The study involves an in-depth case study on the leadership task of the grade heads at a private secondary school in Gauteng with the main research problem arising as: After defining the leadership task of grade heads at a private secondary school in Gauteng, how important do the learners in the grade view the individual grade head tasks to be? From the mixed-method research conducted, it stems that the leadership tasks of the grade head (and also the grade head system as a whole) have a positive impact on the learners and the holistic school environment. Commerce, little magazines and modernity : New York, 1915-1922

This thesis examines the theme of commerce in four magazines of literature and the arts, all published in New York between 1915 and 1922. The magazines are The Seven Arts (1916-1917), 291 (1915-1916), The Soil (1916-1917), and The Pagan (1916-1922). The division between art and commerce is addressed in the text of all four, in a variety of different ways, and the results of that supposed division are explored for each magazine. In addition ‘commerce’ is also used in this thesis in the sense of conversation or communication, and is used as a way to describe them in the body of their immediate cultural environment. In the case of The Seven Arts, as discussed in Chapter 1, the theme of commerce with the past, present, and future is examined: the way that the magazine incorporates the European classical past and rejects the more recent intellectual past; the way it examines the industrial present, and the projected future of American arts and letters. In the case of The Soil and 291 (the subjects of Chapters 2 and 3) there is extensive commerce between them in the sense of intercommunication, a rival dialogic demonstrating both ideological and economic rivalry. These two chapters comprise an extensive examination of the relationship between the magazines, and shows how much of this involves commerce in the financial sense. The fourth magazine, The Pagan, is concerned with a different sense of commerce, in the form of its rejection of the American capitalist system, and is critically examined here for the first time. The introduction is a survey of examples from the whole field of American periodicals of the time, particularly those immediately relevant to the magazines described here, and acts to delineate the field of scholarship and also to justify the particular approach used. The conclusion provides a summary of the foregoing chapters, and also suggests ways in which each magazine approaches the dissemination, or ‘sale’ of the idea of the new.

Les études sur la mémoire, qui connaissent une grande popularité depuis les années 1980, ont mené à un intérêt pour l’histoire de l’histoire et pour la création de figures héroïques. Ce mémoire de maîtrise s’inscrit dans ces courants de recherche en étudiant le sort qu’une historiographie plurinationale a réservé à trois officiers français du théâtre nord-américain de la guerre de Sept Ans. Nous observerons comment les ouvrages britanniques, français, américains, canadiens-anglais et canadiens-français ont traité de Vaudreuil, Bougainville et Lévis. Nous pourrons ainsi exploiter la richesse de l’historiographie relative à cette guerre, qui date du XVIIIe siècle jusqu’à aujourd’hui. Il s’agira de suivre les regards croisés que les historiens des différentes époques et allégeances nationales ont porté sur nos personnages. C’est que ces trois hommes incarnent trois postures que l’historiographie interprétera de façon variable. En effet, comme cette production historique est surtout marquée par des rivalités entre les personnages qui prennent des allures de conflits nationaux, nos héros seront surtout jugés selon une perspective nationale. Vaudreuil, le gouverneur canadien né dans la colonie y devient donc le champion de son «pays», Bougainville, le métropolitain critique des conditions coloniales, futur navigateur et homme des Lumières, est jugé en fonction de ses propos sur le Canada, alors que Lévis, le métropolitain discret dans ses écrits, sera surtout jugé en fonction de sa victoire à Sainte-Foy en 1760. / Very popular since the 1980s, studies on collective memory have stimulated interest in historiography and especially in the construction of heroic figures. The thesis follows this trend in studying how a multinational historiography treated three French officers of the Seven Years’ War’s North American theatre. We observe how Vaudreuil, Bougainville and Lévis have fared at the hands of historians from Great Britain, France, the United States and English and French Canada, from the eighteenth century to the present. The purpose of the study is to isolate the varying perspectives from which historians of different times and national allegiance have examined the three figures. In the end, the three men were seen to incarnate three contrasting, variously interpreted postures. Since historians were particularly sensitive to what they saw as national conflicts, they judged their heroes accordingly. Vaudreuil, the Canadian-born governor of Canada, thus became the champion of his “country”; Bougainville, French-born future navigator and protagonist of the Enlightenment who wrote disparagingly about the colony, was judged on these opinions; while Lévis, a Frenchman who was more discreet in his writings, was evaluated above all as the victor of the battle of Sainte-Foy in 1760.

This thesis deals with the issues of military deserters from the imperial-royal army at the period of the enlightened absolutism, thus during the reign of Maria Theresa and her sons Joseph II and Leopold II. Based on written as well as printed sources, originated mainly from the activity of the supreme provincial offices of the Kingdom of Bohemia at this time, an explanation on the questions of deserters' punishments, their limited pardons and mutual exchanges, made between the Habsburg Monarchy and her allies, has been offered. Moreover, the attention has been paid to the state's approach to the inhabitants that either provided aid to the deserters, or vice versa participated in their pursuit and capture. The last part of the text has been devoted to the registries of military deserters who originated from Bohemia, with the main emphasis on the Seven Years' War, because these registries have been preserved mostly for this conflict. Esta tese estuda a adivinhação nas sete tragédias supérstites de Ésquilo entendendo-se a adivinhação não no sentido estrito de revelação de fatos futuros, mas no sentido mais amplo de um diálogo que se estabelece entre as instâncias divina e humana valendo-se de formas e recursos variados. Assim, a análise e interpretação destas tragédias priorizam os diversos aspectos deste diálogo divinatório para mostrar a adivinhação como fundamento da construção de estratégias dramáticas na tragédia esquiliana, por informar e definir tanto a peculiaridade desta poética quanto sua visão do mundo. / This thesis studies divination in the seven surviving tragedies of Aeschylus. Divination is taken here not in the strict sense of revelation of future events, but in the broader sense of a dialogue that is established between divine and human levels through a variety of forms and resources. Thus, the analysis and interpretation of these tragedies prioritises the different aspects of this divinatory dialogue, in order to show that divination is the basis for constructing the dramatic strategies in the tragedies of Aeschylus, since it informs and defines both the particular features of this poetics and its view of the world.

Modelos constitutivos para materiais hiperelásticos: estudo e implementação computacional / Constitutive models for hyperelastic materials: study and computational implementation

O objetivo central deste trabalho é implementar modelos constitutivos hiperelásticos não lineares em um código computacional que faz análise não linear geométrica de cascas. São necessários, para este propósito, conceitos sobre álgebras linear e tensorial, cinemática, deformação, tensão, balanços, princípios variacionais, métodos numéricos e hiperelasticidade. Tal programa usa a formulação Lagrangiana posicional, o método dos elementos finitos, o princípio dos trabalhos virtuais e o método iterativo de Newton-Raphson para solução das equações não lineares. O elemento finito de casca possui dez nós, sete parâmetros por nó e variação linear da deformação ao longo da espessura. Para dedução dos novos modelos usou-se a decomposição multiplicativa do gradiente da função mudança de configuração, o tensor deformação de Green-Lagrange e o tensor da tensão de Piola-Kirchhoff de segunda espécie. O código desenvolvido foi usado em simulações de diversos exemplos e apresentou boa precisão na análise mecânica de polímeros naturais altamente deformáveis. A ocorrência do fenômeno travamento não se manifestou nas análises realizadas. A presente pesquisa confirmou outros trabalhos, reforçou a necessidade de se usar modelos hiperelásticos não lineares para simular o comportamento mecânico de polímeros naturais e apresentou resultados condizentes com dados experimentais existentes na literatura científica e às respectivas soluções analíticas. / The main objective of this work is to implement nonlinear hyperelastic constitutive models in a computational code of geometrically nonlinear analysis of shells. For this purpose, concepts of linear and tensor algebras, kinematics, strain, stress, balances, variational principles, numerical methods and hyperelasticity are necessary. Such program uses the positional Lagrangian formulation, the finite element method, the principle of virtual work and the iterative method of Newton-Raphson for the solution of the nonlinear equations. The shell finite element has ten nodes, seven parameters per node and presents linear variation of the strain along the thickness. To achieve the new constitutive models the multiplicative decomposition of the deformation gradient, the Green-Lagrange strain tensor and the second Piola-Kirchhoff stress tensor are used. The developed code is tested for simulations of various examples and presents good accuracy in the mechanical analysis of highly deformable natural rubber. The locking phenomena didn\'t appear in the proposed analysis. The present research confirms other works, corroborates the need of using nonlinear hyperelastic models to simulate the mechanical behavior of natural rubber and presents suitable results when compared to existent experimental data of the scientific literature and to the respective analytical solutions.

A Study on the Stop-and-Frisk Legal System of the Police Officers ¡V¡V Taking Five Main Structures of the Administration Act as the Means of Analysis

The implementation of the stop-and-frisk duty of the police is extremely closely related to the intervention of people¡¦s freedom of action, privacy and moral integrity right. In the past, the basis of law for the fulfillment of the stop-and-frisk duty by the police authorities was only the ¡§Regulations of the Police Duties.¡¨ Nevertheless, the Regulations contained no content of the objective for initiating the stop-and-frisk duty, the stop-and-frisk procedures and the means of relief. The Regulations only mention the term of stop and frisk, but lack the soul and body of stop and frisk. Based on the term of stop and frisk, the police always legitimized the enforcement of many banning acts, such as searching the house of a citizen in the midnight in the name of fulfilling the stop-and-frisk duty of the household. Similar behaviors were frequently found, thus creating many complaints from the citizens. After the chancellor of Judicial Yuan made an explanation of Shih No. 535, a lot of feedbacks from the police were undoubtedly created. To Taiwan, this is a great leap in marching towards a country under the rule of law. It has made the police authorities understand the importance of administrative procedures, and urged the birth of ¡§Act of Exercise of the Police Powers.¡¨ In the new Act, the behavior of stop and frisk is replaced by the term ¡§checking of identity.¡¨ A local scholar, Wu Keng once mentioned that ¡§stop and frisk¡¨ had been abolished and not been used. However, is it the fact? This paper is going to investigate the issue. Besides, does the constitution of the Act mean that the stop-and-frisk legal system is sound enough? This is another issue worthy of studying. Due to the vastness and un-limitedness of Administration Act, there is no country in the world having a sound and complete Administration Act. Nevertheless, viewing at the theories and principles of Administration Act, it can be generally divided into five main structures: basic principles, administrative organization, limit of administrative rights, administrative relief and administrative surveillance. If an administrative legal system is fearless to receive the examination based on each item of the five main structures of Administrative Law, it can be called a sound and complete administrative legal system. Another local scholar, Li Chen-Shan thinks that the separation of criminal law from Administration Act has led to the division of the police¡¦s mission of maintaining public security into two parts: ¡§prevention of harm¡¨ and ¡§criminal arrest,¡¨ which prevents the administrative harm and the criminal harm respectively. While they cross over the administrative area and the criminal area, stop-and-frisk duty belongs to an administrative behavior. Since it just belongs to the ¡§prevention of harm,¡¨ it should be regulated by the theories and principles of Administration Act. Therefore, this paper takes the stop-and-frisk legal system of police officers as the main body of the study. From the viewpoint of the science of law, this paper employs the abovementioned basic theories of Administration Act, i.e. the ¡§five major structures¡¨ of administrative principles, administrative organization, limit of administrative rights, administrative relief and administrative surveillance, as the research approaches of the study to examine the stop-and-frisk system of the police officers of Taiwan. Under this mode of thinking, the study is divided into seven chapters. Chapter 1 is Introduction, which firstly raises queries over the practice of fulfilling stop-and-frisk duty by the police authorities, and then introduces the motives, objectives, research approaches, research area and research structure of the paper. Chapter 2 is Basic Principles of Stop-and-Frisk Legal System, which firstly reviews the basic concepts of the two terms, the police and stop and frisk, and then investigates the background for the constitution of stop-and-frisk legal system. In this chapter, substantial information from the social aspect of the practical phenomena, the economic aspect of the optimal adjustment, the political aspect of negotiation and compromising, and the legal aspect of acts and regulations, is presented, enabling us to have a deeper understanding of the practical phenomena of stop-and-frisk legal system. After that, the chapter analyzes and compares the international aspects of the stop-and-frisk legal system of three countries, Germany, Japan and the United States, so as to take them as the references for the improvement of local legal system. Then, the chapter investigates the concepts of the rule of law of stop-and-frisk legal system, as well as the nature of stop and frisk from the angles of the three administrative principles according to laws and the seven principles of procedural justice. Finally, the chapter explores the relationship between stop-and-frisk legal system and the participation of the parties concerned. It is hoped that through the participation methods of the parties concerned, the stop-and-frisk legal system can become more sound and complete. Chapter 3 introduces the administrative organization of stop-and-frisk legal system by starting from the organizational structure of the existing police organization, and then investigates the organizational structure of the police authorities, staff on duty (including the assistants on duty), the budget and other problems. It is expected that a complete organizational structure can be formed to achieve a smooth operation of the stop-and-frisk practices of police officers. Chapter 4 discusses about the design and use of the limit of the rights of stop-and-frisk legal system. The chapter investigates each item stipulated in Administrative Procedure Act,¡¨ including the administrative plan, administrative legislation, legislative punishment, administrative investigation, administrative agreement, administrative guidance and the fulfillment of administrative obligations, hoping to make a comprehensive investigation of the limit of the stop-and-frisk rights. Chapter 5 introduces the relief and problem-solving measures of stop-and-frisk legal system. There is an ancient saying about law, ¡§Where there is right, there is relief.¡¨ This chapter firstly mentions the right of dissent, and then discusses about the issues of pleading, administrative lawsuit, national compensation, compensation of loss and referendum, intending to cover every detail of the rights of citizens. Chapter 6 talks about the administrative surveillance of stop-and-frisk legal system, and investigates the internal surveillance mechanism of the police authorities themselves and the external fair surveillance mechanism of the third parties. It is hoped that the surveillance mechanisms can meet the national and public requirements, no matter from the legal facet or the practical facet. Chapter 7 is the Conclusions and Suggestions, which synthesize the researcher¡¦s discussion of the five main structures of Administration Act. Over some specific items of the existing stop-and-frisk legal system of the police officers that need to be revised or deleted, the chapter proposes concrete suggestions, which can be a reference for the police authorities in exercising their powers, and working on the goals of building the administrative standards of Taiwan according to law, and improving the legal image of Taiwan under the rule of law.

Slavery, war, and Britain's Atlantic empire : black soldiers, sailors, and rebels in the Seven Years' War

This work is a social and cultural history of the participation of enslaved and free Blacks in the Seven Years’ War in British America. It is, as well, an intellectual history of the impact of Blacks’ wartime actions upon conceptions of race, slavery, and imperial identity in the British Atlantic world. In addition to offering a fresh analysis of the significance of Britain’s arming of Blacks in the eighteenth century, it represents the first sustained inquiry into Blacks’ experience of this global conflict. It contends that, though their rhetoric might indicate otherwise, neither race nor enslaved status in practice prevented Britons from arming Blacks. In fact, Blacks played the most essential role in martial endeavors precisely where slavery was most fundamental to society. The exigencies of worldwide war transformed a local reliance upon black soldiers for the defense of particular colonies into an imperial dependence upon them for the security of Britain’s Atlantic empire. The events of the Seven Years’ War convinced many Britons that black soldiers were effective and even indispensable in the empire’s tropical colonies, but they also confirmed that not all Blacks could be trusted with arms. This work examines “Tacky’s revolt,” during which more than a thousand slaves exploited the wartime diffusion of Jamaica’s defensive forces to rebel, as a battle of the Seven Years’ War. The experience of insecurity and insurrection during the conflict caused some Britons to question the imperial value of the institution of slavery and to propose that Blacks be transformed from a source of vulnerability as slaves to the key to the empire’s strength in the southern Atlantic as free subjects. While martial service offered some Blacks a means to gain income, skills, a sense of satisfaction, autonomy, community, and even (though rarely) freedom, the majority of Blacks did not personally benefit from their contributions to the British war effort. Despite the pragmatic martial antislavery rhetoric that flourished postwar, in the end the British armed Blacks to perpetuate slavery, not to eradicate it, and an ever more regimented reliance upon black soldiers became a lasting legacy of the Seven Years’ War. / text
