Cette étude aborde le sujet de l’arbitrage de l’offre-finale. L’étude vise tout d’abord à présenter la particularité de ce mécanisme arbitral au travers du prisme de l’arbitrage salarial pratiqué au baseball. Elle vise ensuite à promouvoir l’utilité de ce processus au sein de ce cadre sportif en proposant son emploi pour régler les litiges relatifs à la détermination du montant des indemnités de transferts des footballeurs professionnels européens. / The following is a case-study about final-offer arbitration. The first objective is to describe the uniqueness of this mechanism in the context of baseball salary-arbitration. The second is to promote the utility of this process, in the context of baseball salary-arbitration. For instance, it advocates for its use to determine appropriate fees to be paid for professional european soccer players transfers.

Cabiakman et la suspension pour fins d’enquête en rapports collectifs

La suspension pour fins d’enquête est une mesure administrative qui permet à l’employeur de suspendre la prestation de travail d’un salarié le temps de faire enquête sur des actes qui lui sont reprochés et qui sont susceptibles d’entacher la réputation ou l’image de l’entreprise. Les principes applicables en la matière ont été précisés par la Cour suprême en 2004 dans l’arrêt Cabiakman c. Industrielle-Alliance, Compagnie d’assurance sur la vie, qui traite d’un contrat individuel de travail. Notre mémoire porte sur les circonstances justifiant une suspension pour fins d’enquête en rapports collectifs. Afin de vérifier le traitement de cette mesure administrative, nous avons effectué une analyse qualitative de la jurisprudence arbitrale québécoise en matière de suspension pour fins d’enquête avant et après Cabiakman. D’abord, nous avons vérifié la compatibilité des principes formulés dans Cabiakman et des principes issus de la jurisprudence arbitrale québécoise antérieure à cet arrêt. Ensuite, nous avons analysé l’influence de cet arrêt en rapports collectifs en examinant si la jurisprudence arbitrale québécoise qui lui est postérieure s'y réfère et en applique les principes. Finalement, nous avons tenté de corréler l’influence ou l’absence d’influence de Cabiakman sur la jurisprudence arbitrale à l’adhésion des arbitres à la thèse de la coexistence ou à la thèse de l’autonomie. Nos résultats ont démontré que Cabiakman n’est pas parfaitement compatible avec la jurisprudence arbitrale qui lui est antérieure puisque des principes différents de ceux énoncés par la Cour suprême s’y retrouvent. Aussi, nous avons remarqué que la jurisprudence arbitrale postérieure à cet arrêt s’y réfère souvent et en applique certains principes. Toutefois, nous ne considérons pas que l’influence de cet arrêt sur la jurisprudence arbitrale soit entièrement corrélée au rattachement des sentences arbitrales à l’une ou l’autre des deux thèses. En effet, d’autres hypothèses pourraient expliquer les résultats que nous avons obtenus. / A suspension for investigation purposes is an administrative measure which allows the employer to suspend an employee for alleged acts that may damage the reputation or the image of the company. The principles which apply to this administrative suspension were established by the Supreme Court of Canada in 2004 in Cabiakman v. Industrial Alliance Life Insurance Co., which deals with an individual contract of employment. Our research focuses on the circumstances justifying a suspension for investigation purposes in collective labour relations. In order to study the treatment of this administrative measure, we conducted a qualitative analysis of the decisions of arbitration tribunals from Quebec regarding the suspension for investigation purposes before and after Cabiakman. We initially verified the compatibility of the principles established in Cabiakman and the principles of the arbitration decisions from Quebec rendered prior to this judgment. Subsequently, we analyzed the influence of this judgment in collective labor relations by examining if the arbitration tribunals from Quebec referred to Cabiakman and implemented its principles. Finally, we attempted to correlate the influence or lack of influence of Cabiakman on the arbitration decisions to the adhesion of the arbitrators to the coexistence thesis or to the autonomy thesis. Our results indicated that Cabiakman is not entirely consistent with the previous arbitration decisions because their principles are different from those expressed by the Supreme Court. In addition, we noticed that the posterior arbitral decisions often referred to Cabiakman and implemented some of its principles. However, we do not consider that the influence of this judgment on the arbitration decisions is entirely correlated to the linking of the arbitral decisions to one of the theses. Indeed, other hypotheses could explain the results of our research.

Its analysis passes through the perception of a new international dynamic that places the state sovereignty, previously seen as unlimited, as something relative, which ends up propitiating the understanding that the immunity of jurisdiction is a value that may suffer limitations. The facts that triggered the relativization of this immunity serve to understand the gradual adaptation of its regulation to the characteristics of the international public law, upon the division of the acts practiced by the States into acts of government and acts of management. Having relativized the immunity in the procedure s instruction phase, thesis already appeased both in Brazil and in the majority of the countries of the international community, the challenge is to mitigate the immunity in the enforcement of the judgment decision phase, which continues generating polemics, maintaining almost absolute. This situation shows to be inefficient for solution of the majority of labor-related conflicts between domestic employees and foreign entities governed by public law, whether due to the difficulty in finding goods from the foreign State possible of being expatriated, whether due to the lack of execution of this procedure through the diplomatic means. We will thus seek to propose new guidelines to make effective the final verdict in labor lawsuits filed by national persons against foreign entities governed by public law, based on the fact that work is a constitutionally ensured human value in our country, to be observed inclusively by a foreign State, without this harming its sovereignty / O presente trabalho tem por objetivo desenvolver um estudo sobre a imunidade de jurisdição e de execução do ente público externo que contrata trabalhadores brasileiros. Sua análise passa pela percepção de uma nova dinâmica internacional que coloca a soberania estatal, antes tida como ilimitada, como algo relativo, o que acaba por propiciar o entendimento de que a imunidade de jurisdição é um valor passível de sofrer limitações. Os fatos que desencadearam a relativização dessa imunidade servem para entender a gradual adequação de sua regulação às características do direito internacional público, mediante a divisão dos atos praticados pelos Estados em atos de império e atos de gestão. Relativizada a imunidade na fase de conhecimento do processo, tese já pacificada tanto no Brasil como na maioria dos países da comunidade internacional, o desafio é abrandar a imunidade na fase de execução de sentença, que continua gerando polêmicas, mantendo-se quase absoluta. Essa situação mostrase ineficiente para a solução da maioria dos conflitos de natureza trabalhista entre empregados nacionais e entes de direito público externo, quer pela dificuldade de se encontrar bens do Estado estrangeiro passíveis de serem expropriados, quer pela falta de efetivação desse processo pela via da diplomacia. Buscaremos, dessa forma, propor novas diretrizes para tornar efetiva a sentença condenatória em ações trabalhistas movidas por nacionais contra os entes de direito público externo, com fundamento de que o trabalho é valor humano constitucionalmente assegurado no nosso país, a ser respeitado inclusive pelo Estado estrangeiro, sem que com isso seja ferida a sua soberania

The process of bringing closer Labor Law and Civil Law is considered a return trip to the origins of Labor Law, within Civil Law. This approach has been treated as the solution to labor relations disputes and the ultimate valorization of the workers dignity. As a consequence, the study intends to validate the applicaton of the Civil Code within Labor Law, aiming conflict resolution, and to conclude whether or not there is compatibility in the application of the principles of objective good faith, equity and the social function of contract, those which became Law as part of article 422 of the 2002 Civil Code. Therefore as we transfer Civil Code concepts to the concrete cases within Labor Law, far more reaching decisions can be made and we depart from mere individual rights to the civil responsibility of contracts. By doing this, workers will benefit from a legal protection unheard of or even imagined before / presente estudo tem como propósito trabalhar a conciliO objetivo deste estudo é, sobretudo, mas não apenas, a análise da reaproximação do Direito do Trabalho com o Direito Civil, a partir da promulgação da Constituição Federal em 1988, assim como da posterior promulgação do novo Código Civil em 2002, que operou grandes transformações nas relações privadas contemporâneas, incluindo a despatrimonialização, e que, por isso mesmo, vem sendo chamado de Direito Civil Constitucionalizado. Considerada como um caminho de volta em busca das origens do Direito do Trabalho dentro do Direito Civil, essa reaproximação vem sendo tratada como a solução para o resgate das relações trabalhistas, com vistas à definitiva valorização da dignidade do contratante trabalhador. Como consequência, pretende-se então a verificação da concreção do novo Código Civil, no âmbito do Direito do Trabalho, na busca da solução de conflitos, concluindo pela compatibilidade ou não da aplicação dos princípios da boa-fé objetiva, da equidade e da função do contrato, pela atual positivação desses princípios no diploma civil promulgado em 2002, por meio do art. 422. Conclusion and termination of fixed-term work agreements has influence on legal status of employees, work quality, efficiency of undertaking’s activity as well as provides parties with opportunities to individualize operating conditions and implement reasonable objectives, increases employment. In addition to common labour law norms, according to peculiarities of employment relations there are also rights and guaranties determined by special legal norms applied to fixed-term work agreements. With reference to summarized experience of national legal regulation in Lithuania and other foreign countries, European Union labour law acts, judicial practice and research work results of other authors this work deals with legal employment relationship existing between employer and employee in the process of conclusion and termination of a fixed-term work agreement and paying the main attention to their particularities in the whole of similar relations. It analyzes the machinery of given legal relations’ regulation. There is a conception of a fixed-term work agreement presented. It determines the parties of this legal relation and the content of a fixed-term agreement settled by them. Fixed-term employment meets labour market requirements in upsurge of flexible work organization forms. One of these forms is also a fixed-term work agreement.

Constitutionalizaton of Law’s different areas is a phenomenon gradually more ingrained in our cultural and legal framework. Maybe the best demonstration is the increasingly prominent role of the Constitutional Court (TC) – Constitution’s Supreme Interpreter – in defining and redefining concepts, rights and legal principles touching a range of subjects, from TaxLaw to Human Rights. This is relevant to understand the Law and its current effects whether it is valued positively or negatively. / La constitucionalización de las distintas áreas del Derecho es un fenómeno cada vez más arraigado en nuestra cultura y contexto jurídicos. Tal vez la forma más evidente en que se haya manifestado sea el creciente protagonismo del Tribunal Constitucional (TC), supremo intérprete de la Constitución, en la significación y resignificación de conceptos, derechos y principios jurídicos que, a través de sus sentencias, han afectado desde el derecho tributario hasta los derechos humanos. Sea que esto se valore positiva o negativamente, su relevancia para comprender el derecho y sus efectos en la actualidad es innegable.

A partir de uma noção histórica do nascimento do direito do trabalho com enfoque posterior à sua evolução e desenvolvimento no Brasil será traçado o conceito deste ramo jurídico especilizado bem como alguns dos seus princípios específicos norteadores mais precisamente o princípio da proteção do trabalhador e da valorização do trabalho. Posteriormente tentar-se-á definir o conceito de bens de família a partir do estudo dos mesmos através da análise do princípio da dignidade da pessoa humana, direito à moradia utilidade e habitalidade para fins de delimitação da impenhorabilidade desses bens. Ultrapassando tal estudo será objeto de análise também o princípio da efetividade processual como fundamento do processo assim como a execução trabalhista a qual face à natureza alimentar do crédito exeqüendo, deve ser ainda mais efetiva e célere. Ulteriormente serão abordados os princípios da razoabilidade e da proporcionalidade, os quais se tornam imprescindíveis ao alcance de uma interpretação justa e eficaz no que tange à proteção insculpida na Lei 8.009/90. Por fim após fixarem-se as premissas necessárias à viabilização da interpretação mais adequada das normas postas sob apreço no presente passa-se a propor a relativização da impenhorabilidade dos bens de família para a satisfação de créditos trabalhistas através de parâmetros de razoabilidade e proporcionalidade na ponderação de valores conflitantes. / Salvador
