A narrative policy analysis of the challenges of land tenure reform in South Africa between 1996 and 2009 : a case study of the Labour Tenants (Labour Tenant Act No. 3 of 1996) in KwaZulu-Natal.

This study is centred on the challenges of land tenure reforms in South Africa taking a case study of the labour tenants in KwaZulu-Natal between 1996 and 2009. The study uses narrative policy analysis as a framework for understanding these challenges. Of course, the challenges around the tenure reforms cannot be discussed in isolation from the land owners and the government. Voices of the labour tenants, farmers, government and civil society are heard in this study. This study shows how policy change comes about and how instrumental stories are in bringing about change. It also specifically looked at the factors that lead to policy change. The measures put in place to bring about the needed policy change and finally the procedures and condition advanced to secure this new change in policy were examined. The study focuses on a redistributive policy, as it looks at policy transition from one regime, in which a certain group of people was disadvantaged in terms of ownership, to the next, where the previously disadvantaged are being uplifted. Stories in this study are used to show how and why change occurs in policy arenas. The study used qualitative methodology to obtain the information that was needed to answer the research question. Documents were used to source this information, which was in the form of workshop minutes, reported complaints, government legislation and policy documents such as the Labour Tenant Act No.3 of 1996, the Constitution of the Republic of South Africa, the Green Paper and the White Paper on South African Land Policy. Other documents included a report on independent research done on the relationships between farmers and labour tenants on farms in KwaZulu-Natal and the various land and agrarian reports. This study unearths the challenges of land tenure reforms in South Africa, through a narrative policy analysis technique. The study used the narratives to gain a better understanding of the policy; the story of the government in the form of the legislation enacted relating to land and the story of the people as recipients of the policy. The Labour Tenant Act No.3 of 1996 is used as the main document of reference and Association for Rural Advancement (AFRA) as the voice of civil society, not only as a source of information. In this study the voices of AFRA, labour tenants and farmers are collectively referred to as the people‟s voice. KwaZulu-Natal was used as a case study due to the high rate of labour tenants in the province as well as its history of the land conflict. The study in its final chapter refers to the difficulty of managing redistributive policies such as land reform. Déloger le peuple : l’Etat et l'administration des expulsions locatives / Evicting people : the State and the government of eviction proceedings

Chaque année, près de 165 000 ménages locataires sont assignés au tribunal par leurspropriétaires dans d'une procédure d'expulsion pour dette locative, soit plus de 1% des ménagesrésidant dans le parc locatif de France métropolitaine. Fondée sur une enquête statistique etethnographique menée dans un département populaire de région parisienne, cette thèse restitue lesinégalités de trajectoire procédurale d'un échantillon de locataires en procédure d'expulsion, en lienavec l'activité des institutions publiques chargées de recouvrir leurs créances et d'administrer cecontentieux : commissions de travail social liées au droit au logement, tribunaux d'instance, bureaudes expulsions de la préfecture et commissariats de police. Elle met tout d'abord en lumière lesconditions et la rationalité économiques spécifiques qui conduisent un nombre important deménages populaires à suspendre le paiement du loyer plutôt que de recourir à d'autres circuitsd'endettement. La thèse analyse ensuite les dispositifs de recouvrement et les usages du droit quemobilisent les propriétaires afin de recouvrir et de sanctionner les créances locatives, et letraitement que réserve l'institution judiciaire à leurs demandes et aux locataires indisciplinés. Elleétudie enfin les logiques régaliennes de l'autorisation administrative et de l'exécution, par lesservices de l’État et les acteurs publics locaux, du concours de la force publique à l'encontre desménages condamnés par le tribunal et se refusant à quitter leur logement. En définitive, la thèseanalyse l'endettement locatif comme une transaction à crédit particulière, dont les dispositifs derecouvrement et de sanction coercitive font apparaître la violence légitime de l’État comme uneinstance nécessaire à la reproduction du marché du logement, de ses normes économiques commedes inégalités de statuts résidentiels qui le structurent. / Every year, nearly 165,000 indebted tenants are summoned to French housing courtsbecause of rent arrears. This number represents more than 1% of the renter households in thecountry. Based on an inquiry, both statistical and ethnographic, which we conducted in a destituedistrict in the Parisian suburbs, this dissertation sheds light on the unequal judicial trajectories of asample of indebted tenants facing a court summons, and analyzes the activity of the publicinstitutions in charge of collecting rent debts and carrying out eviction proceedings. The study firsthighlights the specific economic rationality which leads impoverished households to suspend thepayment of their rent rather than sacrifyng other domestic expenditures or taking out other types ofcredit. The dissertation then focuses on how landlords bring the dispute to court, and identifies thefactors of the judge's ruling in evictions cases. Thirdly, the research deals with the work of the localstate “eviction bureau” employees, who deliver legal authorizations to police eviction squads toexecute the court-orderedj physical removal of the defaulting renters who refuse to vacate thepremisses. By studying rent debts collection practices and legal eviction proceedings, thisdissertation shows how the State's legitimate violence, both physical and symbolic, enables thereproduction of the rental housing market.

Considerando-se a falta de explicitação e objetivação destes pressupostos teórico-filosóficos que amparam práticas em Resolução de Problemas, objetiva-se realizar um estudo analítico acerca dos discursos que permeiam, engendram, potencializam e põem em funcionamento práticas, teorias, teorizações e outros discursos sobre a Resolução de Problemas tanto no cenário nacional quanto internacional. Para tanto, procedemos a análise do discurso, pautada pela arqueogenealogia de Michel Foucault enquanto uma caixa de ferramentas, para compor uma análise com o corpus desta pesquisa, que consiste em entrevistas, questionários, artigos, livros, teses, dissertações e demais materiais acadêmicos. Uma questão diretriz a ser trabalhada nessa tessitura é: Como e quais pressupostos filosóficos operam, tessem ou põem em funcionamento discursos presentes nas pesquisas em Resolução de Problemas? Bem como seus desdobramentos sobre práticas discursivas relacionadas ao tema. Desse modo, observamos que há momentos, movimentos, práticas e discursos que possuem uma fundamentação teórica bastante consistente com os pressupostos filosóficos que lhes dão suporte. Por outro lado, há aqueles que não têm preocupações críveis com a teoria, residindo na práxis enquanto eixo estruturador de suas práticas em Resolução de Problemas. Há situações em que a Resolução de Problemas aproxima-se da égide de uma metodologia, enquanto que, em outro panorama, ela pode ser concebida como algo mais amplo e complexo, que visa dar conta de campos, elementos e conceitos problemáticos como: sujeito, objeto (matemático), sociedade, Educação Matemática, fazer e/ou ter ciência, valores, conhecimento (matemático), pedagogia, didática, enfim, uma gama de assuntos podem ser trabalhados sob essa perspectiva, aproximando-a de uma Filosofia da Educação Matemática. Isso permite inferir de alguma forma que, para entender-se a Resolução de Problemas, com seus princípios, bases e propostas de pesquisa educativa e educacional, faz-se extremamente necessário entender-se seus pressupostos teóricos, pois são eles que lhe darão o tom de algo restrito ou amplo, uma metodologia ou uma filosofia. Contudo, tal concepção será sempre local e regional, sendo ela validada e legitimada pela comunidade que a pratica. / Problem Solving practices are problematized in this research in the form of a “tessiture” . They are articulated around an analytical study on the subject of Problem Solving and its philosophical tenants. Considering the lack of conceptual understanding of the theoretical - philosophical presuppositions that bear on practices in Problem Solving, we aim to carry out an analytical study of the discourses th at permeate, engender and potentiate elements as: practices , theories, theorizations and other discourses on Problem Solving both on the national and international scene , besides running them . In order to do so, we proceeded to Michel Foucault’s discourse analysis based on archaeogenealogy, as a tool box, to compose an analysis with the corpus of this research, which consists of interviews, questionnaires, articles, books, theses, dissertations and other academic materials. A guiding question to be addressed in this “ tessiture” is: How and which philosophical presuppositions work or running discourses present in the researches in Problem Solving? As well as its implications on discursive practices related to the theme. Thus, we observe that there are moments, movements, practices and discourses that have a theoretical foundation very consistent with the philosophical tenants that support them. On the other hand, there are those who do not have credible concerns with theory, residing in praxis as the structuring axis of their practices in Problem Solving. There are situations in which Problem Solving fits into the aegis of a methodology . In another scenario , it can be conceived as something broader and more complex, which aims to deal with problematic fields, elements and concepts such as subject, mathematical objects, pedagogy, mathematical knowledge, society, didactics, finally, a range of subjects can be worked from this perspective, approaching it of a Philosophy of Mathematics Education. This allows us to infer, in some way, that in order to understand Problem Solving with its principles, bases and proposals for research, educational and educative practice , it is extremely necessary to understand its theoretical presuppositions, because that will give the tone of something restricted or broad, a methodology or a philosophy. However, such a conception will always be local and regional, being validated and legitimized by the community that practices it.

I Sverige har distansarbete blivit allt vanligare, vilket har resulterat i fler tomma ytor på kontor. Ekonomiska fluktuationer och pandemin har också visat att behovet och efterfrågan på kontorsutrymme kan variera betydligt, vilket skapar samhällsekonomiska problem genom vakanta kontorslokaler. Därför behövs det lösningar för att göra kontorslokaler mer attraktiva för användare. Genom att förstå hyresgästers preferenser kan fastighetsägare anpassa sina lokaler för att erhålla hyresgästernas lojalitet. Målet med undersökningen är att ta reda på deras förväntningar och preferenser när det gäller kontorslokaler i Sverige. De faktorer som primärt undersöks inkluderar läge/tillgänglighet, arbetsmiljö, kontorsutformning och externa faktorer som pandemin. Vårt arbete fokuserar på att sammanfatta hyresgästers preferenser för att bidra till utvecklingen av kontor och göra dem mer attraktiva i Sverige. Denna studie undersöker sex olika hyresgästers preferenser för kontorslokaler i Malmö, i kombination med tidigare forskning om ämnet. Vid val av metod för datainsamling har vi även fokuserat på semistrukturerade intervjuer. Resultaten visar att hyresgästerna generellt hade liknande preferenser, inklusive läge/tillgänglighet, arbetsmiljö och anpassning till hyresgästens verksamhet. En bra inomhusmiljö och funktionella kontor var också viktiga faktorer för de flesta. Innovation och flexibla utrymmen betraktades som optimala för dagens arbetsplatser, och en effektiv kontorsutformning bör möjliggöra flexibilitet samtidigt som den säkerställer koncentration och integritet för alla anställda. Dock kan preferenser påverkas av både interna och externa faktorer, inklusive en osäker ekonomisk situation och pandemins konsekvenser. / In Sweden, remote work has become increasingly common, leaving more empty spaces in offices. Economic fluctuations and the pandemic have also demonstrated that the need and demand for office space can vary significantly, causing socio-economic problems through vacant office spaces. Therefore, solutions are needed to make office spaces more attractive to users. By understanding tenants' preferences, property owners can adapt their premises to obtain tenants' loyalty. The aim of the survey is to find out their expectations and preferences regarding office spaces in Sweden. Factors primarily examined include location/accessibility, work environment, office layout, and external factors such as the pandemic. Our work focuses on summarizing tenants' preferences to contribute to the development of offices and make them more attractive in Sweden. This study examines six different tenants' preferences for office spaces in Malmö, in combination with previous research on the subject. In selecting the approach for data collection, we have also focused on semi-structured interviews. The results show that tenants generally had similar preferences, including location/accessibility, work environment, and adaptation to the tenant's business. A good indoor environment and functional offices were also important factors for most. Innovation and flexible spaces were considered optimal for today's workplaces, and an efficient office layout should enable flexibility while ensuring concentration and privacy for all employees. However, preferences can be influenced by both internal and external factors, including an uncertain economic situation and pandemic consequences.
