Literacy in Corrections Inmate Employment : a thesis presented in fulfillment of the requirements for the degree of Master of Management in Communication Management at Massey University, Wellington, New Zealand

This thesis investigates literacy in prison-based employment training provided by Corrections Inmate Employment (CIE), a Government Training Establishment, in New Zealand. The descriptive case study aims to provide an understanding of literacy in CIE. It does this by combining existing research with information gained from participant observation and staff and prisoner interviews at the Central Kitchen and the Print Shop at men’s prisons in Wellington. The thesis suggests that engagement with literacy in these CIE workplaces depends on whether it is safe or suitable to participate in workplace literacy activities; whether there is an opportunity to participate (including access to specialised support services like literacy programmes); and whether prisoners are interested in or see benefits from participating. For CIE to be more effective – both in providing a base for meaningful employment and lifelong learning – employment training needs to be offered in areas in which prisoners are interested, in tandem with embedded support services like literacy and numeracy training programmes.

The overall objective: of the study was to construct a video technology material to present the experience of motherhood to women prisoners in a closed regime and, as a result, to promote the debate about the reality of the mother-child relationship in the prison context. Method: the research had an exploratory and transversal design with a qualitative approach. Fifteen women were arrested in a closed regime. There were 13 individual semi-structured interviews and 3 focus groups. Data collection took place in a regional mixed prison in the period between April and July 2017. The data were transcribed and submitted to the content analysis proposed by Bardin. For the production of the documentary, the images were collected during an action carried out by Projeto Inspira, in its 5th edition. This action occurred on November 10, 2017 with 12 distressed mothers of the Regional Prison of Santa Maria, four of them recorded testimonials for the documentary. They were encouraged to talk about their experience from the following question: What is the experience of being a parent of children in the childhood / adolescence phase and being stuck? In addition to the inmates participated in the documentary: a caregiver grandmother and professionals involved in the issue. After being videotaped, the content was edited through the process of visualization and decupagem. Results: the results of this research reveal that mothers' experiences are permeated by feelings of their children's homesickness, blame for being wrong, shame before them for the prison situation. The mothers of this study were aware of the damage caused by the crime and, consequently, their arrest in the children's lives. It was found that maternity in the prison system is also hampered by the precariousness of the interpersonal relationships established during the execution of the sentence. The final product: of this study is the production of a documentary titled: A hug without grids: real stories of women prisoners and their children. Endings considerations: mothers in prison are deprived and fragile, deprived of power, voice and self-esteem to exercise parenthood. It adds up the lack of coexistence and the mother-child bond is threatened. In this way, improvements in the prison environment are suggested that allow for the assiduity and the quality of the interaction during the visits and, with this, the maintenance and strengthening of the mother-child bond, considering the evidence of a scenario of double helplessness, in which mothers and children are deprived of coexistence and reciprocal affection. / Introdução: O número de crianças e adolescentes com mães presas é crescente e vem demandando debates entre pesquisadores, representantes públicos, organizações não governamentais (ONGs) e a sociedade em geral, com vistas ao planejamento de ações destinados a minimizar os impactos negativos do sistema prisional, na saúde e no desenvolvimento psicológico da criança/adolescente. O objetivo geral: do estudo foi construir um material tecnológico em vídeo sobre a vivência da maternidade para mulheres presas em regime fechado. Método: a pesquisa teve um delineamento exploratório e transversal com abordagem qualitativa. Participaram 15 mulheres presas em regime fechado. Foram realizadas 13 entrevistas semiestruturadas individuais e 3 grupos focais. A coleta de dados ocorreu em um presídio misto regional no período entre abril e julho de 2017. Os dados foram transcritos e submetidos à análise de conteúdo proposta por Bardin. Para a produção do documentário, as imagens foram coletadas durante uma ação realizada pelo Projeto Inspira, em sua 5ª edição. A referida ação ocorreu no dia 10 de novembro de 2017 com 12 mães apenadas do Presídio Regional de Santa Maria, 4 delas gravaram depoimentos para o documentário. Elas foram estimuladas a falar sobre sua experiência a partir da seguinte questão: Como é a experiência de ser mãe de filhos na fase da infância/adolescência e estar presa? Além das detentas, participaram do documentário: uma avó cuidadora e profissionais envolvidos na temática. Depois de gravado em vídeo, o conteúdo foi editado através do processo de visionagem e decupagem. Resultados: os resultados desta pesquisa revelam que as vivências das mães são permeadas por sentimentos de saudades dos filhos, culpa por terem errado, vergonha diante deles pela situação prisional. As mães deste estudo mostraram ter consciência sobre os danos causados pelo crime e, consequentemente, pela prisão delas na vida dos filhos. Constatou-se que a maternidade no sistema prisional é dificultada, também, pela precariedade das relações interpessoais estabelecidas durante o cumprimento da pena. O produto final: deste estudo foi a produção de um documentário intitulado: Um abraço sem grades: histórias reais de mulheres presas e seus filhos. Considerações finais: as mães presas encontram-se carentes e fragilizadas, desprovidas de poder, voz e autoestima para exercer a parentalidade. Soma-se a falta de convivência e o vínculo mãe-filho(a) fica ameaçado. Assim sugere-se melhorias no ambiente prisional que propicie a assiduidade e a qualidade da interação durante as visitas e, com isso, a manutenção e o fortalecimento do vínculo mãe-filhos, considerando a evidência de um cenário de duplo desamparo, no qual mães e filhos estão privados de convivência e afeto recíproco.

A reintegração social dos cidadãos-egressos: uma nova dimensão de aplicabilidade às ações afirmativas

It approaches the significant increase of the Brazilian prison population, the characteristics of these segregated mass of people and programmatic mistakes, incompatible with efficient social reintegration politics that should be guided by the respect for Human dignity and spontaneous participation of those activities. It reflects how a social reaction guided by prejudice and discrimination consists as a factor that promotes secondary criminal practice, simultaneously victimizing the very same society, in a paradoxical context, marked by this recalcitrant cycle. Regarding this context, it searches for ways to achieve crime reduction through the modification of the social reaction when facing the breaking of criminal laws and through the creation of alternatives that could annul the effect of such reactions, such as affirmative actions. It analyzes the hypertrophy of the criminal punishments, as a way to categorize and stigmatize the former inmate citizen. Explores as they continue to get punished and have their rights affected because of this negative evaluation of their social identity, furthermore enhanced by the World wide spread of information on the cyberspace, disclosing them the right of forgiveness from their criminal past, as the respective registers, media coverage and other given data affect their process of social reintegration. It also contemplates the importance of labor to the people and it s wide protection provided by the Brazilian legal system, demonstrating the necessity of guaranteeing it to the former inmate citizens through positive discrimination. As a result, it proposes the mandatory hiring, by the State, of these former inmate citizens (in a proportional limit) and, on the other hand, evaluates the results of government incentives for their hiring in the private sector. It suggests the application of the regime de cottas to the egresses-citizen, considering their unique characteristics and the recent decisions of the Brazilian Supreme Court on the subject. Finally, it idealizes changes in the constitutional and sub constitutional order, in federal and state scope, aiming to reserve a percentile of the vacant working opportunities to the inmates, to those who serve alternative criminal punishments and to former inmate citizens, to work on contracts and services hired by processes of public bidding, as well as on companies who come to integrate exemption tax programs. At last, it suggests necessary legislative alterations in order to grant concession of economic subvention to the companies that hire those subjects, seeking their social reintegration through the creation of work ranks and their professional qualification. / A presente tese de Doutoramento discorre, em essência, sobre as justificações à aplicação de ações afirmativas aos cidadãos-egressos, visando a reintegração social dos mesmos, em face de sua hipossuficiência, marcada pelo estigma carcerário e consequente déficit de implementação de direitos, notadamente o direito social ao trabalho. Aborda o desenvolvimento significativo da população carcerária brasileira, as características dos integrantes dessa massa segregada e os equívocos programáticos, incompatíveis com uma política eficiente de reintegração social, orientada pelo respeito à dignidade humana e participação espontânea dos mesmos. Reflete como a reação social, pautada pelo preconceito e discriminação, constitui-se em relevante fator de fomento a práticas delitivas secundárias, vitimando, coetaneamente, a própria sociedade, num contexto paradoxal, caracterizado pela recalcitrância viciosa. Em face desse contexto, opera caminhos à diminuição da criminalidade pela modificação da reação do grupo social em face da violação de leis penais e pela criação de medidas que anulem os efeitos de tais reações, como a adoção de ações afirmativas Analisa a hipertrofia da sanção penal ao término do cumprimento da pena, em meio a um processo de categorização estigmático dos cidadãos-egressos. Explora como continuam a ser punidos e ter seus direitos afetados, diante de uma avaliação negativa de sua identidade social, máxime numa era de hiperinformação, eivada pela potencialidade informativa dos cyberespaços, descortinando-lhes o direito ao esquecimento de seu passado criminal, em especial quando os respectivos registros, notícias e demais dados lhes afetam o processo de reintegração social. Contempla, ademais, a importância do trabalho às pessoas e sua ampla proteção pelo sistema jurídico brasileiro, demonstrando a necessidade de se garantir a fruição desse direito aos cidadãos-egressos, por meio de discriminação positiva. Como resultado, propõe a obrigatoriedade do setor público de contratar cidadãos-egressos (num limite proporcional) e, de outro lado, destaca o incentivo à disseminação de medidas de estímulo à contratação pelo setor privado. Suscita a aplicação do regime de cotas aos cidadãos-egressos, tendo em vista as suas características peculiares e as recentes decisões do Supremo Tribunal Federal sobre o tema. Por fim, idealiza alterações na ordem constitucional e infraconstitucional, em âmbito federal e estadual, visando o estabelecimento de reserva percentual de vagas de trabalho aos reclusos, cumpridores de medidas alternativas e egressos do sistema penitenciário, nas obras e serviços contratados mediante processo de licitação pública, bem como, às empresas que vieram a integrar programas de isenção tributária. Além disso, sugere alterações legislativas necessárias para a concessão de subvenção econômica às pessoas jurídicas que os contratarem, objetivando favorecer a reintegração social por meio da criação de postos de trabalho e qualificação profissional.

The institute of preventive detention is a new protective measure in our penal law. The theme of this thesis is an analysis of the comission and goals of the new protective measure and focusing on a comparation of theoretical and practical function of this protective measure. The folowing chapters provide the characterization of the preventive detention and its legal framework in the Czech republic. The component part of the thesis is also a description of the preventive detention in a legal framework of other state, concretely Slovakia. At the end of the work there are explicated knowledges obtained during the visit of the Institute for preventive detention Brno. In this chapter not only functional equipment is described but also the compositon of the inmates and employees and their most important competencies. Programms, by which are the medical goals fullfiled are described at the end of the thesis.

Coping guidelines for women who have experienced the psychological impact of Intimate Partner Violence (IPV) in Ehlanzeni District

Thesis (Ph.D. (Psychology)) -- University of Limpopo, 2022 / The study investigated the phenomena of Intimate Partner Violence (IPV) in women in Ehlanzeni District, Mpumulanga, South Africa in order to develop coping guidelines. This is because, one in every four, or a quarter (25%) of all women in South Africa, are assaulted by their partners every week. The study adopted a qualitative approach utilising an exploratory, hermeneutic phenomenological research design. A non-probability sample of ten women, who were victims of IPV, was used. The theoretical framework for the study was Afrocentric theory. This framework was used so that the investigation was underpinned by truly African concepts. The study was conducted at Victim Empowerment Programmes in Mkhuhlu and Acornhoek, Ehlanzeni District in Mpumalanga Province. Semi-structured interviews were used as data collection instruments and analaysed using thematic analysis (TA). The following themes and sub-themes emerged out of the data: Theme 1: Understandings of Intimate Partner Violence (IPV); Theme 2: Intimate Partner Violence (IPV) experienced by participants; Theme 3: Reasons for Intimate Partner Violence (IPV); Sub-theme 3.1: Alcohol as a facilitator of IPV; Sub-theme 3.2: Early parenthood as a facilitator of IPV; Sub-theme 3.3: Poverty as a facilitator of IPV and Sub-theme 3.4: Observed behaviour as a facilitator for IPV; Theme 4: The role of lobola/culture in Intimate Partner Violence (IPV); Theme 5: What makes participants stay in abusive relationships (marriages) and Theme 6: Steps, or interventions, taken by participants in order to cope with Intimate Partner Violence (IPV). Based on these findings it was recommended that a study of male perceptions towards IPV, and a nationwide study or studies on IPV, be carried out under the auspices of the Department of Social Development (DoS) and/or the Department of Health (DoH) with the help of relevant non-governmental organisations (NGOs). Coping guidelines for women victims of IPV were developed out of the research findings.

Esta pesquisa é realizada por profissional que há quatorze anos vem trabalhando em programas de educação nos presídios do Estado de São Paulo e consiste em uma análise crítica acerca das práticas de Educação de adultos presos no Estado de São Paulo, especialmente as práticas desenvolvidas a partir da década de 80 do Século XX pela Funap. Historiamos o processo de constituição do quadro de educadores que atuam no sistema penitenciário do Estado, problematizamos a condição de precariedade em que desenvolvem este trabalho e apontamos os obstáculos para que esta experiência seja transformada em uma política pública de Educação de Adultos Presos. O trabalho é também uma tentativa de aprofundar a investigação sobre as políticas para a Educação de Jovens e Adultos em Regimes de Privação da Liberdade, praticamente inexistente, tanto na Secretaria da Administração Penitenciária quanto na Secretaria Estadual de Educação. O texto apresenta uma breve reflexão sobre as funções atribuídas à pena e à prisão, aproximações entre a Educação de Jovens e Adultos e a Educação de Adultos Presos e subsidia a reflexão sobre a especificidade desse trabalho para esta área no Estado de São Paulo, com o levantamento do quadro de educadores hoje existente no Estado, selecionando-se uma amostra para a pesquisa qualitativa. Finalmente, a pesquisa aponta os caminhos para que a Educação de Adultos Presos no Estado de São Paulo possa ser efetivada como uma política pública que garanta às pessoas privadas da liberdade o direito à Educação pública, gratuita e de qualidade, previsto tanto na Constituição Federal e na Lei de Execução Penal quanto na Lei de Diretrizes e Bases da Educação. / This research is made by a professional who is working about fourteen years in education programs in the prisons in the São Paulo State and consists in a critical analysis about the practices of education of adult inmates, specially the actions made since the 80\'s by Funap. We have studied the history of the constitution process of this staff of teachers who works in the prison system of São Paulo State, we have made an analysis about the precarity of conditions in which they teach and we have pointed the obstacles for that experience would be transformed in a public policy of Education of Inmate Adults. This work is too an attempt to go deeper into the investigation about Education of Adults in Freedom Deprive Regimes, nearly nonexistent, as much in the State Secretary of Prison Administration as in the State Secretary of Education. The text presents a brief reflection about the functions which the society hopes from the sentence and the prison, the approaches between the Younkers and Adults Education and the Inmate Adults Education and improve the reflection about the specificity of this work and training for the teachers for the Inmate Adults Education in the São Paulo State, with the survey of the teachers staff who exists currently in this state, selecting a sample for the qualitative research. Finally, the research points the ways for the Inmate Adults Education in the São Paulo state could be stated how a public policy which could assure for the inmate people the right to a public Education, free and with high quality. This right is predicted as in the sentence execution Law as in the Brazilian Constitution and the educational laws.

This analysis demonstrates that violence is placed in all communities and societies and that, often, it is even legitimated by and deep-rooted in the religious phenomenon. Currently, the determinant causes of criminality are inbuilt in structural and social problems, but despite that there remain ideological subterfuges exempting the State, the system and the society itself. Looking at the results or the mentioned anomies that burden the convicts and the ex-convicts, it is possible to perceive that the genesis of this problematic is predominantly social. Inside this context, the religious phenomenon can become either an element of rescue and transformation of the convict him/herself, or a mere aid work aiming at corroborating the social order and current structures. The performance of Pires do Rio s Prison Pastoral became an inquiring element in this dominant paradigm encouraging a new attitude of society towards convicts and evicts.Through its work, the Prison Pastoral questions the prison system which is bankrupted; points out to solutions and agglutinate transforming actions. In this perspective, the prisoners supported by the Pastoral feel themselves agents of transformation of this reality retrieving their self-esteem, their citizenship, being and feeling no longer the segregated, the leftover of society. And that allows them to socially interact, turning them into protagonists of their own history. / Esta dissertação visa levantar os dados e as atividades da Pastoral Carcerária de Pires do Rio, desde sua fundação em 27 de fevereiro de 1997, ressaltando os desdobramentos das reflexões e ações desta pastoral. Esta análise demonstra que a violência está inserida em todas as comunidades e sociedades, muitas vezes, legitimada e arraigada no próprio fenômeno religioso. Na atualidade, as causas determinantes da criminalidade estão inseridas nas questões estruturais e sociais, mas permanece um subterfúgio ideológico, isentando o Estado, o sistema e a própria sociedade. Percebe-se, a partir dos resultados das ditas anomias que pesam sobre cada um dos presos e egressos, a gênese desta problemática é, predominantemente, social. O fenômeno religioso dentro deste contexto de presídio se torna um elemento de resgate e transformação do próprio preso ou de um mero assistencialismo para corroborar com a ordem social e estrutura vigente. A atuação da Pastoral Carcerária em Pires do Rio se tornou um elemento questionador deste paradigma dominante provocando uma nova postura da sociedade em relação aos presos e aos egressos. Em sua atuação, a Pastoral Carcerária questiona o próprio sistema carcerário, que se encontra falido, apontando soluções e aglutinando ações transformadoras. Neste prisma, os presos respaldados pela Pastoral sentem-se, eles próprios, agentes de transformação desta realidade, resgatando sua auto-estima, o seu ser cidadão; sendo não mais os segregados, os sobrantes da sociedade. O que lhes permite interagir socialmente, tornando-os protagonistas de sua história.

L'utilisation européenne des prisons ouvertes : l'exemple de la France / The use of open insitutions in Europe : the exemple of France

Les prisons ouvertes constituent un modèle pénitentiaire singulier, qui puise son origine dans des expérimentations carcérales de la première moitié du XIXème siècle. Leurs caractéristiques et leurs atouts ont été définis en 1955 par la jeune Organisation des Nations-Unies en même temps que fut encouragé leur usage. Malgré ce soutien, les prisons ouvertes ne trouvèrent pas partout le même espace pénologique, ce que le cas français illustre largement par la faible proportion d’utilisation réservée à ces établissements. De plus, l’ultra-minorité des prisons ouvertes françaises s’accompagne de critères d’emploi qui font figures d’exceptions, en comparaison des autres pays européens utilisateurs de ce modèle.Toutefois, la réforme des modalités d’exécution des peines intervenue récemment dans l’hexagone pourrait entrainer une reconsidération de leurs fonctions. La présente recherche propose donc de situer ces établissements dans les nouvelles inflexions qui touchent la pénologie européenne et française, tout en envisageant la place que pourraient être amenées à y trouver les différentes déclinaisons du modèle ouvert de détention / Open prisons constitute a unique model prison, which has its origin in prison experiments of the first half of the nineteenth century. Their characteristics and strengths were identified in 1955 by the young United-nations, when was also encouraged their use. Despite this support, open prisons are not found everywhere the same penological space, as the French low rate of utilization illustrated well. In addition, the ultra-minority of French open prisons and their criteria of employment figure as an exception, in comparison with the other European countries witch use this model.However, the reform of the enforcement sentences system recently intervened in the hexagon could lead to a reconsideration of their use. So this research proposes to locate these facilities in new inflections that affect the European and French penology, while considering the role that could be led to find different versions of the open institution model

O texto apresenta uma breve reflexão sobre as funções atribuídas à pena e à prisão, aproximações entre a Educação de Jovens e Adultos e a Educação de Adultos Presos e subsidia a reflexão sobre a especificidade desse trabalho para esta área no Estado de São Paulo, com o levantamento do quadro de educadores hoje existente no Estado, selecionando-se uma amostra para a pesquisa qualitativa. Finalmente, a pesquisa aponta os caminhos para que a Educação de Adultos Presos no Estado de São Paulo possa ser efetivada como uma política pública que garanta às pessoas privadas da liberdade o direito à Educação pública, gratuita e de qualidade, previsto tanto na Constituição Federal e na Lei de Execução Penal quanto na Lei de Diretrizes e Bases da Educação. / This research is made by a professional who is working about fourteen years in education programs in the prisons in the São Paulo State and consists in a critical analysis about the practices of education of adult inmates, specially the actions made since the 80\'s by Funap. We have studied the history of the constitution process of this staff of teachers who works in the prison system of São Paulo State, we have made an analysis about the precarity of conditions in which they teach and we have pointed the obstacles for that experience would be transformed in a public policy of Education of Inmate Adults. This work is too an attempt to go deeper into the investigation about Education of Adults in Freedom Deprive Regimes, nearly nonexistent, as much in the State Secretary of Prison Administration as in the State Secretary of Education. The text presents a brief reflection about the functions which the society hopes from the sentence and the prison, the approaches between the Younkers and Adults Education and the Inmate Adults Education and improve the reflection about the specificity of this work and training for the teachers for the Inmate Adults Education in the São Paulo State, with the survey of the teachers staff who exists currently in this state, selecting a sample for the qualitative research. Finally, the research points the ways for the Inmate Adults Education in the São Paulo state could be stated how a public policy which could assure for the inmate people the right to a public Education, free and with high quality. This right is predicted as in the sentence execution Law as in the Brazilian Constitution and the educational laws.
