Against the Backdrop of Sovereignty and Absolutism: The Theology of God's Power and Its Bearing on the Western Legal Tradition, 1100-1600

In focusing on the theology of God's power, this dissertation neither presents an exhaustive historical biography of political theology nor exalts its career in the Western history of ideas. Rather, it attempts to determine the degree to which the modern fate of this field depended on the dialectic of the distinction between two separate types of God's power. To this end, I explore employments and embodiments of this power over a number of centuries. The mediaeval investigation into God's attributes was originally concerned with the problem of divine almightiness, but underwent a slow but steady displacement from the territory of theology to the freshly emerging proceedings of legal analysis. Here, based on the distinction between potentia Dei absoluta and ordinata (God's absolute and ordered power), late-mediaeval lawyers worked out a new terminology to define the extent of the power-holder's authority. This effort would give rise, during the early modern era, to the gradual establishment of the legal-political framework represented by the concepts of the prince and sovereignty. In covering the time from Peter Damian (d. 1072) to Alberico Gentili (d. 1608), I demarcate the limits of this evolution as well as its thematic direction. Damian illustrates how mediaeval theologians' introduction of the distinction potentia Dei absoluta/ordinata extended the horizon of what is feasible for God, while Gentili confronts us by placing the most spectacular consequences of the emerging question in the normative realms of law and politics. I conclude that the question of potentia Dei finally emerges as the Archimedean point from which the account of the history of the European legal tradition is supplemented with its structuring twofoldness - through, for example, such binomial conceptual tensions as centralism/authonomy, legislative/judicial authority, and written/unwritten law.

Innovation Patterns in the Design-Driven Industries. Opening Up the 'Made in Italy'

The main argument of the dissertation is structured around the relationship of innovation and modularity with a special focus on innovation openness. This research took a grasp in understanding the context, the classics, story of Italian design, and Made in Italy at the same time exploring design today: based on a field work in Milan, Lombardy. Case study method proved to be as most suitable for answering the explorative nature of this research. The approach was thus relying on secondary data, desk research and observation for understanding the context both from the angle of tradition and current discourse, as for reaching the next level: collecting cases worth to pursue. The cases presented were chosen to elucidate the targeted questions, and to open the path for further research. However, obstacles faced on the field narrowed the cases covered, and the breadth of the investigation of each case study. Limitations in data access did not allow going beyond the story, I had to rely on what was constructed by the company itself. Despite these obstacles the analysis benefited from the perspective of communication and branding: it made possible to investigate a complex innovation effort. This proved to be a valuable insight, since design-driven industries are driven by producing meanings, forming the discourse where communication plays a key role. This work explores what modularity means in production opening up the perspective toward the aesthetic and semantic realm of production of goods. Furthermore in search for the locus of innovation it examines the relationship of modularity, innovation and openness. By exploring architectural innovation [Henderson and Clark 1990] I found that core design concepts that define the direction of technological improvements enter the conceptual frame of innovation: • What was interpreted as ‘values’ by the company defining the design are proven to be core design concepts in the conceptual frame, as they define here a technological and conceptual [stylistic] frame. • Thus, architecture draws here a semantic and aesthetic frame of conveying meanings. [Not just merely defining the technological construction of the artifact described by the interaction of the elements]. • Procedural innovation [coined by me]: the effort that evolves around the main objective to most efficiently elaborate on the core design concepts in technological, and semantic realms. Further findings of the case studies suggest that open methodology of design and innovation is prone to come from third parties to established firms: • open design methodology as a communication strategy that contributes to innovation practices of the company, and not as a conscious strategy coming from the other way round. Here technological and communication tools are intertwined, as they are conveying meanings defined by the core design concepts • Firms in need for raising their capacities and reshaping organizational routines to innovate turn to third parties in the Knowledge-Intensive Business Services • elucidate hybrid forms of innovation Adding to theory The above-mentioned empirical findings were backed by a concise summary on: • open/ user/ collaborative innovation scholarship • links between modularity and innovation • and understanding the relationship of modular design in the history of design and architecture; also elaborating the: • Semantic frame of innovation: where the product is an architecture of meanings • Framework for understanding stylistic realm of conveying meanings and innovation • Linking modular design of products as a conceptual approach [aesthetics] and linking it to production from an evolutionary perspective Adding empirical insights to be considered for • Organizational theory: namely redefining the boundaries of the firm • Innovation openness: based on the locus of innovation • Modularity: apart from focusing on production, organization and that modular construction of goods has also a conceptual meaning (conceptually exploring the relationship of modular design and integrality with examples from architecture and classics of Italian design). Considering goods as an architecture of meanings and firms producing brands rather than goods, it draws on the implications of arrangement of production.

An Impact Study of DC Protection Techniques for Shipboard Power Systems

The need for DC power at continuous uninterrupted rates is a reality for ship survival during highly intense combat and regular travel. The new proposed distribution system on the all-electric ship is designed using a DC distribution method (zones) in which the use of transformers and frequency issues/manipulation can be eliminated with the use of power electronics. These power electronic devices can greatly simplify the system and provide more available space, possible cost reduction, and variable control. One key feature is to make sure that the DC buses/systems and converters/rectifiers are protected from faults, transients, and other malicious events that can cause unwanted interference, shutdown, and possible damage or destruction. DC faults can have a detrimental impact on the ship performance. DC protection should allow for high speed and highly sensitive detection of faults enhancing reliability in the supply of electric power. DC fault protection geared towards a lower voltage scenario/system has not yet been studied and analyzed rigorously. The research goal of this work has been to develop a method in which the system can detect a DC fault and perform suppression of the fault and return to normal operating conditions once the fault is removed. The use of power electronics and DC fault detection methods are employed to determine how to best protect the system?s stability and longevity. The findings of the research work have demonstrated that using zero-crossing logic on the AC side of the system is beneficial in DC fault detection. Also, different grounding schemes can produce different effects, whereas some grounding schemes can help protect the system during a disturbance.

Die umfangreichen Untersuchungen ausgewählter Mg2Si-basierter Materialien innerhalb dieser Arbeit zeigen neue Wege für die Anwendung der SPS-Technik in der Grundlagen- als auch angewandten Forschung und liefern entscheidendes, neues Material für die Charakterisierung der Li-Verbindungen Li2xMg2-xX (X = Si, Ge, Sn, Pb). Aufbauend auf vorangegangenen Arbeiten und den hier dargestellten Resultaten ergeben sich sowohl neue Möglichkeiten der Synthese, basierend auf dem SPS-Prozess (in Verbindung mit der Pulverherstellung, ‑verarbeitung und einem entsprechenden Werkzeugdesign), als auch eine Optimierung der Materialeigenschaften von Verbundwerkstoffen durch Nutzung dieser Technik. Die ternären Phasen Mg2Si1−xXx (X = Ge, Sn, Pb) und Mg2−x/2Si1−xSbx Die pulvermetallurgische Herstellung der Phasen Mg2Si1-xXx (X = Ge, Sn und Pb) und der Phase Mg2‑x/2Si1-xSbx gelang in dieser Arbeit erstmals mit Hilfe der SPS-Technik aus kugelgemahlenen Pulvergemischen (MgH2, Si, X). Die ternären Phasen Li2xMg2−xX (X = Si, Ge, Sn, Pb) Der Einbau von Li in Mg2Si wurde in dieser Arbeit erstmalig durch die SPS-Festkörperreaktion aus LiH, MgH2 und Si untersucht. Die Synthese der Li-armen Li2xMg2−xSi-Phasen gelingt schon bei Temperaturen von max. 700 °C. Die Schmelzsynthese dieser extrem luft- und feuchtigkeitsempfindlichen Proben wurde unter Argon-Schutzgas aus den Elementen mit anschließender Wärmebehandlung bei 200 °C angewendet. Dabei lassen sich drei unterschiedliche kubische Li2xMg2−xSi-Phasen mit 0 < x < 0,8 auf der Mg2Si-reichen Seite des ternären Systems finden. Mit steigendem Li-Gehalt können röntgenographisch zwei strukturelle Umwandlungen, ausgehend von der Raumgruppe Fm-3m für Mg2Si zu P-43m und P-43m mit der Bildung einer Überstruktur mit a′ = 2a bestimmt werden. Mit steigendem Li-Gehalt in Li2xMg2−xSi ändern sich die Eigenschaften. Der Übergang vom halbleitenden zum metallischen Zustand konnte in dieser Arbeit erstmalig gezeigt werden. In Analogie zu Li2xMg2−xSi konnten die Phasen Li2xMg2−xX (X = Ge, Sn, Pb) charakterisiert werden. Eine Intercalation für Li in Mg2X ist nicht möglich. Die Verbundwerkstoffe basierend auf Mg2Si Das spröde Materialverhalten vonMg2Si-Proben kann durch einen pulvermetallurgisch erzeugten Verbundwerkstoff mit Mg reduziert werden. The Ternary Phases Li2xMg2−xX (X = Si, Ge, Sn, Pb) The intercalation of Li into Mg2Si is investigated for the first time by using the SPS solid state reaction based on LiH, MgH2 and Si. The synthesis of the Li poor phase Li2xMg2−xSi could be obtained at temperatures of max. 700 °C. The melting technique made of the elements of these extremely air and moisture sensitive samples could be performed under Argon protective atmosphere followed by a heat treatment at 200 °C. Three different cubic phases of Li2xMg2−xSi can be found on the Mg2Si rich side of the ternary System with the composition in the range of 0 < x < 0,8. With increasing Li content two structural conversions can be found using the x-ray analysis. A change from the space group Fm-3m for Mg2Si via P-43m to P-43m with a superstructure of a′ = 2a could be detected. Linked with the increasing Li content is a change of the properties. The change from the semiconducting behaviour to a metallic characteristic could be shown for the first time. Analogous to Li2xMg2−xSi the phase Li2xMg2−xX (X = Ge, Sn, Pb) could be synthesised and analysed. An intercalation of Li in to Mg2X ist not possible. Composite Materials Based on Mg2Si The brittle behaviour of Mg2Si samples can be reduced by composite material with Mg using the powder metallurgical route. The SPS-Technique Using MgH2 the distribution of the current, the density and the temperature in the sample and tool could be judged.

L’amélioration des systèmes électroniques pour le déploiement de l'avion tout électrique dépend de la capacité des composants passifs, tels que les condensateurs, à réduire leur volume, leur masse et leur coût, et augmenter leurs performances et leur fiabilité, particulièrement dans l’environnement aéronautique. Dans ce contexte, cette thèse a eu pour objectif l’étude et le développement de nouvelles technologies de condensateurs pour des applications avioniques. Dans la première partie des travaux, nous abordons l’évaluation de condensateurs céramique de puissance. La technologie céramique constitue, en effet, l’une des rares solutions matures capables de répondre aux exigences des équipementiers. La caractérisation, l’analyse des mécanismes de défaillance, de leurs effets et de leur criticité (AMDEC) ainsi que l’étude de fiabilité et de robustesse de composants commerciaux présentant des architectures originales (condensateurs multi-chips) ont été réalisées. Ces résultats ont été complétés par une étude plus amont sur la caractérisation de céramiques frittées par frittage flash (SPS). Les permittivités colossales de ces matériaux permettraient d’accroitre la fiabilité et la miniaturisation des condensateurs tout en conservant de fortes valeurs de capacité et de tension nominale. La seconde partie, plus fondamentale, a été consacrée au développement de nanoparticules céramique/polymère coeur-écorce pour des applications de condensateurs enterrés, opérant aux radiofréquences. La synthèse et les caractérisations physico-chimiques des nanocomposites ainsi que les procédés de fabrication de condensateurs en couches épaisses sont, en premier lieu, décrits. Une méthode de caractérisation électrique large bande a été mise au point pour permettre l’analyse des propriétés diélectriques et des mécanismes de conduction des nanoparticules. Les performances des dispositifs ont été recherchées en fonction de la température et des procédés de mise en forme. En outre, la durabilité en température de ces derniers a été évaluée. / The improvement of electronic systems for the deployment of all-electric aircrafts depends on the ability of passive components, such as capacitors, to reduce their volume, weight and cost, and to increase their performance and reliability, particularly in the aeronautical environment. In this context, the objective of this thesis was to study and develop novel capacitor technologies for avionics. In the first part of this work, the evaluation of power ceramic capacitors has been discussed. Indeed, the ceramic technology appeared to be one of the few mature solutions meeting the requirements of OEMs. The characterization, the failure mode, effects and criticality analysis (FMECA) and reliability and robustness assessment of commercial components using original architectures (multi-chip capacitors) have been performed. These results have been completed by a more advanced study on the characterization of new ceramics sintered by spark plasma sintering (SPS). The colossal permittivity of these materials could allow to increase reliability and miniaturization of capacitors while maintaining high values of capacitance and voltage rating. The second part, more fundamental, is devoted to the development of core-shell ceramic/polymer nanoparticles for embedded capacitors operating at radiofrequencies. The synthesis and the physicochemical characterization of the nanocomposites as well as the manufacturing processes of the thick film capacitors are first described. A new broadband electrical characterization methodology has been developed to analyze the dielectric properties and the conduction mechanisms of the nanoparticles. The effects of the temperature and the manufacturing process on the device performance have been investigated. In addition, the durability was evaluated.

RIPENSARE L'EDUCAZIONE NELL'ERA DIGITALE / Rethinking education in the digital age

Questa ricerca interdisciplinare prende atto delle visioni contrastanti all’interno della Media Literacy: da un lato quella utopica che individua nel progresso tecnologico l’alba di una nuova era per l’umanità, dall’altro l’approccio distopico preoccupato dalle potenziali derive conseguenti all’uso acritico e compulsivo dei dispositivi. Tale contrapposizione, sebbene con diverse sfumature, si riverbera nei vari ambiti educativi spesso impedendo la piena comprensione delle dinamiche della comunicazione contemporanea. La prospettiva antropocentrica che ispira l’intera trattazione valorizza i contributi non apodittici capaci di “dialogare”, passando dalla logica escludente dell’aut - aut a quella inclusiva dell’et - et. A partire da alcune significative acquisizioni delle Scienze Cognitive, delle Scienze Umane e dei Media Studies a cui sono dedicati i primi due capitoli, viene offerto un excursus nella literacy teso ad individuare piste pedagogiche praticabili nei diversi contesti, frutto della sperimentazione e della verifica sul campo riportate nella parte finale. Il lavoro intende dimostrare, non soltanto a livello empirico, che la Rete e la sua stessa orizzontalità possono e devono diventare paradigma operativo per un’azione educativa efficace in grado di superare visioni settoriali e semplificazioni, grazie ad un approccio multiprospettico incentrato sulla persona chiamata a “ri-conoscersi” per ripensare l’educazione nell’era digitale. / This interdisciplinary research notes the conflicting views within the Media Literacy: from one side the utopian one locating in technological progress the dawn of a new era for humanity and from the other the dystopian approach worried by potential drifts consequent to the uncritical and compulsive use of the devices. This conflict, although with different nuances, reverberates in the various educational environments often preventing the full understanding of the dynamics of contemporary communication. The anthropocentric perspective that inspires the whole discussion enhances non-dogmatic contributions able to "talk", passing from the exclusionary logic of the “aut – aut” to that inclusive “et – et”. Starting from some significant acquisitions of Cognitive Sciences, Human Sciences and Media Studies to which the first two chapters are dedicated, an excursus in literacy aimed at identifying educational tracks viable in different contexts, is offered as a result of experimentation and verification on field described in the final part. The work aims to demonstrate, not only empirically, that the Internet and its own horizontality can and should become operational paradigm for effective educational action able to overcome sectoral visions and simplifications, thanks to a multi-perspective approach centered on the person called to "re-cognize oneself" to rethink education in the digital age.

Una performance teatrale è un meccanismo complesso che viaggia attraverso molte variabili. L'approccio della lettura dell'evento performativo come nodo d'incontro e scambio di diversi agenti e aspetti è stato inoltre presentato dall'International Federation for Theater Research (IFTR) nella pubblicazione Theatrical Events. Borders, Dynamics, Frames. La tesi dottorale, in accordo con tale lettura, presenta tre case-study: Motus, Punchdrunk e Robert Wilson. I tre esempi sono qui analizzati nella loro totalità di opere d'arte, fenomeni culturali e meccanismi organizzativi, evidenziandone peculiarità, similitudini e differenze. Di ognuno sono stati valutati il processo creativo, le strategie di produzione, la relazione con la stampa e/o i mezzi di diffusione, le collaborazioni con la comunità artistica, la relazione con il pubblico. La ricerca è stata portata avanti coordinando diverse metodologie: la preferenza è stata data alle fonti primarie e al lavoro di campo nell'area di New York - interviste, fotografie, raccolta di dati e materiale iconografico. Sono stati poi consultati gli archivi della New York Public Library for the Performing Arts, della Byrd Hoffmann Foundation e del The Watermill Center. Il secondo capitolo si avvale inoltre della preziosa collaborazione sul campo dei ricercatori del gruppo ISPOCC (Initiative for the Study and Practice of Organized Creativity and Culture) della Columbia University Business School / A performance is a dynamic system that involves many variables. The importance of theatre performances as aesthetic-communicative encounters of a wide range of agents and aspects has also been stressed by IFTR, through the working group "Theatrical events" and its publication Theatrical Events. Borders, Dynamics, Frames. In accordance with the IFTR approach, the dissertation presents three case-study: Motus, Punchdrunk and Robert Wilson. The three international artists and companies are studied here as a crossroad of interactions among art, marketing, and social context, tracing similarities and differences in their theatrical productions. Specifically, the research analyzed four theatrical events: Sleep No More by Punchdrunk, Syrma Antigones project by Motus, The Discovery Watermill Day and The Old Woman by Robert Wilson. The essay is the result of a combined archive and fieldwork research based in New York. The archival materials is from New York Public Library for the Performing Arts, Byrd Hoffman Foundation, The Watermill Center, Motus theater company's archive, while the fieldwork collected visual materials such as pictures, sketches, videos as well as interviews and artists notes during the events. Part of the Sleep No More's fieldwork is in collaboration with ISPOCC (Initiative for the Study and Practice of Organized Creativity and Culture) at Columbia University Business School.

食品輸入管理與WTO/SPS協定規範合致性之研究-以我國針對日本輸入食品輻射管制措施為中心 / A Study on Food Import Regulation and its Consistency of SPS Agreement under WTO: Focusing on Taiwan’s Regulatory Response to the Radioactivity in Japanese Food Products

由於全球貿易自由化,食品的流通也漸趨便利。各國為避免或減少因食品貿易流通而導致外來動植物疫病蟲害入侵、或蔓延之機會,及防範食品、飲料或飼料中之添加物、污染物等的潛在風險,以保護境內國民及動植物的生命或健康,及維護自然生態環境,會對進口食品採取相關規範與措施。當會員基於主權制定相關措施時,可能會因這些措施對於貿易活動之限制性效果,而損及其他會員在WTO下之貿易利益,因而會造成其他國家的關切,甚至訴諸WTO爭端解決機制。 本文將介紹國際間常受其他會員關切的食品管制措施類型,主要以在WTO SPS委員會之會議上受到關切,或當事國向WTO提出控告的個案,來進行探討。藉由個案研究,以從中了解WTO重要條文及所涉議題之內涵與重要原則,並作為我國對進口食品管制措施管理之借鏡。我國自2002年加入WTO後,進口食品的值與量明顯增加,我國食品輸入管理機制也越顯重要。自2011年3月11日福島核災發生,大量放射性物質外洩對整體環境、人類及生物健康造成危害,故各國紛紛對日本食品實施管制程度不等的進口管制措施,以防止遭到輻射汙染之食品輸入。我國自日本輸入食品種類與數量皆甚多,因此亦對日本食品採取特定管制措施。針對此我國此管制措施,本文將以國際經貿法的觀點,依據 WTO協定中與檢驗措施密切相關的SPS協定規範、過往案例之裁決及相關文獻,分析我國針對日本輸入食品輻射管制措施之適法性,並判斷該措施將來是否存在遭非難之可能,希冀能對於我國日後政策走向提供一實質性之參考及展望。 / Global trade in agricultural and food products has grown rapidly in recent decades, with countries becoming more engaged in cross-border trade, whether as exporters or importers. All countries maintain measures to ensure that imported food is safe for consumers, and to prevent the spread of pests or diseases among animals and plants. These sanitary and phytosanitary measures can take many forms, such as requiring products to come from a disease-free area, inspection of products, specific treatment or processing of products. Sanitary and phytosanitary measures, by their very nature, may result in restrictions on trade. After the March 11, 2011 earthquake and tsunami damaged the Fukushima Daiichi nuclear power plant in Japan, radiation was released into the environment near the plant. Growing concerns over radiation cause several countries, such as Korea and China to impose restrictions on the import of Japanese products. Taiwan, one of Japan's key food export markets, also imposed regulations in order to secure the safety of people. However, in 2015 Japan has filed a dispute against Korea at the World Trade Organization (WTO) over import restrictions that Japan found the measures inappropriate and against the Agreement on the Application of Sanitary and Phytosanitary (SPS Agreement). It also demonstrats that countries which impose import restrictions could be facing international adjudication through the WTO. Therefore, this essay staying with the view of international trade law, in particular the SPS Agreement under WTO, tries to analyze the consistency of Taiwan’s import regulations on Japanese Food Products with the rules and norms of the WTO in order to assess the legitimaticy of Taiwan’s trade policy.
