estabelecidos na Constituição Federal de 1988, constitui o conceito central da
presente dissertação de mestrado e sua abordagem teve como fundamento a versão
contra-hegemônica dos direitos humanos, aqui reconhecida como instrumento de
transformação e superação de maneira radicalmente democrática dos conflitos por
terra no Brasil. O objetivo geral da pesquisa reside na análise das experiências
históricas do Assentamento Normandia e do Acampamento na Fazenda Papagaio -
ambos localizados na região Agreste do estado de Pernambuco -, nas quais
procuramos identificar as determinações sociojurídicas que conduziram, na primeira,
ao reconhecimento da função social da propriedade rural e, na segunda, ao
impedimento à sua efetivação enquanto condição que possibilita a expansão da
justiça social, ainda que nos marcos de uma sociedade capitalista. Nessa
perspectiva, fizemos a opção metodológica pela pesquisa bibliográfica e documental
com abordagem qualitativa. Inicialmente, dedicamo-nos ao estudo das principais
obras dos autores clássicos do pensamento social brasileiro com a finalidade de
compreender os fundamentos históricos da estrutura agrária do Brasil e os níveis
elevados de concentração fundiária que a caracterizam. Em seguida, investigamos a
regulamentação do conceito de função social da propriedade rural nas cartas
magnas brasileiras e no plano jurídico infraconstitucional, bem como os principais
debates travados a seu respeito. Construído o quadro teórico, pudemos
desenvolver, com maior consistência, a última etapa da presente dissertação, na
qual realizamos uma pesquisa documental com base nos processos administrativos
e judiciais relativos a cada uma das citadas experiências. Ao final, a pesquisa nos
permitiu concluir que o próprio texto constitucional sofre diferentes interpretações,
podendo ser instrumentalizado para atender aos interesses da elite agrária
brasileira. Assim, se, por um lado, a experiência do Assentamento Normandia
revelou a inserção da dimensão social e política do conflito por terra no debate
jurídico e o reconhecimento da função social da propriedade rural como instrumento
que possibilita a efetivação de um conjunto de direitos fundamentais, por outro, a
experiência do Acampamento Papagaio demonstrou a limitação do debate sobre a
reforma agrária a uma discussão exclusivamente técnica relativa à (im)produtividade
da terra, acabando por gerar uma leitura do dispositivo constitucional que regula a
função social da propriedade rural funcional à reprodução da lógica segragacionista
imposta pelo direito de propriedade em seu aspeto mais tradicional. / The social function of rural property, as related to rights, principle and guaranty
stated in the Federal Constitution of 1988, forms the basis for the central concept of
this master degree thesis and its approach had as basement the counter hegemonics
version of human rights, here recognized as an instrument of transformation and
overcoming in a radical and democratic way of conflicts for land in Brazil. The
general aim of this search is the analyses of historic conflicts in Normandia
settlement and encampment on Papagaio farm.- both located in rural area of the
state of Pernambuco - where we sought to identify the social and juridical
determinations that drove, in the first, to the acceptance of social function of rural
property and second, to the obstruction to its execution while condition that enables
the expansion of social justice, even though in the marks of a capitalist society.
Based on these facts, we made the methodological choice of bibliographical and
documentary with qualitative approach. Initially, we devoted to the study of the major
works of classical authors of the social Brazilian thought with the objective to
understand the historical basement of agrarian structure of Brazil and the high levels
of landholding concentration that features it. Then, we explored the regulation of the
concept of social function of rural property in Brazilian magna-letter and the infra
constitutional judicial plan and also the main debates that happened regarded to it.
Built the theorist chart, we developed with more consciousness the last stage of this
present thesis, in which we got the direction to have a documental search based on
judicial and administrative proceedings related to each of the mentioned
experiments. Finally, the search let us to deduce that the constitutional text itself
admits different interpretations, it can be exploited to attend the interests of Brazilian
agrarian elite. So, if by one side the experiment of Normandia settlement revealed
the insertion of social dimension and the political conflicts for land in judicial debate
and the recognition of social function of rural property as an instrument that enables
the execution of a set of fundamental rights, on the other side, the experiment of
Papagaio encampment showed the restriction of debate about agrarian reform to an
exclusive technical discussion related to the poorness of the land, leading to create a
reading of the constitutional apparatus that regulates the social function of functional
rural property to the reproduction of logical segregation imposed by the rights of
property in its more traditional aspect.

Plano diretor de desenvolvimento urbano de Aracaju e a função social da propriedade urbanaAlves, Saraí Araujo 29 August 2018 (has links)
The Master Plan is the main instrument of the urban policy of a municipality, and must follow
the general guidelines brought by the City Statute, National Law No. 10,257, of July 10,
2001. In Aracaju, the PDDU - Urban Development Master Plan, still in force, is that of
Complementary Municipal Law No. 42, dated October 4, 2000. Pursuant to the provisions of
art. 40, §3, of the City Statute, the law establishing the master plan shall be reviewed at least
every ten years. This temporary lapse was ratified by the Aracaju Municipal Organic Law
updated, in its article 219. The Aracaju PDDU (2000) was not updated according to the
directives brought by the City Statute in 2001, and all attempts to review have not been
finalized. Within this context, the proposed research sought to analyze the causes of nonoccurrence
of the revisions and the consequences for the municipality of Aracaju, the
accomplishment of the participative management, as well as the (dis) fulfillment of the
principle of the social function of urban property, investigating if the instruments provided for
in art. 182, §4, of the Federal Constitution of 1988 were implemented. To accomplish this and
the other specific objectives, different methodological procedures were used, associated to
different stages, namely: bibliographic survey, analysis of judicial processes and interviews
with specialists from different areas of Knowledge. The results of this work show that Aracaju
has been presenting, since 2000, an accelerated and disordered urban growth, with several
impacts on the city and its inhabitants, like the increase of the homicide rate, being, at present,
the largest in the country. Thus, it was verified that Aracaju's current PDDU (2000) has been
outdated for approximately 18 (eighteen) years, without fulfilling the purpose for which it is
intended, suffering the influence of social actors who do not see the city of Aracaju as a being
who pulses full of life and who deserves and needs protection. / O Plano Diretor é o principal instrumento da política urbana de um município, devendo seguir
as diretrizes gerais trazidas pelo Estatuto da Cidade, Lei Nacional n° 10.257, de 10 de julho
de 2001. Em Aracaju, o PDDU – Plano Diretor de Desenvolvimento Urbano, ainda vigente, é
o da Lei Complementar Municipal n° 42, de 04 de outubro de 2000. Por força do que dispõe o
art. 40, §3°, do Estatuto da Cidade, a lei que instituir o plano diretor deverá ser revista, pelo
menos, a cada dez anos. Referido lapso temporal foi ratificado pela Lei Orgânica Municipal
de Aracaju atualizada, em seu artigo 219. O PDDU (2000) de Aracaju não foi atualizado
segundo as diretrizes trazidas pelo Estatuto da Cidade em 2001, não sendo também ultimadas
todas as tentativas de revisão. Dentro desse contexto, a investigação proposta procurou
analisar as causas da não ocorrência das revisões e as consequências para o município de
Aracaju, a realização da gestão participativa, bem como o (des) cumprimento do princípio da
função social da propriedade urbana, investigando se os instrumentos previstos no art. 182,
§4°, da Constituição Federal de 1988 foram implementados. Para a concretização desse e dos
demais objetivos específicos, utilizou-se distintos procedimentos metodológicos associados a
diferentes etapas, a saber: levantamento bibliográfico, análise de processos judiciais e
realização de entrevistas com especialistas de diferentes áreas do Saber. Os resultados desse
trabalho mostram que Aracaju vem apresentando, desde 2000, um crescimento urbano
acelerado e desordenado, com diversos impactos sobre a cidade e seus habitantes, a exemplo
do crescimento da taxa de homicídios, sendo, atualmente, a maior do país. Assim, verificou-se
que o atual PDDU (2000) de Aracaju encontra-se desatualizado, há aproximados 18 (dezoito)
anos, sem cumprir a finalidade para a qual se destina, sofrendo a influência de atores sociais
que não enxergam a cidade de Aracaju como um ser que pulsa cheio de vida e que merece e

Previous issue date: 2012-09-26 / This Dissertation aims to talk about dwelling and housing, concerning social
aspects, social rights, applicability and efficiency in their environment. This project
shows the idea of Master Degree in Social Politics, knowing that it analyzes the
social function of property at the III Development Plan of Pelotas City and the way it
came to be. From the concept of social function of property, you can find a wider
concept of habitat, the right to city and urban field, how the outlook for urban
development is influencing new horizons that cover the social function of property.
The right to city, which is a relatively new issue to the Brazilian context, have a direct
influence on how the social function or property should be looked at. And this is the
reason why we should take into consideration a study of urban development,
distribution around habitable areas and ways of spatial segregation. For the last ten
years, Brazil has been going through substantial changes in the dwelling field, with
social programs for different social classes regarding buying a home or building a
home. However, the right of property and its social function remains slacked when it
comes to efficiency, even though there is an on going changing in the social
environment. This project intends to analyze how the III Development Plan of Pelotas
City dealt with not only the social function or property and preservation of the right to
city, but also the way the issues have been discussed, the way the context influences
the housing deficit in the city, and if it has been done democratically / A presente Dissertação busca como norte a moradia, a habitação,
visualizadas no aspecto social, no âmbito dos direitos sociais, aplicabilidade e
eficácia dos mesmos no meio em que se inserem. O trabalho se coaduna com a
ideia do mestrado de Política Social, tendo em vista que se volta à análise da função
social da propriedade no III Plano Diretor da cidade de Pelotas e a forma como o
mesmo restou elaborado. Ao partir-se da concepção de função social da
propriedade encontra-se amparo em um conceito mais amplo de habitat, o Direito à
Cidade e o campo urbanístico, como estas atuais visões de desenvolvimento do
espaço urbano estão influenciando nos novos horizontes que abarcam a função
social da propriedade. Tema relativamente novo no contexto brasileiro, o Direito
à Cidade influencia diretamente como a função social da propriedade deve ser
pensada, motivo pelo qual uma análise do aproveitamento urbano, distribuição em
áreas habitáveis e formas de segregação espacial devem ser levadas em
consideração. O país vem atravessando nos últimos dez anos, mudanças
substanciais no âmbito da habitação, com programas direcionados às várias classes
sociais, principalmente, no que diz respeito aos financiamentos para aquisição da
casa própria como também para construção desta. Entretanto, no que concerne ao
direito de propriedade em si e sua função social, encontra-se estagnação, ausência
de aplicação de seu conceito e muito embora haja inclusão em documentos de
planejamento urbanístico planos diretores não se encontra efetividade, apesar
da transformação constante do meio social. O presente estudo busca analisar como

Avaliar as transformações apresentadas pelo processo de Planejamento Urbano, através do instrumento do Plano Diretor, na vigência do Estatuto da Cidade é o campo em que se situa esta pesquisa; cujos resultados deverão contribuir para a discussão acerca dos alcances e limites do Plano Diretor como instrumento de planejamento urbano. De modo a formar pressupostos teóricos que fundamentem a análise dos casos, estuda-se o processo de urbanização e o histórico do planejamento urbano no Brasil; as distintas concepções assumidas pelo Plano Diretor ao longo dos anos em que se desenvolveu e consolidou a prática do planejamento urbano no Brasil; o conteúdo regulamentado pelo Estatuto da Cidade; e a região do Vale do Paraíba paulista. Previous issue date: 2008-05-30 / The enactment of the Brazilian urban law referred to as Estatuto da Cidade, or Urban Act
(Brazilian Law 10.257/2001), was a landmark in the affirmation and development of Brazilian Urban
Law. Said statute established the guidelines for urban policy, and provided for the tools aimed at
achieving the stated goals. The guideline highlighted in this paper is the fight against the speculative
retention of urban real properties. Such speculation activity most of the time stems from the
underutilization or non-utilization of the urban real property. One waits for the occasional increase in the
value of the property, often as a result of investments made by the very Public Administration, to sell it
afterwards at a price significantly higher than that at which it was bought, without having to worry about
the social harm caused by such practice, and clearly infringing the constitutional principle that provides
for the social function of the property.
This form of retaining urban real property is deleterious to urban planning, the basis of which is
the statute that introduces the municipal zoning ordinance. Such ordinance sets the criteria for the
assessment of the lawful use of urban real estate. If the property is not used in accordance with the terms
provided for by it, legal and constitutional remedies may be applied in order to compel the owner to fit his
property to the terms stipulated by the zoning ordinance, which sets the parameters for the assessment of
the regular use of urban real properties. If the property does not comply with the legal prescriptions, legal
and constitutional measures may be applied in order to compel the owner to arrange for its property to
follow the zoning ordinance legislation. Among such measures, one approached the mandatory parceling,
building, and use of urban property, the graduated real estate tax, and the expropriation paid with
government bonds, all of which are provided for in the Federal Constitution and in the Urban Act, and
grounded on the social function of property.
The main objective of this paper, however, was the analysis of the possible application of such
measures to the public urban property that fails to comply with the rules provided for by the city zoning
ordinance. For this purpose, one sought to prove, based on the Federal Constitution and the urban law, the
possibility of application of the principle that stipulates the social function of property also to public
urban real properties which fail to meet the prescriptions set by the city zoning ordinance. Finally, one
demonstrated that there are no legal reasons for the non-application of said zoning-ordinance measures to
public properties. Otherwise, one would cause the rules of urban planning to be violated and thus
prejudice the fulfillment of the social functions of the city, which is the primary objective of urban policy,
and guaranteed by the Federal Constitution / A edição do Estatuto da Cidade (Lei 10.257/2001) significou um marco para a afirmação e o
desenvolvimento do Direito Urbanístico brasileiro. Referido diploma legal estabeleceu as diretrizes
da política urbana, e previu os instrumentos para o alcance das metas traçadas. Dentre tais
diretrizes, destacou-se no presente trabalho a do combate à retenção especulativa do imóvel urbano.
Tal processo de especulação imobiliária é, no mais das vezes, levado a cabo pela subutilização ou
pela não utilização do imóvel urbano. Aguarda-se eventual valorização do bem imobiliário, muitas
vezes decorrente de investimentos realizados pelo próprio Poder Público, para aliená-lo por um
valor bem superior ao de aquisição, sem qualquer preocupação com o prejuízo social decorrente
dessa atividade, e em evidente contrariedade ao princípio constitucional da função social da
propriedade.
Essa forma de retenção do imóvel urbano é prejudicial ao planejamento urbanístico, que é
consubstanciado na lei que institui o plano diretor municipal. É o plano diretor que fixa os
parâmetros para a aferição do regular aproveitamento do imóvel urbano. Caso o bem imobiliário
não seja utilizado nos termos de suas prescrições, podem ser utilizados instrumentos previstos legal
e constitucionalmente para compelir o proprietário a adequar o seu imóvel ao que prevê a legislação
de ordenação urbana. Dentre tais instrumentos, foram abordados o parcelamento, edificação e
utilização compulsórios do imóvel urbano, o imposto predial e territorial urbano progressivo no
tempo e a desapropriação com pagamento em títulos, todos previstos na Constituição Federal e no
Estatuto da Cidade, e fundamentados no princípio da função social da propriedade.
O objeto principal do trabalho, no entanto, foi a análise da possibilidade de aplicação de tais
instrumentos à propriedade pública urbana que desatenda aos preceitos do plano diretor municipal.
Para tanto, buscou-se comprovar, com fundamento no Texto Constitucional e na legislação
urbanística, a possibilidade de aplicação do princípio da função social também à propriedade urbana
pública. Ao final, demonstrou-se que não há razões de ordem jurídica a impedir a aplicação de tais
instrumentos de ordenação urbanística à propriedade pública. Atitude em sentido contrário
significaria uma afronta ao planejamento urbano e prejudicaria a realização das funções sociais da
cidade, objetivo primordial da política urbana, garantido constitucionalmente

Previous issue date: 2010-10-28 / This paper proposes a study about the interpretation of legal provisions that establish the new regulatory framework of one of the mean legal institutions of official performance allusive to agrarian reform, that is the expropriation by social interest to the agrarian reform. This reform is also known as agrarian expropriation, especially under the perspective of the consequences of collective occupation of rural property in the process of inspection or administrative assessment, or
that is about to judge the respective action of agrarian expropriation. One concern that guided this study was to indicate the list of government initiatives to try to contain conflicts in the field, as well as to check to the most diverse jurisdictional understandings these incursions resulted. As theoretical support of this work, the normativity, the relevance of the principle of human dignity and of the nature
protection and the centrality that the principle of social function bears in the current stage of "evolution" of parental rights were analyzed. This occurred without forgetting that there was an expansion of the content, inserted in a context of class struggle, a process of flows and inflows, advances and setbacks. We sought to accomplish an interpretation
more in line with the normativity of the constitutional provisions, in view of the binding and normative force of the constitutional principles, especially of the social function of property. The intention was to resolve the apparent conflict between fundamental rights, since the balance between the respective constitutional values, aiming to achieve the right to access to land as social right, therefore, fundamental right. / O presente trabalho propõe um estudo sobre a interpretação dos dispositivos legais que constituem o novo marco normativo de um dos principais institutos jurídicos de atuação oficial alusivo à reforma agrária, que é a desapropriação por interesse social para fins de reforma agrária. Esta também é conhecida por desapropriação agrária, notadamente sob o prisma das consequências da ocupação coletiva do imóvel rural em vias de vistoria ou avaliação administrativa, ou que está por ajuizar a respectiva ação de desapropriação agrária. Uma preocupação que norteou o presente trabalho foi indicar o rol de iniciativas governamentais na tentativa de conter os conflitos no campo, bem como verificar os mais diversos entendimentos jurisdicionais que estas incursões ocasionaram. Como suporte teórico do trabalho, analisaram-se a normatividade, a relevância do princípio da dignidade da pessoa humana e da proteção à natureza e a centralidade que o princípio da função social ostenta no atual estágio
de evolução do direito pátrio. Isso sem desprezar que houve uma ampliação do conteúdo, inserido num contexto de luta de classe, num processo de fluxos e influxos, avanços e retrocessos. Buscou-se realizar uma interpretação mais consentânea com a normatividade das disposições constitucionais, numa perspectiva da força vinculante e
normativa dos princípios constitucionais, notadamente da função social da propriedade. Avaliar as transformações apresentadas pelo processo de Planejamento Urbano, através do instrumento do Plano Diretor, na vigência do Estatuto da Cidade é o campo em que se situa esta pesquisa; cujos resultados deverão contribuir para a discussão acerca dos alcances e limites do Plano Diretor como instrumento de planejamento urbano. De modo a formar pressupostos teóricos que fundamentem a análise dos casos, estuda-se o processo de urbanização e o histórico do planejamento urbano no Brasil; as distintas concepções assumidas pelo Plano Diretor ao longo dos anos em que se desenvolveu e consolidou a prática do planejamento urbano no Brasil; o conteúdo regulamentado pelo Estatuto da Cidade; e a região do Vale do Paraíba paulista. Por fim, a partir do estudo e análise do processo de elaboração e do conteúdo dos Planos Diretores de 2006 dos Municípios de São José dos Campos e Pindamonhangaba, no Vale do Paraíba paulista, compreendido nas etapas de Diagnóstico e Proposições, verifica-se em que medida o processo de Planejamento Urbano, através do instrumento do Plano Diretor, vem incorporando os princípios, diretrizes e instrumentos urbanísticos regulamentados pelo Estatuto da Cidade, em 2001; no sentido de enunciar uma nova concepção de planejamento e gestão territorial. / To evaluate the transformations presented by the process of the Urban Planning, through the instrument of the Master Plan, in the validity of the Statute of the City is the field where it is pointed this research; which results may contribute for the discussion about the reaches and limits of the Master Plan as an instrument of the urban planning. In order to form theories which base the analysis of the cases, are studied the process of the urbanization and the historic of the urban planning in Brazil; the distinct conceptions assumed for the Master Plan during the years in which was developed and consolidated the practice of the urban planning in Brazil; the content regulated by the Statute of the City; and the region of the Valley Paraíba paulista. From the study and analysis of the process of elaboration and of the content of the Master Plans 2006 from the cities of São José dos Campos and Pindamonhangaba, in the Valley Paraíba paulista, comprehended by the stages of Diagnostics and Proposals, it is verified how the process of the Urban Planning, through the instrument of the Master Plan, incorporates the principles, directives and urbanistics instruments regulated by the Statute of the City, in 2001; in order to enunciate a new conception of territorial planning and management.
