War (1880-1881) meant that the Dutch developed an admiration for the Transvaalers for the determination and courage they displayed in their attempts to defeat the British army. President Paul Kruger's call shortly after the war that the Transvaal needed young Dutchmen further encouraged Engelenburg to come to South Africa. Previously Engelenburg had for a year worked for Fred Hogendorp at the Dagblad van Suidholland en s’Gravenhage in The Hague. Circumstances abruptly changed when Hogendorp suddenly became insane. During the same time, the owner of De Volksstem newspaper in Pretoria had committed suicide and Engelenburg seized the work opportunity. Within a matter of three months, he arrived in the Transvaal. Within a month after his arrival he was appointed chief editor of De Volksstem. He had studied the Transvaal situation thoroughly and by means of the newspaper and through tireless efforts, he contributed to improving the farming community’s cultural literacy. The education situation in the Transvaal enjoyed his constant attention. After the Anglo-Boer War (ABW) (1899-1902), he continued to work towards improving the education system in the Transvaal. He early on became involved in the Transvaal University College (later University of Pretoria). Before the ABW he did everything possible to promote the Dutch language to the Boer people. However, after the war he realised that Afrikaans had a rightful place, and he, in addition to Dutch, became a champion for the Afrikaans language. The battle between the proponents of Dutch and Afrikaans respectively, increased after the ABW. To achieve unity of action between the two groups, De Zuid Afrikaanse Akademie voor Taal, Letteren and Kunst was founded in 1909. Behind the scenes Engelenburg was one of the major driving forces to assist with the founding of the organisation. As a board member and later as chairman, he gave impetus to the Akademie. In 2009 the organisation celebrated its centenary. This is an important milestone, especially seen in the light of the current political climate in South Africa.
